Industry, Organizations Raise Stakes In Global Anti-Piracy Campaign
Multinational companies are looking for new ways to stop counterfeit and pirated versions of their products from undermining their profits and reputations, and at a recent high-level meeting with leading intergovernmental bodies, they took the anti-piracy and counterfeiting campaign in new directions.
Industry groups and the organisations have seized upon ties to organised crime and the health and safety risks to individuals of counterfeit and pirated products as a focal point as they put greater resources, pressure and effort into changing laws and public perception to be more supportive of their concerns. But the top-level business executives, government and intergovernmental officials were not joined on the panels by representatives of consumers, and may have been speaking largely to a room of likeminded people.
The third Global Congress on Combating Counterfeiting and Piracy, being held this year in Geneva on 30-31 January, is co-organised by the World Intellectual Property Organization (WIPO), World Customs Union and Interpol.

Las empresas multinacionales buscan nuevas maneras de impedir que las versiones falsificadas y pirateadas de sus productos menoscaben sus ganancias y su reputación. En una reciente reunión de alto nivel con organismos intergubernamentales líderes, las empresas dieron a la campaña contra la piratería y la falsificación en una nueva dirección.
Los grupos industriales y las organizaciones han aprovechado la vinculación con el crimen organizado y los riesgos que implican los productos falsificados y pirateados para la salud y la seguridad de las personas como punto central, al tiempo que destinan mayores recursos, ejercen mayor presión y hacen más esfuerzos a fin de cambiar las leyes y la percepción pública de forma que sus preocupaciones reciban más atención. Sin embargo, los representantes de los consumidores no se unieron a los paneles de dirigentes empresariales, funcionarios de gobierno y de instituciones intergubernamentales, quienes pueden haberse dirigido a una audiencia principalmente con ideas afines.
El tercer Congreso mundial sobre la lucha contra la falsificación y la piratería, celebrado este año en Ginebra del 30 al 31 de enero, fue organizado conjuntamente por la Organización Mundial de Propiedad Intelectual (OMPI), la Organización Mundial de Aduanas (OMA) y la Organización Internacional de Policía Criminal (Interpol).

IMPLEMENTATION OF TRIPS FLEXIBILITIES FOR PUBLIC HEALTH PURPOSES IN DEVELOPING COUNTRIES
The objectives of this part are two-fold. The first is to analyze the extent to which developing countries have implemented the so-called TRIPS flexibilities within their national legislation. The second is to review the actual use of these flexibilities for public health purposes. In this regard, two key questions are asked:
• What national legislation is in place in developing countries?
• What needs to be put in place to enable countries to use TRIPS-compliant flexibilities to facilitate access to medicines?
The main focus is on the implementation of the provisions of the TRIPS Agreement as they relate to patent protection, set out in Section 5 of the Agreement. An overview of the key public health-related TRIPS flexi-bilities that could be incorporated into domestic patent laws is first pro-vided. The prevailing laws in developing countries are then assessed against this range of public health-related flexibilities to determine the extent to which they have incorporated such flexibilities. APLICACIÓN DE LAS FLEXIBILIDADES PREVISTAS EN EL ACUERDO SOBRE LOS ADPIC CON FINES DE SALUD PÚBLICA EN LOS PAÍSES EN DESARROLLO
Esta sección tiene dos objetivos. El primero es analizar en qué medida los países en desarrollo incorporan las llamadas flexibilidades previstas en el Acuerdo sobre los ADPIC en el ámbito de sus legislaciones nacionales. El segundo es analizar la utilización real de dichas flexibilidades con fines de salud pública. En este sentido, se plantean dos preguntas clave:
• ¿Qué leyes nacionales están en vigor en los países en desarrollo?
• ¿Qué es necesario implementar para que los países puedan hacer uso de las flexibilidades previstas en el Acuerdo sobre los ADPIC a fin de facilitar el acceso a los medicamentos?
El enfoque principal se centra en la aplicación de las disposiciones del Acuerdo sobre los ADPIC en cuanto a la protección por patente, según se establece en la Sección 5 del Acuerdo. En primer lugar, se proporciona una descripción general de las flexibilidades clave previstas en el Acuerdo sobre los ADPIC relacionadas con la salud pública, que podrían incorporarse en las leyes nacionales sobre patentes. Luego, se evalúan las leyes vigentes en los países en desarrollo en relación con este abanico de flexibilidades concernientes a la salud pública con el fin de determinar la medida en que se incorporan dichas flexibilidades.
