The States Parties to this Treaty
Reaffirming the importance and urgency of preventing an arms race in outer space and of approving concrete proposals on confidence building which could prevent such an arms race, as set out in United Nations General Assembly Resolutions 56/535 and 55/32 on the prevention of an arms race in outer space,
Recognizing the common interest of all humankind in the exploration and non-weapons use of outer space for peaceful purposes,
Reaffirming the will of all States that the exploration and use of outer space, including the Moon, the planets and other celestial bodies, shall be for weapons-free, peaceful purposes and shall be carried out for the benefit and in the interest of all countries, irrespective of their degree of economic or scientific development,
Reaffirming the provisions of articles III and IV of the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies, Resolution 2222(XXI), annex,
Recalling the obligations of all States to observe the provisions of the Charter of the United Nations regarding the use or threat of use of force in their international relations, including in their space activities,
Reaffirming paragraph 80 of the Final Document of the Tenth Special Session of the General Assembly, Resolution S-10/2, in which it was stated that in order to prevent an arms race in space further measures should be taken and appropriate international negotiations held in accordance with the spirit of the Treaty,
Reiterating that the Conference on Disarmament, as the single multilateral disarmament negotiating forum, has the primary role in the negotiation of a multilateral agreement or agreements, as appropriate, on the prevention of an arms race in outer space in all its aspects, as set out in United Nations General Assembly Resolutions 56/535 and 55/32 on the prevention of an arms race in outer space,
Affirming that it is the policy of the State Parties to this Treaty to permanently ban all space-based weapons,
Have agreed as follows:
Article I
PERMANENT BAN ON BASING OF WEAPONS IN SPACE
1. Each State Party to this Treaty shall:
(1) Implement a ban on space-based weapons; and
(2) Implement a ban on the use of weapons to destroy or damage objects in space that are in orbit; and
(3) Immediately order the permanent termination of research and development, testing, manufacturing, production, and deployment of all space-based weapons of such State Party.
2. Each State Party to this Treaty shall immediately work toward supporting other non-signatory State Parties in negotiating, signing, ratifying, and implementing this world agreement banning space-based weapons.
3. The Secretary General of the United Nations shall submit to the General Assembly of the United Nations within 90 days of the date that three (3) State Parties have signed this Treaty, and every 90 days thereafter, a report on:
1) The implementation of the permanent ban on space-based weapons required by Section 1 of this Article I; and
2) Progress toward negotiating, signing, ratifying, and implementing this Treaty as set out in Section 2 of this Article I.
4. Nothing in this Treaty shall be construed to prohibit the following activities, provided such activities are not related to space-based weapons:
(1) Space exploration;
(2) Space research and development;
(3) Testing, manufacturing or deployment that is not related to space-based weapons or systems; or
(4) Civil, commercial, or defense activities (including communications, navigation, surveillance, reconnaissance, early warning, or remote sensing) that are not related to space-based weapons or systems.
Article II
1. Each State Party to this Treaty undertakes not to base in space any object carrying nuclear weapons or any other kinds of weapons, including weapons of mass destruction, install such space-based objects or weapons on celestial bodies, or station such weapons in outer space in any other manner. The moon, the planets, and other celestial bodies shall be used by all States Parties to this Treaty exclusively for non-weapons, peaceful purposes. The establishment of weapons-related military bases, installations and fortifications, the testing of any type of weapons and the conduct of military maneuvers on celestial bodies or space-based objects shall be forbidden.
2. The use of military personnel for scientific research or for any other non-space-based weapons, peaceful purposes shall not be prohibited. The use of any equipment or facility necessary for peaceful exploration or habitation of the moon, the planets or other celestial bodies, or on objects in space shall also not be prohibited.
Article III
Each State Party to this Treaty undertakes not to assist, encourage or induce any State, group of States, international organization, or other entity or program to engage in activities contrary to the provisions of this Treaty.
Article IV
Each State Party to this Treaty agrees to the establishment, funding, equipping and deployment of an Outer Space Peacekeeping Agency, whose mission is to monitor outer space and enforce the permanent ban of space-based weapons under this Treaty.
Article V
As used in Article I, the terms:
1. The terms "space" and "outer space" mean all space extending upward from an altitude greater that 110 kilometers above sea level.
