TIFLIS.- Las tropas rusas que volvieron hoy a Poti "están destruyendo sus infraestructuras militares y navales", denunció el alcalde de ese puerto georgiano en el mar Negro, Iván Saguinadze, en declaraciones a la radio estatal de Georgia desde el lugar de los hechos.
Poco antes, el Ministerio de Asuntos Exteriores de Georgia había declarado que las autoridades del país trataban de saber cuál era el propósito que persiguen las fuerzas rusas en Poti, situado a 70 kilómetros al sur de Abjasia, la segunda región separatista georgiana. Poti es el principal puerto comercial de Georgia y cuenta con una terminal petrolera.
Esta mañana el Ministerio georgiano del Interior anunció que las tropas rusas habían abandonado Poti y comenzado a retirarse de la estratégica ciudad de Gori, situada 25 kilómetros al sur de la separatista región de Osetia del Sur. "Esperamos que también hoy las tropas rusas se retiren de Zugdidi (ciudad georgiana, casi en la frontera con Abjasia) y que tendremos todo el control sobre Gori", dijo Utiashvili.
Una columna de policías georgianos entró en Gori, donde fue recibida por efectivos de las tropas rusas. Según la cadena de televisión Rustavi-2, la columna georgiana, integrada por cerca de 30 vehículos de distinto tipo, llegó hasta el centro de la ciudad.
En las imágenes de la ciudad mostradas por Rustavi-2 se veían muy pocos habitantes y numerosos carros de combates y blindados rusos en el arcén de la carretera. Las tropas rusas se encuentran desde el miércoles en Gori, aunque según las autoridades de Georgia se comprometieron a abandonarla antes del mediodía de hoy (10.00 hora peninsular española).
El secretario del Consejo de Seguridad Nacional de Georgia, Alexandr Lomaya, dijo que una vez que la policía del país se haga cargo de la ciudad los desplazados podrán regresar a sus hogares. Según datos preliminares del Gobierno georgiano, cerca de 40.000 personas, el 80% de la población de Gori, huyeron de la ciudad ante el avance de las tropas rusas.
Sarkozy recibe garantías de que Rusia respetará el acuerdo de paz
El presidente francés, Nicolas Sarkozy, que hoy recibirá a la secretaria de Estado de Estados Unidos, Condoleezza Rice, de camino a Tiflis, ha recibido garantías de su homólogo ruso, Dmitri Medvedev, de que Rusia respetará el acuerdo de paz.
Ante las dudas surgidas en torno al final efectivo de las hostilidades en territorio georgiano, Sarkozy conversó anoche con el presidente ruso, según han informado fuentes oficiales francesas. "El presidente de la República ha recibido del presidente Medvedev la garantía de que Rusia respetará los compromisos contraídos", asegura un comunicado difundido por el Elíseo tras la conversación.
Dichos compromisos se refieren al acuerdo en seis puntos que Sarkozy negoció el martes primero con Medvédev y después con el presidente georgiano, Mijail Saakashvili, para poner fin a la guerra entre Rusia y Georgia por el territorio georgiano separatista de Osetia del Sur.
El acuerdo prevé, entre otras medidas, la retirada de las fuerzas de combate a las posiciones que ocupaban antes del comienzo de las operaciones y el respeto de la soberanía e integridad territorial de Georgia, condiciones que no parecen cumplirse sobre el terreno.
Moscú y Tiflis divergen en cuanto a la significación del acuerdo. El encuentro entre ambos tendrá lugar en el Fuerte de Brégançon, residencia oficial de verano de la presidencia de la República, situado en la Costa Azul muy cerca de donde Sarkozy pasa sus vacaciones. Al anunciar la misión de Rice, el presidente estadounidense tuvo el miércoles palabras muy duras con Rusia, a la que exigió que retire inmediatamente sus fuerzas de Georgia, país considerado el mejor aliado de Washington en el Cáucaso.

