COUNCIL DIRECTIVE 2000/29/EC
of 8 May 2000
on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty establishing the European Community, and in particular Article 37 thereof,
Having regard to the proposal from the Commission,
Having regard to the opinion of the European Parliament(1), Having regard to the opinion of the Economic and Social Committee(2),
Whereas:
(1) Council Directive 77/93/EEC of 21 December 1976, on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(3). For the sake of clarity and rationality, it has been amended on a number of occasions, often substantively(4). It should therefore be consolidated.
(2) Plant production is very important to the Community.
(3) Plant production yields are consistently reduced through the effects of harmful organisms.
(4) The protection of plants against such organisms is absolutely necessary not only to avoid reduced yields but also to increase agricultural productivity.
(5) Action aimed at the systematic eradication of harmful organisms within the Community, established by the plant health regime applicable in the Community as an area without internal frontiers, would have only limited effect if protective measures against their introduction into the Community were not applied at the same time.
(6) The need for such measures has long been recognised and they have formed the subject of many national regulations and international conventions, including the International Plant Protection Convention (IPPC) of 6 December 1951 concluded at the United Nations Food and Agricultural Organisation (FAO), which is of worldwide interest.
(7) One of the most important measures consists in listing the particularly dangerous harmful organisms whose introduction into the Community must be prohibited and also the harmful organisms whose introduction into the Member States when carried by certain plants or plant products must also be prohibited.
(8) The presence of some of these harmful organisms, when plants or plant products are introduced from countries in which these organisms occur, cannot be effectively checked. It is therefore necessary to make minimum provision for bans on the introduction of certain plants and plant products, or to provide for special checks to be made in the producer countries.
(9) Such plant health checks must be limited to introductions of products originating in non-member countries and to cases where there is strong evidence that one of the plant-health provisions has not been observed.
(10) It is necessary to make provision under certain conditions permitting derogations from a certain number of provisions. Experience has shown that the same degree of urgency may be attached to a certain number of derogations as is attached to the safeguard provisions. Therefore the urgency procedure specified in this Directive should also be made applicable to these derogations.
(11) Temporary safeguard measures not laid down in this Directive should normally be adopted by the Member State where the problem originates in the case of imminent danger of the introduction or spread of harmful organisms. The Commission should be informed of all events which require the adoption of safeguard measures.
(12) Given the importance of the trade in plants and plant products between the French overseas departments and the remainder of the Community, it is desirable to apply the provisions of this Directive to them. In view of the special nature of the agricultural production of the French overseas departments, it is appropriate to provide for additional protective measures justified on grounds of the protection of health and life of plants therein. The provisions of this Directive should also be extended to protective measures against the introduction of harmful organisms into the French overseas departments from other parts of France.
(13) Council Regulation (EEC) No 1911/91 of 26 June 1991 on the applications of the provisions of Community law to the Canary Islands(1) integrates the Canary Islands into the Community customs territory and into the common policies. Under Articles 2 and 10 of that Regulation, application of the common agricultural policy is subject to the entry into force of specific supply arrangements. Such application must also be accompanied by specific measures concerning agricultural production.
(14) Council Decision 91/314/EEC of 26 June 1991 setting up a programme of options specific to the remote and insular nature of the Canary Islands (Poseican)(2) outlines the options to be implemented to take account of the specific problems and constraints faced by those islands.
(15) To accommodate therefore the specific plant health situation in the Canary Islands, it is appropriate to extend the application of certain measures of this Directive for a period expiring six months after the date by which Member States must have implemented forthcoming provisions dealing with the Annexes to this Directive for the protection of the French overseas departments and of the Canary Islands.
(16) It is appropriate to adopt, for the purposes of this Directive, the model certificates approved under the IPPC, as amended on 21 November 1979, in a standardised lay-out which has been drawn up in close cooperation with international organisations. It is also appropriate to lay down certain rules concerning the conditions in accordance with which such certificates may be issued, certain rules for the use of previous models during a transitional period, and certification requirements in the case of the introduction of plants and plant products from third countries.
(17)In the case of importations of plants or plant products from third countries the authorities responsible in such countries for issuing certificates should be, in principle, those empowered under the IPPC. It could be desirable to establish lists of these authorities for the non-contracting third countries.
(18) The procedure applicable to certain types of amendments to be made to the Annexes to this Directive should be simplified.
(19) The scope of this Directive should be clarified in respect of ‘wood’. In particular, it is useful to follow the detailed descriptions of ‘wood’ set out in Community Regulations.
(20) Certain seeds are not included amongst the plants, plant products and other objects, listed in the Annexes to this Directive, which must be subjected to a plant health inspection in the country of origin or the consignor country before being permitted to enter in the Community or in intra-Community trade.

CONSILIUL UNIUNII EUROPENE,

Întrucât:
(1) Directiva Consiliului 77/93/CEE din 21 decembrie 1976 privind măsurile de protecţie împotriva introducerii în Comunitate a organismelor dăunătoare plantelor sau produselor vegetale şi împotriva răspândirii acestora în cadrul Comunităţii( ). Întru asigurarea clarităţii şi raţionalităţii, a fost frecvent modificată, adesea în mod substanţial . Prin urmare, trebuie consolidată.
(2) Cultivarea plantelor este foarte importantă pentru Comunitate.
(3) Recoltele de plante se reduc constant din cauza consecinţelor organismelor dăunătoare.
(4) Protecţia plantelor împotriva acestor organisme este absolut necesară nu doar în scopul evitării unor recolte scăzute, dar şi în scopul creşterii productivităţii agricole.
(5) Acţiunile destinate eradicării sistematice a organismelor dăunătoare din interiorul Comunităţii, stabilite prin regimul de sănătate a plantelor aplicabil în Comunitate, în calitatea sa de zonă fără frontiere interne, ar avea doar un efect limitat, dacă măsurile de protecţie împotriva introducerii acestora în cadrul Comunităţii nu vor fi aplicate în acelaşi timp.
(6) Necesitatea unor astfel de măsuri a fost demult recunoscută, devenind obiectul mai multor regulamente naţionale şi convenţii internaţionale, inclusiv Convenţia Internaţională privind Protecţia Plantelor (IPPC) din 6 decembrie 1951, încheiată la Organizaţia Naţiunilor Unite pentru Alimentaţie şi Agricultură (FAO), care prezintă un interes mondial.
(7) Una dintre cele mai importante măsuri constă în identificarea organismelor dăunătore extrem de periculoase, introducerea cărora în Comunitate trebuie interzisă, precum şi a organismelor dăunătoare, introducerea cărora pe teritoriul statelor membre, în cazul în care sunt transportate prin anumite plante sau produse vegetale, de asemenea, trebuie interzisă.
(8) Prezenţa unora dintre aceste organisme dăunătoare, în cazul în care plantele sau produsele vegetale se introduc din ţările în care aceste organisme există, nu poate fi verificată eficient. Prin urmare, este necesar de a impune interdicţii minime la introducerea anumitor plante şi produse vegetale sau de a prevedea controale speciale, care să fie efectuate în ţările producătoare.

De asemenea, prevederile prezentei Directive trebuie extinse, astfel încât să includă măsuri de protecţie împotriva introducerii organismelor dăunătoare în departamentele franceze de peste mări din alte părţi ale Franţei.
(13) Regulamentul Consiliului (CEE) nr. 1911/91 din 26 iunie 1991 cu privire la aplicările prevederilor legislaţiei Comunităţii faţă de Insulele Canare ((1)1)1)1)1)) integrează Insulele Canare în teritoriul vamal al Comunităţii şi în politicile comune. În conformitate cu articolele 2 şi 10 din acest regulament, aplicarea politicii agrare comune este subordonată intrării în vigoare a unor reglementări specifice privind furnizările. O astfel de aplicare trebuie, de asemenea, însoţită de măsuri speciale privind producţia agricolă.

De asemenea, este binevenit, de a stabili anumite reguli privind condiţiile conform cărora pot fi eliberate aceste certificate, reguli privind aplicarea modelelor anterioare pe parcursul perioadei de tranziţie şi cerinţele de certificare în cazul introducerii plantelor sau produselor vegetale din ţările terţe.
(17) În cazul importului de plante sau produse vegetale din ţările terţe, autorităţile responsabile pentru eliberarea certificatelor din ţările respective trebuie, în principiu, să fie acele autorităţi, care sunt împuternicite în baza IPPC. Este oportun de a întocmi liste cu autorităţile respective din ţările terţe necontractante.
(18) Procedura aplicabilă anumitor tipuri de amendamente, care urmează a fi introduse în anexele la prezenta directivă, trebuie simplificată.
(19) Termenii de referinţă din prezenta directivă trebuie clarificaţi în privinţa „lemnului”. În special, este necesar de respectat descrierile detaliate ale „lemnului” specificate în regulamentele comunitare.
(20) Unele seminţe nu sunt incluse printre plantele, produsele vegetale şi alte obiecte, indicate în anexele la prezenta directivă, care trebuie supuse unei inspecţii de sănătatea plantelor în ţara de origine sau ţara expeditoare înainte de a primi permisiunea de a intra pe teritoriul Comunităţii sau în comerţul în cadrul Comunităţii.

PERFORMANCE AUDIT OF MOLDOVAN CUSTOMS 2006-07
The Moldovan Customs is responsible for the collection and refund of customs duties levied on the import, export and storage of goods within Moldovan borders. In order to do this it must ensure that that the correct amount of revenue is collected in a timely fashion without placing an undue burden on law abiding citizens and businesses. In order to achieve this it needs to:-
1. Be able to operate within an unambiguous legislative framework;
2. Ensure that revenue is collected or refunded on a timely and accurate basis; and
3. Keep burdens on compliant businesses to a minimum.
In our examination of the Moldovan Customs we found that:
a) Businesses are avoiding customs duties because legislation is not drafted sufficiently clearly. We found that businesses are taking advantage of the wording in import and export legislation to avoid paying higher rates of tax. For instance, businesses are able to import luxury cars under the regime which was intended for tractors. We estimate that in 2006 alone, this activity cost the Moldovan tax-payer 47m leh.
b) Businesses are claiming allowances they are not entitled to because legislation is not drafted clearly enough. We tested 100 allowance claims and found that in 20% of cases individuals were claiming allowances that they were not entitled to. For example, disable people are given an allowance to enable them to import medical equipment or medicines. However, this rule is also being used to claim allowances on other luxury items, such as televisions.
c) Customs are have collected 20% more revenue in 2006 than in 2005. This success has been attributable partly to Customs collecting all revenue centrally. This has reduced the potential for revenue to be lost through fraud.
d) At each financial year end there is a discrepancy between the duty collected according to the Minister of Finance and Customs. This difference is occurs because Customs are counting all the revenue on imports or exports that occurred within the year. Whereas, the Minister of Finance is simply counting the amount of cash received in 2006.
e) Customs have been successful in reducing debts owed by businesses by reforming way in which revenue is collected. Previously, a business could move their goods and pay any customs duty owed later. However, Customs has introduced a new rule whereby businesses must deposit the duty on the goods they are moving before passing through the port. At the end of 2005 Customs was owed unpaid duty of 143m leh. This been reduced to zero for 2006.
f) Customs have introduced a new IT system which has speeded up the time it takes to process declarations at the borders considerably. The system means that business and individuals do not have to spend as long completing forms because the majority of their details are held on the database. Processing each declaration now takes as little as 15 minutes, when previous some applications could take up to a day to process.
g) Customs introduced a system where brokers complete declarations on behalf of businesses on 1 March 2006. The aim of the system is to allow businesses to outsource the completion of declarations. Customs are responsible for training and vetting these brokers. However, we tested ?? applications which have been made through brokers in 2006 and found that ?? have not been completed correctly.
Recommendations
In order to increase the effectiveness of revenue collection, we suggest that the following steps are taken:-
A. Parliament should review legislation covering the different regimes for customs duties and allowances. This should involve:-
Identifying parts of the legislation where drafting is insufficiently clear; and
Re-drafting those areas of legislation.
B. The Minister of Finance should consider revising the way in which he measures the duty collected each year. By bringing the way that duty collected is measured into line with Customs method, any discrepancy in the revenue reported by the Minister and Customs could be more easily identified and challenged.
C. Customs should conduct a review of the Brokers system in order to identify why the frequency of mistakes in declarations has been so high. They should consider whether:-
Vetting procedures have ensured that only those brokers with sufficient skill have been accredited; and
Whether more could be done to educate brokers and thereby reduce the number of mistakes made.

Auditul performanţei la Serviciul Vamal din Republica Moldova 2006-2007
Serviciul Vamal din Republica Moldova este responsabil de colectarea şi rambursarea taxelor vamale încasate la importarea, exportarea şi depozitarea bunurilor în limitele frontierelor Moldovei. Pentru a realiza acest lucru el trebuie să asigure colectarea volumului corect de venit la timpul potrivit, fără a plasa o povară exagerată asupra legii, fapt ce ar dăuna cetăţenilor şi companiilor. În vederea realizării celor propuse Serviciul Vamal trebuie:-
1. Să aibă posibilitatea de a activa în contextul unui cadru legal clar;
2. Să asigure faptul că veniturile sunt colectate sau rambursate la timp şi corect; şi
3. Să reducă povara companiilor disciplinate la minimum.
:
a) Companiile evită achitarea taxelor vamale, deoarece legislaţia vamală nu este elaborată destul de clar. c) S-a depistat că companiile profită de formularea legislaţiei cu privire la export şi import, pentru a evita achitarea unor taxe mai mari. Spre exemplu, companiile pot importa maşini luxoase în cadrul regimului preconizat pentru tractoare. Noi am evaluat că numai în 2006 astfel de activităţi i-a costat pe contribuabilii din Moldova 47 milioane lei.
b) Companiile solicită indemnizaţii la care nu au dreptul din cauza formulării neadecvate a legislaţiei. Spre exemplu, oamenilor cu dezabilităţi li se acordă indemnizaţii care le-ar permite să importe echipament medical şi medicamente. Cu toate acestea, regula dată este folosită, de asemenea, şi la solicitarea indemnizaţiilor pentru alte articole de lux, cum ar fi televizoarele.

Recomandări
Pentru a spori eficacitatea procesului de colectare a veniturilor noi sugerăm să fie întreprinşi următorii paşi:
A. Parlamentul trebuie să re-examineze legislaţia cu privire la diferite regimuri ale taxelor şi indemnizaţiilor vamale. Aceasta presupune următoarele:
Identificarea părţilor insuficient de clare din legislaţie; şi
Reformularea acestor aspecte ale legislaţiei.
B. Ministerul de Finanţe trebuie să revadă modul de calculare a taxelor colectate în fiecare an. Ajustând modul de calculare a taxelor colectate la metoda practicată de Serviciul Vamal, orice dezacord în ceea ce priveşte veniturile declarate de către Minister şi Serviciul Vamal va putea fi identificat şi soluţionat mai uşor.

