Source text - German Vor vielen Jahren hat mich ein Manager einmal gefragt, was wir eigentlich wirtschaftlich davon hätten, dass wir uns ein Firmenarchiv leisten. Zum damaligen Zeitpunkt konnte ich zwar erklären, wie wichtig das Gedächtnis einer Firma sei, musste es aber in bezug auf den wirtschaftlichen Unternehmenserfolg mit Versprechungen für die Zukunft belassen. Mittlerweile haben sie sich erfüllen lassen, und die erfolgreiche Durchführung des Projektes „100 Jahre XXX: Dein wahres Stück Schweiz“ ist ein weiterer Beleg dafür. Welche Wege hierfür beschritten werden mussten, welche Hindernisse überwunden wurden und welche Erfolge man mit einem „History Marketing“ Projekt feiern kann, möchte ich in diesem Bericht kurz zusammenfassen. Am Anfang war eine Idee… wie so oft sitzt man am Schreibtisch und überlegt, wie können wir ein Marken- bzw. Firmenjubiläum für die interne und externe Kommunikation einsetzten. Welche Form der Präsentation passt am besten dazu und welche Abteilungen des Unternehmens sollten einbezogen werden. Für ein 100-jähriges Markenjubiläum ist die Beantwortung dieser Frage nicht allzu schwer. Marketing, die Produktionsstätte des Jubiläumsartikels und Corporate Affairs mussten zum Team gehören. Eine Herausforderung stellte im Fall XXX der Zeitplan dar. Im April 2007 fiel der Startschuss zum Projekt, und Anfang 2008 mussten alle Aktivitäten abgeschlossen und das fertige Konzept einsatzfähig sein. Nachdem die Fachbereiche Ende 2006 angesprochen wurden und im April 2007 die Budgetmittel zur Verfügung standen, konnte das nur zweiköpfige Archiv-Team mit der Planung beginnen. Der größte Teil des historischen Archivbestandes der Firma XX hatte bis Ende 2006 noch im Werk Bern geweilt und war bereits nach Bremen überstellt worden. Um mit diesen Archivalien arbeiten zu können, mussten sie zunächst in den Bestand des Company Archives integriert werden. Dabei handelte es sich um insgesamt fünf Paletten unsortierter und nicht erschlossener Dokumente und Artefakte. Innerhalb kürzester Zeit wurden zunächst das Schriftgut und die Werbematerialien gesichtet, verzeichnet und zum Teil konservatorischen Maßnahmen unterzogen. Erst als feststand, dass wir (fast) lückenlos die Geschichte der Marke XXX an Hand des Bestandes aufzeigen können, hatten wir uns entschlossen, das Jubiläums-Projekt intensiv voranzutreiben. Bereits zwei Jahre zuvor hat das Company Archive ein Buch über eine Marke aus der XXX Familie herausgegeben, mit dem Bestreben, damit den Grundstein für eine Fortsetzungsreihe zu legen. Deshalb war schnell klar, dass auch anlässlich des XXX Jubiläums ein Buch herausgeben werden sollte. In Anbetracht der kurzen Zeitschiene konnten wir allerdings nicht, wie im Buch „100 Jahre XXX: die Geschichte einer Marke“ mit jungen Autoren zusammenarbeiten, die zu diesem Thema noch nie publiziert hatten. Es mussten kurzfristig Insider gefunden werden, die bereits über Kenntnisse zum Thema verfügten. So war es nach aufwendiger und intensiver Suche schließlich ein Glücksfall, dass wir mit XX und XX (Enkel des Firmengründers) zwei Autoren gewinnen konnten, die bereits zehn Jahre zuvor zum Thema „XXX“ wissenschaftlich gearbeitet und publiziert hatten. Zusammen mit einem Kenner des historischen Marketings der Schweizer Schokoladenhersteller, XX ider, bildeten sie ein Autorenteam und arbeiteten fortan sehr eng gemeinsam mit uns an der inhaltlichen Gestaltung des Buches. At the time, I was able to explain the importance of a company history but had to relate this to the financial success of the company through promises for the future. These promises have now been fulfilled, and the successful completion of the ‘100 years of XXX: your true piece of Switzerland’ project is further proof of this. In this report, I intend to summarise the steps we had to take to reach this stage, the obstacles we had to overcome and the successes that can be achieved through a history marketing project. It all started with an idea… As so many times before, we sat at our desks and wondered how to include our brand and company anniversary in internal and external communications. What was the best way to present the anniversary and which of the company’s departments should be involved? For the brand’s 100th anniversary, these questions were not difficult to answer. The team had to be made up of Marketing, the centenary