TIFLIS. - The Russian troops that returned to Poti today “are destroying the military and naval infrastructures" there, the mayor of this Georgian port on the Black sea, Iván Saguinadze denounced, in statements to the Georgia state radio straight from where the battles are taking place.
Some time prior, the Georgia's Ministry of Foreign Affairs had stated that the authorities of the country were trying to find out what the intention of the Russian forces in Poti was, which is located 70 kilometers to the South of Abkhazia, the second separatist Georgian region. Poti is the main commercial port of Georgia and relies on a petroleum terminal there.
This morning, the Georgian Ministry of the Interior announced that Russian troops had left Poti and begun withdrawing from the strategic city of Gori, located 25 kilometers to the South of the separatist region of Southern Ossetia. "We also expect the Russian troops to withdraw today from Zugdidi (Georgian city, almost at the border with Abkhazia) and that we will have full control over Gori ", Utiashvili said.

The above mentioned commitments refer to the six points’ agreement that Sarkozy negotiated on Tuesday the first, with Medvédev and later with the Georgian president, Mikhail Saakashvili, to put an end to the war between Russia and Georgia for the Georgian separatist territory of South Ossetia.
Among other measures, the agreement plans for, the retreat of the combat forces to the positions that they were occupying prior to the start of the combat operations and respect for Georgia's sovereignty and territorial integrity, conditions that do not seem to be implemented over the territory.
Moscow and Tiflis differ as regards the meaning of the agreement. The Russian authorities insist that Western authorities should force the Georgian officials in charge of signing a non-aggression agreement and refusing to negotiate the future of South Ossetia and Abkhazia, another rebel Georgian territory, with the current authorities of Tiflis whom they do not trust.
On their behalf, the Georgian authorities denounce the "imperialistic" ambitions of Moscow and the violation of its territorial integrity. Sarkozy, who wields the turn at the Presidency of the European Union this quarter, will host this evening, around 15:00 h (13:00 GMT), the head of American diplomacy, who has been entrusted by president George W. Bush, with a support mission of the Georgia authorities.
The meeting between both will take place in Fort Brégançon, official summer residence of the presidency of the Republic, located on the Côte d'Azur, close to where Sarkozy spends his vacation. On having announced Rice's mission, the American president had some very harsh words for Russia on Wednesday, to which it was required that the latter should immediately withdraw its forces from Georgia, considered Washington's best ally in the Caucasus.
Meanwhile, yesterday France obtained the support to its peace negotiations from its European allies, though Poland and the Baltic republics reproached Paris' lack of firmness facing Russia. The Twenty-seven in Brussels declared themselves ready to carry out a role on land by sending observers or mediators to the area to guarantee that both factions respect the truce conditions.
| French to English: Encore un pas vers l'adoption de principes directeurs sur l'extrême pauvreté et les droits de l'homme par le Conseil des droits de l'homme des Nations unies en 2010

