SOFTWARE LICENSE AGREEMENT
PLEASE READ THE TERMS AND CONDITIONS OF THIS SOFTWARE LICENSE AGREEMENT (THE "AGREEMENT") CAREFULLY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS, SELECT THE "DECLINE" BUTTON AT THE END OF THIS AGREEMENT. This Agreement is made by and between Sun Microsystems, Inc. ("Sun") and the individual or entity accepting the terms and conditions as of the Effective Date. This Agreement pertains to Software and Information (as defined below) made available by Sun via any website, tool, technology or other mechanism for the purposes described herein (collectively, the “Access Tools”).
1. For all Software and/or other Information which is made available to you by Sun through the Access Tools and which is covered by a separate agreement between you and Sun (a "Separate Agreement"), the terms and conditions of that Separate Agreement shall govern your rights and obligations as to such Software and/or Information.
2. For all other Software and Information made available through the Access Tools, the following terms and conditions shall govern your rights and obligations as to such Software and/or Information:
A. LICENSE TO USE. Subject to and conditioned upon your compliance with the restrictions and obligations of this Agreement, including but not limited to Section 2.B:
a. Sun grants you a non-exclusive and nontransferable license to the software made available via the Access Tools and related documentation made available by Sun, including without limitation patches and updates (collectively, "Software") for your own internal use only; and
b. Sun grants you a non-exclusive and nontransferable license to information other than Software provided or made available by Sun via the Access Tools, including without limitation release notes, read-me files, and patch number designations (collectively, “Information”) for your own internal use only.
B. RESTRICTIONS. (a) The Software and Information made available under this Agreement are licensed, not sold, to you by Sun. Sun reserves all rights not expressly granted hereunder. (b) You may make a single archival copy of Software and Information to the extent permitted by law. You may not otherwise copy the Software or Information, or modify or distribute all or any portion of the Software or Information. However, if the Sun documentation accompanying Software lists specific portions of Software, such as header files, class libraries, reference source code, and/or redistributable files, that may be handled differently, you may use such specific portions of the Software only as provided in the applicable Sun documentation. (c) You may not rent, lease, lend or encumber Software or Information, or use the Software or Information in any manner to provide time-share or service bureau services. (d) The scope of your license does not include any right, express or implied, (i) to access, copy, distribute, display or use the Software or Information to provide diagnostic, maintenance, repair or technical support services on behalf of any third party, without Sun's prior written authorization, or (ii) for any third party to access, copy, distribute, display or use the Software or Information to provide diagnostic, maintenance, repair or technical support services on your behalf, without Sun's prior written authorization. (e) You may not decompile, disassemble, or reverse-engineer Software except to the extent otherwise permitted by law. (f) You may not publish or provide the results of any benchmark or comparison tests run on Software to any third party without the prior written consent of Sun. (g) Software and Information are the confidential information of Sun. The scope of your license does not include any right, express or implied, to do any of the following without Sun's prior written authorization: (i) disclose the Software or Information to any third party for your direct or indirect commercial gain or advantage, (ii) access, copy, distribute, display or use the Software or Information in any way to provide diagnostic, maintenance, repair or technical support services for Sun software or Sun hardware on behalf of any third party for your direct or indirect commercial gain or advantage, or (iii) for any third party to access, copy, distribute, display or use the Software or Information to provide diagnostic, maintenance, repair or technical support services for Sun software or Sun hardware on your behalf for such party's direct or indirect commercial gain or advantage. The Software and Information are copyrighted by Sun. (h) Unless otherwise specified, if Software is delivered with embedded or bundled software that enables functionality of Software, you may not use such embedded/bundled software on a stand-alone basis or use any portion of such embedded/bundled software to interoperate with any program(s) other than Software. (i) Software may contain programs that perform automated collection of system data and/or automated software updating services. System data collected through such programs may be used by Sun, its subcontractors, and its service delivery partners for the purpose of providing you with remote system services and/or improving Sun's software and systems. (j) Software and Information are not designed, licensed or intended for use in the design, construction, operation or maintenance of any nuclear facility and Sun and its licensors disclaim any express or implied warranty of fitness for such uses. (k) No right, title or interest in or to any trademark, service mark, logo or trade name of Sun or its licensors is granted under this Agreement. (l) Your license to use the Software hereunder is conditioned upon your having a valid license to use any underlying Sun software to which the Software pertains. For example, in the case of patches and updates for the Solaris OS, you must have a valid license to use the Solaris OS in order to use the related patches and updates provided hereunder.
C. DISCLAIMER OF WARRANTY. THE SOFTWARE AND INFORMATION ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL EXPRESS AND IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE EXTENT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.
D. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR ANY DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE AND/OR THE INFORMATION EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER OR NOT SUCH DAMAGES ARE FORESEEABLE. IN NO EVENT WILL SUN'S LIABILITY TO YOU, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE AMOUNT, IF ANY, PAID BY YOU FOR THE SOFTWARE AND INFORMATION UNDER THIS AGREEMENT. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED WARRANTY FAILS OF ITS ESSENTIAL PURPOSE.
E. EXPORT REGULATIONS. All Software, Information, documents, technical data, and any other information made available or delivered to you under this Agreement are subject to US export control laws and may be subject to export or import regulations in other countries. You agree to comply strictly with all such laws and regulations and acknowledge that you have the responsibility to obtain such licenses to export, re-export, or import as may be required after obtained by or delivered to you.
F. U.S. GOVERNMENT RESTRICTED RIGHTS. If Software or Information is being acquired by or on behalf of the U.S. Government or by a U.S. Government prime contractor or subcontractor (at any tier), then the Government's rights in Software and Information will be only as set forth in this Agreement; this is in accordance with 48 C.F.R. 227.7202-4 or successor regulation (for Department of Defense (DOD) acquisitions) and with 48 CFR 2.101 and 12.212 or successor regulation (for non-DOD acquisitions).
G. RECORDS AND AUDIT. During the term of this Agreement and for a period of three (3) years thereafter, you agree to keep proper records and documentation of your compliance with this Agreement. Upon five (5) business days' notice, you shall permit an independent accounting firm selected by Sun to examine and inspect, at your facility and during normal business hours, such records and documentation for the purpose of determining your compliance with the terms and conditions of this Agreement, at Sun's expense. Sun may exercise its audit right pursuant to this section once per calendar year; provided, however that if Sun discovers a material default of your obligations pursuant to this Agreement during an audit, then Sun may exercise its audit right every three (3) months, until such time as the default is corrected. The remedies provided in this section in the event of Sun's discovery of any breach by you of this Agreement are in addition to all other rights and remedies Sun may have with respect to such breach under this Agreement, at law or in equity.
3. TERMS OF USE. You confirm that you have read and understand the terms of use located at the bottom of each Sun webpage (“Terms of Use”) and that you agree to the Terms of Use.
4. ORDER OF PRECEDENCE. In the event of any conflict between the terms and conditions of this Agreement, any Separate Agreement, and the Terms of Use, the order of precedence shall be as follows: first, any Separate Agreement; second, this Agreement; and third, the Terms of Use. Whether a conflict exists between the terms and conditions of the aforementioned agreements shall be determined by considering the text of the contract provisions, their context and intended scope, and the subject matter of the agreements.
5. AUTHORITY. If you are accepting this Agreement on behalf of a company or other entity, you represent that you are authorized to bind the company or entity to this Agreement. You further represent that you are of majority age and otherwise competent to enter into contracts.
6. GOVERNING LAW. Any action related to this Agreement will be governed by California law and controlling U.S. federal law. No choice of law rules of any jurisdiction will apply.
7. JURISDICTION; VENUE. The parties hereby exclusively and irrevocably submit to, and waive any objection against, the personal jurisdiction of the United States District Court for the Northern District of California, and the state courts of the State of California located in the County of Santa Clara.
8. SEVERABILITY. If any provision of this Agreement is held to be unenforceable, this Agreement will remain in effect with the provision omitted, unless omission would frustrate the intent of the parties, in which case this Agreement will immediately terminate.
9. TERMINATION. This Agreement is effective until terminated. You may terminate this Agreement at any time by destroying all copies of Software and Information. This Agreement will terminate immediately without notice from Sun if you fail to comply with any provision of this Agreement. Sun may also terminate this Agreement at any time with written notice to you. Upon termination, you must destroy all copies of Software and Information.
10. NO AGENCY. This Agreement does not create any partnership, franchise, joint venture, agency, or fiduciary relationship. Neither party may bind the other party or act in a manner which expresses or implies a relationship other than that of independent contractor.
11. INTEGRATION. This Agreement is the entire agreement between you and Sun relating to its subject matter. It supersedes all prior and contemporaneous oral and written communications, proposals, representations and warranties and prevails over any conflicting or additional terms of any quote, order, acknowledgment, or other communication between the parties relating to its subject matter during the term of this Agreement. No modification of this Agreement will be binding, unless in writing and signed by an authorized representative of each party. You may not assign this Agreement to any third party without Sun's prior written consent.

E. 수출 규정. 본 계약 조건에서 사용자에게 전달되거나 사용 가능해지는 모든 소프트웨어, 정보, 문서, 기술 데이터 및 기타 정보는 US 수출 규제법을 따르며 기타 국가의 수출 또는 수입 규정을 따를 수도 있습니다. 해당하는 모든 법률 및 규정을 엄격히 준수하는 데 동의하고 구입 또는 전달 받은 후 필요할 수도 있는 수출, 재수출 또는 수입에 대한 라이센스를 구입해야 하는 책임이 있음을 인정합니다.
