7.6 V prípade ak sa spoločník nezúčastní na valnom zhromaždení osobne a ani prostredníctvom splnomocnenca a svoju neúčasť z vážnych dôvodov bezodkladne neospravedlní, uskutoční sa v lehote do 30 dní valné zhromaždenie s tým istým programom valného zhromaždenia. Ak sa ten istý spoločník nezúčastní ani na tomto „náhradnom valnom zhromaždení“, sú spoločníci oprávnení prijímať rozhodnutia podľa bodu 7.2 jednoduchou väčšinou hlasov prítomných spoločníkov.
7.7 Rozhodnutia prijaté valným zhromaždením, ktoré sa konalo v súlade s právnym poriadkom a touto spoločenskou zmluvou sú záväzné pre všetkých spoločníkov aj v prípade, keď neboli prítomní na zasadnutí alebo keď s týmto rozhodnutím nesúhlasili.
7.8 Valné zhromaždenie spoločnosti je uznášaniaschopné, ak boli spoločníci riadne pozvaní a je prítomných alebo zastúpených najmenej 50 % hlasov.
7.9 Valné zhromaždenie rozhoduje jednoduchou väčšinou prítomných alebo zastúpených hlasov, pokiaľ zákon alebo táto spoločenská zmluva nepredpisujú niečo iné. Spoločníci majú pri hlasovaní nasledovný počet hlasov:

Edward McMillan-Scott (PPE-DE). – Mr President, I rise simply to report to the House the good news that last night the President of Pakistan, who was our guest a few weeks ago, has commuted the death sentence on my constituent Mirza-Tahir Hussain, who had been on death row for 18 years but is widely regarded to be innocent of the charges against him. A number of Members of the European Parliament, led by Mr Karim, were going to Pakistan next month to make a final plea. Now, of course, we shall turn our efforts towards ensuring Mr Hussain can return to Leeds by Christmas.
I am delighted at this news and hope that the President of Parliament will make a statement later today. I know he has worked very hard on this case, as have other Members of Parliament.

President. The next item is the report by Andreas Schwab, on behalf of the Committee on Petitions, on the annual report on the European Ombudsman’s activities in 2005 (2006/2117(INI)) (A6-0309/2006).

Nikiforos Diamandouros, ombudsman. PPresident, I wish to thank you for this opportunity to address Parliament and to present the annual report for 2005, a year in which the Office of the European Ombudsman celebrated an important milestone: its tenth year of operation.
The changes I propose are therefore limited both in number and scope. My principal objective is to ensure that citizens can have full confidence in the Ombudsman’s power to find the truth when hearing witnesses or inspecting documents.
I intend to make the most of that partnership in seeking to contribute to the deepening of a service culture to the benefit of EU citizens. Thank you for your attention.

Edward McMillan-Scott (PPE-DE). – Pán predseda, vystupujem jednoducho iba preto, aby som oznámil členom Parlamentu dobrú správu, že president Pákistánu, ktorý bol pred niekoľkými týždňami naším hosťom, včera večer zmiernil trest smrti vynesený nad mojím voličom Mirzom-Tahirom Hussainom, ktorý strávil v bloku ciel smrti 18 rokov, ale je všeobecne považovaný za nevinného, pokiaľ ide o činy z ktorých bol obvinený. Niekoľko členov Európskeho parlamentu pod vedením pána Karima malo budúci mesiac ísť do Pákistánu a predniesť tam záverečnú reč. Teraz samozrejme chceme zamerať naše snahy na to, aby sa pán Hussain mohol do Vianoc vrátiť do Leedsu.
Táto novinka ma potešila a dúfam, že predseda Parlamentu k nej prednesie neskôr behom dnešného dňa prehlásenie. Viem že na tomto prípade veľmi intenzívne pracoval, rovnako ako aj ďalší členovia parlamentu.

Predseda. Ďalším bodom je správa Andreasa Schwaba, v zastúpení Výboru pre petície, k výročnej správe o aktivitách Európskeho ombudsmana v roku 2005 (2006/2117(INI)) (A6-0309/2006).

Nikiforos Diamandouros, ombudsman. Pán predseda, chcel by som Vám poďakovať za túto možnosť, vystúpiť pred Parlamentom a predniesť výročnú správu za rok 2005, rok, v ktorom úrad Európskeho ombudsmana oslávil významné výročie: desiaty rok jeho činnosti.
Zmeny ktoré navrhujem sú preto obmedzené, pokiaľ ide o ich počet a aj ich rozsah. Mojím prvoradým cieľom je zabezpečiť, aby občania mali plnú dôveru v ombudsmanovu moc, nájsť pravdu pri vypočúvaní svedkov alebo skúmaní dokumentov.
Mám v úmysle čo najviac zlepšiť toto partnerstvo v snahe prispieť k prehĺbeniu kultúry služieb v prospech občanov EU. Ďakujem vám za pozornosť.
