Source text - Italian Oltre le incertezze e la precarietà del presente, tornare ad affrontare la scommessa del futuro L’ascolto delle nuove generazioni per costruire l’Italia che verrà I dati congiunturali degli ultimi mesi su crescita, occupazione e consumi hanno registrato la rapida evoluzione della crisi e ne hanno documentato l’inequivocabile natura recessiva. Nonostante le politiche di contenimento del debito pubblico e le misure di sostegno all’economia italiana approntate dal Governo, siamo davanti a una crisi pervasiva che sta investendo la società e l’economia del Paese in modo quasi “virale”, compromettendone non solo la tenuta finanziaria, ma anche i riferimenti ideali e istituzionali, la mutualità inter-generazionale, la capacità di interpretare le sfide del presente, la visione del futuro. Per i cittadini si tratta di una vera e propria crisi di fiducia. Il rischio ineludibile, in questo momento, è che si leda la trama di relazioni che è pilastro portante del Paese, che si scatenino pericolose conflittualità fra generazioni e che le emergenti dimensioni di precarietà e vulnerabilità sociale restino inascoltate. Accanto all’urgenza di sostenere l’economia nazionale, si pone oggi una rinnovata urgenza: restituire fiducia ai cittadini; promuovere e sostenere l’alleanza fra giovani ed anziani che è centrale per superare la crisi; prestare ascolto ad una parte della società spesso ai margini, che sta vivendo trasformazioni repentine ed ha bisogno di supporto per comprendere e gestire il cambiamento. Anche per questo, lo IAL - Innovazione Apprendimento Lavoro, oggi impresa sociale, ha scelto di prendere parte alla difficile sfida di interpretare la complessità delle trasformazioni in atto, di studiare e approntare nuovi strumenti di lettura delle istanze di tutela sempre più diffuse nella società. Si tratta di offrire un contributo alla costruzione dell’Italia che verrà, ascoltandone i protagonisti: le nuove generazioni del Paese. Coerentemente con la sua identità e la sua mission storica, fortemente legata ai valori della solidarietà, della tutela del lavoro e dell’impegno sociale propri della Cisl, lo IAL ha progettato e affidato all’Istituto Nazionale di Ricerche Demòpolis un percorso di ascolto e studio valoriale delle nuove generazioni, per l’individuazione dei compiti inevasi di tutela dei giovani, delle nuove forme di partecipazione e dei linguaggi emergenti, per la verifica delle variabili che incidono sulla complessa transizione al mondo adulto, per la conoscenza delle dimensioni di precarizzazione dell’esistenza e del lavoro sempre più generalizzate. Oltre le incertezze e la precarietà del presente, tornare ad affrontare la scommessa del futuro L’ascolto delle nuove generazioni per costruire l’Italia che verrà 40 ITALIAPIÙ	Translation - English Beyond the uncertainty and precariousness of the present, returning to facing future challenges Listening to the younger generations to build the future of Italy The economic data in recent months on growth, employment and consumption has shown the rapid evolution of the crisis, documenting the unequivocal nature of recession. Despite the Government’s policy of public debt containment and measures to support the Italian economy, we are facing a pervasive crisis that is affecting society and the economy of the country in an almost “viral” way, compromising not only the financial wherewithal, but also the ideal and institutional references, the mutual inter-generational exchange, the ability of interpreting present challenges and a vision of the future. For citizens it is a real crisis of confidence. The unavoidable risk, at this time, is damage to the web of relationships that is the cornerstone of the country, which is causing dangerous conflict between generations while emerging dimensions of insecurity and social vulnerability remain unresolved. Besides the urgent need to support the national economy, there is now a renewed urgency: restoring confidence to the citizens; promoting and supporting the alliance between young and old that is central to overcoming the crisis; listening to a part of society often at the margins, which is experiencing rapid changes, requiring support to understand and manage change. Also for this, the IAL - Innovazione Apprendimento Lavoro, today a social enterprise, has chosen to take part in the difficult challenge of interpreting the complexity of the changes underway, studying and developing new ways of reading the widespread instances of protection society. It hopes to offer a contribution to the construction of the Italy to come, listening to the protagonists: the country’s new generation. Consistent with its identity and its historic mission, which is strongly linked to the values of solidarity, to labour protection and social commitment precisely of Cisl, the IAL has designed and given to the National Institute for Research Demòpolis a process of listening and study of values of the younger generations, for the identification of outstanding tasks concerning their protection, new forms of participation