RESUMO
Este trabalho monográfico versa sobre um controvertido dispositivo legal, cujo teor, porquanto dispõe sobre relevante matéria jurídica, foi tomado como objeto de reflexão por parte dos estudiosos que, propondo-se a investigar, compreender, explicar e aplicar o Direito Processual Civil, têm-lhe dirigido especial atenção: trata-se do artigo 475-J, caput, do CPC, inserido no ordenamento jurídico pela lei n.° 11.232/2005, em meio à denominada terceira etapa da reforma processual. Instaurada a polêmica doutrinária acerca do tema, concernente às diferentes (e antagônicas) interpretações dadas ao mencionado dispositivo, revela-se urgente a necessidade de uniformizar o entendimento que lhe é dirigido, uma vez que as interpretações díspares, naturalmente, transbordaram para o âmbito do Poder Judiciário, que tem proferido diferentes decisões a situações jurídicas idênticas — fato que implica na violação de uma garantia constitucional, qual seja, a segurança jurídica, que se consubstancia como um dos valores mais buscados por um Estado que se autodenomina “Estado de Direito Democrático”. Nesse diapasão, a presente monografia se propõe — sem a pretensão de apresentar a solução definitiva (tida, assim, como correta) à questão —, a procurar apreender, mediante o procedimento metodológico proposto nas linhas introdutórias, o conteúdo do novel artigo 475-J, caput, do CPC (que cuida da execução de sentença que determina o pagamento de quantia), para, destarte, perquirir a forma mais racional de se aplicar a norma jurídica em comento, considerando-se, dentre vários aspectos, a nova sistemática do Processo Civil, imposta pelas ondas reformistas que lhe tocam. Em suma: será apresentada uma proposta de interpretação ao polêmico dispositivo legal.

ABSTRACT
This monograph ponders over a controversial provision of law whose content, since it prescribes a relevant juridical matter, has been chosen as the object of study of many analysts. These have been drawing close attention to it by proposing to investigate, understand, explain and apply the Civil Procedural Law: it regards the main body of article 475-J of the Brazilian Civil Proceedings Code (CPC), comprised in law 11232/2005 of the legal system, amongst the so-called third stage of procedural reform. Having established the doctrinal polemic vis-à-vis the theme, which concerns diverse (and antagonistic) interpretations towards the above-mentioned provision, there is an urgent need to standardize the understanding attributed to it. This necessity is due to the fact that disparate interpretations have naturally fallen within the ambit of the Judiciary, which has reached different decisions on identical legal statuses. This fact implies the violation of the constitutional right to judicial security, which comprises one of the most paramount values sought by a State which entitles itself “Rule of Democratic Law”. Therefore, the present monograph is aimed at trying to grasp the content of the novel article 475-J, main body, of the Brazilian CPC (which addresses the execution of sentence that determines the payment of value), without the pretension to present the ultimate solution to the matter (thus, taken as correct). This will be done by means of the methodological procedure depicted in the introduction. To that end, this study will thoroughly investigate the most sensible way of applying the juridical law in question by taking into account, amongst various aspects, the new systematics of the Civil Action determined by the reformist waves surrounding the latter. To sum up, a proposal of interpretation towards the controversial provision of law is going to be presented.