Le Haut Commissariat aux droits de l'homme des Nations unies a organisé les 27 et 28 janvier 2009 au Palais Wilson ( à Genève) un séminaire sur le projet de principes directeurs sur l'extrême pauvreté et les droits de l'homme. http://www2.ohchr.org/english/issues/poverty/consultation/index.htm
Les conclusions de ce séminaire laissent entrevoir l'adoption de ces principes en 2010 par le Conseil des droits de l'homme.
Pendant deux jours, une centaine de personnes, des représentants d'Etats, des experts des droits de l'homme, des ONG ont donné leur avis sur un projet de principes directeurs destiné à orienter l'action des Etats, de la communauté internationale et de la société civile dans la lutte contre la misère.
José Bengoa, co-auteur du projet de principes directeurs sur l'extrême pauvreté et les droits de l'homme , a expliqué le long combat encore inachevé pour la mise en oeuvre des droits de l'homme dans le monde. Progressivement, les femmes, les enfants, les populations autochtones ont obtenu que des textes internationaux protègent leur accès aux droits de l'homme. A la demande du Père Joseph Wresinski et grâce à sa vision prophétique, les instances des droits de l'homme des Nations unies ont fait le lien entre l'extrême pauvreté et droits de l'homme. C'est ainsi qu'aujourd'hui, nous pouvons parler d'un instrument solide qui établit un élan et un cadre pour la lutte contre l'extrême pauvreté basée sur les droits de l'homme.
De façon tout à fait inhabituelle, plusieurs personnes connaissant une vie difficile ont pu prendre la parole durant la première matinée du séminaire.
Bernard Mourgeon, militant d'ATD Quart Monde, Lyon (France) a notamment déclaré:
« Je me bats pour que ce que j’ai vécu n’arrive pas à d’autres. Un projet de principes directeurs sur les droits de l'homme et l'extrême pauvreté m’intéresse si c’est un texte de combat contre la misère, pour que les personnes vivant dans la grande pauvreté aient un accès effectif aux droits de l'homme.
Par exemple l’article 18 dit que : « L’Etat doit tout spécialement veiller à la protection des groupes vulnérables de la population, entre autres les sans-logis, les enfants de la rue, les handicapés et les personnes âgées, qui sont les plus touchées par l’extrême pauvreté. »
Pour les sans-logis, les enfants vivant dans la rue, l’Etat ne doit pas se limiter à les protéger. Il faut qu’il les aide pour que leur situation disparaisse, qu'il mène un combat pour qu’il n’y ait plus jamais de personnes sans logement ou d’enfants qui vivent dans la rue.
Bernard Mougeon a également commenté les articles 10 et 16 du texte :
L’article 10 dit qu’il faut favoriser « la création d’instances d’évaluation et de contrôle auxquelles participent les personnes vivant dans l’extrême pauvreté. » Je suis à 100% d’accord pour qu’elles puissent donner leur avis. Mais Il faut créer les conditions pour qu'elles puissent participer vraiment, car ces personnes sont fragiles. Certaines aussi fragiles que du cristal.
Dans ce texte des principes directeurs, j’ai particulièrement aimé l’article 16 qui dit que :
« Les personnes vivant dans l’extrême pauvreté ont le droit de former une famille, d’entretenir leurs enfants, d’en prendre soin, de les éduquer, et de jouir de la dignité fondamentale inhérente à tout être humain, assurant le respect de la vie privée et familiale. »
Cet article 16, c’est le rêve de vie de tous ceux qui ont eu une vie très difficile. C’est mon rêve. Si je peux former une famille et prendre soin de mes enfants, ça veut dire que j’ai un travail, que mes enfants vont à l’école, que je peux les soigner. Cet article 16 devrait être mis en tête de tous les textes qui parlent de la lutte contre la misère. »
Silvia Velasco, militante d'ATD Quart Monde, a participé en juin 2007 à Cusco (Pérou), aux consultations organisées par ATD Quart Monde et plusieurs ONG avec le représentant du défenseur du peuple, avec Jose Bengoa, co-rédacteur du texte, et quelques fonctionnaires. A la fin de son intervention, elle a demandé aux représentants des Etats :
« Nous espérons que vous et vos Etats, adopterez, ces projets de principes directeurs pour que les droits de l'homme soient réellement respectés pour tous et par tous. »
Puis elle a cité un participant de la consultation de Cusco : « Ces consultations sont un moment significatif parce que nous avons planté une graine dans la terre pour qu'à l'avenir, nos enfants ne vivent pas dans la même misère que nous et pour qu'ils récoltent les fruits de cette graine, car ils sont l'avenir du monde. »

L'ensemble du texte a été discuté par les participants en respectant une égalité de parole entre tous. Ce qui a donné des débats vraiment interactifs et une place réelle aux ONG. Onze ONG avaient envoyé au Haut Commissariat aux droits de l'homme des commentaires sur le projet de principes directeurs.
Les thèmes suivants ont ainsi été abordés :
• Les principes transversaux qui sous-tendent une approche de la lutte contre l'extrême pauvreté basée sur les droits de l'homme:
Indivisibilité et interdépendance des droits - Egalité, non-discrimination et non- stigmatisation des personnes vivant dans l'extrême pauvreté - Participation des personnes vivant dans l'extrême pauvreté - Transparence - Nécessité pour les responsables de rendre des comptes.
• Accès aux droits :
Droits civils et politiques, à l'enregistrement à l'état civil, à la participation, droit à une alimentation adéquate, droit à un niveau de vie suffisant, accès aux soins, droit à l'eau potable et à l'assainissement, au logement, à l'éducation et à la culture, au travail décent et à la sécurité sociale, droit à la justice.
• Obligations internationales et coopération.
• Coopération et responsabilités des acteurs non-étatiques.
Eugen Brand, Délégué général d'ATD Quart Monde, a notamment insisté pour l'on distingue bien la pauvreté de l'extrême pauvreté, d'une façon dynamique et sans opposer les deux notions, car selon la conjoncture les niveaux de pauvreté et d'extrême pauvreté varient.
Si l'on élabore seulement des politiques de lutte contre la pauvreté générale ou bien des politiques visant à protéger telle ou telle catégorie de population, nous craignons, et nous l'avons vérifié de nombreuses fois, que le noyau dur de l'extrême pauvreté ne soit pas atteint par ces politiques.
Si la communauté internationale et les Etats sont capables de créer des politiques globales et cohérentes de lutte contre l'extrême pauvreté, elles protégeront également les populations en risque de tomber dans l'extrême pauvreté lorsque des crises apparaissent.
Le projet de principes de directeurs sur l'extrême pauvreté et les droits de l'homme préconise une approche de la lutte contre la pauvreté basée sur les droits de l'homme. Pour rester fidèle à cette orientation fondamentale, il est nécessaire de prendre en compte et de partir des situations extrêmes de pauvreté.
Le Mouvement ATD Quart Monde a proposé que la définition utilisée par Leandro Despouy dans son rapport final sur les droits de l'homme et l'extrême pauvreté, soit retenue pour le projet de principes directeurs sur l'extrême pauvreté et les droits de l'homme.