and emerging languages, for the verification of the variables that affect the complex transition to the adult world, for the awareness of the dimensions of insecurity of employment that is becoming and more and more generalised. The commitment of the IAL and Demòpolis is to offer their own contribution to the redefinition of the guidelines and options for the future, and with this synergy, to enhance their know-how and expertise: the historic capital of the national IAL in the field of training throughout lifelong learning, promoting the improvement of skills in working for innovation and greater worker participation in business life; the experience gained by the Demòpolis in the analysis of Italian public opinion, in political and social research, in their listening targeted to the younger generations. The choice of offering to contribute to the understanding of the youth segment moves from a process of reflection that the IAL, together with Cisl, reached in the last year and for which it has asked for an operational contribution from Demòpolis. The significant transformations which have occurred in the last twenty years in the dynamics of entrance into the world of work have drastically altered the personal and professional lives of the younger generations, affecting the perception and expectations regarding security - increasingly more individual and less collective - the institutional points of reference for youth, the methods of orientation during education, training and entrance into employment, perception and the construction of the future. In this context, IAL and Demòpolis have decided to restore depth to a social segment that is too often spoken about by means of stereotypes, through a journey of understanding of an entire portion of the country that tries to find fulfilment in life and work. In the framework of avoiding stereotypes in talking about the new generations, IAL and Demòpolis are working to analyse the different types of youth experience: the experience of those who study, as well as that of those looking for their first job or are at their initial work experience; the testimony of those who seek new forms of participation, of those who are socially engaged; and the unique perspective of “atypical” and “contract” workers, who are living in a state of temporary employment. Precisely an analytical focus will offer the reading the microcosm of those registered at employment agencies, recounting their experiences and fears. As early as September it is our intention to identify points of convergence with that world that is an expression of associations with which we find identity and common values, with the aim of seeking out, in a logic of new territorial welfare, the correlations between the needs and the sensitivity expressed by young people and by the older population. With these goals, we will present in specific public policy initiatives, the results of the joint IAL - Demòpolis analysis, as a contribution of knowledge to the general public and institutions, to restore centrality to the challenges of the future that each civil actor must feel called upon to face, beyond the uncertainty and precariousness of the present.

SCOPO DEL CAPITOLATO GENERALE Il presente Capitolato costituisce parte integrante, unitamente agli altri documenti contrattuali (annesso tecnico, prezziari, specifiche, disegni, etc.) del contratto stipulato fra Committente ed Appaltatore. Le clausole in esso contenute trovano applicazione, salvo che non sia diversamente stabilito in contratto. In caso di divergenza, le clausole contenute nel contratto e i suoi allegati prevarranno su quelle del presente Capitolato Generale. 2. GENERALITA’ E DEFINIZIONI Ogni qualvolta impiegati i termini che seguono avranno il significato qui loro attribuito. 2.1 Committente: La Società che stipula il contratto con l'Appaltatore. 2.2 Appaltatore: L'impresa Appaltatrice incaricata dell'esecuzione dei lavori oggetto dell'appalto. 2.3 Rappresentante della Committente: La persona incaricata di rappresentare la Committente come specificato all'art. 5.0. 2.4 Direttore dei Lavori: La persona in possesso delle necessarie capacità tecnico-professionali che assume, a norma delle vigenti disposizioni di legge, la funzione di Direttore dei Lavori come specificato dall'art. 6.0. 2.5 Capo cantiere: La persona in possesso della necessaria esperienza e professionalmente qualificata, incaricata di rappresentare l'Appaltatore durante le assenze del Direttore dei Lavori come specificato dall'art. 6.0. 2.6 Responsabile dei Lavori: La persona in possesso delle necessarie capacità tecnico-professionali che assume, a norma delle vigenti disposizioni di legge, la funzione di Responsabile dei Lavori come specificato dall'art. 6.0. 3. NORME DI SICUREZZA Esame e conoscenza del luogo e delle condizioni di lavoro. 3.1 L'Appaltatore s'impegna a rispettare ed a fare rispettare dai propri dipendenti e dalle persone delle quali deve rispondere, tutte le norme di legge e i regolamenti vigenti in materia di sicurezza, prevenzione degli infortuni sul lavoro e igiene del lavoro. 