2. The terms "space-based weapon" and "space-based system" mean a device capable of damaging or destroying an object or person (whether in outer space, in the atmosphere, or on earth) by -
(1) Firing one or more projectiles to collide with that object or person;
(2) Detonating one or more explosive devices in close proximity to that object or person;
(3) Directing a source or energy against that object or person; or
(4) Any other undeveloped means.
Article VI
Each State Party to this Treaty undertakes to take any measures it considers necessary in accordance with its constitutional processes to prohibit and prevent any activity in violation of the provisions of the Treaty anywhere under its jurisdiction or control.
Article VII
1. The provisions of articles I and II of this Treaty shall apply to all States, regardless of whether such States are signatories to this Treaty.
2. Any State Party to this Treaty may propose amendments to the Treaty. The text of any proposed amendment shall be submitted to the Depositary who shall promptly circulate it to all States Parties.
3. An amendment shall enter into force for all States Parties to this Treaty, upon the deposit with the Depositary of instruments of acceptance by a majority of States Parties. Thereafter it shall enter into force for any remaining State Party on the date of deposit of its instrument of acceptance.
Article VIII
This Treaty shall be of unlimited duration.
Article IX
1. Two years after the entry into force of this Treaty, a conference of the States Parties to the Treaty shall be convened by the Depositary at Geneva, Switzerland. The conference shall review the operation of the Treaty with a view to ensuring that its purposes and provisions are being realized, and shall in particular examine the effectiveness of the provisions of articles I and II in eliminating the dangers of an arms race in space, and of space-based weapons.
2. At intervals of not less than two years thereafter, a majority of the States Parties to the Treaty may obtain, by submitting a proposal to this effect to the Depositary, the convening of a conference with the same objectives.
3. If no conference has been convened pursuant to paragraph 2 of this article within ten years following the conclusion of a previous conference, the Depositary shall solicit the views of all States Parties to the Treaty, concerning the convening of such a conference. If one-third or ten of the States Parties, whichever number is less, respond affirmatively, the Depositary shall take immediate steps to convene the conference.
Article X
1. This Treaty shall be open to all States for signature. Any State which does not sign the Treaty before its entry into force in accordance with paragraph 3 of this article may accede to it at any time.
2. This Treaty shall be subject to ratification by signatory States. Instruments of ratification or accession shall be deposited with the Secretary-General of the United Nations.
3. This Treaty shall enter into force upon the deposit of instruments of ratification by five (5) Governments in accordance with paragraph 2 of this article.
4. For those States whose instruments of ratification or accession are deposited after the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession.
5. The Depositary shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit of each instrument of ratification or accession and the date of the entry into force of this Treaty and of any amendments thereto, as well as of the receipt of other notices.
6. This Treaty shall be registered by the Depositary in accordance with Article 102 of the Charter of the United Nations.
Article XI
This Treaty, of which the English, Arabic, Chinese, French, Russian, and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to the Governments of the signatory and acceding States.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective governments, have signed this Treaty, opened for signature at __________ on the ____day of __________, two thousand and five.

Los Estados Parte a este Tratado
Reafirmando la importancia y la urgencia de prevenir una carrera armamentista en el espacio exterior y de aprobar ofertas concretas que fortalezcan la confianza capaz de prevenir tal carrera de armamentos, según lo precisado en las Resoluciones 56/535 y 55/32 de la Asamblea General de las Naciones Unidas en favor de la prevención de una carrera armamentista en el espacio exterior.
Reconociendo el interés común de toda la humanidad en la exploración y uso del espacio exterior para propósitos pacíficos;
Reafirmando la voluntad de todos los Estados en cuanto a que la exploración y uso del espacio exterior, incluyendo la luna, los planetas y otros cuerpos celestes, sean para propósitos pacíficos y libres de armas, y efectuados para el provecho y en el interés de todos los países, independientemente de su grado de desarrollo económico o científico,
Reafirmando las provisiones de los artículos III y IV del Tratado sobre los Principios que Gobiernan las Actividades de los Estados en la Exploración y Uso del Espacio Exterior, incluyendo la Luna y Otros Cuerpos Celestes, Resolución 2222(XXI), anexo.
