En relation avec l’habilitation pour agir et pour répondre à la demande en justice, on signale les droits qui sont censés de correspondre à la partie demanderesse; la titularité sur les marques dont on demande la radiation pour cause de défaut d’utilisation correspond à la partie demandée d’après les documents apportés.

En relación con la jurisdicción, se invocan las diversas disposiciones legales que se consideran aplicables para fundamentar la competencia de los tribunales españoles para conocer de la presente demanda, mencionando especialmente a estos efectos la Ley de Marcas, así como la Ley de Patentes, que se considera subsidiariamente aplicable al presente caso, en lo que a las competencias objetiva y territorial se refiere.
En cuanto a la legitimación para interponer la demanda y para oponerse a la misma, se invocan los derechos que se presumen atribuidos a la parte demandante; corresponde a la parte demandada, de conformidad con los documentos aportados, la titularidad de las marcas sobre cuya caducidad por falta de uso versa la presente demanda.

fee for Services: CLIENT will pay AGENT and/or any corporation or other third party acting on behalf of AGENT, (i) _____% percent of prize monies earned or received in Grand Slams and ATP tournaments and matches, excluding exhibitions, and Davis Cup matches that total between $_____________ and $________________ during this AGREEMENT, (ii) _____% percent of prize monies earned or received in Grand Slams and ATP tournaments and matches, excluding exhibitions, and Davis Cup matches in excess of $_______________ during this AGREEMENT, and (iii) _____% percent of all monies and/or other consideration earned or received by CLIENT, directly or indirectly, under any agreement(s) or contract(s) relating to CLIENT’s tennis endeavors entered into during this AGREEMENT, including, but not limited to, sponsorship or endorsement agreements and appearance fees or other remunerations for Grand Slams and ATP tournaments, exhibition matches, clinics, or any other monies not covered under Paragraphs 3A(i) and 3A(ii) herein. Commissions due AGENT shall become payable when such monies or other consideration are received by CLIENT and/or by any corporation or other third party acting on behalf of CLIENT. In no way is the aforesaid fees to be diminished by (a) any monies paid to any of CLIENT’s creditors (either by legal process or otherwise); and (b) any withholdings, deductions, and/or contributions at the source.