3.2 L'Appaltatore assume pertanto l'obbligo di attenersi scrupolosamente a tutte le norme di leggi e regolamenti vigenti, nonché alle disposizioni particolari in vigore all'interno delle Raffinerie della Committente che l’Appaltatore dichiara di conoscere per averne ricevuto preventiva informazione e la relativa documentazione dalla Committente medesima. 3.3 L'Appaltatore dichiara di avere già visitato le aree dove eseguirà i Lavori e di aver piena conoscenza e consapevolezza dei rischi inerenti i luoghi di lavoro oggetto dell’appalto per aver ricevuto dalla Committente tutte le necessarie informazioni sui suddetti rischi e sulle misure di prevenzione e di emergenza adottate dalla Committente medesima in relazione alle attività di quest’ultima. 3.4 L'Appaltatore dichiara inoltre di aver preso visione del documento di valutazione dei rischi elaborato dalla Committente (D.U.V.R.I.), ai sensi dell'art. 26, comma 3 del D.lgs 81/08, disponibile sul sito elettronico www.erg.it e di essere stato pertanto reso edotto dei rischi esistenti nell'ambiente in cui opererà e sulle misure di prevenzione ed i emergenza adottate in relazione alla attività della Committente e delle eventuali attività di altre imprese coinvolte nell'esecuzione dell'opera. 3.5 Dichiara inoltre di aver tenuto conto, nella formulazione del prezzo, di tutte le circostanze e rinuncia sin d'ora a qualsiasi compenso aggiuntivo o indennizzo, assumendosi ogni onere e rischio. PROGETTAZIONE 4.1 1I lavori oggetto dell'Appalto potranno essere illustrati da "disegni di massima" predisposti dalla Committente. Tali disegni avranno in generale lo scopo di indicare la sistemazione generale, la disposizione ed ampiezza delle opere. L'Appaltatore dovrà far redigere a sua cura e spese, da un Ingegnere di fiducia, regolarmente iscritto all'Albo professionale, il progetto esecutivo delle opere, completo dei calcoli delle strutture portanti, ivi comprese quelle in cemento armato e metalliche. Tuttavia la Committente, a suo insindacabile giudizio, si riserva la facoltà di far compilare da suoi tecnici o da tecnici di sua fiducia, tale progetto esecutivo completo dei calcoli delle strutture portanti, ivi comprese quelle in cemento armato e metalliche, ed in tal caso tale progetto dovrà essere sottoscritto per accettazione dal Direttore del Lavori che se ne assumerà la responsabilità in solido con l'Appaltatore. L'Appaltatore è altresì tenuto a sviluppare a sua cura e spese il progetto architettonico fornito dalla Committente ed i particolari costruttivi in scala 1:50 in base ai calcoli delle strutture portanti precedentemente indicati. Delle opere in cemento armato ed a struttura metallica è fatto in ogni caso obbligo all'Appaltatore di provvedere alla denuncia, nei modi e termini di legge, agli Uffici competenti, ed a mantenere in cantiere i documenti, i campioni dei cubetti in calcestruzzo e dei ferri di armatura, il tutto come previsto dalle legge vigenti in materia. L'Appaltatore dovrà inoltre a sua cura e spese provvedere alla presentazione agli Uffici competenti dei collaudi statici e della eventuale altra documentazione che dovesse risultare necessaria che gli sarà consegnata dalla Committente. Il progetto esecutivo redatto a cura dell'Appaltatore, completo dei particolari sopra indicati, dovrà essere trasmesso alla Committente prima dell'inizio dei lavori; questa si riserva di dare la sua approvazione al progetto esecutivo, pur rimanendo l'Appaltatore totalmente responsabile del progetto stesso. La medesima regolamentazione vale anche per modifiche e varianti al progetto esecutivo che fossero richieste dalla Committente "in corso d'opera". Al termine dei lavori l'Appaltatore dovrà fornire alla Committente, senza alcun compenso aggiuntivo, tutti i disegni aggiornati e particolareggiati delle opere eseguite in copia riproducibile, che rimarranno proprietà della Committente. 4.2 L'Appaltatore ha l'obbligo comunque di: • accertare la portanza del terreno di fondazione producendone, a richiesta della Committente, tutti i certificati dei saggi o prove effettuate; • tener conto, per il calcolo della struttura, oltre che del peso proprio anche di carichi fissi, accidentali o mobili indicati dalla Committente; • verificare e controllare i progetti, i calcoli e disegni, assumendo pertanto le responsabilità connesse. Qualora l'Appaltatore non comunicasse le proprie osservazioni o riserve per iscritto, prima dell'inizio dei lavori, il progetto si intenderà approvato ed accettato dallo stesso; • eseguire le opere secondo le migliori tecniche, regole d'arte e con l'impiego di materiali di prima qualità. 4.3 Sarà altresì obbligo dell'Appaltatore accertare se vi siano discordanze tra i disegni forniti dalla Committente e le norme di legge, ed avvertirne immediatamente la Committente stessa che provvederà affinché siano apportate le dovute modifiche. 