Steuerfrei sind40. die Hälftea. 1der Betriebsvermögensmehrungen oder Einnahmen aus der Veräußerung oder der Entnahme von Anteilen an Körperschaften, Personenvereinigungen und Vermögensmassen, deren Leistungen beim Empfänger zu Einnahmen im Sinne des § 20 Abs. 1 Nr. 1 gehören, oder an einer Organgesellschaft im Sinne der §§ 14, 17 oder 18 des Körperschaftsteuergesetzes, oder aus deren Auflösung oder Herabsetzung von deren Nennkapital oder aus dem Ansatz eines solchen Wirtschaftsguts mit dem Wert, der sich nach § 6 Abs. 1 Nr. 2 Satz 3 ergibt, soweit sie zu den Einkünften aus Land- und Forstwirtschaft, aus Gewerbebetrieb oder aus selbständiger Arbeit gehören. 2Dies gilt nicht, soweit der Ansatz des niedrigeren Teilwerts in vollem Umfang zu einer Gewinnminderung geführt hat und soweit diese Gewinnminderung nicht durch Ansatz eines Werts, der sich nach § 6 Abs. 1 Nr. 2 Satz 3 ergibt, ausgeglichen worden ist. 3Satz 1 gilt außer für Betriebsvermögensmehrungen aus dem Ansatz mit dem Wert, der sich nach § 6 Abs. 1 Nr. 2 Satz 3 ergibt, ebenfalls nicht, soweit Abzüge nach § 6b oder ähnliche Abzüge steuerwirksam vorgenommen worden sind,b. 1des Veräußerungspreises im Sinne des § 16 Abs. 2, soweit er auf die Veräußerung von Anteilen an Körperschaften, Personenvereinigungen und Vermögensmassen entfällt, deren Leistungen beim Empfänger zu Einnahmen im Sinne des § 20 Abs. 1 Nr. 1 gehören, oder an einer Organgesellschaft im Sinne der §§ 14, 17 oder 18 des Körperschaftsteuergesetzes. 2Satz 1 ist in den Fällen des § 16 Abs. 3 entsprechend anzuwenden,c. 1des Veräußerungspreises oder des gemeinen Wertes im Sinne des § 17 Abs. 2. 2Satz 1 ist in den Fällen des § 17 Abs. 4 entsprechend anzuwenden,d. der Bezüge im Sinne des § 20 Abs. 1 Nr. 1 und der Einnahmen im Sinne des § 20 Abs. 1 Nr. 9,e. der Bezüge im Sinne des § 20 Abs. 1 Nr. 2,f. der besonderen Entgelte oder Vorteile im Sinne des § 20 Abs. 2 Satz 1 Nr. 1, die neben den in § 20 Abs. 1 Nr. 1 und Abs. 2 Satz 1 Nr. 2 Buchstabe a bezeichneten Einnahmen oder an deren Stelle gewährt werden,g. der Einnahmen aus der Veräußerung von Dividendenscheinen und sonstigen Ansprüchen im Sinne des § 20 Abs. 2 Satz 1 Nr. 2 Buchstabe a,h. der Einnahmen aus der Abtretung von Dividendenansprüchen oder sonstigen Ansprüchen im Sinne des § 20 Abs. 2 Satz 2,i. der Bezüge im Sinne des § 22 Nr. 1 Satz 2, soweit diese von einer nicht von der Körperschaftsteuer befreiten Körperschaft, Personenvereinigung oder Vermögensmasse stammen,j. des Veräußerungspreises im Sinne des § 23 Abs. 3 bei der Veräußerung von Anteilen an Körperschaften, Personenvereinigungen oder Vermögensmassen, deren Leistungen beim Empfänger zu Einnahmen im Sinne des § 20 Abs. 1 Nr. 1 gehören.2Dies gilt für Satz 1 Buchstabe d bis h auch in Verbindung mit § 20 Abs. 3. 3Satz 1 Buchstabe a, b und d bis h ist nicht anzuwenden für Anteile, die bei Kreditinstituten und Finanzdienstleistungsinstituten nach § 1 Abs. 12 des Gesetzes über das Kreditwesen dem Handelsbuch zuzurechnen sind; Gleiches gilt für Anteile, die von Finanzunternehmen im Sinne des Gesetzes über das Kreditwesen mit dem Ziel der kurzfristigen Erzielung eines Eigenhandelserfolges erworben werden. 4Satz 3 zweiter Halbsatz gilt auch für Kreditinstitute, Finanzdienstleistungsinstitute und Finanzunternehmen mit Sitz in einem anderen Mitgliedstaat der Europäischen Gemeinschaft oder in einem anderen Vertragsstaat des EWR-Abkommens.
