Resumen ejecutivo y recomendaciones
Los defensores y defensoras de derechos humanos en Guatemala ubican con claridad el año 2000 como el inicio de una dinámica de ataques que vulneran el derecho a defender derechos humanos. Los últimos seis años han visto la expansión del fenómeno y las consecuencias en la renovación del terror impulsado durante el enfrentamiento armado interno (1960-1996).
Este análisis, claro está, muestra un síntoma de un deterioro más global de la democracia guatemalteca, de la situación de los derechos humanos y del estancamiento del proceso de paz que significa que la posguerra está siendo bastante violenta y complicada. En este sentido, este informe presenta sólo la expresión de una de las formas de violencia que experimenta la Guatemala contemporánea.
El presente reporte es un análisis de la información sistematizada durante los primeros seis años de esta nueva fase de limitación del derecho a defender derechos humanos, así como un análisis más profundo sobre las diferencias en los patrones de los ataques de acuerdo al tipo de defensor atacado.
En líneas generales, se puede observar que en los últimos seis años, los ataques contra los defensores han venido en línea ascendente, sufriendo un drástico aumento durante el año 2005, en donde hubo un salto en la cantidad de ataques, equivalente al 84%. Este salto cuantitativo se ve matizado cuando se observa más detenidamente la conducta de los ataques por sector atacado. Los defensores de derechos civiles y políticos han mantenido desde el 2003 un número más o menos similar de ataques y una curva de aumento mucho menos prolongada. En cambio, los defensores de derechos económicos, sociales y culturales; así como los defensores de los derechos de los pueblos indígenas sufrieron un incremento dramático de ataques durante el 2005. En el caso del sector de los defensores de los derechos económicos, sociales y culturales, el cambio es de 32 ataques en el 2004 a 99 ataques en el 2005. En el caso del sector de los defensores de los derechos de los pueblos indígenas es de 6 ataques en el 2004 al 30 en el 2005.
La mayor parte de las violaciones en contra de los defensores y defensoras de derechos humanos lo constituyen las violaciones al derecho a la libertad y seguridad que se convierten en un valladar a enfrentar en el día a día para los y las defensoras, ya que con este tipo de ataques se reinstala el terror vivido durante el conflicto armado interno. Sin embargo, en los últimos seis años, 60 defensores y defensoras de derechos humanos han sido asesinados por defender el derecho a defender derechos humanos, mostrando como de la amenaza se pasa a la acción y ha habido defensores que han pagado con su vida el derecho a defender derechos humanos en un país que trata de construir la paz.
Otra problemática que confrontan los defensores de derechos humanos es la seguridad de las instalaciones e información de las organizaciones, 129 allanamientos afectaron a las organizaciones durante los seis años analizados. Por otra parte, en el 2004 se empezó a detectar una nueva modalidad de ataque que es conocida como la “criminalización” de la defensa de los derechos humanos” que consiste tanto en el acoso penal del ejercicio de los derechos de manifestación y reunión, así como el impulso de acusaciones penales en contra de defensores para distraer o parar la acción de defensa que se realiza. De este tipo de ataques se contabilizaron 44 ataques.
La sistematización desarrollada en torno a los ataques a defensores y defensoras de derechos humanos ha de incluir la grave situación de los operadores de justicia quienes enfrentan una compleja realidad. Aunque se carece de un órgano único de monitoreo de situación de lo que enfrentan jueces, magistrados y fiscales, lo que se deduce de la información existente es que el número de amenazas y asesinatos ocurridos a este grupo de defensores es similar al que enfrenta el resto de defensores. Sin embargo, en este entorno, los asesinatos son más frecuentes en contra de jueces y fiscales. Executive Summary and Recommendations
The Human Rights defenders in Guatemala clearly establish the year 2000 as the start of a series of attacks that weaken the defence of human rights. The passed six years have seen the extension of the problem and the consequences of the renewal of terror acts during the period of internal armed conflict from 1960 to 1996.
It is clear that this analysis displays the more global symptoms of deterioration of the Guatemalan democracy, the human rights situation, and the stalling of the peace process, which means that the post-war period is proving to be quite violent and complex. Taking this into consideration, this report only shows one of the forms of violence experienced in the Guatemala of today.
This report is an analysis of the systematic information gathered during the first six years of this new phase which limits the right to defend human rights, as well as a deeper analysis of the differences between the patterns of attack as regards to the kind of human rights defender that has been attacked.
In general terms, we can observe that attacks against human rights defenders have steadily progressed in the passed six years, culminating in a drastic rise in 2005 where the rate of attacks jumped 84%. This quantum leap is clarified further when we observe in more detail the characteristics of the aggression on each attacked sector. Political and Civil Rights defenders have sustained a more or less stabilised number of attacks since 2003, displaying a negligible upward curve. In contrast, defenders of economic, social and cultural rights, as well as defenders of the rights of the aboriginal population, suffered a dramatic increase of attacks during 2005. Specifically in the case of defenders of economic, social and cultural rights, the increase goes from 32 attacks in 2004 to 99 in 2005. As regards defenders of aboriginal rights, the increase is from 6 attacks in 2004 to 30 in 2005.
The majority of violations against Human Rights defenders are violations against the right to freedom and security. This is a constant stumbling block for the defenders that perpetuates the terror experienced during the period of internal armed conflict. In the passed six years however, 60 Human Rights defenders have been assassinated for trying to defend Human Rights, proving that the threat of violence leads to actual violence, with the result that Human Rights defenders have lost their lives whilst defending Human Rights in a country that is trying to build peace.
Another issue which confronts Human Rights defenders is the security of their facilities and the information available to the different organisations. 129 incidences of burglary were recorded in the different organisations during the six years of the study. Also, in 2004, a new form of attack, known as the “criminalisation” of Human Rights defence, was recorded. This consists in both the threat of jail terms for exercising the right to assembly and protest, along with the increase of legal accusations against the Human Rights defenders in order to delay or completely halt the intended defence act. A total of 44 attacks of this type were reported.
Along with the systemic attacks against Human Rights defenders, the dire situation in which the legal profession finds itself due to the complex reality that they are facing should also be mentioned. Although there is no single agency that monitors the situation in which judges, magistrates and lawyers find themselves, we can conclude from the current information available that the number of threats and murders against this group of defenders is similar to that which the Human Rights defenders are up against. El agente Patrol no impone restricciones de tamaño sobre el fichero param.hist.
El tamaño del fichero tampoco lo limita el SO en cuestión de ser de 32 o 64 bits, sino que está limitado por la aplicación ejecutada sobre el SO en cuestión. Si la aplicación ha sido compilada con soporte para ficheros masivos, entonces la aplicación sí puede buscar o realizar operaciones de fichero ya que la estructura de los datos utilizada para representar el desbordamiento de los ficheros es capaz de almacenar valores de envergadura.
El agente Patrol es consciente del soporte para ficheros masivos, por lo tanto el agente Patrol no restringe la operación de ficheros masivos siempre y cuando no haya restricciones impuestas a la hora de configurar los parámetros del SO cómo está expuesto a continuación:
1 – Limitación impuesta por "ulimig" (check ulimit -f)
La salida del “ulimit –f” deberá fijarse como “unlimited” o mayor ge 4 gigas. Por favor verifique que esto sea así. Si está fijado en 4 gigas, entonces cambie este límite por uno más alto, el cual según su cliente no llegue a alcanzar historial, pero que sea menor de 1 tera (esto es una limitación del sistema de archivos). Alternativamente, lo puedes fijar como “unlimited”.
Diagnósticos a capturar para investigar esto:
