39. אחריות הקבלן לנזק
מיום התחלת עבודה ועד למתן תעודת השלמה כאמור בסעיף 12 לעיל יהא הקבלן אחראי לשמירה ולהשגחה על העבודות ועל הציוד. בכל מקרה של נזק לעבודות ו/או לציוד, מסיבה כלשהי לרבות כתוצאה משיטפונות, רוחות, סערות, שלגים יהא על הקבלן לתקן את הנזק על חשבונו בהקדם האפשרי באופן שעם השלמתן תהיינה העבודות במצב תקין וראוי לשימוש ומתאימות בכל פרטיהן להוראות החוזה.

Contractor's liability for damages
From the day that work commences and until such time as the certificate of completion is granted, as provided under Section 12 above, the contractor shall be responsible for safeguarding and overseeing the works and the equipment. In any event of damage to the works and/or to the equipment, for any reason whatsoever including as a result of flooding, winds, storms, snow, the contractor shall be required to repair the damage at its own expense as soon as possible and in such manner that upon completion of the works, they shall be in proper condition and suitable for use and conforming in all ways to the provisions of the contract.
