ECONOMICO, DI CONCERTO CON IL MINISTRO DELL’AMBIENTE E
DELLA TUTELA DEL TERRITORIO E DEL MARE 19 FEBBRAIO 2007, AI
FINI DELL’INCENTIVAZIONE DELLA PRODUZIONE DI ENERGIA
ELETTRICA MEDIANTE IMPIANTI FOTOVOLTAICI
L’AUTORITA' PER L’ENERGIA ELETTRICA E IL GAS
Nella riunione dell’11 aprile 2007
Visti:
• la legge 14 novembre 1995, n. 481;
• il decreto legislativo 29 dicembre 2003, n. 387 (di seguito: decreto legislativo n.
387/03);
• la legge 23 agosto 2004, n. 239 (di seguito: legge n. 239/04);
• il decreto del Ministro delle Attività Produttive, di concerto con il Ministro
dell’Ambiente e della Tutela del Territorio 28 luglio 2005, come integrato e
modificato dal decreto ministeriale 6 febbraio 2006 (di seguito: decreto ministeriale 28
luglio 2005);
• il decreto del Ministro delle Attività Produttive, di concerto con il Ministro
dell’Ambiente e della Tutela del Territorio 6 febbraio 2006 (di seguito: decreto
ministeriale 6 febbraio 2006);
• il decreto del Ministro dello Sviluppo Economico, di concerto con il Ministro
dell’Ambiente e della Tutela del Territorio e del Mare 19 febbraio 2007, recante
“Criteri e modalità per incentivare la produzione di energia elettrica mediante
conversione fotovoltaica della fonte solare, in attuazione dell’articolo 7 del decreto
legislativo 29 dicembre 2003” (di seguito: decreto ministeriale 19 febbraio 2007);
• il Testo integrato delle disposizioni dell’Autorità per l’energia elettrica e il gas (di
seguito: l’Autorità) per l’erogazione dei servizi di qualità dei servizi di distribuzione,
misura e vendita dell’energia elettrica per il periodo di regolazione 2004-2007,
allegato alla deliberazione dell’Autorità 30 gennaio 2004, n. 4/04, e sue successive
modifiche e integrazioni (di seguito: Testo integrato della qualità);
• il Testo integrato delle disposizioni dell’Autorità per l’erogazione dei servizi di
trasmissione, distribuzione, misura e vendita dell’energia elettrica per il periodo di
regolazione 2004-2007 e disposizioni in materia di contributi di allacciamento e diritti
fissi, allegato alla deliberazione dell’Autorità 30 gennaio 2004, n. 5/04, e sue
successive modifiche e integrazioni (di seguito: Testo integrato);
• la deliberazione dell’Autorità 14 settembre 2005, n. 188/05, e sue successive
modifiche e integrazioni (di seguito: deliberazione n. 188/05);
• la deliberazione dell’Autorità 19 dicembre 2005, n. 281/05, e sue successive
modifiche e integrazioni (di seguito: deliberazione n. 281/05);
• la deliberazione dell’Autorità 10 febbraio 2006, n. 28/06, e sue successive modifiche e
integrazioni (di seguito: deliberazione n. 28/06);
• la deliberazione dell’Autorità 11 aprile 2007, n. 88/07 (di seguito: deliberazione n.
88/07);
• la deliberazione dell’Autorità 11 aprile 2007, n. 89/07 (di seguito: deliberazione n.
89/07);
• la lettera dell’Enea del 2 aprile 2007, prot. n. ENEA/2007/19320/ACS (prot. Autorità
n. 8676 del 4 aprile 2007).
