Source text - English PROPOSTA DI RISOLUZIONE IN MERITO ALLA CRESCENTE RICHIESTA IN SENO ALL’U.E. DI MISURE DI CONTROLLO E TUTELA DELLE ONG E DELLA LORO ATTIVITA’, VOLTE A LIMITARE LE CONTROVERSIE INTERNAZIONALI SUL RUOLO E LE FUNZIONI DI SUDDETTE ORGANIZZAZIONI.
Il Parlamento Europeo dei Giovani,
• Nel pieno rispetto dei principi generali delle ONG dell’Unione Europea sanciti nella Carta di Elewitt del 1995 che stabilisce:
- all’art. A1, la conformità in obiettivi e funzioni da parte delle ONG europee ai valori di giustizia sociale, equità e rispetto dei diritti umani;
- agli art. C3-7 la conformità di ciascuna ONG con le leggi di uno degli Stati Membri dell’Unione, nell’indipendenza decisionale del proprio organo amministrativo;
- all’art. C2, la natura non remunerativa delle ONG europee;
- agli art. A3, B7-8, il dovere di coinvolgere la società civile nella cooperazione allo sviluppo e nel raggiungimento della giustizia sociale, promuovendo la collaborazione fra i diversi settori della società stessa;
• vista la “Convenzione Europea sul riconoscimento della personalità giuridica delle organizzazioni non governative internazionali” (Strasburgo 1986), che ribadisce:
- art. 1, lo scopo non lucrativo delle organizzazioni non governative europee e la stabilità rappresentativo - amministrativa delle stesse nei territori dei rispettivi paesi;
- art. 2, l’estensione del riconoscimento della personalità giuridica acquisita nel paese in cui hanno sede i rispettivi uffici regolamentari agli altri Stati Membri dell’Unione;
- art. 3, l’integrazione della prova di acquisizione di personalità e competenza legale con documenti che definiscano l’autorizzazione amministrativa, la registrazione o qualsiasi altra forma di pubblicità da parte dello Stato, che le garantisca;
• viste le considerazioni del CEDAG (Comité européen des associations d’intérêt général) sulla costruzione di un miglior partenariato tra Commissione Europea ed ONG, evitando una definizione restrittiva di ONG nel rispetto delle diversità del settore associativo;
• visto il documento di lavoro della Commissione Europea “la Commissione e le Organizzazioni non Governative: rafforzare il partenariato”, che sancisce:
- il riconoscimento della necessità di definire una strategia più coerente nei suoi rapporti con le ONG, nel mantenimento e sviluppo delle migliori pratiche esistenti nei diversi settori;
- la garanzia di debita esperienza nel settore ONG di eventuali organismi intermediari di cui la Commissione decida di servirsi;
- le garanzie finanziarie nelle condizioni cui sono subordinate le sovvenzioni concesse alle ONG;
• viste le disposizioni attualmente in vigore nei singoli Stati Membri dell’Unione Europea, ed in particolare:
1. in Italia:
a) legge 49/87 (26 febbraio);
- art. 28, sul riconoscimento d’idoneità alle ONG italiane;
- art. 29, sugli effetti d’idoneità, tra cui le modalità di concessione dei contributi e dei finanziamenti e la determinazione dei relativi importi, stabilite con apposita delibera di un Comitato direzionale, sentito il parere della Commissione per le Organizzazioni non Governative italiane;
- art. 32.1, sull’impiego da parte delle ONG, nell’ambito di programmi riconosciuti conformi alle finalità della legge, ove previsto nei programmi stessi, di cooperanti cittadini italiani maggiorenni in possesso delle conoscenze tecniche, dell’esperienza professionale e delle qualità personali necessarie;
- art. 37.4, sugli stanziamenti;
b) Decreto del Presidente della Repubblica del 12/04/1988 n. 177 (DPR 177/88);
- Titolo I - art. 3, sulla creazione della Commissione italiana per le Organizzazioni non Governative;
- Titolo V/Capo1 - art. 39, sui settori utili per il riconoscimento d’idoneità;
- Titolo V/Capo1 - art. 40, sulla documentazione e prerequisiti necessari al riconoscimento d’idoneità, tra cui l’obbligatorietà di uno statuto interno all’organizzazione stessa;
- Titolo V/Capo1 - art. 41, sulle procedure per il riconoscimento d’idoneità;