5. RAPPRESENTANTE DELLA COMMITTENTE 5.1 La Committente potrà farsi rappresentare da un suo incaricato che potrà anche non far parte del proprio personale, che avrà facoltà di assistere all'esecuzione dei lavori senza manlevare, con ciò, l'Appaltatore dalle proprie responsabilità. L'incaricato della Committente avrà la facoltà di verificare il perfetto adempimento, da parte dell'Appaltatore, che dovrà darne ampia dimostrazione, a tutte le prescrizioni contrattuali, e potrà rifiutare quei lavori che, a suo insindacabile giudizio, non siano stati eseguiti correttamente ed a perfetta regola d'arte. In tal caso l'Appaltatore sarà tenuto a rieseguire i lavori a propria cura e spese. Qualora l'Appaltatore non provvedesse nei termini fissati dall'incaricato della Committente, a rieseguire i lavori contestatigli, la Committente potrà far eseguire gli stessi ad altra impresa. Le maggiori spese che la Committente dovesse sostenere in dipendenza di quanto suipotizzato saranno ISAB S.r.l. – CAPITOLATO GENERALE APPALTO LAVORI Edizione marzo 2009 Pag. 4 di 18 addebitate all'Appaltatore a deconto delle sue fatture, fatto salvo il diritto al risarcimento dei danni. 5.2 Il rappresentante della Committente, od altra persona a ciò incaricata, potrà accedere in qualsiasi momento e circostanza agli uffici, officine di cantiere, ai magazzini e/o alle officine dell'Appaltatore e dei suoi fornitori, per effettuare tutti quei controlli ritenuti dallo stesso necessari. 5.3 Nell’espletamento dei suoi compiti, il Rappresentante della Committente non avrà responsabilità alcuna nei confronti sia dell'Appaltatore, sia di qualsiasi terzo, per ogni evento o danno che potesse verificarsi nel corso o comunque in occasione ed in conseguenza dell'esecuzione dei lavori. Saranno del tutto escluse dai compiti del Rappresentante della Committente tutte le incombenze relative alla gestione del Cantiere, alla sorveglianza della mano d'opera e dell'esecuzione materiale dei lavori, manutenzione e funzionamento delle opere di qualunque genere, incombenze tutte che sono e devono rimanere di esclusiva competenza e responsabilità dell'Appaltatore. 6. DIREZIONE DEI LAVORI 6.1 L'Appaltatore designerà alla direzione dei lavori, a sua cura e spese, una persona in possesso delle necessarie capacità professionali e delle qualifiche richieste dalla legge, che assumerà le funzioni di Direttore dei lavori. I compiti del Direttore dei lavori sono quelli previsti dalle vigenti disposizioni di legge in materia. Il nominativo di tale persona dovrà essere comunicato dall'Appaltatore alla Committente per iscritto. 6.2 Qualora l'Appaltatore, in relazione alla natura dei lavori, non ritenga necessaria la presenza continuativa del Direttore dei lavori sui luoghi del lavori provvederà a nominare a sua cura e spese, in aggiunta al Direttore dei lavori, un Capo Cantiere esperto e professionalmente qualificato, il quale sarà sui luoghi dei lavori in permanenza e per tutta la loro durata. Durante l'assenza del Direttore dei lavori il Capo Cantiere rappresenterà l'Appaltatore e pertanto la Committente potrà inviare al Capo Cantiere tutte le comunicazioni relative ai lavori oggetto dell'appalto che si rendessero necessarie. Il nominativo di tale persona dovrà essere comunicato dall'Appaltatore alla Committente per iscritto. 6.3 La Committente avrà la facoltà di nominare, ove previsto dalla vigente normativa (Titolo IV del D.Lgs. 81/08), un Responsabile dei Lavori cui spetteranno gli obblighi e gli adempimenti di cui alla normativa sopra citata. 7. ONERI A CARICO DELL'APPALTATORE Oltre a quanto annoverato negli altri articoli del presente Capitolato ed a quanto previsto nel testo del contratto, sarà a totale carico e spesa dell'Appaltatore, in via indicativa e non esclusiva, quanto segue: 7.1 Le prestazioni di proprio personale tecnico e amministrativo nonché la mano d'opera specializzata e comune per la direzione e l'esecuzione dei lavori. 7.2 Le prestazioni di proprio personale, degli attrezzi e degli strumenti per l'esecuzione delle misurazioni, dei tracciamenti e dei collaudi. 7.3 I costi per le assicurazioni obbligatorie di legge, nonché gli oneri retributivi per tutto il personale. 7.4 Le imposte, tasse, licenze e tributi connessi con il contratto ed imposti da autorità governative e/o altre autorità aventi giurisdizione sul contratto stesso. 7.5 Le spese per i viaggi, trasporti locali, trasferte, vitto e alloggio per il personale. 7.6 I materiali di consumo e di apporto, gli accessori di montaggio e di fissaggio, mezzi d'opera e i ponteggi, gli indumenti di protezione e di sicurezza e, in genere, tutti gli attrezzi per l'esecuzione dei lavori. Il tutto in accordo alle norme di legge ed a quelle, interne, delle Raffinerie della Committente. 7.7 La manutenzione ordinaria e straordinaria dei propri mezzi d'opera ed attrezzature, nonché la loro riparazione e i loro consumi (carburanti, lubrificanti, etc.). 