- Căn cứ điều 47, 43, 31, 58 – Pháp lệnh thủ tục giải quyết các vụ án dân sự.
- Áp dụng điều 7, K1 - Nghị định 70/CP ngày 12/06/1997 của Chính phủ quy định về chế độ án phí, lệ phí.
Xử:
- Công nhận sự thuận tình ly hôn giữa anh Trần X X X X X và chị Lê X X X X X.
- Về con chung: Giao cháu gái Trần X X X – sinh 01/11/1999 cho chị Lê X X X X X trực tiếp nuôi dưỡng chăm sóc cho đến khi cháu trưởng thành 18 tuổi, tự lập về kinh tế hoặc đến khi có sự thay đổi khác.
Anh Trần được quyền đi lại thăm nom chăm sóc cháu Trần X X X không ai được ngăn cản.
- Về tài sản và nhà ở: Các đương sự không yêu cầu toà giải quyết nên tòa không xét.
- Bác yêu cầu của Anh Trần về việc được trực tiếp nuôi dưỡng chăm sóc cháu Trần X X X.
- Bác yêu cầu khác của các bên đương sự.
- Anh Trần phải chịu 50.000 đ án phí ly hôn sơ thẩm, được trừ vào 50.000 đ tiền tạm ứng án phí đã nộp tại biên lai thu số 4659 ngày 26/11/2002 của Đội thi hành án Quận Thanh Xuân.
Án xử công khai sơ thẩm có mặt các bên đương sự. Tòa báo các bên đương sự có quyền kháng cáo trong hạn 15 ngày kể từ ngày tuyên án.

- Defendant: Mrs. Le X X X X X, born in 5 February 1978.
Occupation: Staff of International Loan and Assistance Department - Ha Noi Department of
Planning and Investment.
Residence: 109 /162, Vuong Thua Vu - Quarter 17, Khuong Trung – Thanh Xuan – Ha Noi

DECISION
- Based on Article 89 – item 1, Article 90, Article 92, 94 of the Marriage and Family Law – year 2000
- Based on the Article 47, 43, 31, 58 – State law on procedure for settling civil cases.
- In application of Article 7, Item 1 - Degree 70/CP dated 12th June 1997 issued by the Government providing regulations on fees and legal costs.
To Judge:
THE COURT DECISES
- To recognize the divorce by consent of Mr. Tran X X X X X and Mrs. Le X X X X X.
- Concerning common child: Mrs. Le X X X X X has sole custody of her daughter Tran X X X born on November 1st , 1999 until she is 18 years old and capable of supporting herself or until other changes occur.
Mr.Tran has access to his daughter Tran X X X without restriction.
- Concerning assets and residential property: As both concerned Parties did not request a settlement, no adjustment is given by the court.
- To reject the request by Mr.Tran that he has custody of Tran X X X
- To reject other requests of the concerned parties
- Mr.Tran must pay a legal fee of VND 50,000 for this first divorce judgment with the amount to be deducted from the advanced legal fee payment – receipt number 4659 dated 26th November 2002 and issued by the Case Executive Group of Thanh Xuan district.
This first case has been deliberated in public with attendance of both parties. The court hereby informs the concerned parties that they have a right to appeal against this decision within 15 days from the date of pronouncement.