article’s production facilities and Corporate Affairs. For XXX, a major challenge was the schedule; the project started in April 2007 and all the activities had to be completed and the finished strategy ready for use by the start of 2008. Once the specialist departments had been addressed at the end of 2006 and the budget resources were made available in April 2007, the small archive team of just two people was able to start planning. Most of XXX's historical archive stock was stored in the Bern factory until the end of 2006 when it had already been transferred to Bremen. To work with these archives, however, they first had to be integrated into the company archive stock. There were five pallets of unsorted and non-indexed documents and artefacts. Within the shortest period, the written and advertising materials were sorted, recorded and partially subjected to conservation measures. Only when we realised that the archive stock provided us with evidence of (almost) the entire history of the XXX brand did we decide to truly press ahead with the centenary project. Two years previously, the Company Archive department had published a book about a XXX brand, hoping to lay the foundation stone for a series. It therefore quickly became clear that a book should be published to mark XXX’s anniversary. In view of time restraints, however, we were unable to follow in the footsteps of the book ‘100 years of XXX: the history of a brand’ and work with young authors who had not yet published material on this topic. We instead had to quickly find insiders with existing knowledge of the area. Following a laborious and extensive search, we had a stroke of luck and found our two authors, XX and XX(grandson of the company’s founder), who had already conducted research and published literature on the topic of ‘XXX' ten years ago. Together with XX, an expert on the historical marketing of the Swiss chocolate manufacturer, they formed a team of authors and immediately began to work closely with us on the contents of the book. Without this smoothly functioning working relationship it would have been impossible to complete our ambitious plan of having the finished book in our hands by the start of 2008.

Source text - German Sehr geehrter Herr Dr. XXX, danke für die Übermittlung des Auskunftsersuchens der Europäischen Kommission aufgrund einer Beschwerde wegen angeblicher Beihilfen der österreichischen Wirtschaftskammern. Die XXX nimmt zu den Fragen der Kommission wie folgt Stellung: Vorweg ist darauf hinzuweisen, dass die Beschwerde ganz offenkundig keinem Rechtsschutzbedürfnis entspringt, sondern einer rein politischen Zwecksetzung dient. Sie instrumentalisiert das Beihilfenrecht, um unter Berufung auf dieses die Beseitigung des Systems gesetzlicher beruflicher Vertretungen in Österreich und damit letztlich auch in den anderen Mitgliedstaaten zu erreichen. Dieses politische Motiv wird auf der Homepage der beschwerdeführenden Gesellschaft, der XXX, – auffindbar unter der Url XXXXX bei Eingabe des Suchbegriffes „Pflichtmitgliedschaft“ – offen zum Ausdruck gebracht. Nicht zu übersehen ist auch der zeitliche Zusammenhang zwischen der Anfang September 2008 erfolgten Einbringung der Beschwerde und den österreichischen Nationalratswahlen am 28. September 2008. Bei diesen nämlich ist die vom Vorstandsvorsitzenden der beschwerdeführenden XXX unterstützte Partei „Liberales Forum“ wieder angetreten, die schon in der Vergangenheit wiederholt Kampagnen gegen die Pflichtmitgliedschaft in Kammern organisiert hat und diese im letzten Wahlkampf auch erneut zum Thema gemacht hat. Schließlich wird der politische Charakter der Beschwerde auch daran deutlich, dass in ihr durchwegs mit unbelegten Behauptungen gearbeitet wird, die einer Entsprechung im Tatsächlichen entbehren. I. Fragenbeantwortung 1. Bitte erläutern Sie, ob die Pflichtbeiträge (Kammerumlagen) als staatliche Mittel anzusehen sind. Bitte geben Sie an, ob die Pflichtbeiträge dazu verwendet werden, beide Wirkungsbereiche der Kammern zu finanzieren (eigener und übertragener Wirkungsbereich laut Definition gemäß Artikel 120b(1) und (2) des Bundes- Verfassungsgesetzes (siehe S. 7 der Beschwerdeschrift)). 