F. U.S. 정부의 제한된 권리. 소프트웨어 또는 정보가 U.S. 정부에 의해 또는 U.S. 정부를 대신하여 또는 주 계약자 또는 하청 업체(임의 계층)에 의해 취득되는 경우, 소프트웨어 및 정보에 대한 정부의 권리는 본 계약에 명시되어 있는 내용에만 해당됩니다. 이는 48 C.F.R. 227.7202-4 또는 이후 규정(국방부(DOD) 취득의 경우) 및 48 CFR 2.101 및 12.212 또는 이후 규정(비 DOD 취득의 경우)에 적용됩니다.
G. 기록 및 감사. 본 계약을 준수한다는 본 기록과 문서를 본 계약 기간과 그 이후 3년 동안 유지할 것에 동의합니다. 5일간의 영업일 통지에 따라 Sun에서 선택한 독립 회계 법인이 사용자의 시설에서 일반적인 근무 시간 동안 Sun의 비용으로 본 계약의 계약 조건의 준수를 확인하기 위해 해당 기록과 문서를 검사하고 검사하도록 허가합니다. 3. Why does it need to set a working folder at installation stage?
☞ The working folder is the default folder to save photographs and videos imported from Anycall while using the Anycall MediaStudio. Setting the most frequently used path the working folder will help you to find data imported from Anycall in an easy way.

1. Is it necessary to execute LiveUpdate?
☞ It is highly recommended to run LiveUpdate for more convenient use. Using this feature, you can keep your application to the latest version at all-time.

☞ Anycall MediaStudio will help you keep your program to the latest version whenever you open it. If the LiveUpdate completes properly, the Anycall MediaStudio you are using at the time is the latest. Connecting to Phone
1. Anycall MediaStudio does not recognize the phone when connected to PC via a cable.
☞ Check if you have installed Samsung USB Driver on you PC. You can download the driver at AnycallLand (http://www.anycall.com/).
2. It does not recognize the phone even after installed the driver and connected to PC.
☞ Check the Operating System of your PC. If you installed the USB driver while connecting the phone to system using Windows 98, it might probably not recognize the phone. In this case, remove the drive from Device Manager and make sure that the phone is not connected to PC when you install it again. Now there is no problem with Windows 98 - connecting your phone to PC.
3. Can I use Anycall MediaStudio with other’s phones from family or friends?
☞ Anycall MediaStudio supports all kinds of Anycall phones. But, some Anycall phones without camera and camcorder capabilities do not support part of features such as retrieving pictures and video files from the phone. Also, they will not work normally, if Lock or Privacy Protection feature of the phone is set on.
4. I disconnected the cable while signaling. Could it be bad to my phone or my computer?
☞ It will not cause serious problems to your PC as well as you phone. However, unknown errors can appear. Preferably refrain from disconnecting cable when you are making connection.
5. I want to see information about my phone such as size and kind of the desktop etc.
☞ They are available only when you just connected your phone to PC. Thus, you cannot check them out before you disconnect the cable and resume the connection again.
Useful Tips
1. How can I retrieve pictures or video footage from my phone?
☞ Connect the cable to your phone and run Media Explorer. Then click retrieve pictures menu from Anycall on the application to see a list stored at the phone. Select pictures you want to retrieve and click Retrieve button in order to put them into Image Box. Finally you may click Save to send them into the user-defined folder. As for multimedia retrieving, you can get video files you want in the same sequence as pictures are retrieved.
2. I select Print template and push Print button. But nothing was printed.
☞ First, Make sure that the printer is connected properly to your computer. IF there is no problem with the connection, check if you installed Printer driver you need. Then try Print again.
3. I want to turn off Cut mood.
☞ Push Cut button on the menubar one more time to turn off the mode.

Abstract
Forming an Incident Response Team (IRT) in the 1990s can be a daunting task. Many people forming an IRT have no experience with doing this. This paper examines the role an IRT may play in the community, and the issues that should be addressed both during the formation and after commencement of operations. It may be of benefit to existing IRTs as it may raise awareness of issues not previously addressed.
1. Introduction
On 8 March 1993, the Security Emergency Response Team (SERT) commenced Incident Response operations in Australia. Prior to this, discussions had been held with other Incident Response Teams (IRTs) to discuss the establishment of the team, and what would be required. A significant amount of work was performed just before, and immediately after, commencement to establish operations and tools. Further communication with other IRTs assisted SERT to establish policies and helped SERT to grow in its own constituency, and the computer security community at large.
Since that time, SERT has undergone many changes, and these transitions could not have been effected as smoothly as they were without the work that had been achieved earlier.