Appraisal
Overview
The formal appraisal process involves:-
• Performance Planning – agreeing a balanced framework of objectives with your line manager for the annual appraisal period 1st April to 31st March;
• Formal appraisal discussions – including an interim appraisal (October) covering the first six months of the appraisal year, and an annual appraisal (April) covering the full year;
• Appraisal ratings – at the interim and annual stage, performance will be rated in terms of one of 3 categories (A, B or C);
• Assessment of potential – a rating of potential will be assigned at the interim and annual stage to those who have evidenced most clearly their potential for career progression within the NAO in the next 3 to 4 years. This will be recorded as a * (‘star’) rating, separate from the appraisal rating.
Appraisal discussions with your manager should be an open review of performance strengths and areas for improvement against your objectives and the Office competencies. Discussions should also focus on potential for career progression as well as progress against development objectives and plans for the period ahead. The Performance Discussion Framework provides an aide-memoire for issues you and your manager would want to cover when preparing for and holding discussions about your performance.
Recording the appraisal discussion. You summarise the key points of the discussion on the Record of Appraisal Discussion, and your manager may add further specific comments before summarising the overall standard of performance achieved.
Appraisal ratings. Your reporting and reviewing officer will agree an indicative performance appraisal rating at the interim and annual stages, and will submit this to the Unit Management Board for moderation. Reporting and reviewing officers will also make proposals to their Unit Management Boards on staff who have demonstrated most clearly their potential for career progression and who should, therefore, be awarded a * (star) rating. Ratings of performance and potential will only be disclosed to you following completion of the Unit and Office moderation process.
Determining appraisal ratings
Performance appraisal ratings provide a summary of the overall standard of performance you have achieved. To determine your rating, your reporting and reviewing officer will consider your performance in terms of the whole balanced framework of objectives and across the full range of NAO competencies. They will need to agree which of the rating categories provides the closest fit to your achieved performance, and the expected profile will help managers gauge performance and ensure consistency. The ratings will, of course, be subject to Unit and Office wide moderation to ensure consistency and objectivity.
Here is a broad indication of the standards of performance at each of the performance levels, though it is not intended to be exhaustive or prescriptive:-

In comparison to most staff, those rated A are likely to have:-
• Consistently delivered a strong performance across all the competencies. Excelled in terms of some competencies
• Consistently delivered a strong performance against a wide ranging and challenging set of objectives relating to: work delivery and impact on clients; key management challenges and contribution to the wider team; and wider contribution to Unit and Office initiatives
• Achieved some objectives that are particularly challenging for the grade
• Made significant progress against a challenging development plan, showing clear progress across a wide range of professional and managerial skills
• Achieved a higher standard and quality of performance overall
B
Staff rated B are likely to have:-
• Consistently delivered a reliable and acceptable performance across the competencies
• Consistently delivered a standard and quality of performance that is acceptable and reliable against the full balanced framework of objectives
• Demonstrated some clear strengths in terms of what has been achieved (objectives) and how he or she has contributed (competencies)
• Made good progress against the development plan; has developed against the range of competencies
• Delivered a standard and quality of performance similar to the majority of his or her colleagues in the same grade
C
In comparison to most staff, those rated C are likely to have:-
• Delivered a sound performance against some of the competencies, though some aspects of performance will have been less polished or consistent
• Delivered some objectives to the required standard, although performance on other aspects of the role will have been less accomplished or reliable, and the scope of achievement relatively narrow
• Needed more management support than his or her colleagues in order to perform and deliver
• Made some progress against the development plan, but this has been relatively limited in pace and scope
• Achieved a weaker standard and quality of performance overall
These definitions are intended to provide a helpful guideline, but they are inevitably subject to interpretation in individual cases. On their own they are unlikely to represent a sufficient safeguard of consistency across the Office, or against any erosion of marking standards over time. We have, therefore, underpinned the appraisal framework by making explicit the profile of marks that we would expect to see, and which is set out below.

There would, however, be scope within the profile for variation within particular teams, areas or grades providing these were explained and justified.
The Management Committee will review the expected profile from year to year and between the interim and final appraisal in light of a range of factors, including corporate performance, rates of turnover, promotion opportunities and progress in terms of enhancing management capacity as well as other initiatives. Staff will be made aware of any change to the expected profile.
The assessment of potential
The * (star) rating indicates that you have shown most clearly the potential for career progression in the NAO within the next 3 to 4 years. It does not mean that you necessarily will progress, or that others will not. There will need to be flexibility in these ratings from year to year, particularly where actual progress exceeds or falls below earlier expectations. But they are intended: to meet a management need for up-to-date information on prospective promotion candidates with most potential; for development and succession planning purposes; and for staff to have clear feedback which will help them plan and manage their own careers.
To achieve this rating you will have demonstrated clear evidence of the capacity to take on higher levels of responsibility by:-
• Demonstrating leadership and management behaviours that are a key to success in more senior positions. These behaviours could include the following:-
• Inspiring, challenging and supporting others to develop, improve and to give of their best
• Making positive impact as a polished professional and leader with clients, senior staff and colleagues
• Being convincing and intellectually agile in how you present and discuss issues
• Getting to grips quickly with the more complex and conceptual issues
• Developing a clear grasp of wider strategic issues and the ‘bigger picture’
• Showing high levels of drive, energy and focus to achieve and excel across the full range of responsibilities
• Demonstrating flair, dynamism and freshness by innovating and improving the way things are done for the wider Corporate good
• Absorbing more challenging and stretching responsibilities and learning new things faster than others
• Adapting quickly and flexibly to new demands and experiences
• Striving to do the job of the higher grade and substituting successfully for your manager when required
• Showing capacity to deliver what would normally be done by colleagues who perform well in more senior roles and remaining robust and assured when under pressure
These examples are not intended to be exhaustive.
The * (star) rating does not imply that others lack potential. Some may, for example, have potential but it has not yet been demonstrated clearly; some may need longer to develop; and others will have the capacity to broaden the range of responsibilities within their current grade.
Staff eligible for a * (star) rating include those achieving an appraisal rating of A or B and who are not in the Assistant Auditor or Auditor grades. Of those who are eligible, we would expect around 15% - 25% to be assigned the * (star) rating, though this may vary within teams, areas or grades. This group is likely to include mainly staff rated A, but there would be scope to include some staff rated B where clear potential has been shown.
In some non-audit specialisms and for staff on fixed term contracts there may be limited scope for progression in the NAO. For these colleagues, a * (star) rating may be given on the basis of their assessed ability to progress their career within the wider specialism outside the Office.
Assistant Auditors and Auditors will be assessed in terms of the A, B or C ratings of performance but not the assessment of potential since the majority should be capable of advancing to Audit Principal on qualification.
To assist those who may have longer-term potential which has not yet been sufficiently developed or evidenced to warrant the potential rating, reporting and reviewing officers should indicate on the Record of Appraisal Discussion what actions they should focus on to evidence their potential more clearly.
Review and moderation of appraisal ratings
Unit moderation. Reporting and reviewing officers will agree indicative ratings, taking into account each individual’s performance against objectives and competencies. They will also make proposals regarding who should be awarded a rating of potential. The expected profile will help managers gauge performance and ensure consistency. The assessments will be reviewed at area level then by Unit Management Boards for objectivity and consistency, and where appropriate, assessments will be moderated.
The following performance criteria may be helpful when reviewing performance of staff at area level and by Unit Management Boards. They are not prescriptive or exhaustive but provide a reference point for discussion:-
• Delivery of accounts/ studies/ objectives to budget, time and quality
• Delivery of other projects to budget, time and quality and completion of work or other activities on top of normal duties
• Demonstration of a well rounded set of skills and competencies
• Relative workload and complexity of work in relation to the expectations of the grade/ specialism and the hours of work (part-time or full-time status)
• Management of staff, including the impact of action taken
• Exam performance (trainees)
• Mix and challenge of work
• Wider contribution and impact (team, area, Unit and Office)
• Reasonableness/ validity of time charged to indirect codes not related to participation in wider initiatives
Management Committee. The Management Committee will review the corporate profile of appraisal ratings to consider consistency and objectivity across the Office as a whole, based on a detailed analysis of ratings against a range of equality criteria, as well as advice from the Human Resources team. This review will identify any strategic performance and career management issues which might need to be addressed on a corporate basis.
Disclosure
Once the moderation process has been completed, the Record of Appraisal Discussion should be disclosed to you. There would be scope for you to arrange to meet with your reporting and/ or reviewing officer to:-
• Discuss your appraisal, and your assessment of performance and potential in particular
• Firm up on your objectives for the review period ahead, including your development plan
• Resolve any queries, and involve the reviewing officer if necessary. Most, if not all, queries should be resolved in this way. If, after your discussion, you still feel you have grounds for appeal against your annual assessment, you should follow the appeal procedure provided at the InterAct site on Merlin (Merlin/ Your Career/ InterAct/ Briefings).

C
În comparaţie cu ceilalţi angajaţi, cei care au obţinut gradul de calificare C, după toate probabilităţile:
• Au dat dovadă de performanţe adecvate în unele competenţe, chiar dacă anumite aspecte ale performanţelor vor fi mai puţin cizelate sau consistente
• Au realizat careva obiective ale nivelului solicitat, deşi din alte aspecte, performanţele sunt mai puţin îndeplinite sau sigure, domeniul de realizare fiind relativ limitat
• Au nevoie de mai mult suport din partea conducerii decât colegii săi pentru a îndeplini sarcinile de serviciu
• Au înregistrat anumite progrese în realizarea planului de dezvoltare, însă aceste progrese au fost destul de limitate
• Au obţinut un nivel scăzut şi o performanţă generală de calitate joasă
Aceste definiţii au ca scop oferirea unor îndrumări utile, însă ele pot fi în mod inevitabil interpretate în funcţie de particularităţile fiecărui caz în parte. Doar definiţiile aparte nu sunt suficiente pentru a asigura consistenţă în cadrul instituţiei, prin urmare vor trebui elaborate şi standarde peste o anumită perioadă de timp. • Validitatea timpului ocupat pentru activităţile indirecte ce nu ţin de participarea in iniţiativele mai largi
Comitetul Administrativ Comitetul Administrativ va examina profilul corporativ al gradelor de calificare pentru a lua în considerare consistenţa şi obiectivitatea în cadrul instituţiei ca un tot întreg, în baza unei analize detaliate în raport cu un şir de criterii de egalitate, precum şi informaţii din partea echipei Resurselor Umane. Această examinare va identifica orice performanţă strategică şi probleme ce ţin de managementul carierei care pot fi puse în discuţie la nivel corporativ.
Prezentarea informaţiilor