Recordando las obligaciones de todos los Estados de observar las provisiones de la Carta de las Naciones Unidas respecto del uso o a la amenaza de uso de la fuerza en sus relaciones internacionales, incluyendo sus actividades en el espacio,

Reiterando que la Conferencia sobre el Desarme, como único foro multilateral para la negociación del desarme, ocupa la posición principal en la negociación de un acuerdo multilateral, o acuerdos, hacia la prevención de una carrera armamentista en el espacio exterior, en todos sus aspectos, tal y como lo establecen las Resoluciones 56/535 y 55/32 de la Asamblea General de las Naciones Unidas sobre la prevención de una carrera armamentista en el espacio exterior,
Afirmando que es política de los Estados Signatarios de este Tratado la prohibición permanente de todo armamento en el espacio.
Los Estados Signatarios acuerdan lo siguiente:
Artículo I - PROHIBICIÓN PERMANENTE DE LAS ARMAS EN EL ESPACIO
1. Cada Estado firmante de este tratado:
(1) Implantará la prohibición de armas con base en el espacio exterior;
(2) Implantará la prohibición del uso de armas para destruir o dañar objetos que están en órbita en el espacio; y
(3)Ordenará el inmediato y permanente final de la investigación, desarrollo, prueba, manufactura, producción, y despliegue de todas sus armas con base en el espacio;
2. Cada Estado Signatario de este Tratado trabajará inmediatamente en el apoyo de otros estados no signatarios en la negociación, firma, ratificación e implantación de este acuerdo a escala mundial para prohibir los armamentos con base en el espacio.
3. El Secretario General de las Naciones Unidas someterá a la Asamblea General de las Naciones Unidas en un plazo de 90 días a
partir de la fecha en la que tres (3) Estados Signatarios hayan firmado este Tratado, y cada 90 días en lo adelante, un informe sobre:
(1) La implantación de la prohibición permanente de las armas con base en el espacio requerida por la Sección 1 de este ArtículoI; y
(2) el progreso hacia la negociación, firma, ratificación, e implantación de este Tratado según lo establece la Sección 2 de este Artículo I.
4. Nada de lo contenido en este Tratado será interpretado con el fin de prohibir las siguientes actividades, siempre que no estén relacionadas a las armas con base en el espacio:
(1) La exploración del espacio;
(2) La investigación y desarrollo espacial;
(3) Las pruebas, manufactura o despliegue que no estén relacionados con armas o sistemas armamentistas en el espacio;
(4) Actividades civiles, comerciales, o de la Defensa (incluyendo comunicaciones, navegación, vigilancia, reconocimiento, alertas o detección remota) que no estén relacionadas con armas o sistemas armamentistas con base en el espacio.
Artículo II
1. Cada Estado Signatario de este Tratado se compromete a no establecer bases en el espacio para objeto alguno que acarree armas nucleares o cualesquiera otra clase de armas, incluyendo armas para la destrucción en masa; o instalar tales objetos o armas sobre cuerpos celestes, o estacionar tales armamentos en el espacio exterior de alguna otra manera. La luna, los planetas y demás cuerpos celestes serán utilizados por todos los Estados Signatarios de Este Tratado exclusivamente para propósitos que no estarán relacionados con el armamentismo y que serán enteramente pacíficos.
El establecimiento de bases militares relacionadas a las armas, de instalaciones y de fortificaciones, las pruebas de cualquier tipo de armas y la práctica de maniobras militares en cuerpos celestes o sobre objetos en el espacio, será prohibido.
2. El uso de personal militar para la investigación científica o para otros propósitos pacíficos que no estén relacionados a las armas en el espacio, no será prohibido. El uso de cualquier equipo o instalación necesaria para la exploración o habitación pacífica de la luna, los planetas o de otros cuerpos celestes, o de otros objetos en el espacio, tampoco será prohibido.
Artículo III
Cada Estado Signatario de este Tratado asume el compromiso de no ayudar, estimular o inducir a un estado, grupo de estados, organización internacional, o cualesquiera otra entidad o programa, a involucrarse en actividades contrarias a las provisiones de este Tratado.
Artículo IV
Cada Estado Signatario de este Tratado conviene en la necesidad de establecer, financiar, equipar y desplegar una Agencia para la Paz en el Espacio Exterior, cuya misión será supervisar el espacio exterior y hacer cumplir la prohibición permanente contra las armas con base en el espacio que establece este Tratado..
Artículo V
De acuerdo a su uso en este Tratado:
1. Los términos “espacio” y “espacio exterior” aluden al espacio que se extiende más allá de 110 kilometros sobre el nivel del mar.
