3. Per l’esercizio dell’attività di offerta fuori sede di strumenti finanziari e servizi di investimento, i soggetti di cui al comma 2 si avvalgono di dipendenti o di promotori finanziari.
Art. 25
(Promotori finanziari)
1. E’ promotore finanziario la persona fisica che, in qualità di agente o mandatario, esercita professionalmente l’attività di offerta fuori sede.
2. Il soggetto che conferisce l’incarico è responsabile in solido dei danni arrecati a terzi dal promotore finanziario nell’espletamento dell’agenzia o del mandato ricevuto.
3. E' istituito presso l’autorità di vigilanza il registro pubblico dei promotori finanziari.
4. L’autorità di vigilanza determina i requisiti di onorabilità e di professionalità per l'iscrizione al registro di cui al comma 3. I requisiti di professionalità per l'iscrizione all'albo sono accertati sulla base di criteri valutativi che tengono conto della pregressa esperienza professionale, validamente documentata, ovvero sulla base di prove valutative indette dall’autorità di vigilanza.
5. L’autorità di vigilanza può disciplinare procedimenti semplificati, per l’iscrizione al registro di cui al comma 3, dei soggetti già sottoposti a controllo da parte di autorità di vigilanza estere.
6. Il registro di cui al comma 3 è pubblico e può essere tenuto in modo informatizzato

2. The supervisory authority will determine the parties that may engage in the out-of-office canvassing of financial instruments and/or investment services.
3. In engaging in the out-of-office canvassing of financial instruments and investment services, the parties referred to in paragraph 2 above will avail themselves of employees or financial promoters.
Article 25
(Financial promoters)
1. A financial promoter is a natural person who, acting as an agent or authorised representative, is professionally engaged in out-of-office activities.
2. The party conferring the appointment will be jointly liable for prejudice caused to third parties by the financial promoter in the performance of the agency activity or the mandate received.
3. A public register of financial promoters will be set up and maintained by the supervisory authority.
4. The supervisory authority will determine the requirements of good repute and professionalism for entry in the register referred to in paragraph 3. The requirements of professionalism for entry in the list will be ascertained in the light of assessment criteria taking account of duly documented prior professional experience or on the basis of assessment tests organised by the supervisory authority.
5. The supervisory authority may establish simplified procedures for the entry in the register, referred to in paragraph 3, of parties that have already been monitored by foreign supervisory authorities.
6. The register referred to in paragraph 3 will be public and will be computerised