7. ANALIZA COMPARATIVĂ A PRACTICILOR DIN MOLDOVA ŞI UE
Moldova se află în relaţii comerciale cu multe ţări, inclusiv membrii UE.
Pentru a menţine şi dezvolta aceste relaţii cu ţările UE, RM trebuie să îndeplinească în primul rând acţiunile prevăzute în planul RM-UE, cât şi recomandările DG SANCO referitor la cerinţele pentru a obţine statutul pentru ţările terţe care por să exporte produse de origine animală în UE, şi anume:
• Respectarea pe deplin a cerinţelor OMC
• Aderarea la Organizaţia de protecţie a plantelor a ţărilor din bazinul Mării Mediterane,
• Participarea activă în Organizaţia Mondială pentru sănătatea animalelor, Organizaţia Mondială de protecţie a plantelor, Codex Alimentarius,
• Elaborarea în baza recomandărilor comisiei privind comerţul cu produse de origine animală a măsurilor pentru implementarea graduală a cerinţelor igienice pentru produsele alimentare armonizate cu cele europene (timpul executării, modificarea legislaţiei, costurile),
• Evaluarea sistemului de control sanitar şi fitosanitar în raport cu cel din UE,
• Întreprinderea acţiunilor privind identificarea animalelor şi a sistemului de urmărire a mişcării animalelor,
• Îndeplinirea cerinţelor UE referitor la sănătatea animalelor şi produselor de origine animală.
Organele administrării publice de specialitate din domeniul produselor alimentare trebuie să demonstreze îndeplinirea următoarelor cerinţe generale, şi anume:
• Existenţa bazei legislative adecvate referitor la utilizarea diferitor substanţe în special la interzicerile sau admiterile de răspândire, inclusiv modul de efectuare a inspecţiilor, şi a implementării sistemelor calităţii,
• Existenţa unui program adecvat de control permanent a conţinutului unor substanţe şi a reziduurilor de acestea în produsele de origine animală, în special pentru produsele destinate exportului,
• Competenţa serviciilor sanitare de a efectua controlul respectării cerinţelor sanitar-igienice.
Directiva europeană 882/2004 lărgeşte cerinţele pentru sectorul produselor de origine animală, cât şi a nutreţurilor. Noua directivă prevede ca CE să ceară de la ţările terţe, care intenţionează să exporte produse în UE, să asigure informarea deplină şi la timp referitor la organizarea şi dirijarea activităţilor ce ţin de siguranţa alimentelor, în special:
o Reglementările sanitare şi fitosanitare (adaptate sau propuse de ţară),
o Procedurile de control şi inspecţie, procedurile de carantină, procedurile şi metodele aplicate pentru determinarea reziduurilor de pesticide în produsele alimentare,
o Procedurile de evaluare a riscului, factorii luaţi în considerare, nivelul de determinare a protecţiei sanitare şi fitosanitare,
„Garanţiile” prevăd ca exportul în UE să corespundă Directivei privind produsele alimentare, şi sa fie o tratare echivalentă.
Informaţia care este solicitată de la ţările care vor să exporte pe teritoriul UE, va fi evaluată faţă de orice risc posibil care este legat de produsul dat, şi poate fi clasificat ca „Situaţia şi structura anumită” a ţării terţă.
Principiile de reglementare vor fi formulate astfel ca cerinţele comisiei să fie respectate iar perioada de tranziţie să ofere timp pentru a pregăti o astfel de informaţie.
Informaţia necorespunzătoare poate să aducă impunerea unor condiţii.
FVO va efectua audituri privind „echivalenţa” expusă în informaţie, sistemelor de management şi securitate a produselor cerinţelor UE. Rapoartele de control vor fi publice.
Noua directivă prevede că organele de control din UE pot să întreprindă controale la întreprinderile alimentare din UE. Reglementarea prevede de asemenea că experţii de la Comisie sunt în drept să efectueze controlul oficial la întreprinderile din ţările terţe.
Este important de menţionat care sunt principiile in privinţa controlului care trebuie să fie implementat şi constituie următoarele:
• Efectuarea sistematică a controlului cu abordarea in baza riscurilor,
• Efectuarea controlului fără avertizare anterioară,
• Efectuarea controlului la toate etapele de producere, prelucrare şi distribuţie,
• Extinderea controlului pentru produsele de import şi export şi pentru produsele alimentare comercializate pe piaţa UE.
Misiunea FVO in RM in perioada 23-27 mai 2005, a avut loc ca urmare a cererii Guvernului RM de a exporta in UE produse de origine animală şi produse derivate de origine animală. In prezent, unicul produs de origine animala destinat consumului uman, pe care Moldova este autorizata sa-l exporte in UE, este mierea de albine (Decizia Comisiei 2004/432/EC din 29 aprilie 2004).
Unul din domeniile de baza, care necesita restructurare şi ajustare la cerinţele UE este sistemul de laboratoare veterinare.
Recomandările misiunii FVO vizează acest aspect şi impun o revizuire a sistemului prin prisma armonizării legislaţiei in vigoare, inclusiv a planurilor de monitorizare a sănătăţii animalelor, a reziduurilor in produsele de origine animala şi in hrana acestora pe întreg lanţul începând cu producătorul de nutreţuri, la procesorul de produse animale şi terminând cu punctul de comercializare al acestora.
Pentru a analiza care este situaţia în RM vis-a-vis de cerinţele privind controlul oficial al produselor alimentare vom compara cerinţele europene cu situaţia de fapt după cum urmează:
Activităţi din partea statului
Sunt determinate şase elemente de bază a controlului oficial al produselor, cinci din care sunt bazate pe recomandările FAO/VOZ, adoptate pe plan mondial:
1. Legea privind produsele alimentare şi alte acte de reglementare în domeniu. Elaborarea legii privind produsele alimentare constituie parte componentă a sistemului de control. Este necesară stabilirea măsurilor de restricţie în cazurile de nerespectare a legii.
În RM este adoptată Legea privind produsele alimentare, totodată nu sunt prevăzute unele mecanisme de implementare eficientă a legii.
2. Coordonarea sistemului de control a produselor alimentare
Sistemul eficient al controlului produselor alimentare necesită o strategie privind controlul operativ la nivel naţional, care trebuie să fie organizat în aşa fel, ca să cuprindă responsabilitatea tuturor serviciilor antrenate în acest control.
În RM nu este elaborată strategia de coordonare operativă a sistemului de control alimentar.
3. Serviciile de control
Administrarea şi efectuarea controlului alimentar necesită personal calificat, bine instruit, care să exercite cinstit funcţiile de control, care să funcţioneze independent fără a crea conflicte de interese. Măsurile de restricţie trebuie să fie adoptate prin instanţele de judecată.
În RM nu este lege privind controlul oficial al produselor alimentare, bazate pe directiva 882/2004, unele cerinţe se conţin în reglementările tehnice specifice.
Nu este un act normativ referitor la modul de inspectare a întreprinderilor bazat pe principiile sistemului HACCP.
4. Laboratoarele
Laboratoarele de încercări sunt parte componentă a sistemului de control a produselor alimentare. Ele trebuie să fie dotate cu utilaj pentru încercări privind indicii fizico-chimici şi microbiologici. Laboratoarele trebuie să fie acreditate, completate cu personal calificat şi recunoscute la nivel internaţional.
Laboratoarele în RM sunt acreditate doar în sistemul naţional de acreditare, nu sunt acreditate şi recunoscute pe plan european. Dotarea este insuficientă.
5. Informarea, studierea şi instruirea
Prezentarea informaţiei tuturor componenţilor ciclului de producere de la fermă la masă ceea ce constituie un factor foarte important pentru inspectori în activitatea de supraveghere a pieţei. Organelor de control le este necesar ca să fie susţinut nivelul de pregătire profesională a personalului inspectorilor de stat la nivelul cerinţelor contemporane.
În RM în prezent acest segment lipseşte.
Principiile de autocontrol şi responsabilitatea producătorului
Conform noii legislaţii europene, producătorii produselor alimentare poartă responsabilitate deplină pentru securitatea produselor alimentare şi în acest context este foarte importantă implementarea sistemelor de management al calităţii, şi evaluarea riscurilor la etapa de producere.
În UE sistemul HACCP este mandatoriu pentru toate întreprindere de prelucrare şi fabricare a produselor finale. Un astfel de tip de autocontrol este deja implementat în special la întreprinderile mari, dar lipseşte la combinatele de carne.
Sistemul HACCP prevede un lanţ logic de evaluare a riscurilor la etapa de producere, unde controlul este necesar în scopul evitării riscurilor. Întreprinderile sunt obligate să efectueze înscrierile tuturor controalelor, care se efectuează în cadrul sistemului HACCP în scopul supravegherii. La ferme ca instrument în scopul controlului se utilizează Codul de bună practică.
Industria alimentară în prezent pleacă de la metodele vechi tradiţionale de control a produsului finit, şi se implementează tot mai mult metode prin care se preîntâmpină cazurile de fabricare a produselor periculoase. În prezent tot mai mult se aplică codurile de bună practică, (de ex. EUREPGAP), cerinţele igienice prin care devin tot mai rigide.
În unele ţări legislaţia prevede în mod obligatoriu existenţa laboratoarelor la întreprinderi, dar din punctul de vedere al siguranţei alimentelor este foarte important ca să fie accesul liber le laboratoarele oricărui producător, în special în contextul trasabilităţii produselor.
Totuşi un rol deosebit pentru a asigura trasabilitatea produselor alimentare îi revine sistemului HACCP. Determinarea punctelor critice de control trebuie să fie făcută în baza unor cercetări aprofundate, în unele cazuri cu aspect ştiinţific. Legislaţia europeană prevede înregistrarea întreprinderilor producătoare de produse alimentare în scopul posibilităţii de identificare a producătorului. Fiecărei întreprinderi i se atribuie un număr de înregistrare care trebuie să însoţească produsul până la punctul de destinaţie. Producătorul trebuie să efectueze înregistrarea ingredientelor utilizate pentru identificarea ulterioară.
Legea RM privind produsele alimentare prevede unele cerinţe referitor la sistemul HACCP. Astfel:
- Articolul 21 prevede - “Sistemul de analiză a pericolului şi de control al circuitului alimentar în punctele critice de control
Agenţii economici din sectorul alimentar implementează sisteme de analiză a pericolului şi de control al circuitului alimentar în punctele critice de control, bazându-se pe:
a) analiza eventualelor pericole de contaminare a produselor alimentare pe parcursul fluxului tehnologic în cadrul întreprinderilor din sectorul alimentar;
b) determinarea etapelor fluxului tehnologic ce prezintă eventuale pericole şi stabilirea punctelor critice;
c) efectuarea controlului în punctele critice;
d) estimarea periodică a eficienţei controlului efectuat conform prevederilor specificate la lit.a)-c) şi actualizarea acestor prevederi în cazul modificării procesului de producere a produselor alimentare”
- Articolul 29 prevede - “Legea, cu excepţia art.6 lit.c), în partea ce ţine de sistemul de analiză a pericolului şi de control al circuitului alimentar în punctele critice de control, şi a art.21, care vor intra în vigoare la 1 ianuarie 2007”. Deci practic cerinţele referitoare la obligativitatea implementării sistemului HACCP sunt în vigoare, dar totodată trebuie de menţionat că în prezent puţine întreprinderi au certificat sistemele de calitate inclusiv sistemul HACCP.
Sunt certificate sistemele calităţii la un număr mic de întreprinderi circa 10, în ceea ce priveşte HACCP doar 4.
Această problemă necesită suport din partea donatorilor străini şi conştientizarea de către agenţii economici care sunt privilegiile pentru declararea conformităţii în cazul când întreprinderea a implementat şi certificat sistemul HACCP.
8. CONCLUZII
8.1. Cadrul legislativ şi normativ
Cadrul legislativ pentru desfăşurarea activităţii de supraveghere a pieţei asupra produselor alimentare în general este creat: Legile generale (Legea privind produsele alimentare, Legea privind activitatea de reglementare tehnică. Legea privind protecţia consumatorilor) cât şi legile speciale referitoare la produse concrete este creată şi continuă să se dezvolte.
Cadrul normativ şi în special actele normative privind stabilirea cerinţelor de siguranţă şi esenţiale de calitate (reglementările tehnice ) pentru produse, elaborate în baza directivelor europene nu sunt aprobate şi implementate.
Totodată se resimte lipsa unei legi privind supravegherea pieţei sau a controlului oficial al produselor care ar stabili toate aspectele legale privind supravegherea pieţei prin care ar fi stabilite autorităţile de supraveghere a pieţei, competenţele şi responsabilităţile lor, cât şi o clară delimitare a funcţiilor.
8.2. Cadrul instituţional
Legea privind produsele alimentare şi Legea privind activitatea de reglementare tehnică prevăd că activitatea de supraveghere a pieţii se efectuează de autorităţile abilitate.
Totodată lista autorităţilor abilitate nu este parte nici a unei legi în vigoare.
Nu este stabilită prin actele legislative sau normative delimitarea strictă a funcţiilor pentru a evita dublarea funcţiilor şi controalele excesive şi totodată excluderea cazurilor de neacoperire cu control a unor tipuri de produse. Totodată organele abilitate cu funcţii de control în domeniul produselor alimentare efectuează totodată control ramural care de fapt ar trebui să aibă mai mult un aspect consultativ şi de suport metodologic, tehnologic de specialitate, dar nu scop restrictiv.
Nu este clar definit rolul structurilor vamale în sistemul de supraveghere a pieţei.
Este necesară urgentarea creării Agenţiei de siguranţă a alimentelor care pe de o parte ar centraliza funcţiile ce ţin de asigurarea securităţii şi calităţii produselor pe de altă parte ar favoriza întreprinderile de producere din domeniul alimentar prin susţinere, monitorizare şi consultare.
8.3. Situaţia privind laboratoarele de încercări şi organismele de certificare utilizate în cadrul supravegherii pieţii şi organismele de certificare.
Situaţia existentă denotă faptul că în general în structurile abilitate cu funcţii de supraveghere şi control nu există laboratoare proprii. Nu sunt stabilite nici careva criterii conform cărora pentru încercările de laborator în scopul supravegherii pieţei probele prelevate se plasează în unele sau alte laboratoare. Laboratoarele existente nu sunt dotate în modul corespunzător pentru încercări privind indicii de inofensivitate şi caracteristicilor de calitate. Astfel în impediment în calea depistării produselor neconforme cerinţelor prescrise este lipsa laboratoarelor dotate corespunzător. În Planul de acţiuni RM-UE la compartimentul “Consolidarea capacităţilor de supraveghere a pieţii a fost stipulată acţiunea privind dezvoltarea laboratoarelor de încercări, dar până în prezent careva activităţi în acest domeniu nu au fost desfăşurate.
În prezent în RM sunt acreditate 10 organisme de certificare a produselor alimentare.
Este necesară întărirea a două elemente a controlului oficial a produselor alimentare: Inspectoratul privind produsele alimentare şi laboratoarelor cu scopul asigurării controlului eficient al produselor alimentare şi nutreţurilor şi a serviciilor respective legate de fabricarea produselor alimentare şi sănătatea animalelor.
Este necesar de asemenea:
• Modernizarea laboratorului naţional CRDV prin reutilarea, însuşirea metodelor noi de încercări şi implementarea sistemelor calităţii,
• Utilarea suplimentar a două laboratoare noi cu utilaj analitic modern,
• Instruirea personalului laboratoarelor pentru însuşirea metodelor moderne de încercări.
8.4. Situaţia privind personalul antrenat în activitatea de supraveghere a pieţei
Analiza situaţiei privind personalul care activează în domeniul supravegherii pieţei reliefează un şir de probleme şi în primul rând motivaţia joasă prin salarii mici, condiţii de muncă dificile, dotare necorespunzătoare, lipsa posibilităţilor de a fi instruiţi corespunzător.
8.5. Părerea producătorilor
Au fost intervievate un şir de întreprinderi pentru a afla opinia referitor la controalele din partea organelor de control.
Rezultatele respondenţilor:
• Controalele efectuate de structurile sanitar-epidemiologice se efectuează conform contractelor cu respectarea periodicităţii de o dată la 10-15 zile.
• Controalele efectuate de Inspectoratul Principal de Stat în Standardizare, Metrologie şi protecţia consumatorilor din cadrul Serviciului Standardizare şi Metrologie se efectuează selectiv şi nu mai des de o dată în an, cu excepţia cazurilor când sunt reclamaţii de la consumatori.
• Serviciul sanitar-veterinar ia probe o dată pe săptămână conform contractelor,
• Întreprinderile nu dispun de mijloace financiare pentru a crea şi întreţine laboratoare.
• Suportul informaţional din partea ministerelor acordată agenţilor economici este foarte mic, adesea întreprinderile nu cunosc normele şi cerinţele în vigoare, nu cunosc cerinţele pieţei pe care intenţionează să plaseze produsele. Până în prezent se utilizează o serie de instrucţiuni neactualizate, care se utilizau în perioada fostei URSS.
Unii intervievaţi consideră că este necesar în mod urgent prin decizia Guvernului să se formeze o comisie din specialişti din ramură pentru a examina nivelul dotării tehnice a întreprinderilor producătoare de produse alimentare, dotarea cu utilaj tehnologic, dotarea cu laboratoare de încercări, organizarea controlului chimico/tehnologic şi microbiologic, pregătirea profesională a specialiştilor, a bazei de acte normative, controlului la toate etapele producerii, începând cu materia primă şi terminând cu păstrarea produselor. În baza rezultatelor acestei evaluări, MAIA va crea mecanismul de creare a condiţiilor de dezvoltare a producerii şi a cerinţelor unice în care trebuie să activeze agenţii economici care produc produse alimentare, indiferent de volumul producţiei, a formei de proprietate.
Aceste măsuri ar permite să se soluţioneze problemele în ramură stabilind:
• Numărul de întreprinderi care fabrică produse alimentare,
• Volumul produselor fabricate de fiecare întreprindere şi respectiv în total pe ţară,
• Nivelul dotării cu utilaj respectiv,
• Calitatea produselor fabricate
În scopul eliminării barierelor tehnice în comerţ şi protecţia pieţei RM de pătrunderea produselor necorespunzătoare cerinţelor în vigoare sau periculoase inclusiv şi genetic modificate se consideră oportun crearea Centrului privind securitatea şi calitatea produselor alimentare, dotat cu echipament modern, laboratoare pentru încercări etc.
În prezent laboratoarele de încercări folosesc echipament încă procurat în anii 1950-1980, şi în prezent nu dispun de mijloace financiare pentru a procura utilaj modern.
8.6. Corespunderea organelor de control din RM cerinţelor UE
( Analiza este efectuată în comparaţie cu cerinţele directivei 882/2004)
• Structura de dirijare
În RM sunt două nivele de dirijare –central şi local (raional sau municipal)
Structura trebuie modernizată cu delegarea unor funcţii şi responsabilităţi la nivel local, şi dimpotrivă de întărit sistemul de reglementare de stat acolo unde merge vorba de securitatea alimentară
• Independenţa în luarea deciziilor şi imparţialitatea
Principiul de independenţă a serviciilor din cadrul controlului oficial şi de reglementare sunt stabilite prin legislaţie , în practică ele sunt la etapa de dezvoltare.
• Resursele
În RM se resimte o mare insuficienţă de resurse pentru asigurarea eficientă a controlului oficial al produselor inclusiv implementarea directivelor europene pentru produsele alimentare. În special putem menţiona punctele de control la frontieră, laboratoarele etc. Se are în vedere lipsa resurselor pentru dotări, pregătirea personalului etc.
• Personalul
Conform cerinţelor directivei personalul trebuie să aibă statut de independenţă faţa de agentul economic supus controlului. În cazurile când se antrenează personal din afara autorităţii de control, personalul trebuie să întreprindă măsuri care să asigure acelaşi nivel de independenţă ca şi personalului angajat conform schemei de încadrare
În prezent în RM completarea cu personal calificat este nesatisfăcătoare.
• Abilităţile conform legislaţiei
Autorităţile de supraveghere a pieţei conform legislaţiei sunt suficiente, nu este creat mecanismul pentru a fi realizate la nivel eficient
Stabilirea priorităţilor şi stabilirea procedurilor documentate pentru activitate
În prezent pentru sectorul alimentar priorităţile sunt stabilite de DG SANCO conform evaluărilor care au fost făcute şi recomandările care reiese din rezultatul evaluării. Aceste priorităţi sunt incluse în Planul de acţiuni UE-RM.
Totodată având în vedere lipsa procedurilor documentate, auditul intern nu se efectuează.
• Serviciile laboratoarelor de investigări
Reţeaua de laboratoare este la etapa de dezvoltare (inclusiv prin programul FSP)
• Structurile pentru controlul importului
Conform datelor oficiale nu există înregistrări corespunzătoare privind măsurile de supraveghere şi restricţionare. În special recepţionarea, prelucrarea depozitarea şi transmiterea produselor de origine animală şi a animalelor care urmează a fi transmise în UE.
• Controlul stării animalelor
În prezent MAIA elaborează baza legislativă pentru asigurarea unui sistem eficient de evidenţă a animalelor armonizat cu cerinţele europene. Sistemul de urmărire şi evidenţă a animalelor va fi în sistem automatizat şi întreţinut informaţional.

