Source text - French ///La régulation des pourvois : Exécution préalable et modes de sélection - Mme Elisabeth BARADUC, Ancien Président de l’Ordre des avocats au Conseil d’Etat et à la Cour de cassation de France La régulation des pourvois ne peut être dissociée du rôle confié par la loi au juge de cassation. Elle ne sera envisagée ici qu’en matière civile et est en lien direct avec le contrôle de légalité qui est la mission de la Cour de cassation et qui comporte deux aspects : Un contrôle de cohérence de la décision qui lui est déférée ou contrôle « disciplinaire ». Un contrôle normatif qui tend, d’une part, à assurer l’uniformité dans l’interprétation et l’application de la loi et, d’autre part, à combler les lacunes de celle-ci ou à l’adapter aux nécessaires évolutions que commande l’Etat de Droit. Qui parle de sélection des pourvois pense réduction de leur nombre. Je n’ai cependant pas conçu le sujet de cette table ronde du seul point de vue quantitatif, car cette conception des modes de sélection m’a paru trop réductrice : certes, la sélection appliquée à la formation du pourvoi permet leur encadrement et leur réduction, mais l’objectif de sélection se poursuit lors du traitement du pourvoi, pour apporter une réponse différenciée selon la question posée au juge de cassation ; la sélection est alors directement destinée à servir la qualité de la justice. Les modes de sélection qui seront ici envisagés concernent successivement : La formation du pourvoi : mode de sélection négatif en ce qu’il limite l’accès au juge. Le traitement du pourvoi : mode de sélection positif en ce qu’il est destiné à apporter une réponse appropriée du juge de cassation à la question qui lui est posée. I - La sélection lors de la formation du pourvoi Plusieurs critères peuvent être envisagés : L’enjeu financier du litige : Le pourvoi ne serait possible que si la demande ayant donné lieu à la décision attaquée porte sur une somme supérieure à un montant déterminé. Ce système présente l’inconvénient majeur qu’un litige d’un montant modique peut avoir un impact important dans l’ordre juridique et poser une question de principe. L’autorisation de pourvoi donnée par l’auteur de la décision attaquée : Cette sélection du pourvoi par celui qui a rendu la décision attaquée présente deux inconvénients. D’une part, dans les pays où elle a été mise en œuvre, cette pratique s’est accompagnée d’une grande réticence du juge du fond à autoriser le pourvoi. D’autre part, elle est un facteur de complexité dans la mesure où elle oblige à organiser un recours contre le refus d’autorisation. L’exécution préalable de la décision : Le pourvoi n’étant pas suspensif, la décision attaquée peut et doit être exécutée. La question de savoir si cette exécution préalable est une condition de recevabilité du pourvoi a fait l’objet d’un long débat. Il en est résulté l’abandon d’un tel critère : exiger du demandeur au pourvoi une exécution préalable de l’arrêt qui porte condamnation à son encontre serait la source d’une inégalité dans l’accès au juge de cassation : inégalité entre le demandeur au pourvoi qui est condamné et celui qui est débouté, inégalité tenant aux ressources financières lorsque le demandeur au pourvoi n’a pas les moyens d’exécuter l’arrêt. Une solution plus souple -adoptée en France- consiste à confier au juge saisi par le pourvoi le soin de décider ou non de l’examiner selon que l’arrêt a ou n’a pad été exécuté (voir infra). Les ressources financières du demandeur au pourvoi : L’insuffisance des ressources financières d’un justiciable pour faire appel à un avocat ne peut évidemment lui barrer l’accès au juge de cassation. Afin de respecter le principe de l’égal accès, principe supranational et constitutionnel, un système d’aide juridictionnelle a été mis en place. Il est ainsi conçu en France : l’Etat rémunère le conseil du justiciable, mais lorsqu’il s’agit de former un pourvoi en cassation, un bureau d’aide juridictionnelle, qui n’est pas une juridiction, examine si le pourvoi est susceptible d’être fondé sur un moyen de cassation sérieux. Si tel n’est pas le cas, l’aide juridictionnelle est refusée, à la fois pour ménager les deniers publics et éviter les pourvois dépourvus de fondement. La nature de la décision attaquée : C’est le dispositif de la décision attaquée qui constitue le meilleur critère de sélection quant à l’accès au juge de cassation. La décision attaquée doit être rendue en dernier ressort et mettre fin pour partie à la procédure, c’est-à-dire avoir épuisé la juridiction du juge sur la question de droit que conteste le pourvoi. Sont donc insusceptibles de pourvoi ou tout au moins de pourvoi immédiat : les décisions purement avant-dire droit, les décisions qui ne mettent pas fin à l’instance, par exemple, parce qu’elles écartent une exception de procédure ou tout autre incident ou fin de non recevoir, les décisions qui prononcent uniquement des mesures provisoires. Ces modes de sélection appliqués à la formation du pourvoi ont pour objet de restreindre leur nombre. Les modes de sélection du traitement du pourvoi qui vont maintenant être envisagés relèvent du juge de cassation lui-même et concernent les modalités selon lesquelles le pourvoi va être examiné. II - La sélection du traitement du pourvoi Ces modes de sélection peuvent porter sur l’examen du pourvoi ou sur le traitement de celui-ci. A - Les modes de sélection relatifs à l’examen du pourvoi Le retrait du rôle : Le recours en cassation étant une voie de recours extraordinaire, il ne fait pas obstacle, en principe, à l’exécution de la décision attaquée. Bien plus, cette exécution est un droit du défendeur au pourvoi qui bénéficie du titre exécutoire que constitue l’arrêt attaqué. Pour faire respecter ce droit et assurer la protection de la partie qui a gagné devant le juge du fond, la Cour de cassation, saisie à cet effet, peut décider de retirer du rôle des affaires à juger un pourvoi qui lui est déféré lorsque l’arrêt n’est pas exécuté. Le défendeur au pourvoi peut ainsi saisir la Cour de cassation d’une demande de retrait du rôle lorsque l’arrêt d’appel n’est pas exécuté. Saisi d’une demande en ce sens, le délégué du premier président, par une décision qui n’est pas juridictionnelle, apprécie si l’exigence imposée au demandeur de s’acquitter des condamnations prononcées contre lui entraîne des conséquences manifestement excessives au regard de son droit d’accès au juge de cassation. Si le demandeur est en mesure d’exécuter les condamnations prononcées contre lui, le pourvoi n’est pas examiné tant que l’arrêt n’est pas exécuté. Si la situation financière du demandeur au pourvoi ne lui permet pas d’exécuter et qu’ainsi l’exigence d’une exécution préalable – totale ou partielle- constituerait une mesure entravant l’accès effectif du requérant au juge de cassation, le pourvoi sera examiné alors même que l’arrêt n’est pas ou pas totalement exécuté. Ce mode de sélection des pourvois examinés est aujourd’hui mis en œuvre en France dans des conditions qui ménagent à la fois le droit du créancier d’obtenir l’exécution du titre exécutoire dont il bénéficie et le droit du demandeur au pourvoi d’accéder au juge de cassation. B - Les modes de sélection relatifs au traitement du pourvoi Une fois le pourvoi intégralement instruit et l’instruction contradictoire achevée, les modalités selon lesquelles le pourvoi va être examiné sont proposées par le rapporteur plus particulièrement en charge du dossier au sein de chaque chambre et en fonction de la réponse qu’il estime approprié d’apporter au pourvoi. Cette sélection va donc s’effectuer au regard du contenu des écritures, du caractère sérieux ou non du pourvoi et de la nature du contrôle disciplinaire ou normatif auquel la Cour de cassation est invitée et de l’importance de la question posée. Le traitement des pourvois non sérieux : la procédure de non-admission : Lorsque le pourvoi en cassation est manifestement irrecevable ou non fondé sur un moyen de cassation sérieux, le rapporteur a la possibilité de proposer son orientation vers une formation de trois magistrats composant la chambre à laquelle le pourvoi a été attribué et de suggérer une décision de non-admission. La décision de non admission est pris par la Chambre concernée. Cette procédure en vigueur devant la Cour de cassation depuis le 1er janvier 2002 est très voisine de celle que connaît le Conseil d’Etat depuis 1987. La décision de non-admission n’est pas motivée et ne comporte donc aucune approbation de la solution adoptée par la Cour d’appel : c’est pour cette raison qu’il ne s’agit pas à proprement parler d’un arrêt (qui suppose une motivation) ; mais d’une décision qui met cependant définitivement fin à l’instance en cassation. Une telle proposition du rapporteur est transmise aux avocats des parties qui ont la possibilité de la contester lorsqu’elle est manifestement le résultat d’une erreur. Utilisée communément par toutes les chambres de la Cour de cassation dans des proportions variables (environ 30 à 40 % des pourvois), la non-admission concerne indistinctement les pourvois qui mettent en cause le contrôle disciplinaire et ceux qui suggèrent un contrôle normatif : dans cette dernière hypothèse, la non-admission n’est envisagée que si la question posée a déjà été résolue par la Cour de cassation et qu’elle n’entend pas changer sa position. Le traitement des pourvois mettant en œuvre des moyens disciplinaires : Il faut d’emblée indiquer qu’il n’y a pas de frontière entre les moyens disciplinaires et ceux invitant à un contrôle normatif : certains moyens disciplinaires présentent en réalité un caractère normatif ; tel est le cas du défaut de réponse lorsqu’il s’agit de savoir si des conclusions sont opérantes ; il en va de même du moyen de dénaturation lorsque l’acte en cause est une clause type qu’on trouve dans une multitude d’actes. De même, la Cour de cassation se donnant la faculté de requalifier les moyens, elle peut préférer censurer sous un visa d’apparence disciplinaire, alors que la solution est normative. La distinction peut donc apparaître artificielle, mais elle m’a semblé pertinente pour les besoins de l’exposé. L’orientation vers une formation qui juge le pourvoi par une décision motivée est toujours proposée lorsque le rapporteur envisage une cassation ; elle l’est aussi lorsqu’il envisage de rejeter le pourvoi, mais qu’il importe de faire savoir l’intensité du contrôle que la Cour de cassation entend opérer sur la motivation du juge du fond. Le traitement des pourvois invitant à un contrôle normatif : Lorsque le pourvoi invite la Cour de cassation à contrôler l’application uniforme de la règle de droit, à régler une question nouvelle, à combler une lacune de la loi ou encore à assurer l’adaptation de celle-ci aux évolutions de la société, une première sélection de tous les pourvois qui posent la même question apparaît nécessaire. Ce regroupement des pourvois, première étape du mode de sélection de leur traitement, ne peut être réalisé que par la mobilisation d’outils informatiques et d’une indication claire donnée par l’auteur du pourvoi de la question posée. Cette indication est donnée par une fiche qui accompagne le mémoire ampliatif qui développe les moyens de cassation. Le traitement du pourvoi est toujours laissé à l’initiative du rapporteur qui peut proposer de le juger par une formation de trois magistrats ou par une formation de section ou de plénière de chambre. Le président de la chambre à laquelle le pourvoi a été attribué a bien entendu la possibilité de décider de la formation qui le jugera. L’élargissement du débat pour mesurer les conséquences sociales, économiques, humaines et faire apparaître l’enjeu de la décision à intervenir apparaît parfois souhaitable, en favorisant par exemple les interventions (soumises au débat contradictoire) des personnes ou organismes susceptibles d’enrichir la discussion. La réunion d’une assemblée plénière ou d’une chambre mixte est laissée à l’initiative du premier président ou de la chambre saisie qui se prononce par un arrêt non motivé, mais il s’agit là de questions qui seront examinées par la troisième table ronde. On constate ainsi que les modes de sélection et de traitement des pourvois ont pour objectif de décourager l’usage perverti du droit d’accès au juge de cassation pour préserver la spécificité de la Cour régulatrice du droit ; les différents modes de sélection participent en définitive très étroitement de la qualité des décisions rendues.	