Resumo
É reconhecida a importância da padronização e aprimoramento do processo de auto-aplicação de insulina, devido ao aumento do número de pessoas com DM em uso desta terapêutica nos últimos anos. Sabe-se que a eficácia do tratamento com a insulina depende de fatores pessoais, clínicos e do sistema de saúde, como também as intervenções em saúde devem ser propostas a partir do conhecimento das reais necessidades da população, desta maneira, o presente estudo objetivou analisar o processo da administração da insulina entre as pessoas com Diabetes Mellitus, cadastradas nas Equipes de Saúde da Família de um município do estado de Minas Gerais. Trata-se de um estudo transversal e descritivo. A coleta ocorreu de agosto a outubro de 2006, onde as 269 pessoas entrevistadas foram selecionadas por meio de uma amostragem aleatória simples, sendo que entre estas, 169(62,8%) pessoas fazem a auto-aplicação e 100 (37,2%) não fazem a auto-aplicação da insulina. Foi utilizada a entrevista estruturada para a coleta de dados dos dois grupos distintos, grupo A- auto-aplica e grupo B não auto-aplica a insulina. Na comparação entre os dois grupos, foi encontrada diferença estatisticamente significante para a variável escolaridade, porém não significante para as variáveis: faixa etária, sexo, tempo de diagnóstico e de tratamento com insulina. Em relação às pessoas que não se auto-aplicam, os motivos mais referidos foram os problemas motores, visuais ou cognitivos. Foi identificado que 90% necessitam de auxílio em todo o processo da administração da insulina no domicílio e 75% recebem auxílio de família. Os resultados referentes ao processo de administração da insulina entre as pessoas que auto-aplicam foram: 99,4% recebem seringas pelas ESFs, 89,4% fazem reutilização destas seringas, 83,4% descartam este instrumental no lixo comum, 100% utilizam a insulina NPH fornecida nas ESFs, 17,8% fazem alterações na dose da insulina por conta própria, 66,9% fazem um teste de glicemia no mês, 71,6% realizam o rodízio nos locais de aplicação de maneira não sistematizada, 81,7% guardam a insulina na porta da geladeira, 50,9% transportam a insulina em contato direto com o gelo, no caso de viagens, o escore porcentual de acertos foi 62% para a realização da técnica de preparo e aplicação da insulina, não tendo diferença estatisticamente significante entre as variáveis sócio-demográficas e clínicas, 81,1% não souberam informar o tempo de ação da insulina NPH, 36,1% aspiraram uma dose diferente à da referida,durante a prática de aspiração, sendo que entre estes foram encontradas associações estatisticamente significantes entre as variáveis: sexo e a faixa etária. Estes dados apontam aspectos positivos em relação à distribuição de seringas e da insulina NPH e lacunas de conhecimento para a realização desta prática, fato que pode dificultar o controle glicêmico e aumentar o risco para as complicações agudas e crônicas do DM e no local da aplicação da insulina. Traz também subsídios para o planejamento, organização e elaboração de estratégias prioritárias de assistência para esta clientela.

Abstract
The standardization and improvement of the process of self-administration of insulin is acknowledged due to an increase in the number of persons with diabetes mellitus (DM) who have been using this therapeutics over the last years. It is known that the efficacy of the treatment depends on personal and clinical factors, and the health system, but health interventions have to be proposed based on the real needs of the population as well. Therefore, this study aims at analyzing the process of insulin administration among persons with DM registered with the Equipes de Saúde da Família (ESF’s, or Family Health Teams) located in a town in the state of Minas Gerais. It concerns a transversal and descriptive study whose data were gathered from August to October, 2006. The 269 persons interviewed were selected by simple random sampling; among them, 169 (62.8%) persons self-administer insulin, while 100 (37.2%) do not self-administer it. A structured interview was carried out so as to gather data about two different groups: group A self-administers insulin and group B does not self-administer it. When comparing both groups, a statistically significant difference in the education variable was noticed. However, it was not significant for the variables age group, gender, diagnosis time and treatment time with insulin. Regarding the persons who do not self-administer insulin, the most common reasons were motor, visual or cognitive impairments. It was found out that 90% need help in the entire process of insulin administration at home and 75% are helped by the family. These were the outcomes concerning the insulin administration process among persons who self-administer it: 99.4% receive syringes from ESF’s; 89.4% reuse these syringes; 83.4% discard them in common garbage; 100% use the NPH insulin provided by ESF’s; 17.8% change the insulin dose themselves; 66.9% undergo a monthly blood glucose test; 71.6% go to various administration places in a non-systematized way; 81.7% keep the insulin on the refrigerator door; 50.9% carry the insulin in direct contact with ice when they travel; 62% could correctly apply the insulin preparation and administration techniques, statistically significant difference not being observed between the socio-demographic and clinical variables; 81.1% could not inform the NPH insulin action time; and during the infusion practice, 36.1% filled the syringe with a dose different from the one prescribed, statistically significant associations between the variables gender and age group being noticed. Such data indicate positive aspects regarding the distribution of syringes and NPH insulin, but lack of knowledge regarding how to follow the infusion practice. The latter may hinder the control of blood glucose level, and may also raise the risk of acute and chronic complications of DM and the risk of reactions at the insulin injection site. Furthermore, these data provide aid for the planning, organization and elaboration of overriding assistance strategies for these patients.