7. COMPARATIVE ANALYSIS OF THE MOLDOVAN AND EU PRACTICES
Moldova has trade relations with a number of countries, including EU members.
To maintain and develop its relationships with the EU countries, the Republic of Moldova should firstly implement the RM-EU Actions Plan and the recommendations of DG SANCO on the requirements for obtaining the status of third countries that are allowed to export products of animal origin to the EU, and namely:
• Fully comply with the WTO requirements
• Accede to the European and Mediterranean Plant Protection Organization,
• Actively participate in the World Organization for Animal Health, International Plant Protection Convention, Codex Alimentarius,
• Develop, on the basis of the Commission recommendations on the trade in products of animal origin, measures for gradual implementation of the hygienic requirements for foodstuffs, harmonized with the European ones (time of enforcement, law amendment, costs),
• Evaluate the system of sanitary and phytosanitary control against the EU one,
• Carry out actions of animal identification and animal tracing system;
• Meet the EU requirements regarding the animal health and products of animal origin.
The specialized public administration bodies in the area of foodstuffs shall prove that they meet the general requirements, and namely:
• Existence of a proper legal framework on various substances, especially regarding the prohibition or permits of their spread, including the inspection procedure and implementation of quality systems,
• Existence of a proper ongoing control of the content of some substances and their residues in products of animal origin, especially for export-oriented products,
• Competence of sanitary services regarding the control of the compliance with the sanitary-hygienic requirements.
The European Directive 882/2004 broadens the requirements both for products of animal origin and forage. According to the new directive, the EC shall request that third countries, which intend to export products to the EU, provide thorough and timely information about the organization and management of food safety activities, especially:
o Sanitary and phytosanitary regulations (adjusted or proposed by the country),
o Control and inspection procedures, quarantine procedures, the procedures and methods used to identify residues of pesticides in food products,
o Risk assessment procedures, the factors taken into account, the level of sanitary and phytosanitary protection,
The “guarantees” provide that the export to the EU shall comply with the Directive on foodstuffs and there shall be an equivalent treatment.
The information requested from the countries willing to export to the EU will be verified against any possible risk related to this product, and may be regarded as a "certain situation and structure" of the third country.
The regulation principles will by formulated in such a way as to meet the Commission requirements, and have a sufficient transition period for the preparation of such information.
Inappropriate information may lead to the imposition of some conditions.
FVO will audit the "equivalence” presented in the information, as well as the compliance of management and food security systems with the EU requirements. The control reports shall be public.
The new directive empowers that the EU control bodies to carry out controls at the food plants based in the EU. The regulation also empowers the Commission experts to make an official control of the plants based in third countries.
It is important to mention the following control principles that shall be implemented:
• Conduct a systematic risk-based controls,
• Conduct unscheduled controls,
• Conduct a control at all stages of production, processing, and distribution,
• Extend the control for import and export products, as well as for foodstuffs traded on the EU market.
The FVO Mission to the Republic of Moldova during 23-27 May 2005 was held based on a request of the Moldovan Government to export products of animal origin and products derived from animal origin. At present, the only product of animal origin intended for human consumption, which Moldova is authorized to export to the EU, is honey (Commission Decision 2004/432/EC of 29 April 2004).
The system of veterinary laboratories is a basic area that needs to be restructured and adjusted to the EU requirements.
The recommendations of FVO Mission regard this issue and call for a system revision through harmonization of the laws in force, including of the Monitoring Plans of the animal health, residues in products of animal origin and forage along the entire chain, starting with the forage producers to animal products processor to trade outlets.
To analyze the situation in the Republic of Moldova with regards to the official control of foodstuffs, we will compare the European requirements with the de facto situation, as follows:
Activities carried out by the State
Six main elements of the official control of products have been determined, five of which are based on the FAO recommendations, approved on the international arena:
1. Foodstuffs Law and other regulatory acts in this area. The development of the Foodstuffs Law is a component part of the control system. It is necessary to establish restriction measure for the failure to comply with the law.
A Foodstuffs Law was approved in the Republic of Moldova, but there haven't been provided any mechanisms for the efficient enforcement of this law.
2. Coordination of the foodstuffs control system
An efficient foodstuffs control system requires a strategy on operative national control, which should be organized in such a way as to cover the responsibility of all services involved in this control.
The Republic of Moldova doesn’t have any strategy on the operative coordination of food control system.
3. Control services
The proper management and control of the food control requires qualified and well trained staff that will carry out honestly the control functions and work independently without running into any conflicts of interests. The restrictive measures shall be passed through courts of law.
The Republic of Moldova doesn’t have a law on the official control of foodstuffs, based on Directive 882/2004; some requirements are included in specific technical regulations.
There is no regulatory act regarding the inspection of enterprises on the basis of HACCP principles.
4. Laboratories
The testing laboratories are a component part of the foodstuffs control system. They need to be provided with proper equipment for testing physical-chemical and micro-biological indices. The laboratories must be accredited, provided with qualified staff, and recognized on the international arena.
The Moldovan laboratories are accredited only in the national accreditation system; they are not accredited and recognized on the European arena. They are poorly equipped.
5. Information, studying, and training
Submission of information about all components of the production cycle form the farm to the table is an important factor for the inspectors in the market surveillance activity. The professional qualification of the staff of the control bodies, including the state inspectors, need to be permanently upgraded, in line with the European requirements.
This system lacks in the Republic of Moldova.
Principle of producer’s self-control and responsibility
According to the new European law, the foodstuffs producers shall bear full responsibility for the foodstuffs’ security. Therefore the implementation of quality management system and risk assessment at the production stage is crucially important.
In the EU the HACCP system is mandatory for all processing and end-products manufacturing companies. Such a self-control is already implemented, especially by the large companies, but it lack at the meat factories.
The HACCP system provides for a logical chain of risk assessment during the production stage in order to avoid them. The companies shall record all controls, carried out under HACCP system, for surveillance purposes. The Best Practices Code is the control instrument used by farms.
At present the food industry is trying to departure from the old traditional control methods of the end-product and tends to implement methods that help avoid the production of dangerous products. The Best Practices Code is more frequently used (e.g. EUREPGAP), whereby the hygienic requirements become more demanding.
In some countries the law requests that the companies have their own laboratories. In terms of the food security, it is crucially important that any product has free access to the laboratory, especially in the context of product traceability.
However, the HACCP system has an important role, securing the traceability of foodstuffs. The critical control points need to be determined on the basis of deep researches, in some cases of a scientific nature. The European law provides for the registration of the foodstuffs companies in order to allow the identification of the producer. Each company is attributed a registration number, which shall accompany the product till the point of destination. The producer shall record the ingredients used for subsequent identification.
The Republic of Moldova Law on Foodstuffs stipulates some requirements for HACCP system. Thus:
- Article 21 runs - "System for Hazard Analysis and Food Circuit Control in the Critical Control Points
The economic units in the food area shall implement systems for hazard analysis and food circuit control in the critical control points, performing the following:
a) analyze the eventual foodstuffs contamination threats during the technological flow in the food enterprises;
b) determine the stages of the technological flow that pose eventual threats and establish the critical points;
c) carry out the control in the critical points;
d) assess, on a periodical basis, the efficiency of the conducted controls in line with the provisions laid down in items a) to c) and update the provisions, if the foodstuffs production process changes”.
- Article 29 runs – “The law, except for Article 6 item c), the part related to the hazard analysis system and foodstuffs circuit control in the critical control points, and for Article 21, shall enter into force on 1 January 2007”. Thus, the requirements related to the compulsory implementation of HACCP system are in force. However, it is worth mentioning that at present very few enterprises have certified their quality systems, including under HACCP system.
Only a few enterprises (10) have certified their quality systems and only 4 under the HACCP system.
To settle these problems, support of external donors is needed, as well as to inform the economic units about the privileges of conformity certification, in case when the company implements and certified the HACCP system.
8. CONCLUSIONS
8.1. Legal and normative framework
In general, the legal framework for the food market surveillance was created: the general laws (Law on Foodstuffs, Law on Activity of Technical Regulation, Law on Customer Protection) and the special laws, referring to some specific products have been approved and are developing continuously.
There haven’t approved and implemented any laws, and especially regulatory acts, on the safety and quality requirements (technical regulations) for products, developed on the basis of European directives.
At the same time, there is a need for a law on marker surveillance or official control of products that would regulate all issues related to market surveillance, appoint market surveillance authorities and define their responsibilities and clearly delimit their functions.
8.2. Institutional Framework
The Law on Foodstuffs, Law on Activity of Technical Regulation stipulates that the technical regulation and market surveillance shall be carried out by the authorized authorities.
However, the list of authorized authorities is not published in any law in force.
The functions are not clearly delimited in any law or regulatory act, thus allowing for possible overlapped functions, excessive controls, and possible uncovered product types. At the same time, the bodies authorized with control functions in the area of foodstuffs are also performing the branch controls, which should actually have an advisory, methodological support, technological nature, rather than a restrictive purpose.
The role of customs structure is not clearly defined in the market surveillance system.
It is necessary to speed up the establishment of Food Security Agency, that will centralize the functions related to products' security and quality, on the one hand, and will foster the development of food processing enterprises through support, monitoring, and consulting, on the other hand.
8.3. Situation with the testing laboratories, certification bodies used during the market surveillance, and certification bodies.
It is a fact that at present the structures provided with surveillance and control functions don’t have their own laboratories. There are neither established any criteria of placing the samples for laboratory testing, for purposes of market surveillance, in certain laboratories. The existing laboratories are not equipped appropriately for tests of harmlessness indices and quality characteristics. Thus, the lack of properly equipped laboratories represents an impediment to the identification of products that fail to comply with the set requirements. The RM-EU Actions Plan stipulates in section "Develop the Market Surveillance Capacities” the need to develop the testing laboratories, but no action has been taken in this respect yet.
At present 10 organizations of foodstuffs certification are accredited in the Republic of Moldova.
It is necessary to strengthen two elements of the official control over foodstuffs: Food Products Inspectorate and laboratories, in order to ensure an efficient control over foodstuffs and forage, and the relevant services related to food products processing and animal health.
In addition, in is necessary to:
• Modernize the national laboratory of the Republican Centre for Veterinary Diagnosis by re-equipping it, acquiring new testing methods, and implementing quality systems,
• Use two additional laboratories, provided with new modern analytical equipment,
• Train the laboratory staff in modern testing methods.
8.4. Situation of the staff involved in the market surveillance activity
The analysis of the situation of the staff involved in the market surveillance activity reveals a number of problems, related mainly to the low motivation due to low salaries, difficult working conditions, inappropriate endowment, lack of access to proper training.
8.5. Producers’ opinion
A number of enterprises were interviewed to find their opinion about the controls carried out by the control bodies.
Here are the respondents' replies:
• The sanitary-epidemiological structure carries out controls in accordance with the contractual provisions, every 10-15 days.
• The Main State Inspectorate for Standardization and Metrology and customer protection under the Standardization and Metrology Service carry out their controls randomly, but not more frequent than once a year, except for the cases when they receive claims from consumers.
• The sanitary-veterinary service takes samples on a weekly basis, according to the contractual terms,
• The enterprises don’t have enough financial means to establish and maintain their own laboratories.
• The ministries offer very little informational support to economic units. Often the enterprises are not aware of the norms and requirements in force; don't know the requirements of their potential sales markets. They still use a series of old instructions, inherited from the former USSR.
Some interviewees believe that it is necessary to establish shortly, through a Government Decision, a committee consisting of branch experts, that would assess the level of technical endowment of food processing enterprises, the endowment with technological equipment, the endowment of testing laboratories, the conduct of the chemical/technological and microbiological control, staff training, development of proper regulatory acts, control at all stages of production, from raw material to storage of end-products. On the basis of data from this assessment, the MAFI will create a proper mechanism that will allow setting appropriate conditions for foodstuffs development. It will also establish single requirements for economic units that produce foodstuffs, regardless of the volume of production and form of ownership.
These measures will settle some problems in this area by establishing:
• The number of enterprises that produce foodstuffs,
• The output of every enterprise and, respectively, the overall output per country,
• The level of endowment with proper equipment,
• The quality of manufactured products.
In order to eliminate the technical trade barriers and protect the Moldovan market from products that fail to meet the requirements in force, or pose a danger, or are genetically modified, it would be benefic to establish a Centre for Food Security and Quality, provided with modern equipment, testing laboratories, etc.
The testing laboratories are still using the equipment procured back in 1950-1980, and don’t have enough financial means to buy modern equipment
8.6. Compliance of the Moldovan control bodies with the EU requirements
(The analysis is made in comparison with the requirements of Directive 882/2004)
• Management Structure
In the Republic of Moldova there are two management structures – central and local (rayon and municipal)
The structure needs to be modernized, by delegating some functions and responsibilities to the local level. On the contrary, the state regulation system needs to be tightened in areas of food security.
• Independence and impartiality in decision-making
The principle of independence of official control and regulation services are laid down in the law, but de facto they are still under development.
• Resources
The Republic of Moldova has a severe shortage of resources needed for an efficient official control of products, including for the implementation of the European directives on foodstuffs. This is especially true of the customs control points, laboratories, etc. By this we mean the lack of resources for equipment, staff training, etc.
• The staff
As per the directive, the staff shall be independent from the controlled economic unit. If external staff is contracted, then they should ensure the same level of independence as the staff employed by the control authority.
At present there is a shortage of qualified staff in the Republic of Moldova.
• Abilities according to the law
According to the law, there are enough market surveillance authorities, but there isn’t any efficient enforcement mechanism.
Setting priorities and documented procedures for the activity
At present the priorities of the food sector are established by DG SANCO, on the basis of the performed assessments and resulting recommendations. These priorities are included in the EU-RM Actions Plan
At the same time, there is no internal audit due to the lack of documented procedures.
• Services provided by testing laboratories
The network of laboratories is under development (including under FSP programme)
• Structures for import control
According to the official data, there aren’t any relevant records of surveillance and restriction measures. This is especially true about the receipt, processing, storing, and circulation of products of animal origin and animals that are to be transported into the EU.
• Control of the animal’s status
At present MAFI is developing the legislative basis that will secure an efficient system of animal tracing, in line with the European requirements. The animal tracing and recording system will be automated.