Translation - English /// Regulating appeals on points of law: Prior execution and screening methods– Elisabeth Baraduc, former President of the Bar Association at the Conseil d’Etat and the Court of Cassation in France. Regulating appeals on points of law (pourvois en cassation) can not be dissociated from the role conferred by law on the Court of Cassation. It will be considered here only in relation to civil matters, and it is directly connected with review of legality (contrôle de légalité). This is the function of the Court of Cassation and it comprises two aspects: • Reviewing the coherence of the decision referred, or “disciplinary” review (contrôle disciplinaire); • Normative review (contrôle normatif) which seeks, first, to ensure uniformity in the interpretation and application of the law, and, second, to fill the lacunae in the law, or to adapt it to the necessary changes which the rule of law demands. When one talks of screening referrals to the Court of Cassation, inevitably one thinks of reducing their number. However, I did not formulate the topic for this conference solely from a quantitive point of view, as that notion of screening methods appeared too simplistic to me. Certainly, screening, when applied to the lodging of referrals, means they can be compartmentalised and reduced. However, the aims of screening continue to be relevant when the referral is being processed so as to produce a differentiated response according to the question put to the Court of Cassation. Screening is therefore intended as a direct aid to the quality of justice. The methods of screening that will be considered here concern the following in turn: • Lodging the referral: a negative method of screening, in that it limits access to the court; and • Processing the referral: a positive method of screening, in that it is aimed at providing an appropriate response from the Court of Cassation to the question posed. I – Screening when the referral is lodged Several criteria may be considered. The financial risks of litigation: The referral would only be possible if the claim that gave rise to the contested decision concerns a sum that is higher than a specific amount. The major disadvantage with this system is that litigation for a modest amount can still have a significant impact on the legal system and raise a fundamental question. Granting leave to appeal on points of law by the author of the contested decision: This method of screening the referral by the court that made the contested decision has two disadvantages. First, in countries where it has been used, the practice has coincided with a great deal of reluctance on the part of the court of first instance or court of appeal to grant leave. Second, it is a complicating factor in that it leads to an appeal being brought against the refusal to grant leave. Prior execution of the decision: As the referral does not have suspensive effect, the contested decision can and must be executed. The question of whether prior execution is a condition for the admissibility of the referral has been the subject of much debate. This resulted in the criterion falling into disuse. Demanding that the applicant execute the decision made against him or her would lead to inequality in gaining access to the Court of Cassation: inequality as against the applicant who is ordered to pay damages and the applicant whose referral is dismissed, and inequality stemming from financial resources where the applicant does not have the means to execute the judgment. A more flexible solution, which has been adopted in France, involves entrusting the court dealing with the referral with the task of deciding whether or not to examine it depending on whether the judgment has or has not been executed (see below). The financial resources of the applicant: A litigant’s lack of financial resources to instruct a lawyer obviously cannot bar him or her from having access to the Court of Cassation. So as to respect the principle of equal access to justice, a supranational and constitutional principle, a system of legal aid (aide juridictionelle) has been put in place. This is how it works in France: the State remunerates the litigant’s lawyer, but when it comes to bringing an appeal on points of law, a legal aid bureau (bureau d’aide juridictionelle), although not a court, examines whether there are good grounds for such a referral. If this is not the case, legal aid is refused, both to protect public funds and to avoid referrals which have no merit. The nature of the contested decision: The operative part of the decision (le dispositif) – which also contains information on the nature of the decision - is the best criterion for screening, when it comes to gaining access to the Court of Cassation. The contested decision must have been made by a court of final instance – in terms of the facts of the case - and must partly bring an end to the procedure, that is, it must have exhausted the lower court’s jurisdiction over the question of law upon which the referral is based. The following are therefore not open to appeal on points of law, or at least not an immediate appeal: • purely interlocutory judgements (décisions avant-dire droit); • decisions that do not conclude the proceedings, for example, where an application alleging a procedural irregularity (exception de procedure), or any other interlocutory application (incident) or application to strike out (fin de non recevoir) is dismissed; or • decisions that only grant temporary measures. These methods of screening, applied when the referral is made, are designed to reduce their number. The methods of screening the processing of the referral, which will be considered now, are within the remit of the Court of Cassation itself and concern the ways in which the referral will be examined. II - Screening the Processing of Referrals These methods of screening may concern the consideration or processing of the referral. A – Screening methods connected with the consideration of the referral Removal from the Court list As an appeal on points of law is an extraordinary application, in principle it should not obstruct the execution of the contested decision. Moreover, execution of the decision is a right of the respondent to the referral, whose authority to execute is contained in the contested decision. To safeguard this right and to ensure the protection of the party who was successful before the lower court, the Court of Cassation may decide to remove from the Court list a referral made to it if the judgment has not been executed. In this way the respondent may apply to the Court of Cassation for the referral to be removed from the Court list when the court of appeal judgment has not been executed. Once the Court has such an application before it, the delegate of the President of the Court of Cassation, through a non-judicial decision, assesses whether the demand imposed upon the applicant to comply with the judgment made against him would have unreasonable consequences with regard to his right to have access to the Court of Cassation. If the applicant is able to comply with the judgment made against him, the referral will not be considered for as long as the judgment has not been executed. If the financial circumstances of the applicant are such that he is unable to comply, so that prior execution, in full or in part, effectively amounts to an impediment to the applicant’s access to the Court of Cassation, the referral will be considered even though the judgment has not been executed, or has not been executed in full. This method of screening referrals is used in France today in conditions that carefully manage both the right of the creditor to have his enforcement order complied with and the right of the applicant to have access to the Court of Cassation. B – Screening methods connected with processing the referral. Once the referral has been fully prepared for the hearing and the contentious investigation procedure has been completed, the reporting judge (le rapporteur), who is specifically assigned to the matter within each chamber, proposes the methods according to which the referral will be considered. These methods also depend on the response which he considers to be appropriate to the referral. This method of screening is therefore carried out on the basis of the contents of the pleadings, the issue of whether the referral is reasonable or not, the nature of the disciplinary or normative review which the Court of Cassation is invited to consider and the importance of the question raised. Processing unreasonable referrals - the non-admission procedure: When the appeal on points of law is manifestly inadmissible or not founded on a reasonable ground of review, the reporting judge may propose that it be sent before a bench formed of three justices chosen from the Division to which the referral has been assigned, with a recommendation that the referral should not be admitted. The decision not to admit a referral is taken by that Division. This procedure, which has been in use at the Court since 1 January 2002, is very close to the one used by the Conseil d’Etat since 1987. The decision not to admit the referral does not contain a statement of reasons, and therefore does not contain an approval of the solution adopted by the court of appeal. For this reason, strictly speaking, it is not a judgment, which presupposes a statement of reasons. It is, however, a decision that brings an end to the referral. When the reporting judge makes such a recommendation, it is sent to the lawyers for the parties, who may contest it if it is manifestly erroneous. Commonly used by all Divisions of the Court of Cassation in varying degrees (around 30% to 40% of referrals), the non-admission procedure concerns referrals for both disciplinary and normative review with no distinction made. In the case of the latter, non-admission is only envisaged if the issue raised has already been decided by the Court, and it does not intend to change its position. Processing referrals based on disciplinary grounds: First of all, it is necessary to point out that there is no division between disciplinary grounds and those seeking normative review. Some disciplinary grounds actually have a normative character. Such is the case with a failure to file a reply in a matter concerning the issue of whether the pleadings have become operative. It is the same for the ground of misconstruction of a document (la dénaturation), where the provision in question is a clause of the sort that is found in numerous documents. Likewise, the Court of Cassation, having given itself the power to reclassify grounds of referral, may prefer to censure a decision on what appears to be a disciplinary ground, even though the solution is normative in character. The distinction may therefore appear artificial, but it appears to me relevant to the requirements of this paper. Sending a matter before a bench which makes a ruling on the referral by means of a reasoned judgment is always recommended when the reporting judge envisages the judgment being set aside. This is also the case when the reporting judge envisages that the referral will be rejected, but it is nevertheless important to publicise the extent to which the Court of Cassation intends to review the reasons given in the judgment of the lower court. Processing referrals seeking normative review: When the referral invites the Court of Cassation to review the uniform application of the rule of law, or to rule on a new question, or to fill a lacuna in the law or even to ensure the adaptation of the law to changes in society, it seems necessary to make an initial screening of all the referrals raising the same question. This grouping together of referrals, a first stage in the method of selecting how they are to be processed, can only be carried out by mobilising computer technology and by making use of a clear statement of the question raised given by the author of the referral. This information is given by means of a note which accompanies the supplementary pleadings, where the grounds of the appeal on points of law are developed. Processing the referral is always left in the hands of the reporting judge, who may propose that it be heard by a bench formed of three justices or by a Section bench or Division bench in plenary session (comprising at least five justices). The President of the Division that has been assigned the referral may of course decide the formation of the bench which will hear the case. Broadening the scope of the submissions so as to weigh up the social, economic and human consequences of the case, and to bring to light what is at issue in the contested decision is sometimes desirable. So, for example, contributions made during oral submissions from persons or bodies capable of enhancing the legal argument are encouraged. The question of whether the Court sits in plenary session or as a joint bench is left up to the President of the Court of Cassation or the President of the Division dealing with the referral, who decides by way of a decision containing no statement of reasons. That, however, is a matter to be considered at the third conference. Thus it can be seen that the methods of screening and handling referrals have the aim of discouraging the abuse of the right to gain access to the court of cassation so as to preserve the specific nature of this Court as a regulator of the law. In the final analysis, the different methods of screening are closely linked to the quality of the decisions.