7.8 Le spese di trasporto, assicurazione, sorveglianza e custodia per i materiali, le attrezzature, le baracche e i mezzi d'opera necessari per l'esecuzione dei lavori, rimanendo inteso che l'Appaltatore manleva la Committente da ogni responsabilità in caso di furto, incendio e danneggiamento. SCOPE OF THE GENERAL TERMS AND CONDITIONS These Contract General Terms and Conditions constitute an integral part, together with the other contractual documents (technical annex, price lists, specifications, plans and drawings, etc.) of the Contract stipulated by the Client and the Contractor. The clauses herein contained find their application, except when differently established in the Contract. In cases of divergence, the clauses contained in the Contract and its annexes will prevail on those of these Contract General Terms and Conditions. 2. GENERALITIES AND DEFINITIONS Each time that the following terms are used, they will have the meanings attributed to them. 2.1 Client: The Company that stipulates the contract with the Contractor. 2.2 Contractor: The Contracting Company hired for the execution of the Contract works. 2.3 Client Representative: The person appointed to represent the Client as specified in Art. 5.0. 2.4 Works Supervisor: The person possessing the necessary technical-professional capacities and who assumes, according to the legal norms in force, the position of Works Supervisor as specified in Art. 6.0. 2.5 Works Execution Coordinator: The person possessing the necessary experience and professionally qualified, appointed to represent the Contractor during the absence of the Works Supervisor as specified in Art. 6.0. 2.6 Project Supervisor: The person possessing the necessary technical-professional capacities and who assumes, according to the legal norms in force, the position of Project Supervisor as specified in Art. 6.0. 3. SAFETY NORMS Inspection and awareness of the workplace and work conditions. 3.1 The Contractor agrees to respect and enforce his own employees and the persons to which they respond to respect all the legal norms and regulations in force regarding health, safety and prevention of accidents in the workplace. 3.2 The Contractor thus assumes the obligation to scrupulously adhere to all the legal norms and regulations in force, as well as the particular dispositions in force within the Raffinerie by the Client that the Contractor declares to be aware of and to have received preventive information and the relative documentation by the Client himself. 3.3 The Contractor declares to have already seen the areas where the Works will be carried out and to be fully aware or the risks inherent in the workplaces that are subject of the Contract and to have received all the necessary information from the Client regarding the aforesaid risks and the accident prevention and emergency measures adopted by the Client himself in relation to the latter’s activities. 3.4 The Contractor further declares to have seen the risk evaluation document drawn up by the Client (D.U.V.R.I.), pursuant Art. 26, sub-section 3 of Legislative Decree 81/08, available on the Internet site www.erg.it and to thus be aware of the risks that exist in the environment in which he will work as well as the accident prevention and emergency measures adopted in relation to the Client’s activity and of the possible activities of other Companies involved in the execution of the works. 3.5 He furthermore declares to have considered, in the formulation of the price, all the circumstances and as of now renounces any additional compensation or indemnity, assuming every risk and charge himself. ____________________________________________________________________________ ISAB S.r.l. – CONTRACT GENERAL TERMS AND CONDITIONS March 2009 Issue Page 3 of 18 4. PLANNING 4.1 The works subject of this Contract can be illustrated by conceptual diagrams made available by the Client. Such diagrams will in general have the purpose of indicating the general layout, the disposition and size of the works. The Contractor must draft at his own expense, by an Engineer appointed by him, regularly registered in the professional rolls, the definitive project of the works, complete with the calculations of the weight-bearing structures, including those in reinforced concrete and metallic framework. However, the Client, at his total discretion, reserves the right to have his own technicians or those he deems as reliable, draft the complete final project, complete with the calculation of the weight-bearing structures, including those in reinforced concrete and metallic framework, and in such case, the project must be signed for acceptance by the Works Supervisor who will assume the responsibility together with the Contractor. The Contractor is moreover bound to develop at his own expense the architectural project provided by the Client and the construction details on a 1:50 scale based on the calculation of the weight-bearing structures previously indicated. Works in reinforced concrete and metallic framework require a report by the Contractor to the competent Institutions and offices and to maintain the documents in the worksite, as well as the samples of the cubes of cement and the reinforcement metallic poles, as is set out by the relevant legal norms in force. The Contractor must also at his own expense present the competent Institutions and offices the stability tests and any