Sur proposition de la France, appuyée par le Chili, la Belgique, le Pérou, le Brésil, la Suisse, le Venezuela, puis les ONG présentes, un large consensus s'est dégagé entre les représentants des Etats pour :
• que le texte final des principes directeurs soit centré sur l'extrême pauvreté qui concerne tous les pays du monde ;
• que le processus de consultation qui a eu lieu jusqu'à maintenant se poursuive jusqu'à la rédaction finale (et donc permette la participation des ONG au sein desquelles les personnes vivant dans l'extrême pauvreté s'expriment) ;
• qu'il rappelle les normes internationales existantes et les décline en recommandations opérationnelles aux Etats et aux différents acteurs ;
• que le Conseil des droits de l'homme mandate l'experte indépendante sur l'extrême pauvreté, Magdalena Sepulveda, pour rédiger le texte final qui sera ensuite soumis au vote du Conseil des droits de l'homme sous une forme à définir.
Magdalena Sepulveda a déclaré que le texte a une vraie légitimité et constituera un instrument puissant pour rappeler aux Etats, à la communauté internationale et à l'ensemble des acteurs, leurs obligations en ce qui concerne la lutte contre l'extrême pauvreté et l'exclusion sociale à un moment où la crise financière menace et aggrave la vie de millions de personnes.

Sans aucun doute, l'ensemble de nos actions publiques de mobi-lisation contre la misère et pour l'accès des personnes les plus défa-vorisées aux droits de l'homme ont aussi contribué à cette étape importante qui devrait déboucher en 2010 sur l'adoption de principes directeurs sur l'extrême pauvreté et les droits de l'homme par le Conseil des droits de l'homme des Nations unies.

The conclusions of this seminar anticipate the adoption of these principles in 2010 by the Human Rights Council.
Over two days, hundreds of people, Nation representatives, experts on human rights, and NGO's expressed their opinions concerning the draft guiding principles intended to guide the action of Nations, of the international community and non-trading partnerships in the fight to strive for a world without despair.
José Bengoa, co-author of the draft guiding principles on extreme poverty and human rights , explained the long and still unfinished fight for implementation of human rights around the world. Women, children, and Aboriginal people have gradually ascertained that international texts protect their access to human rights. At the request of and thanks to the prophetic vision of Father Joseph Wresinski, United Nations human rights authorities have determined the link between extreme poverty and human rights. Therefore today, we can talk about a viable tool which establishes a momentum and a framework for the fight against extreme poverty based on human rights.
In a completely exceptional way, several individuals having experienced life's cruel hardships, were able to speak during the first morning of the seminar.
Bernard Mourgeon, ATD Fourth World activist, Lyon (France) stated in particular:
«I am fighting so what I have lived through does not happen to others. A draft guiding principles on human rights and extreme poverty interests me if it is a motivational text to fight against despair, so that persons living in extreme poverty have veritable access to human rights.
Article 18 for example states that: «The State must be particularly vigilant to protect the most vulnerable groups of the world population, among others the homeless, children living in the street, the handicapped and the elderly, who are the most affected by extreme poverty.»
For the homeless and children living on the street, the State must not be limited to protecting them. It is necessary for them to be helped so that their plight is eradicated, so that it leads a fight so that there are never any people without a place to live or children living on the street.
Bernard Mougeon also commented on articles 10 and 16 of the text:
Article 10 says that it is necessary to encourage «the creation of assessment and monitoring authorities in which those living in extreme poverty can participate.» I agree 100 % so that they may give their own opinion. However, it is necessary to create the conditions so that those affected may truly participate, given that these persons are frail. Some are as frail as crystal.
I particularly loved article 16 in this text of the guiding principles which says that:

