45. What is apparent from the further evidence and which is non-contentious is as follows:
• On 9 May and 13 May 2006 F was taken to Sydney airport;
• On each occasion he refused to board a flight to the United States;
• On each occasion he informed his father and the authorities that he did not want to return to the United States;
• On the first occasion the father’s attempts to persuade the child to join him voluntarily were unsuccessful and the father then desisted from any further attempt to force the child onto the plane;
• On the second occasion the Federal police officer approached the child who was crying and saying that he was not willing to get on the plane. The officer then said to F something like “What will you do if I have to pick you up and carry you onto the plane?”. F said “I won’t go” and started crying more. The officer then grabbed hold of F’s upper arm and attempted to pull him off the seat. F reacted by pulling his arm free and attempting to move his body further away. F was also holding tightly onto the seat handles and cushion. The officer desisted and stepped back as it became evident that F was becoming more distressed. The Federal Police refused to apply any further force to the child. The father was then invited to attempt to persuade the child to join him on the plane but the child resisted any of his father’s entreaties.
46. The father’s evidence concerning the events surrounding 9 May 2006 would indicate that the maternal grandmother was fully supportive of the child in his resistance to return to the United States. She insisted on accompanying the child to the airport and at the airport told the father to “[l]eave the child alone. Can you hear he doesn’t want to go back with you”. Whilst there may be reason to question whether the child’s reactions might have been different if the maternal grandmother had appeared to be supportive of the return order, the reality is that the child was hostile and oppositional. The grandmother’s empathy could not be seen to detract from that reality.
The counselling report
47. The counselling report prepared by Ms C details three one hour interviews with F on 16 June, 23 June and 4 July 2006 as well as shorter interviews with the mother, the father and the maternal grandmother. The reporter indicates that she discussed with the child the nature of the Hague Convention which had set out rules for what should happen if a child is moved between countries where both parents have not agreed that that should have occurred. It is not apparent that the reporter explained to the child that the nature of a return under the Hague Convention was so that the courts in the country to where the child was being returned could then decide the issue as to where the child should live and that accordingly any return to the United States may only be a temporary one. The reporter concluded that from her interviews with the child it was evident that the child’s views of his relationship with his father had become significantly more negative. She noted that his unambivalent strident rejection of the father, with no apparent guilt or conflict, was consistent with the child being alienated.
48. The reporter noted that she was surprised that the father did not seem to have considered the impact on F’s welfare if he was removed from Australia and relocated back to the United States and the emotional and psychological cost of this on the child. The reporter further noted considerable animosity between the mother, her mother and the father. It was long standing and pre-dated the move from America to Australia. She further reported that her counselling sessions with the child did not have any positive impact on the child’s re-evaluation of his relationship with his father. She reported that if any headway was to be made in healing the relationship, long term family counselling of over 12 months by an experienced practitioner needed to be conducted.
49. The reporter then noted that the child retained a strong conviction that he objected to being returned to America. He saw his father as unsafe and someone who did not listen to him. He said that he would resist any attempts to force him onto the plane by kicking and screaming, and that if he was forcibly taken back to America he would run away.
50. The reporter concluded that F had a:
“strong objection to going back to America...He stated he feels Australian and this is a strong feeling... [i]t is...likely his feelings about the USA have been influenced by his Mother and her family.”
51. The reporter observed that the psychological effect of returning the child to the United States was likely to be negative and adversely affect his welfare. If forced to return with the father this:
“is more like [sic] to lead to an escalation of bad feelings towards the Father over time and further breakdown in the Father/son relationship, and an increased likelihood of depression, acting out behaviours, self harming behaviours and school failure.”
52. The psychologist commented that the child had demonstrated a sufficient level of maturity, that it was appropriate to take his views into account, he having demonstrated the use of emotions as an internal monitoring and guidance system and was able to participate in exploring hypothetical situations. The reporter was clearly of the view that the child’s objection showed a strength of feeling beyond mere expression of preference or ordinary wishes. The forcible removal to the airport had galvanised the child’s belief that it was up to him to fight for what he wanted.