other possible documentation that could be necessary that the Client will deliver to him. The final project drafted by the Contractor, complete in all details as indicated above, must be transmitted to the Client prior to the start of the works; the latter reserves the right to give his approval to the final project, though the Contractor remains totally responsible for the project itself. The same regulation is valid also for modifications and variations to the final project that may be requested by the Client “in the course of work”. At the termination of the works, the Contractor must provide to the Client, without any additional compensation, all the updated and detailed drawings and diagrams of the works carried out in a copy that can be reproduced, which will remain the property of the Client. 4.2 The Contractor is required however to: •check the carrying capacity of the foundation terrain, producing, upon Client request, all the certificates of the samples or tests carried out; •take into account, for the calculation of the structure, in addition to its own weight, also that of the fixed, accidental or mobile loads indicated by the Client; •check and control the projects, calculations and diagrams, thus assuming the connected responsibilities. Whenever the Contractor has not communicated his own observations or reservations in writing, prior to the start of the works, the project is understood as approved and accepted by the same; •carry out the works according to the best techniques and practices and with the use of top quality materials. 4.3 The Contractor will furthermore be required to ascertain if there are discrepancies between the diagrams provided by the Client and legal norms, and to immediately indicate them to the Client himself who will ensure that the necessary modifications are made. 5. CLIENT REPRESENTATIVE 5.1 The Client can be represented by someone appointed by him who does not necessarily have to be part of his own personnel, who will have the faculty of assisting in the execution of the works without however releasing the Contractor from his own responsibilities. The person appointed by the Client will have the faculty to verify the perfect fulfilment by the Contractor, who shall provide ample demonstration, of all the contractual prescriptions, and he may refuse those works that, at his sole discretion, have not been carried out correctly and with perfect workmanship. In such case the Contractor will be bound to once again carry out the works at his own expense. Should the Contractor be unable to carry out once again the contested works in the times established by the Client, the Client may have the same works carried out by another Company. The increased expenses that the Client may need to sustain in dependence on what is hypothesised will be charged to the Contractor and detracted from his invoices, maintaining the right of indemnity for damages. ____________________________________________________________________________ ISAB S.r.l. – CONTRACT GENERAL TERMS AND CONDITIONS March 2009 Issue Page 4 di 18 5.2 The Client representative, or any other person appointed to that role, may have access at any time and circumstance to offices, workshops of the work site, warehouses and / or workshops of the Contractor and his suppliers, to carry out all those controls deemed necessary by the same. 5.3 In the performing of its tasks, the Client Representative will have no liability towards either the Contractor or any third party, for any event or damages that could occur in the course or however in occasion and as a result of the execution of the works. The Client Representative will be completely excluded from the duties or the tasks related to worksite management, to the monitoring of labour and to the material execution of the works, maintenance and operation of the works of any kind, all tasks which are and must remain the exclusive responsibility the Contractor. 6. SUPERVISION OF THE WORKS 6.1 The Contractor shall designate the direction of the work, at his own expense, a person who possesses the necessary professional skills and qualifications required by law, who will assume the functions of Works Supervisor. The duties of the Works Supervisor are those set out in the applicable provisions of law. The name of that person must be communicated by the Contractor to the Client in writing. 6.2 If the Contractor, in relation to the nature of the works, is does not consider necessary the continuous presence of the Works Supervisor in the places of work, he will appoint at his own expense, in addition to the Works Supervisor, an expert and professionally qualified Works Execution Coordinator, who will work on the sites for their entire duration. During the absence of the Works Supervisor, the Works Execution Coordinator will represent the Contractor and thus the Client may send to the Works Execution Coordinator all communications relating to the work covered by the contract that may be necessary. The name of that person must be communicated by the Contractor to the Client in writing. 