The court determines that at this stage, Caspi is, practically speaking, not a buyer but a creditor who received collateral – and if he did not register the pawn in his own name, he is not an insured creditor. This accords with Section 2(b) of the Law of Collateral. The court saw the letter of agreement and the loan agreement as a single agreement which is a collateral agreement (as indicated by circumstances). Although the parties did not call it by its correct name, the court is empowered by Section 2(b) to relate to the contract in accordance with its true meaning – as hidden collateral. |
