Su Vostra richiesta, preciso quanto segue in ordine alle questioni di carattere penale delle quali mi sto occupando, a livello di consulenza e assistenza, per la Società XXXXXX Italia s.r.l..
Nello scorso mese di ottobre 2006, ho ricevuto incarico di assistere _______________________________________________ in un procedimento penale pendente presso la Procura della Repubblica presso il Tribunale di Firenze.
Questo procedimento, iscritto nell'anno 2006, riguarda una serie di avvisi di rettifica dell'accertamento della Agenzia delle Dogane di Firenze relativi a bollette d’importazione di merci dell'anno 2003. Il mio intervento, come con voi discusso, si è, per il momento, indirizzato a rappresentare al Sostituto Procuratore della Repubblica affidatario delle indagini, anche con memoria difensiva depositata nel mese di novembre 2006, il fatto che, all'epoca delle contestazioni, _______________________________________________ non rivestiva cariche di rappresentanza nella Società ____________________________, cui le contestazioni si riferiscono, oggi Società XXXXXX Italia s.r.l. Per questa evidenza formale, con riguardo a quella annualità, la posizione dell'________________________________________________ dovrebbe, pertanto essere chiarita, senza conseguenze per lui sul piano penale.
Dall'ultima verifica, non è risultata ancora presa alcuna decisione in merito ad una richiesta di archiviazione, da parte della Procura, nei confronti dell'_____________________________________________, ma risultano disposti ulteriori accertamenti. Detto procedimento dovrebbe proseguire, comunque, a carico dell'effettivo responsabile all'epoca dei fatti, che dovrà provvedere a predisporre una linea difensiva nel merito della questione.
Peraltro, come penalista, non mi sono occupato di approfondire i termini contrattuali con i quali è regolamentata, con l'acquisizione di quote e, successivamente, con la fusione tra le società ________________ e XXXXXX Italia s.r.l, la questione di chi debba farsi carico, oltre che delle spese, dei pagamenti di eventuali sanzioni penali, come multe o ammende, relativamente all'anno 2003. Ancora: quanto alla polizza assicurativa stipulata da XXXXXX Italia s.r.l Italia e alla questione se questa possa coprire i danni potenziali di cui si sta parlando, nel processo penale eventualmente instaurando, credo che meglio di me possa darVi indicazioni uno specialista in diritto assicurativo, che Vi invito a contattare.
Orbene: sono stato recentemente da Voi messo al corrente che sarebbero stati notificati processi verbali di constatazione relativi all'anno 2005, per questione analoga a quella del 2003. In questo caso _________________________________ potrà, questa volta in maniera formalmente corretta, essere chiamato a risponderne, risultando, dalle visure storiche della Camera di Commercio di Firenze, che egli era amministratore della _________________________ dal 3 gennaio 2005.
Ancora non risulterebbe, però, iscritto alcun nuovo procedimento penale presso la Procura della Repubblica, ma è, verosimilmente, solo questione di tempo, poiché è certamente probabile, così come sono state iscritti nel registro delle notizie di reato, su comunicazione alla magistratura da parte dell'Agenzia della Dogana, i fatti del 2003, che siano prossimamente comunicati e iscritti i fatti, analoghi, relativi al 2005. Non sono possibili previsioni certe sui tempi dell'eventuale iscrizione. E' anche teoricamente possibile che le nuove segnalazioni della Agenzia della Dogana, una volta trasmesse alla Procura, siano riunite al fascicolo già esistente, il quale verrebbe a contenere le contestazioni relative alle diverse annualità, trattandosi di questione, in diritto e in fatto, analoga.
I reati contestati, relativi all'anno 2003, e per i quali la notitia criminis è stata iscritta nei Registri della Procura, erano quelli di cui agli artt. 292 e 295 DPR n.43/73, relativi ad ipotesi di contrabbando e a circostanze aggravanti del medesimo, nonché di cui all'art. 483 c.p., che sanziona la falsità ideologica commessa dal privato in atto pubblico ( falsità da ritenersi contestata in ordine a quanto rappresentato alla Dogana nelle bolle di importazione, ciò che è oggetto degli avvisi di rettifica e dei ricorsi presentati). E' presumibile, stante la identità dei fatti, che anche per l'anno 2005 possano essere contestate le stesse ipotesi di reato.
Le sanzioni, per questi reati, sono, sotto il profilo edittale, indubbiamente gravose. L'art. 292 DPR 43/73 prevede che si possa essere condannati al pagamento di una multa non minore di due e non maggiore di dieci volte i diritti che si accertassero dovuti. L'ipotesi aggravata di cui all'art.295 dello stesso DPR, e relativa presumibilmente, nel caso che ci occupa, all'essere il reato connesso ad altro contro la fede pubblica (la falsità ideologica), prevede l'applicabilità di una pena detentiva, la reclusione da tre a cinque anni. L'art. 483 del codice penale punisce, poi, la falsità ideologica commessa dal privato in atto pubblico con la reclusione fino a due anni.