ORIUNDE NE-AM AFLA, OAMENI SĂ RĂMÎNEM
Dialogul studenţilor cu refugiaţii a fost apreciat cu nota maximă
În luna decembrie, curent, un grup de studenţi ai Universităţii Libere Internaţionale din Moldova au lansat şi organizat prima şedinţă a clubului de discuţii DIXY CLUB la care au participat nu doar studenţii de la Departamentul Jurnalim şi Ştiinţele Comunicării, fondatorii clubului oratoric, ci şi de la economie, drept, istorie, relaţii internaţionale, psihologie etc. Tema pusă în discuţie – Statutul juridic şi social al refugiaţilor aflaţi în Moldova – a fost inspirată de noul curs de lecţii Mass-media şi Refugiaţii, (prof. D.Maxim, Magistru în Jurnalism) susţinut de Reprezentanţa ICNUR în Moldova.
Fireşte, tonul discuţiilor a fost dat de studenţii-audienţi ai cursului în cauză iniţiindu-i pe cei prezenţi cu terminologia şi noţiunile folosite în sistemul azilului. Faptul că printre invitaţi au fost şi un grup de refugiaţi (din Sudan, Siria etc.) discuţia a devenit şi mai interesantă. Întrebările şi răspunsurile veneau atît către şi de la studenţii-audienţi ai Cursului, cît şi de la / către refugiaţi.
Un comunicat interesant pentru cei neiniţiaţi în domeniu a fost prezentat de Romeo Maxian, student la Departamentul Istorie, cu tema: “Evoluţia sistemului de azil în Republica Moldova”, prin care a atras atenţia şi asupra cauzelor apariţiei refugiaţilor. “Legea R.Moldova privind statutul refugiaţilor este apreciată de către experţii internaţionali, însă implementarea acesteia lasă de dorit; în genere realităţile prin care trec solicitanţii de azil, refugiaţii, sunt mult mai dure, iar obţinerea statulul de refugiat nu e un proces tocmai uşor“ – susţine colegul de la istorie.
Un alt comunicat elaborat într-o formă eseistică şi dintr-un unghi psihologico-social a avut tema „Refugiaţii – suflete pierdute sau provizoriu lipsiţi de mîna Domnului” prezentat de Ion Mandeş, sutdent la Comunicare Publică, de la care reţinem că: “Refugiaţii îşi pierd casa, prietenii, avuţiile, dar nu renunţă la viaţă! Lipsiţi de toate acestea, cine ar fi în stare să reziste anevoiosului drum al bejenieii? Ei nu au nevoie de compasiunea celor din jur, ci de respectul şi înţelegerea lor”.
S-a vorbit şi despre faptul că refugiaţii au dreptul să studieze la instituţii de învăţămînt superior, însă marea problemă a lor constă în imposibilitatea de a-şi achita taxele pentru studii. Aceasta e şi cauza din care mulţi nu-şi permit luxul de a căpăta o profesie, deşi, avînd dreptul la muncă, s-ar părea că au posibilităţi să adune banii necesari pentru acest scop. Aici, însă, apare problema respingerii acestora de către unii patroni, ori salarizarea muncii lor la minim. Unul dintre refugiaţi, mulţumit că Moldova i-a oferit gazdă şi minimul necesar, a menţionat că solicitantul de azil întîmpină mari greutăţi în vederea obţinerii statutului de refugiat ori a unui loc de muncă. La rîndul lor, studenţii au aflat multe lucruri privind cauzele părăsirii de către aceştia a ţării de origine şi numeroasele greutăţi prin care au trecut în drum spre ţara de azil.
Discuţia s-a încheiat mult mai tîrziu decît se preconizase, pentru că apăruse prea multe întrebări şi chiar unele neclarităţi privind aspectele juridice ale problemei în cauză, dar, propriu-zis, şi situaţia incertă a unor refugiaţi şi solicitanţi. Cu toate acestea îmbucurător a fost faptul că atît organizatorii, studenţii cît şi refugiaţii s-au arătat solidari şi s-au bucurat de înţelegere reciprocă. E un lucru minunat şi asta ne-a bucurat cel mai mult – oriunde ne-am afla, oameni să rămînem.
Se zice că timpul le pune pe toate la locul lor.
Şi pentru că vă cunosc problemele, dar şi marea dorinţă de a reveni la locurile natale, vă doresc împlinirea acestora cît mai degrabă posibil, astfel încît de acum încolo toate sărbătorile să le întîlniţi cu cei dragi în sînul familiei, în pace şi cu bucurie sufletească.

În timp ce copiii refugiaţi se distrau în blocul B, concomitent, în sala de festivităţi a aceleiaşi grădiniţe nr. 119 (director - Tatiana Palamari), micii actori de aici erau în aşteptarea lui Moş Craciun cu un spectacol extraordinar.
REALITĂŢILE MIGRAŢIONALE ÎN MOLDOVA DISCUTATE ÎN CADRUL UNEI
MESE ROTUNDE DEDICATĂ ZILEI INTERNAŢIONALE A MIGRANŢILOR
Oficiali guvernamentali, reprezentanţi ai organizaţiilor internaţionale şi ai societăţii civile au discutat diverse aspecte ale migraţiei şi impactul acestia asupra dimensiunii umane şi dezvoltării Republicii Moldova, în cadrul unei mese rotunde organizată de către Organizaţia Internaţională pentru Migraţie (OIM), cu ocazia Zilei Internaţionale de Solidaritate cu Migranţii.
La Masă rotundă cu genericul “Ziua Internaţională a Migranţilor: Realităţi Migraţionale în Moldova”, participanţii au abordat problema migraţiei ca un fenomen complex care exercită un impact atât pozitiv, cât şi negativ asupra societăţii moldoveneşti.
Discuţiile au fost axate având la bază patru studii, realizate de OIM, UNICEF şi PNUD, cu sprijinul Agenţiei Suedeze de Cooperare şi Dezvoltare Intrenaţională (SIDA) şi al Comisiei Europene. Impactul migraţiei şi al remitenţelor la nivel de gospodărie, situaţia copiilor rămaşi fără îngrijirea părintească în urma migraţiei, costul uman al migraţiei, impactul ei asupra comunităţilor şi încălcarea drepturilor migranţilor moldoveni – iată câteva subiecte care au fost discutate.
Aceste studii arată, inter alia, că în timp ce nivelul remitenţelor migranţilor moldoveni a crescut şi în prezent constituie o treime din produsul intern brut (mai mult de un milliard de dolari în 2006), iar nivelul investiţiilor în micul business s-a mărit, fenomenul migraţiei în Moldova are un impact negativ asupra copiilor rămaşi fără îngrijirea părinţilor care au plecat la munci peste hotare, iar drepturile migranţilor din Moldova sunt încălcate. Aceste constatări dovedesc faptul că problema migraţiei trebuie percepută ca un fenomen complex, cu aspecte atât positive, cât şi negative.
“Nu putem nega faptul că migranţii contribuie semnificativ la dezvoltarea socială şi economică a ţărilor în care lucrează şi trăiesc. Reeşind din aceasta, în egală măsură trebuie acordată atenţie siguranţei şi bunăstării lor, – a declarat Directorul General al OIM, Brunson McKinley. – Migranţii trebuie ajutaţi într-o manieră rapidă, sigură şi bine-coordonată”.
ÎMBUNĂTĂŢIREA PLEDOARIEI INTERAŢIONALE A ORGANIZAŢIILOR
NEGUVERNAMENTALE
ECRE (Consiliul European pentru Refugiaţi şi Exilaţi),
este o reţea pan Europeană de organizaţii nonguvernamentale
de asistenţă şi promovare a protecţiei şi integrării solicitanţilor de azil, a refugiaţilor şi a persoanelor intern strămutate în baza valorilor demnităţii umane, a drepturilor omului şi a eticii solidarităţii
Pe 24 şi 25 octombrie, în oraşul Moscova, în incinta Centrului de odihnă “Soiuz”, s-a desfăşurat seminarul regional cu tematica Îmbunătăţirea pledoariei interaţionale a organizaţiilor neguvernamentale, organizat de către ECRE (Consiliul European al Refugiaţilor şi Exilaţilor) cu participarea reprezentanţilor ONG din Moldova, Belarus, Ucraina şi Rusia.
Întrunirea a avut drept scop oferirea sprijinului necesar organizaţiilor neguvernamentale, din cele patru ţări, ce activează în domeniul apărării drepturilor omului, în special ale refugiaţilor şi solicitanţilor de azil şi este doar unul din seria de întîlniri internaţionale organizate de ECRE pentru reprezentanţii ONG care, în pofida multor greutăţi, îşi continuă activitatea în acest domeniu. Schimbul de experienţă şi practicile înaintate ale unor participanţi a extins agenga seminarului. În acest context dl Jan Hendrik Doerfel (ex-Consilier de Programe, Consiliul Europei), consideră că “activităţile ONG pot avea şi un efect adiţional dacă, în implementarea proiectelor lor, ar folosi mecanismele ONU şi chiar Raportorii Speciali ai Naţiunilor Unite la un nivel mai aprofundat. Acest fapt ar avea un efect practic şi în cazurile individuale şi ar duce neapărat la extinderea colaborării şi schimbului de informaţii dintre ONG şi avocaţi”.
Fără îndoială, la sfîşitul celor două zile de discuţii şi sesiuni, participanţii au rămas mulţumiţi de organizarea eficientă a seminarului şi s-au încurajaţi recipoc în promovarea respectării drepturilor omului în ţările pe care le reprezintă.
“PREZENŢA EXPERŢILOR DIN ROMÂNIA A PERMIS SCHIMBUL DE IDEI ŞI EXPERIENŢE UTILE”
În perioada 20-24 noiembrie 2006, la Predeal, România, s-a desfăşurat un seminar de instruire pentru un grup de judecători din Republica Moldova. Seminarul face parte dintr-un proiect mai vast, finanţat de Uniunra Europeană, la solicitarea Reprezentanţei ICNUR în Moldova şi, practic, reprezintă o continuare a procesului de instruire şi familiarizare a reprezentanţilor instituţiior de resort guvernamentale privind domeniul azilului.

“Consider că organizarea seminarului a fost excelentă, atît din punct de vedere al modului în care a fost structurată agenda, a calităţii materialelor şi informaţiilor prezentate, cît şi din punct de vedere al timpului alocat pentru discuţii şi aplicaţii practice. Am convingerea că semianrul a adus pentru participanţi clarificări în ceea ce priveşte conceptele şi mecanismele din cadrul procedurii de azil şi că informaţiile prezentate le vor fi utile în activitatea de zi cu zi”.

“Seminarul a oferit cadrul perfect pentru discutarea unor probleme deosebite legate de noţiunile fundamentale ale protecţiei internaţionale pentru factorii de decizie implicaţi în procedura de recunoaştere a statutului de refugiat. Acesta a permis o prezentare cuprinzătoare şi concretă a principalelor concepte, precum şi a modalităţilor practice de abordare a acestora. În plus, prezenţa experţilor din România a permis schimbul de idei şi experienţe utile în abordarea viitoare a evaluării solicitărilor formelor de protecţie. Prin toată organizarea sa, seminarul s-a ridicat la standarde foarte înalte în ceea ce priveste activităţile de instruire, atît de importante în munca de zi cu zi a practicienilor.
Doresc să apreciez contribuţiile active, nivelul prezentărilor, profesionalismul şi implicarea tuturor factorilor în această activitate, să mulţumesc organizatorilor pentru invitarea colegilor din România în vederea realizării unui schimb util de experienţă, precum şi să remarc continuitatea în organizarea unor astfel de evenimente din partea UNHCR şi a partenerilor săi din Republica Moldova. Avînd în vedere participarea şi la alte evenimente de acest gen, consider că seminarul organizat anul acesta la Predeal a fost cu mult mai mult decît reuşit”.

Pe data de 9 decembrie 2006, Clubul Internaţional al Femeilor din Moldova a organizat cel de-al 10-lea Tîrg Anual, cu participarea tuturor ambasadelor străine şi organizaţiilor internaţionale din Moldova, inclusiv Reprezentanţa ICNUR şi partenerii săi de implementare.
Aşteptarea lui Moş Crăciun de către copiii din familiile refugiate şi solicitante de azil, a fost anticipată de un frumos dar venit din partea Reprezentanţei ICNUR prin intermediul ONG Salvaţi Copiii - absolut toţi copiii, circa 40, au primit vestimentaţie şi încălţăminte de iarnă. În acest scop au fost alocaţi circa 25 mii de lei.

The dialog between the students and the refugees was appreciated at maximum
This December a group of students from the International Free University of Moldova launched and organized the first session of the discussion club DIXY CLUB, which was attended not only by the students of the Journalism and Communication Sciences Department, who are the founders of the oratory club, but also by students in economy, history, international relations, psychology, etc. The topic for discussions - The legal and social status of the refugees in the Republic of Moldova – was inspired by the new course Mass-media and the Refugees, (prof. D. Maxim, MA in Journalism) supported by the ICNUR representative office in Moldova.
Obviously, the key of the discussions was given by the students attending this course, informing the attendees about the terms and notions used in the asylum system. The presence of some refugees (from Sudan and Syria) made the discussion even more interesting. Questions and answers came both from and for the students-attendees of the Course and the refugees.
An interesting report for those unfamiliar with this field was presented by Romeo Maxian, a student at the History Department, on the topic: “The Evolution of the Asylum System in the Republic of Moldova”, via which he drew the attention on the very causes of the refugees existence. “The Law of the Republic of Moldova on the refugees status is highly appreciated by the international experts, but its implementation is far from satisfactory; generally, the realities faced by the asylum seekers and refugees are much harsher, and the process of getting the refugee status is not an easy one” – states our colleague from the History Department.
Another report presented in the form of an essay from a psycho-social point of view was entitled "The refugees - lost souls or temporarily spared God's blessing" whose author was Ion Mandeş, a student in Public Communication, who said that: “The refugees lose their home, friends, wealth, but they do not give up life! Deprived of all this, who can stand the hard road of wander? They do not need the compassion of those around; they need their sympathy and respect.”
There was also considered the right of the refugees to study in higher educational institution, but the great problem here is that they cannot afford paying the educational fees. That is why they cannot learn a job; though enjoying the right to work it seems that they have the opportunity to collect the means for this purpose. Another problem is employers’ refusal to employ them or minimum remuneration for their work. One of the refugees, grateful that Moldova provided him with home and met his basic needs, mentioned that the asylum seekers encounter great difficulties in receiving the refugee status or a work place. In their turn, the students found out about the reasons for leaving their country of origin and the huge number of problems met on the way to the asylum country.
The discussions lasted for a longer period of time than was initially planned, because there were raised many questions and uncertainties regarding the legal aspects of the approached issues, and also the doubtful situation of some refugees and asylum seekers. Nevertheless, it was encouraging that both the organizers, students and refugees were unanimous in their thoughts and reached mutual understanding. That was a wonderful thing and we were very happy – wherever we are, we shall stay humans.
They say time that finds a place for everything.
And as I know your problems and also your great desire to return to your native places, I wish you the fulfillment of this desire as soon as possible, so that from now on you could celebrate all the holidays within your family, in peace and joy.

