Employee Handbook
Welcome to XXXXXXXXXXXXXXXX Services, Inc. This handbook will help explain what you can expect from XXXXXXXXXXXXXXXX Services, Inc. and what XXXXXXXXXXXXXXXX Services, Inc. expects from you. The handbook contains a summary of many of XXXXXXXXXXXXXXXX Service’s employment practices. It is not intended to be a contract or to include any contract terms. Neither the contents of this handbook nor any verbal statements should be considered as an assurance of continued employment. Any employee may be terminated at any time, with or without cause. XXXXXXXXXXXXXXXX Services, Inc. reserves the right to change, add to, or cancel any of these policies at its sole and absolute discretion and without notice to employees. Please read this handbook carefully.

Employee Status
Probationary Employee: The first thirty (30) days of employment with XXXXXXXXXXXXXXXX Services, Inc. are considered a period of training and adjustment. At the end of the thirty (30) day period, the supervisor will review the employee’s performance with the employee. If the employee satisfactorily completes the probationary period, he/she will be eligible for full-time or part-time status.
Full-Time Employee: After completion of the probationary period, an employee may be eligible for full-time status. An employee is considered a full-time employee when he/she has satisfactorily completed the probationary period and is scheduled to work 36 hours or more hours on a consistent basis. Full-time employees are eligible for all XXXXXXXXXXXXXXXX Services, Inc.'s benefits.
Part-Time Employee: After completion of the probationary period, an employee may be eligible for part-time status. An employee is considered a part-time employee when he/she has satisfactorily completed the probationary period and is scheduled to work fewer than 36 hours per week. Part-time employees are eligible for XXXXXXXXXXXXXXXX Services, Inc.'s safety equipment programs but are not eligible for any paid time off or health benefits.
Immigration Law
The U.S. Immigration Law requires that any employee hired after November 6, 1986 be subject to a document inspection process. This process applies to both U.S. citizens and non-citizens. The verification process must take place within three business days of hiring. New employees must present documents to prove their identity and employment eligibility and XXXXXXXXXXXXXXXX Services, Inc. must physically examine this evidence. The employee and XXXXXXXXXXXXXXXX Services, Inc. must complete the required Employment Eligibility Verification (I-9) form, which is maintained for government inspection.
Hours of Work
All full-time employees are scheduled to work at least eight hours per day, at least forty hours per week.
The regular work week for plant employees is Monday through Friday. There may be some variation in the daily and weekly schedule depending upon the specific job classification. For plant payroll purposes, the work week begins on a Sunday and ends on the following Saturday.
The hours of work at 3301 West 48th Place are: First shift, 6:30AM -
3:00 PM, second shift, 2:45 PM to 11:15 PM, third shift 10:15PM – 6:15 AM.
Administrative employees at 3301 West 47th Place are scheduled to work Monday through Friday, 8:00 a.m. - 4:30 p.m. There may be some variation in the daily and weekly schedule depending upon the specific job classification.
Time Cards
All non-exempt (hourly) employees are required to record their hours on a time card using the time clock provided. Under no circumstances is an employee to punch another employee's time card. Violation of this rule may result in immediate dismissal.
Lunch and Break
During an regular eight hour shift, all non-exempt (hourly) employees receive a one half-hour unpaid lunch break and one paid fifteen minute break taken determined by their supervisor.
All salaried employees receive a one-half hour unpaid lunch break.
Overtime
XXXXXXXXXXXXXXXX Services, Inc. expects employees to work overtime when it is required. It is understood that situations may occasionally arise that will prevent an employee from working overtime, but it is important that overtime work is considered by employees as a part of the job.
Non-exempt employees are paid for overtime hours based on the following schedule:
1. For all hours worked in excess of the forty-hour base, employees will be paid at the rate of time and one-half. Hours worked do not include holidays, vacation or sick time.
2. To receive the time and one-half rate for work on Saturdays and Sundays, an employee must have worked a forty-hour week.
Exempt employees are not paid for working more than 40 hours.
Performance Appraisal
The performance of each employee is reviewed after the probationary period, after the first six months of employment and thereafter once each year. Performance appraisals are considered in making salary decisions, but the results of the review will not necessarily result in a merit increase.
For non exempt plant employees, there is a review after the thirty(30) day probationary period, and then every December. Performance appraisals are considered in making salary decisions, but the results of the review will not necessarily result in a merit increase.
Uniform Policy
XXXXXXXXXXXXXXXX Services, Inc. currently provides all non-office employees with uniforms, which include eleven shirts and eleven pairs of pants. Employees will be measured for uniforms after their one-month probationary period. Employees are expected to report for work attired in the uniform. Employees are not to report for work wearing clothes other than the uniform provided. Uniforms are to be turned in every Friday for cleaning. Clean uniforms are provided every week. Uniform jackets are also available to rent. There is a weekly charge, and it will be deducted from the employees paycheck.
A deposit for the uniforms will be deducted from the employee’s first paychecks after the probationary period. This deposit reflects less than half of the actual cost for the uniforms. These uniforms are considered to be the property of XXXXXXXXXXXXXXXX Services, Inc. and upon terminating employment with XXXXXXXXXXXXXXXX Services, Inc.; employees must return all uniform pants and shirts. An employee’s final check will have the deduction for any unreturned uniforms, and the deposit will held until all uniforms are returned to XXXXXXXXXXXXXXXX Services, Inc. Employees are held responsible for keeping track of all their uniforms, report any problems concerning the uniforms and are ultimately responsible for any lost uniforms.
Safety Equipment
All plant employees are expected to report for work wearing steel toed shoes or boots. Upon presentation of a receipt for the shoes to XXXXXXXXXXXXXXXX Services, Inc., XXXXXXXXXXXXXXXX Services, Inc. will reimburse workers for the cost of the safety shoes. These shoes are to be worn only for work at XXXXXXXXXXXXXXXX Services, Inc. XXXXXXXXXXXXXXXX Services, Inc. may provide employees with a new pair of safety shoes every year provided new shoes are needed. The year is defined as that year following the purchase date, as indicated on the receipt, of the safety shoes.
XXXXXXXXXXXXXXXX Services, Inc. is concerned about the safety of its employees. XXXXXXXXXXXXXXXX Services, Inc. supplies safety gloves to all non-office employees. Gloves are issued to each worker and the date of the issuance is recorded for each worker. A replacement pair of gloves will be issued to a worker only if the worker presents the gloves most recently issued to establish these gloves should be replaced. Employees must turn in worn gloves to get a replacement pair. If a worker looses the gloves, he/she must replace the gloves at his/her own cost. If the worker refuses to replace the gloves at his/her own cost and chooses to return to work without gloves, the worker will be dismissed until the worker replaces the gloves.
Equipment to protect employees' hearing is also available and must be worn in designated areas as requested by one’s supervisor.
Eye protection will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn at all times when the employee is working in the plant.
Dust protection will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn by all employees who are working in a high dust area when requested by their supervisor.
Hard hats will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn at all times when the employee is working in the plant.
XXXXXXXXXXXXXXXX Services, Inc. expects workers to assume responsibility for preventing the loss of their safety equipment.
All XXXXXXXXXXXXXXXX Services, Inc. employees are required to report all injuries on the job, even very minor injuries (example: scraping a knee). Accident and/or incident reports will be completed as requested by OSHA.
Only Licensed drivers are to be handling motorized equipment.

Insurance Benefits
XXXXXXXXXXXXXXXX Services, Inc. offers a group health care plan. Benefits of that plan are available with the human resource department.
Holidays
All full-time employees are eligible to receive full-pay for the following six holidays:
New Year's Day Labor Day
Memorial Day Thanksgiving Day
Independence Day Christmas Day
When a holiday falls on a Saturday or Sunday, if an employee has worked the regular forty hours during the preceding week, an employee will be paid for eight holiday hours in addition to the regular forty hours. Excused sick hours are included in the regular hours worked for this case only.
To be paid for a holiday, an employee must work the scheduled day before the holiday and the scheduled day after the holiday.
Vacation days can be used in conjunction with holidays.
Vacation
XXXXXXXXXXXXXXXX Services, Inc. provides vacation time, with pay, to all regular full-time employees. After one year of continuous service, and employee is eligible for one week of vacation. After two years of employment, an employee is eligible for two weeks of vacation. After five years of employment, an employee is eligible for three weeks of vacation. After ten years of employment, an employee is eligible for four weeks of vacation.
On an employee’s anniversary of employment, he/she can carry no more than one week of vacation pay into the following year.
Employees should give their supervisor notice of his/her vacation dates as soon as possible with a minimum of one month’s advance notice. Preferences for vacation periods will be based upon length of service, current workloads and fairness to the other employees in their department.
If a paid holiday falls within the vacation period, the employee will not be charged for a vacation day for the holiday.
Absence and Tardiness
Absence from work is defined as failure to report for and remain at work as scheduled. Absence includes all time lost from the job whether excused or unexcused, avoidable or unavoidable. Unexcused absence is a failure by the employee to notify their supervisor before their scheduled work time.
Tardiness is defined as the employee's failure to report for work at the scheduled starting time and be present at his/her appointed workstation (see hours of work). Repeated tardiness, three times within a rolling twelve-month period (a time period that begins with the first occurrence of tardiness) is considered grounds for disciplinary action up to and including immediate termination.
If an employee has an unexcused absence from work, the employee will not be paid for the time off. Repeated unexcused absences are considered grounds for disciplinary action up to and including immediate termination.
When an employee cannot report for work at the beginning of his/her shift, the employee must contact his/her supervisor prior to one hour of their shift or no later than within fifteen minutes of his/her starting time. The employee must speak directly to his/her supervisor or acting supervisor (if the supervisor is absent). Voice mail messages are considered unacceptable, and family members calling in absences are also considered unacceptable. An employee must inform the supervisor that he/she is not reporting for work that day or is going to be tardy, the reason he/she is not reporting for work or is going to be tardy, and when he/she expects to return to or arrive at work.
If an employee has an unexcused absence for three consecutive days without notifying the supervisor, the individual's employment will be terminated. This termination will be considered voluntary on the employee's part and will be considered job abandonment.
Sick/Personal Days
The purpose of sick time is to protect the employee from loss of earnings because of short-term illness or injury and, therefore, should not be used for purposes other than those outlined in this handbook.
After successful completion of the initial 30-day probationary period, employees get five paid sick days per year. Sick days are paid at the employee’s regular straight time rate of pay. If employment with XXXXXXXXXXXXXXXX Services, Inc. is terminated for any reason, unused sick days will not be paid out to the employee.
It is the intention of the Company that these days be used for those sometimes unavoidable circumstances which do not permit an employee to come to work, such as: (1) employee’s sickness, (2) a sickness in the family, (3) car breakdown, (4) personal business, etc. The employee is paid at his or her regular rate for these days used. While these days are allowed for any reason, the use of these days is subject to notification to the company. Emergency Use: When an employee is sick or has an emergency, the employee’s supervisor must be notified one hour before the shift or no later than within the first fifteen minutes of his/her scheduled start time. If the employee is too ill, and notification cannot be made by the designated notification period, notification must be made as soon as possible. Non-Emergency Use: When using these days for personal reasons, such as personal business or vacation, the employee must request and receive approval from his or her supervisor as far in advance as possible.
Compassionate Leave
Upon completion of the initial probationary period, employees may be allowed up to three consecutive workdays with pay in the event of death in his/her family. Immediate family is designated as your spouse, child, parent, brother, sister, mother-in-law, father-in-law, grandparents, brother or sister of employee’s parents. For other relatives, compassionate leave will be determined by the employee’s supervisor.
Family and Medical Leave
XXXXXXXXXXXXXXXX SERVICES, INC. will grant family and medical leave for reasons specified by the federal Family and Medical Leave Act (FMLA) for up to twelve work weeks in a twelve-month period.
Eligibility
An employee must have been employed by the Company for at least one year (twelve months) and have worked at least 1,250 hours during that year to be eligible for Family or Medical Leave.
Qualifying Reasons for Family and Medical Leave
Qualifying reasons for requesting this leave include the following:
a) the birth of a child of the employee
b) the adoption of a child or the placement of a foster child with the employee;
c) to care for a sick spouse, child or parent if the individual has a serious health condition; or
d) an employee’s own serious health condition.
An employee’s serious health condition that involves:
the need for in-patient care in a hospital, hospice or residential medical care facility.
continuing treatment by a health care provider, or
an employee’s chronic condition causing him or her to be medically unable to perform his or her work duties, or
maternity causing an employee to be medically unable to perform her assigned work duties.
Process for applying for Family and Medical Leave
If the family and medical leave is foreseeable, the employee needs to provide at least thirty days notice. However, if the employee cannot reasonably give thirty days notice for the requested leave, the employee should provide notice as soon as possible.
Requests for family and medical leave must be made in writing using the Family and Medical Leave Request Form that can be obtained from the Human Resources Office.
Proof or “certification” of the necessity of the leave, if the leave is due to the illness or injury of an employee, or if the employee requests the leave to care for an ill family member, will be required in accordance with applicable law.
If the leave request meets the qualifications for such a leave under the Family and Medical Leave Act, and the leave is granted, the Company will require recertification of the continued need for leave every 3 weeks while the employee remains on leave.
If the Company finds reason to doubt the validity of the certification, it may require, at its own expense, a second medical opinion from a health care provider approved by the Company, but not regularly employed by the Company.
Conditions of Family and Medical Leave
If the leave is taken for the birth of an employee’s child, or the placement with the employee of a child for adoption or foster care, leave must be taken within one month after the birth or placement of the child.
Family and Medical Leave is unpaid leave. Although the Company will not require the use of vacation or sick leave by the employee, the employee may choose to use their annual allotment of leave during the Family and Medical Leave period.
The Company will continue to pay it’s contribution to group health benefits during an approved Family and Medical Leave. If an employee has a portion to the health care plan that they are responsible for, it is important that the employee continue to pay their portion of their medical premium during this leave. Payment is due the first of each month. If your payment is late, XXXXXXXXXXXXXXXX Services will send you a notice. Fifteen days before 30 days is elapsed, XXXXXXXXXXXXXXXX Services will send you a notice stating your medical coverage will be lost is you do not make payment before 30 days has elapsed since your payment was due.
