SECCION TERCERA
De la servidumbre de paso
Art. 564. El propietario de la finca o heredad, enclavado entre otras ajenas y sin salida a camino público, tiene derecho a exigir paso por las heredades vecinas, previa la correspondiente indemnización.
Si esta servidumbre de paso se constituye de manera que pueda ser continuo su uso para todas las necesidades del predio dominante estableciendo una vía permanente, la indemnización consistirá en el valor del terreno que se ocupe y en el importe de los perjuicios que se causen en el predio sirviente.
Cuando se limite el paso necesario para el cultivo de la finca enclavada entre otras y para la extracción de sus cosechas a través del predio sirviente sin vía permanente, la indemnización consistirá en el abono del perjuicio que ocasione este gravamen.
Art. 565. La servidumbre de paso debe darse por el punto menos perjuicial al predio sirviente, y, en cuando fuere conciliable con esta regla, por donde sea menor la distancia del predio dominante al camino público.
Art. 565. La anchura de la servidumbre de paso será la que baste a las necesidades del predio dominante.

PART THREE
On easement of access
Section 564. The owner of a country property situated between properties belonging to others and with no access to the public highway may claim a compulsory right of way through the neighbouring properties, subject to payment of the appropriate compensation.
If this easement of access is such that it is continually being used for all the needs of the dominant estate thus establishing a permanent thoroughfare, the compensation shall consist of the value of the land it occupies and the damages suffered by the servient estate holder.
When access is limited to that necessary for the cultivation of the dominant estate situated between others and for removal of its crops through the servient estate without establishing a permanent thoroughfare, compensation will consist of the payment of the damages caused by this encumbrance.
Section 565. The easement of access shall be granted at the point least prejudicial to the servient estate and, insofar as consistent with this rule, at the shortest possible distance from the dominant estate to a public highway.
Section 566. The width of the easement of access shall be sufficient to fulfill the needs of the dominant estate.

Artículo 25. Requisitos para la entrada en territorio español.
1. El extranjero que pretenda entrar en España deberá hacerlo por los puestos habilitados al efecto, hallarse provisto del pasaporte o documento de viaje que acredite su identidad, que se considere válido para tal fin en virtud de convenios internacionales suscritos por España y no estar sujeto a prohibiciones expresas. Asimismo, deberá presentar los documentos que se determinen reglamentariamente que justifiquen el objeto y condiciones de estancia, y acreditar medios de vida suficientes para el tiempo que pretenda permanecer en España, o estar en condiciones de obtener legalmente dichos medios.
Artículo 26. Prohibición de entrada en España.
1. No podrán entrar en España, ni obtener un visado a tal fin, los extranjeros que hayan sido expulsados, mientras dure la prohibición de entrada, así como aquellos que la tengan prohibida por otra causa legalmente establecida o en virtud de convenios internacionales en los que sea parte España.
2. A los extranjeros que no cumplan los requisitos establecidos para la entrada, les será denegada mediante resolución motivada, con información acerca de los recursos que puedan interponer contra ella, plazo para hacerlo y autoridad ante quien deben formalizarlo, y de su derecho a la asistencia letrada, que podrá ser de oficio, y de intérprete, que comenzará en el momento mismo de efectuarse el control en el puesto fronterizo.
Artículo 27. Expedición del visado.
1. El visado se solicitará y expedirá en las Misiones Diplomáticas y Oficinas Consulares de España, y habilitará al extranjero para presentarse en un puesto fronterizo español y solicitar su entrada. Excepcionalmente, los visados de estancia podrán ser solicitados y expedidos en el puesto habilitado para la entrada.
2. Reglamentariamente se establecerá la normativa específica del procedimiento de concesión y expedición de visados, conforme a lo previsto en la disposición adicional undécima de la Ley 30/1992, de 26 de noviembre. En dicho procedimiento podrá requerirse la comparecencia personal del solicitante.
3. El ejercicio de la potestad de otorgamiento o denegación de visados se sujetará a los compromisos internacionales vigentes en la materia y se orientará al cumplimiento de los fines de la política exterior del Reino de España y de otras políticas públicas españolas o de la Unión Europea, como la política de inmigración, la política económica y la de seguridad ciudadana.