1.1. Umlagearten und Zurechnungsgrundsätze Die Wirtschaftskammern, d.h. die Bundeskammer (= Wirtschaftskammer Österreich – WKÖ) und die neun Landeskammern finanzieren sich gemäß § 122 Wirtschaftskammergesetz 1998 – WKG, BGBl I 1998/103 idF BGBl I 2006/78, über zwei Kammerumlagen: die Kammerumlage 1 (KU1) und die Kammerumlage 2 (KU2). Die KU 1 bemisst sich in einem Tausendsatz der Vorsteuerschuld, der Einfuhrumsatzsteuer und der Erwerbsteuer, die KU 2 in einem Hundertsatz der in einem Unternehmen anfallenden Arbeitslöhne. Die Höhe der anzuwendenden Tausendund Hundertsätze ist von den Kammern innerhalb des gesetzlich vorgegebenen Rahmens autonom festzulegen (§ 122 Abs 1, letzter und vorletzter Satz, Abs 7 und 8 WKG). KU 1 und KU 2 sind Selbstbemessungsabgaben, d.h. sie sind von den Umlagenpflichtigen selbst zu berechnen und zusammen mit den anderen Abgaben abzuführen. Sie werden zwar – aus rein verwaltungsökonomischen Gründen – von den Abgabenbehörden des Bundes (§ 122 Abs 6 WKG) eingehoben, die sie an die Bundeskammer zur Weiterverteilung an die Landeskammern zu überweisen haben, doch wirken die Behörden dabei als reine Dienstleister, denen keine inhaltliche Einflussnahme auf die Höhe der Umlagen zukommt. Das macht auch § 126 Abs 1 zweiter Satz WKG deutlich, demzufolge zwischen dem Bundesministerium für Finanzen und der Bundeskammer eine Einhebungsvergütung zu vereinbaren ist. Nach der Rechtsprechung gelten für die Zurechnung dieser Umlagen zur öffentlichen Hand ähnliche Grundsätze, wie für die Zurechnung der Willensbildung (s. dazu unten zu Frage 3). Kernelement dieser Zurechnung ist die Frage, ob die öffentliche Hand zu irgendeinem Zeitpunkt in der Kette von der Erhebung zur Verwendung Kontrolle über das Abgabenaufkommen hatte, die ihr eine Umlenkung der Mittel in das allgemeine Budget bzw auf andere Verwendungszwecke ermöglicht hätte (vgl zB Rs C-83/98 P, Ladbroke; Rs C-379/98, PreussenElektra). Die Höhe des an die Wirtschaftskammer Österreich zu überweisenden Betrags wird von den Umlagenpflichtigen (es handelt sich um Selbstbemessungsabgaben!) anhand objektiver Kriterien auf der Grundlage von Sätzen errechnet, die seitens der Bundeskammer bekanntgegeben werden, und steht daher ex ante fest, ohne dass die Abgabenbehörden über das Ausmaß der von ihnen an die Kammern weiterzuleitenden Beträge oder etwa über die Zueignung oder Umlenkung eines Teils des Aufkommens zur öffentlichen Hand entscheiden könnten. Die – gesetzlich vorgesehene und bundesverfassungsgesetzlich abgesicherte – autonome und eigenverantwortliche Festlegung der Umlagenhöhe ist Ausfluss der den Kammern gegenüber dem Staat zukommenden Freiheit: Gerade weil es ihre zentrale Aufgabe ist, die Interessen ihrer Mitglieder gegenüber dem Staat zu vertreten (siehe unten 2.1.3), müssen sie über die notwendige Freiheit verfügen, eigenständig und selbstbestimmt nicht nur die Art und Weise ihrer Aufgabenerfüllung, sondern auch die notwendigen Voraussetzungen dafür festzulegen. 1.2. Verwendung der Umlagen Die Bestimmungen über die Finanzierung der Wirtschaftskammerorganisation unterscheiden grundsätzlich nicht zwischen der Finanzierung des eigenen bzw. des übertragenen Wirkungsbereiches. Somit stehen zunächst beiden Wirkungsbereichen sämtliche gesetzlich zulässigen Finanzierungsmöglichkeiten – nämlich durch Umlagen, Leistungsentgelte und sonstige Erträge im Sinne des § 121 WKG – offen. In der Praxis werden die einzelnen Leistungen der Kammern unterschiedlich finanziert: so werden Leistungen des übertragenen Wirkungsbereiches – etwa die Ausstellung von Ursprungszeugnissen - durch mit der konkreten Leistung verknüpfte Entgelte (Gebühren für Sonderleistungen gemäß § 125 WKG) finanziert (siehe unten Frage 2.2). Leistungen des eigenen Wirkungsbereiches, die ohne Zuordnung zu konkreten Kammermitgliedern erbracht werden, werden überwiegend im Wege der Umlagen finanziert. Dies betrifft insbesondere die wirtschaftliche wie rechtliche Interessenvertretung sowie den Bereich der allgemeinen oder branchenspezifischen Information. Die Pflichtbeiträge werden – entsprechend dem Aufgabenportfolio der Kammern (siehe dazu unten zu Frage 2.1.3) – ganz überwiegend zur Finanzierung der Aufgaben und Aktivitäten im eigenen Wirkungsbereich verwendet. Zu einem letztlich geringen Teil werden sie allerdings auch zur Bestreitung der Kosten der Aufgabenbesorgung im übertragenen Wirkungsbereich herangezogen (siehe unten 2.2 und 3.1). Soweit die Umlagen der Finanzierung der Aktivitäten im eigenen Wirkungsbereich