Vous m’autoriserez à faire l’économie des salutations et félicitations que veulent les usages, car le temps presse et nous est compté. Vous remarquerez que le même sujet sera traité par Mme Elisabeth Baraduc et par moi-même et que, sans nous être concertés, le point de départ fut le même. Ce sera donc une variation sur un même thème, la variation du magistrat et celle de l’avocate. Pour éclairer un même thème, je crois que c’est fortement utile. C’est aussi une gageure pour le vieux professeur de droit judiciaire que je suis de faire connaître le commun dénominateur des conditions de saisine de la Cour de cassation en présence d’un auditoire aussi prestigieux. L’accès à la Cour de cassation et sa saisine sont directement déterminés par la spécificité de sa mission. En tant que juridiction suprême, elle est en effet amenée à censurer les décisions des juges de fond qui auraient contrevenu à la loi (contrôle de légalité) ou lorsque la procédure suivie aurait été violée dans certaines règles de forme (contrôle de régularité). Cette partie de ce contrôle est qualifiée parfois de contrôle disciplinaire en ce qu’il ne concerne que les motivations, la foi due aux actes, les droits de la défense, le principe dispositif qui délimite la saisine du juge. Mais là n’est pas le rôle déterminant de la Cour de cassation qui est de veiller à l’unité de la jurisprudence judiciaire et cela au-delà de la simple sauvegarde de l’intérêt individuel des parties au litige. La Cour a donc une mission d’intérêt général qui est de contrôler si les juridictions de fond appliquent et interprètent la loi de façon cohérente, d’assurer l’unité dans cette implication et cette interprétation, garantissant ainsi l’égalité des citoyens devant la loi et, par là même, la sécurité juridique, tout en restant attentive à la nécessaire adaptation des normes juridiques, à l’évolution de la société dans un Etat de Droit. La sécurité juridique ne saurait, en effet, consacrer un droit acquis à une jurisprudence figée. Il ne peut valablement être répondu à la question de la saisine de la Cour sans avoir égard à la mission essentielle de la Cour. C’est la raison de ce préambule. Les conditions de saisine de la Cour sont de fond et de forme. De fond, en ce qu’elles concernent le contenu et la portée du pourvoi qui doivent être précisés quant à la décision attaquée, quant aux moyens invoqués contre cette décision, quant à la partie qui doit avoir un intérêt à exercer ce recours, quant à la partie contre laquelle le pourvoi est dirigé. De forme, en ce qu’elles concernent la déclaration de pourvoi, la signification du pourvoi, le dépôt d’un mémoire ou des délais. Toutes ces conditions qui concernent la saisine se présentent comme les pièces d’une mosaïque ; l’une de ces pièces ferait-elle défaut, il ne pourrait être question d’une saisine valable de la Cour de cassation. Ces exigences peuvent paraître excessivement formelles ; elles se justifient néanmoins parce que le recours en cassation doit demeurer exceptionnel. La contestation porte en effet et ne peut porter que sur une démission juridictionnelle censée contenir de manière définitive tous les éléments de réponse, en fait et en droit, à une question litigieuse, sur lesquels les parties ont déjà débattu dans le respect du contradictoire. Cette décision définitive n’est plus susceptible de recours. Ce sont là des impératifs de sécurité juridique et de paix judiciaire qui exigent que la remise en question de ces réponses juridictionnelles ne soit admise qu’à des conditions très strictes et cela est commun à tout Etat de Droit qui connaît une Cour suprême. Qui peut saisir la Cour de cassation ? Seule une partie au procès et, plus précisément, une partie à la décision attaquée a la qualité pour ce pourvoi, mais encore à la condition qu’elle y ait intérêt, c’est-à-dire que la décision lui fasse grief. Elle doit donc préciser cet intérêt et l’intérêt qu’elle a, qu’elle escompte en tant que demanderesse en cassation. Le ministère public peut se pourvoir en cassation s’il est lui-même partie au litige. Il y a aussi un ministère public à la Cour de cassation. La circonstance que la loi oblige ce ministère public à intervenir dans toute affaire dont la Cour est saisie pour faire connaître aux parties et aux juges de la Cour son avis sur les mérites du pourvoi ne lui octroie pas la qualité de partie, mais bien celle d’amicus curia qui, en toute indépendance et impartialité, s’exprime en tant que voix de la loi. A quelles conditions une partie peut-elle avoir accès à la Cour de cassation ? La réponse à cette question est également directement déterminée par la mission spécifique de la Cour de cassation, qui n’est pas un troisième juge amené à trancher des conflits. La décision attaquée doit avoir été rendue en dernier ressort, elle doit avoir épuisé la juridiction du juge sur la question litigieuse, c’est-à-dire que le juge s’est prononcé et n’a plus à le faire sur ce point de droit qui est donc définitivement jugé ; il s’est dessaisi de la question. Le recours en cassation doit avoir été préalablement introduit dans un délai que la loi précise, sinon elle est déchue de son propre recours. Le demandeur en cassation doit indiquer avec précision la partie contre qui il dirige son pourvoi, ce que le demandeur critique dans la décision qu’il attaque, la loi dont il prétend qu’il y a violation et le moyen qu’il invoque pour étayer sa prétention. Toutes ces conditions doivent être strictement respectées, à défaut de quoi le juge de cassation déclarera le demandeur non recevable, sans même que soit examiné le fond de la critique. Quand peut-on saisir le juge de cassation ? Le moment pour se pourvoir est significatif. La critique que suppose le pourvoi en cassation et que doit expliciter le mémoire en cassation n’est, en effet, admissible devant le juge de cassation que pour autant que le point de droit sur lequel porte le litige ait été jugé définitivement et en dernier ressort, de telle manière qu’aucun juge du fond n’ait à y revenir. La loi n’autorise d’ailleurs le pourvoi que si les autres moyens de faire rapporter un jugement ont été épuisés. Pour quels motifs peut-on se pourvoir ? Les motifs ou les raisons de ce pourvoi doivent constituer un grief juridique précis dont le demandeur doit indiquer les conséquences juridiques qui lui portent atteinte. Le demandeur doit indiquer avec précision la disposition qu’il entend critiquer et le texte légal qui serait violé. Comment faut-il se pourvoir ? Comment saisit-on la Cour de cassation ? Satisfaire aux exigences déjà citées implique le respect de certaines formalités pour garantir la prise en considération effective de ce qui est et doit rester un recours extraordinaire. Il ne suffit pas que la partie intéressée ou son avocat fasse une déclaration formelle de pourvoi. Il faut encore que l’acte de pourvoi soit signifié dans son intégralité par un fonctionnaire public qu’est l’huissier de justice à la partie contre laquelle le pourvoi est dirigé. A ces conditions de forme, s’ajoutent des conditions quant à l’objet et à la portée du recours. La partie contre laquelle le recours est dirigé doit pouvoir savoir avec précision en quoi la décision attaquée est critiquée, en quel de ses motifs, en quelle partie de son dictum, sur quelle base juridique se fonde le pourvoi, en quoi la cassation qui pourrait en résulter pourrait affecter la décision en ce qui concerne le demandeur en cassation, mais également en ce qui concerne la partie défenderesse contre qui le pourvoi est dirigé. Toutes ces conditions peuvent paraître nombreuses, pesantes ; toutes ces exigences ne s’inscrivent que dans le cadre traditionnel du respect du principe du contradictoire de la procédure et du principe général du respect des droits de la défense qui caractérisent toutes les procédures judiciaires. Ces exigences sont en l’occurrence d’autant plus importantes que la procédure en cassation est essentiellement écrite, d’où l’importance de la présentation des moyens dans un mémoire par un barreau de préférence spécialisé. Dans le document écrit, je m’exprime à propos de l’importance du mémoire, de l’exclusion du moyen nouveau ; le temps nous est trop compté pour m’attarder, mais je suis prêt à répondre à des questions sur ce point. La saisine de la Cour pose aussi un problème de gestion du flux des affaires. L’accroissement constant du nombre des affaires soumises à la Cour pose un problème aigu de flux que la Cour doit pouvoir maîtriser, faute de quoi le bon accomplissement de sa mission essentielle de formation du droit sera mis en péril. Ce problème sera davantage examiné par Mme Elisabeth Baraduc. Cette maîtrise de flux appelle des solutions qui relèvent directement du problème posé de la saisine de la Cour. Il s’agit notamment de la représentation obligatoire des parties par un barreau spécialisé, l’instauration d’une chambre de première évaluation des pourvois, des chambres à géométrie variable en fonction de la difficulté et de l’intérêt des affaires, une motivation simplifiée, voire sommaire lorsque la nature de l’affaire s’y prête et un appui logistique des magistrats, appui administratif, informatique et juridique. L’accès à la jurisprudence de la Cour de cassation. La question de l’accès à la Cour de cassation doit comprendre aussi la question de l’accessibilité de la jurisprudence qu’elle produit, l’accessibilité par le mode de publications imprimées, mais aussi par le biais de sites Internet, les nouvelles technologies. Toutes ces exigences qui conditionnent la saisine de la Cour ne sont finalement pas fondamentalement différentes de celles qui s’imposent à l’égard de tout acte juridictionnel comportant une réponse en droit. Ces conditions sont néanmoins à l’égard d’une Cour suprême plus exigeantes et plus contraignantes en raison des conséquences qui s’attachent à ces décisions. Je vous remercie pour votre attention.	Translation - English Referring a case to the Court of Cassation – Jean Dujardin, Principal Counsel for the Crown at the Court of Cassation in Belgium Thank you, Mr. Chairman. I trust you will allow me to keep the customary pleasantries brief, as our allotted time is short. You will notice that the same subject will be dealt with by Elizabeth Baraduc and myself and that, although we did not confer, our point of departure is the same. This will therefore be a variation on the same theme from the point of view of a judge and that of a lawyer. I think that it is very useful to shed light upon the same theme. It would also be a challenge for an old professor of law like me to try to shed light upon the essential issues concerning a reference to the Court of Cassation with such a prestigious audience. Access and referrals to the Court of Cassation are determined directly by the specific nature of the Court's role. As a supreme court, the Court of Cassation is required to censure the decisions of the lower courts that are alleged to have contravened the law (review of legality or contrôle de légalité) or when certain formal rules of the procedure followed are alleged to have been breached (procedural review or contrôle de régularité). This part of review is sometimes described as disciplinary review (contrôle disciplinaire), in that it only concerns the statements of reasons given in judgments (les motivations), the issue of due credence being given to the documents in the case (la foi due aux actes), the rights of the defence (les droits de la défense) and the principle that the Court must make a decision on all the questions submitted to it and on nothing else (le principe dispositif), which sets the boundaries of the referral made to the Court. But that is not the defining role of the Court of Cassation; its defining role is to ensure that the case law in the ordinary courts is unified, as well as safeguarding the interests of the individual parties to the litigation. The Court therefore has a public interest role which is to check that the lower courts apply and interpret the law consistently, and to ensure unity of this application and interpretation so as to guarantee equality before the law, and, in that way, guarantee legal certainty. At the same time it has to remain mindful of the need to adapt legal rules to an evolving society governed by the rule of law. Indeed, legal certainty should never be used to enshrine a law that has come about through case law that has stopped evolving. It is not possible to deal properly with the issue of referring a case to the Court without having regard to the Court’s essential role. That is the reason for this introduction. The conditions for referring a case to the Court are procedural and substantive. With regard to substance, they concern the content and scope of the referral, which must be specified by reference to the contested decision, the grounds relied upon against that decision, the applicant - who must have locus standi - and the respondent. With regard to procedure, the conditions concern the notice of referral (la declaration de pourvoi), service of the notice of referral (la signification de pourvoi), lodging the notice (le dépôt d’un mémoire) and the time limits (les délais). All these conditions concerning the referral are like pieces of a jigsaw; if one of the pieces is missing, there can be no question of a valid referral to the Court of Cassation. These requirements may appear excessively formal. Nevertheless, they are justified because an appeal on points of law must remain exceptional. This is because the application to set aside a judgment concerns, and it may only concern, a defect in the court’s ruling which was supposed to contain all the elements of a definitive response, in fact and in law, to a litigious question over which the parties have already had a full hearing. This definitive decision is not open to appeal on the substantive issues of the case. These are essential elements of legal certainty and harmony, which require that the responses from the court should only be called into question under very strict conditions. That is common to every state governed by the rule of law and which has a Supreme Court. Who then can make a referral to the Court