Translation - English Exemption from Taxation § 31The following are exempt from taxation40. Half of a.1Increases in business assets or receipts from the disposition or withdrawal of ownership interests in corporations, associations of individuals, or estates from which payments are treated as income, within the meaning of § 20 Para. 1 No. 1, in the hand of the recipient, or in a subordinate member of an affiliated tax group within the meaning of §§ 14, 17, or 18 Corporate Income Tax Act (“KStG”), or from the liquidation of such an entity or from a reduction in its registered capital or from the recognition of such an asset based on its value as determined under § 6 Para. 1 No. 2 3rd Sent., to the extent that they are classified as income from agriculture or forestry, from a business enterprise, or from self-employment. 2The foregoing does not apply to the extent that the use of the lower going concern value, to its full extent, led to a reduction in income and to the extent that such reduction in income has not been offset through the use of a value as determined under § 6 Para. 1 No. 2 3rd Sent. 3Sentence 1 furthermore does not apply to increases in business assets arising through the use of the value determined under § 6 Para. 1 No. 2 3rd Sent. to the extent that deductions under § 6b or similar deductions have been claimed for tax purposes,b.1The sales price within the meaning of § 16 Para. 2, to the extent that it is based on the sale of ownership interests in corporations, associations of individuals, or estates from which payments are treated as income, within the meaning of § 20 Para. 1 No. 1, in the hand of the recipient, or in a subordinate member of an affiliated tax group within the meaning of §§ 14, 17, or 18 KStG. 2Sentence 1 is to be applied analogously in cases described in § 16 Para. 3,c. 1The sales price or the market value within the meaning of § 17 Para. 2. 2Sentence 1 is to be applied analogously in cases described in § 17 Para. 4,d. 1Payments within the meaning of § 20 Para. 1 No. 1 and of receipts within the meaning of § 20 Para. 1 No. 9,e. Payments within the meaning of § 20 Para. 1 No. 2,f. Special payments or benefits within the meaning of § 20 Para. 2 No. 1st Sent. No. 1, which are granted in addition to or instead of receipts described in § 20 Para. 1 No. 1 and Para. 2, 1st Sent. No. 2 lit. a,g. Receipts from the disposition of dividend coupons and other claims within the meaning of § 20 Para. 2, 1st Sent. No. 2 lit. a,h. Receipts from the assignment/surrender of dividend claims and other claims within the meaning of § 20 Para. 2, 2nd Sent.,i. Payments within the meaning of § 22 No. 1, 2nd Sent., to the extent they originate from a corporation which is not exempt from corporate income tax, an association of individuals, or estate,j. The sales price, within the meaning of § 23 Para. 3, of dispositions of ownership interests in corporations, associations of individuals, or estates from which payments are treated as income, within the meaning of § 20 Para. 1 No. 1, in the hand of the recipient.2The foregoing also applies with respect to 1st Sent. lit. d to h in conjunction with § 20 Para. 3.31st Sent. lit. a, b, and d to h is not applicable with respect to shares which are attributable to the trading book of financial institutions and financial services institutions under § 1 Para. 12 Financial Institutions Act (Gesetz über das Kreditwesen); the same applies with respect to shares held by finance companies within the meaning of the Financial Institutions Act which were acquired for the purpose of realizing gain from short-term proprietary trading. 43rd Sent., second clause, also applies to financial institutions, financial services institutions, and finance companies domiciled in another Member State of the European Community or in a state which is a signatory to the European Economic Area Agreement.