Considerato che:
• l’articolo 5, comma 2, del decreto ministeriale 19 febbraio 2007 prevede che
l’Autorità definisca:
• le modalità e le tempistiche secondo le quali il gestore di rete comunica il
punto di consegna ed esegue la connessione di un impianto fotovoltaico alla
rete elettrica, prevedendo penali nel caso di mancato rispetto;
• le modalità con le quali le condizioni di cui al precedente alinea si applicano
anche agli impianti che hanno acquisito il diritto alle tariffe incentivanti ai
sensi dei decreti ministeriali 28 luglio 2005 e 6 febbraio 2006;
• l’articolo 10, comma 1, del decreto ministeriale 19 febbraio 2007 prevede che
l’Autorità aggiorni i provvedimenti emanati in attuazione dei decreti ministeriali 28
luglio 2005 e 6 febbraio 2006, al fine di stabilire le modalità, i tempi e le condizioni
per l’erogazione delle tariffe incentivanti di cui all’articolo 6 del decreto ministeriale
19 febbraio 2007 (di seguito: tariffe incentivanti) e del premio di cui all’articolo 7 del
predetto decreto ministeriale (di seguito: premio); e che l’articolo 5, comma 4, del
decreto ministeriale 19 febbraio 2007 stabilisce che, nell’ambito del predetto
aggiornamento, l’Autorità possa stabilire ulteriori condizioni rispetto a quelle stabilite
dal medesimo decreto;
• l’articolo 10, comma 2, del decreto ministeriale 19 febbraio 2007 prevede che
l’Autorità determini le modalità con le quali le risorse per l’erogazione delle tariffe
incentivanti e del premio, nonché per la gestione delle attività previste dal medesimo
decreto, trovano copertura nel gettito della componente tariffaria A3.
Considerato che:
• la deliberazione n. 281/05 e la deliberazione n. 89/07 definiscono le condizioni per
l’erogazione del servizio di connessione alle reti elettriche i cui gestori hanno obbligo
di connessione di terzi a tensione nominale, rispettivamente, superiore ad 1 kV e
minore o uguale ad 1 kV, stabilendo, inoltre:
a. disposizioni particolari per la connessione degli impianti di produzione di
energia elettrica da fonti rinnovabili, in coerenza con quanto previsto
dall’articolo 14 del decreto legislativo n. 387/03;
b. forme di indennizzo automatico verso il soggetto richiedente la connessione
nel caso di mancato rispetto delle tempistiche definite per la comunicazione del
punto di consegna e per l’esecuzione dei lavori di connessione;
• le deliberazioni di cui al precedente alinea risultano applicabili anche per la
connessione alla rete di impianti fotovoltaici e sono coerenti con quanto previsto
dall’articolo 5, comma 2, del decreto ministeriale 19 febbraio 2007;
• con la deliberazione n. 88/07, l’Autorità ha introdotto disposizioni inerenti il servizio
di misura dell’energia elettrica prodotta, definendo le responsabilità e le modalità di
erogazione del medesimo servizio;
• la deliberazione di cui al precedente alinea è funzionale alla misura dell’energia
elettrica avente diritto alle tariffe incentivanti;
• l’Enea, con lettera del 2 aprile 2007, ha manifestato l’esigenza di disporre di alcuni
dati relativi agli impianti fotovoltaici ai fini del monitoraggio di cui all’articolo 15 del
decreto ministeriale 19 febbraio 2007, indicando altresì la stima dei costi da sostenere
per il medesimo monitoraggio nel triennio 2007-2009.
Ritenuto opportuno:
• dare attuazione alle disposizioni di cui all’articolo 5, comma 2, del decreto
ministeriale 19 febbraio 2007, relativamente alle condizioni per la connessione alla
rete di impianti fotovoltaici, facendo riferimento alle disposizioni di cui alla
deliberazione n. 281/05 e di cui alla deliberazione n. 89/07;
• definire, ai sensi dell’articolo 5, comma 2, del decreto ministeriale 19 febbraio 2007 le
modalità secondo cui le condizioni previste dalle deliberazioni richiamate al
precedente alinea, con particolare riferimento agli indennizzi automatici, si applichino
anche ai soggetti responsabili che abbiano acquisito il diritto alle tariffe incentivanti ai
sensi dei decreti ministeriali 28 luglio 2005 e 6 febbraio 2006;
• dare attuazione alle disposizioni di cui all’articolo 10, comma 1, del decreto
ministeriale 19 febbraio 2007 definendo ulteriori condizioni secondo quanto previsto
dall’articolo 5, comma 4, del predetto decreto ministeriale, ai fini di garantire certezza,
equità di trattamento e non discriminazione a tutti i soggetti responsabili che
intendono usufruire delle tariffe incentivanti e del premio previsti dal medesimo
ministeriale 19 febbraio 2007;
• prevedere, in particolare:
a. per quanto concerne l’accesso alle tariffe incentivanti, che il soggetto
responsabile dell’impianto fotovoltaico debba dichiarare, sotto la propria
responsabilità, di rispettare i requisiti per l’ammissibilità alla tariffa
incentivante previsti dal decreto ministeriale 19 febbraio 2007, nonché:
i. di essere proprietario dell’immobile ove è installato l’impianto o,
diversamente, disporre dell’autorizzazione sottoscritta dal proprietario,
o dai proprietari, di tale immobile, qualora detto proprietario/i sia/siano
diverso/i dal soggetto responsabile;
ii. di aver conseguito tutte le autorizzazioni necessarie alla costruzione e
all’esercizio dell’impianto, nel rispetto dei vincoli architettonici e
paesaggistici, della normativa esistente in materia di sicurezza durante
le attività di costruzione ed esercizio dell’impianto e dei relativi
allacciamenti.