This paper looks at the topic of what it takes to form an IRT. It examines what issues need to be addressed and resolved prior to, and after, forming an IRT. It looks at the constituency, policies, relationships, information, equipment, tools, and interaction with the wider community.
Much of the information in this paper is not new. It has been steadily collected from a number of sources over time, and various amounts of it have been applied by SERT with varying success. The overwhelming message throughout this paper is:

Using the Net to make voice calls is getting a second chance, as an improved technology with special appeal to networked businesses
Finding a crack team of developers in St. Petersburg, Russia, nearly 10 years ago was a boon for software company Relativity Technologies, says Chief Executive Vivek Wadhwa. Among other things, his engineers there (plus a smaller team in Novosibrsk, Siberia) are highly skilled and earn much less than their U.S. counterparts. There was only one downside for Wadhwa's North Carolina company -- the $2,000 a month in phone calls required to stay in close touch with his Russian staff.
About six months ago, though, he found a way to cut those charges to next to nothing -- by routing the calls over his IP (Internet protocol) network. After trying out several approaches, he's using voice-over-IP software from Vedic Technologies in nearby Raleigh, N.C., that provides security, conference calling -- and acceptable voice quality. The sound doesn't match the clarity of AT&T, Wadhwa concedes, but he has weekly two-hour conference calls with his development team. "Given the type of money we save and the length of calls we have, it's worth it," he says.
Internet phone calling is one of those Web revolutions that never really arrived -- at least, not yet. But the buzz over so-called IP telephony is building once again, this time for different reasons than the original expectation that consumers would use their PCs to make free long-distance calls. Consumer voice-over-IP continues to be a mainly a hobbyist market for international calling. Many startups catering to consumers have failed, and Net2Phone (NTOP ), the leader in Internet calling, has shifted its business model to include more profitable niches (like phone cards) and brought in new management.
"PICK CAREFULLY." Today's excitement comes instead from businesses that see an opportunity to integrate voice calling into their current IP networks as a way to save money and add new communications capabilities. The technology is still susceptible to excess hype, partly because upgrading systems to handle voice can be expensive and requires complex engineering. Yet many midsize businesses with lots of broadband capacity can benefit from using voice-over-IP.
"We're starting to see more clear-cut cases where a company can save a lot of money," says Jim Slaby, senior industry analyst at Giga Information Group in Cambridge, Mass. "But you really have to pick your spots carefully for it to make sense." Slaby estimates that 15% of large companies are now experimenting with IP telephony. In two years, he thinks 40% will be -- but that only half of those may end up buying systems.
Today the technology works best for calls within one location. Within a local area network (LAN), the sound quality of voice-over-IP is often just as good as over traditional phone lines, experts say. Calling quality is also quite acceptable between offices over a corporate Intranet, analysts say -- although companies can start to run into sound-quality problems as calls compete with other data applications over a wide area network.
SINGLE STRUCTURE. For companies that make a lot of high-cost calls to developing nations, the savings are especially clear. Research firm Gartner estimates that businesses can save 50% or more on international voice and fax calls over an IP telephony network. It says companies can also lower their network-management costs by consolidating voice and data into a single communications infrastructure. But it estimates that only 20% of current corporate networks would be able to handle voice traffic without a significant upgrade.
What makes IP telephony worth that extra effort for many companies is the promise of features that only the Net makes possible. Internet conference calls can include video, display who's logged onto the call, and identify the speaker. Web sites are being built that allow users to reach a live customer-support rep by clicking a link on a Web page. At the same time, the rep can see exactly where on the site (for example, in the middle of an order) the caller's question arose.
"The kind of enhanced service that this platform allows is so much wider and cheaper to deliver that the legacy stuff isn't even competitive," enthuses Net2Phone CEO Stephen Greenberg.
ACCOMMODATIVE SYSTEM. Tarantella (TTLA ), a software company in Santa Cruz, Calif., has bought that argument. It's currently adding IP telephony to its network, mainly to better provide 24-hour support to customers -- along with more flexible working arrangements for its customer-support team. It plans to build a system that can route calls to either U.S. or British offices, depending on the time of day, or to employees who are working from home over a broadband connection.
While CEO Doug Michels expects to save money, "the [main] issue is to provide an economical yet flexible system that can accommodate our very distributed and mobile work force," he says.
Already, major telecom equipment and Internet infrastructure companies are betting that more companies will follow the path Reliability and Tarantella are taking. Of those, Cisco Systems (CSCO ) is probably making the biggest bet on IP telephony now, developing and heavily marketing new products for the market, says Slaby. Indeed, if lots of large companies decide to integrate their voice and IP networks, they'll need better routers and IP switches than their existing networks have. So far, Slaby says, "Cisco is ahead of actual market demand with its technology."