- Titolo V/Capo1 - art. 42, su revoca d’idoneità e (comma 4) relazione annuale di aggiornamento da parte della Direzione generale del Ministero degli Affari Esteri sulle organizzazioni non governative riconosciute idonee;
- Titolo V/Capo2 - art. 43, sulla conformità di obiettivi, programmi ed iniziative delle ONG alle finalità della legge;
- Titolo V/Capo2 - art. 44, sulle modalità di concessione dei contributi alle ONG ritenute idonee dalla Commissione;
- Titolo V/Capo3 - art. 51.1-2, sui compiti della rappresentanza italiana in merito ai cooperanti;
c) visto il D.M. 337 del15/09/2004,
- art. 1, sull’esame e l’approvazione dei rapporti delle ONG;
- art. 3, sulla certificazione antimafia;
- art. 4, sull’esame e l’approvazione dei rapporti ONG relativi ai progetti in corso;
d) visto il D.M. 544 del 28/11/1993, sul trasferimento di competenza dei processi pendenti in relazione alle ONG nei paesi dell’ex - Jugoslavia alla giurisdizione di un tribunale internazionale;
2. in Spagna:
a) legge 23/98 del 7 luglio,
- capitolo I sez. 2.0, sulla determinazione dei principi, degli obiettivi e delle priorità della politica spagnola per lo sviluppo;
- capitolo III sez. 1.0, sull’attribuzione delle competenze degli organi esecutivi sulla definizione, formulazione ed esecuzione della politica spagnola per lo sviluppo;
- capitolo VI sez. 10, sulla disposizione del principio di progresso statale nella cooperazione non governativa, della definizione delle organizzazioni private di cooperazione allo sviluppo, della prescrizione delle modalità di aiuti e sovvenzioni, e della dichiarazione della necessità di pubblicizzazione e sensibilizzazione pubblica in merito alle suddette organizzazioni di cooperazione non governativa;
b) Real Decreto 993/1999 dell’11 giugno,
- art. 2, sull’obbligatorietà dell’appartenenza al registro spagnolo ONG per l’ottenimento di aiuti e sovvenzioni;
- art. 4, sui prerequisiti e le procedure per il riconoscimento d’idoneità e l’iscrizione al registro;
- art. 5, sulle procedure d’iscrizione e gli effetti d’idoneità, stabiliti e supervisionati dal Ministero degli Affari Esteri;
3. in Inghilterra:
a) Charities Act 2006,
- art. 1.1, sulla definizione di ONG (charity);
- art. 6.1.1A.1, sull’istituzione della Charity Commission, organo non governativo avente il compito di riunire e tutelare le ONG inglesi registrate con riconoscimento d’idoneità;
- parte 1A, sez. 2A-B-C, sull’istituzione di un tribunale nazionale interno alla Charity competente in materia di ONG, e di un tribunale d’appello ad essa esterno ed inerente al controllo giuridico della Commission stessa;
4. in Francia:
a) legge 99/014 del 22 dicembre 1999,
- capitolo III – art. 12, sull’organizzazione e le attività delle ONG francesi, soggette a controlli da parte di organi competenti interni ed esterni sui registri ed i rapporti finanziari;
- capitolo III – art. 13, sul dovere di fornire adeguata informazione pubblicitaria sulla struttura, le funzioni, le attività e gli obiettivi da parte di ciascuna organizzazione;
- capitolo III – art. 17.2, sull’assunzione e la gestione del personale;
- capitolo V – art. 27, sulle sanzioni penali, la revoca d’idoneità e la sospensione della rappresentanza amministrativa delle organizzazioni in questione;
5. In Germania:
a) (da aggiornare)
• Considerati i recenti avvenimenti concernenti l’ONG “Arche de Zoé”, il problema del controllo e della tutela delle ONG e del loro funzionamento;
• Considerati gli obiettivi di sviluppo millennio (MDG) elaborati in seno all’ONU nei quali si afferma il ruolo indispensabile delle ONG nello sradicare povertà estrema e fame; garantire l’educazione primaria universale; combattere l’HIV; garantire la sostenibilità ambientale; sviluppare un partenariato mondiale per lo sviluppo (punti 1, 2, 6, 7, 8);
• Considerati i rapporti all’ONU redatti da parte di un “High level panel of eminent people”(12/2004) e dall’ex segretario generale Kofi Annan (03/2005) nei quali si richiede una rappresentanza consultiva delle ONG all’ONU;