b. per quanto concerne l’ammissione al premio, che il soggetto responsabile
dell’impianto fotovoltaico debba dichiarare, sotto la propria responsabilità, di
rispettare i requisiti per l’ammissibilità al premio previsti dal decreto
ministeriale 19 febbraio 2007;
c. per quanto concerne la gestione dell’impianto fotovoltaico, che il soggetto
responsabile sia tenuto al rispetto dei seguenti obblighi:
i. non alterare le caratteristiche di targa delle apparecchiature di misura e
non modificare i dati di misura registrati dalle medesime;
ii. consentire l’accesso all’impianto e alle relative infrastrutture, comprese
quelle di misura dell’energia elettrica prodotta, al soggetto attuatore e
agli altri soggetti di cui il soggetto attuatore può avvalersi per
l’espletamento delle attività di verifica e controllo;
iii. inviare annualmente al soggetto attuatore la documentazione che attesti
il possesso, per l’anno precedente, dei requisiti per acquisire il titolo di
autoproduttore di cui all’articolo 2, comma 2, del decreto legislativo n.
79/99 ai fini dell’erogazione dell’incremento alla tariffa incentivante di
cui all’articolo 6, comma 4, del decreto ministeriale 19 febbraio 2007,
pena il mancato riconoscimento del medesimo incremento;
iv. comunicare al soggetto attuatore il/i nuovo/i numero/i di matricola a
sostituzione di quello/i precedente/i, nel caso in cui uno o più pannelli
e/o convertitori della corrente continua in corrente alternata che
compongono l’impianto, a seguito di danni o avarie non riparabili e che
ne rendano necessaria la sostituzione, venga/vengano sostituito/i con
altri di pari potenza;
d. per quanto concerne l’effettuazione delle verifiche e dei controlli di cui
all’articolo 11 del decreto ministeriale 19 febbraio 2007, di prevedere che il
soggetto attuatore possa effettuare verifiche di carattere documentale e di
carattere tecnico-impiantistico avvalendosi eventualmente della collaborazione
di soggetti terzi abilitati e/o enti di ricerca, di certificazione e/o istituti
universitari qualificati nel settore specifico, informando l’Autorità;
• dare attuazione alle disposizioni di cui all’articolo 10, comma 2, del decreto
ministeriale 19 febbraio 2007, definendo le modalità con le quali le risorse per
l’erogazione delle tariffe incentivanti e del premio, nonché per la gestione delle attività
previste dal medesimo decreto, trovano copertura nel Conto per nuovi impianti da
fonti rinnovabili e assimilate alimentato dalla componente tariffaria A3;
• prevedere che i soggetti responsabili di impianti fotovoltaici che hanno diritto alle
tariffe incentivanti trasmettano al soggetto attuatore anche i dati richiesti dall’Enea ai
fini del monitoraggio di cui all’articolo 15, comma 1, del decreto ministeriale 19
febbraio 2007;
• prevedere che, al fine di consentire il monitoraggio previsto dall’articolo 15, comma 1,
del decreto ministeriale 19 febbraio 2007, l’Enea, coordinandosi con il soggetto
attuatore, individui un opportuno insieme di soggetti responsabili pubblici, i quali
sono tenuti a consentire all’Enea l’installazione di sistemi di rilevamento e
comunicazione dati per il monitoraggio tecnologico a distanza delle prestazioni degli
impianti fotovoltaici
DELIBERA
1. di approvare le disposizioni attuative del decreto del Ministro dello Sviluppo
Economico, di concerto con il Ministro dell’Ambiente e della Tutela del Territorio e
del Mare 19 febbraio 2007, ai fini dell’incentivazione della produzione di energia
elettrica mediante impianti fotovoltaici, riportate in allegato (Allegato A) al presente
provvedimento, di cui forma parte integrante e sostanziale;
2. di stabilire, ai sensi dell’articolo 5, comma 2, del decreto ministeriale 19 febbraio 2007
che, per i soggetti responsabili che hanno acquisito il diritto alle tariffe incentivanti ai
sensi dei decreti ministeriali 28 luglio 2005 e 6 febbraio 2006 i cui impianti non sono
ancora stati connessi alla rete elettrica:
• in caso di connessioni a reti elettriche a tensione nominale:
a. inferiore o uguale ad 1 kV, si applichino le disposizioni di cui