TWO-TRACK STRATEGY. Cable companies and regional telephone companies are also experimenting with voice-over-IP services. Net2Phone's Greenberg thinks that eventually only one broadband pipe will be going into the home, and phone and cable companies will battle over control of customer, though "nothing like that ever happens overnight," adds Slaby.
For now, traditional phone companies are trying to make their investment in current voice networks last as long as possible while simultaneously making the most of their new investments in IP-related infrastructure, says Slaby. Gartner Research Director Richard Costello has little doubt that traditional phone companies will be able to provide voice-over-IP, if that's what their customers want. For now, the most important thing is for them to remain flexible as IP technology evolves, he says.
Vedic Technologies CEO Percy Rajani, who sells the IP telephony product that Relativity uses, says his software occupies a middle ground between the poor-quality solutions that initially popped up for consumers and the high-end systems sold by the likes of Cisco. But to make sales, he still has to overcome the technology's lackluster image from its early days. Potential clients "say, 'We tried that stuff, and it's garbage,'" he admits. To get them to buy, he usually offers a free trial and has a range of pricing plans, including one where his company takes a cut of monthly savings on phone bills.
In today's tough tech environment, with companies looking to save money every way possible, Internet calling is getting a second start. For companies that sell it, however, the best approach may be to underpromise and overdeliver. Because nothing can kill a technology faster than two disappointments in a row.
-------------------------------------------------------------------------------------------------------------------------------Microsoft has confirmed its intention to acquire Navision, a Danish, mid-market business applications vendor. While the short-term impact of this move will be limited, it poses a serious threat to vendors in the long-term. Alan Pelz-Sharpe, VP of Research and Consulting at Ovum, North America, comments.
There is a lot of debate in the press about how Microsoft's acquisition of Navision will impact on the market and particularly on technology stocks. On one hand, it's seen as a confidence boost in a turbulent market and, on the other, a serious threat to incumbent business application vendors such as SAP. But how real or immediate is this threat?
It's clear that the impact of this acquisition will take quite some time to filter through. It's two years since Microsoft bought Great Plains, the ERP vendor and a year since it bought nCompass, a web content management (WCM) vendor. Neither of these products impacted much on Microsoft's revenue and market share. But they have impacted the wider market, for example, in the WCM market many smaller vendors have failed.
Microsoft's very presence in a market is enough to cause corporate jitters. Ovum expects to see smaller and financially unstable CRM, and SCM, vendors coming under more pressure as they encounter Microsoft on shortlists. There is also the risk that Microsoft's famed low pricing will lead corporate CFOs to believe the costs of business applications are falling even lower, which will squeeze the market further.
Established vendors, such as Siebel and SAP, won't be lying awake wondering what Microsoft's next move will be. They won't come up against Microsoft, in a serious competitive situation, for a few years. This is because it's hard to implement a business application that is driven by underlying business processes. To deploy it with any success, generally requires at least some systems integration and business analysis skills. Microsoft simply doesn't have these skills in any substantial measure.
For sales, Microsoft depends on an army of resellers, distributors and small consultancies in the business application market. It will encounter a Catch 22 situation as it moves up the complexity chain. Why would a small SI or consultancy want to sell a Microsoft CRM, or SCM, system at a low price with minimal integration, when they could sell more substantial and complex products? For smaller companies it is simply not economical to sell Microsoft business software much of the time. Despite this situation, the acquisition of Navision does pose a serious threat to many vendors in the long-term when viewed as part of the overarching strategy of .NET and the drive to provide software as a service. Navision delivers more high-end technology into the Microsoft portfolio, to sit alongside Groove, Great Plains and nCompass.
It will be a slow move from software as a standalone, or pre-packaged, solution to software as a service. But in three to five year's time, companies such as IBM, EDS and Accenture may be lining up alongside Microsoft in the service provision market. To get to this point, there is likely to be a lot of bloodshed along the way.
For niche business application software vendors its time to acquire, or be acquired, and adapt to the new IT world. The days of standalone applications are numbered. Like everything else in the technology world, things never happen quite as quickly as the hype suggests. But software as a service and the entire hosted service market will have its day sooner or later, and fighting for the largest slice with be Bill Gates and Steve Ballmer.
Linux may have slipped out of the headlines as the 'fad of the day' but its adoption rate by mainstream computing is steadily increasing, notably in China. Its growing success arises from a number of different factors, some of which seem to owe more to chance than the direct result of outright support, says Ovum principal analyst Gary Barnett.
Sun Microsystems
Sun's move to Linux is highly significant, as it means that every major Unix vendor now supports Linux in one way or another. The Unix vendors were destined to have an uneasy relationship with Linux, since it poses a significant potential threat, not just to sales of their own flavour of Unix but also to their hardware (particularly as clustering technology allows Linux on Intel to scale up). This uneasiness is sharpened by the fact that, as each Unix vendor announced support for Linux they added to its gravitas, which in turn made it more of a potential threat. It was almost inevitable that someone was going to have to walk on stage dressed in a penguin costume and Scott McNealy, by taking too long to articulate a clear position for Sun with respect to Linux, drew the short straw.