At the end of Family and Medical Leave, the employee will be returned to the position the employee held when the leave was granted or will be given an equivalent position with like employment benefits, pay and other terms and conditions of employment.
If the employee does not return to work at the expiration of Family and Medical Leave, the Company will require the repayment of health insurance premiums it paid on the employee’s behalf during the leave period. Reimbursement will not be required if the employee does not return from leave because of the continuance, reoccurrence, or onset of a serious health condition that prevents the employee from performing the employee’s job.
When Family and Medical Leave and medical leave under Worker’s Compensation coincide, if Worker’s Compensation allows you to return to work under “light duty” conditions, and a light duty job is available, you may refuse to return if a doctor will not certify that you are able to return to work under the Family and Medical Leave rules. However, should you refuse to take a light duty job made available to you, you may lose your Worker’s Compensation benefits.
Personal Leave
Any non-medical reason for extended time off is considered personal leave and must be approved by the management of XXXXXXXXXXXXXXXX Services, Inc. Personal leave will be limited to four weeks. Personal leave is without compensation and employment is not guaranteed.
Jury Duty
Whenever an employee is required to serve as a juror during the regular working hours, the employee must sign over the endorsed jury voucher to XXXXXXXXXXXXXXXX Services, Inc. in order to receive regular pay. Non-exempt employees are eligible for up to two weeks of their regular pay minus the jury pay per Illinois state law. Exempt employees are paid their normal salary minus the jury pay per Illinois state law.
Military Duty
If an employee is a member of the reserve, he/she must give at least 30 days notice of weekend drills, and annual training weeks. The employee will be permitted to return to the same position, rate of pay, and accrued vacation time. There will be no compensation for the time spent away from the job.
Outside Employment
It must be realized that employment with XXXXXXXXXXXXXXXX Services, Inc. is the employee's primary responsibility. Outside employment will not be considered an excuse for poor performance, absenteeism, tardiness or refusal to work overtime. Should the outside employment cause or contribute to any of these situations, the outside employment must be discussed with XXXXXXXXXXXXXXXX Services, Inc. management.
Confidentiality
XXXXXXXXXXXXXXXX Services, Inc. tries to protect each employee’s confidentiality. Supervisors are instructed not to give out any information about an employee and to refer phone calls seeking such information to the personnel office. In return, we expect employees to protect the company’s confidences as well. Employees are not permitted to share any information about the company with any non- employee. Employees must hold confidential all information about the company--including names of company customers-and report to the personnel office inquires from anyone concerning the company’s business.
Substance Use and Abuse
The use and abuse of alcohol and drugs on the job poses a serious threat to both fellow workers and XXXXXXXXXXXXXXXX Services, Inc.
The possession, use or sale of alcohol, unauthorized or illegal drugs or any misuse of any legal drugs on XXXXXXXXXXXXXXXX Services, Inc.'s premises or while on company business is prohibited and is grounds for immediate termination.
All plant employees are required to take a drug test before starting their employment, and if the drug test is failed employment will be denied.
If there is reason for a supervisor to suspect that an employee is under the influence of drugs or alcohol which impairs judgment, performance or behavior while on XXXXXXXXXXXXXXXX Services, Inc.'s premises or while on company business, the employee will be asked to take a drug or alcohol test. If they fail the test or refuse to take on, XXXXXXXXXXXXXXXX Services, Inc. will consider this grounds for immediate termination.
To maintain a plant free of drugs and weapons, XXXXXXXXXXXXXXXX Services, Inc. reserves the right to search any employee entering the plant and to search equipment and storage areas. In addition to pre-employment drug testing, XXXXXXXXXXXXXXXX Services, Inc. reserves the right to randomly test for alcohol or drugs.
Each employee is responsible for promptly reporting to XXXXXXXXXXXXXXXX Services, Inc.’s management any use of prescribed medication, which may affect the employee’s judgment, performance or behavior.
No Solicitation
Solicitation by an employee of another employee is prohibited during the workday, while either the person doing the soliciting or the person being solicited are required to do his or her work tasks. Distribution of advertising material, handbills or other literature on company property is prohibited at any time. Employees are not permitted access to the plant or other working areas during their off duty hours.
Use and Care of Vehicles
Any employee who operates a commercially licensed vehicle (truck) owned or controlled by XXXXXXXXXXXXXXXX Services, Inc. must possess a valid CDL license.
Each employee who operates or has supervision over the operation of any Company vehicle, has the responsibility for:
a. the vehicle.
b. safety of cargo and/or passengers.
c. physical hazards.
d. security vehicles.
e. reporting accidents.
g. defensive driving.
The employee is responsible for all personal property left in any Company vehicle.
If an employee is driving a licensed vehicle and is involved in an accident, the employee must immediately contact the police department and report the accident. After contacting the police, the employee must then contact XXXXXXXXXXXXXXXX Services, Inc. and report the accident to Company management. All accidents, thefts, vandalism and damage to a vehicle must be reported to Company management.
If an employee hits a parked car or stationary object or obstacle, the employee must immediately report this to the police and try to locate the owner of the vehicle or object. If the employee cannot locate the owner, he/she must leave a note in a conspicuous place listing his/her name and address, the Company name and a brief description of the accident.
An employee who fails to report any accident involving a Company vehicle may have his/her employment immediately terminated.
Employees who have a second accident, for which they are at fault, within a six-month period, are considered accident repeaters. Accident repeaters are subject to either a warning letter or immediate termination, depending on the severity of the accidents.
Use and Care of Equipment
Employees are expected to exercise extreme care in the use of XXXXXXXXXXXXXXXX Services, Inc.'s property and to use this property only for authorized purposes. Negligence in the care and use of XXXXXXXXXXXXXXXX Services, Inc.'s property will be considered cause for termination.
Unauthorized removal of XXXXXXXXXXXXXXXX Services, Inc.'s property from the premises or its conversion to personal use will be considered cause for immediate termination and prosecution.
Any employee who is proven to have knowledge of a theft or vandalism of XXXXXXXXXXXXXXXX Services, Inc.'s property and who does not report it to the management of XXXXXXXXXXXXXXXX Services, Inc. will be terminated.
Any damage to equipment by an employee will be documented and placed in the employee personnel file. This will be taken into consideration during reviews.
Disciplinary Process
The primary purpose of the disciplinary system is to correct improper behavior.
When an employee violates a XXXXXXXXXXXXXXXX Services, Inc.'s rule or policy, the supervisor may follow this process:
First violation: Verbal documented warning.
Second Violation: A formal written warning of the offense, and at the supervisor’s discretion up to three days suspension without pay.
Third violation: The employee will be discharged from employment at XXXXXXXXXXXXXXXX Services, Inc.
An employee can be discharged at any time, without regard to the preceding steps, if he/she commits an offense, which in the supervisor’s judgment would be contrary to the well being of XXXXXXXXXXXXXXXX Services, Inc. or any of its employees
The management of XXXXXXXXXXXXXXXX Services, Inc. must approve every discharge.
Dispute Resolution
XXXXXXXXXXXXXXXX Services Inc maintains an open door policy. Employees who have complaints or disagreements regarding employment or work matters are encouraged to try to resolve these problems by discussing them with their supervisor or one of the company owners if there is a conflict with their supervisor. An employee who has a work-related problem should report that problem to his/her supervisor. There should be no fear of retaliation at any stage of the process. The supervisor should try to reach a solution through a thorough discussion of the problem with the employee.
This program is intended to provide a forum where complaints can be resolved fairly, consistently, and in a constructive manner. This policy supplements, and does not replace, any other policies that might pertain to the problem.
Harassment Statement
We believe that mutual respect is an essential characteristic of a productive workplace. For that reason, XXXXXXXXXXXXXXXX Services prohibits all forms of illegal harassment of employees by managers, fellow employees, employees of outside vendors or visitors. Any form of harassment related to an employee’s race, color, sex, religion, national origin, perceived or actual disability, marital status, or veteran’s status is a violation of this policy, and will be treated as a disciplinary matter.
For these purposes, the term “harassment” includes, but is not limited to, slurs, jokes, or other verbal, graphic or physical conduct relating to an individual’s race, color, sex, religion, national origin, age, perceived or actual disability, or marital or veteran status.
Harassment also includes unwelcome sexual advances, requests for sexual favors, and other verbal, graphic, or physical conduct of a sexual nature.
A failure to uphold XXXXXXXXXXXXXXXX Services, Inc.’s commitment to create a harassment-free workplace will result in disciplinary action, up to and including termination.
Employees’ Role in Maintaining a Harassment-Free Work Environment
Every employee must share the responsibility with senior management in maintaining harassment –free work environment. If you feel you are being harassed, or witness the harassment of another employee, by a supervisor, another employee, a vendor, or a visitor because of race, color, sex, religion, national origin, age, perceived or actual disability, or marital or veteran’s status, first let the harassing person know of your objections, if possible. If you find it difficult to do so, or your objections do not produce results, you should report the problem as soon as possible to one of the owners.
Retaliation Is Prohibited
XXXXXXXXXXXXXXXX Services, Inc. prohibits retaliation against any employee who rejects, protests or complains about harassment. If you feel you have been subject to retaliation, please contact your supervisor or one of the owners as soon as possible.
Smoking Policy
It is the policy of XXXXXXXXXXXXXXXX Services, Inc. that smoking is unacceptable anywhere on the premises except in the two designated smoking areas listed below. The designated smoking areas are as follows:
1. Outside of the 3259 building by the doorway where the ash urn has been attached to the building.
2. Outside of the 3301 building by the doorway where the ash urn has been attached to the building.
Anyone caught smoking in any other area will be subject to immediate termination.
Software and Internet Policy
At XXXXXXXXXXXXXXXX Services, computers and the software that run on them are important business tools. All employees need to help us maintain the integrity of these systems by complying with the following rules:
1. Employees should not load or download any “plug-ins, add-ons or software onto any computer owned by the company, unless specifically approved by the computer manager or company owner.
2. The Internet is a business tool, and should only be used for business-related purposes.
3. No employee should have any expectation of privacy as to his or her intro or internet use, and XXXXXXXXXXXXXXXX Services, Inc. reserves the right to monitor and record all internet usage.
4. No employee may use company computers to knowingly download or distribute pirated software or data, to deliberately propagate any virus, worm, Trojan hours or trap-door program code, knowingly to dial or overload any computer system or network, or to circumvent any system intended to protect the privacy or security of another user.
5. The display of any kind of sexually explicit image or document on any company system is a violation of XXXXXXXXXXXXXXXX Services’ harassment policy. No sexually explicit information is to be archived, stored, distributed, edited or recorded using the XXXXXXXXXXXXXXXX Services, Inc.’s network or computing resources.
6. Company computing resource must never be used to violate the laws and regulations of the United States or any other nations, or the laws if any state, city, province or other local jurisdiction.
Violating any of the rules listed above may be grounds for disciplinary action up to and including termination.

Bienvenidos a XXXXXXXXXX Services, Inc. Este manual le explicará lo que usted puede esperar de nuestra Compañía y también lo que XXXXXXXXXX Services, Inc., espera de usted. Condición de Empleo
Empleado a prueba: Los primeros treinta (30) días de empleo con XXXXXXXXXX Services, Inc., se consideran como un período del entrenamiento y de ajuste. Al final de los 30 días, el supervisor y el empleado evaluarán su funcionamiento. Si el empleado termina satisfactoriamente el período de prueba, el empleado podrá ser elegible para ocupar un puesto de tiempo completo o de medio tiempo.
Empleado de tiempo completo: Después de la terminación del período de prueba, un empleado podrá ser elegible para ocupar un puesto de tiempo completo. Un empleado de tiempo completo es considerado como la persona que terminó satisfactoriamente el período de prueba y que está programado para trabajar 36 horas o más por semana de una manera constante. Los empleados de tiempo completo tienen derecho a recibir los beneficios que ofrece XXXXXXXXXX Services, Inc.
Empleado de medio tiempo: Al terminar el período de prueba, un empleado podrá ser elegible para ser empleado de medio tiempo. Un empleado de medio tiempo es considerado como la persona que terminó satisfactoriamente el período de prueba y que está programado para trabajar menos de 36 horas por semana. Los empleados de medio tiempo tienen derecho a los programas de seguridad que ofrece XXXXXXXXXX Services, Inc., pero no tienen derecho a recibir sueldo por tiempo no trabajado ni los beneficios de salud.
Leyes de Inmigración
Las leyes de inmigración de los Estados Unidos piden que sean revisados los documentos de toda persona que sea contratada después del 6 de noviembre de 1986. Este proceso de revisión de documentos se les tiene que hacer tanto a las personas que son ciudadanos de Estados Unidos como a los que no lo son. La revisión deberá ocurrir dentro de tres días laborales después de que la persona empiece a trabajar. Los nuevos empleados deben presentarle a XXXXXXXXXX Services, Inc., documentos que comprueben su identidad y su elegibilidad para el empleo. XXXXXXXXXX Services, Inc., tiene que examinar físicamente la evidencia proporcionada. Después, tanto el empleado como XXXXXXXXXX Services, Inc., deberán llenar la forma (I-9), que es la forma de verificación de elegibilidad para el empleo “Employment Eligibility Verification” que se mantendrá en las oficinas para inspección por el Gobierno.
Horarios de Trabajo
Todos los empleados de tiempo completo están programados para trabajar por lo menos ocho horas por día, y al menos cuarenta horas por semana.
La semana normal de trabajo para los empleados de la planta es de lunes a viernes. Puede haber una cierta variación en la programación diaria y semanal dependiendo de la clasificación específica del puesto. Para los propósitos de la nómina de pago de la planta, la semana del trabajo comienza el domingo y termina el sábado siguiente.
Las horas del trabajo en la planta de 3301 West 48th Place son:
Primer turno 6:30 A.M. - 3:00 P.M.
Segundo turno 2:45 P.M. - 11:15 P.M.
Tercer turno 10:15 P.M. - 6:15 A.M.
