ЦПК України, що був прийнятий 18.03.2004 р. та набув чинності з 1.09.2005 р., увібрав в себе чимало передових та прогресивних ідей, які відображають сучасні уявлення про цивільний процес і ґрунтуються на досвіді не лише вітчизняному, а й зарубіжному, європейському перед усім. В той же час реалізація деяких положень ЦПК, зміст певних його норм викликають численні та справедливі запитання як у практичних працівників, так і у науковців. Будучи безумовним кроком вперед, новий ЦПК не є актом повністю досконалим і деякі закріплені в ньому нормативні положення можуть і повинні бути предметом для обговорення з метою подальшого удосконалення чинного законодавства. | Translation - English
Civil Procedural Code of Ukraine, which was accepted on 18th of March of 2004 and had been taken into the effect starting 1st of September, included number of progressive and advanced ideas, which reflect the current outlooks about the Civil procedure and are based on not only native but also on international, European in particular outlook. At the same time implementation of some of these articles of Civil Procedural Code, content some of its norms with raise numerous and fair questions both from professional practitioners and from scientists.
Defiantly being a step forward, new Civil Procedural Code is not perfect and some of the norms that are fixed in it might be and must be a subject for the discussion with the goal of further improvement of the law enforcement.