all’articolo 9, commi 9.2, 9.3, 9.4 e 9.5 dell’Allegato A alla
deliberazione n. 89/07, assumendo:
i. il tempo di messa a disposizione del preventivo per la
connessione pari al tempo di cui all’articolo 8, comma 2, del
decreto ministeriale 28 luglio 2005;
ii. il tempo di realizzazione della connessione pari al tempo di cui
all’articolo 8, comma 3, ultimo periodo del decreto ministeriale
28 luglio 2005;
b. maggiore di 1 kV, si applichi quanto previsto dall’articolo 14, comma
14.1, dell’Allegato A alla deliberazione n. 281/05 assumendo i tempi di
realizzazione degli impianti e degli interventi di cui all’articolo 8,
comma 8.2, lettere a. e b., della medesima deliberazione pari al tempo
di cui all’articolo 8, comma 3, ultimo periodo, del decreto ministeriale
28 luglio 2005;
• nel caso in cui la data di ricevimento da parte dell’impresa distributrice della
richiesta di connessione di cui all’articolo 8, comma 1, del decreto ministeriale
28 luglio 2005 sia antecedente all’entrata in vigore della presente deliberazione
e l’impresa distributrice non abbia ancora comunicato il punto di consegna, il
tempo di messa a disposizione del preventivo come definito alla precedente
lettera a), punto i., decorre a partire dal primo giorno del mese successivo alla
data di entrata in vigore del presente provvedimento;
• nel caso in cui la data di ricevimento da parte dell’impresa distributrice della
comunicazione di conclusione dei lavori di cui all’articolo 8, comma 3,
secondo periodo, del decreto ministeriale 28 luglio 2005, sia antecedente
all’entrata in vigore della presente deliberazione, e l’impianto non è ancora
stato connesso, il tempo di cui alla precedente lettera a), punto ii., e lettera b)
decorrono a partire dal primo giorno del mese successivo alla data di entrata in
vigore del presente provvedimento;
3. di prevedere, ai sensi dell’articolo 5, comma 2, del decreto ministeriale 19 febbraio
2007 e in alternativa al precedente punto 2., che i soggetti responsabili di impianti che
hanno acquisito il diritto alle tariffe incentivanti ai sensi dei decreti ministeriali 28
luglio 2005 e 6 febbraio 2006 possano richiedere la connessione alle reti elettriche con
obbligo di connessione di terzi ai sensi della deliberazione n. 281/05 o della
deliberazione n. 89/07. In tal caso decade l’eventuale precedente richiesta e si applica
quanto previsto dalle deliberazioni richiamate, anziché quanto previsto dall’articolo 8,
commi 2 e 3, ultimo periodo, del decreto ministeriale 28 luglio 2005. Qualora il
soggetto responsabile abbia già versato acconti all’impresa distributrice competente
per la realizzazione della connessione, tali acconti devono essere considerati validi ai
fini della nuova richiesta di connessione;
4. di abrogare l’articolo 3, commi 3.1, 3.2, 3.3 e 3.4, della deliberazione n. 188/05, oltre
che l’Allegato A alla medesima deliberazione;
5. di trasmettere il presente provvedimento al Ministro dello Sviluppo Economico, al
Ministro dell’Ambiente e della Tutela del Territorio e del Mare, alla società Gestore
dei servizi elettrici S.p.A. e alla Cassa conguaglio per il settore elettrico;
6. di pubblicare il presente provvedimento sulla Gazzetta Ufficiale della Repubblica
italiana e sul sito internet dell’Autorità (www.autorita.energia.it), affinché entri in
vigore dalla data di pubblicazione | Translation - English

IMPLEMENTATION OF THE FEBRUARY 19, 2007 DECREE OF THE MINISTER OF ECONOMIC DEVELOPMENT, JOINTLY WITH THE MINISTER FOR THE ENVIRONMENT AND THE PROTECTION OF LAND AND SEA, FOR PURPOSES OF CREATING INCENTIVES TO PRODUCE ELECTRICAL ENERGY THROUGH PHOTOVOLTAIC SYSTEMS
THE AUTHORITY FOR ELECTRICAL ENERGY AND GAS
In a meeting held on April 11, 2007
In consideration of:
• Law 481 of November 14, 1995
• Legislative Decree no. 387 of December 29, 2003 (hereinafter referred to as Legislative Decree no. 387/03)
• Law no. 239 of August 23, 2004 (hereinafter referred to as Law no. 239/04)
• the decree of the Minister of Production Activities, jointly with the Minister of the Environment and the Protection of Land and Sea dated July 28, 2005, as supplemented and amended by the Ministerial Decree of February 6, 2006 (hereinafter referred to as the Ministerial Decree of July 28, 2005)