Los empleados administrativos de las oficinas de 3301 West 48th Place, están programados para trabajar de lunes a viernes de 8:00 A.M. - 4:30 P.M. Puede haber cierta variación en el horario diario y semanal dependiendo de la clasificación específica del puesto.
Tarjetas de tiempo
Todos los empleados de medio tiempo (de pago por hora) deben de registrar sus horas en una tarjeta usando el reloj de tiempo proporcionado. Bajo ninguna circunstancia se permitirá que un empleado perfore la tarjeta de tiempo de otro empleado. La violación a esta regla puede dar lugar al despido inmediato.
Almuerzo y Período de Descanso
Durante una jornada regular de ocho horas, los empleados de medio tiempo (de pago por hora) recibirán media hora no pagada para su almuerzo y un período de descanso de 15 minutos con pago fijado por el supervisor.
Todos los empleados de tiempo completo (a sueldo) recibirán media hora no pagada para su almuerzo.
Horas Extras
XXXXXXXXXX Services, Inc., espera que los empleados trabajen horas extras cuando se les requiera. Se entiende que puede haber situaciones que hagan que un empleado no pueda trabajar horas extras, pero es importante que los empleados consideren las horas extras como parte posible de su trabajo.
A los empleados de medio tiempo, las horas extras se pagarán de acuerdo a lo siguiente:
1. Las horas de trabajo que excedan la base de 40 horas, serán pagados a tiempo y medio. Las horas trabajadas no incluyen días festivos, vacaciones o tiempo de enfermedad.
2. Para que un empleado pueda recibir el pago de tiempo y medio para trabajar los sábados y los domingos, el empleado deberá haber ya trabajado una semana de 40 horas.
A los empleados de tiempo completo no se les pagará por trabajar más de 40 horas.
Evaluación del Desempeño en el Trabajo
El desempeño de cada empleado en su trabajo se evalúa después del período de prueba, se evalúa otra vez después de los primeros seis meses de empleo y después una vez cada año. Las evaluaciones se utilizan para tomar decisiones en cuanto al sueldo, pero los resultados de la evaluación no necesariamente darán lugar a un aumento del sueldo.
Los empleados de medio tiempo que trabajen en la planta, son evaluados después de los 30 días del período de prueba, después se les evalúa cada diciembre. Las evaluaciones se utilizan para tomar decisiones en cuanto al sueldo, pero los resultados de la evaluación no necesariamente darán lugar a un aumento del sueldo.
Política del Uniforme
XXXXXXXXXX Services, Inc., actualmente les da a todos los empleados que no sean de oficina, uniformes. El paquete de uniformes consiste en once camisas y once pares de pantalones. Después del período de prueba de un mes, a los empleados se les medirá para darles sus uniformes. Se espera que los empleados siempre lleguen a trabajar vistiendo su uniforme. Los empleados no deben llegar a trabajar con ropa que no sea el uniforme proporcionado. Los uniformes deben ser entregados cada viernes para su lavado. Cada semana se les proporcionarán uniformes limpios a los empleados. Hay chaquetas de uniformes disponibles que se les rentan. Si el empleado quiere rentar una chamarra se le hará un cobro semanal por la renta que se cargará a su pago semanal.
Por los uniformes se cobrará un depósito que será deducido de los primeros cheques de sueldo del empleado después del período de prueba. Este depósito representa menos de la mitad del costo verdadero de los uniformes. Los uniformes seguirán siendo propiedad de XXXXXXXXXX Services, Inc., y al terminar el empleo con XXXXXXXXXX Services, Inc.; los empleados deben devolver todos los uniformes. El cheque final de un empleado que sale de la compañía tendrá una deducción por todos los uniformes que no haya entregado, y el depósito se mantendrá hasta que todos los uniformes se le devuelvan a XXXXXXXXXX Services, Inc. Los empleados son responsables de saber donde están sus uniformes, y de reportar todo tipo de problemas que existan con ellos y también son responsables por los uniformes perdidos.
Equipo de seguridad
Todos los empleados de la planta deben de venir a trabajar calzando botas o zapatos de seguridad con punta de acero. A la presentación del recibo del calzado de seguridad a XXXXXXXXXX Services, Inc., XXXXXXXXXX Services, Inc., reembolsara a los trabajadores el costo del calzado de seguridad. Estos zapatos deben usarse únicamente para el trabajo que realicen en XXXXXXXXXX Services, Inc. XXXXXXXXXX Services, Inc., puede dar a los empleados un nuevo par de zapatos de seguridad cada año si fuera necesario. El año se define como el año siguiente a la fecha de compra según lo indique el recibo de los zapatos de seguridad.
XXXXXXXXXX Services, Inc. se preocupa por la seguridad de sus empleados. XXXXXXXXXX Services, Inc., les da guantes de seguridad a todos sus empleados que no sean de la oficina. Los guantes se le dan a cada trabajador y la fecha en que la que se le dan se registra para cada persona. Solamente se pueden dar guantes nuevos si el empleado presenta los guantes anteriores y comprobar que es necesario cambiarlos. El trabajador debe presentar los guantes gastados para conseguir un par nuevo. Si un trabajador pierde sus guantes, deberá conseguir unos a su propio costo. Si el trabajador no quiere reemplazar sus guantes pagándolos, y elige volver al trabajo sin ellos, el trabajador quedará suspendido y no podrá trabajar hasta que reemplace los guantes.
También hay equipo disponible para la protección de los oídos y que se debe usar en áreas señaladas a solicitud del supervisor.
XXXXXXXXXX Services, Inc., da equipo para la protección de los ojos, y debe usarse siempre que el empleado esté trabajando en la planta.
XXXXXXXXXX Services, Inc., proporciona protección contra el polvo que debe ser usado por todos los empleados que estén trabajando en un área alta en polvo cuando así lo solicite su supervisor.
XXXXXXXXXX Services, Inc., da cascos protectores de cabeza que deben usarse siempre que el empleado esté trabajando en la planta.
XXXXXXXXXX Services, Inc., espera que los trabajadores sean responsables y eviten la pérdida de su equipo de seguridad.
XXXXXXXXXX Services, Inc., requiere que todos los empleados den aviso de todas las lesiones que ocurran en el trabajo, incluso las lesiones que sean de menor importancia (ejemplo: el raspando de una rodilla). Los reportes del accidente o el incidente serán tramitados como lo solicita la OSHA (La Administración de Seguridad y Salud en el Trabajo).
Solamente los conductores con licencia podrán manejar el equipo motorizado.

XXXXXXXXXX Services, Inc., ofrece un plan de seguro médico. Los beneficios que ofrece nuestro plan los puede ver con nuestro departamento de recursos humanos.
Días Festivos
Se les pagarán a todos los empleados de tiempo completo los seis días festivos siguientes:

Día de la Independencia Día de Navidad
Cuando un día de fiesta cae en sábado o domingo, si un empleado ha trabajado las 40 horas regulares durante la semana anterior, al empleado le serán pagadas ocho horas del día de fiesta además de las 40 horas regulares. Las horas de enfermedad justificadas se incluirán en las horas regulares trabajadas solamente para este caso.
Para que un día de fiesta le sea pagado a un empleado, el empleado debe trabajar el día regular anterior al día festivo y el día regular después del día festivo.
Los días de vacaciones se pueden utilizar conjuntamente con los días de fiesta.
Vacaciones
XXXXXXXXXX Services, Inc., le da tiempo de vacaciones pagadas a todos los empleados regulares de tiempo completo. Después de un año de servicio continuo, un empleado puede tomar una semana de vacaciones. Después de dos años de empleo, un empleado puede tomar dos semanas de vacaciones. Después de cinco años de servicio, un empleado puede tomar tres semanas de vacaciones. Después de diez años de empleo, un empleado puede tomar cuatro semanas de vacaciones.
En su aniversario de contratación, un empleado podrá pasar no más de una semana de vacaciones para usarlas en el siguiente año.
Los empleados deben avisar a su supervisor tan pronto como sea posible, las fechas en que quieren tomar sus vacaciones. El aviso debe darse con un mínimo de anticipación de un mes. Para decidir si un empleado puede salir de vacaciones, además de que tenga derecho a tomarlas, se considerará su tiempo en el empleo, las cargas de trabajo actuales y se respetaran otros empleados de un departamento que hayan solicitado sus vacaciones con mas anterioridad.
Si un día festivo pagado cae dentro de un período de vacaciones, al empleado no se le cargará un día de vacaciones por el día festivo.
Ausencias y Retrasos
La ausencia al trabajo se define como el no avisar que no se presentará al trabajo o el no permanecer en el trabajo como ya había sido programado. La ausencia incluye todo tiempo perdido fuera del trabajo sin importar que la ausencia sea justificada o no, ni que se haya podido evitar o no. La ausencia no justificada es cuando el empleado no le notifica a su supervisor que va a faltar antes de su tiempo programado de trabajo.
Se define como retraso cuando un empleado no llega a trabajar a la hora normal de inicio de labores programada y no está en su lugar de trabajo a la hora apropiada (ver horarios de trabajo).
Si un empleado llega tarde constantemente, es decir, que tiene tres retrasos repetidos dentro de un período de doce meses, se hace acreedor a una acción disciplinaria y que pueden ser hasta la causa de despido inmediata.
Si un empleado tiene una ausencia no justificada al trabajo, al empleado no se le pagará por el tiempo que no trabajó. Las ausencias no justificadas repetidas se consideran como bases para una acción disciplinaria y pueden hasta causar la terminación inmediata.
Cuando un empleado no puede presentarse a trabajar al inicio de su turno, tiene por fuerza que contactar a su supervisor por lo menos una hora antes del turno y no más de quince minutos después de su hora de entrada. El empleado deberá hablar directamente con su supervisor o con el supervisor temporal (si su supervisor está ausente). No serán aceptados los mensajes telefónicos de voz, ni tampoco que los miembros de la familia sean los que llamen. El empleado deberá informar al supervisor que no se presentará a trabajar ese día o que va a llegar tarde. Debe dar las razones por las cuales no va a ir a trabajar o por las que va a llegar tarde y a que horas va a llegar o espera volver al trabajo.
Si un empleado tiene ausencias injustificadas por tres días consecutivos sin notificar a su supervisor, quedará terminado el empleo del individuo. Esta terminación será considerada voluntaria por parte del empleado y será considerada abandono de trabajo.
Días de Enfermedad y Días Personales
La razón de los “días de enfermedad” es proteger al empleado contra pérdidas de salario causadas por enfermedades o lesión leves, por lo tanto, no se deben de utilizar esos días para otras cosas que no sean los que se explican en este manual.
Después de terminado en forma exitosa el período de prueba de los 30 días, los empleados adquieren cinco días de enfermedad pagados por año. Los días de enfermedad son pagados en base al pago regular del empleado. Si el empleo con XXXXXXXXXX Services, Inc., se termina por cualquier razón, no le serán pagados al empleado los días de enfermedad que no haya usado.
Es la intención de la compañía que esos días se utilicen solamente para esas situaciones a veces inevitables que no permiten que un empleado venga trabajar, tales como: (1) enfermedad del empleado, (2) una enfermedad en la familia, (3) automóvil descompuesto, (4) cosas personales, etc. Al empleado se le paga la cantidad diaria regular por los días usados. Aunque el uso de estos días puede ser casi por cualquier razón, el uso de estos días deberá notificarse a la compañía. Uso de emergencia: Cuando un empleado se enferma o tiene una emergencia, el supervisor del empleado debe ser notificado una hora antes del cambio de turno y no más de quince minutos después de su hora de entrada. Si el empleado esta demasiado enfermo, y la notificación no se puede hacer durante el término señalado, la notificación debe hacerse lo antes posible. Uso de no emergencia: Cuando se usan estos días por razones que no son de enfermedad, tales como para cosas personales o vacaciones, el empleado debe solicitar y recibir la aprobación de su supervisor lo mas anticipado como sea posible.
Permiso de Ausencia de Compasión
Después de haber terminado su período inicial de prueba, los empleados pueden obtener tres días pagados consecutivos en caso de que haya habido una muerte en su familia inmediata. La familia inmediata comprende esposo o esposa, hijos, padres, hermanos, suegros, abuelos y tíos del empleado. Para otros parientes, el otorgamiento del permiso lo determinará el supervisor del empleado.
Permiso Familiar y Médico
XXXXXXXXXX SERVICES, INC., concederá Permisos Familiares y Médicos por las razones especificadas en el Acta Federal de Ausencias Familiares y Médicas (FMLA) por un término de hasta doce semanas de trabajo por cada período de doce meses.
Elegibilidad
Un empleado debe haber sido empleado por la Compañía por lo menos un año (doce meses) y haber trabajado por lo menos 1,250 horas durante ese año para ser elegible a un Permiso Familiar y Médico.
Debe haber Razones Calificables para que se otorguen los Permisos Familiares y Médicos
Las Razones Calificables para solicitar Permisos Familiares y Médicos incluyen lo siguiente:
a) el nacimiento de un hijo del empleado
b) la adopción o la adopción temporal de un niño por el empleado;
c) para cuidar para un esposo, un hijo o un padre enfermo si el individuo tiene una enfermedad seria; o
d) enfermedad o condición seria de salud de un empleado.
Una condición seria de salud de un empleado es:
la necesidad de cuidado dentro de un hospital, hospicio o un lugar residencial de asistencia médica.
tratamiento continuo por un profesional de cuidados médicos, o
que la condición crónica de un empleado no le permita realizar sus deberes de trabajo, o
la maternidad, que médicamente no permita que una empleada realice sus deberes asignados de trabajo.
Proceso para solicitar Permisos Familiares y Médicos
Si se puede prever la necesidad de un Permiso Familiar y Medico, el empleado necesita dar el aviso por lo menos treinta días antes. Sin embargo, si el empleado no puede dar aviso antes de los treinta días, entonces deberá proporcionar el aviso tan pronto como sea posible.
Las solicitudes de Permisos de Familiares y Médicos deben hacerse por escrito, usando la forma especial que se obtiene en la oficina de Recursos Humanos.
