This License agreement is effective from the date it is executed by each party until it is terminated. Licensee may terminate this License agreement
at any time by destroying or returning to XXX all copies of the Software and documentation in his possession or under his control. XXX may terminate this License agreement on notice to Licensee if XXX finds that Licensee has violated any of the terms of this License agreement. Such termination by XXX shall be in addition to and without prejudice to such rights and remedies as may be available to XXX including injunction and other equitable remedies. Upon notification of termination, Licensee agrees to cease using the Software, destroy or return to XXX all copies of the Software and documentation and to certify in writing within ten (10) days thereafter, that Licensee has
complied with the foregoing and that all known copies, including backup copies, have been destroyed or returned. All provisions relating to
confidentiality, proprietary rights, and on-disclosure shall survive the termination of this Software License agreement.

Dieser Lizenzvertrag gilt ab dem Datum seiner Ausführung durch jede der Parteien bis zur seiner Beendigung. Der Lizenznehmer kann diesen Lizenzvertrag jederzeit durch Vernichtung oder Rückgabe aller Software- und Dokumentationskopien, die sich in seinem Besitz oder unter seiner Kontrolle befinden, an XXX, beenden. XXX kann diesen Lizenzvertrag mit Benachrichtigung an den Lizenznehmer kündigen, wenn XXX feststellt, dass der Lizenznehmer jegliche der Bedingungen dieses Lizenzvertrags verletzt hat. Die Möglichkeit einer solchen Beendigung durch XXX dient als Zusatz zu den Rechten und Rechtsbehelfen von XXX und beeinträchtigt nicht dessen vorhandene Rechte und Rechtsbehelfe, einschließlich gerichtlicher Verfügungen und anderer, gleichberechtigter Rechtsbehelfe. Nach der Benachrichtigung über die Beendigung stimmt der Lizenznehmer zu, die Nutzung der Software einzustellen und alle Kopien der Software und der Dokumentationen zu vernichten oder an XXX zurückzugeben. Zudem hat der Lizenznehmer innerhalb von zehn (10) Tagen hiernach schriftlich zu bescheinigen, dass er Voranstehendem entsprochen hat und dass somit alle bekannten Kopien, einschließlich Sicherungskopien, vernichtet oder zurückgegeben wurden. Alle Bestimmungen bezüglich Vertraulichkeit, Eigentumsrechten und Geheimhaltung bestehen nach Beendigung dieses Softwarelizenzvertrags weiter. |