Microsoft
Microsoft can also take some credit for boosting interest in Linux, although this is more by chance than a deliberate move.
Across Europe, a surprising number of very large end-user organisations, including governments, are considering Linux as a less expensive alternative to Microsoft's software. In many cases this is little more than a bargaining ploy in their negotiations with Microsoft. However, the company's mishandling of the publicity surrounding the move to a more subscription-based pricing model has raised concerns about software pricing. People are now asking questions such as: "How much is the ability to query an SQL database directly from my word processing package worth to me?"
Microsoft's new licensing model means that a large number of end-user organisations are paying significantly more for their office productivity software. Consequently, many of them are looking closely at streamlined, less expensive alternatives. Ultimately the market will decide, and Microsoft is still able to revise its pricing strategy. In the meantime, it has certainly got a number of large organisations thinking about cheaper alternatives such as open source software.
The Chinese Government
The Chinese Government is extremely interested in Linux for a number of reasons. Primarily, Linux offers independence from the big US vendors that effectively own the world's software business. Linux also offers a range of scalability that fits well with the diverse, and often aged, computing infrastructure that exists in China. (For example, Linux can be deployed to low-end Intel machines right through to IBM mainframes.) Finally, access to the Linux source offers a level of flexibility that can be effectively exploited by China's vast reserve of programming talent - the result of a well-evolved university system.
America's dominance of the software market is profound. Microsoft and IBM account for about 30% of all software sales and the top ten list of software vendors is almost exclusively the preserve of US companies. While China is exhibiting something of a renaissance in terms of world trade, it is traditionally loath to place itself at the mercy of foreign corporations. In Linux's favour, Microsoft's new approach to licensing presents problems for China as it is based on Internet activation coupled with a shift towards subscription-based pricing.
China's IT infrastructure covers a vast spectrum from very aged systems to some of the most modern in the world. The concept that a single OS may provide a common platform across even a relatively small subset of this base is highly appealing, if only from a cost perspective.
China's potential as a software powerhouse is vastly underrated. Western software companies poorly serve China when it comes to support for the Chinese languages. Given a standard operating system upon which to focus effort, China could promote itself to the first division in the world of software - which could benefit us all.
In courting Linux, China faces some challenges. The desire for privacy that adds to its attraction also jars with the commitment that Linux users make to keep their users' informed of any changes to the source code. China will have to share some of its intellectual property; it remains to be seen how comfortable it will be with this arrangement.

Using the Net to make voice calls is getting a second chance, as an improved technology with special appeal to networked businesses
Finding a crack team of developers in St. Petersburg, Russia, nearly 10 years ago was a boon for software company Relativity Technologies, says Chief Executive Vivek Wadhwa. Among other things, his engineers there (plus a smaller team in Novosibrsk, Siberia) are highly skilled and earn much less than their U.S. counterparts. There was only one downside for Wadhwa's North Carolina company -- the $2,000 a month in phone calls required to stay in close touch with his Russian staff.
About six months ago, though, he found a way to cut those charges to next to nothing -- by routing the calls over his IP (Internet protocol) network. After trying out several approaches, he's using voice-over-IP software from Vedic Technologies in nearby Raleigh, N.C., that provides security, conference calling -- and acceptable voice quality. The sound doesn't match the clarity of AT&T, Wadhwa concedes, but he has weekly two-hour conference calls with his development team. "Given the type of money we save and the length of calls we have, it's worth it," he says.
Internet phone calling is one of those Web revolutions that never really arrived -- at least, not yet. But the buzz over so-called IP telephony is building once again, this time for different reasons than the original expectation that consumers would use their PCs to make free long-distance calls. Consumer voice-over-IP continues to be a mainly a hobbyist market for international calling. Many startups catering to consumers have failed, and Net2Phone (NTOP ), the leader in Internet calling, has shifted its business model to include more profitable niches (like phone cards) and brought in new management.
"PICK CAREFULLY." Today's excitement comes instead from businesses that see an opportunity to integrate voice calling into their current IP networks as a way to save money and add new communications capabilities. The technology is still susceptible to excess hype, partly because upgrading systems to handle voice can be expensive and requires complex engineering. Yet many midsize businesses with lots of broadband capacity can benefit from using voice-over-IP.
"We're starting to see more clear-cut cases where a company can save a lot of money," says Jim Slaby, senior industry analyst at Giga Information Group in Cambridge, Mass. "But you really have to pick your spots carefully for it to make sense." Slaby estimates that 15% of large companies are now experimenting with IP telephony. In two years, he thinks 40% will be -- but that only half of those may end up buying systems.