Si el permiso se debe a una enfermedad o lesión del empleado, o si el empleado está solicitando el permiso para cuidar a un miembro enfermo de su familia, se requerirán pruebas o la “certificación” de la necesidad del permiso de acuerdo con la ley.
Si es aprobada la petición del permiso, la Compañía requerirá una nueva certificación cada 3 semanas mientras el empleado continúe ausente.
Si la Compañía tiene duda sobre la validez de la certificación, la Compañía podrá requerir a su propio costo, una segunda opinión por parte de un médico que esté aprobado por ella, pero que no sea empleado regular de la empresa.
Condiciones del Permiso Familiar y Médico
Si el permiso se usa debido al nacimiento de un hijo del empleado o debido a la adopción o la adopción temporal de un niño por el empleado, el permiso deberá tomarse durante el mes que siga al nacimiento o la adopción del niño.
El Permiso Familiar y Médico no es un permiso pagado. Aunque la Compañía no requerirá que el empleado utilice su tiempo de vacaciones o sus días de enfermedad, el empleado tendrá derecho a decidir si utiliza esos días junto con el Permiso Familiar y Médico.
La Compañía continuará pagando la parte que le corresponde del programa del seguro médico durante un Permiso Familiar y Médico. Si el empleado es responsable de pagar su porción del plan de seguro médico, es importante que el empleado continúe haciendo los pagos de su porción durante el período del permiso. El pago debe hacerse el primer día de cada mes. Si su pago se retasa, XXXXXXXXXX Services, Inc., le enviará un aviso al empleado informándole que su cobertura médica se perderá si transcurren 30 días de la fecha en que se debió haber pagado el seguro.
Al final del Permiso Familiar y Médico, el empleado será reinstalado en el puesto que tenía cuando fue aprobado el Permiso Familiar y Médico o le será dada una posición de empleo equivalente con prestaciones, pago y condiciones semejantes.
Si el empleado no vuelve al trabajo al final del Permiso Familiar y Médico, la Compañía requerirá el reembolso de las primas del seguro médico que pagó a favor del empleado durante el período del permiso. El reembolso no será requerido si el empleado no regresa a trabajar después del permiso debido a que la condición continúa, recurre, o se le presenta una seria condición de salud que evite que el empleado pueda hacer su trabajo.
Cuando coinciden el Permiso Familiar y Médico con el Seguro de Incapacidad del Trabajador, y el Seguro de Incapacidad del Trabajador permite que el empleado vuelva al trabajo bajo condiciones de “trabajo ligero”, y si hay disponible un puesto de trabajo ligero, el empleado puede rechazar volver al trabajo si un doctor no certifica que el empleado puede volver al trabajo bajo las reglas del Permiso Familiar o Médico. Sin embargo, si el empleado rechaza el trabajo ligero disponible, el empleado puede perder los beneficios del Seguro de Incapacidad del Trabajador.
Permisos personales
Cualquier ausencia al trabajo durante un tiempo extendido por razones que no son médicas se considerará permiso personal y deberá ser aprobado por la gerencia de XXXXXXXXXX Services, Inc. Los permisos personales se limitarán a cuatro semanas. Estos permisos se dan sin remuneración y el empleo no queda garantizado.
Presencia en Jurado
Siempre que algún empleado tenga que servir como miembro de un jurado durante horas de trabajo regulares, el empleado debe endosar su vale de pago de jurado a XXXXXXXXXX Services, Inc., y así recibir su pago regular. Los empleados de medio tiempo podrán recibir hasta dos semanas de su pago regular pero se descontará el pago de jurado de acuerdo a la ley del estado de Illinois. Los empleados de tiempo completo recibirán su sueldo normal menos el pago de jurado de acuerdo a la ley del estado de Illinois.
Deberes Militares
Si un empleado es un miembro de la reserva militar, deberá dar aviso por lo menos 30 días antes de ir a las prácticas de fin de semana, y al tiempo anual de entrenamiento. Al empleado se le permitirá volver a su misma posición, salario y tiempo acumulado de vacaciones. No habrá remuneración por el tiempo que el empleado esté fuera del trabajo.
Empleos Exteriores
El empleado debe comprender que su empleo con XXXXXXXXXX Services, Inc., es su responsabilidad primaria. El que el empleado tenga un segundo empleo exterior no será excusa para que no trabaje bien, se ausente, llegue tarde o se niegue a trabajar horas extras. Si el empleo exterior causa o contribuye a cualquiera de estas situaciones, el segundo empleo del empleado debe discutirse con la gerencia de XXXXXXXXXX Services, Inc.
Confidencialidad
XXXXXXXXXX Services, Inc., trata de proteger la confidencialidad de cada empleado. Los supervisores están instruidos a no divulgar información sobre un empleado y deben pasar las llamadas telefónicas que buscan tal información a la oficina de personal. A la vez, XXXXXXXXXX Services, Inc., espera que los empleados también protejan los asuntos confidenciales de la Compañía. Queda prohibido que los empleados compartan información sobre la Compañía con personas que no sean empleados de ella. Los empleados deben mantener como confidencial toda la información sobre la Compañía, incluyendo nombres de sus clientes, e informar a la oficina de personal toda pregunta que les hagan referente a los negocios de la compañía.
Uso y Abuso de Sustancias
El uso y abuso del alcohol y drogas en el trabajo plantea una amenaza seria a los compañeros trabajadores y a XXXXXXXXXX Services, Inc.
La posesión, el uso o venta de alcohol, drogas no autorizadas o ilegales o el mal uso de medicamentos legales en terrenos de XXXXXXXXXX Services, Inc., o mientras se están desempeñando negocios de Compañía queda prohibido y es base para el despido inmediato.
Todos los aspirantes a empleo deben someterse a un análisis de drogas antes de comenzar su empleo y si fallan la prueba, les será negado el empleo.
Si hay razón para que un supervisor sospeche que un empleado está bajo influencia de drogas o del alcohol que perjudiquen su juicio, desempeño o comportamiento estando en terrenos de XXXXXXXXXX Services, Inc., o al estar desempeñando negocios de la compañía, se le pedirá al empleado que se someta a una prueba de la drogas o alcohol. Si el empleado falla la prueba o rehúsan tomar la prueba, XXXXXXXXXX Services, Inc., considerará esto como suficiente razón para el despido inmediato.
Para mantener una planta libre de drogas y armas, XXXXXXXXXX Services, Inc., se reserva el derecho de revisar a todo empleado que entra a la planta y de revisar las áreas de equipo y almacenamiento. En adición a la prueba de las drogas que se hace antes de dar el empleo, XXXXXXXXXX Services, Inc., se reserva el derecho de revisar espontáneamente para drogas o alcohol.
Todo empleado será responsable de avisar con oportunidad a la gerencia de XXXXXXXXXX Services, Inc., sobre el uso de cualquier medicamento recetado, que pudiera afectar su juicio, desempeño o comportamiento.
Solicitación Entre Empleados
Queda prohibida la solicitación de un empleado de otro durante las horas de trabajo, cuando la persona que esta solicitando y la persona que esta recibiendo la solicitación tienen que estar haciendo sus deberes de trabajo. Queda prohibido en todo momento la distribución de material de publicidad, papeletas y otra literatura en terrenos de la compañía. No se les permitirá a los empleados el acceso a la planta o a otras áreas de trabajo durante sus horas de descanso.
Uso y Cuidado de Vehículos
Todo empleado que opere un vehículo con placa comercial (camión) propiedad de o controlado por XXXXXXXXXX Services, Inc., debe tener una licencia de manejo válida CDL (comercial).
Todo empleado que maneje o tenga supervisión sobre la operación de cualquier vehículo de la Compañía, tiene la responsabilidad:
a. del vehículo.
b. la seguridad de la carga y de los pasajeros.
c. peligros físicos.
d. vehículos de seguridad.
e. reportar accidentes.
g. manejar en forma defensiva.
El empleado es responsable de toda su propiedad personal que lleve en cualquier vehículo de la Compañía.
Si un empleado que conduce un vehículo con placas se ve implicado en un accidente, el empleado deberá llamar inmediatamente al departamento del policía y notificar sobre el accidente. Después de contactar a la policía, el empleado deberá llamar a XXXXXXXXXX Services, Inc., y reportar el accidente a la gerencia de la Compañía. Todos los accidentes, robos, vandalismos y daños a un vehículo necesitan reportarse a la gerencia de la compañía.
Si un empleado golpea un coche estacionado u objetos y obstáculos inmóviles, el empleado debe reportar el hecho de inmediato a la policía y deberá intentar localizar al dueño del vehículo o del objeto. Si el empleado no puede localizar al dueño, le deberá dejar una nota en un lugar visible dando su nombre y dirección, el nombre de la Compañía y una breve descripción del accidente.
Un empleado que no reporte algún accidente que involucre un vehículo de la compañía puede ser despedido de inmediato.
Los empleados que sean culpables en un segundo accidente dentro de un período de seis meses, serán considerados como repetidores de accidentes. Los repetidores de accidentes podrán recibir una carta de amonestación o ser despedidos de inmediato, dependiendo de la severidad de los accidentes.
Uso y Cuidado del Equipo
Se espera que los empleados sean extremadamente cuidadosos al usar el equipo propiedad de XXXXXXXXXX Services, Inc., y que utilicen el equipo solamente para los usos autorizados. La negligencia en el uso y cuidado del equipo propiedad de XXXXXXXXXX Services, Inc., puede considerarse causa de despido.
El retirar propiedad de XXXXXXXXXX Services, Inc., de sus terrenos, o su conversión al uso personal será considerado como causa de despido inmediato y acusación ante las autoridades.
Todo empleado que se demuestre haber tenido conocimiento de hurto o vandalismo de propiedades de XXXXXXXXXX Services, Inc., y que no lo haya reportado a la gerencia de XXXXXXXXXX Services, Inc., será despedido.
Se documentarán todo tipo de daños a equipo causados por un empleado y los documentos se mantendrán en el archivo personal del empleado. Estos documentos se considerarán durante revisiones de desempeño personal.
Procesos Disciplinarios
El propósito primario del sistema disciplinario es corregir conducta incorrecta.
Cuando un empleado viola alguna política o regla de XXXXXXXXXX Services, Inc., el supervisor podrá seguir el siguiente proceso:
Primera violación: Advertencia verbal documentada.
Segunda violación: Una advertencia formal por escrito detallando la ofensa, y a discreción del supervisor una suspensión de hasta por tres días sin pago.
Tercera violación: El empleado será despedido del empleo en XXXXXXXXXX Services, Inc.
Un empleado puede ser despedido en cualquier momento y sin considerar los pasos anteriores, si a juicio del supervisor, el empleado ha cometido una ofensa que pueda perjudicar el bienestar de XXXXXXXXXX Services, Inc., o cualquiera de sus empleados.
La gerencia de XXXXXXXXXX Services, Inc., debe aprobar cada despido.
Resolución de Conflictos
XXXXXXXXXX Services, Inc., mantiene la política de “puerta abierta.” Se les pide a los empleados que tengan quejas o desacuerdos de asuntos de trabajo o el empleo para que intenten resolver estos problemas, discutiéndolos con su supervisor o con uno de los dueños de la Compañía si es que hay un conflicto con el supervisor. El papel que tienen los empleados en mantener un Ambiente de Trabajo Libre de Hostigamiento y Acoso
Cada empleado debe compartir la responsabilidad con la gerencia en mantener un ambiente del trabajo libre de hostigamiento. Si usted se siente acosando o hostigado, o presencia el hostigamiento a otro empleado, por parte de un supervisor, otro empleado, un proveedor, o por un visitante debido a su raza, color, sexo, religión, origen nacional, edad, impedimento percibido o verdadero, estado civil o estado militar, si es posible, primero haga saber a la persona que esta acosando de sus objeciones. Si usted encuentra difícil de hacer así pues, o sus objeciones, y si estas no producen resultados, usted debe reportar cuanto antes sobre el problema a uno de los dueños.
Se Prohíben las Represalias

Política de Fumar

Toda persona que sea vista fumando fuera de estas áreas podrá ser despedida de inmediato.
Política de Software e Internet
En XXXXXXXXXX Services, las computadoras y el software que se utilizan son herramientas importantes del negocio. Todos los empleados necesitan ayudarnos a mantener la integridad de estos sistemas cumpliendo con las siguientes reglas:

Ningún empleado puede utilizar las computadoras de la compañía para que a sabiendas descargue o distribuya software o datos pirateados, para propagar deliberadamente todo tipo de, gusanos, Trojans o código de programa de trampa, o con conocimiento marcar o sobrecargar cualquier sistema informático o red, o evitar cualquier sistema instalado para proteger la privacidad o la seguridad de otro usuario.
5. La exhibición de de todo tipo de imágenes sexualmente explícitas o documentos en cualquier sistema de la compañía es una violación a las políticas de Hostigamiento y Acoso de XXXXXXXXXX Services, Inc. No deberán archivarse, guardarse, distribuirse, editarse o grabarse información sexual explícita usando la red y otros recursos de computación de XXXXXXXXXX Services, Inc.
6. Nunca se deberán utilizar los recursos de computación de la Compañía para violar las leyes y los reglamentos de los Estados Unidos o de cualquier otra nación, o las leyes de cualquier estado, ciudad, provincia u otra jurisdicción local.

Welcome to XXXXXXXXXXXXXXXX Services, Inc. This handbook will help explain what you can expect from XXXXXXXXXXXXXXXX Services, Inc. and what XXXXXXXXXXXXXXXX Services, Inc. expects from you. The handbook contains a summary of many of XXXXXXXXXXXXXXXX Service’s employment practices. It is not intended to be a contract or to include any contract terms. Neither the contents of this handbook nor any verbal statements should be considered as an assurance of continued employment. Any employee may be terminated at any time, with or without cause. XXXXXXXXXXXXXXXX Services, Inc. reserves the right to change, add to, or cancel any of these policies at its sole and absolute discretion and without notice to employees. Please read this handbook carefully.