The effect of the further evidence
53. The trial judge had concluded, after having read the welfare reports of KB and heard her cross examination, that the child’s objections were to separation from the people he wanted to live with rather than an objection to returning to the United States, and that although he had expressed the wishes in melodramatic terms, they did not show a strength of feeling beyond the mere expression of a preference or ordinary wish. She had further concluded that the child did not understand the real issues and did not distinguish between leaving one parent’s household for another as against leaving one country for another.
54. There has been considerable discussion in the cases in the texts on precisely what it is that the child objects to. The relevant regulation talks about the child objecting to “being returned”. Several of the cases have endeavoured to read down that phrase to mean effectively being returned to the country of habitual residence for the purposes of enabling that country to determine where and with whom the child should reside. The view was expressed by the Full Court (Barblett DCJ, Ellis and Lindenmayer JJ) in Director General of Department of Community Services and Crowe (1996) FLC 92-717 and reaffirmed in De L and Director General NSW Department of Community Services (1997) 21 Fam LR 413 at 426 that the objection was an objection to being returned to the country of the child’s habitual residence and not to living with a particular parent. The Court went on in De L to say:
“However, as was pointed out by Balcome LJ in Re R (Child Abduction: Acquiescence) (1995) 1 FLR 716, there may be cases ‘where the two factors are so inevitably and inextricably linked that they cannot be separated’.
...
We would not suggest that children must articulate that they object to being returned to the country of their habitual residence for the purpose of enabling the courts of that country to resolve the merits of any dispute as to where and with whom they should live in order to come within the provisions of reg. 16(3)(c). That is not the language of children and the Court should not expect them to formulate and articulate their objection, if they had objected in the relevant sense, in that manner. The Court must have regard to the whole of the evidence and determine, no matter how the children articulate their views, whether the children object in the relevant sense.”
55. In Agee and Agee (2000) FLC 93-055 a differently constituted Full Court (Finn, Holden and Guest JJ) questioned whether it was appropriate to place any gloss upon the words “objects to being returned” to import the words “so that the courts of that country may resolve the merits of any dispute as to where and with whom the child should live”.
56. Ultimately it is unnecessary for us in this case to further comment upon the argument. In our view the evidence is now overwhelming that the child objects to being returned to the United States. Whether that is because of the absence of his primary caregiver or is based upon real or imagined memories of life in the United States as compared to life in Australia, it is clear that the child’s objections are firm and have been rationally explained by him.
57. Because of the introduction of the further evidence, we find it unnecessary to deal with the grounds of appeal that assert error on behalf of the trial judge. The case that we are examining now is a different case to the case that the trial judge dealt with. Events have taken a much more dramatic course. The child has now experienced the execution of a warrant that resulted in his being placed into foster care, two trips to the airport with attempts to have him board the plane, including some mild force being applied, and several sessions of counselling in an endeavour to have him change his view. All of these events have proven unsuccessful. The evidence before us inextricably draws us to the conclusion that the requirements of Regulation 16(3) have been met and that the mother has clearly established that F objects to being returned to the United States, his objection shows a strength of feeling beyond a mere expression of a preference or an ordinary wish and that he has attained an age and degree of maturity at which it is appropriate to take account of his views.
58. In their monograph entitled “The Hague Convention on International Child Abduction”, Paul Beaumont and Peter McEleavy, (Oxford University Press, 1999) note at page 178:
“Sixteen was taken as the outer limit for the scope of the Convention because it was agreed that persons over that age had a mind of their own which could be ignored neither by their parents nor the State. For those slightly younger a discretion was required to avoid forcible repatriations, which it was envisaged could have had a detrimental effect on the public perception of the Treaty.”
Discretion revisited
59. In our view, in light of the events that have occurred since Lawrie J’s judgment, including the material contained in the additional welfare report, it is clear that an exception to mandatory return has been established. That now requires us to determine the manner in which the discretion to make a return order should be now exercised.