• Considerato il rapporto n°2250 concernente i lavori della missione di informazione costituita l’11 febbraio 2004 sulle ONG francesi in cui si richiedono: un dialogo con le maggiori ONG per l’elaborazione di un nuovo trattato in merito di statuto, finanziamenti e fiscalità; un partenariato con il mondo delle imprese; la remunerazione ufficiale e a prezzo di mercato di dirigenti e professionisti che lavorano nelle ONG; la creazione di una missione parlamentare sulla cooperazione decentralizzata; l’obbligo di rapporti annuali al parlamento; la promulgazione di uno statuto giuridico europeo delle ONG; la definizione di una procedura unica di accreditamento presso le istituzioni internazionali; la creazione di un’assemblea consultiva mondiale delle ONG all’ONU; l’”utilità pubblica” quale criterio indispensabile per il riconoscimento di idoneità; un miglioramento dei tempi burocratici;
• Considerata la richiesta del francese “Comité économique et social” riunitosi il 13 luglio 2000 di seminari di informazione, nonché di una maggiore cooperazione fra gli organi dell’UE;
• Considerate le richieste della Associazione italiana “Solidar” di adottare il principio di concorrenza fra le ONG e dell’obbligo di iscrizione delle suddette ad albi sopranazionali e all’Associazione ONG italiane;
• Considerate le richieste della Associazione ONG Italiane di incremento delle risorse per la cooperazione internazionale allo 0,33% del PIL (in vista dello 0,7% previsto dall’ONU negli MDG) e di definizione di vincoli e regole nell’utilizzo dei fondi;
• Considerate le richieste delle associazioni delle ONG di Spagna e Germania di incrementare il dialogo con le istituzioni, nonché dell’adozione di norme trasparenti che prevedano diritti e doveri del processo di decision making;
dispone:
1. la creazione di un unico organo europeo di rappresentanza e controllo delle ONG, garantendo in questo modo maggiore trasparenza sul loro operato e costituendo al contempo un luogo internazionale di scambio e arricchimento reciproco;
2. una rappresentanza consultiva delle ONG all’ONU;
3. una chiara distinzione dei ruoli (da stabilirsi in seno all’UE) tra gli organi europei preesistenti in merito di giustizia e fiscalità;
4. la necessità di una maggiore cooperazione fra gli organi dell’UE;
5. la divisione fra ONG internazionali e ONG operanti prevalentemente nel paese di appartenenza, così da garantire alle prime un ruolo di maggiore rilevanza nel dialogo internazionale, valorizzando al contempo la funzione delle seconde su scala locale;
6. l’adozione di norme trasparenti che prevedano diritti e doveri del processo di decision-making, cui possano partecipare le suddette ONG a carattere internazionale, unitamente con le Associazioni nazionali delle ONG;
7. l’obbligo di iscrizione di tutte le ONG ad albi sopranazionali e all’associazione nazionale, garantendo così un’ulteriore forma di controllo ma anche di dialogo e cooperazione fra le diverse organizzazioni;
8. l’adozione di un unico statuto giuridico e di uniche procedure di accreditamento validi per tutte le ONG;
9. l’obbligo di pubblicazione del bilancio e sua verifica da parte di un revisore esterno, nonché l’obbligo di pubblicazione di opuscoli e riviste informative in merito all’operato dell’ONG;
10. la necessità di instaurare un partenariato con il mondo delle imprese diversificando le fonti di sostegno finanziario e garantendo l’eterogeneità dei rapporti;
11. l’obbligo da parte delle ONG di avere al loro interno sia volontari sia professionisti;
12. il prezzo di mercato per la remunerazione di dirigenti e professionisti;
13. la necessità di garantire da parte dei singoli stati un rapporto minimo aiuti allo sviluppo/PIL, nonché quale percentuale di questo debba essere assegnata alle ONG;
14. l’adozione del principio di concorrenza, basato sulla qualità e non sul minor prezzo, per i progetti presentati dalle ONG;
15. la realizzazione da parte dell’UE di una campagna di informazione e di sensibilizzazione della popolazione riguardo l’operato e il ruolo delle ONG in ambito nazionale e internazionale.
Translation - Italian PROPOSAL OF RESOLUTION REGARDING THE INCREASE WITHIN THE U.E. OF MEASURES OF CONTROL AND GUARDIANSHIP OF THE NGO’S AND THEIR ACTIVITIES DIRECTED TO. LIMIT THE INTERNATIONAL CONTROVERSIES ON THE ROLE AND FUNCTIONS OF THE AFORESAID ORGANIZATIONS.