of Cassation? Only a party to the proceedings and, more precisely, a party to the contested decision, may make such a referral. In addition to the requirement of having an interest in the decision, that party must also have been adversely affected by it. The party must specify the interest which he or she has, and upon which he or she intends to rely as an appellant on a point of law. The Office of Counsel for the Crown may appeal on a point of law if it is party to the proceedings. There is also a separate Office of Counsel for the Crown at the Court of Cassation. The fact that the law requires that this Office intervene in every matter before the Court, so as to make its opinion on the merits of the referral known to the parties and to the judges of the Court, does not grant it the status of a party to the proceedings, but that of an amicus curiae, which, independently and impartially, speaks on behalf of the law. Under what circumstances may a party have access to the Court of Cassation? The answer to this question is also determined directly by the specific role of the Court of Cassation. This role is not that of a court of third instance brought in to settle disputes. The contested decision must have been made at last instance on the substantive issues; it must have exhausted the jurisdiction of the court on the contentious issue, that is, the court has made its ruling and has nothing more to say on this point of law, which has been definitively decided. The court is therefore functus officio. Prior to this, the appeal on points of law must have been brought within a time limit specified by law, failing which the party loses the right to make a referral. . The applicant must identify precisely the party against whom the referral is made, what the applicant is criticising in the contested decision, the law which is claimed to have been violated, and the ground relied upon to support the claim. All these conditions must be strictly complied with, failing which the Court of Cassation will dismiss the application, without even considering the basis of the criticism. When can a case be referred to the Court of Cassation? The time for making a referral is important. The criticism, upon which the appeal on points of law is based and which the statement of grounds for the referral must specify, is not admissible to the Court of Cassation until the point of law which the litigation concerns has been definitively ruled upon at final instance on the merits, so that no lower court has to go back over it. Furthermore the law only authorises a referral if the other grounds for having a judgment set aside have been exhausted. Upon what grounds may a referral be made? The grounds or reasons for a referral must constitute a specific cause of action and the applicant must identify the legal consequences that are prejudicial to him or her. The applicant must identify precisely the provision which he or she intends to criticise and the legal text that is alleged to have been infringed. How must a referral be made? How is a matter brought before the Court of Cassation? Satisfying the requirements cited above means complying with certain formalities in order to guarantee that what is, and must remain an extraordinary remedy is effectively taken into consideration. It is not enough that the interested party or his or her lawyer formally applies for an appeal on a point of law. The referral must also be served in its entirety on the respondent to the referral by a court official, namely the court bailiff. Added to these procedural requirements are the requirements as to the aim and scope of the remedy. The respondent to the referral must be able to know precisely in what way the contested decision is being criticised, and on which of the court's reasons, on which part of its dictum and on what legal basis the referral is founded. The respondent is also entitled to know in what way the quashing order, which may result from this, might affect the decision as regards the applicant, but also as regards the respondent to the referral. All these conditions may appear numerous, even exacting. However, all these requirements are merely part of the established respect for natural justice and the general principle of respect for the rights of the defence, which are characteristic of all legal systems. To be more specific, these demands are all the more important as the procedure for an appeal on points of law is essentially written, hence the importance of the grounds being filed in pleadings drafted by specialist counsel. As regards the written document, I am talking about the importance of what is pleaded and of the exclusion of any ground that has not been pleaded. Our allotted time is too short for me to dwell on this, but I am ready to reply to any questions on this point. Bringing a case before the court also leads to a problem in controlling the floodgates of litigation. The constant growth in the number of cases submitted to the Court has led to a severe influx which the court must be able to control. Failure to do so would mean that achieving its underlying goal of defining the law would be undermined. This problem will be examined further by Elisabeth Baraduc. Floodgates control calls for solutions which are a direct response to the problem posed by bringing a matter before the Court. It concerns in particular the compulsory representation of parties by specialist counsel; the establishment of a section for preliminary consideration of referrals; sections with compositions that vary according to the difficulty and importance of the cases; a simplified statements of reasons, which may even be summary if this is appropriate to the nature of the case; and logistical support for justices, that is administrative, legal and computer-based support. Access to the reported decisions of the Court of Cassation The question of having access to the Court must also include the question of accessibility to the reported decisions which it produces, accessibility through printed publications but also through Internet sites, the new technologies. All these demands that shape the way in which a matter is brought before the Court are not in the end fundamentally different from those imposed on every legal measure that requires a response in law. Nevertheless, as far as the Supreme Court is concerned, these conditions are more demanding and more restrictive because of the consequences of the Court’s decisions. Thank you for your attention.

Source text - French JUGE DE CASSATION, JUGE D’APPEL, JUGE DU FOND Merci, Monsieur le Président. Je remercie le Roi du Maroc et le Président de la Cour suprême du Maroc, ainsi que le Bureau de l’AHJUCAF qui nous ont offert un cadre idéal pour nous permettre d’échanger en faveur de nos juridictions. Dans le combat quotidien pour le renforcement de l’Etat de droit, la justice occupe une place de choix et la Cour suprême y joue un rôle de premier plan. Selon la Constitution de la République du Tchad, la Cour suprême est la plus haute instance judiciaire du pays. C’est devant elle que sont portés des pourvois contre les décisions émanant des Cours d’appel et des tribunaux tant en matière civile, coutumière, sociale que pénale. Elle est en outre juge administratif, juge des comptes et juge de contentieux des élections locales. Force est de relever cependant que la Cour suprême du Tchad a une particularité tirée de la loi n°006/PR/98 du 07/08/98, portant organisation et fonctionnement de la Cour suprême, qui dispose en son article 61 que « l’arrêt est rendu soit sur le siège, soit après délibéré à jour fixe. La chambre judiciaire casse et annule la décision qui lui est déférée; elle peut soit renvoyer l’affaire devant une autre juridiction de même nature que celle dont émane la décision attaquée, soit si l’affaire est reconnue en état au fond, évoquer et statuer ». Cette disposition exorbitante veut dire tout simplement que la Cour suprême, dans certains cas, a le pouvoir d’évocation, c’est-à-dire qu’elle peut juger en fait et en droit. C’est ce qui fait sa particularité, voire son originalité, car, outre sa mission classique, une faculté légale lui est reconnue pour être juge d’appel et du fond. Cette modeste intervention portera d’abord sur le rôle classique de la Cour suprême et, ensuite, sur son pouvoir d’évocation, c’est-à-dire sur sa particularité. Celle-ci nous amènera à dégager quels en sont les raisons, les inconvénients et les avantages. I / LA COUR SUPRÊME : JUGE DE CASSATION A l’instar des autres juridictions, la Cour suprême du Tchad n’examine pas en principe les éléments de fait dans un procès, mais cherche plutôt à s’assurer s’il a été fait une saine application de la loi. Elle sert de régulateur aux autres juridictions, garantit la fixité de la jurisprudence et contribue à l’unification dans l’interprétation des règles de droit. En sa qualité de plus haute juridiction du pays, sa mission essentielle et classique est de veiller à la bonne application de la loi, d’assurer l’unité et l’harmonie de la jurisprudence. Au regard de l’article 7 de la loi n° 004/PR/98 du 25/5/98 portant organisation judiciaire, la Cour suprême est la plus haute juridiction en matière judiciaire, administrative et des comptes. A cet égard, elle est Juge de cassation en toutes matières, elle ne peut donc réexaminer les faits et en donner une autre version. Elle considère ces faits comme souverainement établis par les juges du fond. Elle ne juge donc pas l’affaire, elle juge le jugement ou l’arrêt. En examinant les arrêts et les jugements attaqués du seul point de vue de la correcte application de la loi, la Cour suprême donne sa position sur le sens de la règle de droit et sur l’interprétation qu’il convient de lui donner. Ses arrêts de cassation ou de rejet orientent les diverses juridictions en leur indiquant comment il convient d’interpréter telle ou telle règle de droit. C’est ainsi qu’elle assure une interprétation uniforme de la règle de droit et consolide la base de la jurisprudence. Tel est le principe, mais l’article 61 de la loi n° 006/PR/98 du 07/08/98 portant organisation et fonctionnement de la Cour suprême énonce aussi une exception qui fait de la Cour suprême du Tchad, juge d’appel et juge du fond. II/ LA COUR SUPRÊME : JUGE D’APPEL Comme juge de second degré, la Cour suprême du Tchad reprend entièrement l’examen tant en ce qui concerne les faits qui sont à l’origine du litige qu’en ce qui concerne les règles de droit appliquées à ces faits. De par ce pouvoir légal reconnu à la Cour suprême, elle peut soit casser la décision attaquée en déclarant que la Cour d’appel a faussement appliqué la loi, soit, au contraire, accueillir la décision attaquée en estimant que la Cour d’appel a bien appliqué la règle de droit. Bien que la technique de cassation interdise en principe que la Cour suprême substitue sa propre décision au jugement et à l’arrêt annulé, il est des cas où la Cour suprême casse sans renvoyer. Il en est ainsi lorsque le renvoi est inutile parce que la juridiction du fond n’aurait rien à juger. Telle est l’hypothèse de cassation pour contrariété de jugement : la légalité est rétablie par l’annulation de la deuxième décision en date. Il en va également lorsque la Cour suprême statue directement à la place des juges du fond. Cette possibilité est reconnue aussi à l’Assemblée plénière saisie sur second pourvoi. Celle-ci peut mettre ainsi fin au litige quand les faits, tels qu’ils ont été souverainement constatés et appréciés par les juges du fond, lui permettent d’appliquer la règle de droit appropriée. III / LA COUR SUPRÊME : JUGE DU FOND • CAUSES DE CETTE PARTICULARITE Les raisons qui ont motivé cette option tiennent du fait que le Tchad est sorti d’une longue guerre qui a pratiquement duré plus de deux décennies. L’incidence négative de cette guerre sur les structures du pays, notamment sur les structures judiciaires, est évidente. Il y a donc eu une longue période où, hélas, la relève des magistrats en âge avancé n’a pas été observée du fait de la carence dans la formation initiale. La plupart de magistrats actuellement en exercice sont jeunes et n’ont pas tous une expérience suffisante pour garantir convenablement aux justiciables une justice de qualité. Pour tout le Tchad, on ne compte qu’une seule juridiction d’appel. En cas de rébellion de la Cour d’appel (même autrement composée) par rapport à une décision de la Cour suprême, le seul recours possible est l’assemblée plénière composée de neuf magistrats au moins. Aussi, pour garantir aux justiciables une certaine célérité, faudrait-il nécessairement qu’à un moment donné la juridiction supérieure tranche et mette ainsi fin au litige et éviter que le procès ait un caractère interminable. Cette particularité rompt avec un grand principe unanimement admis et usité par la plupart des juges de cassation des pays d’expression française qui consiste à ne pas faire du Juge de cassation un juge de fait. Elle comporte assurément un certain nombre d’inconvénients qu’il convient de relever. • LES INCONVENIENTS DE LA PARTICULARITE : Il est fort à craindre que l’exercice abusif de cette faculté d’évocation donnée au juge supérieur tchadien risque de dénaturer la mission dévolue par essence à une juridiction de cassation qui est de veiller exclusivement à l’application de la loi. L’usage de cette faculté peut être de nature à rompre le principe d’égalité des citoyens devant la loi. Pour que cette égalité soit observée, il faut nécessairement que l’application de la loi soit uniforme et le pouvoir de statuer sur la conformité des décisions avec les lois de la République soit clairement défini. Cette chance, si elle en est une, doit être donnée à tout le monde. Tout justiciable ayant succombé à un procès rendu suite à une évocation a peut-être le sentiment que l’affaire n’est pas terminée et qu’il reste sur sa soif de justice. Par son pouvoir d’évocation légal, la Cour suprême du Tchad devient implicitement un troisième degré de juridiction, d’autant plus qu’elle statue et juge complètement au fond sans renvoi. Aussi, se comporte-elle comme une « super Cour d’appel ». Usant de son pouvoir de juge