Today the technology works best for calls within one location. Within a local area network (LAN), the sound quality of voice-over-IP is often just as good as over traditional phone lines, experts say. Calling quality is also quite acceptable between offices over a corporate Intranet, analysts say -- although companies can start to run into sound-quality problems as calls compete with other data applications over a wide area network.
SINGLE STRUCTURE. For companies that make a lot of high-cost calls to developing nations, the savings are especially clear. Research firm Gartner estimates that businesses can save 50% or more on international voice and fax calls over an IP telephony network. It says companies can also lower their network-management costs by consolidating voice and data into a single communications infrastructure. But it estimates that only 20% of current corporate networks would be able to handle voice traffic without a significant upgrade.
What makes IP telephony worth that extra effort for many companies is the promise of features that only the Net makes possible. Internet conference calls can include video, display who's logged onto the call, and identify the speaker. Web sites are being built that allow users to reach a live customer-support rep by clicking a link on a Web page. At the same time, the rep can see exactly where on the site (for example, in the middle of an order) the caller's question arose.
"The kind of enhanced service that this platform allows is so much wider and cheaper to deliver that the legacy stuff isn't even competitive," enthuses Net2Phone CEO Stephen Greenberg.
ACCOMMODATIVE SYSTEM. Tarantella (TTLA ), a software company in Santa Cruz, Calif., has bought that argument. It's currently adding IP telephony to its network, mainly to better provide 24-hour support to customers -- along with more flexible working arrangements for its customer-support team. It plans to build a system that can route calls to either U.S. or British offices, depending on the time of day, or to employees who are working from home over a broadband connection.
While CEO Doug Michels expects to save money, "the [main] issue is to provide an economical yet flexible system that can accommodate our very distributed and mobile work force," he says.
Already, major telecom equipment and Internet infrastructure companies are betting that more companies will follow the path Reliability and Tarantella are taking. Of those, Cisco Systems (CSCO ) is probably making the biggest bet on IP telephony now, developing and heavily marketing new products for the market, says Slaby. Indeed, if lots of large companies decide to integrate their voice and IP networks, they'll need better routers and IP switches than their existing networks have. So far, Slaby says, "Cisco is ahead of actual market demand with its technology."
TWO-TRACK STRATEGY. Cable companies and regional telephone companies are also experimenting with voice-over-IP services. Net2Phone's Greenberg thinks that eventually only one broadband pipe will be going into the home, and phone and cable companies will battle over control of customer, though "nothing like that ever happens overnight," adds Slaby.
For now, traditional phone companies are trying to make their investment in current voice networks last as long as possible while simultaneously making the most of their new investments in IP-related infrastructure, says Slaby. Gartner Research Director Richard Costello has little doubt that traditional phone companies will be able to provide voice-over-IP, if that's what their customers want. For now, the most important thing is for them to remain flexible as IP technology evolves, he says.
Vedic Technologies CEO Percy Rajani, who sells the IP telephony product that Relativity uses, says his software occupies a middle ground between the poor-quality solutions that initially popped up for consumers and the high-end systems sold by the likes of Cisco. But to make sales, he still has to overcome the technology's lackluster image from its early days. Potential clients "say, 'We tried that stuff, and it's garbage,'" he admits. To get them to buy, he usually offers a free trial and has a range of pricing plans, including one where his company takes a cut of monthly savings on phone bills.
In today's tough tech environment, with companies looking to save money every way possible, Internet calling is getting a second start. For companies that sell it, however, the best approach may be to underpromise and overdeliver. Because nothing can kill a technology faster than two disappointments in a row.

There is a lot of debate in the press about how Microsoft's acquisition of Navision will impact on the market and particularly on technology stocks. On one hand, it's seen as a confidence boost in a turbulent market and, on the other, a serious threat to incumbent business application vendors such as SAP. But how real or immediate is this threat?
It's clear that the impact of this acquisition will take quite some time to filter through. It's two years since Microsoft bought Great Plains, the ERP vendor and a year since it bought nCompass, a web content management (WCM) vendor. Neither of these products impacted much on Microsoft's revenue and market share. But they have impacted the wider market, for example, in the WCM market many smaller vendors have failed.
Microsoft's very presence in a market is enough to cause corporate jitters. Ovum expects to see smaller and financially unstable CRM, and SCM, vendors coming under more pressure as they encounter Microsoft on shortlists. There is also the risk that Microsoft's famed low pricing will lead corporate CFOs to believe the costs of business applications are falling even lower, which will squeeze the market further.