dienen, ist die Staatlichkeit dieser Mittel auf dem Boden der Entscheidung des EuGH in der Rs C-379/98, PreussenElektra, umfassend zu verneinen. Einerseits fließen diese, von Privaten aufgebrachten Mittel den Kammern ohne staatliche Zugriffsmöglichkeit zu. Andererseits verfolgen die Kammern in ihrem eigenen Wirkungsbereich – dies natürlich innerhalb der gesetzlichen Rahmenbedingungen, aber das gilt in gleicher Weise für Wirtschaftstreibende – autonom festgelegte, selbstgesetzte Ziele. Dem Staat kommt keine Möglichkeit zu, diese Ziele und damit die Mittelverwendung inhaltlich zu bestimmen (siehe ausführlich unten zu Frage 3). Die Kammern unterscheiden sich bei ihrem Agieren im eigenen Wirkungsbereich von Wirtschaftstreibenden nur durch den Umstand der Bündelung verschiedener Einzelinteressen der Mitglieder, aber nicht durch die Art der vertretenen und verfolgten Interessen. Es bleibt daher hinsichtlich der für die Erfüllung der Aufgaben des eigenen Wirkungsbereiches verwendeten Mittel bei dem Befund, dass diese iSd Urteils PreussenElektra einem Privaten (den Kammern) von anderen Privaten (den Mitgliedern) aufgrund gesetzlicher Anordnung überlassen werden und insoweit nicht dem staatlichen Budget zuzurechnen sind. XXX has the following response to the Commission’s questions: It is first necessary to note that the complaint is clearly made for purely political purposes rather than out of a need for legal protection. It uses the State aid law as a remedy for abolishing the system of compulsory membership of enterprises in Austria and thus also in the other Member States. This political motive is clearly evident when entering the search term ‘Pflichtmitgliedschaft’ (‘Compulsory membership’) in the website of XXX, the company filing the complaint, found under XXX. The temporal relation between the complaint being filed at the start of September 2008 and the Austrian National Council elections on 28 September 2008 is clear to see. The Liberal Forum, the party supported by XXXs CEO, was once again represented at these elections. This party has previously organised campaigns against compulsory membership in economic chambers and revisited this issue in the recent election. The political agenda behind the complaint is also evident from its being full of unfounded statements with no bearing on reality. I. Response to questions 1. Please explain whether the compulsory contributions can be regarded as State funds. Please advise whether they are used to finance both spheres of action of the chambers (own sphere of action and delegated matters of federal administration, as defined in Article 120b(1) and (2) of the Federal Constitutional Law (see page 7 of the complaint). 1.1 Types of apportionment and imputability principles The economic chambers, meaning the federal chamber (Austrian Federal Economic Chamber) and the nine regional chambers, are financed in accordance with Section 122 of the 1998 Economic Chamber Act [Wirtschaftskammergesetz – WKG], Federal Law Gazette I (Bundesgesetzblatt I, BGBl. I) No 1998/103), as amended by Federal Law Gazette I No 2006/78, by means of two chamber apportionments: chamber apportionment 1 [Kammerumlage 1 – KU 1] and chamber apportionment 2 [Kammerumlage 2 – KU 2]. The KU 1 is calculated as a mill rate of the tax liability, the value-added tax on imports and the acquisition tax; the KU 2 is calculated as a percentage of the salaries paid by the company. The mill rate and percentage used are independently determined by the chambers within the legally applicable scope (Section 122(1), final two sentences, and Section 122(7) and (8) of the Economic Chamber Act). Chamber apportionments 1 and 2 are self-calculated contributions, meaning that those subject to apportionments must calculate the amounts due themselves and pay them together with the other contributions. For purely administrative reasons, they are levied by the State tax authorities (Section 122(6) of the Economic Chamber Act), who must forward them to the federal chamber for subsequent transfer to the regional chambers. However, the authorities are acting as a simple service provider and have no influence on the amount of the contributions. This is made clear by the second sentence of Section 126(1) of the Economic Chamber Act, according to which a levy fee is to be agreed between the Federal Ministry of