Pursuant to the provisions of Article 77 par. 4 of the Real Estate Management Act, the sum of performances made by a perpetual usufructuary of agricultural real property for the purpose of building elements of physical infrastructure will be included in the difference between the previous and updated usufruct fee. The court of first instance hearing the matter ruled that an increase in the value of the property is the only circumstance justifying an owner’s challenging of the previous fee. In the court’s opinion, issues other than a change in the value of the property are not material to the settlement of the matter. Thus, the provisions of Article 77 par. 4 of the Real Estate Management Act were not applied.
An increase in the value of the property is indeed the basis for fee update pursuant to Article 77 par. 1 of the Real Estate Management Act. However, pursuant to Article 77 par. 4 of the Real Estate Management Act in force as at the date of fee update, in updating the fee, the sum of performances made by the perpetual usufructuary for the purpose of building elements of physical infrastructure will be included in the difference between the previous and updated fee. A literal interpretation of the above-mentioned provisions results in the conclusion that the administrative body is obliged to include the above performances in the update. The sum of these performances has been appraised by the plaintiff at PLN 4,822,952.40 and has not been offset in the annual fee update.

Zgodnie z przepisami art. 77 ust. 4 ustawy o gospodarce nieruchomościami, wartość świadczeń wniesionych przez użytkownika wieczystego nieruchomości gruntowej na rzecz budowy poszczególnych urządzeń infrastruktury technicznej zalicza się na poczet różnicy między opłatą dotychczasową a opłatą zaktualizowaną. Sąd pierwszej instancji rozpoznający sprawę orzekł, że wzrost wartości nieruchomości jest jedyną okolicznością uzasadniającą zakwestionowanie przez właściciela wysokości dotychczasowej opłaty. W opinii sądu, kwestie inne niż różnica wartości nieruchomości, nie są istotne dla rozpatrzenia tej sprawy. Stąd też, przepisy art. 77 ust. 4 ustawy o gospodarce nieruchomościami nie mają zastosowania.
Wzrost wartości nieruchomości jest w istocie podstawą do aktualizacji opłaty zgodnie z art. 77 ust. 1 ustawy o gospodarce nieruchomościami. Niemniej jednak, na podstawie art. 77 ust. 4 ustawy o gospodarce nieruchomościami w brzmieniu obowiązującym na dzień aktualizacji opłaty, podczas aktualizowania wysokości opłaty wartość świadczeń wniesionych przez użytkownika wieczystego na rzecz budowy poszczególnych urządzeń infrastruktury technicznej zalicza się na poczet różnicy między opłatą dotychczasową a opłatą zaktualizowaną. Dosłowna interpretacja wyżej wymienionych przepisów prowadzi do wniosku, że organ administracyjny ma obowiązek uwzględnić powyższe świadczenia w aktualizacji opłaty. Wartość tych świadczeń została oceniona przez powoda na kwotę 4.822.952,40 złotych i nie została potrącona z zaktualizowanej opłaty rocznej.
