This article was published in the International Social Science Journal (ISSJ), Vol. 58, No. 188, pp., 319 -334, 2006 . I translated it in 10/2007. The abstract and the biographical note only are reproduced below.
Abstract:
For many years seeds and plant varieties were beyond the purview of intellectual property rights. But since 1930s intellectual property rights have covered them. Till the advent of Trade Related Intellectual Property Rights under WTO nations had no obligation to extend intellectual property rights to them, unless they were members of UPOV. Apart from provisions of TRIPS, changes in laws, technological advances and judicial interpretation of laws have resulted in the strengthening the rights of patent holders and breeders while farmers’ rights had been diminished or effectively nullified. This has other implications like restriction on the researchers’ freedom to invent and innovate and for North- South trade in seeds and grains, particularly in Genetically Modified crops such as soya. In this paper open source is suggested as a solution and a model Bio Linux model is put forth as an alternative. While it is not claimed that open source will be a panacea this paper highlights some of the possibilities that are opened up by open source. It also suggests that open source will be very useful in finding a solution to anti-commons problem while promoting innovations.

Krishna Ravi Srinivas is a visiting faculty with Indian Institute of Management, Bangalore, India. His doctoral dissertation was on biodiversity and intellectual property rights. His research interests include intellectual property rights and development policy, open source and open access, trade and environment, global trade regulation, traditional knowledge, and science, technology and society.

Résumé
Pendant de nombreuses années, les semences et les variétés végétales n’ont pas fait l’objet de droits de propriété intellectuelle. Ce n’est que dans les années 1930 que la situation a changé. Jusqu’à la conclusion de l’Accord de l’OMC sur les aspects des droits de propriété intellectuelle qui touchent au commerce (ADPIC) les États, sauf s’ils étaient membres de l’UPOV, n’étaient pas obligés de les placer sous le régime de la propriété intellectuelle. Indépendamment des dispositions de l’Accord sur les ADPIC, les modifications de la législation, les avancées technologiques et la jurisprudence ont conduit au renforcement des droits des détenteurs de brevets et des obtenteurs, tandis que les droits des agriculteurs étaient réduits ou pratiquement vidés de leur substance. Cela a eu d’autres conséquences comme la réduction de la liberté d’invention et d’innovation des chercheurs ainsi que du commerce Nord-Sud des semences et des grains, particulièrement en ce qui concerne les produits agricoles génétiquement modifiés comme le soja. Dans cet article, nous proposons la source libre comme solution et un modèle BioLinux comme alternative. Sans prétendre que la source libre sera une panacée, l’article met en relief quelques-unes des possibilités qui en résultent. Il suggère également qu’elle facilitera beaucoup la recherche d’une solution au problème de l’opposition à la notion de domaine commun (anti-commons) tout en favorisant l’innovation.

I started teaching financial management in business schools ( EDHEC - ESPEME, ESCAET) in 1992, and have been providing translation services since 1996.
Previously, I worked, as auditor or financial controller of large French multinationals such as VALLOUREC, Entreprise JEAN LEFEBVRE... At NORMED, I invented the illustrated financial monthly report and a method to assess the ROI in computerization that was published. At CONCEPT S.A., I designed and wrote the user's manual of fiinancial softwares for fixed assets management and for dealing rooms, chart of accounts included. I then created and managed the Club for insurance management controllers (at CAPA) in Paris, the meetings of which have been reported in L'Argus de l'assurance; from the outset, it was a great success. At the same time, I published professional articles and papers in Design Industrie, Echanges - DFCG, La lettre de la S.F.T..
I was born in Paris where I have been educated, learning English, German and Italian as foreign languages. I became a manager in different business fields for companies in France as well as overseas in English-speaking countries: research ( CEGOS), management control in shipbuilding and insurance ( NORMED, CAPA), audit (GUERARD-VALLAS, presently MAZARS), chartered accountancy, consulting in management computing (EUREST), design and production of financial software manuals (CONCEPT S.A.) and legal expertise in ship repairs (T.C. in Antibes).