The European Youth Parliament,
in full respect of the fundamental principles of the NGO of the European Union enacted in the Elewitt Declaration of 1995 which establishes
under art. A1, the conformity to the objectives and functions of the European NGOs regarding the values of social justice, equity and respect of human rights;
under arts. C3-7 the conformity to every NGO within the laws of the State Members of the Union, regarding the decisional independence of their own administrative entity;
under art. C2, the non-profitable nature of European NGOs;
under arts. A3, B7-8, the duty to involve the civil society in the cooperation of the development and in the attainment of the social justice, promoting the collaboration among the different sectors of the same society;
under the “European Convention” on the recognition of the juridical entity of the international non-government organizations” (Strasburg 1986), that confirms:
art. 1, the non-profitable purpose of the European non-governmental organizations and the stability representative/administrative of the same in the territories of the respective countries;
art. 2, the extension of the recognition of the legal entity acquired in the country in which they have respective regulatory offices in the other States Members of the Union;
art. 3, the integration of the text of acquisition of personality and legal competence with documents that define the administrative authorizition and registration or any other form of publicity from the State, which guarantees it;
given the considerations of the CEDAG (Comité européen des associations of intérêt général) on the construction of a good partnership among the European Committee and NGO, avoiding a restrictive definition of NGO in the respect to the differences of the associated sector;
given the official document of the European Committee and the non-Governmental Organizations: to strengthen their partnership”, which enacts:
the necessity to define a strategy more coherent with its relationships with the NGOs, in the maintenance and development of the best existing practices in the different sectors;
the guarantee of proper experience in the sector NGO of possible intermediary organisms which the Committee decides to use;
the financial guarantees under which the conditions granting subsidies to the NGOs are subject;
currently given the governing dispositions in the single Members of the European Union, and particularly:
in Italy:
law 49/87 (26 February);
art. 28, on the recognition of suitability of the Italian NGOs;
art. 29, on the effects of the suitability, among which the formalities of concession of the contributions and the financings and the determination of the relative amounts, established with special deliberation of a directive Committee, based on the opinion of the Committee for the Italian non-Governmental Organizations
art. 32.1, on the employment from the NGOs, within officially recognized programs conforming to the schemes of the law, where outlined in the programs themselves, of qualified and cooperative Italian citizens in possession of the technical knowledges, of the professional experience and of the required personal skills;
art. 37.4, on the appropriations;

Given the recent events related to the NGO “Arks de Zoé”, the problem of control and the guardianship of the NGOs and their operation;
Given the objectives of the millennium (MDG) development to elaborate in breast of the U.N. in which it affirms the essential role of the NGOs to eradicate extreme poverty and hunger; to guarantee universal primary education; to fight HIV; to guarantee an environmental sustainability; to develop a world partnership for development (stings 1, 2, 6, 7, 8);
Considered the relationships to the U.N. compiled from a “High level panel of eminent people”(12/2004) and from the former Secretary General Kofi Annan (03/2005) in which an advisory representation of the NGOs is required by the U.N.;