de fait et de droit, la Cour suprême du Tchad peut diligenter une seconde instruction à l’issue de laquelle elle prononce un arrêt de cassation emportant évocation du dossier. C’est ainsi que la section sociale de la Cour suprême, ayant cassé et annulé l’arrêt de la Cour d’appel de N’Djaména qui a déclaré abusif le licenciement d’une salariée remise à son corps d’origine après avoir perçu tous ses droits sociaux et condamné son employeur à lui verser une indemnité pour non-respect de la procédure, a évoqué et débouté la salariée. Cette particularité de la Cour suprême du Tchad ne comporte pas que des inconvénients. Elle présente certains aspects positifs. • LES AVANTAGES : Le pouvoir reconnu au Juge suprême par l’article 61 précité a un avantage réel qui consiste à éviter de longs procès souvent interminables. La règle d’évocation est de nature à éviter un deuxième pourvoi devant la Cour suprême. Il diminue notablement toute rébellion ou résistance des tribunaux ou de l’unique Cour d’appel du Tchad. La règle d’évocation se trouve également au niveau de la saisine de l’Assemblée plénière sur un second pourvoi ; en effet, l’Assemblée plénière peut mettre fin au litige lorsque les faits, tels qu’ils ont été souverainement constatés et appréciés par les juges du fond, lui permettent d’appliquer la règle de droit appropriée. Dans cette hypothèse de cassation sans renvoi, la Cour suprême ne joue plus son rôle de gardienne de droit pour constituer un troisième degré de juridiction. Cela est d’autant plus vrai que la Cour suprême se prononce sur les dépenses et les remboursements des frais engagés. Nous venons de voir que le Juge suprême au Tchad dispose d’un pouvoir d’évocation qui lui permet d’apprécier à la fois les faits et le droit. Cela constitue son originalité, mais ce système comporte de nombreux inconvénients que nous avons relevés, car il n’est pas souvent conforme à certains principes fondamentaux. Néanmoins, ce n’est qu’une faculté donnée au Juge suprême tchadien. Il ne s’agit donc que d’un pouvoir qu’on peut utiliser dans certains cas. Si on en use sans en abuser, il serait de nature à régler certains problèmes spécifiques dus aux réalités du Tchad. CONCLUSIONS Le juge de cassation assume sa fonction traditionnelle de gardienne de la loi grâce à certains principes que sont le principe de l’unicité favorisant l’unité de la législation et l’unité de la jurisprudence sur toute l’étendue de son territoire, le principe de la limite de l’intervention du juge de cassation aux questions de droit, le principe de voie de recours du droit commun de pourvoi et le principe de l’interprétation de la loi. Le juge de cassation était à l’origine cantonné dans sa fonction traditionnelle de gardien de la loi. Si les jugements étaient une opinion particulière du juge, on vivrait dans une société sans savoir précisément les engagements que l’on y contracte », et dans les déclarations de Monsieur le Chapelier à la tribune de l’Assemblée « le tribunal de cassation pas plus que les tribunaux de district ne doit avoir de jurisprudence à lui disait-il si cette jurisprudence des tribunaux, la plus détestable des institutions, existait, il faudrait la détruire. Cette conception avait trouvé un écho favorable en Italie et s’est manifestée sous la doctrine connue sous le nom de « Nomofilaschia » inspiré d’une institution grecque, les « nomophylaques » magistrats chargés d’assister aux assemblées populaires afin d’interdire toutes propositions contraires aux lois. Ensuite, les attributions du juge de cassation se sont renforcées. Outre sa mission de gardien de la loi, c’est-à-dire celle du respect des volontés du législateur, le juge de cassation dispose par voie d’interprétation de la loi d’un pouvoir créateur de droit qui lui permet d’assurer à la fois l’unité de la législation et de la jurisprudence. Pour interpréter la loi, la juge de cassation a la charge de reconstituer, non seulement « la volonté exprimée par le législateur » mais encore « l’interprétation de cette volonté au-delà de l’histoire ». Cette conception large de la fonction a pu engendrer une force créatrice de la jurisprudence. Ainsi en de nombreux domaines, des théories comme celles de l’astreinte, de l’enrichissement sans cause, la responsabilité du fait des choses sont nées de la force créatrice de la jurisprudence et sont venues illustrer cette tendance plus généreuse des pouvoirs et de la mission régulatrice : contrôle de la légalité et de la motivation cohérente des décisions rendues en dernier ressort. Il s’agit d’une interprétation par voie de doctrine qui permet au juge de dire le droit en cas de silence ou de lacune mais encore à donner une interprétation conforme aux nécessités du moment, tout en conservant à sa jurisprudence une stabilité suffisante. Je vous remercie.	Translation - English COURT OF CASSATION , COURT OF APPEAL, COURT OF ADJUDICATION Thank you, Mr Chairman. I would like to thank the King of Morocco, the President of the Supreme Court of Morocco and the office of AHJUCAF who have offered us the ideal setting for an exchange of ideas for the benefit of our courts. In the daily struggle to consolidate the rule of law, the courts occupy a prominent position and the Supreme Court plays a leading role. According to the Constitution of the Republic of Chad, the Supreme Court is the highest judicial authority in the country. Before it are brought appeals on points of law against decisions coming from the courts of appeal and the trial courts concerning civil, customary, social and criminal law. Furthermore it is also an administrative court, an audit court and a local electoral court. It must be pointed out, however, that Chad’s Supreme Court has a distinctive feature which stems from law number 006/PR/98 of 07/08/98 relating to the organisation and workings of the Supreme Court. Article 61 of this law provides that “judgments be given either at the hearing or after deliberation on a fixed day. The Ordinary Division of the Supreme Court may set aside the decision brought before it; it can then either refer the case to another court of the same rank as the one which made the contested decision, or, if the case is recognised as being one which the court can deal with on its merits, it can transfer the substantive matter to itself for hearing and determination” (évocation). This exceptional provision means quite simply that, in certain cases, the Supreme Court has the power to have a matter transferred to itself, that is it can give judgement on both fact and law. This is what makes the Court distinctive, even original, for outside its traditional role it is legally empowered to be the court of appeal and the court of adjudication. This modest paper will deal first with the traditional role of the Supreme Court and then with its power to transfer cases from the lower courts to itself for a decision, that is, its distinctive role. This will help us to ascertain the reasons for, and the advantages and disadvantages of this system. I / THE SUPREME COURT: COURT OF CASSATION As with other courts of cassation, the general rule with Chad's Supreme Court is that it does not examine the facts of a case, but rather it seeks to ascertain that there has been a proper application of the law. It regulates the other courts, guarantees consistency in case law and contributes to a unified interpretation of the law. In its capacity as the highest court in the land its fundamental, traditional role is to oversee the proper application of the law and to ensure that case law is unified and harmonious. With regard to Article 7 of law number 004/PR/98 of 25/5/98 concerning the organisation of the judiciary, the Supreme Court is the highest court in the ordinary, administrative and auditing hierarchies. In that regard, it acts as the Court of Cassation in all matters, and it therefore cannot re-examine the facts and impose another version of those facts. The Court considers these facts as having been conclusively established by the lower courts. It therefore does not judge the case; it judges the judgment. By examining contested decisions solely from the point of view of the proper application of the law, the Supreme Court sets out its position on the meaning of the law and on the interpretation that should be given to it. Its rulings setting aside contested decisions or dismissing referrals guide the various other courts by showing them how to interpret any rule of law properly. In this way the Court ensures a uniform interpretation of the law and consolidates the foundations of case law. That is the general rule, but Article 61 of law number 006/PR/98 of 07/08/98, concerning the organisation and workings of the Supreme Court, also sets out an exception to this rule that makes Chad’s Supreme Court a court of appeal and a court of adjudication. II/ THE SUPREME COURT: COURT OF APPEAL As a court of second instance, Chad’s Supreme Court completely re-examines the case, both as to the facts, which are the cause of the litigation, and as to the rules of law applied to those facts. By this power, the Supreme Court may either set aside the contested decision by declaring that the Court of Appeal has wrongly applied the law, or alternatively uphold the contested decision by judging that the Court of Appeal has correctly applied the rule of law. Although, in principle the technique of setting aside a decision prohibits the Supreme Court from substituting its own decision for the judgment that has been set aside, there are cases where the Supreme Court sets aside a decision without remitting the matter for re-trial (le renvoi).This is the case when returning the matter to the Court of Appeal for re-trial would be unnecessary because the lower court would have nothing to judge. Such is the theory behind setting aside a decision on a point of law in contrast with passing judgment: legality is only re-established when the second decision in time is set aside. This is also the case when the Supreme Court directly determines the outcome of the case, instead of the lower courts. The Plenary Assembly of the Supreme Court also has this power when it deals with a second referral on the same point of law after the lower court has refused to follow the first interpretation made by the Supreme Court (saisie sur second pourvoi). This can bring an end to the litigation when the facts, which have been conclusively established and assessed by the lower courts, allow the Supreme Court to apply the appropriate rule of law. III / THE SUPREME COURT: COURT OF ADJUDICATION • CAUSES OF THIS DISTINCTIVE ROLE The reasons behind this prerogative stem from the fact that Chad emerged from a long war that lasted practically two decades. The negative effect of this war on the country’s structures, particularly on the court structures, is evident. There was therefore a long period when unfortunately judges, who were advanced in years, were not being replaced because of the lack of initial training. The majority of judges currently sitting are young, and they do not all have enough experience to sufficiently guarantee a high quality system of justice for litigants. For the whole of Chad there is only one single Court of Appeal. In the event of resistance from the Court of Appeal (even if it were composed of different judges) against a decision of the Supreme Court, the only possible recourse is the plenary assembly made up of at least nine judges. Also, so that litigants can be guaranteed a degree of swiftness in handling the case, it is necessary that at any given time the Supreme Court is able to settle and put an end to the litigation, and to prevent the process from becoming interminable. This distinctive role breaks an important principle unanimously accepted and widely used by the majority of courts of cassation in the French-speaking world, namely not to make the court of cassation a court that judges the facts. This role certainly has a number of disadvantages, which should now be set out. • THE DISADVANTAGES OF THIS DISTINCTIVE ROLE: There is good reason to fear that the abuse of the power to transfer a matter to Chad’s Supreme Court for determination may distort the essential role assigned to a court of cassation, a role which is solely to oversee the application of the law. The use of this power could breach the principle of equality of citizens before the law. To ensure that this equality is observed, the application of the law must be uniform and the power to rule on the conformity of decisions with the laws of the Republic must be clearly defined. This opportunity, if it can be described as such, must be given to everyone. Any litigant who has lost a trial following such a transfer order may feel that the matter has not been closed and that he or she is left with a feeling of injustice. Through its power to transfer cases from the lower courts for determination, Chad's Supreme Court has by implication become a court of third instance. This is all the more so since the Court can rule upon and determine a matter completely on its merits, without having to remit the case for trial before a lower court. It also behaves like a "super Court of Appeal". Using its power as a judge of fact and of law, Chad's Supreme Court can carry out a second examination of the matter, after which it may make a quashing order and have the substantive matter brought before it for determination. In this way the Social Division of the Supreme Court quashed a decision of the Court of Appeal in Chad’s capital, N'Djamena. The Court of Appeal’s decision declared as wrongful the termination, by way of a ministerial order, of a civil servant’s secondment to a private company. The employee was reinstated in her position as a civil servant after having received all her entitlements from the company. She instigated proceedings, and the Court of Appeal ordered the employer to pay damages for breach of procedure. After quashing the order, the Supreme Court ordered that the case be brought before itself for determination and dismissed the employee’s claim. This distinctive role of Chad's Supreme Court does not only have its drawbacks. There are also some positive