Artigo 27.°
Competência
Compete ao Conselho Superior do Ministério Público:
Nomear, colocar, transferir, promover, exonerar, apreciar o mérito profissional, exercer a acção disciplinar e, em geral, praticar todos os actos de idêntica natureza respeitantes aos magistrados do Ministério Público, com excepção do Procurador-Geral da República;
Aprovar o regulamento eleitoral do Conselho, o regulamento interno da Procuradoria-Geral da República, o regulamento previsto no n.º 4 do artigo 134.º e a proposta do orçamento da Procuradoria-Geral da República;
Deliberar e emitir directivas em matéria de organização interna e de gestão de quadros;
Propor ao Procurador-Geral da República a emissão de directivas a que deve obedecer a actuação dos magistrados do Ministério Público;
Propor ao Ministro da Justiça, por intermédio do Procurador-Geral da República, providências legislativas com vista à eficiência do Ministério Público e ao aperfeiçoamento das instituições judiciárias;
Conhecer das reclamações previstas nesta lei;
Aprovar o plano anual de inspecções e determinar a realização de inspecções, sindicâncias e inquéritos;
Emitir parecer em matéria de organização judiciária e, em geral, de administração da justiça;
Exercer as demais funções que lhe sejam atribuídas por lei. | Translation - Romanian
Articolul 27.
Competenţe
Consiliul Superior al Ministerului Public are următoarele competenţe:
Numirea, transferul, promovarea, exonerarea, aprecierea meritelor profesionale, exercitarea acţiunilor disciplinare şi efectuarea, în general, a tuturor actelor de aceeaşi natură privitoare la magistraţii Ministerului Public, cu excepţia Procurorului General al Republicii;
Aprobarea regulamentului electoral al Consiliului, a regulamentului intern al Procuraturii Generale a Republicii, a regulamentului prevăzut la punctul 4, articolul 134 şi a propunerii de buget pentru Procuratura Generală a Republicii;
Deliberarea şi elaborarea de directive în materie de organizare internă şi gestiunea personalului;
Înaintarea către Procurorul General al Republicii de propuneri privind emiterea de directive care să reglementeze activitatea magistraţilor Ministerului Public;
Înaintarea către Ministrul Justiţiei, prin intermediul Procurorului General al Republicii, de propuneri de măsuri legislative în vederea eficientizării Ministerului Public şi a perfecţionării instituţiilor judiciare;
Cunoaşterea reclamaţiilor prevăzute în prezenta lege;
Aprobarea planului anual de inspecţii şi hotărârea realizării de inspecţii, investigaţii şi anchete;
Elaborarea de avize în legătură cu organizarea judiciară şi, în general, cu administrarea justiţiei;
Exercitarea celorlalte funcţiuni conferite prin lege. |