Employee Status
Probationary Employee: The first thirty (30) days of employment with XXXXXXXXXXXXXXXX Services, Inc. are considered a period of training and adjustment. At the end of the thirty (30) day period, the supervisor will review the employee’s performance with the employee. If the employee satisfactorily completes the probationary period, he/she will be eligible for full-time or part-time status.
Full-Time Employee: After completion of the probationary period, an employee may be eligible for full-time status. An employee is considered a full-time employee when he/she has satisfactorily completed the probationary period and is scheduled to work 36 hours or more hours on a consistent basis. Full-time employees are eligible for all XXXXXXXXXXXXXXXX Services, Inc.'s benefits.
Part-Time Employee: After completion of the probationary period, an employee may be eligible for part-time status. An employee is considered a part-time employee when he/she has satisfactorily completed the probationary period and is scheduled to work fewer than 36 hours per week. Part-time employees are eligible for XXXXXXXXXXXXXXXX Services, Inc.'s safety equipment programs but are not eligible for any paid time off or health benefits.
Immigration Law
The U.S. Immigration Law requires that any employee hired after November 6, 1986 be subject to a document inspection process. This process applies to both U.S. citizens and non-citizens. The verification process must take place within three business days of hiring. New employees must present documents to prove their identity and employment eligibility and XXXXXXXXXXXXXXXX Services, Inc. must physically examine this evidence. The employee and XXXXXXXXXXXXXXXX Services, Inc. must complete the required Employment Eligibility Verification (I-9) form, which is maintained for government inspection.
Hours of Work
All full-time employees are scheduled to work at least eight hours per day, at least forty hours per week.
The regular work week for plant employees is Monday through Friday. There may be some variation in the daily and weekly schedule depending upon the specific job classification. For plant payroll purposes, the work week begins on a Sunday and ends on the following Saturday.
The hours of work at 3301 West 48th Place are: First shift, 6:30AM -
3:00 PM, second shift, 2:45 PM to 11:15 PM, third shift 10:15PM – 6:15 AM.
Administrative employees at 3301 West 47th Place are scheduled to work Monday through Friday, 8:00 a.m. - 4:30 p.m. There may be some variation in the daily and weekly schedule depending upon the specific job classification.
Time Cards
All non-exempt (hourly) employees are required to record their hours on a time card using the time clock provided. Under no circumstances is an employee to punch another employee's time card. Violation of this rule may result in immediate dismissal.
Lunch and Break
During an regular eight hour shift, all non-exempt (hourly) employees receive a one half-hour unpaid lunch break and one paid fifteen minute break taken determined by their supervisor.
All salaried employees receive a one-half hour unpaid lunch break.
Overtime
XXXXXXXXXXXXXXXX Services, Inc. expects employees to work overtime when it is required. It is understood that situations may occasionally arise that will prevent an employee from working overtime, but it is important that overtime work is considered by employees as a part of the job.
Non-exempt employees are paid for overtime hours based on the following schedule:
1. For all hours worked in excess of the forty-hour base, employees will be paid at the rate of time and one-half. Hours worked do not include holidays, vacation or sick time.
2. To receive the time and one-half rate for work on Saturdays and Sundays, an employee must have worked a forty-hour week.
Exempt employees are not paid for working more than 40 hours.
Performance Appraisal
The performance of each employee is reviewed after the probationary period, after the first six months of employment and thereafter once each year. Performance appraisals are considered in making salary decisions, but the results of the review will not necessarily result in a merit increase.
For non exempt plant employees, there is a review after the thirty(30) day probationary period, and then every December. Performance appraisals are considered in making salary decisions, but the results of the review will not necessarily result in a merit increase.
Uniform Policy
XXXXXXXXXXXXXXXX Services, Inc. currently provides all non-office employees with uniforms, which include eleven shirts and eleven pairs of pants. Employees will be measured for uniforms after their one-month probationary period. Employees are expected to report for work attired in the uniform. Employees are not to report for work wearing clothes other than the uniform provided. Uniforms are to be turned in every Friday for cleaning. Clean uniforms are provided every week. Uniform jackets are also available to rent. There is a weekly charge, and it will be deducted from the employees paycheck.
A deposit for the uniforms will be deducted from the employee’s first paychecks after the probationary period. This deposit reflects less than half of the actual cost for the uniforms. These uniforms are considered to be the property of XXXXXXXXXXXXXXXX Services, Inc. and upon terminating employment with XXXXXXXXXXXXXXXX Services, Inc.; employees must return all uniform pants and shirts. An employee’s final check will have the deduction for any unreturned uniforms, and the deposit will held until all uniforms are returned to XXXXXXXXXXXXXXXX Services, Inc. Employees are held responsible for keeping track of all their uniforms, report any problems concerning the uniforms and are ultimately responsible for any lost uniforms.
Safety Equipment
All plant employees are expected to report for work wearing steel toed shoes or boots. Upon presentation of a receipt for the shoes to XXXXXXXXXXXXXXXX Services, Inc., XXXXXXXXXXXXXXXX Services, Inc. will reimburse workers for the cost of the safety shoes. These shoes are to be worn only for work at XXXXXXXXXXXXXXXX Services, Inc. XXXXXXXXXXXXXXXX Services, Inc. may provide employees with a new pair of safety shoes every year provided new shoes are needed. The year is defined as that year following the purchase date, as indicated on the receipt, of the safety shoes.
XXXXXXXXXXXXXXXX Services, Inc. is concerned about the safety of its employees. XXXXXXXXXXXXXXXX Services, Inc. supplies safety gloves to all non-office employees. Gloves are issued to each worker and the date of the issuance is recorded for each worker. A replacement pair of gloves will be issued to a worker only if the worker presents the gloves most recently issued to establish these gloves should be replaced. Employees must turn in worn gloves to get a replacement pair. If a worker looses the gloves, he/she must replace the gloves at his/her own cost. If the worker refuses to replace the gloves at his/her own cost and chooses to return to work without gloves, the worker will be dismissed until the worker replaces the gloves.
Equipment to protect employees' hearing is also available and must be worn in designated areas as requested by one’s supervisor.
Eye protection will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn at all times when the employee is working in the plant.
Dust protection will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn by all employees who are working in a high dust area when requested by their supervisor.
Hard hats will be provided by XXXXXXXXXXXXXXXX Services, Inc. and must be worn at all times when the employee is working in the plant.
XXXXXXXXXXXXXXXX Services, Inc. expects workers to assume responsibility for preventing the loss of their safety equipment.
All XXXXXXXXXXXXXXXX Services, Inc. employees are required to report all injuries on the job, even very minor injuries (example: scraping a knee). Accident and/or incident reports will be completed as requested by OSHA.
Only Licensed drivers are to be handling motorized equipment.

Insurance Benefits
XXXXXXXXXXXXXXXX Services, Inc. offers a group health care plan. Benefits of that plan are available with the human resource department.
Holidays
All full-time employees are eligible to receive full-pay for the following six holidays:
New Year's Day Labor Day
Memorial Day Thanksgiving Day
Independence Day Christmas Day
When a holiday falls on a Saturday or Sunday, if an employee has worked the regular forty hours during the preceding week, an employee will be paid for eight holiday hours in addition to the regular forty hours. Excused sick hours are included in the regular hours worked for this case only.
To be paid for a holiday, an employee must work the scheduled day before the holiday and the scheduled day after the holiday.
Vacation days can be used in conjunction with holidays.
Vacation
XXXXXXXXXXXXXXXX Services, Inc. provides vacation time, with pay, to all regular full-time employees. After one year of continuous service, and employee is eligible for one week of vacation. After two years of employment, an employee is eligible for two weeks of vacation. After five years of employment, an employee is eligible for three weeks of vacation. After ten years of employment, an employee is eligible for four weeks of vacation.
On an employee’s anniversary of employment, he/she can carry no more than one week of vacation pay into the following year.
Employees should give their supervisor notice of his/her vacation dates as soon as possible with a minimum of one month’s advance notice. Preferences for vacation periods will be based upon length of service, current workloads and fairness to the other employees in their department.
If a paid holiday falls within the vacation period, the employee will not be charged for a vacation day for the holiday.
Absence and Tardiness
Absence from work is defined as failure to report for and remain at work as scheduled. Absence includes all time lost from the job whether excused or unexcused, avoidable or unavoidable. Unexcused absence is a failure by the employee to notify their supervisor before their scheduled work time.
Tardiness is defined as the employee's failure to report for work at the scheduled starting time and be present at his/her appointed workstation (see hours of work). Repeated tardiness, three times within a rolling twelve-month period (a time period that begins with the first occurrence of tardiness) is considered grounds for disciplinary action up to and including immediate termination.
If an employee has an unexcused absence from work, the employee will not be paid for the time off. Repeated unexcused absences are considered grounds for disciplinary action up to and including immediate termination.
When an employee cannot report for work at the beginning of his/her shift, the employee must contact his/her supervisor prior to one hour of their shift or no later than within fifteen minutes of his/her starting time. The employee must speak directly to his/her supervisor or acting supervisor (if the supervisor is absent). Voice mail messages are considered unacceptable, and family members calling in absences are also considered unacceptable. An employee must inform the supervisor that he/she is not reporting for work that day or is going to be tardy, the reason he/she is not reporting for work or is going to be tardy, and when he/she expects to return to or arrive at work.
If an employee has an unexcused absence for three consecutive days without notifying the supervisor, the individual's employment will be terminated. This termination will be considered voluntary on the employee's part and will be considered job abandonment.
Sick/Personal Days
The purpose of sick time is to protect the employee from loss of earnings because of short-term illness or injury and, therefore, should not be used for purposes other than those outlined in this handbook.
After successful completion of the initial 30-day probationary period, employees get five paid sick days per year. Sick days are paid at the employee’s regular straight time rate of pay. If employment with XXXXXXXXXXXXXXXX Services, Inc. is terminated for any reason, unused sick days will not be paid out to the employee.
It is the intention of the Company that these days be used for those sometimes unavoidable circumstances which do not permit an employee to come to work, such as: (1) employee’s sickness, (2) a sickness in the family, (3) car breakdown, (4) personal business, etc. The employee is paid at his or her regular rate for these days used. While these days are allowed for any reason, the use of these days is subject to notification to the company. Emergency Use: When an employee is sick or has an emergency, the employee’s supervisor must be notified one hour before the shift or no later than within the first fifteen minutes of his/her scheduled start time. If the employee is too ill, and notification cannot be made by the designated notification period, notification must be made as soon as possible. Non-Emergency Use: When using these days for personal reasons, such as personal business or vacation, the employee must request and receive approval from his or her supervisor as far in advance as possible.
Compassionate Leave
Upon completion of the initial probationary period, employees may be allowed up to three consecutive workdays with pay in the event of death in his/her family. Immediate family is designated as your spouse, child, parent, brother, sister, mother-in-law, father-in-law, grandparents, brother or sister of employee’s parents. For other relatives, compassionate leave will be determined by the employee’s supervisor.
Family and Medical Leave
XXXXXXXXXXXXXXXX SERVICES, INC. will grant family and medical leave for reasons specified by the federal Family and Medical Leave Act (FMLA) for up to twelve work weeks in a twelve-month period.
Eligibility
An employee must have been employed by the Company for at least one year (twelve months) and have worked at least 1,250 hours during that year to be eligible for Family or Medical Leave.
Qualifying Reasons for Family and Medical Leave
Qualifying reasons for requesting this leave include the following:
a) the birth of a child of the employee
b) the adoption of a child or the placement of a foster child with the employee;
c) to care for a sick spouse, child or parent if the individual has a serious health condition; or
d) an employee’s own serious health condition.
An employee’s serious health condition that involves:
the need for in-patient care in a hospital, hospice or residential medical care facility.
continuing treatment by a health care provider, or
an employee’s chronic condition causing him or her to be medically unable to perform his or her work duties, or
maternity causing an employee to be medically unable to perform her assigned work duties.
Process for applying for Family and Medical Leave
If the family and medical leave is foreseeable, the employee needs to provide at least thirty days notice. However, if the employee cannot reasonably give thirty days notice for the requested leave, the employee should provide notice as soon as possible.
Requests for family and medical leave must be made in writing using the Family and Medical Leave Request Form that can be obtained from the Human Resources Office.
Proof or “certification” of the necessity of the leave, if the leave is due to the illness or injury of an employee, or if the employee requests the leave to care for an ill family member, will be required in accordance with applicable law.
If the leave request meets the qualifications for such a leave under the Family and Medical Leave Act, and the leave is granted, the Company will require recertification of the continued need for leave every 3 weeks while the employee remains on leave.
If the Company finds reason to doubt the validity of the certification, it may require, at its own expense, a second medical opinion from a health care provider approved by the Company, but not regularly employed by the Company.
Conditions of Family and Medical Leave
If the leave is taken for the birth of an employee’s child, or the placement with the employee of a child for adoption or foster care, leave must be taken within one month after the birth or placement of the child.
Family and Medical Leave is unpaid leave. Although the Company will not require the use of vacation or sick leave by the employee, the employee may choose to use their annual allotment of leave during the Family and Medical Leave period.
The Company will continue to pay it’s contribution to group health benefits during an approved Family and Medical Leave. If an employee has a portion to the health care plan that they are responsible for, it is important that the employee continue to pay their portion of their medical premium during this leave. Payment is due the first of each month. If your payment is late, XXXXXXXXXXXXXXXX Services will send you a notice. Fifteen days before 30 days is elapsed, XXXXXXXXXXXXXXXX Services will send you a notice stating your medical coverage will be lost is you do not make payment before 30 days has elapsed since your payment was due.
At the end of Family and Medical Leave, the employee will be returned to the position the employee held when the leave was granted or will be given an equivalent position with like employment benefits, pay and other terms and conditions of employment.
If the employee does not return to work at the expiration of Family and Medical Leave, the Company will require the repayment of health insurance premiums it paid on the employee’s behalf during the leave period. Reimbursement will not be required if the employee does not return from leave because of the continuance, reoccurrence, or onset of a serious health condition that prevents the employee from performing the employee’s job.