aspects. • THE ADVANTAGES: The power given to the Supreme Court by Article 61 has a real advantage in that it avoids long, often interminable proceedings. The rule that allows a case to be transferred to the Court for determination avoids a second referral to the Supreme Court. In particular it reduces defiance or resistance from the lower courts or from Chad's sole Court of Appeal. This rule is also in evidence when the Plenary Assembly deals with a second referral. Indeed the Plenary Assembly can put an end to litigation when the facts, such as they have been conclusively established and assessed by the by the lower court, allow it to apply the law appropriately. Under this notion of setting aside a decision on points of law without remitting the case to another court for retrial, the Supreme Court no longer plays its role of guardian of the law, but instead acts as a court of third instance. This is evidenced by the fact that the Supreme Court makes rulings on costs and on the reimbursement of legal fees. We have just seen how the Supreme Court in Chad has the power to transfer matters to itself for determination, which allows it to assess both the facts and the law. This is its distinctive role, but this system has many disadvantages, which we have outlined, for often this role does not conform with certain fundamental principles. Nevertheless, it is only one power given to Chad's Supreme Court. It therefore only concerns a power that can be used in certain cases. If it is used without being abused, it will address certain specific problems arising from the realities of life in Chad. CONCLUSIONS The Court of Cassation assumes its traditional role as guardian of the law due to certain principles, namely: the principle of applying the law in a uniform manner, which encourages unified legislation and unified case law throughout its jurisdiction; the principle of limiting the involvement of the Court of Cassation to matters of law; the principle of a channel of appeal under ordinary law by way of a referral; and the principle of effectiveness. The Court of Cassation was originally confined to its traditional role of guardian of the law. This concept relies on the rigid principle of the separation of powers and on the idea that the court must limit itself to applying the law, whilst the legislature, by contrast, has the role, not only of making the law, but also of interpreting it. Supporters of this theory take their thinking from the writings of Montesquieu, who said: “In republican government, it is in the nature of the constitution for judges to follow the letter of the law. If judgments were the individual opinion of a judge, one would live in this society without knowing precisely what engagements one has contracted”. And in the speeches of Isaac le Chapelier to the French National Assembly he said: “No more than the district courts, should the Court of Cassation have its own binding precedents, and if there were a system of binding precedents, that most detestable of institutions, it would have to be destroyed. The only aim of the provisions upon which you are to deliberate is to prevent this from being introduced”, session of 18 November 1790 Parliamentary archives XX, page 516. This concept met with approval in Italy, and it emerged under the doctrine known as “Nomofilaschia”, inspired by a Greek institution, “nomophylakia”. These were judges who had the task of attending the popular assemblies so as to prohibit the passing of any bills that were contrary to the law. Later, the powers of the Court of Cassation were strengthened. In addition to its role of guardian of the law, that is its role of ensuring respect for the wishes of the legislature, the Court of Cassation, through the interpretation of the law, has the power to create law, and this allows it to ensure uniformity of both legislation and case law. In order to interpret the law, the Court of Cassation has the task of piecing together, not only “the will as expressed by the legislature”, but also “the interpretation of this will across the ages”. This broad perception of the Court’s function has engendered a creative strength in its case law. Thus in a number of areas, theories like the imposition of coercive penalties for failure to comply with a court order (l’astreinte), unjust enrichment (l’enrichissement sans cause) and liability for damage caused by things under one’s control (la responsabilité du fait des choses) were born from the creative strength of the Court’s case law. These theories have come to illustrate a tendency towards a more generous interpretation of the powers and the regulatory role of the Court, namely reviewing decisions given at final instance as to their legality and the coherency of their statements of reasons. What this concerns is an interpretation of the Court’s role making use of doctrine that allows it to express the law in cases where the law is silent, or where there are lacunae. That doctrine also allows the Court to provide an interpretation that meets with the requirements of the moment, whilst retaining sufficient stability in its case law. I thank you.

Source text - French LA MOTIVATION BREVE EN QUESTION Guy CANIVET Premier President de la Cour de Cassation Si l’on admet que la motivation est l’ensemble des justifications de toute nature qui fonde la décision d’un juge, on se rend compte, selon que l’on s’adresse à des Cours de Common Law ou de Civil Law, que la technique de motivation est différente : dans un cas, on aura une motivation brève, dans l’autre, une motivation très explicite. Au-delà de ces différences formelles, on se rend compte que cette rupture dans la technique de motivation correspond à des fonctions différentes ou à des pouvoirs différents des juges de Common Law et des juges de Civil Law. Le juge de Common Law a un pouvoir de création de la norme, de la règle. Il va choisir le terrain sur lequel il va vouloir créer un précédent, qu’il s’agisse d’une affaire socialement discutée, d’un grand problème de société et, à partir de ce précédent, il va créer une règle nouvelle, soit par correction, soit par ajout d’un précédent ancien. Par conséquent, c’est un juge qui crée la loi. Créant la loi, il a l’obligation d’en donner les motifs ; autrement dit, comme il va se déterminer non seulement par des motifs juridiques, mais par des données de fait et des valeurs sociales mises en œuvre et communément admises par la société, il va devoir se justifier de sa décision devant l’espace social auquel il s’adresse. C’est la raison pour laquelle ce juge de Common Law motive longuement ; c’est également la raison pour laquelle, au lieu d’avoir une décision complètement collective, on a une confrontation de décisions individuelles qui vont déterminer une majorité, donc le motif majoritaire sera celui du juge qui aura eu la motivation complète, alors que la minorité s’expliquera par des opinions dissidentes. Pour le juge de Civil Law, la problématique n’est pas la même. Ce n’est pas lui qui crée la loi, il l’interprète. L’interprétant le fera selon des logiques purement juridiques qui, par conséquent, vont conduire à des motivations brèves. Quelles sont les raisons qui font que ce juge de Common Law ne peut pas motiver longuement ces décisions et est contraint à ces motivations brèves ? En quoi n’est-ce pas satisfaisant ? Quels sont les palliatifs qui permettront de répondre à cette nécessité de motivation ? Pourquoi ce juge de Civil Law et, en particulier, le juge de cassation française motivent-ils brièvement ? La première raison tient à la technique de cassation elle-même. Qu’est-ce que la technique de cassation française ? Les parties vont poser au juge un certain nombre de questions de manière très formalisée, selon des règles très précises que l’on appelle des moyens et le juge ne fait que répondre à ces questions ; autrement dit, un arrêt de cassation est un ensemble de réponses à des griefs purement juridiques formés à partir d’une décision rendue par un juge dit du fond. Ce juge de cassation ne raconte pas une histoire, la décision de cassation n’est pas un récit ni une motivation globale de la solution du litige, mais c’est une succession de réponses logiques aux questions juridiques posées à ce juge. La deuxième raison est la séparation des pouvoirs. Le juge français, le juge de Civil Law ne crée pas la loi, il l’interprète. Par conséquent, l’interprétant va lui donner un sens soit grammatical, soit plus éloigné, par des raisonnements plus complexes, a contrario ; en tout cas, il est subordonné à la loi. Interprétant la loi, il n’a pas à donner les raisons du législateur ; il ne peut pas se substituer au législateur pour expliquer le sens de la loi de manière critique ou approbative. Puisque la loi est l’expression de la volonté générale, le juge ne peut ni ajouter ni transformer ni justifier la volonté générale. Voilà pourquoi lorsque le juge interprète la loi, il en révèle le sens en la répétant purement et simplement. Voilà les deux raisons pour lesquelles ce juge de cassation est enfermé dans une motivation brève. Est-ce satisfaisant ? D’abord, ce juge ne justifie pas la loi, mais il ne justifie pas même les raisons de la méthode d’interprétation de la loi ; autrement dit, s’il est passé par un raisonnement a contrario ou purement syntaxique, il ne va pas dire pourquoi, mais il donnera le sens de la loi telle qu’il la comprend, sans dire quelle est sa méthode d’interprétation. C’est de là qu’est venue, semble-t-il, la critique la plus forte d’un certain nombre de commentaires depuis très longtemps, notamment une critique interne d’un procureur général de la Cour de cassation, M. Adolphe Touffait et d’un professeur, André Tunc. L’un et l’autre ont rédigé un article intitulé : « Pour une motivation plus explicite des arrêts de la Cour de cassation ». Ils expliquent que cette absence de motivation des Cours de cassation correspond pour elles à une perte d’influence parce que, dans l’opinion, on a besoin de connaître les raisons du juge. C’est parce que ce juge n’argumente pas sur ces raisons que, disent ces commentateurs, « les Cours de cassation perdent de l’influence », car elles n’arrivent pas à faire passer la conviction de leurs décisions dans l’opinion publique. Ce courant de contestation vient en réalité d’auteurs qui sont soit habitués aux juridictions supranationales, ce qui est le cas d’Adolphe Touffait qui était juge à la Cour de justice des Communautés européennes avant d’être procureur général à la Cour de cassation, et d’André Tunc qui était un grand comparatiste du système français avec le système anglo-américain. On voit bien que c’est de la comparaison qu’est venue la critique sur cette motivation brève. S’il faut faire changer la motivation brève, quels sont les moyens pour cela ? D’abord, rien n’empêche le juge, même dans notre système de Civil Law où il ne crée pas le droit, de donner les raisons pour lesquelles il interprète la loi différemment. C’est sous l’angle de la sécurité juridique que cette absence de motivation devient le plus contestable. Le juge de cassation qui, pendant un siècle, aura interprété l’article 1384 du Code civil d’une telle manière, va un jour l’interpréter différemment. Est-il logique que, changeant complètement l’interprétation de la loi, il n’en donne pas les raisons ? C’est ce qui devient insupportable en sécurité juridique ; si le juge change l’application de la loi, encore lui appartient-il de dire pourquoi il le fait et quelles raisons déterminantes le poussent à ce changement. Ces raisons sont généralement connues : l’article interprété est devenu obsolète, incohérent dans le système juridique et il est devenu indispensable de l’interpréter différemment. La première poussée est sous l’angle de la sécurité juridique qui conduirait le juge à motiver pour lui-même et à réfléchir en lui-même des raisons de changer l’interprétation. La deuxième raison pour laquelle le juge va sortir de cette réserve d’interprétation est l’émergence des normes supranationales. Lorsque l’on applique le droit de la Convention européenne des Droits de l’Homme, par exemple, avec des logiques de confrontation entre le droit national et le droit de la convention, et que le juge peut écarter l’application du droit national, il sera bien obligé de dire pourquoi il l’écarte, selon des logiques de proportionnalité, de subsidiarité ou de réserve d’interprétation. Il va être obligé d’expliquer pourquoi il évince le droit national pour le faire primer par un droit supranational. Si ce juge est interpellé dans cette obligation de mieux motiver, comment va-t-il procéder en gardant sa propre technique, la technique de cassation et en donnant des raisons à l’opinion publique qui en demande et à la classe juridique ? Il y a deux manières de le faire. D’abord, en rendant public tout ce que l’on appelle les instruments préalables aux arrêts de la Cour de cassation. Ce matin, M. le Procureur général Jean Dujardin a dit qu’une décision de la Cour de cassation est précédée d’un certain nombre d’études qui sont d’abord l’avis de l’avocat général et, ensuite, le rapport du rapporteur. On se rend compte que, si l’on publie l’avis de l’avocat général et le rapport du rapporteur avec les décisions, on a déjà bien là un ensemble de raisons qui ont conduit le juge à déterminer sa décision. Autrement dit, les motifs ne sont pas clairement exprimés, mais la problématique dans laquelle le juge a statué est clairement exprimée. La deuxième manière de procéder est celle des rapports, que pratique la Cour de cassation, consistant à publier chaque année les grands arrêts créateurs de droit rendus par la Cour et d’assortir ces arrêts d’un commentaire qui les replace dans un courant jurisprudentiel, ce qui permet d’avoir une vue rétrospective, c’est-à-dire pourquoi on en est arrivé là, et une vue prospective qui permet de discerner pourquoi et où l’on va. En dégageant ces grands courants de jurisprudence, on arrive à justifier cette création jurisprudentielle par le juge de cassation. Ces deux manières peuvent être contestables. Dans un cas, il s’agit d’ouvrir au public les instruments préparatoires à la décision et, dans l’autre, de permettre au juge d’ajouter à sa décision par son propre commentaire. On disait ce matin que le juge de cassation avait une doctrine et on s’étonnait que ce soit le cas. Si le juge commente lui-même sa décision, il exprime plus que la décision, il donne la raison de sa décision dans une doctrine continue. Voilà, me semble-t-il, ce qui permet en tout cas de garder cette technique précieuse qui est notre culture juridique des systèmes de Civil Law dans ses méthodes d’interprétation de la loi et de contrôle de la légalité des décisions du fond, tout en donnant satisfaction à ce courant assez fort exprimé par l’opinion des juristes de devoir motiver plus expressément les décisions de justice.	