60. There are two other reported cases in which children have refused to cooperate in being flown out of the country. In Re HB (Abduction: Children’s Objections) (No 2) [1998] 1 FLR 564, Hale J (as she then was) dealt with a matter that had been remitted to her after a visit to the Court of Appeal. In October 1996 Hale J had ordered that children then aged 13 and 11½ should be returned from England to Denmark notwithstanding that it was contrary to their expressed wishes. The younger child refused to board the plane. The child was given leave to become a party to the proceedings and leave to appeal against the order. The Court of Appeal granted the child leave and remitted the matter for further hearing on the basis that there had been a fundamental change in the circumstances since the original decision (see Re HB (Abduction: Children’s Objections) (No 2) [1998] 1 FLR 564). In Re HB the children had been overheld in England from August 1996. When the matter came on for rehearing in November 1997 15 months had passed. The younger child was extremely resistant to live with her mother in Denmark. Hale J said (emphasis added):
“It is obvious that there are now very serious questions about where the best interests of both these children lie. Mr Nicholls points out that the object of the Hague Convention is set out in its preamble. In essence this is to further the best interests of children by ensuring their speedy return to the country where they have been habitually resident. Once the time for a speedy return has passed, it must be questioned whether it is indeed in the best interests of a child for there to be a summary return after the very limited inquiry into the merits which is involved in these cases. Article 12 of the Convention recognises this by allowing the court to refuse to return the child if proceedings are brought more than a year after the wrongful removal or retention of the child where the child is now settled in its new environment.
For all these reasons, it seems to me inevitable that the Hague Convention proceedings must be dismissed.”
61. In Re M (A minor) (Child Abduction) [1994) 1 FLR 390 the Court of Appeal were faced with the circumstances where children aged 11 and 10 had been ordered to return to their father in Australia after their mother had, without consent, brought them to England. The children were placed on a flight as unaccompanied minors and the elder child created a scene and tried to open the aircraft door as the aircraft was taxiing. The captain refused to fly with him on board and aborted the flight. The two boys were handed over to the social services and detained at the airport. The Court of Appeal said that the behaviour of the eldest child amounted to a fundamental change in the position that had been presented to the trial judge, that it was proper to set aside the consent order made and reconsider the children’s position. It was appropriate to have the matter remitted for rehearing.
62. In Re SC (A Child) [2005] EWHC 2205 (Fam Div) Nicholas Mostyn QC sitting as a Deputy High Court judge when dealing with a case involving a child who had been wrongfully removed from the United States in 1999 and secreted in England for more than four years said:
“It is clear to me (at least) that notwithstanding the grievous wrong done to F; notwithstanding the deceit and subterfuge perpetrated by M; and notwithstanding the existence of a Californian custody order, that it was in October 2003 or at any time thereafter inconceivable that an English court would have returned S to California for a custody trial there.”
His Honour then went on to deal with competing claims for residence and contact saying:
“I recognise that all manner of moral and philosophical objections can be raised to this view. No doubt F, and his many supporters in California and Ireland would say that in taking this view I am rewarding the worst kind of turpitude and encouraging a kidnapper’s charter which says that if someone can successfully abduct a child for sufficiently long period of time then that person will get away from it. But these views have to be subordinated to the child’s best interests and in my view it would be a breach of the judicial duty to sacrifice a child’s best interests in order to prove a point of principle.”

45. Lo que se evidencia de los siguientes testimonios y que no es objeto de controversia es lo que se menciona a continuación:
• El día 9 de Mayo de 2006 F fue trasladado hasta el aeropuerto de Sydney;
• Reiteradamente este se negó a embarcar en un avión hacia los Estados Unidos de América;
• Reiteradamente este comunicó a su padre y a las autoridades su voluntad de no regresar a los Estados Unidos de América;
• La primera vez, los intentos de convencer al niño de reunirse con él voluntariamente fueron infructuosos y el padre desistió entonces de realizar cualquier otro intento de obligar a el niño a subir al avión;
• En la segunda ocasión el oficial de la policía federal se acercó al niño que estaba llorando y que decía que no quería subir al avión. El oficial entonces le dijo a F algo como " ¿Qué harías si te cojo y te subo al avión?". F le respondió algo similar a " No iré" y comenzó otra vez a llorar más. El oficial, en ese momento, sujetó al niño de su antebrazo e hizo mención de arrastrarlo de su asiento.