This article 16, is the life-long dream of all those who have led a very difficult life. It is my dream. If I can start a family and take care of my children, which means that I have a job, that my children go to the school, and that I can take care of them. This article 16 should be put at the forefront of all texts which talk about the fight against despair.»

At the end of her speech, she asked the Nations' representatives :
«We hope that you and your Nations, will adopt these drafts guiding principles so that human rights are truly respected for all and by all.»
She then quoted a participant of the Cusco consultation: «These consultations are a significant time because we planted a seed in the land so that in the future, our children will not live in the same despair as us and so that they may harvest the fruits of this seed, since they are the future of the world.»

The entire text was discussed by the participants by respecting equality of speech among all. Which provided for truly interactive debates and a real position to the NGO's. Eleven NGO's had sent comments on the draft guiding principles to the High commission on human rights.
The following subjects were therefore broached:
• The cross-cutting principles which underlie an approach of the fight against extreme poverty based on human rights:
Indivisibility and interdependence of rights - Equality, non-discrimination and non-stigmatization of persons living in extreme poverty - Participation of persons living in extreme poverty - Visibility - Necessity for those in charge to provide an appropriate progress report.
• Access to rights:
Civil and political laws, to registration of family status, to participation, the right for adequate food, the right to a suitable standard of living, access to care, the right to drinking water and purification, to housing, to education and to culture, to decent work and Social Security, and the right to justice.
• International obligations and cooperation.
• Cooperation and responsibilities of the non-nation players.
Eugen Brand, the Delegate general of ATD Fourth World, particularly insisted on clearly distinguishing between the poverty of extreme poverty, dynamically and without contrasting the two notions, since according to the circumstances, poverty levels and extreme poverty may vary.
If we simply develop policies on the fight against wide spread poverty or rather policies aiming at protecting such and such a population category, we fear, and we have verified it numerous times, that the hard core of extreme poverty is not reached by these policies.
If the international community and Nations are capable of creating comprehensive and consistent policies to fight against extreme poverty, they will also protect the populations in risk from falling into extreme poverty when crises arise.
The draft guiding principles on extreme poverty and human rights recommend an approach on the fight against poverty based on human rights. In order to remain faithful to this fundamental course, it is necessary to take into account and to start from extreme situations of poverty.
The ATD Fourth World Movement proposed that the definition used by Leandro Despouy in his final report on human rights and extreme poverty, be retained for the draft guiding principles on extreme poverty and human rights.

On France's proposition, supported by Chile, Belgium, Peru, Brazil, Switzerland, Venezuela, then the NGO's present, a wide consensus emerged among the Nations' representatives:
• so that the final guiding principles text be focused on extreme poverty which concerns all the countries of the world;
• so that the consultation process which has taken until today, may continue until to the final drafting (and therefore allow the participation of NGO's within which those living in extreme poverty to express themselves);
• so that it evokes the existing international standards and turns them down in operational recommendations to Nations and to the various key players;
• so that the Human Rights Council appoints an independent expert on extreme poverty, Magdalena Sepulveda, to draft the final text which will then be submitted to the Human Rights Council for vote under a procedure yet to be defined.
Magdalena Sepulveda stated that the text has true legitimacy and will constitute a powerful tool to remind Nations, the international community and all other key players, of their obligations as regards the fight against extreme poverty and social exclusion at a time when the financial crisis threatens and makes life worse for millions of people.

Without a doubt, all of our public outreach activities against despair and for access to human rights for the most discriminated people, has also contributed to this important step, which should emerge in 2010, on the adoption of guiding principles on extreme poverty and human rights by the United Nations Human Right Council.