Translation - English WHY DO OUR COURTS GIVE BRIEF STATEMENTS OF REASONS? Guy Canivet First President of France's Court of Cassation If we accept that the statement of reasons contains the entire rationale that forms the basis of a court's decision, we realise that the technique of setting out those reasons is different, depending on whether we are looking at common law or civil law courts. In one there is a brief statement of reasons, in the other a very detailed one. Aside from these differences in form, we realise that this divergence in the technique of setting out the reasons for a decision corresponds with the different functions or the different powers of the common law and civil law courts. Common law judges have the power to create the law or rule. They will choose the area in which they wish to create a precedent, be it a socially controversial matter or a major social problem. From this precedent, they will create a new rule, either by revising, or by adding to an old precedent. Consequently, it is the judges who create the law. Since they create the law, they must give reasons for doing so. To put it another way, as they will decide a matter, not only on legal grounds, but also on issues of fact and the social values practised and commonly accepted by society, they will have to justify their decision to the social arena they are addressing. This is why common law judges give lengthy statements of reasons. It is also the reason why, instead of having a completely collective decision, there is a comparison of individual decisions from which a majority will be determined. Therefore the majority decision will be that of the judge who presents a complete statement of reasons on behalf of the court, while the minority set out their position in the dissenting opinions. For the civil law court, the problem is not the same. It does not create the law; it interprets the law. The court does this according to purely legal processes which consequently result in a brief statement of reasons. Why is the civil law court not permitted to give long statements of reasons in its judgments, but is instead restricted to short statements? In what ways is this unsatisfactory? What can be done to alleviate this paucity of reasoning? Why does the Civil Law court, and in particular the French Court of Cassation, give brief statements of reasons? The first reason has to do with the actual method of setting aside a decision on a point of law, known as “cassation”. What is the French method of cassation? The parties will put a number of questions, called grounds of appeal, to the court in a very formal manner, according to very precise rules, and the court responds only to those questions. To put it another way, a cassation judgment is a collection of responses to purely legal grounds of appeal drawn from a decision given by a court of first instance or a court of appeal, known as the juge du fond. The Court of Cassation does not recount the facts of the case. The cassation decision is not a narrative, nor does it provide a global statement of reasons in response to the litigation. Instead it is a series of logical replies to legal questions put to the court. The second reason concerns the separation of powers. The French court - the civil law court - does not create the law; it interprets the law. Consequently, the interpreter will give it either a grammatical or a more detached meaning through more complex reasoning, a contrario. In any case, the court is subordinate to the law. When interpreting the law, the court does not have to give the reasoning of the legislature; it can not substitute itself as the legislature in order to explain the meaning of the law in either a critical or approbative manner. Since the law is the expression of the general will, the court cannot add to, transform or justify the general will. That is why, when the court interprets the law, it reveals its meaning by purely and simply repeating the law. Those are the two reasons why the Court of Cassation is restricted to a short statement of reasons. Now the question is: is this satisfactory? First of all, the Court does not justify the law, nor does it even justify the reasons behind the method of interpreting the law. In other words, if the Court relies upon a contrario or purely syntactic reasoning, it will not say why. Instead, the Court will give the meaning of the law such as it understands it, without saying what its method of interpretation is. It appears that that is where the strongest criticism from a certain number of commentators over a very long period of time has come from, in particular internal criticism from Principal Counsel for the State at the Court of Cassation, Adolphe Touffait, and from a professor of law, André Tunc. Both drafted an article entitled “Pour une motivation plus explicite des arrêts de la Cour de cassation”, in which they called for more detailed statements of reasons in the decisions of the Court of Cassation. They explain that this absence of reasoning from the courts of cassation means that the courts’ influence is undermined because, in their opinion, the reasoning of the Court needs to be made known. It is because the Court does not present its reasoning that, in the words of these commentators, “the Courts of Cassation are losing influence”, as they cannot convey the conviction of their decisions to the public. This current of dissent actually comes from those who are used to supranational jurisdictions, which is the case with Adolphe Touffait, who was a judge at the Court of Justice of the European Communities before becoming Principal Counsel for the State at the Court of Cassation, and André Tunc, who was a great comparatist of the French system with the Anglo-American system. It is clear that this criticism of the short statement of reasons has come from that comparison. If it is necessary to change the short statement of reasons, what are the grounds for doing so? First of all, nothing prevents the court, even in our civil law system where it does not create the law, from giving reasons why it interprets the law differently. From the point of view of legal certainty, the absence of a detailed statement of reasons becomes most questionable. Thus the Court of Cassation, which for a century has interpreted Article 1384 of the French Civil Code in a certain way, one day decides to interpret it differently. Is it logical then that, in completely changing the interpretation of the law, the Court does not give its reasons for doing so? In terms of legal certainty this is what has become unacceptable. If the court changes the application of the law, it is up to the court to say why it has done so and what determining factors pushed it towards this change. In this case, these reasons are generally known: the interpretation of the Article has become an obsolete, inconsistent part of the legal system, and it is now essential that the Article be interpreted differently. The first force for change is from the perspective of legal certainty, which should lead to the court providing reasoned decisions for itself and to the court itself reflecting on the reasons for changing its interpretation. The second reason why the court will depart from its existing interpretation is the emergence of supranational laws. When the law of the European Convention on Human Rights, for example, is applied and there are conflicting principles between national and Convention law, the Court may put aside the application of national law. It will then be obliged to say why it has done so, in keeping with the principles of proportionality, subsidiarity, and effectiveness. It will be obliged to explain why it has supplanted national law so that supranational law holds primacy. If the court is taken to task over the requirement to provide more detailed reasons, how will it set about keeping its own technique, the technique of cassation, whilst providing reasons both to the public, who have requested this, and to lawyers and judges? There are two ways of doing this. First of all, it should make public all of what we call the Court of Cassation’s pre-judgment documentation. This morning Principal Counsel for the Crown, Jean Dujardin, said that a decision of the Court of Cassation is preceded by a certain number of written submissions, the first being the opinion of the Principal State Counsel, followed then by the Reporting Judge’s report. It can be seen that, if the opinion of the Principal State Counsel and the report of the Reporting Judge are published alongside the decisions, we already have a collection of reasons which led the court to reach its decision. To put it another way, the grounds of the decision are not expressed clearly, but the issues around which the Court gave its ruling are. The second way of setting about this concerns the reports produced by the Court of Cassation, and it involves publishing each year the Court’s leading cases and furnishing these decisions with a commentary that places them in the context of an evolving case law. This provides a retrospective view, that is, it explains how the Court arrived at this point, and a prospective view, which makes it possible to ascertain where the Court is going and why. By drawing from these leading developments in case law, we can justify this creation of legal precedents by the Court of Cassation. These two methods may be questionable. As for the first, it concerns opening up to the public the pre-decision documentation, and with the second, it allows the court to add to its decision by providing its own commentary. This morning we said that the Court of Cassation had its own legal doctrine and we were surprised that this was the case. If the Court comments on its own decision, it expresses more than the actual decision; it gives the reasons for its decision as part of a continuing legal doctrine. It appears to me that this is what makes it possible to retain this precious technique of cassation – a technique that underpins the legal culture of civil law systems – as part of the methods of interpreting the law and reviewing the legality of the decisions of the lower courts. At the same time it satisfies this tendency, expressed quite strongly by the opinions of jurists, towards the courts being required to convey the reasoning in their decisions more clearly.

Foram aprovados dois regulamentos sobre a recolha de dados estatísticos e acção financeira correspondente, bem como alterações ao regulamento que estabelece os Totais Admissíveis de Captura e Quotas (TAC) para 2000, tendo também sido aprovadas alterações relativamente ao regime de conservação dos recursos da pesca no Mediterrâneo. Foram aprovados, ainda, os contingentes pautais para 2000 relativamente a certos produtos da pesca e revisto o quadro jurídico relativo à consulta da indústria e dos meios interessados na Política Comum das Pescas. O Conselho adoptou um conjunto de Orientações Políticas referentes à realização de Ateliers Regionais, instrumentos de consulta dos vários sectores interessados nas questões relevantes que se apresentam no sector da pesca e foi iniciado o debate sobre a revisão do Programa de Orientação Plurianual da Frota (POP IV). The report on this subject was presented to and approved at the Santa Maria da Feira European Council, following recommendations from the Cologne and Helsinki Summits. Two regulations on the collection of data and appropriate financial measures were approved, as were amendments to the regulation setting Total Allowable Catches (TACs) and quotas for 2000. Amendments to the conservation regime for fishery resources in the Mediterranean were also approved. Even annual tariff quotas for 2000 relating to certain fishery products and the legal framework concerning the consultation of industry and those affected by the Common Fisheries Policy were approved. The Council adopted a range of Political Guidelines relating to the creation of Regional Workshops as consultation instruments for the various sectors involved in the fishery industry. In addition, they initiated the debate on the review of the fishing fleet Multi-Annual Guidance Programme (MAGP IV). Finally, we refer to the Informal Council of Ministers for Agriculture, which took place at Evora. The Portuguese Presidency proposed as a topic for debate: “Quality through diversity: a challenge for European Agriculture”. This is unavoidable in the medium term, particularly in view of the future enlargement of the Union. Indeed, given the framework which is expected to come from the negotiations in the World Trade Organisation (WTO), and the need to adapt to a new range of demands, it is necessary to start to consider creating new directions for the Common Agricultural Policy (CAP). The Evora Informal Council served to launch this debate by proposing topics, which, far from being innocuous within the EU, could potentially lead to a significant breakdown in European agriculture. These topics included: o Strengthening diversity as a means of retaining territorial balance o The certification of specific quality products as an essential part of that diversity o Setting a minimum standard of quality for products and the generalisation of guarantees for consumers, and, finally o Guarantees to strengthen CAP in respect of support for the production of public goods and to reinforce attitudes in favour of integration of environmental concerns and sustainability in the sector.

