This Summary addresses only the major aspects of the Program – not every detail or every circumstance that might arise under the Program or each benefit feature. Each benefit feature has its own summary plan description.
The “Program” is the document that legally governs the Program’s terms and operations and creates any rights for you or your dependents. If there are any differences between this Summary and the Program document, the Program document will control. Further details about the Program are on file at the XXXX, Inc. (“XXXX”) corporate office at 2902 Enterprise Drive, Anderson, Indiana 46013. You are welcome to review this document simply by calling the Human Resources Department at (765) 778-6488. WHAT ARE THE ELIGIBILITY, ENROLLMENT AND TERMINATION PROVISIONS OF THE BENEFIT FEATURES?
Look to the insurance certificates, benefit summaries, and summary plan descriptions to determine who is eligible for the various benefit features and a description of when coverage will terminate under the benefit features. At your date of hire and during the annual open enrollment period, you will receive an orientation/enrollment packet which will describe your benefits to you.
WHAT IS COBRA?
COBRA is a federal law that allows certain persons to continue health coverage under certain circumstances.
A. Qualified Beneficiaries.
Only “qualified beneficiaries” may choose to continue coverage. You are a qualified beneficiary if you are covered under the benefit feature on the day before a “qualifying event” and you are:
• an eligible employee who is covered under the applicable benefit feature (called a “covered employee”);
• a spouse of a covered employee; or
• a dependent child of a covered employee (including dependents born to or placed for adoption with you during the continuation coverage).
As a “qualified beneficiary” you can elect to continue:
• medical coverage (including prescription drug and mental health/substance abuse benefits),
• dental coverage,
• vision coverage,
• employee assistance coverage, and/or
• health care flexible spending account coverage (which are each separately-electable benefits under COBRA) if a “qualifying event” occurs.
B. Qualifying Events.
If one of the following “qualifying events” should occur that would cause you
to lose coverage under a benefit feature(s), you have the right to choose to continue benefit coverage under the benefit feature(s) through COBRA.
These qualifying events are:
• your death;
• your termination of employment (other than by reason of gross misconduct) or reduction of hours that results in a termination of coverage under the applicable benefit feature;
• your divorce or legal separation;
• you becoming entitled to Medicare benefits; or
• your child ceasing to be considered a dependent child under the applicable benefit feature. (In this instance, your child would be eligible for COBRA, but your coverage under the applicable benefit feature(s) would not change).
C. Electing COBRA Coverage.
To obtain continuation coverage, a qualified beneficiary must elect it on a form provided by XXXX. The period to elect COBRA benefits ends 60 days after the later of:
• the date the qualified beneficiary would lose coverage due to the qualifying event; or
• the date the COBRA notice is sent by XXXX.
The election form explains the terms and payments for coverage. Your election is considered to be made on the date you send the election form to XXXX.
D. Paying for COBRA Coverage.
The qualified beneficiary is responsible for paying the monthly cost of continuation coverage. This cost is called a “premium.” Premiums must be paid each month.
After a qualifying event, the qualified beneficiary will receive a notice specifying:
• the amount of the premium,
• to whom the premium is to be paid, and
• the date each monthly payment is due.
Failure to pay premiums on a timely basis will result in termination of coverage as of the date the premium is due. Payment of any premium (other than the initial one - see below) will be considered “timely” only if it
is made within 30 days after the due date.
The initial premium payment, which is for the time period between the date of the qualifying event and the date you elected COBRA coverage, must be made within 45 days after the date of election. Failure to pay this initial premium by the due date will result in cancellation of coverage back to the initial date coverage would have been terminated.
E. Length of COBRA Coverage.
18 Months. When a qualifying event is caused by termination of employment or reduction in hours, a qualified beneficiary may elect to extend coverage for up to 18 months from the date of the qualifying event.
29 Months. If a qualified beneficiary is determined under Title II or XVI of the Social Security Act to be disabled within 60 days of the initial COBRA continuation coverage period (due to termination of employment or reduction in hours) (even if the disability began or was determined to be a disability before the first 60 days of the initial 18 month continuation period) the following applies:
• all qualified beneficiaries whose coverage is due to the same qualifying event may elect to extend coverage for up to 29 months from the date of the qualifying event. To obtain this extended coverage, the qualified beneficiary must notify XXXX of the disability determination within 18 months of the qualifying event and 60 days after the latest of: (i) the date the qualified beneficiary is determined to be disabled by the Social Security Administration, (ii) the date the qualifying event occurs, (iii) the date the qualified beneficiary loses or would lose coverage, or (iv) the date the qualified beneficiary is notified of his or her notice obligation.
• In addition, the qualified beneficiary must notify XXXX within 30 days of the later of: (i) the date of final determination by the Social Security Administration that the qualified beneficiary is no longer disabled, or (ii) the date the qualified beneficiary is notified of his or her notice obligation.