Section 25. Requirements for leave to enter Spanish territory.
1. A foreign national seeking leave to enter Spanish territory must apply to a post designated to that end and be in possession of a national passport or travel document which satisfactorily establishes his or her identity, is considered valid for that purpose in accordance with international conventions ratified by Spain, and whose holder is not subject to any specific prohibition. Likewise he or she must produce the documentation stipulated in the regulations which demonstrates the purpose and the circumstances of his or her stay, and must either provide evidence of adequate financial means of support for the time he or she intends to remain in Spain, or be in a position to legally obtain such means.
Section 26. Refusal of leave to enter Spain.
1. Any foreign nationals who have been expelled may not be granted leave to enter Spanish territory, nor obtain entry clearance to do so, for as long as the leave to enter prohibition remains in force; and the same restrictions apply to those who are barred from entering Spain on other legal grounds or pursuant to the provisions of any international conventions in which Spain is a participating state.
2. Foreign nationals who do not meet leave of entry requirements will be informed of the ruling against them and the reasons for the refusal in writing, which will come into force from the time of examination by the Immigration Officer at the port of entry, together with information on how to appeal against the decision, the period within which and before which authority an appeal must be brought, and their right to both legal representation, which may be court-appointed, and an interpreter.
Section 27. Issue of entry clearance.
1. Visa nationals may apply for entry clearance to Spanish Diplomatic Missions and Consular Offices, which issue visas permitting the former to arrive at a Spanish port of entry and request leave to enter. In exceptional cases, short-stay visas may be applied for to, and issued at, the port of entry.
2. The rules relating to the exact procedure of the grant and issue of entry clearance shall be laid down in accordance with the eleventh additional provision of Act No. 30, of 26th November, 1992. During the application procedure, the applicant may be required to appear in person.
3. The exercise of discretionary powers in the grant or refusal of entry clearance shall be subject to current international commitments and be guided by the foreign policy objectives of the Kingdom of Spain, and by other Spanish and European Union public policy objectives in spheres such as immigration, the economy and public safety.

NORMAS DE REGLAMENTO INTERIOR DE LA COMUNIDAD DE PROPIETARIOS DE "XXXX"
Con estas normas se pretende regular los detalles de convivencia y la adecuada utilización de los servicios y cosas comunes.
NORMATIVAS REGULADORAS
Artículo 1º La Comunidad de Propietarios de los cuatro apartamentos que constituyen XXXX situado en CALLE XXXX, nº X, término municipal de XXXX, se regirá para su funcionamiento por las disposiciones contenidas en la vigente Ley de Propiedad Horizontal y por los Estatutos aprobados por la Comunidad de Propietarios. En lo que en estas disposiciones no se consigne, la Comunidad se regirá por lo establecido en el presente reglamento y en su defecto, por los acuerdos de la Junta de Propietarios.
Artículo 2º Para la aprobación y modificación parcial o total del presente Reglamento, se estará a lo dispuesto en el número 2 del articulo 16 de la Ley de Propiedad Horizontal, esto es mediante el voto de la mayoría del total de los propietarios que a su vez represente la mayoría de las cuotas de participación, con las disposiciones complementarias expresadas en el indicado nº 2 del artículo 16 para los casos en que dicha mayoría no pudiera alcanzarse por falta de asistencia.
Artículo 3º De conformidad con lo preceptuado por el artículo sexto de la citada Ley de Propiedad Horizontal "las normas de régimen interior obligarán a todo titular, mientras no sean modificadas en la forma prevista para tomar acuerdos sobre la administración"
Artículo 4º Se aplicará el contenido del artículo 19 de la Ley de Propiedad Horizontal, a toda infracción de las normas establecidas en las presentes Normas de Régimen Interior, dando lugar por tanto al apercibimiento al titular o en su caso al ocupante del piso, por escrito del Presidente de la Comunidad. Desatendido el requerimiento por el titular ocupante, la Junta podrá instar y obtener judicialmente la privación del uso del piso o local a aquél y a quienes con él convivan. Dicha privación la fijará discrecionalmente el Juez, por un plazo no superior a dos años atendida la gravedad de la falta, sin que afecte a los restantes derechos dominicales y a la obligaciones derivadas del título. Así mismo, tendrá la Junta acción contra el ocupante no propietario, para obtener del Juez el lanzamiento o resolución del contrato, en su caso, pero sólo podrá ejercitarla cuando el titular no lo hiciera en el plazo prudencial que se hubiere señalado en requerimiento fehaciente. Para el ejercicio de las expresadas acciones judiciales se seguirán los trámites del proceso abreviado de cognición, siendo Juez competente el municipal o comarcal del lugar donde esté sita la finca, salvo lo dispuesto en la Ley de Arrendamientos Urbanos.