When Family and Medical Leave and medical leave under Worker’s Compensation coincide, if Worker’s Compensation allows you to return to work under “light duty” conditions, and a light duty job is available, you may refuse to return if a doctor will not certify that you are able to return to work under the Family and Medical Leave rules. However, should you refuse to take a light duty job made available to you, you may lose your Worker’s Compensation benefits.
Personal Leave
Any non-medical reason for extended time off is considered personal leave and must be approved by the management of XXXXXXXXXXXXXXXX Services, Inc. Personal leave will be limited to four weeks. Personal leave is without compensation and employment is not guaranteed.
Jury Duty
Whenever an employee is required to serve as a juror during the regular working hours, the employee must sign over the endorsed jury voucher to XXXXXXXXXXXXXXXX Services, Inc. in order to receive regular pay. Non-exempt employees are eligible for up to two weeks of their regular pay minus the jury pay per Illinois state law. Exempt employees are paid their normal salary minus the jury pay per Illinois state law.
Military Duty
If an employee is a member of the reserve, he/she must give at least 30 days notice of weekend drills, and annual training weeks. The employee will be permitted to return to the same position, rate of pay, and accrued vacation time. There will be no compensation for the time spent away from the job.
Outside Employment
It must be realized that employment with XXXXXXXXXXXXXXXX Services, Inc. is the employee's primary responsibility. Outside employment will not be considered an excuse for poor performance, absenteeism, tardiness or refusal to work overtime. Should the outside employment cause or contribute to any of these situations, the outside employment must be discussed with XXXXXXXXXXXXXXXX Services, Inc. management.
Confidentiality
XXXXXXXXXXXXXXXX Services, Inc. tries to protect each employee’s confidentiality. Supervisors are instructed not to give out any information about an employee and to refer phone calls seeking such information to the personnel office. In return, we expect employees to protect the company’s confidences as well. Employees are not permitted to share any information about the company with any non- employee. Employees must hold confidential all information about the company--including names of company customers-and report to the personnel office inquires from anyone concerning the company’s business.
Substance Use and Abuse
The use and abuse of alcohol and drugs on the job poses a serious threat to both fellow workers and XXXXXXXXXXXXXXXX Services, Inc.
The possession, use or sale of alcohol, unauthorized or illegal drugs or any misuse of any legal drugs on XXXXXXXXXXXXXXXX Services, Inc.'s premises or while on company business is prohibited and is grounds for immediate termination.
All plant employees are required to take a drug test before starting their employment, and if the drug test is failed employment will be denied.
If there is reason for a supervisor to suspect that an employee is under the influence of drugs or alcohol which impairs judgment, performance or behavior while on XXXXXXXXXXXXXXXX Services, Inc.'s premises or while on company business, the employee will be asked to take a drug or alcohol test. If they fail the test or refuse to take on, XXXXXXXXXXXXXXXX Services, Inc. will consider this grounds for immediate termination.
To maintain a plant free of drugs and weapons, XXXXXXXXXXXXXXXX Services, Inc. reserves the right to search any employee entering the plant and to search equipment and storage areas. In addition to pre-employment drug testing, XXXXXXXXXXXXXXXX Services, Inc. reserves the right to randomly test for alcohol or drugs.
Each employee is responsible for promptly reporting to XXXXXXXXXXXXXXXX Services, Inc.’s management any use of prescribed medication, which may affect the employee’s judgment, performance or behavior.
No Solicitation
Solicitation by an employee of another employee is prohibited during the workday, while either the person doing the soliciting or the person being solicited are required to do his or her work tasks. Distribution of advertising material, handbills or other literature on company property is prohibited at any time. Employees are not permitted access to the plant or other working areas during their off duty hours.
Use and Care of Vehicles
Any employee who operates a commercially licensed vehicle (truck) owned or controlled by XXXXXXXXXXXXXXXX Services, Inc. must possess a valid CDL license.
Each employee who operates or has supervision over the operation of any Company vehicle, has the responsibility for:
a. the vehicle.
b. safety of cargo and/or passengers.
c. physical hazards.
d. security vehicles.
e. reporting accidents.
g. defensive driving.
The employee is responsible for all personal property left in any Company vehicle.
If an employee is driving a licensed vehicle and is involved in an accident, the employee must immediately contact the police department and report the accident. After contacting the police, the employee must then contact XXXXXXXXXXXXXXXX Services, Inc. and report the accident to Company management. All accidents, thefts, vandalism and damage to a vehicle must be reported to Company management.
If an employee hits a parked car or stationary object or obstacle, the employee must immediately report this to the police and try to locate the owner of the vehicle or object. If the employee cannot locate the owner, he/she must leave a note in a conspicuous place listing his/her name and address, the Company name and a brief description of the accident.
An employee who fails to report any accident involving a Company vehicle may have his/her employment immediately terminated.
Employees who have a second accident, for which they are at fault, within a six-month period, are considered accident repeaters. Accident repeaters are subject to either a warning letter or immediate termination, depending on the severity of the accidents.
Use and Care of Equipment
Employees are expected to exercise extreme care in the use of XXXXXXXXXXXXXXXX Services, Inc.'s property and to use this property only for authorized purposes. Negligence in the care and use of XXXXXXXXXXXXXXXX Services, Inc.'s property will be considered cause for termination.
Unauthorized removal of XXXXXXXXXXXXXXXX Services, Inc.'s property from the premises or its conversion to personal use will be considered cause for immediate termination and prosecution.
Any employee who is proven to have knowledge of a theft or vandalism of XXXXXXXXXXXXXXXX Services, Inc.'s property and who does not report it to the management of XXXXXXXXXXXXXXXX Services, Inc. will be terminated.
Any damage to equipment by an employee will be documented and placed in the employee personnel file. This will be taken into consideration during reviews.
Disciplinary Process
The primary purpose of the disciplinary system is to correct improper behavior.
When an employee violates a XXXXXXXXXXXXXXXX Services, Inc.'s rule or policy, the supervisor may follow this process:
First violation: Verbal documented warning.
Second Violation: A formal written warning of the offense, and at the supervisor’s discretion up to three days suspension without pay.
Third violation: The employee will be discharged from employment at XXXXXXXXXXXXXXXX Services, Inc.
An employee can be discharged at any time, without regard to the preceding steps, if he/she commits an offense, which in the supervisor’s judgment would be contrary to the well being of XXXXXXXXXXXXXXXX Services, Inc. or any of its employees
The management of XXXXXXXXXXXXXXXX Services, Inc. must approve every discharge.
Dispute Resolution
XXXXXXXXXXXXXXXX Services Inc maintains an open door policy. Employees who have complaints or disagreements regarding employment or work matters are encouraged to try to resolve these problems by discussing them with their supervisor or one of the company owners if there is a conflict with their supervisor. An employee who has a work-related problem should report that problem to his/her supervisor. There should be no fear of retaliation at any stage of the process. The supervisor should try to reach a solution through a thorough discussion of the problem with the employee.
This program is intended to provide a forum where complaints can be resolved fairly, consistently, and in a constructive manner. This policy supplements, and does not replace, any other policies that might pertain to the problem.
Harassment Statement
We believe that mutual respect is an essential characteristic of a productive workplace. For that reason, XXXXXXXXXXXXXXXX Services prohibits all forms of illegal harassment of employees by managers, fellow employees, employees of outside vendors or visitors. Any form of harassment related to an employee’s race, color, sex, religion, national origin, perceived or actual disability, marital status, or veteran’s status is a violation of this policy, and will be treated as a disciplinary matter.
For these purposes, the term “harassment” includes, but is not limited to, slurs, jokes, or other verbal, graphic or physical conduct relating to an individual’s race, color, sex, religion, national origin, age, perceived or actual disability, or marital or veteran status.
Harassment also includes unwelcome sexual advances, requests for sexual favors, and other verbal, graphic, or physical conduct of a sexual nature.
A failure to uphold XXXXXXXXXXXXXXXX Services, Inc.’s commitment to create a harassment-free workplace will result in disciplinary action, up to and including termination.
Employees’ Role in Maintaining a Harassment-Free Work Environment
Every employee must share the responsibility with senior management in maintaining harassment –free work environment. If you feel you are being harassed, or witness the harassment of another employee, by a supervisor, another employee, a vendor, or a visitor because of race, color, sex, religion, national origin, age, perceived or actual disability, or marital or veteran’s status, first let the harassing person know of your objections, if possible. If you find it difficult to do so, or your objections do not produce results, you should report the problem as soon as possible to one of the owners.
Retaliation Is Prohibited
XXXXXXXXXXXXXXXX Services, Inc. prohibits retaliation against any employee who rejects, protests or complains about harassment. If you feel you have been subject to retaliation, please contact your supervisor or one of the owners as soon as possible.
Smoking Policy
It is the policy of XXXXXXXXXXXXXXXX Services, Inc. that smoking is unacceptable anywhere on the premises except in the two designated smoking areas listed below. The designated smoking areas are as follows:
1. Outside of the 3259 building by the doorway where the ash urn has been attached to the building.
2. Outside of the 3301 building by the doorway where the ash urn has been attached to the building.
Anyone caught smoking in any other area will be subject to immediate termination.
Software and Internet Policy
At XXXXXXXXXXXXXXXX Services, computers and the software that run on them are important business tools. All employees need to help us maintain the integrity of these systems by complying with the following rules:
1. Employees should not load or download any “plug-ins, add-ons or software onto any computer owned by the company, unless specifically approved by the computer manager or company owner.
2. The Internet is a business tool, and should only be used for business-related purposes.
3. No employee should have any expectation of privacy as to his or her intro or internet use, and XXXXXXXXXXXXXXXX Services, Inc. reserves the right to monitor and record all internet usage.
4. No employee may use company computers to knowingly download or distribute pirated software or data, to deliberately propagate any virus, worm, Trojan hours or trap-door program code, knowingly to dial or overload any computer system or network, or to circumvent any system intended to protect the privacy or security of another user.
5. The display of any kind of sexually explicit image or document on any company system is a violation of XXXXXXXXXXXXXXXX Services’ harassment policy. No sexually explicit information is to be archived, stored, distributed, edited or recorded using the XXXXXXXXXXXXXXXX Services, Inc.’s network or computing resources.
6. Company computing resource must never be used to violate the laws and regulations of the United States or any other nations, or the laws if any state, city, province or other local jurisdiction.
Violating any of the rules listed above may be grounds for disciplinary action up to and including termination.

Condición de Empleo

Puede haber una cierta variación en la programación diaria y semanal dependiendo de la clasificación específica del puesto. Para los propósitos de la nómina de pago de la planta, la semana del trabajo comienza el domingo y termina el sábado siguiente.
Las horas del trabajo en la planta de 3301 West 48th Place son:
Primer turno 6:30 A.M. - 3:00 P.M.
Segundo turno 2:45 P.M. - 11:15 P.M.
Tercer turno 10:15 P.M. - 6:15 A.M.
Los empleados administrativos de las oficinas de 3301 West 48th Place, están programados para trabajar de lunes a viernes de 8:00 A.M. - 4:30 P.M. Puede haber cierta variación en el horario diario y semanal dependiendo de la clasificación específica del puesto.
Tarjetas de tiempo
Todos los empleados de medio tiempo (de pago por hora) deben de registrar sus horas en una tarjeta usando el reloj de tiempo proporcionado. Bajo ninguna circunstancia se permitirá que un empleado perfore la tarjeta de tiempo de otro empleado. La violación a esta regla puede dar lugar al despido inmediato.
Almuerzo y Período de Descanso
Durante una jornada regular de ocho horas, los empleados de medio tiempo (de pago por hora) recibirán media hora no pagada para su almuerzo y un período de descanso de 15 minutos con pago fijado por el supervisor.
Todos los empleados de tiempo completo (a sueldo) recibirán media hora no pagada para su almuerzo.
Horas Extras
XXXXXXXXXX Services, Inc., espera que los empleados trabajen horas extras cuando se les requiera. Se entiende que puede haber situaciones que hagan que un empleado no pueda trabajar horas extras, pero es importante que los empleados consideren las horas extras como parte posible de su trabajo.
A los empleados de medio tiempo, las horas extras se pagarán de acuerdo a lo siguiente:
1. Las horas de trabajo que excedan la base de 40 horas, serán pagados a tiempo y medio. Las horas trabajadas no incluyen días festivos, vacaciones o tiempo de enfermedad.
2. Para que un empleado pueda recibir el pago de tiempo y medio para trabajar los sábados y los domingos, el empleado deberá haber ya trabajado una semana de 40 horas.
A los empleados de tiempo completo no se les pagará por trabajar más de 40 horas.
Evaluación del Desempeño en el Trabajo
El desempeño de cada empleado en su trabajo se evalúa después del período de prueba, se evalúa otra vez después de los primeros seis meses de empleo y después una vez cada año. Las evaluaciones se utilizan para tomar decisiones en cuanto al sueldo, pero los resultados de la evaluación no necesariamente darán lugar a un aumento del sueldo.
Los empleados de medio tiempo que trabajen en la planta, son evaluados después de los 30 días del período de prueba, después se les evalúa cada diciembre. Las evaluaciones se utilizan para tomar decisiones en cuanto al sueldo, pero los resultados de la evaluación no necesariamente darán lugar a un aumento del sueldo.
Política del Uniforme
XXXXXXXXXX Services, Inc., actualmente les da a todos los empleados que no sean de oficina, uniformes. El paquete de uniformes consiste en once camisas y once pares de pantalones. Después del período de prueba de un mes, a los empleados se les medirá para darles sus uniformes. Se espera que los empleados siempre lleguen a trabajar vistiendo su uniforme. Los empleados no deben llegar a trabajar con ropa que no sea el uniforme proporcionado. Los uniformes deben ser entregados cada viernes para su lavado. Cada semana se les proporcionarán uniformes limpios a los empleados. Hay chaquetas de uniformes disponibles que se les rentan. Si el empleado quiere rentar una chamarra se le hará un cobro semanal por la renta que se cargará a su pago semanal.