• F reaccionó moviendo su brazo libre intentando mover su cuerpo hacia la otra dirección. F se estaba sujetando fuertemente a los brazos del asiento y al respaldo. El oficial desistió y se retiró hacia atrás ya que parecía evidente que F estaba poniéndose cada vez más incómodo. El policía federal renunció a aplicar más uso de la fuerza al niño. El padre fue entonces invitado a convencer al niño de que se uniera a él, pero el niño se resistió a todas las suplicas de su padre.
• El testimonio del padre respecto a los hechos acaecidos el 9 de Mayo de 2006 indicarían que la abuela materna apoyaba completamente al niño en su negativa a regresar a los Estados Unidos. Ella insistió en acompañar al niño al aeropuerto y en el aeropuerto le dijo al padre que "[d]ejara al niño en paz. ¿No te das cuenta de que no quiere volver contigo?". Aunque puede haber razones para cuestionarse si las reacciones del niño hubieran sido diferentes si la abuela materna se hubiera mostrado comprensiva con la orden de restitución, la realidad es que el niño era hostil y mostraba su oposición. La empatía de la abuela no parece que le hubiera hecho cambiar de actitud.
El informe de Mediación
47. El informe de mediación redactado por la Sra. C pormenoriza tres entrevistas de una hora con F el día 16 de junio, 23 de junio y 4 de julio de 2006 así como entrevistas más cortas con la madre. El informe indica que esta discutía con el niño acerca de la naturaleza de la Convención de la Haya, la cual había establecido las normas que funcionarían si un niño fuera trasladado a países donde ambos progenitores no hubieran convenido que esto fuera a suceder. No está claro que el informador explicara a el niño que la naturaleza de una restitución amparada en la Convención de la Haya era con el objeto de que los tribunales del país donde el niño iba a ser restituido pudieran decidir sobre la causa de dónde el niño debería vivir y que en consonancia cualquier regreso a los Estados Unidos sería temporal. El agente concluyó que derivado de estas entrevistas con el niño era indiscutible que la perspectiva del niño respecto a la relación con su padre se había vuelto notoriamente más negativa. Esta apreció que su rechazo radical sin ambivalencias hacia al padre, sin mostrar ningún tipo de culpa o conflicto interno, se correspondía con el hecho de que el niño estaba siendo alienado.
48. La agente percibió que ella estaba sorprendida de que el padre no pareciera haber tenido en cuenta el impacto en el bienestar de F en el caso de que fuera arrebatado de Australia y recolocado en los Estados Unidos y el coste psicológico y emocional de esto en el niño. La agente además constató que existía antipatía entre la madre, su madre y el padre. Esta era de larga duración y existía desde antes del traslado desde América a Australia. Esta además informó que sus sesiones de mediación con el niño no tuvieron ningún efecto positivo en la reconsideración por parte del niño de su relación con su padre. Esta informó que si se debía realizar algún avance para recuperar la relación, se debería llevar a cabo una mediación familiar de entorno a 12 meses por un asesor experimentado.
49. La agente entonces constató que el niño mantenía una fuerte convicción de que él objetaba ser devuelto a América. Este veía a su padre como una persona insegura y como alguien que no lo escuchaba. Este decía que se resistiría a cualquier tentativa de obligarle a subir al avión dando patadas y gritando, y que si fuera trasladado por la fuerza a América escaparía.
50. La agente llegó a la conclusión de que F tenía:
"una fuerte objeción a volver a América....Este afirmaba que se siente australiano y este es un sentimiento arraigado....es probable que sus sentimientos respecto a los EEUU hayan sido influenciados por su Madre y su familia."
