Retention of data is a complex issue that is acknowledged by all as important. Many parts of the European Commission and country legislatures have differing views on retaining data from telecoms, email and internet usage to facilitate anti terrorist activities. This paper highlights the technology impact behind such legislation and discusses areas for consideration by legislators and implementers. Increased costs based on increases in storage and management requirements are inevitable. Additionally, any increase in technology usage will increase the load on enterprise management particularly in the area of compliance and audit. This will be due to a requirement to ensure and prove that the additional data is secure and tamper free. CA feels that some organizations do not have sufficient control on their existing systems and assets and would need to improve that before they purchase new systems solely to be compliant with new legislation. CA also feels that the purchase of new technology should be planned as an extension, and within the current environment, rather than being seen as a standalone system. These implications should be considered by legislators and implementers in preparing a proportionate and harmonised approach. La conservazione dei dati costituisce una problematica complessa dall’importanza universalmente riconosciuta. Molti esponenti della Commissione Europea e delle legislature nazionali hanno opinioni divergenti circa la necessità di conservare i dati sul traffico dei servizi telefonici e telematici per finalità antiterrorismo. Il presente documento si prefigge di esplorare l’impatto tecnologico di tali disposizioni di legge proponendo alcuni spunti di discussione all’attenzione degli organi legislativi e delle autorità di contrasto. Si profila infatti inevitabile un aumento dei costi conseguenti all’inasprimento degli obblighi normativi che sanciscono la memorizzazione e il trattamento dei dati. Qualsiasi ricorso intensificato ai mezzi tecnologici causerà anche un appesantimento del carico di gestione aziendale, soprattutto in materia di conformità e controlli normativi, a seguito della necessità di tutelare la privacy e garantire l’integrità dei nuovi dati richiesti dal legislatore. CA ritiene che le organizzazioni sprovviste di un controllo sufficiente sui dati e sui sistemi in loro possesso dovrebbero impegnarsi in tal senso prima di acquistare nuovi sistemi al solo scopo di conformarsi alle nuove norme di legge. CA parte inoltre dal presupposto che sarebbe opportuno pianificare l’acquisto di nuove tecnologie in un’ottica di estensione dei sistemi già presenti in azienda anziché limitarsi a crearne di nuovi, disgiunti dall’infrastruttura esistente. Tutte queste implicazioni andrebbero prese in considerazione dai legislatori e dai responsabili dell’applicazione delle norme di legge in fase di elaborazione di un approccio proporzionato e armonizzato.