• the decree of the Minister of Production Activities, jointly with the Minister of the Environment and the Protection of Land dated February 6, 2006 (hereinafter referred to as the Ministerial Decree of February 6, 2006)
• the decree of the Minister of Economic Development, jointly with the Minister of the Environment and the Protection of Land and Sea dated February 19, 2007, indicating “Criteria and procedures to create incentives for the production of electrical energy through photovoltaic conversion of solar energy, in implementation of Article 7 of the Legislative Decree of December 29, 2003” (hereinafter referred to as the Ministerial Decree of February 19, 2007)
• the amended text of the provisions of the Authority for Electrical Energy and Gas (hereinafter referred to as the Authority) for the provision of quality services by services that distribute, meter, and sell electrical energy for the 2004-2007 regulatory period, attached to the Authority’s resolution no. 4/04 dated January 30, 2004, and its subsequent amendments (hereinafter referred to as the Amended Text on Quality)
• the amended text of the Authority’s provisions on supplying transmission, distribution, metering, and sales services for electrical energy for the 2004-2007 regulatory period and provisions on hook-up charges and set fees, attached to the Authority’s resolution no. 5/04 dated January 30, 2004, and its subsequent amendments (hereinafter referred to as the Amended Text)
• the Authority’s resolution no. 188/05 dated September 14, 2005 and its subsequent amendments (hereinafter referred to as resolution no. 188/05)
• the Authority’s resolution no. 281/05 dated December 19, 2005 and its subsequent amendments (hereinafter referred to as resolution no. 281/05)
• the Authority’s resolution no. 28/06 dated February 10, 2006 and its subsequent amendments (hereinafter referred to as resolution no. 28/06)
• the Authority’s resolution no. 88/07 dated April 11, 2007 (hereinafter referred to as resolution no. 88/07)
• the Authority’s resolution no. 89/07 dated April 11, 2007 (hereinafter referred to as resolution no. 89/07)
• the letter from ENEA (the national agency for new technology, energy, and the environment) dated April 2, 2007, prot. no. ENEA/2007/19320/ACS (Authority protocol no. 8676 of April 4, 2007)
Considering that:
• Article 5, paragraph 2 of the Ministerial Decree of February 19, 2007 provides that the Authority must determine:
• the procedures and time frames that the network operator must follow to indicate the point of delivery and hook up a photovoltaic system to the electrical grid, providing penalties for non-compliance
• the procedures by which the conditions set out in the previous clause also become applicable to systems which have acquired the right to incentive rates pursuant to the ministerial decrees of July 28, 2005 and February 6, 2006
• Article 10, paragraph 1 of the Ministerial Decree of February 19, 2007 provides that the Authority must update the provisions issued in implementation of the ministerial decrees of July 28, 2005 and February 6, 2006, for purposes of establishing the procedures, time frames, and conditions for granting the incentive rates indicated in Art. 6 of the Ministerial Decree of February 19, 2007 (hereinafter referred to as the incentive rates) and the premium indicated in Article 7 of said ministerial decree (hereinafter referred to as the premium); and that Article 5, paragraph 4 of the Ministerial Decree of February 19, 2007 provides that when making said update, the Authority may establish conditions in addition to those established by said decree
• Article 10 paragraph 2 of the Ministerial Decree of February 19, 2007 requires the Authority to determine the methods by which the resources needed to pay the incentive rates and premium, as well as manage the activities set forth by said decree, will be covered by proceeds from the A3 rate component.
