The Promoter shall not have any liability and shall not pay any consideration for the patients enrolled by the Investigator, by his own initiative, beyond the agreed maximum number or later than the date of the enrolment termination communication.

L’Organizzatore si impegna nei confronti della Società:
a) a mettere a disposizione della Società il Teatro degli Arcimboldi affinché possa tenervi la manifestazione indicata in premessa di cui al punto “B”, ivi compreso il tempo necessario per il montaggio e lo smontaggio;
b) a mettere a disposizione della Società, per il giorno durante il quale avrà luogo la manifestazione di cui al punto “B” delle premesse, il seguente personale :
- direttore tecnico/elettricista;
- n. 1 custode diurno;
- direttore di sala;
- n. 11 VV.FF;
(personale non disponibile come aiuti su piazza).
La Società potrà richiedere all’Organizzatore personale in aggiunta a quello indicato nel presente articolo, alle condizioni previste dall’allegato 1.
2. Obblighi della Società
2.1. La Società dovrà fornire all’Organizzatore tutte le indicazioni tecniche necessarie (richiesta di personale, attrezzature e esigenze particolari) entro e non oltre 30 giorni prima la data della manifestazione.
A carico della Società saranno tutti i servizi e tutte le prestazioni tecniche relative al montaggio, allo smontaggio e all’effettuazione degli spettacoli (a titolo esemplificativo e non esaustivo: facchini, macchinisti, elettricisti, fonici, tecnici video, sarte, attrezzisti, truccatori, parrucchieri,ecc.).
La Società garantisce che tutto il personale reclutato,direttamente e indirettamente, è in regola, col rispetto delle leggi vigenti in materia di lavoro e copertura assicurativa. Qualsiasi inadempienza derivante dal non espletamento di quanto sopra sarà imputata totalmente alla Società, che dovrà provvedere al risarcimento degli eventuali danni o maggiori oneri.
Resta pertanto inteso che graveranno sulla Società tutti i costi relativi alla realizzazione dei concerti, salvo quanto esplicitamente menzionato al paragrafo Obblighi dell’Organizzatore.
La Società si impegna a concordare con il Teatro, nel rispetto delle norme di sicurezza vigenti, il posizionamento in sala, in graticcia e sul palcoscenico di tutti gli impianti, i circuiti e le strumentazioni tecniche.
2.2. La Società è l’unico responsabile dei compensi e delle assicurazioni sociali e previdenziali del personale artistico, organizzativo e tecnico che parteciperà alla manifestazione ivi comprese le prove e quindi, in via esemplificativa e non esaustiva: dei compensi agli scritturati – comprensivi degli oneri riflessi, allestimento scenico ed attrezzature tecniche, viaggi, trasporti, soggiorni, diarie, noleggi materiali, strumenti, musiche, service audio/video/luci e quanto altro non compreso nella dotazione di servizio del Teatro; (ad eccezione del personale richiesto all’Organizzatore).
La Scheda Tecnica è a totale carico della Società.

The Organizer undertakes before the Company to:
a) provide to the Company the “Teatro degli Arcimboldi” in order to hold the event as stated above in “B”, including for the time needed for the operations of stage assembly and disassembly;
b) provide to the Company, for the day on which the event as stated above in “B” will be held, the following personnel:
- technical director/electrician;
- 1 day custodian;
- floor manager;
- 11 firefighters;
(all personnel which are not part of the standard available working teams).
The Company may request to Organizer to provide additional personnel than what stated in this article, at the conditions specified in annex 1.
2. Obligations of the Company
2.1. The Company shall provide the Organizer with all technical requirements (personnel needed, equipment and special requirements) within and not later than 30 days from the date of the event.
The Company shall be responsible for the cost of all operations regarding the stage assembly, disassembly and the execution of the performances (including, but not limited to: loading personnel, stagehands, electricians, sound technicians, video technicians, tailors, riggers, make-up artists , hairdressers, etc.)
The Company guarantees that all personnel, recruited directly and indirectly, is hired in accordance with the current labor and insurance norms. The Company shall be liable for any default arising from non-compliance to the above stated, and reimburse any damage or additional expense.
It is furthermore agreed that the Company shall be responsible for all costs regarding the execution of the performance, except for what expressly provided under the paragraph Obligations of the Organizer.
The company undertakes to agree with the Theatre, in accordance to the current safety norms, the lay out of all sets, cables and technical equipment on the floor, grid, and stage.
2.2. The Company is the solely liable for the allowances and the social security and pension fees of the artistic, technical and administrative personnel who will take part to the performance and the rehearsals, as for instance, including but not limited to: the fees of the hired personnel – including the social security contributions applicable to the Company, the cost of the stage set and technical equipment, travel, transport, accommodation, daily subsistence allowance, equipment hire, instruments, music, audio/video/light service and any other item which is not included in the service offered by the Theatre; (with the exclusion of the personnel requested to the Organizer).
The Company is fully responsible for the technical information sheet.