51. El agente observó que el efecto psicológico del regreso del niño a los Estados Unidos afectaría con gran probabilidad negativa y adversamente su bienestar. Si fuera obligado a volver con su padre esto:
"es más como si se ocasionara una intensificación de malos sentimientos hacia el Padre de larga duración y a una posterior ruptura en la relación Padre/hijo/a, y una probabilidad aumentada de desarrollar una depresión, de tener comportamientos desaforados, comportamientos autodestructivos o a tender al fracaso escolar."
52. El psicólogo comentó que el niño había manifestado un nivel suficiente de madurez, y que era conveniente tener en cuenta sus opiniones, habiendo este demostrado el uso de las emociones como un monitorizado interno y un sistema de navegación y que era capaz de participar en la prospección de situaciones hipotéticas. La agente apostaba claramente por que la objeción del niño denotaba una solidez de sentimiento más allá de un amera expresión de preferencia o deseos ordinarios. El traslado forzoso al aeropuerto había reforzado la creencia de que dependía de él el luchar por lo que quería.
El efecto de las pruebas aportadas con posterioridad
53. El juez de la causa había concluido, después de haber leído los informes de Servicios Sociales de KB y de haber escuchado su contrainterrogatorio, que las objeciones del niño eran a la separación de las personas con las que quería vivir y no tanto una objeción a volver a los Estados Unidos, y que aunque él había expresado sus deseos de una manera melodramática, estos no denotaban una fuerza de sentimiento más allá de una mera expresión de una preferencia o un deseo ordinario. Ella había llegado a la conclusión posterior de que el niño no comprendía la temática real y no distinguía entre abandonar la vivienda de un progenitor para ir a otra y abandonar un país para ir a otro.
54. Ha habido una considerable discusión sobre los casos en los textos acerca precisamente de que es lo que el niño rechaza. La reglamentación pertinente habla de la objeción del niño a “ser repatriado". Varios de los casos se han esforzado en interpretar este enunciado con el significado efectivo de ser devuelto al país de residencia habitual con el propósito de permitir que el país determine dónde y con quien el niño debería residir. La opinión fue expresada por el Tribunal en Pleno ( Barblett DCJ, Ellis and Lindenmayer JJ) en Director General of Department of Community Services and Crowe (1996)FLC 92-717 y confirmado en De L and Director General NSW Department of Community Services (1997) 21 Fam LR 413 en 426 que la objeción era una objeción a ser devuelto al país de residencia habitual del niño/a y no a vivir con un progenitor en particular. El Tribunal continuó sobre De L diciendo:
"Sin embargo, como fuera señalado por Balcone LJ en Re R( Sustración de un Menor: Aquiescencia) (1995) 1FLR 716 , puede haber casos " donde los dos factores son tan inevitables e inextricablemente ligados que no pueden ser separados".
No sugeriríamos que los niños deban pronunciarse si se niegan a ser devueltos al país de su residencia habitual con el propósito de posibilitar a los tribunales de ese país que diluciden sobre los fondos de cualquier disputa respecto a dónde y con quien deberían seguir viviendo de acuerdo con lo dispuesto dentro de las condiciones del reglamento 16(3) (c). Ese no es el lenguaje de los niños y el Tribunal no esperará de ellos que formulen y articulen su objeción con ese estilo, si ellos hubieran objetado con un sentido inequívoco, de esa manera. El Tribunal debe tener consideración de las pruebas en su conjunto y determinar, sin tener en cuenta cómo el niño articula sus opiniones, si los niños objetan con un sentido inequívoco.
55. En Agee and Agee(2000) FLC 93-055 el Tribunal en Pleno, con unos miembros diferentes,(Finn, Holden y Guest JJ) preguntaron si era necesario adjuntar una anotación sobre las palabras: " sujetos que deben ser devueltos" para aportar las palabras: " para que los tribunales de ese país puedan dilucidar acerca de los pormenores de cualquier contencioso en cuanto a dónde y con quien debería vivir el niño".