Preso atto di questo, e fermo restando che le contestazioni meritano, naturalmente, di essere bene approfondite, onde approntare la migliore difesa, ciò che non può farsi in questa sede, resta da evidenziare, ancora, come si stia parlando, oltretutto, di un procedimento penale che non risulta ancora ben delineato quanto ad una formulazione compiuta delle imputazioni da parte della Procura della Repubblica, cui sono giunte le segnalazioni della Agenzia della Dogana.
Al momento della chiusura delle indagini non solo il Sostituto Procuratore che svolge le indagini stesse, se non riterrà di chiedere l'archiviazione del procedimento, dovrà formulare una imputazione in capo ad una o più determinate persone, nelle loro qualità e funzioni, specificando con esattezza i reati e i fatti contestati; ma dovrà, anche, depositare gli atti di indagine, dei quali potremo prendere visione ed estrarre copia. A quel punto, anche se in termini temporalmente brevi, potremo svolgere attività defensionale, depositando, ad esempio, memorie difensive, precedenti giurisprudenziali, documenti, ovvero atti di indagine da noi svolti per chiarire i fatti. All'esito delle risultanze probatorie di cui alle indagini da lui disposte e di quelle da noi eventualmente effettuate e sottoposte alla sua valutazione, il Pubblico Ministero si determinerà in ordine ad una richiesta di proscioglimento ovvero di rinvio a giudizio, sulla quale dovrà, comunque, decidere un Giudice. Questo per capire meglio la fase processuale, che è quella delle indagini preliminari, nella quale ci troviamo e la possibilità di “interloquire” con la pubblica accusa. Sarebbe auspicabile che al momento del deposito degli atti fosse già intervenuta una decisione nei procedimenti amministrativi, azionati con i ricorsi da XXXXXX Italia presentati, che potrebbe essere di grande aiuto nell’orientarsi e nell’articolare una difesa anche sotto il profilo penale, come di seguito meglio si dirà.
Quanto agli importi che ________________________________ e, dunque, la XXXXXX Italia, potrebbero essere condannati a pagare a titolo di sanzione penale, all'esito di un procedimento da discutere, oltre che nel merito delle responsabilità anche in termini di minimi e massimi applicabili al caso di specie (così come delle ulteriori diminuzioni di pena da calcolare con la concessione di attenuanti), questi non sono allo stato da me quantificabili, non essendo a mia conoscenza, tra l'altro, quali siano le somme complessivamente in contestazione. Ed è del resto ancora non chiaro l'orientamento della Procura su quanto segnalato dalla Agenzia delle Dogane.
Per quanto riguarda, invece, una valutazione del rischio (in procedimenti che risultano pendenti in fase di indagini preliminari, ma per i quali non risulta ad oggi avanzata alcuna richiesta di rinvio a giudizio), posso, allo stato, rappresentare sinteticamente quanto segue.
Definisco probabile, a meno che non intervenga celermente una decisione favorevole a XXXXXX Italia nei ricorsi già presentati in sede amministrativa, il fatto che un procedimento penale venga iscritto anche per l'anno 2005 nei confronti _______________________________________________________ o che quei fatti gli vengano contestati all’interno di quello già rubricato nel 2006.
Quanto alla astratta configurabilità di reati e all'esito dell'eventuale, conseguente, procedimento penale, una sostenibilità delle ragioni accusatorie può definirsi possibile, con le precisazioni che seguono.
Va intanto detto che i ricorsi presentati in sede amministrativa, (che mi sono stati illustrati in sessioni che ho avuto con legali che quelle procedure seguono) paiono fondati su argomenti seri e sostenibili, e risultano, quanto al loro esito, assai rilevanti anche sotto il profilo dell'instaurando processo penale.
Un buon esito di quei contenziosi potrebbe essere risolutivo, ab origine, anche della questione penale, nel senso di un proscioglimento con ampia formula: non posso, quindi, che riportarmi, sotto il profilo del rischio, a quanto sostenuto dai colleghi a quei contenziosi lavorano.
Ma debbo evidenziare che il procedimento penale può offrire spazi di difesa ulteriori e diversi. Mi riferisco, ad esempio( ben oltre l'accertamento di chi sia l'effettivo materiale sottoscrittore delle bolle in contestazione), alla valutazione che il Giudice penale, trattandosi di delitti, dovrà effettuare in ordine alla sussistenza del c.d. elemento soggettivo del reato, ossia della coscienza e volontà e della consapevolezza di violare la legge penale, necessaria, a diverso titolo, perché il reato possa ritenersi integrato. E' ovvio che nel caso di specie, che riguarda una materia assai complessa e che si basa su diverse interpretazioni della normativa applicabile (di nuovo mi richiamo al contenzioso amministrativo), potrà sostenersi, legittimamente, che si riteneva di agire nel giusto, che non si era consapevoli di violare alcune legge penale, che non si aveva alcun intento di "frode", ancorché potesse esserci opposta una interpretazione diversa dalla nostra, da discutersi in sedi che non sono quelle penali.