36 Months. When a qualifying event is caused by your death, divorce or legal separation, entitlement to Medicare or your child ceasing to be a dependent child, the qualified beneficiary may elect to extend coverage for up to 36 months from the date of the qualifying event.
Second Qualifying Event. If a second qualifying event (for example, a death or divorce) occurs during the initial 18-month COBRA continuation

coverage period or the 29-month COBRA continuation coverage period in the case of a disability), all individuals who were qualified beneficiaries in connection with the initial qualifying event and who are still qualified beneficiaries at the time of the second qualifying event may elect to extend coverage
for up to 36 months from the date of the original qualifying event.
Also, if you become entitled to Medicare and then within 18 months experiences a termination of employment or reduction in hours, qualified beneficiaries other than you may elect to extend coverage for up to 36 months from the date the covered employee became entitled to Medicare.
F. When COBRA Continuation Coverage Ends.
COBRA continuation coverage will end earlier than the periods shown above if:
• the first day (including any grace period) for which COBRA premium payments are not made on a timely basis;
• the qualified beneficiary first becomes covered under any other group health plan after electing COBRA coverage. If the other plan contains a limitation with respect to any pre-existing condition that impacts the
qualified beneficiary, coverage will not terminate;
• the qualified beneficiary first becomes entitled to benefits under Medicare after electing COBRA coverage;
• the qualified beneficiary ceases to be disabled (if continuation coverage is due to a disability); or
• XXXX ceases to provide any group health plan to any employee.
You will be notified, as soon as possible after your continuation coverage is terminating, if such coverage terminates prior to the maximum period(s) set forth in subsection E above.

¿CUÁLES SON LAS DISPOSICIONES PARA LA ELEGIBILIDAD, INSCRIPCIÓN Y FINALIZACIÓN DE LAS VENTAJAS DE LOS BENEFICIOS?
Consulte los certificados de seguro, resúmenes de beneficios y descripciones resumidas del plan para determinar quién es elegible para los diferentes beneficios y una descripción de cuándo finalizará la cobertura según las ventajas de los beneficio. Cuando lo contraten o durante el periodo anual de inscripciones abiertas, usted recibirá una guía de orientación/inscripción en la cual se describirán sus beneficios.
¿QUÉ ES COBRA?
COBRA es una ley federal que les permite a ciertas personas continuar con la cobertura de salud en determinadas circunstancias.
A. Beneficiarios calificados.
Sólo “los beneficiarios calificados” pueden optar por continuar la cobertura. Usted es un beneficiario calificado si tiene cobertura según la ventaja de beneficios el día anterior a un “evento que califica” y usted es:
• un empleado elegible que recibe cobertura según la ventaja de beneficios que corresponda (denominado un “empleado cubierto”);
• un cónyuge de un empleado cubierto; o
• un/a Hijo/a dependiente de un empleado cubierto (esto incluye dependientes que nacieron o que le fueron entregados para adopción durante la continuidad de la cobertura).
Como "beneficiario calificado”, usted puede optar por continuar:
• cobertura médica (que incluye beneficios de medicamentos recetados, para la salud mental y el abuso de sustancias),
• cobertura odontológica,
• cobertura oftalmológica,
• cobertura de asistencia para empleados, y/o
• cobertura de cuentas flexibles de gastos médicos (cada evento es un beneficio que se elige por separado según COBRA) en caso de que ocurra un “evento que califica”.
B. Eventos que califican.
Si uno de los siguientes “eventos que califican” ocurriera y esto le causara la pérdida de la cobertura según la o las ventajas de los beneficios, usted tiene derecho a elegir continuar la cobertura de beneficios según las ventajas de beneficios del programa mediante COBRA.
Estos eventos que califican son:
• su fallecimiento;
• la finalización de su relación laboral (por una razón que no sea mala conducta) o una reducción de horas que resulte en la finalización de la cobertura según la ventaja de beneficios que corresponda;
• su divorcio o separación legal;
• su adquisición de derechos a beneficios de Medicare; o
• la suspensión de la condición de su hijo/a como hijo/a dependiente según la ventaja de beneficios que corresponde. (En este caso, su hijo/a será elegible para COBRA, pero su cobertura según la o las ventajas de los beneficios que correspondan no cambiará.)
C. Elección de cobertura COBRA.
Para obtener continuidad de cobertura, un beneficiario calificado debe elegirla en un formulario suministrado por XXXX. El periodo para optar por los beneficios de COBRA finaliza a los 60 días después del último evento:
• la fecha en que el beneficiario calificado perdería la cobertura debido a un evento que califica; o
• la fecha en que XXXX envía la notificación de COBRA.
El formulario de elección explica los términos y condiciones y los pagos de la cobertura. Se considera que usted realizó la elección en la fecha en que le envía a XXXX el formulario de elección.
D. Pago por cobertura COBRA.
El beneficiario calificado es responsable de pagar el costo mensual de la continuidad de la cobertura. Este costo se denomina “prima”. Las primas deben pagarse cada mes.