Finance and the federal chamber. According to case law, similar principles apply to the imputation of these apportionments to the public authorities as to the imputation of decision making processes (see question 3 below). The key aspect when reviewing this imputation is the question of whether the public authorities had control over the revenue from the contributions at any time between their levy and their use, enabling them to redirect said revenue into the general budget or use it for other purposes (see for example Case C-83/98 P, Ladbroke and Case C-379/98, PreussenElektra). The amount to be paid to the Austrian Federal Economic Chamber is calculated by those subject to apportionments (as self calculated contributions) using objective criteria on the basis of the percentages specified by the federal chamber, and is therefore determined ex ante, without the tax authorities being able to decide upon the amounts to be transferred to the chambers or on the suitability or redirection of any part of the revenue for/to the public authorities. The autonomous and independent determination of the apportionment amounts (which is both legally required and safeguarded by the Federal Constitutional Law) is a product of the freedom granted to the chambers by the State. As the chambers’ central role is to protect the interests of their members in relation to the State (see 2.1.3 below), they must have the necessary freedom to determine not only the manner in which they fulfil their duty but also the necessary requirements for this purpose. 1.2 Use of apportionments The provisions on financing the economic chamber organisation do not differentiate between financing their ‘own sphere of action’ and ‘delegated matters of federal administration’. This means that both spheres have access to the legally permitted financing options (namely, apportionments, service fees and other income as defined by Section 121 of the Economic Chamber Act). In practice, the individual services offered by the chambers are financed in different ways. Services within the purview of delegated matters of federal administration (such as the issuance of certificates of origin) are financed by fees that are directly linked to the specific services (charges for special services as per Section 125 of the Economic Chamber Act) (see question 2.2 below). Services provided in the chambers’ own sphere of action and not intended for specific chamber members are predominantly financed by apportionments. This particularly applies to the representation of economic and legal interests and the provision of general or sector specific information. In line with the chambers’ range of services (see question 2.1.3 below), the compulsory contributions are predominantly used to finance the tasks and activities carried out in the chambers’ own sphere of action. To a somewhat lesser extent, however, they are also used to cover the costs of the services provided as delegated matters of federal administration (see 2.2 and 3.1 below). In so far as the apportionments are used to finance activities carried out in the chambers’ own sphere of action, on the basis of the ECJ ruling in Case C-379/98, PreussenElektra, these resources can in no way be deemed State resources. Firstly, these resources are paid to the chambers by private individuals without any possible State intervention. Secondly, the chambers pursue, in their own sphere of action (within the legal framework conditions, which also apply to businesses) independently determined, self-imposed targets. The State is not given any opportunity to determine the details of these targets or, therefore, the use of the resources (see question 3 for full information). The chambers are only differentiated from businesses when carrying out activities in their own sphere of action by the fact that they combine several different member interests; there is no differentiation on the basis of the type of interests represented and pursued. With regard to the resources used to carry out the activities in their own sphere of action, it is therefore found, as in the ruling on PreussenElektra, that they are paid to one private individual (the chambers) by another private individual (the members) on the basis of a legal requirement, and that they are therefore not imputable to the State budget.