56. En último lugar creemos innecesario en este caso deliberar más sobre la disputa. Desde nuestra perspectiva las pruebas corroboran nítidamente que el niño se niega a ser devuelto a los Estados Unidos. Bien sea debido a la ausencia de su principal figura cuidadora o a que esté basado en recuerdos reales o imaginarios de su vida en los Estados Unidos comparados a los de su vida en Australia, es claro que las objeciones del niño son firmes y han sido racionalmente expresadas por este.
57. A causa de la introducción de pruebas posteriores, encontramos innecesario tratar los antecedentes de la apelación que testifican un error en el fallo del juez de la causa. La causa que estamos examinando ahora es una causa diferente a aquella de la que se ocupaba el juez de la causa. Los acontecimientos han adquirido un matiz mucho más dramático. El niño ha experimentado ahora la ejecución de una orden judicial que acabó en su inserción en una casa de acogida, dos viajes al aeropuerto con intentos de hacerle embarcar en el avión, que incluyeron un uso leve de la fuerza, y varias sesiones de asesoría como una tentativa de hacerle cambiar de parecer. Todas estas acciones se han revelado infructuosas. Las evidencias que se nos presentan nos llevan a la conclusión de que los requisitos de la Reglamentación 16(3) se han suscrito y que la madre ha confirmado que F rechaza ser repatriado a los Estados Unidos de América, su objeción denota una solidez de sentimiento más allá de una mera expresión de una preferencia o un deseo ordinario y que este ha alcanzado una edad y un grado de madurez por la cual es conveniente tener en cuenta su opinión.
58. En su monográfico titulado "The Hague Convention on International Child Abduction", Paul Beaumont y Peter McEleavy, (Oxford University Press, 1999) indica en la página 178:
"Dieciséis fue adoptado como el limite superior para el alcance de la Convención porque fue convenido que las personas por encima de esa edad tendrían un raciocinio propio lo cual no podría ser ignorado ni por sus padres ni por el estado. Para aquellos ligeramente más jóvenes fue necesario adoptar una actitud prudente para evitar repatriaciones forzosas, las cuales se preveían podían tener un efecto perjudicial para le percepción pública del Tratado."
Vuelta a la prudencia
En nuestra opinión, a la luz de los acontecimientos que han ocurrido desde el dictamen de Lawrie J, que incluía el material contenido en el informe suplementario de servicios sociales, es evidente que se ha sentado un precedente con la excepción a la extradición. Lo cual nos exige determinar el modo en el cual se debería ahora ejercer la prudencia a la hora de realizar una orden de repatriación.
60. Hay otros dos casos que han sido comunicados, en los cuales los niños se han negado a cooperar a ser trasladados en avión fuera del país. En Re HB (Sustracción: Objeciones de los Niños) (No2) [1998] 1 FLR 564, Hale J (nombre que tenía entonces) trató con el caso que le había sido remitido después de una comparecencia en el Tribunal de Apelación. En octubre de 1996 Hale J había dictaminado que los niños en ese momento de edades de 13 y 11 y medio años debían ser extraditados de Inglaterra a Dinamarca a pesar de que esto fuera en contra de sus deseos manifestados. El más joven de los hermanos se negó a subirse al avión. El niño obtuvo licencia para convertirse en una parte en el proceso legal y licencia para instar una apelación contra el dictamen. El Tribunal de Apelación otorgó al niño la licencia y remitió el asunto para una posterior audiencia en base a que había habido un cambio fundamental en las circunstancias desde el dictamen original (ver Re HB (Sustracción: Objeciones de los Niños) (No2) [1998] 1 FLR 564). En Re HB los niños habían sido retenidos en Inglaterra desde agosto de 1996.Cuando el caso llegó para una nueva audiencia en noviembre de 1997 ya habían pasado 15 meses. El niño menor se mostró siempre reticente a vivir con su madre en Dinamarca. Hale J dijo (el énfasis ha sido resaltado):
Es obvio que hay ahora serias interrogantes sobre donde residen los intereses más apropiados para estos niños. El Sr. Nicholls resalta que el objetivo de la Convención de la Haya se halla establecido en su preámbulo. En esencia esta dedicada a promover los mejores intereses de los niños mediante la garantía de una pronta repatriación al país donde estos hubieran sido habitualmente residentes. Una vez que el regreso urgente ha pasado, debe ser cuestionado si es indudablemente para los mejores intereses del niño el ser devuelto inmediatamente tras la muy limitada investigación realizada acerca de los fundamentos del caso que está presente en estas causas. El artículo 12 de la Convención reconoce esto cuando permite al tribunal negarse a extraditar al niño si los procedimientos son mantenidos por más de un año posterior a la sustracción del niño o su retención de dónde el niño se encuentre asentado en su nuevo entorno. Por todas estas razones, me parece inevitable desestimar los procedimientos de la Convención de la Haya."