CONVIVENCIA
Artículo 5º Los propietarios y ocupantes de las edificaciones procurarán que no se altere la vida tranquila de las mismas con voces, cantares o ruidos molestos. Las máquinas, aparatos de radio y televisión, los de limpieza, etc., deberán regularse en su intensidad a fin de que el ruido no trascienda del ámbito del propietario piso o local que se utilice, y si ello resultare imposible por sus características, se utilizarán en horas que no sean las habitualmente dedicadas al descanso. Se procurará que los niños jueguen en las zonas destinadas a esparcimiento.
ANIMALES DOMÉSTICOS
Artículo 6º Como norma general no se permite la estancia de animales en los elementos comunes. Los animales domésticos, al salir de las viviendas deberán ir acompañados de sus propietarios y atados. De las suciedades o desperfectos que pudieran ocasionar los animales en elementos comunes, o privados, serán responsables los propietarios de los animales.
ASPECTO EXTERIOR
Artículo 7º No se permite colocar en los jardines, balcones o ventanas, objetos que no sean macetas de flores y otros adornos, siempre que no modifiquen su configuración o estado exterior.
Artículo 8º Se prohibe tender ropas en los balcones, jardines o ventanas, de las edificaciones que den a la calle. El tendido de prendas deberá efectuarse en los tendederos, debiendo hacerse debidamente escurridas para evitar molestos goteos a los vecinos de los pisos bajos.
Artículo 9º Para la colocación de rejas, persianas, antenas parabólicas y otros elementos de ornato exterior, así como para variar la pintura, alicatar o modificar el aspecto externo de las viviendas, será preciso contar con la aprobación de la Junta de Propietarios. Los vitrales emplomados, si se abren, deberán ser abatibles sobre eje horizontal bajo, hacia fuera (impidiendo que desde el interior puedan tener visión hacia abajo). Los herrajes barandillas, puertas de garaje, cancelas, etc., que originalmente se cubrieron con pintura color rojo Inglés 555 de TITAN, se repintarán con esta misma tonalidad.
Artículo 10º Los anuncios, carteles, rótulos e inscripciones indicadoras de los nombres de los propietarios se colocarán en el lugar y forma que se determine en Junta de Propietarios, así como los buzones para correspondencia.

INTERNAL RULES AND REGULATIONS OF THE “XXXX” RESIDENTIAL OWNERS ASSOCIATION
The intention of these Rules and Regulations is to regulate the details of coexistence within the community and to ensure the appropriate use of services and common elements.
RULES AND REGULATIONS
Section 1. The Owners’ Association of the four apartments which constitute XXXX, situated in CALLE XXXX, nº X, in the municipality of XXXX, shall be operated according to the provisions of the Horizontal Property Act currently in force, and the Statutes approved by the Owners’ Association. For any eventuality not specified in the aforementioned provisions, the Association shall be governed by these regulations and, where no stipulation is made therein, by resolutions passed by the Board of Owners.
Section 2. The approval and partial or total modification of these Rules and Regulations shall be subject to the provisions of Section 16, Subsection 2, of the Horizontal Property Act, that is, by a majority vote of all the owners, which shall in its turn represent the majority of the proportional ownership interests. The complementary provisions stated in the aforementioned Subsection 2 of Section 16 shall apply in the event that a majority cannot be reached as a result of lack of attendance.
Section 3. In accordance with the precepts of the sixth section of the aforementioned Horizontal Property Act, “the internal rules and regulations shall be binding upon all the owners, unless the former are modified in the prescribed manner in order to come to agreement on administrative issues.”
