A person disposing of a leasehold interest in a property should value the property using one of the three methods as mentioned above and should then test this valuation using the “economic value test” in accordance with Section 4(3A) VAT Act, 1972. Economic value is the amount on which tax was chargeable to the person disposing of an interest in respect of that person’s acquisition of that interest and in respect of any development of the property by or on behalf of that person since that acquisition.
Where the consideration on disposal is less than the economic value (or less than the reduced Economic Value in certain cases), such a disposal is deemed to be an exempt letting of property. In such circumstances, the person making the disposal will not be entitled to deductibility on the acquisition or development of the property. Any deductibility previously claimed must be clawed back. In these circumstances Section 4A does not apply and this form should not be submitted to Revenue at all.

A full description should be given as to what the premises will be used for. If it is intended to use any part of it for purposes other than in connection with taxable supplies of goods and services by the lessee e.g. short term letting of part of the premises, full details should be given on a separate sheet if necessary.
Note 12
A trader will normally be entitled to full deductibility in respect of the VAT charged as a taxable supply of property where it is exclusively used for the purposes of the trader’s taxable supplies of goods or services.
Section 4A does not apply to this acquisition if you are not entitled to full deductibility and this form should not be submitted to Revenue at all.

Bei einer derartigen Sachlage trifft Paragraph 4A nicht zu, und dieses Formular darf bei der Steuerbehörde nicht eingereicht werden.

Der Pächter muss eine genaue Beschreibung des Verwendungszweckes der Immobilie vorlegen. Falls er die Absicht hat, auch nur einen Teil der Immobilie für andere Zwecke als die Versorgung mit Gütern und Dienstleistungen zu verwenden, z.B. für kurzfristige Vermietungen von Teilen der Immobilie, so muss er dazu, wenn nötig, genaue Angaben auf einem separaten Blatt machen.

Source text - English This letter sets out our agreement pursuant to which we will commission you (“the Writer”) to write a treatment for a feature film.
We hereby commission you to write a treatment for a proposed theatric film which will be of between 100 and 130 minutes duration (“the Treatment”).
In consideration of your services and of the rights granted to us we shall pay you a fee of £xxx (“the Fee”) to include any and all expenses and costs incurred in respect of your services as follows:
£xxx on signature hereof;
£xxx on acceptance of the final Treatment.
The Fee shall constitute a buy out of the copyright (including rental and lending rights) and all other rights in the Treatment worldwide for the full period of copyright including any and all extensions, reversion and renewals.
Within 3 months of signature of this Agreement, XXX shall either:-
indicate in writing its intention to commission further development work based on the Treatment, or
indicate in writing that it does not intend to develop the project.
You hereby warrant and undertake that:
Your services will be performed to the best of your skill and ability and in accordance with our reasonable requirements;
You are the sole author and the owner of the rights assigned hereunder;
The Treatment does not infringe the copyright or any other rights of any person and will not be defamatory;
You will at our request and expense execute such further documents as we reasonably require for carrying into effect the terms of this Agreement or for confirming or protecting our rights in the products of your services.
You will not disclose to any other person (other than to your personal advisers) any information concerning us or our affairs or your work under this Agreement.
You will indemnify us against all costs, claims or damages resulting from any breach of your warranties and undertakings.
You will not incur any liability on behalf of XXX, nor pledge XXX’s credit.
If you shall at any time be unable, neglect, fail or refuse to perform your services or any of them or if you shall in any other manner breach this Agreement we may by written notice terminate this Agreement in which event the Fee shall promptly be repaid.
We shall be entitled to assign the benefit of this Agreement.
This Agreement shall be construed and shall take effect in accordance with English law and the Courts of England and Wales shall have exclusive jurisdiction over any dispute.