Después de un evento que califica, el beneficiario calificado recibirá una notificación que especifique:
• el monto de la prima,
• a quién se le pagará la prima, y
• la fecha de vencimiento de cada pago mensual.
Si los pagos de las primas no se efectúan en tiempo y forma, la cobertura finalizará el día de la fecha de vencimiento de la prima. Se considerará que el pago de cualquier prima (que no sea la inicial - ver a continuación) se efectúa " en tiempo y forma" si se la realiza dentro de los 30 días posteriores a la fecha de vencimiento.
El pago inicial de la prima, el cual es para el periodo comprendido entre la fecha del evento que califica y la fecha en que usted optó por la cobertura COBRA, debe realizarse dentro de los 45 días posteriores a la fecha de elección. Si el pago de esta prima inicial no se realiza en la fecha de vencimiento, la cobertura se cancelará desde la fecha inicial en que la cobertura hubiera finalizado.
E. Duración de cobertura COBRA.
18 meses. Cuando el evento que califica lo provoca la finalización de su relación laboral o la reducción de horas, un beneficiario calificado puede optar por extender la cobertura por hasta 18 meses desde la fecha del evento que califica.
29 meses. Si de acuerdo con el Título II o XVI de la Ley de Seguro Social, un beneficiario calificado es considerado incapacitado dentro de los 60 días del periodo de continuidad de cobertura inicial COBRA (debido a la finalización de la relación laboral o a la reducción de horas) (aun si la incapacidad comenzó o si se determinó que era una incapacidad antes de los primeros 60 días del periodo de continuidad inicial de 18 meses), se aplica lo siguiente:
• todos los beneficiarios calificados cuya cobertura se debe al mismo evento que califica pueden optar por extender la cobertura por hasta 29 meses a partir de la fecha del evento que califica. Para obtener esta extensión de la cobertura, el beneficiario calificado debe notificarle a XXXX la decisión de la incapacidad dentro de los 18 meses del evento que califica y 60 días después del último evento: (i) la fecha en que la Administración del Seguro Social determina que el beneficiario calificado está incapacitado, (ii) la fecha en que ocurre el evento que califica, (iii) la fecha en que el beneficiario calificado pierde o perdería la cobertura, o (iv) la fecha en que se le notifica al beneficiario calificado su obligación de informar.
• Además, el beneficiario calificado debe notificarle a XXXX dentro de los 30 días del último evento: (i) la fecha en que la Administración del Seguro Social determine que el beneficiario calificado ya no se encuentra incapacitado, o (ii) la fecha en que se le notifique al beneficiario calificado su obligación de informar.
36 meses. Cuando el evento que califica sea causado por su fallecimiento, divorcio o separación legal, derecho a beneficios de Medicare o por la suspensión de la condición de su hijo/a como hijo/a dependiente, el beneficiario calificado puede optar por extender la cobertura por hasta 36 meses a partir de la fecha del evento que califica.
Segundo evento que califica. Si un segundo evento que califica (por ejemplo, un fallecimiento o divorcio) ocurre durante el periodo de continuidad de cobertura inicial de 18 meses de COBRA

o el periodo de continuidad de cobertura de 29 meses de COBRA en caso de una incapacidad), todas las personas que eran beneficiarios calificados en relación con el evento que califica inicial y que aún son beneficiarios calificados en el momento del segundo evento que califica pueden optar por extender la cobertura por hasta 36 meses a partir de la fecha del evento que califica original.
Además, si usted adquiere derecho a beneficios de Medicare y luego dentro de los 18 meses experimenta una finalización de su relación laboral o una reducción de horas, los beneficiarios calificados, a excepción de usted, pueden optar por extender la cobertura por hasta 36 meses a partir la fecha en que el empleado cubierto adquirió derecho a beneficios de Medicare.
F Fin de la continuidad de la cobertura COBRA.
La continuidad de cobertura COBRA finalizará antes de los plazos anteriormente mencionados si:
• el primer día (que incluye cualquier periodo de gracia) en el que no se efectúen en tiempo y forma los pagos de la prima de COBRA;
• el beneficiario calificado primero recibe cobertura de cualquier otro plan de salud grupal después de optar por la cobertura de COBRA. Si el otro plan contiene una restricción con respecto a cualquier condición preexistente que incide sobre el beneficiario calificado, la cobertura no finalizará;
• el beneficiario calificado primero adquiere derecho a beneficios de Medicare después de optar por la cobertura COBRA;
• el beneficiario calificado deja de estar incapacitado (en caso de que la continuidad de la cobertura se deba a una incapacidad); o
• XXXX deja de suministrar cualquier plan de salud grupal a cualquier empleado.
Se le notificará, tan pronto como sea posible cuando la continuidad de la cobertura esté terminando, si dicha cobertura finaliza antes de que el o los periodos máximos establecidos en el apartado E arriba mencionado.
G. Requisitos de Notificación.
