3.8.1 КОНКУРЕНЦИЈА
1. ТЕКОВНА СОСТОЈБА
1.1 ПРАВНА РАМКА
Законот за заштита на конкуренцијата (“Службен весник на Република Македонија” бр. 04/05 и 70/06) ја уредува заштитата на конкуренцијата во Република Македонија. Законот е усогласен со Договорот за основање на Европската Заедница (членовите 81, 82 и 86); и ЕУ мерките 31962R0017, 32003R0001, 31971R2821, 32004R0139, 31997Y1209(01) и 52001XC1222(03).
Во 2005 година усвоени се подзаконските акти предвидени со Законот за заштита на конкуренцијата, објавени во Службен весник на Република Македонија бр. 91/05:
• Уредбата за групно изземање на вертикалните договори за исклучиво право на дистрибуција, селективно право на дистрибуција, исклучиво право на купување и франшизинг (усогласена со 31999R2790);
• Уредбата за групно изземање на хоризонтални договори за истражување и развој (усогласена со 32000R2659);
• Уредбата за групно изземање на хоризонтални договори за специјализација (усогласена со 32000R2658);
• Уредбата за групно изземање на договори за трансфер на технологија, лиценца или know – how (усогласена со 32004R0772);
• Уредбата за групно изземање на договори за дистрибуција и сервисирање на моторни возила (усогласена со 32002R1400);
• Уредбата за групно изземање на договори за осигурување (усогласена со 32003R0358);
• Уредбата за договори од мало значење (усогласена со 52001XC1222(03) и
• Уредбата за поблиските критериуми за оценка на концентрациите и содржината и формата на известувањето (усогласена со 32004R0802 и 32004R0139).
Во последниот квартал од 2006 година, подготвени се упатства за примена на подзаконските акти донесени врз основа на ЗЗК.
1.2 ИНСТИТУЦИОНАЛНА РАМКА
Согласно чл. 6 од Законот за заштита на конкуренцијата (ЗЗК), надлежен орган за спроведување на законот е Комисијата за заштита на конкуренцијата (КЗК). Комисијата е независен орган, составен од претседател и четири члена. Претседателот и членовите ги именува и разрешува Собранието на Република Македонија, за период од пет години, со право на повторно именување. Комисијата за својата работа одговара пред Собранието на Република Македонија. Претседателот и најмалку два члена на Комисијата се професионално ангажирани во работата на Комисијата. Средствата на Комисијата се обезбедуваат од Буџетот на Република Македонија.
Управните, стручните и другите административно – технички работи ги врши стручната служба на Комисијата. Во стручната служба во редовен работен однос се вработени 16 (шеснаесет) лица од кои 7 (седум) дипломирани правници, 6 (шест) дипломирани економисти, 1 (еден) дипломиран филолог по англиски јазик и книжевност – преведувачка насока и 2 (двајца) со средна стручна спрема. Со стручната служба раководи генерален секретар кој го именува Комисијата.
Комисијата е надлежна да ја контролира примената на одредбите од законот и прописите донесени врз основа на законот; да ги следи и анализира состојбите на пазарот до степен потребен за развој на слободна и ефикасна конкуренција; да води постапки и донесува одлуки.

1. CURRENT SITUATION
1.1 LEGAL FRAMEWORK
The Law on Competition Protection (“Official Gazette of the Republic of Macedonia”) No.04/05 and 70/06) regulates the protection of competition in the Republic of Macedonia The law is aligned with the following EU measures: The Treaty establishing the European Community, Articles 81, 82 and 86 thereof, 31962R0017, 32003R0001, 31971R2821, 32004R0139, 31997Y1209(01) and 52001XC1222(03).
The bylaws envisaged with the Law on Competition Protection (“Official Gazette of the Republic of Macedonia” 91/05) were adopted in 2005:
• Regulation on block exemption granted to vertical agreements on exclusive rights of distribution, selective right of distribution, exclusive right of purchase and franchise (aligned with 31999R2790);
• Regulation on block exemption granted to horizontal researches and development agreements ( aligned to 32000R2659);
• Regulation on block exemption granted to horizontal and specialization agreements (aligned to 32000R2658);
• Regulation on block exemption granted to technology transfer agreements, license or know – how (aligned to 32004R0772);
• Regulation on block exemption granted to agreements on distribution and servicing of motor vehicles (aligned to 32002R1400);
• Regulation on block exemption granted to agreements in the insurance sector (aligned to 32003R0358);
• Regulation on agreements of minor importance (aligned to 52001XC1222(03) and
• Regulation on the form and notification and criteria on concentrations evaluation (aligned to 32004R0802 and 32004R0139).
In the last quarter of 2006, guidance for the implementation of the bylaws adopted on the basis of the LPC were prepared.
1.2 INSTITUTIONAL FRAMEWORK
Pursuant to the Article 6 from the Law on Competition Protection (LPC), Institutional authority for implementation of the LPC is the Commission for Protection of Competition (CPC). The Commission is independent state body, composed of a president and four members. The Parliament of the Republic of Macedonia appoints and dismisses the President and the members of the CPC within a period of five years, with right of reappointment. The Commission tally for its work to the Parliament of the Republic of Macedonia. The President and at least two members of the Commission are professionally engaged in the work of the Commission. The Budget of the Commission is provided from the budget of the Republic of Macedonia.
The Department of Qualified Personnel of the Commission carries out the management, the professional and other administrative and technical matters. Sixteen (16) persons are permanently employed in the professional service of the Commission, of whom seven (7) are legal experts with university degree, six (6) economy experts with university degree, one (1) philologist in English Language and Literature – interpretation department with a university degree and two (2) with high school degree. A Secretary General manages the Department of Qualified Personnel, appointed by the Commission.
The commission is authorized to supervise the application of the provisions of the LPC and the regulations adopted on the basis of the LPC; monitor and analyze the conditions of the market to the extent necessary for free and efficient competition; conduct procedures and adopt decisions.