6.3 The Client will have the faculty to appoint, whenever set out by the norms in force (Title IV of Legislative Decree 81/08), a Project Supervisor who will have the obligations and the execution as per the afore cited norms. 7. CONTRACTOR PROVIDED SERVICES In addition to what is expressed in the other articles of these Contract General Terms, and to what is set out in the text of the Contract, the following is at the total expense to the Contractor, in an indicative and non-exclusive way: 7.1 The services of its own technical and administrative personnel as well as specialised and general labourers for the direction and execution of the works. 7.2 The services of its own personnel, of the tools and instruments for the execution of measurements, surveys and inspections. 7.3 The costs of insurance which is legally required, as well as the retribution expenses for all of its personnel. 7.4 The taxes, duties, licenses and fees connected with the Contract and imposed by the government and/or other authorities having jurisdiction on the Contract itself. 7.5 Expenses for travel, local transportation, transfers, food and lodging for the personnel. 7.6 Consumables and supplies, mounting hardware and brackets, work vehicles and scaffolding, protective and safety clothing and, in general, all the tools to carry out the work. All of it will be in accordance with the law and with the internal norms of the Raffinerie of the Client. 7.7 The ordinary and extraordinary maintenance of his own work vehicles and equipment, as well as their repair and their consumption (fuels, lubricants, etc.). 7.8 Transport costs, insurance, security and storage for materials, equipment, barracks and work vehicles necessary for the execution of the works, it being understood that the Contractor releases the Client from any liability in case of theft, fire and damage.

Le tappe del successo 1919 Nasce la Bialetti Alfonso Bialetti, apre a Crusinallo, Verbania, un’officina per la produzione di semilavorati in alluminio. Spinto dallo spirito imprenditoriale, trasforma la sua officina, Alfonso Bialetti & C. Fonderia in Conchiglia, in un atelier per la progettazione e produzione di prodotti finiti, pronti per il mercato. 1919 Le origini di Girmi Ad Omegna, nello stesso territorio e contemporaneamente alla nascita della Fonderia Bialetti, viene fondata la Cooperativa La Subalpina, che inizia a produrre casalinghi e articoli per profumerie e parrucchieri. Nel 1940 la cooperativa viene poi acquisita interamente dal sig. Mario Caldi, uno dei soci fondatori. Al termine della seconda guerra mondiale, le attività dell'impresa, furono riprese con la produzione di oggetti per la toelettatura e per il bagno. 1933 La Moka: un’invenzione rivoluzionaria Dal genio di Alfonso Bialetti, viene alla luce Moka Express. La Moka dal design Art Decò, rivoluziona il modo di preparare il caffè a casa e permette all’azienda, grazie anche all’ambizione dei figlio Renato, di affermarsi immediatamente tra i principali produttori italiani di caffettiere. 1938 Aeternum agli esordi A Lumezzane, in provincia di Brescia, Bortolo Bugatti, insieme ai suoi figli, fonda l’azienda che porta il suo nome, dedicandosi alla produzione di posate in ottone. Tra il 1954 e il 1955 inizia la produzione di strumenti da cottura in acciaio inox: in quello stesso periodo, l’Azienda assume il nome Aeternum. 1947 Il successo di Rondine Mentre Moka Express inizia ad arrivare sui mercati esteri, a Coccaglio, in provincia di Brescia, Francesco Ranzoni, nonno dell’attuale Presidente del gruppo, fonda un’Azienda specializzata nella produzione di pentole in alluminio: Rondine Italia. Negli anni ’80 la Società è tra le prime in Italia ad utilizzare il rivestimento antiaderente e introdurre la serigrafia sui propri prodotti da cottura. Nello stesso periodo Rondine Italia raggiunge un altro importante traguardo con la creazione della linea di strumenti da cottura in alluminio antiaderente Trudi, che diviene un’icona della produzione, grazie al mix vincente tra innovazione tecnica e stilistica con un eccellente rapporto qualità/prezzo, imponendo il marchio Rondine in Italia e all’estero. 1949 La Subalpina inizia la produzione dei piccoli elettrodomestici Di ritorno dal suo viaggio di nozze negli Stati Uniti, Carlo Caldi, figlio di Mario, decide di far specializzare la sua impresa nella riproduzione di piccoli elettrodomestici, gli stessi da cui era stato affascinato e che aveva acquistato nel paese nordamericano. 1954 Frullo: il primo frullatore italiano L'azienda piemontese lancia il Frullo, primo frullatore di produzione italiana, a cui fanno seguito il macinacaffè Mokaro nel 1956 e, un anno dopo, il frullatore Girmi. Quest'ultimo riscuote un importante successo commerciale, tanto che il suo nome, nato come contrazione delle parole "gira" e "miscela", nel 1961 diviene il nome dell'azienda rinominata Girmi - La Subalpina S.p.A. 1956 La pentola a pressione Debutta sul mercato Astral, la prima pentola a pressione Aeternum. Da questo momento la notorietà del marchio aumenta notevolmente, anche grazie alla figura del “Re Inox” e si afferma come leader nel settore degli strumenti da cottura, in particolare delle pentole a pressione in acciaio inox. Sono anche gli anni che vedono nascere le prime, indimenticabili campagne pubblicitarie e i primi caroselli. 