Hintergrund der Auseinandersetzungen zwischen den Parteien
Ausgangspunkt der Auseinandersetzungen zwischen der Antragstellerin und der Antragsgegnerin ist ein zwischen der Antragstellerin und der XXX am [Datum] geschlossener Finanzierungsvertrag (Loan Agreement). Die Antragstellerin gewährte XXX damit ein Darlehen i.H.v. US$ 350 Millionen. Partei des Loan Agreements war auch die Antragsgegnerin. Denn die Rückzahlung des XXX gewährten Darlehens sollte nicht direkt durch XXX als Schuldnerin erfolgen, sondern über einen komplizierten Rückzahlungsmechanismus. Ziel dieser Gestaltung war es, mexikanischen Unternehmen zu ermöglichen, durch die Aufnahme eines Kredits von YYY in kubanische Unternehmen zu investieren (debt-for-investment mechanism).
Die Antragsgegnerin war insoweit an dem Rückzahlungsmechanismus beteiligt, als die Rückzahlung des Darlehens im wesentlichen durch die Ausschüttung von Dividenden der Antragsgegnerin erfolgen sollte, die einem anderen staatseigenen kubanischen Unternehmen zustanden, das mehrheitlich an der Antragsgegnerin beteiligt war. Bereits das Loan Agreement definierte daher umfangreiche Pflichten der Antragsgegnerin, um das Funktionieren dieses Rückzahlungsmechanismus sicherzustellen. Unter anderem war die Antragsgegnerin nach dem Loan Agreement verpflichtet, monatlich bestimmte Beträge auf ein zu diesem Zweck eingerichtetes Treuhandkonto (escrow account) einzuzahlen.

Die Pflichten der Antragsgegnerin nach dem Loan Agreement wurden durch einen im Jahre 1994 geschlossenen und im Jahre 2000 erneuerten Vertrag (Escrow Agreement) konkretisiert.

Unterschiedliche Regelungen enthalten das Loan Agreement und das Escrow Agreement insbesondere zur Streitbeilegung. Während das Loan Agreement (vgl. Art. ...) eine Schiedsklausel enthält, ist nach der Gerichtsstandsvereinbarung in dem Escrow Agreement (vgl. Art. 22) die Zuständigkeit der italienischen Gerichte in Turin begründet.
Die Auseinandersetzungen zwischen der Antragstellerin und der Antragsgegnerin begannen nach dem Erlass eines Dekrets vom [Datum] durch die kubanische Regierung, das die von der Antragsgegnerin gegenüber der Antragstellerin eingegangenen Verpflichtungen für wirkungslos erklärte. Die Antragsgegnerin teilte der Antragstellerin daraufhin mit, ab dem Zeitpunkt des Inkrafttretens dieses Dekrets ihre Verpflichtungen aus dem Escrow Agreement nicht mehr erfüllen zu können.
In der Folge leitete die Antragstellerin wegen der Verletzung des Escrow Agreements ein Verfahren gegen die Antragsgegnerin vor dem Landgericht in Turin ein. In diesem Verfahren beantragte die Antragstellerin in der Hauptsache festzustellen, dass der Erlass der kubanischen Regierung vom [Datum] nicht zur Auflösung des Escrow Agreements geführt hat und die Antragsgegnerin daher weiter an die Verpflichtungen aus dem Escrow Agreement gebunden ist. Darüber hinaus beantragte die Antragstellerin, die Antragsgegnerin zur Zahlung der Beträge zu verurteilen, die nach dem Escrow Agreement monatlich fortlaufend zu zahlen gewesen wären.
Im Gegenzug leitete die Antragsgegnerin auf der Basis der Schiedsklausel in dem Loan Agreement ein ICC Schiedsverfahren in Paris ein.

Background of the dispute between the Parties.
Origin of the disputes between the Opponent and the Applicant is a financing agreement (Loan Agreement) concluded between the Applicant and XXX on [Date]. With this Loan Agreement, the Applicant granted a loan to XXX in the amount of USD 350 million. The Opponent was also a party to the Loan Agreement. Repayment of the loan granted to XXX was not to be performed directly by XXX, being the debtor, but through a complicated repayment mechanism. Objective of this design was to enable Mexican companies to invest in Cuban companies by taking out a loan from YYY (debt for investment mechanism).
The Opponent was involved in the repayment mechanism insofar as the loan was to have been repaid chiefly with distributions of the Opponent’s dividends, which were to be received by another government-owned Cuban company that had majority control of the Opponent. The Loan Agreement therefore already defined extensive obligations of the Opponent, in order to ensure the functionality of this repayment mechanism. Among others, the Opponent was obligated according to the Loan Agreement to deposit specific amounts into an escrow account established for this purpose.

The Opponent’s obligations according to this Loan Agreement were concluded with a contract, which commenced in 1994 and was renewed in 2000 [Escrow Agreement].

The Loan Agreement and the Escrow Agreement contain different regulations, in particular regarding the settlement of disputes. While the Loan Agreement (cf. Article ...) contains an arbitration clause, the Escrow Agreement (cf. Article 22) enforces the competency of the Italian courts in Turin.
The disputes between the Applicant and the Opponent began after the Cuban government decreed [date] that the obligations accepted by the Opponent vis-à-vis the Applicant were without force. Following this, the Opponent notified the Applicant that it could no longer fulfill its obligations arising from the Escrow Agreement as of the effective date of this decree.
Resulting from this, the Applicant filed proceedings against the Opponent with the regional court Turin for a breach of the Escrow Agreement. In this pro-ceeding, the Applicant filed for the principal object to be that the decree of the Cuban government dated [date] did not result in a dissolution of the Escrow Agreement and that the Opponent therefore is still bound to the obligations of the Escrow Agreement. Furthermore, the Applicant filed for an adjudgment of the Opponent for payment of the amounts, which would have had to be paid continuously on a monthly basis according to the Escrow Agreement.
In return, the Opponent initiated an ICC arbitration proceeding in Paris based on the arbitration clause of the Loan Agreement.