Considering that:
• Resolution no. 281/05 and resolution no. 89/07 determine the conditions for providing the grid hookup service when grid operators are required, respectively, to connect third parties to rated voltage greater than 1 kV and rated voltage less than or equal to 1 kV, and also establishes:
a. special provisions for connecting systems that produce electrical energy from renewable sources, consistent with the provisions of Article 14 of Legislative Decree no. 387/03
b. forms of automatic indemnification for parties who request a hook-up, in case of failure to comply with required deadlines for indicating the point of delivery and completing the hook-up work
• the resolutions indicated in the above clause shall also be applicable to hook-ups to the network of photovoltaic systems and are consistent with the provisions of Article 5, paragraph 2 of the Ministerial Decree of February 19, 2007
• by means of resolution no. 88/07, the Authority introduced provisions regarding the service for metering electrical energy produced and established responsibilities and procedures for providing said service
• the resolution in the above clause is based on metering electrical energy with the right to incentive rates
• in a letter dated April 2, 2007, ENEA indicated the need for data on photovoltaic systems for purposes of monitoring pursuant to Article 15 of the Ministerial Decree of February 19, 2007, and also indicated an estimate of the costs that would be incurred for said monitoring during the three year period from 2007-2009
Considering it appropriate:
• to implement the provisions of Article 6, paragraph 2 of the Ministerial Decree of February 19, 2007 regarding conditions for connection to the network of photovoltaic systems, with reference to the provisions of resolution no. 281/05 and resolution no. 89/07
• pursuant to Article 5, paragraph 2 of the Ministerial Decree of February 19, 2007, to determine procedures that will also make the conditions indicated in the aforementioned resolutions, in particular automatic indemnification, applicable to responsible parties who have acquired the right to the incentive rates pursuant to the ministerial decrees of July 28, 2005 and February 6, 2006
• to implement the provisions of Article 10, paragraph 1 of the Ministerial Decree of February 19, 2007, establishing additional conditions as provided by Article 5, paragraph 4 of said Ministerial Decree, for purposes of guaranteeing certainty, equitable treatment, and non-discrimination to all responsible parties who intend to take advantage of the incentive rates and premium provided by said Ministerial Decree of February 19, 2007
• in particular, to provide:
a. with regard to access to incentive rates, that the party responsible for the photovoltaic system must declare, under his own responsibility, that he has complied with the eligibility requirements to receive the incentive rate provided by the Ministerial Decree of February 19, 2007, and:
i. that he is the owner of the building where the system is installed, or if not, to obtain an authorization signed by the owner or owners of said building, if said owner or owners are different from the responsible party
ii. that he has obtained all necessary authorizations for the construction and operation of the system, complying with architectural and landscaping restrictions, and existing regulations on safety during construction and operation of the system and the relative hook-ups
b. with regard to eligibility for the premium, that the responsible party must declare, under his own responsibility, that he has complied with the eligibility requirements to receive the premium provided by the Ministerial Decree of February 19, 2007
c. with regard to management of the photovoltaic system, that the responsible party must comply with the following obligations:
i. not to alter the rating plate characteristics for the metering equipment and not to change the metering data it records
ii. to permit access to the system and relative infrastructures, including those for metering the electrical energy produced, to the implementing party and other parties the implementing party may use to perform audits and controls
iii. to annually send the implementing party documents that attest that, for the previous year, he met the requirements to be recognized as an autoproducer pursuant to Article 2, paragraph 2 of Legislative Decree no. 79/99 for purposes of increasing the incentive rate set forth in Article 6, paragraph 4 of the Ministerial Decree of February 19, 2007, or said increase will not be approved
iv. to advise the implementing party of the new serial number or numbers replacing the old one/s, if one or more of the system’s panels or converters of direct current to alternating current have been irreparably damaged or malfunctioned and have therefore been replaced by others with the same power
d. with regard to performing audits and controls pursuant to Article 11 of the Ministerial Decree of February 19, 2007, to provide that the implementing party may audit documents and perform technical-system design audits, if necessary with the assistance of qualified third parties and/or research or certification bodies and/or universities which are qualified in the specific sector, and to inform the Authority of such