Section 4. The contents of Section 19 of the Law of Horizontal Property shall apply to any infraction of these Rules and Regulations, which shall be duly communicated to the owner or, where applicable, the occupant of the apartment, in a written notice signed by the President of the Association. Should the owner or occupant fail to respond to the notice, the Board may seek and obtain an order from the Justice of the Peace to deprive the former, together with anybody living with him or her, of the right to use the apartment. The period of the ban, which may not be longer than two years, shall be imposed at the discretion of the Justice of the Peace according to the degree of the infraction, without affecting the owner´s remaining ownership rights and obligations. Likewise, the Committee may bring a civil action against the non-owner occupant in order to obtain an eviction order or a repudiation of the contract, as appropriate, but may only bring said action when the owner has failed to do so within the time period allotted in a duly attested notice. The aforementioned civil action shall follow the process of abbreviated small claims proceedings, the competent judge being the Justice of the Peace of the municipality in which the property is situated, except as provided in the Urban Leasing Act.
COEXISTENCE
Section 5. The owners and occupants of the buildings shall ensure that they do not disturb the peace with shouting, loud singing or excessive noise. Machines, radio and television sets, domestic appliances, etc., must be adjusted to a level so that the noise may not be heard outside the property using them; should this prove impossible due to the nature of the latter, they shall be used at times other than those normally dedicated to rest. Parents shall ensure that children play in designated play areas.
PETS
Section 6. As a general rule, pets are not allowed in the areas common to all. Whenever a pet leaves its owner´s apartment, it must be on a lead and accompanied by its owner. The owners of the animals shall be responsible for any mess or damage caused by pets in both private and common areas.
APPEARANCE OF THE EXTERIOR
Section 7. Flowerpots and decorative objects are the only objects which may be placed in the gardens, and on the balconies and window ledges, provided that they do not alter the shape or exterior condition of the former.
Section 8. It is prohibited to hang laundry on the balconies, from the windows or in the gardens of the buildings overlooking the street. Washing must be hung on the fitted washing lines, having been previously wrung sufficiently to avoid dripping onto the property of residents on the floors below.
Section 9. If an owner wishes to fit window grilles, blinds, satellite dishes and other elements of exterior decoration, or change the colour of the paint, the exterior tiles or any aspect of the exterior appearance of the apartments, s/he must obtain the prior approval of the Board of Owners. The stained-glass leaded windows, if they open, must open outwards with the hinges at the bottom (so that no one can look out and down to the apartment below). The ironwork of the handrails, garage doors, gates, etc., which was originally painted with TITAN 555 English Red, shall be repainted in the same tone.
Section 10. Advertisements, posters, notices, name plates and mailboxes shall be situated in the place and in the manner determined by the Board of Owners.

Thanks for your enquiry and I am happy to tell you Casa XXXX is available from 7 to 22 August. The house is one of six small houses and apartments which share the pool and gardens of XXXX. We find in practice that it is never too busy in and around the pool, even when all six units are full, which they are not often.
XXXX has hosted guests for ten years now and many guests have repeated their holidays here; it has been an environment where friendships have been made - both adults and kids. In recent years we have received a mix of British, French and Spanish groups in high summer.
Casa XXXX occupies one of the quieter corners of the site, fronting neither the pool nor the road but being set on a quiet patio shared with one other house. There is a private roof terrace with views of the mountains and the Valley of XXXX. The village of XXXX itself has no bar or shop but bread, fish and other foods are delivered nearly every morning. You can drive in 5 minutes to the shops of XXXX or XXXX, and there is a very pleasant 25 minute walk to XXXX across country, which is safe to walk at night if you fancy a drink or a meal there.
That gives you a flavour of what is on offer. The rental tariff is €X for one week, €X for two weeks. If you want to reserve you need only pay 25% at this stage and this can be in cash in euros, by cheque or bank transfer. The balance can be paid nearer the time or in cash euros when you arrive, as you prefer.

PROGRAMA DE ASISTENCIA DENTAL
INFORMACIÓN PARA PADRES, MADRES Y TUTORES DE HIJOS/AS NACIDOS EN 1994, 1995, 1996, 1997, 1998, 1999, 2000, 2001, 2002, y 2003
Como saben en el año 2002 se puso en marcha a nivel andaluz la asistencia bucodental gratuita a todos los niños y niñas en edades comprendidas entre los 6 y los 15 años. La implantación de la asistencia se está llevando a cabo de forma progresiva; así, en este año 2008, se van a asistir a los nacidos entre los años 1994, 1995, 1996, 1997 1998, 1999, 2000, 2001, 2002 y 2003.
