Il existe une panoplie de mesures réglementaires potentiellement applicables à des fins de mutualisation d’ouvrages permettant d’installer des fibres optiques.
Ces mesures sont contenues dans le code des Postes et communications électroniques, le code de l’urbanisme, et le code de la voirie routière.
Cependant, aucune d'entre elle ne peut prétendre à une efficacité réelle.
Ces mesures n'ont en effet pas été conçues en fonction de l'objectif de mutualiser des fourreaux destinés aux communications électroniques, et sont donc inadaptées au contexte technico-règlementaire actuel.
Pour être efficaces, elles devront faire l'objet de rectifications, en général mineures.
La mission préconise en conséquence que le législateur groupe ces amendements dans un "paquet optique".
Une fois que les collectivités disposeront ainsi des moyens juridiques nécessaires, les actions suivantes pourront être lancées :
- La connaissance du patrimoine détaillé en fourreaux existants dans le sous-sol est le point de départ de toute action.
Deux voies sont possibles pour cela.
Un recensement par les communes, possibilité qui a un coût, dont la charge pourrait être allégée au niveau communal par des subventions des départements.
L’autre possibilité consiste à agir au niveau législatif, afin d’obliger l’opérateur historique à fournir ces éléments.
- L’établissement de schémas directeurs télécoms par les collectivités territoriales apparaît ensuite comme la seconde étape d’une démarche structurée.
Ceux-ci pourraient être intégrés aux SCOT, niveau adéquat de planification des réseaux.
Il serait nécessaire d’inciter les collectivités territoriales à élaborer ces schémas, et, là encore, les incitations départementales seraient un levier efficace de l’action.
Une modification mineure du code de l’urbanisme concernant les SCOT serait également un signal intéressant en direction des collectivités.
- Une condition importante de la mutualisation consiste à être informé au bon moment des initiatives des autres.
C’est pourquoi il parait intéressant de disposer d’un serveur national, accessible par tous les opérateurs, qui recenserait les travaux de nature télécom de toute commune.
- Il est souhaitable d’imposer aux opérateurs la pose de fourreaux additionnels lors de tous travaux de réseaux de télécommunications.
Cette obligation pourrait être laissée à l’initiative des communes en fonction de leur schéma directeur, et le règlement de voirie serait un outil efficace pour cela.
La mission ne considère pas nécessaire, en l'état actuel des choses, de réguler le prix de location des fourreaux, mais d'exercer une veille concurrentielle sur ce marché.

There exists a plethora of regulatory measures which could potentially be applied to achieve sharing of installations capable of carrying optical fibres.
These measures are contained in the Post and Electronic Communications Code, the Town Planning Code, and the Public Highways Code.
However none of these measures can actually claim to be effective.
They were not designed with the aim of promoting shared use of ducts for electronic communications, and so are not suited to the current regulatory and technical context.
If they are to be effective they will require some (generally minor) changes.
The study therefore recommends that the legislator should group these amendments together in a “cable bundle”.
Once local authorities have the necessary legal means available, it will then be possible to embark on the following actions:
- Detailed knowledge of the existing base of underground ducting is the starting point for any work.
There are two possible routes to achieve this.
Local authorities could produce an inventory: this option would involve a cost for the communes, which might be alleviated by subsidies from the départements.
The other option would involve legislative measures requiring the historic operator to provide this information.
- The second stage in a structured approach would be for local authorities to draw up telecoms master plans.
These could be incorporated in Area Structure Plans, which are the appropriate level for network planning.
It would be necessary to encourage local authorities to draw up these plans, and here again encouragement from the départements would be an effective lever.
A minor change to the Town Planning Code regarding Area Structure Plans would send a pertinent signal to local authorities.
- An important requirement for resource sharing is to receive timely information on work carried out by others.
For this reason it would be beneficial to have available a national server, which all operators could access, which would hold information on all telecoms-related work in any commune.
- It is desirable to impose a requirement on operators to lay additional ducting when carrying out telecoms network works.
This requirement could be left to the communes to specify in accordance with their master plan; highways regulations would be an effective tool for this.
The study does not consider it necessary, as things stand, to regulate the price of renting ducts, but recommends monitoring competition in this market.

Source text - French La mort de Jean-Baptiste fut la grande affaire de ma vie : elle rendit ma mère à ses chaînes et me donna la liberté.
Il n'y a pas de bon père, c'est la règle ; qu'on n'en tienne pas grief aux hommes mais au lien de paternité qui est pourri. Faire des enfants, rien de mieux ; en avoir, quelle iniquité ! Eût-il vécu, mon père se fût couché sur moi de tout son long et m'eût écrasé. Par chance, il est mort en bas âge ; au milieu des Énées qui portent sur le dos leurs Anchises, je passe d'une rive à l'autre, seul et détestant ces géniteurs invisibles à cheval sur leurs fils pour toute la vie ; j'ai laissé derrière moi un jeune mort qui n'eut pas le temps d'être mon père et qui pourrait être, aujourd'hui, mon fils. Fut-ce un mal ou un bien ? Je ne sais ; mais je souscris volontiers au verdict d'un éminent psychanalyste : je n'ai pas de Sur-moi.
Ce n'est pas tout de mourir : il faut mourir à temps.