• to implement the provisions of Article 10, paragraph 2 of the Ministerial Decree of February 19, 2007, determining the methods by which the financial resources used to pay incentive rates and the premium, as well as manage the activities provided by said decree, are covered by the Account for new systems from renewable sources and similar systems funded by rate component A3
• to provide that responsible parties for photovoltaic systems eligible for the incentive rates must also send the implementing party the data ENEA requests for monitoring purposes as provided in Article 15, paragraph 1 of the Ministerial Decree of February 19, 2007
• to provide that, for monitoring purposes as provided by Article 15, paragraph 1 of the Ministerial Decree of February 19, 2007, ENEA, in coordination with the implementing party, shall identify an appropriate group of public responsible parties who must permit ENEA to install data reporting and communication systems for remote technological monitoring of the performance of the photovoltaic systems
IT IS HEREBY RESOLVED
1. to approve the implementing provisions of the Decree of the Minister of Economic Development, jointly with the Minister for the Environment and the Protection of Land and Sea, dated February 19, 2007, for purposes of providing incentives to produce electrical energy through photovoltaic systems, as reported in the attachment (Attachment A) to this provision, of which it is an integral and substantive part
2. to establish as follows, pursuant to Article 5 paragraph 2 of the Ministerial Decree of February 19, 2007, for responsible parties who have become eligible to receive the incentive rates pursuant to the ministerial decrees of July 28, 2005 and February 6, 2006 whose systems are still not connected to the electrical grid:
• for connections to electrical grids when the rated voltage is:
a. less than or equal to 1 kV, the provisions of Article 9, paragraphs 9.2, 9.3, 9.4 and 9.5 of Attachment A to resolution no. 89/07 shall be applicable, assuming:
i. that the time for providing the estimate for the connection is the same as the time indicated in Article 8, paragraph 2 of the Ministerial Decree of July 28, 2005
ii. that the time for completing the connection is the same as the time indicated in Article 8, paragraph 3, last sentence of the Ministerial Decree of July 28, 2005
b. greater than 1 kV, the provisions of Article 14, paragraph 14.1 of Attachment A to resolution no. 281/05 shall be applicable, assuming the completion times for the systems and work that are indicated in Article 8, paragraph 8.2, letters a and b, of said resolution are the same as the time indicated in Article 8, paragraph 3, last sentence of the Ministerial Decree of July 28, 2005
• if the distributor receives the connection request set forth in Article 8, paragraph 1 of the Ministerial Decree of July 28, 2005 prior to the effective date of this resolution and the distributor has still not indicated the point of delivery, the time for providing the estimate as defined in letter a) point 1 above, shall run from the first day of the month following the date this provision went into effect
• if the distributor receives the notice of completion of work pursuant to Article 8, paragraph 3, second sentence of the Ministerial Decree of July 28, 2005, prior to the effective date of this resolution, and the system has not yet been connected, the times indicated in letter a), point ii., and letter b) above shall run from the first day of the month following the date this provision went into effect
3. to provide, pursuant to Article 5, paragraph 2, of the Ministerial Decree of February 19, 2007 and as an alternative to point 2 above, that the responsible parties for systems that are eligible for incentive rates pursuant to the Ministerial Decree of July 28, 2005 and February 6, 2006 may request a connection to electrical grids with an obligation to connect third parties pursuant to resolution no. 281/05 or resolution no. 89/07. In this case, any prior request shall be void and the provisions of the resolutions indicated shall be applicable instead of the provisions of Article 8, paragraphs 2 and 3, last sentence of the Ministerial Decree of July 28, 2005. If the responsible party has already made advance payments to the distributor responsible for making the connection, these payments must be considered valid for purposes of the new connection request
4. to abrogate Article 3, paragraphs 3.1, 3.2, 3.3 and 3.4, of resolution no. 188/05, as well as Attachment A to said resolution
5. to send this provision to the Minister of Economic Development, the Minister for the Environment and the Protection of Land and Sea, the company Gestore dei Servizi Elettrici S.p.A., and the Compensation Fund for the electric industry
6. to publish this provision in the Official Gazette of the Republic of Italy and on the Authority’s website (www.autorita.energia.it), so that it will go into effect on the date of publication.
