6. This section of the report on Anti-spam Regulation covers fundamental policy questions that need to be answered before designing anti-spam regulation:
• What activities or artefacts will be covered by the anti-spam policy?
• Will the policy cover a range of technologies, or one, or will it attempt to be technology neutral?
• What outcomes should be achieved by the anti-spam policy?
• What outcomes should be avoided by the anti-spam policy?
1. Spam – what is it?
Introduction
7. The term “spam” is commonly used in the international media and in policy announcements made by different countries, however there is no commonly held definition of the term. Although broadly referring to the same phenomena, different countries define spam in a manner that is most relevant to their local environment. In developing an anti-spam policy, it is essential that the nature of spam be clearly understood and defined, and that spamming be differentiated from legitimate practice.
Purpose of this chapter
8. This chapter provides an overview of the taxonomy of spam – those attributes that differentiate spam messages from legitimate messages. Countries wishing to develop anti-spam policy should identify which aspects of spam have relevance to their local political, cultural, legal and economic environment. In order to ensure an effective regulatory regime, they should endeavour to ensure that these aspects are capable of being objectively appraised through the consideration of physical and electronic evidence.

1. Qu’est-ce que le spam ?
Introduction

Si un jour tu décides de fuir;
Si un jour tu n’as envie
Viens vite me rencontrer,
J’aurais peut-être besoin de toi...