La sensación de inseguridad es alta entre las personas mayores de 50 años (83,5%) mientras que los jóvenes (menores de 30 años) se sienten en general seguros. Para más de la mitad de los ciudadanos las calles céntricas de la ciudad son los lugares más peligrosos. Frente a esta situación, el 79 % opina que la instalación de cámaras de seguridad podría prevenir de alguna forma la criminalidad. Estos son los datos que se desprenden del primer Pulsómetro XXX de Seguridad en Alicante, encargado por la compañía XXX, proveedor europeo líder en soluciones de seguridad. La encuesta pretende conocer la percepción que los ciudadanos tienen sobre la seguridad en Alicante y cómo esta evoluciona en el tiempo. "Entender la forma en que las personas perciben la seguridad ayuda a desarrollar estrategias eficaces. Aun así hay que tener claro que se trata de una encuesta de percepción, por lo que habría que determinar en que medida estas sensaciones son un reflejo de un problema real y/o creciente", comenta XXX, Director de Marketing de XX. AI preguntar a los alicantinos sobre la sensación de seguridad en diferentes lugares, el 54% de los encuestados respondieron que las calles céntricas de la capital son las zonas mas inseguras. En estos lugares entre el 88 y 95% de los encuestados afirmas sentirse seguros o muy seguro. El 79 % de los alicantinos opina que la instalación de cámaras de seguridad en las calles aumentaría la sensación de seguridad. La percepción de que la videovigilancia podría violar la privacidad de las personas se sitúa entorno al 15%, frente al 40% que cree que merece la pena su instalación porque la seguridad es prioritaria. Resulta significativa la indiferencia general de las personas menores de 30, ya que el 53% afirmó que les daba igual que se les este viendo a través de cámaras de videovigilancia. Translation - English Alicante, xx February 2006. Six out of ten citizens responded “not very” or “not at all” when asked how safe they felt in the city of Alicante. People aged over 50 (83.5%) often feel unsafe while young people (aged under 30) generally feel safe. More than half of the citizens think that the city centre streets are the most dangerous place in the city. In view of this situation, 79% of people think that installing security cameras could help prevent crime. These are the results of the first XXX Security Pulsometer in Alicante, commissioned by XXX, Europe's leading provider of security services. The aim of the survey is to discover how the people of Alicante perceive the levels of safety in their city and monitor how these perceptions change over time. XXX, XXX Marketing Director commented, “Understanding how people perceive safety levels helps us develop effective strategies. Even so, it is important to realise that this is a perception-based survey and that it is therefore necessary to determine the extent to which people's feelings reflect a real and/or growing problem.” When the people of Alicante were asked how safe they felt in different areas, 54% of those questioned replied that the city centre streets were the most dangerous places. The figures are particularly notable among citizens aged over 50, as only 14% of them feel safe walking the streets of Alicante; in contrast, over 50% of people ages between 18 and 40 feel safe. This perception varies substantially with regard to closed spaces such as shopping and leisure centres or public and corporate buildings, where between 88% and 95% of those questioned stated that they felt safe or very safe. 79% of the people of Alicante think that installing security cameras in the streets would make them feel safer. Approximately 15% of people think that video-surveillance could invade personal privacy, while 40% believe that its installation would be beneficial because safety and security should be the top priority. The general indifference of people aged under 30 is significant, with 53% of them stating that they were unconcerned about whether or not they were monitored by video-surveillance cameras. XXX of XXX stated, “It is natural for people to feel safer in places with security systems, such as shopping centres and public and private buildings. Electronic security solutions such as video-surveillance play an important role but broader strategies are required if people are to feel safer in an ever-more complex society and world.
