Historically, government officials who abused the human rights of their populations were able to do so with impunity. Even after authoritarian regimes transitioned toward democracy, the architects of state-led atrocities typically did not face judicial proceedings for their crimes. Instead, for the sake of stability or reconciliation, transitional leaders preferred to offer amnesties to the human rights abusers of previous regimes. Since the 1980s, however, states are increasingly using multiple transitional justice mechanisms including trials, truth commissions, reparations, lustration, museums and other “memory sites,” archives, and oral history projects, to address past human rights violations. This paper focuses on human rights trials, the most prominent of these transitional justice mechanisms. While amnesties are still common, there has been a dramatic new trend: democratizing states throughout the world are beginning to hold individuals, including heads of state, accountable for past human rights violations, especially through the use of trials. This trend has been described by Lutz and Sikkink as “the justice cascade” (Lutz and Sikkink, 2001).
Despite these changes in the international system, there is still little agreement in the comparative politics and international relations literature about the impact of transitional justice trials. Because such human rights trials are relatively recent phenomena, we know little about their strengths and weaknesses, past performances, and prospects for the future (Mendelhoff 2004). The purpose of this paper is to provide empirical data on the use of transitional justice mechanisms around the world and to use that data to test the claims about the negative impact of human rights trials.

Change in Scope. In general, the PI may make changes in the methodology, approach, or other aspects of the project objectives. However, the grantee must obtain prior approval from the XXX awarding office for a change in the direction, type of research or training, or other areas that constitute a significant change from the aims, objectives, or purposes of the approved project (hereafter “change in scope”). The grantee must make the initial determination of the significance of a change and should consult with the GMO as necessary.
Actions likely to be considered a change in scope and, therefore, requiring XXX awarding office prior approval include, but are not limited to, the following:
Change in the specific aims approved at the time of award.
Substitution of one animal model for another.
Any change from the approved use of animals or human subjects.
Shift of the research emphasis from one disease area to another.
A clinical hold by FDA under a study involving an IND or an IDE.
Application of a new technology, e.g., changing assays from those approved to a different type of assay.
Transfer of the performance of substantive programmatic work to a third party through a consortium agreement, by contract, or any other means. If the third party is a foreign component, this type of action always requires XXX prior approval.
Change in key personnel (see “Change in Status, Including Absence, of Principal
Investigator and Other Key Personnel” for requirements for XXX approval of alternate
arrangements for or replacement of key personnel).
Significant rebudgeting, whether or not the particular expenditure(s) require prior
approval. Significant rebudgeting occurs when expenditures in a single direct cost budget category deviate (increase or decrease) from the categorical commitment level
established for the budget period by more than 25 percent of the total costs awarded. For example, if the award budget for total costs is $200,000, any rebudgeting that would
result in an increase or decrease of more than $50,000 in a budget category is considered “significant rebudgeting.” The base used for determining significant rebudgeting excludes the effects of prior-year carryover balances but includes competing and noncompeting supplements.
Incurrence of research patient care costs if costs in that category were not previously
approved by XXX or if a grantee desires to rebudget additional funds beyond those
approved into or rebudget funds out of the research patient care category.
Purchase of a unit of equipment exceeding $25,000.
Change in Status, Including Absence, of Principal Investigator and Other Key Personnel.
The grantee is required to notify the GMO in writing if the PI or key personnel specifically named in the NGA will withdraw from the project entirely, be absent from the project during any continuous period of 3 months or more, or reduce time devoted to the project by 25 percent or more from the level that was approved at the time of award (for example, a proposed change from 40 percent effort to 30 percent or less effort). XXX must approve any alternate arrangement proposed by the grantee, including any replacement of the PI or key personnel named in the NGA.
The request for approval of a substitute PI/key person should include a justification for the change, the biographical sketch of the individual proposed, other sources of support, and any budget changes resulting from the proposed change. If the arrangements proposed by the grantee, including the qualifications of any proposed replacement, are not acceptable to the XXX awarding office, the grant may be suspended or terminated. If the grantee wishes to terminate the project because it cannot make suitable alternate arrangements, it must notify the GMO, in writing, of its wish to terminate, and XXX will forward closeout instructions.
The requirement to obtain XXX prior approval for a change in status pertains only to the PI and those key personnel XXX names in the NGA regardless of whether the applicant organization designates others as key personnel for its own purposes.