1958 L’Omino coi baffi: icona dello stile Bialetti La notorietà del marchio Bialetti viene ulteriormente consolidata grazie ai rilevanti investimenti pubblicitari su Carosello, noto programma televisivo italiano, ed alla comunicazione incentrata sull’immagine dell’ “Omino con i baffi”, nato negli anni ’50 dalla matita di Paul Campani, che ne diviene il simbolo e tutt’oggi è presente sia sul marchio del Gruppo Bialetti Industrie che applicato sui prodotti del brand Bialetti. 1971 Nasce Girmi S.p.A. Girmi – La Subalpina S.p.A. prende il nome di Girmi S.p.A, affermandosi presto come leader in Italia nel settore dei piccoli elettrodomestici: oltre ai frullatori e macinacaffè, vengono prodotti ferri da stiro, forni elettrici, gelatiere, macchine da caffè e tostapane tecnologicamente all'avanguardia e apprezzati dal pubblico per il loro design e l'innovatività. 1993 Rondine acquisisce Bialetti Aziende dalla storia diversa, Bialetti e Rondine, ma accomunate dalla medesima vocazione alla qualità e all'innovazione tanto da indurre l’attuale Presidente, Francesco Ranzoni, ad acquistare da Faema una partecipazione rappresentativa dell’intero capitale sociale dell’Alfonso Bialetti & C. Una mossa imprenditoriale unica che, nel giro di pochi anni, ha originato tanti successi firmati dal mitico "Omino coi baffi". Qualche anno dopo, nel 1998, Rondine e Alfonso Bialetti & C. si uniscono. 2002 Nasce Bialetti Industrie In seguito all’acquisizione di Presmetalcasalinghi del 2000 e di Gb-Guido Bregna del 2001, leader nella produzione di caffettiere in acciaio e di accessori per la casa, si giunge alla nascita dell’attuale Bialetti Industrie S.p.A. Nel 2003 continua l’espansione con l’assorbimento dell’azienda Brevetti Bialetti e la creazione del capogruppo Bialetti Holding, che oggi distribuisce i marchi Bialetti, Rondine, Girmi, Aeternum e CEM. 2005 L’ingresso di Girmi e CEM nel Gruppo La volontà di essere ancor più competitivi nel mercato dei piccoli elettrodomestici porta all’acquisizione di un altro marchio storico, Girmi, le cui origini risalgono ad Omegna proprio nel 1919, come era stato per Bialetti. Nello stesso anno, con l’obiettivo di porre le basi di un sito produttivo e commerciale a servizio dell’area est-europea e mediorientale, il Gruppo Bialetti acquisisce CEM, società attiva nella produzione e commercializzazione di strumenti da cottura in alluminio antiaderente e con un marchio di forte riconoscibilità e tradizione in Turchia. 2006 Il Gruppo acquisisce Aeternum Bialetti Industrie si espande ulteriormente acquisendo Aeternum, lo storico marchio italiano leader nella produzione in acciaio nel settore degli strumenti da cottura e delle pentole a pressione. 2006 Mokona: l’ingresso nel mondo dell’espresso Uno strumento moderno, ma caratterizzato da un design retrò, ispirandosi alla celebre Moka Express: è così che si presenta Mokona, la macchina per espresso dall’innovativa funzionalità trivalente (capsule, cialde e caffè macinato), che l’ha resa immediatamente prodotto di punta nel relativo comparto di mercato e top seller di categoria. 2007 Bialetti Industrie arriva in Borsa È il 27 luglio quando Bialetti Industrie diventa una società quotata su MTA di Borsa Italiana. 2009 L’innovazione di Ceramic OK Per il rilancio del marchio Aeternum viene realizzata l’innovativa linea antiaderente dal rivestimento interno in ceramica. Si tratta della nuova frontiera degli strumenti da cottura per cucinare in modo sano e naturale, proprio come in un piatto! 2010 Bialetti lancia I Caffè d’Italia Nessuno meglio di Bialetti sa quale importanza abbia il rito del caffè nelle famiglie italiane: tradizioni e tecniche locali rendono unica e inconfondibile l’esperienza del caffè degustato nella propria città. Nascono così le capsule de I Caffè d’Italia, un vero e proprio viaggio sensoriale attraverso le eccellenze dell’espresso all’italiana, esaltando le differenze di abitudini e di gusto da nord a sud, passando per Torino, Venezia, Milano, Roma e Napoli. Nel 2014 l’intera linea è stata eletta dai consumatori Prodotto dell’Anno, affermandosi come punto di riferimento per tutti gli appassionati di questa dolce arte pasticcera! 2013 Petravera: il piacere di una cucina genuina Grande è l’investimento di Bialetti nel settore degli strumenti da cottura: nasce infatti la linea Donatello dotata dell’esclusivo rivestimento interno antiaderente Petravera. Il modo di cucinare viene rivoluzionato: i sapori di una cucina genuina si combinano al confort d’uso dell’innovativo rivestimento effetto pietra. 2014 Moka Induction: l’innovazione che preserva la tradizione Ancora una volta Bialetti presenta un’invenzione straordinaria nel settore delle caffettiere tradizionali: si tratta, infatti, della prima Moka adatta per essere utilizzata anche su piani a induzione.
