RESPONSABILITES DU MAITRISE D'OEUVRE
Le Maître d’œuvre est tenu responsable de l'exécution de ses prestations.
Pour l’exécution de sa mission, le Maître d’œuvre s’engage à respecter l’ensemble de la réglementation et des usages en vigueur concernant le programme envisagé et notamment, les règles administratives et techniques. Il s’engage également à tenir compte des sujétions et contraintes particulières applicables au terrain d’assiette de l’opération et à son organisation juridique.
Le Maître d’œuvre est en outre responsable du respect du coût de l'opération et de son délai de réalisation dans les conditions définies ci dessus pour ce qui concerne l’exécution des missions lui incombant.
II-2 SOUS TRAITANCE
Le Maître d’œuvre s’adjoindra les services de sociétés à l’activité complémentaire permettant de mener à bien la mission dans toutes ses phases, architecture, ingénièrie, exécution et économie.
Les missions complémentaires feront l’objet de contrats de sous-traitance avec le Maître d’œuvre.
Le choix des sociétés et les contrats de sous-traitance seront soumis à l’approbation du Maître d’Ouvrage.
II-3 OBLIGATIONS DU MAITRE D’OUVRAGE
1- Le Maître de l’Ouvrage s’engage à fournir au Maître d’œuvre les éléments qui suivent:
• Les études de géomètre et de nivellement.
• Le rapport des sondages que solliciteraient le Maître d’œuvre.
• Préalablement à toute exécution, son approbation écrite et préalable relative aux documents établis par le Maître d’œuvre
Cependant, la Maîtrise d'ouvrage n'est pas responsable des erreurs qui pourraient être commises par les techniciens auprès desquels il a été demandé l'établissement des documents ci-dessus mentionnés. De ce fait, à réception des documents, tout membre de la Maîtrise d'œuvre intéressé pourra demander des explications complémentaires ou procéder à des vérifications personnelles qu'il estime nécessaires. Aucune réserve qui aurait des incidences techniques ou financières ne sera admise par la suite.

PROJECT MANAGER’S RESPONSIBILITIES
The Project Manager is responsible for providing its services.
In carrying out its assignment, the Project Manager undertakes to comply with all current regulations and practices regarding the planned project, and in particular administrative and technical regulations. It also undertakes to take into account the special considerations and constraints applicable to the construction site and to its legal status.
The Project Manager is also responsible for meeting the operation’s cost and its completion time, under the conditions defined above with regard to performing the tasks assigned to it.
II-2 SUBCONTRACTING
The Project Manager will engage the services of complementary companies so that the assignment can be carried out in all its phases, including architecture, engineering, construction and economy.
These complementary engagements will be the subject of subcontracts with the Project Owner.
The selected companies and the subcontracting arrangements will be submitted to the Project Owner for approval.
II-3 PROJECT OWNER’S OBLIGATIONS
1- The Project Owner undertakes to provide the Project Manager with the following:
• The surveyor’s and levelling studies.
• The report on any trial holes requested by the Project Manager.
• Prior to the start of any work, its written approval of the documents prepared by the Project Manager.
However, the Project Owner is not responsible for any errors that might be made by the technicians asked to prepare the aforementioned documents. Hence, upon receiving the documents, any member of the Project Manager’s team may ask for additional explanations or make such personal verifications as he may deem necessary. No reservation having technical or financial effects will be accepted subsequently.