La asistencia dental básica incluye información sobre normas de higiene para mejorar y mantener la salud oral, la limpieza de boca si es necesaria, selladores, empastes, extracciones de dientes y otros tratamientos especiales. Se realiza por los dentistas de cabecera, bien de su Centro de Salud o entre aquellos que quiera elegir de la relación que se encuentra disponible en su Centro de Salud.
Si su hijo o hija ha nacido entre estas fechas ha tenido que ocurrir:
1. QUE SE HAYA RECIBIDO EL TALÓN VERDE: Este talón se llama Talón de Asistencia Dental Anual (TADA) y lo ha tenido que recibir desde la Consejería de Salud de la Junta de Andalucía. Para que le hayan podido prestar asistencia dental gratuita, ha tenido que entregarlo al dentista de cabecera que haya elegido. Si no lo ha utilizado aún y aunque su hijo o hijo no tenga caries, llévelo al dentista con el talón. No le costará nada y estará en manos de un profesional que se encargará de mantenerlo sin caries y aplicarle los programas de profilaxis que necesite.
2. QUE NO HAYA RECIBIDO EL TALÓN VERDE: Debe de solicitarlo en su Centro de Salud lo antes posible. Los requisitos para que se le entreguen en el mismo centro son que su hijo o hija haya nacido en los años mencionados y esté protegido por el Sistem Sanitaria Públco de Andalucía (tiene o haya solicitado la Tarjeta Sanitaria Individualizada).
Recuerde que para que su hijo o hija sea atendido de forma gratuita tiene la obligación de presentar el talón verde todos los años al dentista de cabecera elegido. Si tiene alguna duda en su Centro de Salud le informarán o llame al teléfono 902505060.

DENTAL CARE PROGRAMME
INFORMATION FOR PARENTS AND GUARDIANS OF CHILDREN BORN IN 1994, 1995, 1996, 1997, 1998, 1999, 2000, 2001, 2002 and 2003
As you know, in 2002 a programme was launched to provide free dental care in Andalusia for all children aged between six and fifteen years. The programme is being introduced progressively, meaning that this year dental care is being offered to children born in the years 1994, 1995, 1996, 1997, 1998, 1999, 2000, 2001, 2002 and 2003.
Basic dental care includes information about rules for oral hygiene to improve and maintain good oral health, hygienist teeth cleaning if necessary, sealants, fillings, tooth extraction and other specialised treatments, and is provided by either a dentist at your local Health Centre, or the dentist of your choice from a list of participating dentists available at the Health Centre.
If your child was born between these dates and:
1. S/HE HAS RECEIVED THE GREEN ENTITLEMENT SLIP: The proof of entitlement is called the Annual Dental Care Entitlement Slip and should have been issued to your child from the Health Department of the Andalusian Regional Government; it must be presented to the participating dentist of your choice in order to receive free dental care. If you have not yet used the entitlement slip, take your child to the dentist with it, whether or not s/he has any cavities. It will cost you nothing and you will be in the hands of a professional who will ensure that your child remains cavity-free and suggest appropriate teeth cleaning programmes.
2. S/HE HAS NOT RECEIVED THE GREEN ENTITLEMENT SLIP: You should apply for it in your local Health Centre at the earliest opportunity. To fulfill the requirements, your child must have been born in one of the years stated, be eligible for care under the Andalusian Health Service and either be in possession of or have applied for an Andalusian Health Service medical card.
Remember that you need to present the green entitlement slip to your chosen dentist every year. Your local Health Centre will be able to answer any queries you may have, or you can call this number: 902 505 060.
ASK IN YOUR HEALTH CENTRE ABOUT BENEFITS AND APPOINTMENTS! DON´T WAIT FOR YOUR CHILD TO HAVE CAVITIES BEFORE GOING TO THE DENTIST! APPLY FOR THE ENTITLEMENT SLIP IN YOUR HEALTH CENTRE IF YOU HAVEN´T RECEIVED IT!
