CLAUSES
FIRST - Fixed Term Right to Build
1.1 BOGARIS undertakes in compliance with the conditions of the present Preliminary Contract to establish a fixed Term Right to Build over the NOV DOM PLOT in favor of NOV DOM, which entails NOV DOM’s right and obligation to build a CAR PARK and a SUPERMARKET under the brand name of NOV DOM. КЛАУЗИ
ПЪРВА – Срочно право на строеж
1.1 БОГАРИС се задължава, в съответствие с условията на този Предварителен договор, да учреди срочно право на строеж върху ИМОТА на НОВ ДОМ в полза НОВ ДОМ, което дружество се съгласява да приеме правото и да поеме задължението да построи, в „ИМОТА на НОВ ДОМ”, като стане собственик на Супермаркет с паркинг, който осъществява дейността си под търговската марка НОВ ДОМ. Правото на строеж ще бъде учредено за срок от 30 години и за изграждането на сграда, съгласно одобрен от компетентните органи Идеен проект, който ще бъде изготвен от НОВ ДОМ в съответствие с и в рамките на параметрите, посочени в Приложение 4 [Разположение и ситуационен план] и издадената Виза за проектиране, предоставена от БОГАРИС.
Срещу учреденото Право на строеж НОВ ДОМ ще заплати на БОГАРИС договорената покупна цена, посочена в Клауза 4.