THE MIGRATIONAL REALITIES IN THE REPUBLIC OF MOLDOVA APPROACHED DURING A
ROUND TABLE DEDICATED TO THE INTERNATIONAL DAY OF MIGRANTS
Governmental officials, representatives of international organizations and of civil society discussed different aspects of migration and its impact on the human dimension and the development of the Republic of Moldova during a round table, organized by the International Organization for Migration (IOM) on the occasion of the International Day of Solidarity with Migrants.
During the round table with the topic “The International Day of Migrants: Migrational Realities in the Republic of Moldova”, the participants approached the migration issue as a complex phenomenon that has both a positive and negative impact on the Moldovan society.
The discussions were based on four studies carried out by IOM, UNICEF, and UNDP supported by the Swedish International Cooperation and Development Agency (SIDA) and European Commission. The impact of migration and of remittances on the households, situation of the children left without parental care as a result of migration, the human cost of migration, its impact on the community and violation of Moldovan migrants’ rights – these are a few issues that have been discussed.
These studies show that, inter alia, while the level of Moldovan migrants’ remittances has increased and amounts at a third of the Gross Domestic Product (more than a billion dollars in 2006), and the level of the investments in small businesses has grown, the migration phenomenon in Moldova has a negative impact on children left without parents’ care, who went to work abroad, and the rights of Moldovan migrants are being violated. These findings prove that the migration issue should be perceived as a complex phenomenon, having both positive and negative aspects.
“We cannot deny that migrants contribute significantly to the social and economic development of the countries they work for and live in. On this basis, equal attention should be paid both to their safety and welfare – stated the IOM Director General, Brunson McKinley. -The migrants shall be helped in a quick, safe, and well-coordinated manner.”
IMPROVEMENT OF THE INTERNATIONAL ADVOCACY OF
NON-GOVERNMENT ORGANIZATIONS
ECRE (European Council for Refugees and Exiled),

aimed at assisting and promoting the protection and integrity of the asylum seekers, refugees and internal displaced persons on the basis of human dignity values, human rights and solidarity ethics
A regional seminar entitled “Improvement of the International Advocacy of the Non-Government Organizations” was held by the ECRE (European Council for Refugees and Exiled) on October 24 and 25 within “Soiuz” Resort Center. This event was attended by representatives of NGOs from Moldova, Belarus, and Russia.
This meeting had the purpose of providing the necessary support to Non-Government Organizations from the four countries that operate in the field of human rights protection, in particular of refugees and asylum seekers and was just the first meeting within the series of international meetings organized by ECRE for the NGO representatives who, despite the great difficulties, continue to work in this field. The experience exchange and proposed practices of some of the attendees enlarged the seminar agenda. In this context, Mr. Jan Hendrik Doerfel (Programs ex-Counselor, Council of Europe), believes that “NGO activities can have an additional effect if, during the implementation of their projects, they used UN mechanisms and even UN Special Reporters at a larger extent. This would have a practical effect in individual cases too and would improve inevitably the collaboration and information exchange between the NGOs and lawyers.”
Undoubtedly, at the end of the two days of discussions and sessions, the participants were satisfied with the efficient organization of this seminar and mutually encouraged each other to promote the human rights observance in the countries they represent.
“THE PRESENCE OF ROMANIAN EXPERTS ALLOWED FOR THE USEFUL IDEAS AND EXPERIENCE EXCHANGE”
A training workshop for a group of judges from the Republic of Moldova was held in Predeal, Romania during the period of October 20-24, 2006. The workshop is a part of a larger project, funded by the European Union at the request of the UNHCR representative office in Moldova and is practically a continuation of the process of training and familiarizing the representatives of the governmental line institutions in the asylum area.

On December 9, 2006, the International Club of the Women of Moldova organized the 10th Annual Fair, attended by all the foreign embassies and international organizations from Moldova, including the UNHCR representative office and its implementation partners.
While waiting for Santa Claus, the children from refugee families and asylum seekers were offered a beautiful gift by the UNHCR representative office via Save the Children NGO – all the children, there were almost 40 of them, received warm clothes and footwear. Almost 25 thousands lei were allotted for this purpose.

Măsuri care trebuie luate zilnic pentru а preveni problemele de sănătate:
• Spălarea mâinilor este cea mai importantă măsură de prevenire а bolilor. Părinţii şi copiii trebuie să-şi spele mîinele după ce schimbă scutecele şi înainte de masă pentru а preveni răspândirea microbilor. Învăţaţi-i pe copii să se spele pe mâini când sunt destul de mari ca să mănânce singuri.
• Îmbrăcaţi-i cu haine potrivite vremii. Expunerea la temperaturi extreme sau la precipitaţii poate spori posibilitatea apariţiei bolilor.
• Nu-i lăsaţi în compania adulţilor bolnavi, mai ales când sunt foarte mici.
• Când bănuiţi că copilul este bolnav, puteţi telefona la medic şi îi puteţi descrie simptomele – aceştia pot da sfaturi şi remedii fără а mai face un consult oficial.
Obiective:
- să cunoacă modalităţile de prevenire a problemelor de sănătate;
- să cunoască cele mai efciente modalităţi de alimentare sănătoasă a copilului
Conţinuturi
Părinţilor le-а fost încredinţată o creatură mică care este complet dependentă de ei. Printre alte griji, noii părinţi sunt preocupaţi să-l crească pe micuţ sănătos şi în siguranţă, iar acest lucru devine mai dificil când creşte şi începe să se mişte – e extraordinar cum se mişcă de repede mânuţele şi picioruşele acelea mici!
Casa trebuie “asigurată” pentru copil
Copiii trebuie lăsaţi liberi să exploreze împrejurimile. Odată ce а început să meargă de-а buşilea, părinţii trebuie să aibă grijă să nu existe obiecte cu care să se rănească sau obiecte valoroase pe care le poate sparge. Când v-aţi asigurat că nu mai există nici un motiv de îngrijorare, puteţi să vă relaxaţi şi să vă bucuraţi de copilul Dvs.
Vom prezenta în continuare câteva sugestii pentru а transforma casa într-un mediu lipsit de pericole pentru copil.
• Începeţi prin а încerca să priviţi camera prin ochii copilului. Aşezaţi-vă pe podea şi uitaţi-vă la casă ca şi cum aţi fi copil. Asta vă va ajuta să vă daţi seama de eventualele obiecte periculoase pe care nu le-aţi observat până atunci. Căutaţi-le în toată casa: în bucătărie, în baie, în sufragerie şi mai ales în locurile în care nu puteţi fi tot timpul atenţi la copil.
• Puneţi toate medicamentele şi reţetele într-un loc sigur la care copilul nu poate ajunge. Faceţi acelaşi lucru şi cu substanţele de curăţit, cu plantele şi cu orice altceva poate fi înghiţit sau cu care se poate răni.
• Nu lăsaţi la îndemâna copiilor obiecte foarte meci, detaşabile care pot fi înghiţite sau obiecte cu margini ascuţite cu care se poate răni. Copii mici bagă tot ce găsesc în gură – aşa explorează ei obiectele noi. Controlaţi des jucăriile şi aruncaţi-le pe cele care s-au spart. De asemenea, jucăriile trebuie să fie tot timpul curate. Cele pe care le bagă în gură trebuie spălate des.
• Înlăturaţi obiectele casabile şi pe cele care-i pot cădea în cap copilului.
• Acoperiţi toate prizele şi nu lăsaţi firele electrice la îndemâna copilului.
• Unele substanţe de pe pereţi pot conţine plumb, care e foarte dăunător dacă este înghiţit sau inhalat. Înlăturaţi bucăţile decojite de vopsea şi mai ales pe cele de pe pervazul ferestrelor la care copilul poate ajunge uşor. Când zugrăviţi duceţi copilul de acasă până curăţaţi tot praful.
• Închideţi uşile sau construiţi o portiţă în faţa scărilor pe care copilul ar putea cădea sau pe care ar putea încerca să se caţăre singur.
• Acoperiţi găleţile de gunoi şi nu lăsaţi sacii cu gunoii la îndemâna copilului.
Pregătiţi-vă pentru cazuri de urgenţă
• Trebuie să ştiţi întotdeauna pe cine să chemaţi în cazuri de urgenţă. Puneţi lângă telefon numerele de la policlinică, numărul medicului pediatru (de acasă şi de la policlinică) de la farmacie, de la spitalul de urgenţă, pompieri, poliţie, ale membrilor apropiaţi ai familiei sau ale prietenilor apropiaţi.
• Procuraţi-vă un stingător de incendii şi învăţaţi să-l folosiţi.
• Realiza-ţi un plan de evacuare în caz de pericol şi repetaţi scena împreună cu toţi membrii familiei. Reveniţi asupra acestui plan în fiecare an şi faceţi schimbările necesare.
• Pregătiţi-vă o trusă de prim-ajutor şi anunţaţi toţi membrii familiei unde este pusă, învăţându-i cum se foloseşte. Să aveţi întotdeauna un termometru pentru copii şi medicamente la îndemână în caz de febră, dureri, urticarii, zgârieturi şi de asemenea medicamente pentru indus voma pentru cazurile în care copilul а înghiţit o substanţă otrăvitoare, găsişi ambalajul acesteia şi sunaţi la policlinică sau la un centru de control pentru otrăvuri. Urmaţi instrucţiunile de pe ambalaj cu mare atenţie. Nu induceţi voma, decât dacă instrucţiunile de pe ambalaj indică acest lucru în mod special. Unele otrăvuri, dacă sunt vomitate, pot afecta gâtul şi esofagul copilului.
Una dintre dilemele majore ale părinţilor de copii mici este faptul că trebuie să se afle în două locuri în acelaşi timp. Nu se pot juca cu copilul tot timpul; totuşi, copii mici nu trebuie lăsaţi nesupravegeaţi în locurile nesigure. Se pot întâmpla accidente dacă copilul este obosit, frustrat sau agitat, iar părintele este şi el nervors şi obosit. Pentru а preveni astfel de situaţii, părinţii trebuie să fie întotdeauna odihniţi. Încercaţi să vă odihniţi cât timp copilul doarme.
Părinţii se pot întreba: “Dar cum o să fiu gata cu toate la timp?”. Ţineţi copilul cu dvs. atunci când vă ocupaţi cu treburile casei şi folosiţi aceste momente ca pe nişte experienţe pe care cel mic trebuie să le înveţe. Daţi-i obiectele cu care lucraţi să se joace cu ele; se va simţi bine ştiind că vă “ajută”.
Pentru а putea să facă treaba, părintele trebuie să aibă mâinile libere. De aceea, copilul trebuie să aibă un spaţiu al lui în fiecare cameră, în care să se poată juca singur în siguranţă. Dacă este nevoie, instalaţi o portiţă pentru а-l ţine pe cel mic în acest spaţiu. Asiguraţi-vă că locul în care stă nu prezintă pericole de nici un fel. Faceţi în aşa fel încât să-l puteţi vedea tot timpul când stă singur. Trebuie verificat foarte des ce face.
Locurile pentru somn şi pentru joacă
Dacă aveţi treabă în dormitor, cel mai bun loc pentru copil este pătuţul lui – nu e numai pentru somn! Bebeluşilor le place să se uite la mobilă, darnu-i lăsaţi să pună mâna pe ea. Nu puneţi perne în pătuţ fiindcă se poate sufoca cu ele. Salteaua trebuie să fie destul de înaltă. Puneţi materiale de protecţie pa laturile pătuţului, dar astfel încât să nu cadă peste copil când doarme. Zăbrelele pătuţului trebuie să fie destul de dese, astfel să nu-i poată intra capul între ele.
Construiţi rafturi joase pentru а depozita jucăriile. Astfel, copilul va putea să le vadă şi să ajungă la ele de unul singur, şi va căpăta o oarecare independenţă putând să-şi aleagă jucăria. Aşa va afla şi unde sunt puse jucăriile când sunt strânse!
Pentru jucării mici se poate folosi o cutie de carton. Decupaţi o fotografie cu jucării dintr-o revistă şi lipiţ-o pe cutie. De exemplu, copilul va învăţa că toate animalele domestice se pun în cutia care are pe ea o poză cu animale domestice.
Cutiile mari de carton sunt perfecte pentru jocuri imaginare. Asiguraţi-vă că aţi îndepărtat toatele capsele care pot să-l rănească. Copiilor le place foarte mult să intre şi să iasă din cutii jucându-se “de-а…ceva” cu o păpuşă sau cu un animal de pluş. Cutiile pot fi vopsite ca să arate ca nişte căsuţe, castele, peşteri, etc. pentru jocuri mai extinse.
Baia poate deveni un loc extrem de periculos pentru un copil mic. Asiguraţi-vă că nu poate intra singur în cadă.
Bucătăria
Bucătăria e plină de obiecte şi situaţii periculoase, aşa că încercaţi pe cât posibil să ţineţi mâinile copilului ocupate şi să-l supravegheaţi permanent atâta timp cât se află aici.
• Folosiţi un sertar în bucătărie, aflat la mică înălţime în care să păstraţi jucăriile copilului. Puneţi în sertar obiecte nepericuloase (tigăi, castroane, instrumente de lemn) cu care acesta să se poată juca cât timp i se pregăteşte masa. Ţineţi-l aproape de dvs. ca să-i puteţi vorbi şi să vedeţi tot timpul ce face.
• În jurul vârstei de nouă luni, părinţii pot începe să-l înveţe pe copil cuvintele care desemnează pericolele din bucătărie: fierbinte, foc, pericol.
• Copiilor de un an le place să se joace cu ceşti şi farfuriuţe de plastic. Le plac tigăile, cratiţele şi orice pot să lovească şi să facă zgomot!
• Copiilor mai mari le plac vasele colorate. Folosiţi numai vase de plastic care nu se pot sparge. Ei încep să înţeleagă regulile, dar vor să le testeze limitele. Nu uitaţi că, deşi copii cresc foarte repede, memoria lor se dezvoltă mai lent. Nu vă enervaţi şi amintiţi-i copilului cum să se poarte astfel încât să nu se rănească. În timp ce pregătesc mâncarea, părinţii pot discuta cu copiii despre regulile de igienă din bucătărie: strângerea firimiturilor, spălatul pe mâini înainte de masă, aruncatul hârtiilor murdare.
Alimentaţia sănătoasă
Părinţii petrec o bună bucată de timp în bucătărie împreună cu copiii atunci când îi hrănesc. Copiii mici mănâncă de mai multe ori pe zi. În afară de mesele principale de dimineaţă, de la prânz şi o băutură înainte de culcare. Gustările pot fi alcătuite într-o ceşcuţă de suc şi câţiva biscuiţi sau legume. Asiguraţi-vă că în cursul zilei copilul а primit câte un fel din fiecare din cele 5 grupe importante de alimente: pâine sau cereale, fructe, legume, lapte şi carne sau alte produse bogate în proteine. Nu faceţi exces de grăsimi şi dulciuri şi nici de aditivi nesănătoşi cum ar fi sarea, condimentele, untul, zahărul şi mierea. Bebeluşii cresc repede şi au nevoie de toate vitaminele şi mineralele pentru а deveni adulţi sănătoşi. Vom prezenta mai jos câteva sfaturi pentru o alimentaţi sănătoasă а copiilor mici.
ÎNCURAJAŢI ALEGEREA FELURILOR DE MÂNCARE PENTRU O DIETĂ SĂNĂTOASĂ
Fiţi răbdători. Copii mici nu sunt prea încântaţi când le introduceţi feluri noi de mâncare. Încercaţi mâncarea nouă de mai multe ori, puţin câte puţin. Arătaţi-i copilului că şi celorlalţi le place felul respectiv. Alimentul va fi acceptat când devine mai familiar.
Alcătuiţi un plan
Daţi-i trei sau mai multe alimente din cele cinci grupe principale la micul dejun şi la prânz.
Daţi-i patru sau mai multe alimente din cele cinci grupe principale la “masa principală”.
Faceţi în aşa fel încât gustările să nu fie prea aproape de mesele principale şi daţi-le două sau mai multe alimente din cele cinci grupe principale.
Fiţi un model. Ceea ce fac părinţii contează mai mult ceea ce spun. Copiii învaţă de la părinţi ce şi cum se mănânce.
• Staţi la masă în familie de câte ori este posibil
• Încercaţi mâncăruri noi şi feluri noi de а le găti
• Legumele verzi, cale galbene şi cerealele sunt sănătoase atât pentru copii cât şi pentru adulţi
Fiţi curajoşi. La magazin, părinţii îi pot lăsa pe copii să aleagă o legumă sau un fruct nou, dându-le posibilitatea să aleagă din două sau trei variante, pentru seară “Un nou fel de mâncare” care se organizează în fiecare săptămână. Acasă, copiii pot ajuta la spălatul şi prepararea mâncării.
Fiţi creativi. Încurajaţi copilul să inventeze un nou fel de sandwich sau o nouă gustare folosind trei ingrediente sănătoase. Încercaţi un nou tip de pâine sau cereale. Discutaţi despre noile alimente introduse şi despre grupele din care fac ele parte. Descrieţi culorile şi “materialele” din care sunt făcute. Gustarea e moale, crocantă, dulce, zemoasă, gelatinoasă sau colorată? Când vor deveni adulţi îşi vor dezvolta obiceiuri alimentare sănătoase.
Fiţi atenţi. Supravegheaţi întotdeauna copilul în timpul meselor şi al gustărilor. Copiii de 2-3 ani riscă să se înece cu mâncare şi acest risc nu este eliminat decât în jurul vârstei de 4 ani când pot mesteca şi înghiţi mai bine. Iată câteva mâncăruri ce pot provoca înecul.
• Cârnaţii
• Nucile şi seminţele
• Floricelele de porumb
• Morcovii cruzi
• Bucăţelele de carne
• Untul de arahide
• Stafidele
• Strugurii întregi
• Covrigii
• Chips-urile
• Ţelina crudă
• Cireşele cu sâmburi
• Bucăţile mari de fructe
• Bomboane rotunde sau tari
Apetitul copiilor mici poate varia destul de mult de la o zi la alta în funcţie de ritmul de creştere şi de nivelul de activism. Atâta timp cât sunt de plini de energie, sunt sănătoşi, cresc bine şi mănâncă alimente variate, probabil că primesc elementele nutritive de care au nevoie de mâncare. Dacă părinţii sunt îngrijoraţi că copilul mănâncă prea mult sau prea puţin, trebuie să consulte medicul.
Desigur, o bună alimentaţie începe cu mult înainte ca copilul să poată mânca alimentele solide. Experţii au demonstrat cu mult timp în urmă, că alimentaţia mamei în timpul sarcinii influenţează dezvoltarea unui copil sănătos. Şi odată ce а venit pe lume, dieta sănătoasă trebuie să continue cu hrănirea la sân. Deşi nu toate mamele aleg să-şi hrănească copilul la sân, studiile au arătat că laptele de mamă asigură numeroase beneficii care nu pot fi obţinute prin înlocuiri. El conţine pe lângă toate elementele nutritive de care are nevoie copilul, şi anticorpi proveniţi din sistemul imunitar al mamei care previn colicii, diareea, infecţiile urechilor, ale plămânilor şi ale aparatului urinar. Alte studii au demonstrat că beneficiile hrănirii la sân durează mai mult decât pe perioada suptului, prevenind apariţia limformelor,
Diabetului, colitei, obezităţii şi numeroaselor alergii şi poate avea efecte benefice de lungă durată chiar şi asupra dezvoltării cognitive. Experţii recomandă hrănirea la sân а bebeluşilor pentru cel puţin 6 luni. Dacă aceasta durează un an, beneficiile despre care am vorbit vor fi şi mai numeroase. Medicul pediatru va decide când copilul este pregătit pentru а încerca mâncarea solidă şi va recomanda alimentele necesare. Mulţi dintre aceştia dugerează introducerea cerealelor îmbogăţite cu fier ca un supliment pentru laptele de mamă sau pentru formula de lapte înlocuitor. Introduceţi alimente noi treptat, câte unul odată, astfel încât să vă puteţi da seama dacă apar alergii sau dureri de burtă. Alimentele care provoacă alergii mai des sunt: grâul, alunele de pământ, albuşul de ou, lămâia şi laptele de vacă, deci este recomandabil să nu le introduceţi înainte de împlinirea vârstei de un an.
Copiii mai mari
А avea grijă de doi copii este mult mai obositor decât а avea numai unul de îngrijit, iar riscul accidentelor creşte. E important ca părinţii să ceară ajutor familiei şi prietenilor când simt că sunt copleşiţi.
Deşi copilul poate fi destul de mare să ajute la treburile casei sau să se joace cu fraţii mai mici, nu uitaţi că siguranţa lui este responsabilitatea dvs. Nu-i daţi responsabilităţi prea mari pe care să nu le poată realiza; acest lucru nu va face decât să sporească stresul familiei şi posibilitatea apariţiei unor incendii nedorite. Totuşi, părinţii trebuie să-i facă pe copiii mai mari să înţeleagă că sunt importanţi şi că trebuie să se joace cu fratele mai mic şi să-l supravegheze. Iată câteva moduri în care copilul mai mare se poate implica în crearea unui mediu securizant pentru cel mic.
• Părinţii pot învăţa copilul mai mare cum să caute obiectele care pot fi periculoase pentru cel mic. Creţi-i acestuia să se aşeze pe podea şi să vadă ce obiecte ar putea provoca accidente nedorite (de ex. prizele neacoperite)
• Părinţii îi pot învăţa pe cei mari reguli simple de siguranţă: cum să ceară ajutor prin telefon în cazuri de urgenţă. Arătaţi-le unde sunt scrise numerele importante de telefon şi recapitulaţi împreună planul de evacuare al familiei.
• Părinţii îi pot învăţa pe copiii mari să nu lase jucăriile lor la îndemâna celor mici. Discutaţi cu ei despre jucării, alegeţi-le pe cele care pot fi periculoase pentru cel mic şi găsiţii împreună un loc în care pot fi puse la adăpost.
• Lăudaţi-i de copii atunci când îşi amintesc regulile de siguranţă. Nu uitaţi să vă ocupaţi de amândoi copiii în egală măsură.
Prevenirea problemelor de sănătate
Cea mai bună modalitate de а menţine sănătatea copilului este prevenirea bolilor înainte ca acesta să se instaleze, iar aceasta se realizează prin programarea consultaţiilor regulate. Dacă părintele nu este sigur de ceva anume, trebuie să întrebe medicul sau asistenta. Nici o întrebare nu este lipsită de sens. Discutaţi cu aceştea despre vaccinurile periodice şi despre simptomele bolilor obişnuite ale copiilor mici. Puteţi cere informaţii şi despre câteva măsuri de prevenire. Pe care le puteţi lua acasă, cum ar fi să luaţi temperatura copilului în mod regulat. Unii doctori recomandă luarea temperaturi prin aplicarea termometrului la subţioară: puneţi termometru sub braţul copilului şi ţineţi-l în această poziţie 3-4 minute. Aceasta este o metodă mai confortabilă decât testul rectal pentru copii, dar nu uitaţi că temperatura luată subţioară este cu un grad mai scăzută decât cea orală. Orice nelămurire aţi avea, este mai bine să, faceţi o listă pentru а fi siguri că nu uitaţi să întrebaţi medicul ceva important. La trei luni, copilul trebuie să facă un prim control al dentiţei, iar următorul va fi programat când toţi îi vor apărea toţi cei 20 de dinţi, în jurul vârstei de 36 de luni. Desigur, acestea sunt doar câţiva indicatori generali. Părinţii trebuie să consulte medicul şi stomatologul atunci când copilul are nevoie.
Iată câteva măsuri care trebuie luate zilnic pentru а preveni problemele de sănătate:

