i) Clause 5.3 means that when you take possession of your apartment all the risk passes to you, the buyer. The passing of risk from the seller to the buyer means that the seller is no longer responsible for the building and the buyer, for instance, should ensure he has proper contents insurance including accidental damage. The building itself will be insured by the management company and we shall return to that topic later.
ii) Clause 6.1 provides that the buyer will purchase a share in the management company which means the buyer will become a member of the management company and may therefore exercise some control on the management company’s activities.
iii) Clauses 7 to 7.6 are self-explanatory except that KVD is a tax equivalent to our VAT and is currently levied at 5%. The KVD is payable to the seller on completion and of course it is impossible to predict at what rate KVD will be payable when the transaction is completed.
iv) Clause 7.7 is there for those buyers who wish to avail themselves of the seller’s loan facilities and you will note that the rate of interest on the outstanding balance is 7.9% with payments commencing in the month after the buyer has taken possession of his property. The last sentence in the this clause 7.7 is particularly important since the buyer will not be the owner of the property until he has paid the full consideration to the seller. However, the buyer’s contract will be registered at the local land registry in Northern Cyprus thereby protecting the buyer’s interest in the property (when this law comes into force, it has not done so yet). The remaining part of that clause 7.7 is also important since it contains a penalty (liquidated damages payable to the seller) in circumstances where the buyer defaults and the seller requires immediate possession.

i) شق 5.3 کا مطلب ہے کہ جب آپ اپنے اپارٹمنٹ کا قبضہ لیتے ہیں تو بطور خریدا اس کے بعد مذکورہ اپارٹمنٹ کی تمام تر ذمہ داری آپ پر عائد ہوجاتی ہے- فروخت کنندہ سے جائیداد کی ذمہ داری ہٹ کر خریدار پر آجانے کا مطلب یہ ہے کہ اس کے بعد مذکورہ جائیداد کے حوالے سے فروخت کنندہ ہر طرح کی ذمہ داری سے مبرا ہو جاتا ہے، مثال کے طور پر اب یہ خریدار کا مسئلہ ہے کہ وہ اس بات کو یقینی بناۓ کہ وہ اپنی جائیداد کی مناسب قسم کی انشورنس کرواۓ جس میں حادثاتی نقصانات وغیرہ بھی شامل ہوں- منیجمنٹ کرنے والی کمپنی پوری بلڈنگ کی انشورنس بھی کرواۓ گی اور ہم اس موضوع پر بعد میں بات کریں گے-
ii) شق 6.1 اس بات کی وضاحت کرتی ہے کہ خریدار منیجمنٹ کمپنی کے اندر ایک شیئر خریدے گا جس کا مطلب یہ ہے کہ شیئر ہولڈر ہونے کی بناء پر خریدار بھی منیجمنٹ کمپنی کا ممبر بن جاۓ گا اور اس طریقے سے وہ منیجمنٹ کمپنی کی سرگرمیوں پر کسی حد کنٹرول حاصل کر سکے گا-
iii) شق نمبرات 7 تا 7.6 اپنی وضاحت خود پیش کر رہی ہیں ماسواۓ اس کی وضاحت کے کہ ' کے وی ڈی' ہماری 'وی اے ٹی' کی طرز کا ایک ٹیکس ہے اور موجودہ طور پر اس کی شرح 5 فیصد ہے- 'کے وی ڈی' کی ادائیگی کرنے کی ذمہ داری خریدار پر تکمیل کے وقت عائد ہوتی ہے اورفی الوقت یہ بتانا قبل از وقت ہو گا کہ اس کی ادائیگی کی شرح تکمیل کے وقت حتمی طور پر کیا ہوگی-
iv) شق نمبر 7.7 ان خریداروں سے تعلق رکھتی ہے جو فروخت کنندہ کی قرض کی فراہمی کی سہولت حاصل کرنا چاہتے ہیں اور آپ یہ نوٹ کریں گے کہ باقی ماندہ بقایا جات پر اس قرض کے انٹرسٹ کی شرح 7.9 فیصد ہے اور یہ ان ادائیگیوں پر لاگو ہو گا جو کہ خریدارکو قبضہ کے حصول کے بعد کے مہینوں میں کرنی پڑیں گی- اس شق نمبر 7.7 کا آخری جملہ خاص طور پر اہم ہے اور آپ کی توجہ کا متقاضی ہے جس کی رو سے خریدار اس وقت تک جائیداد کا مالک تصور نہیں کیا جاۓ گا جب تک کہ وہ فروخت کنندہ کا تمام حساب کتاب چکا نہ دے- تاہم، خریدار کے معاہدہ کا اندراج ناردرن سائپرس کے اندر مقامی محکمہ مال کے پاس ہو جاۓ گا جس سے مذکورہ جائیداد سے منسلک خریدار کے مفاد کا تحفظ ہو جاتا ہے ( یہ قانون کب لاگو ہوتا ہے، یہ ابھی تک نہیں ہوا)- شق نمبر 7.7 کا باقی ماندہ حصہ بھی اہمیت کا حامل ہے کیونکہ اس کا تعلق ایک طرح کے جرمانے سے ہے (دیولیہ ہونے کا ہرجانہ قابل ادائیگی براۓ فروخت کنندہ) ان حالات میں جب کہ خریدار ڈیفالٹر ہو جاتا ہے اور فروخت کنندہ فوری قبضے کا مطالبہ کرتا ہے-