Por los uniformes se cobrará un depósito que será deducido de los primeros cheques de sueldo del empleado después del período de prueba. Este depósito representa menos de la mitad del costo verdadero de los uniformes. Los uniformes seguirán siendo propiedad de XXXXXXXXXX Services, Inc., y al terminar el empleo con XXXXXXXXXX Services, Inc.; los empleados deben devolver todos los uniformes. El cheque final de un empleado que sale de la compañía tendrá una deducción por todos los uniformes que no haya entregado, y el depósito se mantendrá hasta que todos los uniformes se le devuelvan a XXXXXXXXXX Services, Inc. Los empleados son responsables de saber donde están sus uniformes, y de reportar todo tipo de problemas que existan con ellos y también son responsables por los uniformes perdidos.
Equipo de seguridad
Todos los empleados de la planta deben de venir a trabajar calzando botas o zapatos de seguridad con punta de acero. A la presentación del recibo del calzado de seguridad a XXXXXXXXXX Services, Inc., XXXXXXXXXX Services, Inc., reembolsara a los trabajadores el costo del calzado de seguridad. Estos zapatos deben usarse únicamente para el trabajo que realicen en XXXXXXXXXX Services, Inc. XXXXXXXXXX Services, Inc., puede dar a los empleados un nuevo par de zapatos de seguridad cada año si fuera necesario. El año se define como el año siguiente a la fecha de compra según lo indique el recibo de los zapatos de seguridad.
XXXXXXXXXX Services, Inc. se preocupa por la seguridad de sus empleados. XXXXXXXXXX Services, Inc., les da guantes de seguridad a todos sus empleados que no sean de la oficina. Los guantes se le dan a cada trabajador y la fecha en que la que se le dan se registra para cada persona. Solamente se pueden dar guantes nuevos si el empleado presenta los guantes anteriores y comprobar que es necesario cambiarlos. El trabajador debe presentar los guantes gastados para conseguir un par nuevo. Si un trabajador pierde sus guantes, deberá conseguir unos a su propio costo. Si el trabajador no quiere reemplazar sus guantes pagándolos, y elige volver al trabajo sin ellos, el trabajador quedará suspendido y no podrá trabajar hasta que reemplace los guantes.
También hay equipo disponible para la protección de los oídos y que se debe usar en áreas señaladas a solicitud del supervisor.
XXXXXXXXXX Services, Inc., da equipo para la protección de los ojos, y debe usarse siempre que el empleado esté trabajando en la planta.
XXXXXXXXXX Services, Inc., proporciona protección contra el polvo que debe ser usado por todos los empleados que estén trabajando en un área alta en polvo cuando así lo solicite su supervisor.
XXXXXXXXXX Services, Inc., da cascos protectores de cabeza que deben usarse siempre que el empleado esté trabajando en la planta.
XXXXXXXXXX Services, Inc., espera que los trabajadores sean responsables y eviten la pérdida de su equipo de seguridad.
XXXXXXXXXX Services, Inc., requiere que todos los empleados den aviso de todas las lesiones que ocurran en el trabajo, incluso las lesiones que sean de menor importancia (ejemplo: el raspando de una rodilla). Los reportes del accidente o el incidente serán tramitados como lo solicita la OSHA (La Administración de Seguridad y Salud en el Trabajo).
Solamente los conductores con licencia podrán manejar el equipo motorizado.

Días Festivos
Se les pagarán a todos los empleados de tiempo completo los seis días festivos siguientes:
Día de Año Nuevo Día del Trabajo
Día de los Soldados Caídos Día de dar Gracias
Día de la Independencia Día de Navidad
Cuando un día de fiesta cae en sábado o domingo, si un empleado ha trabajado las 40 horas regulares durante la semana anterior, al empleado le serán pagadas ocho horas del día de fiesta además de las 40 horas regulares. Las horas de enfermedad justificadas se incluirán en las horas regulares trabajadas solamente para este caso.
Para que un día de fiesta le sea pagado a un empleado, el empleado debe trabajar el día regular anterior al día festivo y el día regular después del día festivo.
Los días de vacaciones se pueden utilizar conjuntamente con los días de fiesta.
Vacaciones
XXXXXXXXXX Services, Inc., le da tiempo de vacaciones pagadas a todos los empleados regulares de tiempo completo. Después de un año de servicio continuo, un empleado puede tomar una semana de vacaciones. Después de dos años de empleo, un empleado puede tomar dos semanas de vacaciones. Después de cinco años de servicio, un empleado puede tomar tres semanas de vacaciones. Después de diez años de empleo, un empleado puede tomar cuatro semanas de vacaciones.
En su aniversario de contratación, un empleado podrá pasar no más de una semana de vacaciones para usarlas en el siguiente año.
Los empleados deben avisar a su supervisor tan pronto como sea posible, las fechas en que quieren tomar sus vacaciones. El aviso debe darse con un mínimo de anticipación de un mes. Para decidir si un empleado puede salir de vacaciones, además de que tenga derecho a tomarlas, se considerará su tiempo en el empleo, las cargas de trabajo actuales y se respetaran otros empleados de un departamento que hayan solicitado sus vacaciones con mas anterioridad.
Si un día festivo pagado cae dentro de un período de vacaciones, al empleado no se le cargará un día de vacaciones por el día festivo.
Ausencias y Retrasos
La ausencia al trabajo se define como el no avisar que no se presentará al trabajo o el no permanecer en el trabajo como ya había sido programado. La ausencia incluye todo tiempo perdido fuera del trabajo sin importar que la ausencia sea justificada o no, ni que se haya podido evitar o no. La ausencia no justificada es cuando el empleado no le notifica a su supervisor que va a faltar antes de su tiempo programado de trabajo.
Se define como retraso cuando un empleado no llega a trabajar a la hora normal de inicio de labores programada y no está en su lugar de trabajo a la hora apropiada (ver horarios de trabajo).
Si un empleado llega tarde constantemente, es decir, que tiene tres retrasos repetidos dentro de un período de doce meses, se hace acreedor a una acción disciplinaria y que pueden ser hasta la causa de despido inmediata.
Si un empleado tiene una ausencia no justificada al trabajo, al empleado no se le pagará por el tiempo que no trabajó. Las ausencias no justificadas repetidas se consideran como bases para una acción disciplinaria y pueden hasta causar la terminación inmediata.
Cuando un empleado no puede presentarse a trabajar al inicio de su turno, tiene por fuerza que contactar a su supervisor por lo menos una hora antes del turno y no más de quince minutos después de su hora de entrada. El empleado deberá hablar directamente con su supervisor o con el supervisor temporal (si su supervisor está ausente). No serán aceptados los mensajes telefónicos de voz, ni tampoco que los miembros de la familia sean los que llamen. El empleado deberá informar al supervisor que no se presentará a trabajar ese día o que va a llegar tarde. Debe dar las razones por las cuales no va a ir a trabajar o por las que va a llegar tarde y a que horas va a llegar o espera volver al trabajo.
Si un empleado tiene ausencias injustificadas por tres días consecutivos sin notificar a su supervisor, quedará terminado el empleo del individuo. Esta terminación será considerada voluntaria por parte del empleado y será considerada abandono de trabajo.
Días de Enfermedad y Días Personales
La razón de los “días de enfermedad” es proteger al empleado contra pérdidas de salario causadas por enfermedades o lesión leves, por lo tanto, no se deben de utilizar esos días para otras cosas que no sean los que se explican en este manual.
Después de terminado en forma exitosa el período de prueba de los 30 días, los empleados adquieren cinco días de enfermedad pagados por año. Los días de enfermedad son pagados en base al pago regular del empleado. Si el empleo con XXXXXXXXXX Services, Inc., se termina por cualquier razón, no le serán pagados al empleado los días de enfermedad que no haya usado.
Es la intención de la compañía que esos días se utilicen solamente para esas situaciones a veces inevitables que no permiten que un empleado venga trabajar, tales como: (1) enfermedad del empleado, (2) una enfermedad en la familia, (3) automóvil descompuesto, (4) cosas personales, etc. Al empleado se le paga la cantidad diaria regular por los días usados. Aunque el uso de estos días puede ser casi por cualquier razón, el uso de estos días deberá notificarse a la compañía. Uso de emergencia: Cuando un empleado se enferma o tiene una emergencia, el supervisor del empleado debe ser notificado una hora antes del cambio de turno y no más de quince minutos después de su hora de entrada. Si el empleado esta demasiado enfermo, y la notificación no se puede hacer durante el término señalado, la notificación debe hacerse lo antes posible. Uso de no emergencia: Cuando se usan estos días por razones que no son de enfermedad, tales como para cosas personales o vacaciones, el empleado debe solicitar y recibir la aprobación de su supervisor lo mas anticipado como sea posible.
Permiso de Ausencia de Compasión
Después de haber terminado su período inicial de prueba, los empleados pueden obtener tres días pagados consecutivos en caso de que haya habido una muerte en su familia inmediata. La familia inmediata comprende esposo o esposa, hijos, padres, hermanos, suegros, abuelos y tíos del empleado. Para otros parientes, el otorgamiento del permiso lo determinará el supervisor del empleado.
Permiso Familiar y Médico
XXXXXXXXXX SERVICES, INC., concederá Permisos Familiares y Médicos por las razones especificadas en el Acta Federal de Ausencias Familiares y Médicas (FMLA) por un término de hasta doce semanas de trabajo por cada período de doce meses.
Elegibilidad
Un empleado debe haber sido empleado por la Compañía por lo menos un año (doce meses) y haber trabajado por lo menos 1,250 horas durante ese año para ser elegible a un Permiso Familiar y Médico.
Debe haber Razones Calificables para que se otorguen los Permisos Familiares y Médicos
Las Razones Calificables para solicitar Permisos Familiares y Médicos incluyen lo siguiente:
a) el nacimiento de un hijo del empleado
b) la adopción o la adopción temporal de un niño por el empleado;
c) para cuidar para un esposo, un hijo o un padre enfermo si el individuo tiene una enfermedad seria; o
d) enfermedad o condición seria de salud de un empleado.
Una condición seria de salud de un empleado es:
la necesidad de cuidado dentro de un hospital, hospicio o un lugar residencial de asistencia médica.
tratamiento continuo por un profesional de cuidados médicos, o
que la condición crónica de un empleado no le permita realizar sus deberes de trabajo, o
la maternidad, que médicamente no permita que una empleada realice sus deberes asignados de trabajo.
Proceso para solicitar Permisos Familiares y Médicos
Si se puede prever la necesidad de un Permiso Familiar y Medico, el empleado necesita dar el aviso por lo menos treinta días antes. Sin embargo, si el empleado no puede dar aviso antes de los treinta días, entonces deberá proporcionar el aviso tan pronto como sea posible.
Las solicitudes de Permisos de Familiares y Médicos deben hacerse por escrito, usando la forma especial que se obtiene en la oficina de Recursos Humanos.
Si el permiso se debe a una enfermedad o lesión del empleado, o si el empleado está solicitando el permiso para cuidar a un miembro enfermo de su familia, se requerirán pruebas o la “certificación” de la necesidad del permiso de acuerdo con la ley.
Si es aprobada la petición del permiso, la Compañía requerirá una nueva certificación cada 3 semanas mientras el empleado continúe ausente.
Si la Compañía tiene duda sobre la validez de la certificación, la Compañía podrá requerir a su propio costo, una segunda opinión por parte de un médico que esté aprobado por ella, pero que no sea empleado regular de la empresa.
Condiciones del Permiso Familiar y Médico
Si el permiso se usa debido al nacimiento de un hijo del empleado o debido a la adopción o la adopción temporal de un niño por el empleado, el permiso deberá tomarse durante el mes que siga al nacimiento o la adopción del niño.
El Permiso Familiar y Médico no es un permiso pagado. Aunque la Compañía no requerirá que el empleado utilice su tiempo de vacaciones o sus días de enfermedad, el empleado tendrá derecho a decidir si utiliza esos días junto con el Permiso Familiar y Médico.
La Compañía continuará pagando la parte que le corresponde del programa del seguro médico durante un Permiso Familiar y Médico. Si el empleado es responsable de pagar su porción del plan de seguro médico, es importante que el empleado continúe haciendo los pagos de su porción durante el período del permiso. El pago debe hacerse el primer día de cada mes. Si su pago se retasa, XXXXXXXXXX Services, Inc., le enviará un aviso al empleado informándole que su cobertura médica se perderá si transcurren 30 días de la fecha en que se debió haber pagado el seguro.
Al final del Permiso Familiar y Médico, el empleado será reinstalado en el puesto que tenía cuando fue aprobado el Permiso Familiar y Médico o le será dada una posición de empleo equivalente con prestaciones, pago y condiciones semejantes.
Si el empleado no vuelve al trabajo al final del Permiso Familiar y Médico, la Compañía requerirá el reembolso de las primas del seguro médico que pagó a favor del empleado durante el período del permiso. El reembolso no será requerido si el empleado no regresa a trabajar después del permiso debido a que la condición continúa, recurre, o se le presenta una seria condición de salud que evite que el empleado pueda hacer su trabajo.
Cuando coinciden el Permiso Familiar y Médico con el Seguro de Incapacidad del Trabajador, y el Seguro de Incapacidad del Trabajador permite que el empleado vuelva al trabajo bajo condiciones de “trabajo ligero”, y si hay disponible un puesto de trabajo ligero, el empleado puede rechazar volver al trabajo si un doctor no certifica que el empleado puede volver al trabajo bajo las reglas del Permiso Familiar o Médico. Sin embargo, si el empleado rechaza el trabajo ligero disponible, el empleado puede perder los beneficios del Seguro de Incapacidad del Trabajador.
Permisos personales
Cualquier ausencia al trabajo durante un tiempo extendido por razones que no son médicas se considerará permiso personal y deberá ser aprobado por la gerencia de XXXXXXXXXX Services, Inc. Los permisos personales se limitarán a cuatro semanas. Estos permisos se dan sin remuneración y el empleo no queda garantizado.