• Îmbrăcaţi-i cu haine potrivite vremii. Expunerea la temperaturi extreme sau la precipitaţii poate spori posibilitatea apariţiei bolilor.
• Nu-i lăsaţi în compania adulţilor bolnavi, mai ales când sunt foarte mici.
• Când bănuiţi că copilul este bolnav, puteţi telefona la medic şi îi puteţi descrie simptomele – aceştia pot da sfaturi şi remedii fără а mai face un consult oficial.
Călătoriile
Este important să ne gândim la măsuri de siguranţă şi atunci când călătorim. Una dintre cele mai importante reguli este: nu lăsaţi niciodată copilul singur în maşină.
Pot rămâne încuiaţi înăuntru, sau pot fi expuşi la frig sau la căldură prea mare. Desigur, tot timpul există pericole când conduceţi, dar dacă şoferul este atent, se pot evita multe accidente. Nu vă suiţi la volan după ce aţi consumat alcool sau medicamente care determină încetinirea capacităţii de reacţie. Părinţii nu trebuie să pună viaţa lor şi а copiilor în pericol mergând cu un şofer care se află în pericol mergând cu un şofer care se află sub influenţa alcoolului sau а drogurilor. Copiii care cântăresc mai puţin de 13 kg trebuie aşezaţi cu faţa la scaunul maşinii, iar cei care cântăresc peste 13 kg pot fi aşezaţi cu spatele la scaun. Copiii trebuie să stea întotdeauna pe locurile din spate ale maşinii.
Comunicarea cu îngrijitoarea
Responsabilitatea părinţilor faţă de sănătate copilul continuă chiar dacă acesta este dat la grădiniţă, dacă este îngrijit de o dădacă său de un alt membru al familiei. Părinţii trebuie să-şi viziteze des copilul şi să semnaleze îngrijitoarei orice situaţie pe care ar observa-o. Înainte de а lăsa copilul în grija altcuiva discutaţi cu îngrijitoarea despre posibile nevoi speciale ale copilului (tratamente, medicaţie) pentru ca aceasta să fie pregătită. Oferiţi-i acestuia următoarele informaţii pentru а şti care sunt nevoile copilului.
• Copilul face un tratament medicamentos?
• Există vreo problemă de sănătate care necesită un tratament special?
• Are alergii?
• Este sensibil la anumite mâncăruri sau preferă anumite alimente?
De asemenea este important ca părinţii să discute cu îngrijitoarea în fiecare zi pentru а afla dacă există vreo schimbare а stării de sănătate, а dispoziţiei sau а comportamentului copilului. Anunţaţi-le pe îngrijitoare dacă:
• Un membru а familiei а plecat
• Un membru а familiei este bolnav
• Au fost introduse alimente noi
• Copilul а avut probleme legate de somn
• Au apărut schimbări fizice cum ar fi apariţia de dinţi noi, iritabilitatea neobişnuită, etc.
• Copilul а început să înveţe regulile pentru toaletă
• Copilul а fost certat pentru un comportament nedorit

Measures to be Taken Daily in Order to Prevent Health Problems:
• Washing hands is the most important disease prevention measure. The parents and children must wash their hands after changing the swaddling clothes and before eating to prevent the spread of germs. Teach the children to wash their hands when they are old enough to eat by themselves.
• Dress them with clothes correspondent to the weather. The exposure to extreme temperatures or precipitations can increase the risk of disease appearance.
• Do not leave them accompanied by sick adults, especially when the children are very small.
• When you suppose that the child is ill, you can call up the doctor and describe the symptoms – they can offer some advices and cures without making an official consultation.

