In Anmerkung zu Art. 5 der Brüssel-Konvention haben Miguel Teixeira de Sousa und Dário Moura Vicente im Kommentar zur Brüssel-Konvention vom 27. September 1968 bezüglich der gerichtlichen Zuständigkeit und Vollstreckung von zivil- und handelsrechtlichen Entscheidungen und zusätzlichen Texten, Lex 1994, Seite 89 geschrieben, dass “die Bestimmung des Erfüllungsorts einer strittigen Verpflichtung grundsätzlich im Einklang mit dem anwendbaren Recht nach dem Kollisionsrecht des Forumstaates erfolgen soll“.