2. Los términos “arma con base en el espacio” o “sistema con base en el espacio” se refieren a dispositivos capaces de dañar o destruir un objeto o una persona (ya sea en el espacio exterior, en la atmósfera, o en la tierra) por medio de –
(1) uno o más proyectiles disparados contra tal objeto o persona;
(2) la detonación de uno o más explosivos en estrecha proximidad a tal objeto o persona;
(3) la emisión de una fuente de energía contra ese objeto o persona; o
(4) cualesquiera otros medios que aún no han sido desarrollados.
Artículo VI
Cada Estado Signatario de este Tratado asume el compromiso de tomar las medidas que considere necesarias de conformidad con sus procesos constitucionales, para prohibir y para prevenir cualquier actividad que viole las provisiones del Tratado en cualquier lugar bajo su jurisdicción o control.
Artículo VII
1. Las provisiones de los artículos I y II de este Tratado aplicarán a todos los Estados, sean signatarios o no del Tratado.
2. Cualquier Estado Signatario este Tratado puede proponer enmiendas al Tratado. El texto de cualquier enmienda propuesta será sometido al Depositario quien lo circulará puntualmente a todos los Estados Signatarios.
3. Una enmienda entrará en vigor para todos los Estados Signatarios de este Tratado cuando la mayoría de los Estados Signatarios entregue al Depositario los documentos de aprobación. A partir de ese momento entrará en vigor para cualquier Estado Signatario no incluido a esa fecha, cuando el mismo deposite sus documentos de aprobación.
Artículo VIII
Este tratado será de duración ilimitada.
Artículo IX
1. Dos años después de la puesta en vigor de este Tratado, una conferencia de los Estados Signatarios del Tratado será convocada por el Depositario en Ginebra, Suiza. La conferencia revisará la operación del Tratado a fin de asegurar que sus propósitos y provisiones están siendo observados, y en particular examinará la eficacia de las provisiones de los artículos I y II en la eliminación de los peligros de una carrera armamentista en el espacio, y de las armas con base en el espacio.
2. Después de la primera Conferencia, a intervalos de no menos de dos años, una mayoría de los Estados Signatarios del Tratado puede obtener, sometiendo una propuesta al Depositario, la convocatoria de una conferencia con los mismos objetivos.
3. Si no se ha convocado una conferencia conforme al párrafo 2 de este artículo en un plazo de diez años desde la conferencia anterior, el Depositario solicitará la opinión de todos los Estados Signatarios del Tratado referente a la convocatoria de tal conferencia. Si es afirmativa la respuesta de una tercera parte o diez de los Estados Signatarios, cualquiera sea el menor de esos números, el Depositario procederá de inmediato a convocar la conferencia.
Artículo X
1. Este Tratado estará a la disposición de todos los Estados para su firma. Cualquier Estado que no firme el Tratado antes de su puesta en vigor de acuerdo con el párrafo 3 de este artículo, podrá acceder o unirse al mismo en cualquier momento.
2. Este Tratado estará sujeto a la ratificación de los Estados Signatarios. Los documentos de ratificación o de ingreso serán depositados ante el Secretario General de los Naciones Unidas.
3. Este Tratado entrará en vigor a partir del depósito de los documentos de ratificación por cinco (5) gobiernos de conformidad con el párrafo 2 de este artículo.
4. Para aquellos Estados cuyos documentos de ratificación o ingreso sean depositados después de la entrada en vigor del Tratado, la entrada en vigor será a partir de la fecha del depósito de sus documentos de ratificación o de ingreso.
5. El depositario informará puntualmente a todos los Estados Signatarios que ingresan la fecha de cada firma, la fecha del depósito de cada documento de ratificación o ingreso, la fecha de la puesta en vigor de este Tratado y de cualesquiera enmiendas al mismo, así como el recibo de otros avisos.
6. Este tratado será inscrito por el Depositario de conformidad con el Artículo 102 de la Carta de las Naciones Unidas.
Artículo XI
Este tratado, cuyas versiones al inglés, árabe, chino, francés, ruso, y español son igualmente auténticas, será depositado ante el Secretario General de las Naciones Unidas, quien enviará copias certificadas del mismo a los gobiernos de los Estados Signatarios que hacen su ingreso.
COMO TESTIGOS DE LO CUAL los aquí firmantes, debidamente autorizados por sus respectivos gobiernos, han suscrito este Tratado, dispuesto para la firma a las______ en el día________ de ___________ , de dos mil seis.