61. En Re M (A minor) (Sustracción de menores) [1994] 1 FLR 390 el Tribunal de Apelación se enfrentó con las circunstancias en las cuales los niños de edades de 11 y 10 habían sido instados a ser devueltos a su padre en Australia después de que su madre hubiera, sin consentimiento, traído a Inglaterra. Los niños fueron colocados en un vuelo en condición de menores no acompañados y el niño mayor protagonizó una escena e intentó abrir la puerta de la aeronave mientras esta estaba rodando para el despegue. El capitán se negó a volar con él a bordo y abortó el despegue. Los dos niños fueron entregados a los servicios sociales y detenidos en el aeropuerto. El Tribunal de Apelación dijo que el comportamiento del niño mayor respondía a un cambio sustancial en la posición que había sido presentada ante el juez de la causa, y que era conveniente dejar de lado la orden de consentimiento y también se debía volver a considerar la posición de los niños. Nos pareció apropiado hacer remitir el caso para su revisión.
62. En Re SC (Un Niño) [2005] EWHC 2205 (Sala de la Familia) Nicholas Mostyn QC que oficia como Magistrado adjunto en el Tribunal Superior, mientras se ocupaba del caso en el que estaba implicado un niño que había sido sustraído inadecuadamente de los Estados Unidos de América en 1999 y retenido clandestinamente en Inglaterra durante más de cuatro años dijo:
"Se revela ante mí obvio que (al menos) sin menospreciar el error doloroso inflingido a F; a pesar del engaño y el subterfugio perpetrado por M; y a pesar de la existencia de una orden de custodia, que fuera en octubre de 2003 o en cualquier momento a partir de ese momento virtualmente inconcebible que un tribunal inglés hubiera hecho regresar a S a California para realizar un juicio de custodia allí."
Su Señoría continuó hablando y pasó a abordar las reclamaciones competentes de residencia y contacto diciendo:
"Reconozco que se pueden aportar todo tipo de argumentos morales y filosóficos en contra de este punto de vista. Sin duda alguna F, y sus numerosos defensores en California e Irlanda dirían que adoptando yo este punto de vista me hallo recompensando la peor variante de la depravación y alentando con ello un fuero del secuestrador por el cual si alguien puede secuestrar a un niño por un periodo de tiempo suficientemente largo, entonces esa persona podrá salir indemne. Pero este enfoque debe estar supeditado a los intereses del niño y en mi parecer, se perpetraría un incumplimiento del deber judicial al sacrificar los intereses del niño simplemente para demostrar la validez de uno de los principios.”

Montaje y alineación de los ejes
La correcta alineación de los ejes optimiza la eficacia y
la duración de la vida de las bandas y de sus componentes.
El diagrama inferior representa el método que, mediante
triangulación , permite verificar el paralelismo.
Este método garantiza que los ejes estén paralelos,
incluso si el bastidor del transportador no lo está. .
Si AD es igual a BC, y si AB es igual a CD, los ejes son paralelos.
El posicionamiento lateral de los ejes sobre la
estructura del transportador es importante respecto del
piñón central bloqueado en cada eje.