Background
A small creature was entrusted to the parents, completely depending on them. Among other concerns, the new parents want to grow their baby healthy and safe, but this becomes more difficult when the child grows and begins to move - it is amazing how fast those small hands and legs are moving!
The house must be “prepared” for the child
The children have to be allowed to explore the surroundings. As the child begins to crawl, the parents must take care not to leave objects the children can hurt with, or valuable ones that they can break. When you get sure that there is no reason for anxiety, you can relax and be glad about your child.
Further, we will present some advices how to transform your house in a safe environment for the child.
• Begin by trying to look at the room through the eyes of the child. Sit down on the floor and look at the house as if you were a child. This will help you to be aware of the possible dangerous things you didn’t notice till then. Search them in the entire house: in the kitchen, bathroom, dining-room, and especially in the places where you can not pay attention to the child the whole time.
• Put all the medicines and prescriptions in a safe place that can not be reached by the child. Make the same procedure with detergents, plants and whatever can be swallowed or hurt with.
• Do not leave at child’s hand small, detachable objects that can be swallowed, or objects with sharp edges, possible to hurt with. The small children put everything they find into the mouth – this is how they explore the new objects. Inspect the toys on a regular basis and throw out the broken ones. Also, the toys have to be clean all the time. The ones the child puts into the mouth have to be washed often.
• Remove the breakable objects and those that can fall over the child.
• Cover all the sockets and do not let electric wires at the child's hand.
• Some substances from the walls can contain lead that is very noxious if it is swallowed or inhaled. Remove the stripped-off parts of dye and especially those from the window-sills, where the child can reach easily. When you paint, take the child away from home until you remove the dust.
• Close the doors or install a wicket in front of the stairs where the child can fall from or try to climb over alone.
• Cover the dustbins and don’t let the garbage-sacks at the child’s hand.
Get ready for emergency cases
• You have to know all the time whom to call in emergency cases. Put near the phone the phone numbers from the polyclinic, the phone number of the pediatrician (from home and polyclinic), from the drugstore, from the emergency hospital, fire-brigade, police, the numbers of close relatives or friends.
• Purchase a fire extinguisher and learn to use it.
• Develop an emergency evacuation plan, and repeat the situation together with the family. Get back to this plan every year and make the necessary changes.
• Prepare a medical kit, announce all family members where is it, and teach them how to use it. Have all the time at hand a thermometer for children and medicines in case of fever, aches, nettle rash, scratch marks and also medicines to provoke vomiting if the child swallowed a noxious substance, find its package and phone to the polyclinic or to a poison control centre. Follow attentively the instructions labelled on the package. Do not provoke vomiting, unless the instructions from the packing prescribe it specially. Some poisons, if vomited, can affect the child’s throat and oesophagus.
One of the major dilemmas of the small children’s parents is that they must be in two places at the same time. They cannot play with the child all the time; however, the children can not be left without supervision in uncertain places. There can happen accidents if the child is tired, frustrated or excited and the parent is also nervous and tired. In order to prevent such situations, the parents must be rested all the time. Try to have a rest when the child sleeps.
The parents can ask themselves: “But how can I be ready with everything in time?". Keep the child with yourself when you are concerned with the household and use these moments as some experiences that the child has to learn. Give him to play with the objects you work, he/she will feel well, realizing that he/she is “helping” you.
In order to work, the parent must have free hands. That’s why the child must have his own space in each room, where he/she can play safely alone. If it is necessary, install a wicket to keep the child in that space. Assure yourself that the place he stays in doesn’t pose any dangers. Try to see him/her all the time he/she stays alone. It is necessary to check very often what he/she is doing.
The places for sleep and play
If you have to do something in the bedroom, the best place for the child is his/her cot – it is not just to sleep! The babies like to look at the furniture, but do not let them touch it. Do not put pillows in the cot, because he/she can suffocate with them. The mattress must be quite high. Put protection materials by the sides of the cot, but in such a way that they can not fall over the baby when he/she sleeps. The bars of the cot heed to be quite close to each other, so that the baby’s head could not fit in the gaps.
Make low shelves to keep the toys. In such a way, the child will be able to see them and to reach them by himself/herself, also he will obtain a little bit of independence, having the possibility to choose the toy. So he/she will know where the toys are when they are gathered!
For small toys you can use a pasteboard box. Cut a photo with toys from a magazine and stick it to the box. For example, the child will learn that all domestic animals are to be put in the box that has on it a photo of domestic animals.
Big pasteboard boxes are perfect for games that develop the imagination. Make sure that you removed the staples that can hurt him/her. Children like very much to get in and out the boxes playing "something" with a doll or plush toy. The boxes can be painted in order to look like houses, castles, caves etc. for extended games.
The bathroom can be an extremely dangerous place for a small child. Make sure that he can not enter the bathtub by himself.
The kitchen
The kitchen is full of dangerous objects and situations, so that try to keep the child's hands busy and supervise him permanently when he/she stays there.
• Use a drawer situated at a small height to keep the child's toys. Put in the drawer objects that are not dangerous (pans, frying-pans, wood tools) and he can play with them during the time you are cooking his/her meal. Keep the baby close to you in order to talk to him/her and to see all the time what he/she is doing.
• At the age of about nine months, the parents can start to teach the baby the words that mean dangers in the kitchen: hot, fire, danger.
• One-year babies like to play with cups and plates made of plastics. They like pans, frying-pans and everything they can hit and make noise!
• Older children like colored crockery. Use only kitchenware of plastics that can not be broken. They begin to understand the rules, but want to test the limits. Do not forget that although the children grow up fast, their memory develops slower. Do not get nervous and remember the child how to behave in order not to get hurt. While cooking, the parents can discuss with the children the rules of hygiene in the kitchen: gathering the crumbs, washing the hands before the meal, throwing out the dirty pieces of paper.
The healthy nutrition
The parents spend a large part of time in the kitchen with the children while feeding them. Small babies eat a number of times a day besides the main meals from the morning, noon and a drink before going to bed. The light meals can consist of a cup of juice, some biscuits or vegetables. Make sure that during the day the baby got each type of the 5 important groups of food: bread or cereals, fruit, vegetables, milk, and meat or other products rich in proteins. Abuse neither of fats and sweets, nor of unhealthy additives as salt, condiments, butter, sugar, and honey. The babies grow up fast and need all the vitamins and minerals to become healthy adults. We will present below several advices for a healthy nutrition of babies.
STIMULATE THE CHOICE OF THE MEALS FOR A HEALTHY DIET
Be patient. Small children are not too delighted when you introduce new meals. Try out the new meals more times, little by little. Show to the child that the others like this meal, too. The meal will be accepted when it becomes more usual.
Draft a plan
Give him/her three or more food ingredients from those five main groups at the breakfast and lunch.
Give him/her four or more food ingredients from those five main groups at the “main meal”.
Arrange in such a way, that the light meals would not be too close to the main meals and during them give two or more food ingredients from the main five groups.
Be an example. The things that parents do are more important than what do they say. The children learn from parents what and how to eat.
• Take the meal with the whole family as often as possible.
• Try new meals and new ways of cooking them.
• The green vegetables, the yellow ones and the cereals are healthy both for children and for adults.
Be courageous. At the foodstore the parents can let the child choose a new vegetable or fruit, giving them the possibility to choose from two or three variants for the “a new meal” evening, which is organized every week. At home, the children can help at washing products and cooking.
Be creative. Encourage the child to invent a new type of sandwich or a new light meal using three healthy ingredients. Try a new type of bread or cereals. Discuss about the newly introduced food ingredients and the groups they are from. Describe the colours and “substances” they are made of. The snack is tender, crispy, sweet, juicy, gelatinous, or coloured? When they become adult, they will develop healthy nutrition habits.
Be attentive. Supervise the child every time during the meals and snacks. The children of 2-3 years risk swallowing the wrong way, and this risk is eliminated only at about the age of four years, when they can chew and swallow better. Here are some meals that can provoke swallowing the wrong way.
• Sausages
• Nuts and seeds
• Popcorn
• Crude carrots
• Pieces of meat
• Peanut butter
• Raisins
• Whole wine grapes
• Cracknels
• Chips
• Crude celery
• Cherries with stones
• Big pieces of fruit
• Round or hard lollipops
The appetite of babies can vary quite much from day to day, depending on rhythm of growing and level of activity. During the time they are full of energy, are healthy, grow well and eat various meals, it is probable that they get the nutritive elements they need. If the parents are worried because the child eats too much or little, they have to consult the doctor.
Sure, a good nutrition begins much earlier than the moment when the baby starts to eat solid food. Long time ago, the experts proved that the mother's nutrition during pregnancy influences the development of a healthy baby. From the birth, the healthy diet has to continue with the breast-feeding. Although not all mothers choose breast-feeding, the studies showed that mother’s milk provides numerous benefits, which can not be obtained by substitutes. Besides all nutritive elements that the baby needs, it contains antibodies from mother's immune system that prevent cramps, diarrhea, infections of ears, lungs and urinary system. Other studies showed that the breast-feeding benefits last longer than the period of sucking, preventing the appearance of lymphomas,
diabetes, cramps, obesity and numerous allergies and can bring long-term benefits even over the cognitive development. Experts recommend breast-feeding for at least 6 months. If it lasts 1 year, the above-mentioned benefits will be more numerous. The pediatrician will decide when the child is ready to try solid food and will recommend the necessary food. Many of them suggest the introduction of cereals fortified with iron, as a supplement to mother's milk or milk substitute formula. Introduce new foods step by step, one at a time, so that you could observe if there appear allergies or stomach aches. The following foods often provoke allergies: wheat, peanuts, glairs, lemon, cow milk, thus it is advisable not to introduce them before the age of 1 year.
Older children
To take care of two children is much more tiresome than to take care just of one, and the risk of accidents increases. It is important that in situations when the parents are overwhelmed, they would ask the family and friends for help.
Although the child can be old enough to help in household or play with younger brothers, don’t forget that his/her safety is your responsibility. Do not entrust him/her too big responsibilities he/she can't accomplish, this will just increase the family's stress and the higher likelihood of unwanted arguments. Although, the parents must make the elder children understand that they are important and that they have to play with the younger siblings and supervise them. Here are several ways by which the elder child can be involved in the creation of a safe environment for the younger one.
• The parents can teach the elder child how to search dangerous objects for the younger one. Ask him/her to sit down on the floor and to see what objects could provoke accidents (for example: uncovered plugs)
• The parents can teach the elder children some simple safety rules: how to ask help by phone in emergency cases. Show them where important phone numbers are written and recapitulate together the family’s evacuation plan.
• The parents can teach elder children not to leave their toys at the hand of younger children. Discuss with them about toys, choose the ones that can be dangerous for the younger child and find together a place where to hide them.
• Praise the children when they remember the safety rules. Don’t forget to take care of both children to the same extent.
The prevention of health problems
The best way to maintain the child’s health is to prevent the diseases before they occur, and it can be realized by programming regular consultations. If the parent is not sure of something, he/she must ask the doctor or the nurse. It is senseless not to ask any questions. Discuss with them about the periodical vaccines and about the symptoms of usual children‘s diseases. You could request information about some prevention measures. Measures that you can take at home, such as to take the child’s temperature regularly. Some doctors recommend taking the temperature by applying the thermometer under the arm: put the thermometer under the child’s arm and keep it in this position 3-4 minutes. This is a more comfortable method than the rectal test for children, but don’t forget that the temperature taken under the arm is lower by a degree than the oral one. Any misunderstanding you may have, it is better to make a list in order to be sure that you will not forget to ask the doctor something important. It is recommended to keep a journal of the vaccines and to write the advices that the doctor and the nurse give to you. In such a way, you will have a kind of register that can be consulted in emergency cases and presented to any other doctor. The doctors recommend complete medical checkups at 1 month, 2 months, 6 months, 9 months, 12 months, 15 months, 18 months, 24 months, and 34 months. All children have to be vaccinated to prevent such diseases as: measles, chicken pox, and mumps. At three months the child should pass the first control of the dentine, and the next will be programmed for the moment when he/she has all 20 teeth, at about 36 months. Sure, these are just a few general indicators. The parents must consult the doctor and the dentist when the child needs that.

Travels
It is important to think about safety measures when traveling. One of the most important rules is: never let the child alone in the car.
They can remain locked inside, or can be exposed to excessive cold or heat. Of course, every time there exists a danger when driving, but if the driver is attentive many accidents can be avoided. Do not drive if you had consumed alcohol or medicines that slow down the reaction capacity. The parents shouldn’t endanger the lives of their children and their own ones, traveling with a driver under the influence of alcohol or drugs. If there appear such situations, suggest that you would drive or find another way to get home. In order not to be distracted from driving by the child, give him/her something to do. When you are speaking with the child, stop the car.
The trip can be for joy or professional interest, but all the passengers have to fasten the safety belts. You can discuss with the children about the importance of the safety belt, but the best reason is to be an example for them fastening the safety belt every time. If the child is under 4 years, he/she must sit in a special chair for car. The children that weight less than 13 kg must face the car's chair, and those who weight more than 13 kg can sit with the back to the car's chair. The children should always sit in the back sit of the car.
Communication with the caregiver
The parents are still responsible for the child’s health even if he/she goes to a kindergarten, or is taken care of by a babysitter or other family member. The parents should visit frequently the child and inform the caregiver about any situation they notice. Before leaving the child under the care of somebody else, talk to the caregiver about the possible special needs of the child (treatment, medications) for him/her to be prepared. Inform him/her about the following, for him/her to know what needs the child has.
• Is the child under a medicinal treatment?
• Does he/she have any health problem that requires a special treatment?
• Does he/she have any allergies?
• Is he/she sensitive to certain meals or prefers some particular foods?
In addition, it is important that the parents discus with the caregiver on a daily basis to find out if there are any changes in the child’s health status, mood, or behavior. Inform the caregiver if:
• A family member has left
• A family member is sick
• New foods have been introduced
• The child had some sleep-related problems
• Some physical changes, such as appearance of a new tooth, unusual irritability, etc.
• The children has started to learn how to go to the bathroom
• The child was berated for an unwanted behavior
ENCOURAGEMENT METHODS TO DEVELOP THE ATTACHMENT
• React to the child’s needs;
• Tell to the child "I LOVE YOU, I SUPPORT YOU, I APPRECIATE YOU! " etc.;
• Help the child express and handle his/her feelings (including the anger and frustration);
• Share the child’s happiness with his/her achievements;
• Help the child clear out the ambiguous feelings in relation to other people;
• Discuss with your child the delicate issues (such as the sexual ones);
• React affectionately (hugs, kisses, physical contacts);
• Read fairy tales to your child;
• Play with your child;
• Go shopping together to buy him/her clothing/toys;
• Encourage open-air activities;
• Help the child with his/her drawings/tasks;
• Teach the child how to cook;
• Help the child understand the jokes or sayings used in the family;
• Teach the child how to participate in the family activities;
• Help the child meet the expectations of the people he/she finds important;
• Hang the child’s pictures on the wall;
• Involve the child in the family meetings or similar activities.

„36) să supună controlului, în limitele competenţei stabilite de lege, caracterul legitim al achiziţionării bunurilor, păstrării, transportării sau comercializării acestora, indiferent de forma de proprietate, în acest scop să viziteze întreprinderi, organizaţii şi instituţii, să efectueze cu participarea administraţiei cercetarea secţiilor de producţie, a depozitelor şi a altor încăperi de serviciu. Controlul se efectuează numai cu autorizaţia şi sub supravegherea conducătorului organului ce îl efectuează, acordându-se controlului predominant un caracter consultativ, cu încetarea acestuia în cazul imposibilităţii realizării sarcinilor prevăzute în articolul 2 al prezentei legi sau stabilirii circumstanţelor ce dovedesc imposibilitatea obiectivă de realizare a acestor sarcini;
37) să ceară, în temeiurile şi în limitele competenţei stabilite de lege, persoanelor oficiale şi gestionarilor, precum şi persoanelor ce însoţesc mărfuri, să prezinte documentele pentru bunurile materiale şi de altă natură; în caz de necesitate să verifice în prezenţa lor corespunderea acestor documente mărfurilor, materiilor prime, semifabricatelor, producţiei finite care se află în depozite, în încăperile de producţie şi în alte încăperi de serviciu, în mijloacele de transport;
38) să ceară, în temeiurile şi în limitele competenţei stabilite de lege, întreprinderilor, organizaţiilor şi instituţiilor să prezinte documentele tehnico-normative şi de evidenţă prin care se reglementează şi se omologhează operaţiile de folosire a bunurilor materiale şi mijloacelor băneşti;”
punctele 40) şi 41) vor avea următorul cuprins:
„40) în cazul apariţiei necesităţii de serviciu, cu condiţia existenţei înregistrării iniţiale şi a autorizaţiei conducerii organului, să ceară de la persoanele oficiale ale întreprinderilor, organizaţiilor şi instituţiilor, într-o formă inofensivă pentru interesele legitime ale acestora, documente, informaţii şi explicaţii asupra subiectelor interesate, ce vor facilita procesul de descoperire a faptelor prejudiciabile şi stabilirii persoanelor vinovate în comiterea acestora;
41) să ridice de la întreprinderi, în ordinea stabilită de lege, mostre de materie primă, semifabricate, articole şi să le trimită spre expertiză şi cercetare în laboratoarele de cercetări ştiinţifice şi în alte instituţii autorizate pentru aceasta;”
2. Articolul 41 alineatul (2) se completează, în final, cu propoziţia: „Nomenclatorul şi cuantumul tarifelor pentru serviciile (acţiunile) poliţiei contra plată, ce poartă un caracter obligatoriu, sunt stabilite conform anexei la prezenta lege, iar în cazul altor servicii cu plată – prin hotărîre a Guvernului, cu indicarea serviciului (actului) şi a mărimii taxei pentru aceste servicii (acte).”

ПАРЛАМЕНТ РЕСПУБЛИКИ МОЛДОВА
Закон о внесении изменений и дополнений в некоторые законодательные акты
Парламент принимает настоящий органический закон.
Ст. I. В Законе о полиции № 416-XII от 18 декабря 1990 года (повторное опубликование: Официальный монитор Республики Молдова, 2002 г., № 17-19, ст. 56), с последующими изменениями, внести следующие изменения и дополнения:
1. В статье 13:
пункты 36)-38) изложить в следующей редакции:
«36) в пределах установленной в законном порядке компетенции, проверять законность закупки материальных ценностей, их хранения, транспортировки или реализации, независимо от формы собственности и в этих целях посещать предприятия, организации и учреждения, с участием администрации проводить осмотр производственных, складских и прочих служебных помещений. Проверка носит преимущественно консультативный характер и проводится только с разрешения и под надзором руководителя контролирующего органа и прекращается в случае невозможности реализации задач, предусмотренных статьей 2 настоящего Закона или установления обстоятельств, объективно доказывающих невозможность реализации данных задач;
37) на основании и в пределах установленной законом компетенции, требовать у должностных и материально ответственных лиц, а также у лиц, сопровождающих грузы, документы на материальные и другие ценности, при необходимости сверять в их присутствии соответствие документов товарам, сырью, полуфабрикатам, готовой продукции, находящиейся на складах, в производственных и иных служебных помещениях, в транспортных средствах;
38) на основании и в пределах установленной законом компетенции, требовать у предприятий, организаций и учреждений нормативно-технические и учетные документы, которыми регламентируются и оформляются операции по использованию материальных ценностей и денежных средств;»
пункты 40) и 41) изложить в следующей редакции:
«40) в связи с служебной необходимостью, отметив свое присутствие в организации и с разрешения руководства, требовать у ответственных лиц предприятий, организации и учреждений, в форме, не ущемляющей их законные интересы, документы, сведения и предоставления по интересующим полицию вопросам, для раскрытия неблаговидных деяний и установления лиц, их совершивших;
41) изымать на предприятиях, в предусмотренном законом порядке, в качестве образцов сырье, полуфабрикаты, изделия и направлять их для проведения анализа и исследований в научно-исследовательские лаборатории и другие полномочные учреждения.”
2. Часть (2) пункта 41 дополнить заключительным предложением: «Перечень и тарифы платных услуг (действий), предоставляемых полицией в обязательном порядке, определены в Приложении к настоящему закону, другие платные услуги устанавливаются Постановлением Правительства, с наименованием услуги (действия) и расценок на эти услуги (действия).»