Presencia en Jurado
Siempre que algún empleado tenga que servir como miembro de un jurado durante horas de trabajo regulares, el empleado debe endosar su vale de pago de jurado a XXXXXXXXXX Services, Inc., y así recibir su pago regular. Los empleados de medio tiempo podrán recibir hasta dos semanas de su pago regular pero se descontará el pago de jurado de acuerdo a la ley del estado de Illinois. Los empleados de tiempo completo recibirán su sueldo normal menos el pago de jurado de acuerdo a la ley del estado de Illinois.
Deberes Militares
Si un empleado es un miembro de la reserva militar, deberá dar aviso por lo menos 30 días antes de ir a las prácticas de fin de semana, y al tiempo anual de entrenamiento. Al empleado se le permitirá volver a su misma posición, salario y tiempo acumulado de vacaciones. No habrá remuneración por el tiempo que el empleado esté fuera del trabajo.
Empleos Exteriores
El empleado debe comprender que su empleo con XXXXXXXXXX Services, Inc., es su responsabilidad primaria. El que el empleado tenga un segundo empleo exterior no será excusa para que no trabaje bien, se ausente, llegue tarde o se niegue a trabajar horas extras. Si el empleo exterior causa o contribuye a cualquiera de estas situaciones, el segundo empleo del empleado debe discutirse con la gerencia de XXXXXXXXXX Services, Inc.
Confidencialidad
XXXXXXXXXX Services, Inc., trata de proteger la confidencialidad de cada empleado. Los supervisores están instruidos a no divulgar información sobre un empleado y deben pasar las llamadas telefónicas que buscan tal información a la oficina de personal. A la vez, XXXXXXXXXX Services, Inc., espera que los empleados también protejan los asuntos confidenciales de la Compañía. Queda prohibido que los empleados compartan información sobre la Compañía con personas que no sean empleados de ella. Los empleados deben mantener como confidencial toda la información sobre la Compañía, incluyendo nombres de sus clientes, e informar a la oficina de personal toda pregunta que les hagan referente a los negocios de la compañía.
Uso y Abuso de Sustancias
El uso y abuso del alcohol y drogas en el trabajo plantea una amenaza seria a los compañeros trabajadores y a XXXXXXXXXX Services, Inc.
La posesión, el uso o venta de alcohol, drogas no autorizadas o ilegales o el mal uso de medicamentos legales en terrenos de XXXXXXXXXX Services, Inc., o mientras se están desempeñando negocios de Compañía queda prohibido y es base para el despido inmediato.
Todos los aspirantes a empleo deben someterse a un análisis de drogas antes de comenzar su empleo y si fallan la prueba, les será negado el empleo.
Si hay razón para que un supervisor sospeche que un empleado está bajo influencia de drogas o del alcohol que perjudiquen su juicio, desempeño o comportamiento estando en terrenos de XXXXXXXXXX Services, Inc., o al estar desempeñando negocios de la compañía, se le pedirá al empleado que se someta a una prueba de la drogas o alcohol. Si el empleado falla la prueba o rehúsan tomar la prueba, XXXXXXXXXX Services, Inc., considerará esto como suficiente razón para el despido inmediato.
Para mantener una planta libre de drogas y armas, XXXXXXXXXX Services, Inc., se reserva el derecho de revisar a todo empleado que entra a la planta y de revisar las áreas de equipo y almacenamiento. En adición a la prueba de las drogas que se hace antes de dar el empleo, XXXXXXXXXX Services, Inc., se reserva el derecho de revisar espontáneamente para drogas o alcohol.
Todo empleado será responsable de avisar con oportunidad a la gerencia de XXXXXXXXXX Services, Inc., sobre el uso de cualquier medicamento recetado, que pudiera afectar su juicio, desempeño o comportamiento.
Solicitación Entre Empleados
Queda prohibida la solicitación de un empleado de otro durante las horas de trabajo, cuando la persona que esta solicitando y la persona que esta recibiendo la solicitación tienen que estar haciendo sus deberes de trabajo. Queda prohibido en todo momento la distribución de material de publicidad, papeletas y otra literatura en terrenos de la compañía. No se les permitirá a los empleados el acceso a la planta o a otras áreas de trabajo durante sus horas de descanso.
Uso y Cuidado de Vehículos
Todo empleado que opere un vehículo con placa comercial (camión) propiedad de o controlado por XXXXXXXXXX Services, Inc., debe tener una licencia de manejo válida CDL (comercial).
Todo empleado que maneje o tenga supervisión sobre la operación de cualquier vehículo de la Compañía, tiene la responsabilidad:
a. del vehículo.
b. la seguridad de la carga y de los pasajeros.
c. peligros físicos.
d. vehículos de seguridad.
e. reportar accidentes.
g. manejar en forma defensiva.
El empleado es responsable de toda su propiedad personal que lleve en cualquier vehículo de la Compañía.
Si un empleado que conduce un vehículo con placas se ve implicado en un accidente, el empleado deberá llamar inmediatamente al departamento del policía y notificar sobre el accidente. Después de contactar a la policía, el empleado deberá llamar a XXXXXXXXXX Services, Inc., y reportar el accidente a la gerencia de la Compañía. Todos los accidentes, robos, vandalismos y daños a un vehículo necesitan reportarse a la gerencia de la compañía.
Si un empleado golpea un coche estacionado u objetos y obstáculos inmóviles, el empleado debe reportar el hecho de inmediato a la policía y deberá intentar localizar al dueño del vehículo o del objeto. Si el empleado no puede localizar al dueño, le deberá dejar una nota en un lugar visible dando su nombre y dirección, el nombre de la Compañía y una breve descripción del accidente.
Un empleado que no reporte algún accidente que involucre un vehículo de la compañía puede ser despedido de inmediato.
Los empleados que sean culpables en un segundo accidente dentro de un período de seis meses, serán considerados como repetidores de accidentes. Los repetidores de accidentes podrán recibir una carta de amonestación o ser despedidos de inmediato, dependiendo de la severidad de los accidentes.
Uso y Cuidado del Equipo
Se espera que los empleados sean extremadamente cuidadosos al usar el equipo propiedad de XXXXXXXXXX Services, Inc., y que utilicen el equipo solamente para los usos autorizados. La negligencia en el uso y cuidado del equipo propiedad de XXXXXXXXXX Services, Inc., puede considerarse causa de despido.
El retirar propiedad de XXXXXXXXXX Services, Inc., de sus terrenos, o su conversión al uso personal será considerado como causa de despido inmediato y acusación ante las autoridades.
Todo empleado que se demuestre haber tenido conocimiento de hurto o vandalismo de propiedades de XXXXXXXXXX Services, Inc., y que no lo haya reportado a la gerencia de XXXXXXXXXX Services, Inc., será despedido.
Se documentarán todo tipo de daños a equipo causados por un empleado y los documentos se mantendrán en el archivo personal del empleado. Estos documentos se considerarán durante revisiones de desempeño personal.
Procesos Disciplinarios
El propósito primario del sistema disciplinario es corregir conducta incorrecta.
Cuando un empleado viola alguna política o regla de XXXXXXXXXX Services, Inc., el supervisor podrá seguir el siguiente proceso:
Primera violación: Advertencia verbal documentada.
Segunda violación: Una advertencia formal por escrito detallando la ofensa, y a discreción del supervisor una suspensión de hasta por tres días sin pago.
Tercera violación: El empleado será despedido del empleo en XXXXXXXXXX Services, Inc.
Un empleado puede ser despedido en cualquier momento y sin considerar los pasos anteriores, si a juicio del supervisor, el empleado ha cometido una ofensa que pueda perjudicar el bienestar de XXXXXXXXXX Services, Inc., o cualquiera de sus empleados.
La gerencia de XXXXXXXXXX Services, Inc., debe aprobar cada despido.
Resolución de Conflictos
XXXXXXXXXX Services, Inc., mantiene la política de “puerta abierta.” Se les pide a los empleados que tengan quejas o desacuerdos de asuntos de trabajo o el empleo para que intenten resolver estos problemas, discutiéndolos con su supervisor o con uno de los dueños de la Compañía si es que hay un conflicto con el supervisor. Un empleado que tenga un problema relacionado con el trabajo debe reportar el problema con su supervisor. No debe haber temor o miedo a las represalias en ninguna etapa del proceso. El supervisor debe intentar encontrar solución al asunto discutiendo el problema con el empleado.
La intención de este programa es para obtener un foro donde las quejas se pueden resolver equitativamente, de forma consistente y de manera constructiva. Esta política ayuda pero no reemplaza a cualquier otra política con la que el problema pueda tener relación.
Declaración de Acoso
Creemos que el respecto mutuo es una característica esencial de un lugar de trabajo productivo. Por esa razón, XXXXXXXXXX Services, Inc., prohíbe todas las formas de acoso y hostigamiento ilegal a los empleados por parte de los supervisores y gerentes, compañeros de trabajo, empleados de proveedores externos o visitantes. Cualquier forma de acoso o hostigamiento que tenga que ver con la raza de un empleado, su color, sexo, religión, origen nacional, impedimento percibido o verdadero, estado civil o estado militar, es una violación de esta política, y serán tratado de forma disciplinaria.
Para estos propósitos, el término “hostigamiento o acoso” incluye, pero no se limita a, las burlas, bromas, conducta gráfica o física referente a la raza de un individuo, su color, sexo, religión, origen nacional, edad, impedimento percibido o verdadero, estado civil o estado militar.
El hostigamiento también incluye los avances sexuales, la solicitud de favores sexuales, y cualquier otra conducta verbal, gráfica, o física de una naturaleza sexual.
El no mantenerse dentro del compromiso de XXXXXXXXXX Services, Inc., de crear un lugar de trabajo libre de hostigamientos y acosos, resultará en una acción disciplinaria, y pudiendo hasta causar el despido.
El papel que tienen los empleados en mantener un Ambiente de Trabajo Libre de Hostigamiento y Acoso
Cada empleado debe compartir la responsabilidad con la gerencia en mantener un ambiente del trabajo libre de hostigamiento. Si usted se siente acosando o hostigado, o presencia el hostigamiento a otro empleado, por parte de un supervisor, otro empleado, un proveedor, o por un visitante debido a su raza, color, sexo, religión, origen nacional, edad, impedimento percibido o verdadero, estado civil o estado militar, si es posible, primero haga saber a la persona que esta acosando de sus objeciones. Si usted encuentra difícil de hacer así pues, o sus objeciones, y si estas no producen resultados, usted debe reportar cuanto antes sobre el problema a uno de los dueños.
Se Prohíben las Represalias
XXXXXXXXXX Services, Inc. prohíbe las represalias contra cualquier empleado que rechace, proteste o se queje del hostigamiento. Si usted siente represalias por haber estado inconforme con el hostigamiento, por favor contacte a su supervisor o a alguno de los dueños tan pronto como sea posible.
Política de Fumar
La política de fumar de XXXXXXXXXX Services, Inc., es que no se permitirá fumar en todo terreno de la Compañía con excepción de las dos áreas de fumar que se describen abajo. Las zonas para fumar son:
1. Fuera del edificio 3259 por la puerta donde hay una urna de cenizas pegada al edificio.
2. Fuera del edificio 3301 por la puerta donde hay una urna de cenizas pegada al edificio.
Toda persona que sea vista fumando fuera de estas áreas podrá ser despedida de inmediato.
Política de Software e Internet
En XXXXXXXXXX Services, las computadoras y el software que se utilizan son herramientas importantes del negocio. Todos los empleados necesitan ayudarnos a mantener la integridad de estos sistemas cumpliendo con las siguientes reglas:
1. Los empleados no deben cargar o descargar ningún “plug-ins”, “add-on” o software a ninguna computadora que sea propiedad de la compañía, a menos de que sean aprobados de forma específica por el gerente de sistemas o un dueño de la compañía.
2. El Internet es una herramienta de trabajo, y se debe utilizar solamente para propósitos relacionados con los negocios.
3. Ningún empleado deberá esperar privacidad durante su uso del Intranet o el Internet, y XXXXXXXXXX Services, Inc., se reserva el derecho de supervisar y de grabar todo uso del Internet.
4. Ningún empleado puede utilizar las computadoras de la compañía para que a sabiendas descargue o distribuya software o datos pirateados, para propagar deliberadamente todo tipo de, gusanos, Trojans o código de programa de trampa, o con conocimiento marcar o sobrecargar cualquier sistema informático o red, o evitar cualquier sistema instalado para proteger la privacidad o la seguridad de otro usuario.
5. La exhibición de de todo tipo de imágenes sexualmente explícitas o documentos en cualquier sistema de la compañía es una violación a las políticas de Hostigamiento y Acoso de XXXXXXXXXX Services, Inc. No deberán archivarse, guardarse, distribuirse, editarse o grabarse información sexual explícita usando la red y otros recursos de computación de XXXXXXXXXX Services, Inc.
6. Nunca se deberán utilizar los recursos de computación de la Compañía para violar las leyes y los reglamentos de los Estados Unidos o de cualquier otra nación, o las leyes de cualquier estado, ciudad, provincia u otra jurisdicción local.
La violación a cualquiera de las reglas enumeradas arriba puede ser motivo de acción disciplinaria, y hasta puede causar el despido.
AVISO
Estas políticas de Personal se han bosquejado como pautas y guías, no deben ser interpretadas como un contrato entre XXXXXXXXXX Services, Inc., y sus empleados. Estas políticas reemplazan todas las políticas anteriores, y las políticas y los beneficios descritos quedarán sujetos al cambio o la revocación en cualquier momento y sin previo aviso.
A menos que haga mención, estas políticas se aplicarán a todos los empleados, tanto los de tiempo completo y los de medio tiempo, pero no a los contratistas independientes, a los voluntarios, o a los empleados de otros patrones que realicen trabajos para XXXXXXXXXX Services, Inc.
La firma del empleado confirma que el empleado ha leído, entiende y esta de acuerdo en seguir las reglas, lineamientos y los requerimientos de este manual. El empleado entiende que ni este manual de empleado ni cualquier oferta de trabajo por parte de la Compañía constituyen un contrato de empleo, y que ningún empleado de la Compañía tiene autoridad para entrar en un acuerdo de empleo por cualquier período de tiempo especificado o para hacer cualquier acuerdo contrario a esta política.