Estos piñones fijos guían la cinta en el sentido
longitudinal del transportador.

Sincronización de los piñones
Instale los piñones sobre los ejes de modo que los
dientes estén correctamente sincronizados. En el caso
de los piñones de taladro cuadrado y un número de
dientes divisible por 4(ej. 16/4=4), los dientes estarán
siempre correctamente sincronizados, cualquiera que sea
la posición de los piñones sobre el eje.
En cambio, si el número de dientes no es múltiplo de
cuatro, deberá sincronizar todos los piñones.En este
caso, cada piñón posee un orificio de sincronización.

Posición de los piñones sobre los ejes
Intralox les recomienda que no bloqueen más de
dos piñones:uno sobre el eje motriz y el otro sobre
el eje del reenvio.Esos piñones, normalmente situados
en el centro de la banda, garantizan su conducción lateral
y mantienen la alineación correcta entre los extremos
del bastidor. .
El piñon fijo del eje motriz debe estar en la misma
posición lateral que el piñón fijo del eje de reenvío.
Todos los demás piñones deben poder desplazarse
lateralmente sobre el eje para permitir la dilatación
o contracción térmica de la banda. Cuando no haya
más de dos piñones por eje,bloquee aquellos situados
en el extremo del dispositivo motriz. Para más

y la separación máxima de los piñones, consulte el
siguiente diagrama.

Montage et parallélisme des arbres
L'alignement correct des arbres optimise l'efficacité
et la durée de vie du tapis et de ses composants. Le
diagramme ci-dessous représente la méthode qui, par
triangulation, permet de vérifier cet alignement. Cette
méthode garantit que les arbres sont parallèles, même
si le bâti du convoyeur ne l'est pas.
Le positionnement latéral des arbres sur le bâti du
convoyeur est important par rapport au pignon central
verrouillé sur chaque arbre. Ces pignons fixes guident
le tapis dans le sens de la longueur du convoyeur. Ils
alignent le tapis selon une même position relative
dans toute la longueur du convoyeur. Si les arbres ne
sont pas positionnés les uns par rapport aux autres,
cela peut entraîner un déviement du tapis.
Synchronisation des pignons
Installez les pignons sur les arbres de sorte que les
dents soient correctement synchronisées. Dans le cas
de pignons comportant des alésages carrés et un
nombre de dents divisible par 4
(exemple : 16 ÷ 4 = 4), les dents seront toujours
correctement synchronisées, quelle que soit la
position des pignons sur l'arbre.
Cependant, si le nombre de dents n'est pas un
multiple de quatre, veillez à bien synchroniser tous les
pignons. Dans ce cas, chaque pignon présente un trou
de synchronisation. Au montage, ces trous doivent
tous être alignés. Pour de plus amples informations
sur la série 200 et le montage des pignons (sens de
rotation), voir page 13.
Position des pignons sur les arbres
Intralox vous recommande de ne "verrouiller" que
deux pignons : un sur l'arbre d'entraînement et un sur
l'arbre de renvoi. Ces pignons, normalement placés au
centre du tapis, assurent son guidage latéral en le
maintenant correctement aligné entre les bords du
bâti.
Le pignon fixe de l'arbre d'entraînement doit être
dans la même position latérale que le pignon fixe de
l'arbre de renvoi. Tous les autres pignons doivent
pouvoir se déplacer librement de façon latérale sur
l'arbre pour suivre l'élongation ou la contraction
thermique du tapis. Lorsqu'il n'y a que deux pignons
par arbre, bloquez ceux situés du côté du dispositif
d'entraînement.

I recently graduated in a Translation and Interpreting degree.
During my studies I specialised in humanities fields and technical translation(industrial engineering.) I have some experience in translating texts from the canmaking industry.) I would like to find an internship, or an in-house job, in English or French speaking countries as a translator or as a Spanish teacher. I am eager to undertake translation projects, and now I can issue invoices as I suscribed to a freelance cooperative(Freelance SCM).