Proprietary estoppel – defendant giving assurances during lifetime association with plaintiff as to future right to property – relief to be granted.
The Plaintiff spent his working life as a farm manager and friend of the first defendant who had made repeated assurances over many years, usually on special family occasions, that the plaintiff would succeed to his farming business. Forty years after their first meeting, the relationship broke down. The first defendant made some lifetime dispositions to the second defendant. The plaintiff sought equitable relief based on proprietary estoppels. Carnwarth J (1998) Gazette, 1 July; (1998) 3 All ER 917 dismissed the claim and the plaintiff appealed.
Held, allowing the appeal, that the fundamental principle that equity was concerned to prevent unconscionable conduct permeated all the elements of the doctrine of proprietary estoppel and, in the end, the court had to look at the matter in the round; that criticisms of Taylor v Dickens (1998) 1 FLR 806 were well-founded; that detriment need not consist of the expenditure of money or other quantifiable financial detriment, so long as it was something substantial, and the requirement for detriment was to be approached as part of a broad inquiry as to whether repudiation of an assurance was or was not unconscionable in all the circumstances; that the defendant’s assurances had been repeated over a long period; some of them had been completely unambiguous and intended to be relied on, and had been relied on; and that the defendant’s assurances were capable of forming the foundation for an enforceable claim based on proprietary estoppel.

Der Kläger arbeitete als Manager auf einem landwirtschaftlichen Betrieb und war mit dem ersten Antragsgegner befreundet. Dieser hatte wiederholt und über einen Zeitraum von mehreren Jahren, meist bei besonderen Familienfeiern, Versprechen ausgesprochen, dass der Kläger sein Nachfolger in seinem landwirtschaftlichen Betrieb werden sollte. Vierzig Jahre nach ihrem ersten Treffen ging die Freundschaft in die Brüche. Der erste Antragsgegner machte zu seinen Lebzeiten einige Veräußerungen an den zweiten Antragsgegner. Der Kläger suchte das Rechtsmittel nach dem englischen Billigkeitsrecht der Rechtsverwirkung vor Gericht einzulegen. Der Richter Carnwath J 1998 Gazette, 1. Juli; 1998 3 All ER 917 wies die Klage ab und der Kläger legte ein Rechtsmittel ein.
Dem Rechtsmittel wurde stattgegeben und das Urteil lautete,

Die Notwendigkeit, dass ein Nachteil nachgewiesen werden kann, muss im Zusammenhang damit betrachtet werden, ob die Dementierung eines Versprechen unter allen Umständen auch tatsächlich gewissenlos war; dass der Antragsgegner die Versprechen mehrmals über einen langen Zeitraum wiederholt ausgesprochen hat; dass einige dieser Versprechen ganz und gar eindeutig waren und es beabsichtigt war, dass man sich auf sie verlassen kann und dass man sich auch tatsächlich auf sie verlassen hatte; dass die Versprechen des Antragsgegners in der Tat den Grundstein für eine einklagbare Klage legen, die auf dem Prinzip der Rechtsverwirkung wegen Grundstückssachen basiert.

I qualified as a translator (Fremdspracheninstitut der Landeshauptstadt München) in 1993. I am a native German speaker, but moved to England in 1993, where I lived for 10 years. During this time I perfected my written and spoken English.
I studied law at the College of Law in London, whilst simultaneously doing my Articles with the law firm Picton Howell Solicitors (now EMW Picton Howell LLP). During these four years I gained experience in English corporate and commercial law, financial transactions, litigation before the English courts, Financial Services practice and regulation as well as cross border matters.
I qualified as a solicitor in 2001 and worked for the City law firm Field Fisher Waterhouse, where I worked in the general commercial law department with special emphasis on cross border matters, particularly in respect of Germany and Austria, as well as the Financial Services department. During this time I was also seconded to a Luxembourg bank as a Compliance Officer.
I moved to Switzerland in 2003 and have since been working as a freelance translator, specializing on legal documents from English into German.
I am currently studying at the Fachhochschule Zürich Winterthur (CAS Fachübersetzen) to gain a deeper insight into the Swiss legal system, obtain a Swiss translation qualification and gain knowledge of CAT tools.