Given the relationship n°2250 concerning jobs of the mission of constituted information February 11 th 2004 on the French NGOs which required: a dialogue with the most greater NGOs for the elaboration of a new essay in worth of statute, financings and taxation; a partenership with the world of enterprises; the official remuneration and at the market price of executives and professionals that work in the NGOs; the creation of a parliamentary mission on the decentralized cooperation; the obligation of annual relationships to the parliament; the promulgation of an European juridical statute of the NGOs; the definition of an unique procedure of accreditation to the international institutions; the creation of a world advisory meeting of the NGOs to the U.N.; the ” public utility” as the essential criterion for the recognition of suitability; an improvement of the bureaucratic times;
Considered the application of French “Comité économique et social” gathered in 13 July 2000 through seminars of information, as well as a greater cooperation among the organs of the EU;
Considered the applications of the Italian Association “Solidar” to adopt the principle of competition among the NGOs and of the obligation of registration of the aforesaid entities on bulletin-boards and with the Italian NGO Association;
Considered the applications of the Italian NGO Association for the increase of the resources for the international cooperation to the 0,33% of the GNP (in 0,7% foreseen by the U.N. in the MDGs) and of definition of ties and rules in the use of the funds;
Considered the applications of the associations of the NGOs of Spain and Germany to increase the dialogue with the institutions, as well as of the adoption of transparent norms that foresee rights and duties of the process of decision making;
it outlines:
the creation of a single European organ of representation and control of the NGOs, guaranteeing in this way greater transparency on their operatikons and constituting at the same time an international place of exchange and mutual enrichment;
an advisory representation of the NGOs to the U.N.;
a clear distinction of the roles (set within the EU) among the pre-existing European organs in terms of justice and taxation;
the need for a greater cooperation among the organs of the EU;
the division between international NGO and working NGO primarily in the country of affiliation, so as to guarantee the first a role of greater importance in the international dialogue, valorizing at the same time the function of the later on a local level;
the adoption of transparent norms that foresee rights and duties of the process of decision-making, which can guarantee the aforesaid international NGO aspect, together with the national Associations of the NGOs;
the obligation of registration on all the international and national NGO association bulletin-boards, guaranteeing a further form of control but also of dialogue and cooperation among the different organizations;
the adoption of one juridical statute and only procedures of accreditation valid for all the NGOs;
the obligation of publication of the budget and verification from an external auditor, as well as the obligation of publication of brochures and informative magazines regarding NGO operations;
the need to establish a partnership with the world of enterprises diversifying the sources of financial support and guaranteeing the heterogeneity of the relationships;
the obligation of the NGOs to have both internal volunteers and professionals;
the price of the market for the remuneration of executives and professionals;
the need to guarantee on behalf of the single states a minimum rapport between development/GNP, as well as what percentage amou nt mus be assigned to the NGOs;
the adoption of the principle of competition, based on the quality and not on the lowest price, for the projects introduced by the NGOs;
the realization by the EU of a campaign of information and sensitivity of the population towards the role of the NGOs both at the national and international level.