Established vendors, such as Siebel and SAP, won't be lying awake wondering what Microsoft's next move will be. They won't come up against Microsoft, in a serious competitive situation, for a few years. This is because it's hard to implement a business application that is driven by underlying business processes. To deploy it with any success, generally requires at least some systems integration and business analysis skills. Microsoft simply doesn't have these skills in any substantial measure.
For sales, Microsoft depends on an army of resellers, distributors and small consultancies in the business application market. It will encounter a Catch 22 situation as it moves up the complexity chain. Why would a small SI or consultancy want to sell a Microsoft CRM, or SCM, system at a low price with minimal integration, when they could sell more substantial and complex products? For smaller companies it is simply not economical to sell Microsoft business software much of the time. Despite this situation, the acquisition of Navision does pose a serious threat to many vendors in the long-term when viewed as part of the overarching strategy of .NET and the drive to provide software as a service. Navision delivers more high-end technology into the Microsoft portfolio, to sit alongside Groove, Great Plains and nCompass.
It will be a slow move from software as a standalone, or pre-packaged, solution to software as a service. But in three to five year's time, companies such as IBM, EDS and Accenture may be lining up alongside Microsoft in the service provision market. To get to this point, there is likely to be a lot of bloodshed along the way.
For niche business application software vendors its time to acquire, or be acquired, and adapt to the new IT world. The days of standalone applications are numbered. Like everything else in the technology world, things never happen quite as quickly as the hype suggests. But software as a service and the entire hosted service market will have its day sooner or later, and fighting for the largest slice with be Bill Gates and Steve Ballmer.
Linux may have slipped out of the headlines as the 'fad of the day' but its adoption rate by mainstream computing is steadily increasing, notably in China. Its growing success arises from a number of different factors, some of which seem to owe more to chance than the direct result of outright support, says Ovum principal analyst Gary Barnett.
Sun Microsystems
Sun's move to Linux is highly significant, as it means that every major Unix vendor now supports Linux in one way or another. The Unix vendors were destined to have an uneasy relationship with Linux, since it poses a significant potential threat, not just to sales of their own flavour of Unix but also to their hardware (particularly as clustering technology allows Linux on Intel to scale up). This uneasiness is sharpened by the fact that, as each Unix vendor announced support for Linux they added to its gravitas, which in turn made it more of a potential threat. It was almost inevitable that someone was going to have to walk on stage dressed in a penguin costume and Scott McNealy, by taking too long to articulate a clear position for Sun with respect to Linux, drew the short straw.

Microsoft can also take some credit for boosting interest in Linux, although this is more by chance than a deliberate move.
Across Europe, a surprising number of very large end-user organisations, including governments, are considering Linux as a less expensive alternative to Microsoft's software. In many cases this is little more than a bargaining ploy in their negotiations with Microsoft. However, the company's mishandling of the publicity surrounding the move to a more subscription-based pricing model has raised concerns about software pricing. People are now asking questions such as: "How much is the ability to query an SQL database directly from my word processing package worth to me?"
Microsoft's new licensing model means that a large number of end-user organisations are paying significantly more for their office productivity software. Consequently, many of them are looking closely at streamlined, less expensive alternatives. Ultimately the market will decide, and Microsoft is still able to revise its pricing strategy. In the meantime, it has certainly got a number of large organisations thinking about cheaper alternatives such as open source software.
The Chinese Government
The Chinese Government is extremely interested in Linux for a number of reasons. Primarily, Linux offers independence from the big US vendors that effectively own the world's software business. Linux also offers a range of scalability that fits well with the diverse, and often aged, computing infrastructure that exists in China. (For example, Linux can be deployed to low-end Intel machines right through to IBM mainframes.) Finally, access to the Linux source offers a level of flexibility that can be effectively exploited by China's vast reserve of programming talent - the result of a well-evolved university system.
America's dominance of the software market is profound. Microsoft and IBM account for about 30% of all software sales and the top ten list of software vendors is almost exclusively the preserve of US companies. While China is exhibiting something of a renaissance in terms of world trade, it is traditionally loath to place itself at the mercy of foreign corporations. In Linux's favour, Microsoft's new approach to licensing presents problems for China as it is based on Internet activation coupled with a shift towards subscription-based pricing.
China's IT infrastructure covers a vast spectrum from very aged systems to some of the most modern in the world. The concept that a single OS may provide a common platform across even a relatively small subset of this base is highly appealing, if only from a cost perspective.
China's potential as a software powerhouse is vastly underrated. Western software companies poorly serve China when it comes to support for the Chinese languages. Given a standard operating system upon which to focus effort, China could promote itself to the first division in the world of software - which could benefit us all.
In courting Linux, China faces some challenges. The desire for privacy that adds to its attraction also jars with the commitment that Linux users make to keep their users' informed of any changes to the source code. China will have to share some of its intellectual property; it remains to be seen how comfortable it will be with this arrangement.