Source text - Spanish Compra de Vivienda Trámites previos: el documento privado En la compraventa de vivienda es frecuente que, con carácter previo al otorgamiento de la escritura pública, se firme un contrato privado entre vendedor y comprador. No es posible en este reducido espacio comentar todos los aspectos del documento privado de compraventa, pero sí remarcar algunas cuestiones que debería de tener en cuenta antes de estampar su firma en uno de ellos: a) Quién firma por la parte vendedora: Cuando vende un promoter, normalmente es el administrador o el apoderado de la sociedad, pero si es un negocio entre particulares, el documento ha de ser firmado por todos los propietarios. Si el vendedor ha dado un poder notarial a otra persona para que firme este documento, el apoderado deberá de presentar la copia autorizada notarial, es decir, el original firmado por el Notario, no una mera fotocopia, y el poder deberá facultarle para la venta, por lo que es conveniente comprobar, leyendo la escritura de poder, que el apoderado está autorizado para formalizar la compraventa. b) Estado de cargas de la vivienda: Es muy importante determinar qué cargas recaen, en su caso, sobre la vivienda. Con frecuencia existirá una hipoteca, en la que el comprador tendrá que subrogarse, es decir, aceptarla y convertirse en deudor de la parte que quede por pagar, frente al Banco o Caja que la haya concedido. c) Cuotas de la comunidad de propietarios: Si la vivienda se encuentra en una comunidad, tendrá que abonar periódicamente la cuota que le corresponda. Hay que comprobar que está al día en cuanto a los pagos o, si no lo está, qué atrasos tiene, solicitando este dato al presidente o al administrador de la comunidad, el cual también podrá informar de los estatutos o normas internas que tenga el edificio. d) Precio y arras.- En el contrato figurará el precio de la vivienda. También si está completamente abonado o queda aplazado en todo o en parte, y la manera de satisfacer la parte aplazada. Es habitual que se pacten arras, es decir, que se establezca una cierta cantidad que el comprador entrega al vendedor como arras o señal (y que suele ser también parte del precio), de forma que si finalmente no se llega a otorgar la escritura pública, el comprador las perderá si es por su culpa, o el vendedor habrá de devolverlas duplicadas, si es por la suya. Es un medio para vincular a ambas partes. e) Gastos de la compraventa: Son cuatro los gastos derivados de la compraventa: - Impuesto sobre el Incremento de Valor de los Terrenos Urbanos (comúnmente llamado Plusvalía). - Escritura Pública. - Inscripción en el Registro de la Propiedad. - Impuestos	Translation - English Purchasing a Property in Spain Preliminary Steps: the Private Document When purchasing a property in Spain, the vendor and purchaser often sign a private contract (contrato privado), prior to execution of the public deed (escritura pública). It is not possible to comment here on every aspect of the private document, but it is worth highlighting some issues which people should take account of before signing such a document. a) Who signs on behalf of the vendor? When a property development company is selling, it is normally a director or agent of the company who signs. However, in the case of a transaction between individuals, the document must be signed by all the owners. If the vendor has given a power of attorney (un poder notarial) to another person to sign the document, the attorney must produce the authorised, notarised version. This means the original signed by the Notary (Notario), and not merely a photocopy. The power of attorney must grant a power of sale to the attorney. It is therefore advisable to check that the attorney is authorised to complete the sale by reading the power of attorney deed. b) Charges affecting the Property: It is very important to determine what charges, if any, are registered against the property. Often there will be a mortgage, in which case the purchaser will have to assume the mortgage . This means that (s)he will have to take over the mortgage and become liable for the amount still owed to the bank or building society which provided the mortgage. c) Service Charges of the Property Owners Association: If the property is part of a Property Owners Association or Community of Owners (Comunidad de Propietarios), regular community service charges will have to be paid. It is necessary to check that these payments are up to date, or if they are not, what arrears there are. This information can be obtained from the chairman (presidente) or manager (administrador) of the Association, who will also be able to confirm the bye-laws and rules of conduct applicable to the building. d) Purchase Price and Deposit: The contract will contain the purchase price of the property. It will also confirm whether the sum has been settled in full or whether all, or part of it, remains outstanding, and the arrangements for payment of the outstanding sum. It is usual for the parties to agree a deposit. This means that they designate a certain sum of money which the purchaser hands over to the vendor as a security deposit for the sale. Normally this sum also forms part of the purchase price. If in the end, the public deed is not executed and the purchaser is at fault, (s)he will lose the deposit. If the vendor is at fault, (s)he will have to pay double the amount of the deposit to the purchaser. This is a means of binding both parties. e) Disbursements on the sale: There are four disbursements arising out of the sale: • Capital Gains Tax on Urban Properties (often called “Plusvalía” in Spain) • The Public Deed • Registration of Title at the Land Registry • Taxes.

Greenspan ha pilotado la autoridad monetaria estadounidense durante 18 años y medio. However, there are also those who accuse him of having fed the “dotcom” bubble in the 1990s with speeches favouring this new model for growth. He is accused of allowing – even encouraging - the huge inequalities currently afflicting the US economy, and of re-acting too slowly to the exuberance – which some described as irrational – of the property market in recent years. In spite of these critics, who are no doubt in the minority among the US’s political and economic elite, Greenspan leaves his post shrouded in a halo of prestige and respect, which on occasions borders on veneration. The “Maestro” - an epithet coined by renowned journalist, Bob Woodward - was considered until recently to be an irreplaceable oracle for the stability of financial markets. Según el Consejo de la Abogacía Europea, que representa a ms de 700.000 abogados, la aplicación de leyes más restrictivas no es necesariamente situación de mayor eficacia en la lucha contra eI terrorismo. Madrid, 9 de diciembre. El Consejo de la Abogacía Europea (CCBE), a propuesta de la delegación espanola, ha emitido una declaración unánime para mostrar su profunda preocupación por la situación de los Derechos Humanos que aplican algunos Estados en el ámbito de la actividad antiterrorista. El Consejo de la Abogacía Europea, organismo internacional que representa a más de 700.000 abogados de toda Europa, mantiene serias dudas sobre la legalidad internacional de varias iniciativas y normas nacionales y comunitarias aprobadas tras los atentados terroristas de los últimos años según informaron después de una sesión plenaria convocada por los Consejos Nacionales de la Abogacía en París. En dicha reunión, los abogados mostraron su condena al terrorismo internacional pero también dejaron claro que ciertas prácticas de los gobiernos, en materia antiterrorista, pueden vulnerar los derechos más fundamentales de la persona. Los abogados reconocen la dificultad de combinar derechos civiles y seguridad, pero aseguran que es posible y además, que se trata de una coexistencia que garantiza todos los valores democraticos. Los miembros del CCBE consideran un instrumento eficaz el Convenio Europeo de Derechos Humanos que defiende las libertades personales y es totalmente compatible con a legislación internacional contra el terrorismo. Diversos organismos internacionales, como el Parlamento Europeo, Consejo de Europa, Consejo de Seguridad o el Alto Comisionado de las Naciones Unidas para los Derechos Humanos también han mostrado su preocupación por el asunto y desean encontrar el equilibrio entre seguridad nacional y protection de las libertades fundamentales. La Abogacía Europea recordó que la aplicación de leyes más restrictivas no es necesariamente sinónimo de mayor eficacia en la lucha contra terrorismo. Translation - English European Bar Association concerned about Human Rights in current Anti-Terrorist climate Prensa CGAE (Official publication of the Spanish Bar Association) 09/12/05 Adopting more restrictive legislation is not necessarily the most effective way to combat terrorism, according to the Council of Bars and Law Societies of Europe (known by its French initials CCBE), which represents over 700,000 lawyers. Madrid, 9 December. Following a proposal from the Spanish delegation, the Council of Bars and Law Societies of Europe made a unanimous declaration expressing deep concerns over how some states apply human rights in the fight against terrorism. At a plenary meeting in Paris, convened by the Bar associations and Law Societies of the Member States, the CCBE, an international organisation representing over 700,000 lawyers throughout Europe, expressed serious doubts over the international legality of various national and community laws and initiatives adopted after terrorist attacks in recent years. At the meeting lawyers condemned international terrorism, but they also made it clear that certain government practices in the fight against terrorism could breach the most fundamental of human rights. Data protection, the right to privacy and professional confidentiality are examples of some of the issues which concerned them. Lawyers invited the governments to comply with international legislation and thereby guarantee respect for human rights, as these do not interfere in any way with the security of the state. The CCBE expressed its concern over the growing tendency on the part of governments to adopt case-by-case legislation after each attack. Apart from there being serious doubts over the effectiveness of such legislation, it can also have consequences for the pillars of European civilisation and values. The lawyers recognised the difficulty in combining civil rights and security, but they emphasised that this is possible and furthermore that such a coexistence guarantees all democratic values. The members of the CCBE believe that the European Convention on Human Rights has proved to be an effective tool in defending personal freedoms, and one which is totally compatible with international legislation against terrorism. Various international organisations, such as the European Parliament, the Council of Europe, the [UN] Security Council and the UN High Commissioner for Human Rights, have also expressed concern on this subject and they want to strike a balance between national security and protecting fundamental freedoms. The CCBE reiterated that adopting more restrictive legislation is not necessarily the most effective way of fighting terrorism. The lawyers also wanted to stress that passing several laws to persuade public opinion that a government is dealing with terrorism only increases feelings of insecurity among the very citizens a democratic state of law is there to represent.

Bio

My work involves translating, proofreading and revising texts from French, Portuguese and Spanish into English, a large proportion of which are legal and financial (see my CV for additional information, or visit my website: www.dpmtranslations.co.uk). In addition, I regularly translate large reports from governments and NGOs. Usually these reports have a European Union dimension, and so there is a requirement that the language is harmonised with EU terminology and style.
I am also commissioned to translate and proofread a variety of commercial texts, including tender documentation, business web sites, marketing and corporate literature, sponsored editorials, flyers and tourist brochures. My clients range from advertising agencies to zoos!
In 2009, I was appointed as a Visiting Lecturer at the University of Westminster (London), teaching Spanish Legal Translation on the European Master’s Degree Course in Technical and Specialised Translation.