Quanto, in sintesi estrema, appena rappresentato consente di concludere che altri elementi a difesa potrebbero essere fatti valere ed essere sottoposti alla valutazione del giudice nell'eventuale processo penale, anche laddove l'esito del contenzioso amministrativo non dovesse essere del tutto fausto per la XXXXXX Italia.
Ciò, peraltro, anche se apre nuovi spazi di difesa, in termini di insussistenza del reato, ma anche di quantificazione della pena tra il minimo e il massimo edittale, non sposta i termini del discorso per quanto attiene una valutazione del rischio che, allo stato, è da definirsi, a mio avviso, possibile, sia sotto il profilo di una richiesta di rinvio a giudizio che di un riconoscimento delle argomentazioni accusatorie.
Spero di avere, per quanto di mia competenza e per quanto la situazione ad oggi consente di fare, esposto in maniera per Voi sufficientemente esauriente il quadro della situazione con riguardo alle problematiche di diritto penale in ordine alle quali è stato richiesto il mio intervento professionale.

At your request I shall delineate what follows in regard to the penal issues, which I am handling, as counsel, for the Company XXXXX ITALIA s.r.l.
I was engaged to represent, ________________________________ last October 2006, in a pending criminal procedure initiated by the Procura della Repubblica (Italian State Prosecutor's Office) in the Court of Florence.
This procedure, registered in 2006, concerns a series of notices of amendment within the investigation by the Italian Customs Agency of Firenze relative to certain customs declarations for importation of merchandise in 2003. As has been previously discussed, the object of my activity has also been, for the moment, to inform the Assistant State Attorney, assigned to the investigation, with a defense brief deposited in November 2006, of the fact that at the time of the accusation, Mr. ___________________ was not invested with the power of representation in the company____________________________, to which the accusations refer, which is today XXXXX ITALIA. Based upon formal evidence, in reference to that year, the position of Mr. ___________________________ should be nevertheless clarified, with no adverse penal consequences for him.
Since my last verification, no decision has been made by the Italian State Attorney's Office in regard to a request to dismiss charges against Mr. _______________________, while further investigative activity has been carried out. Said procedure should be initiated, in any case, against the person who was actually responsible at the time of the occurrence and who shall need to develop a line of defense regarding the issue at hand.
On the other hand, as criminal defense attorney I have not looked deeply into the terms of the contract with which the acquisition of the shares and later with which the fusion of the company _______________________ and XXXXX were regulated or, the issue regarding who must take on the responsibility for paying, over and above the expenses, but also any possible penal sanctions, such as fines or penalties relative to the year 2003. Furthermore, as regards the insurance policy stipulated by XXXXX Italia and the issue as to whether or not it may cover any potential damages brought about by the possible criminal trial being discussed, I feel that, better than I, a specialist in insurance law would be indicated. I suggest you contact such a specialist.
I have recently been informed that a notice of procedures has been issued, based upon reports filed in relation to the year 2005 for issues analogous to those of 2003. In this case Mr. __________________________ may be, in a manner that is formally correct, subject to respond to such charges, in that according to the records of the Chamber of Commerce of Firenze, he was administrator of the Company _______________________________ as of January 3, 2005.
As of yet, however, there have been no new criminal proceedings registered with the prosecutor’s office. Nevertheless, in all probability, it is only a matter of time, and it is certainly likely, in the same manner that the alleged occurrences of 2003 were registered in the record of notification of crimes, upon communication to the prosecutor’s office by the Customs Agency, those of 2005 will also soon be communicated and registered. It is impossible for me to give an estimation of when this will occur. It is also theoretically possible that the new reports from the Customs Agency, once transmitted to the prosecutor’s office, will be compiled and unified with the file already opened: as it pertains to the accusations relative to different years but which, in fact, deal with the same legal issues.
The offenses charged, relative to 2003, and for which the notitia criminis (notification of a crime), was registered with the Prosecutor’s office, were those which are covered by the statutes 292 and 295 DPR (Decree of the President of the Republic) number 43/73, relative to the presumption of acts of contraband and to aggravating circumstances of the same and which, as well, under article 483 p.c. (penal code) sanctions ideological falsity committed (fraudulent declarations) by a private individual in a public document (the falsity to be considered is that which was reported to Customs in the importation declarations, which are the object of the notice of amendment and the complaint filed). It may be presumed that, in view of the facts, for 2005 the same presumed offenses may be charged.
The sanctions for these crimes, under the statutes, are undoubtedly onerous. Article 292 DPR 43/73 provides that one may be condemned to pay a fine not less than two times and not more than ten times the customs duty ascertained. The aggravating circumstances charged under Article 295 of the same DPR, and related presumably, in the case in question, that of an offense that is also against the public trust (ideological falsity), provides for the application of imprisonment for from three to five years. Article 483 of the penal code, then, punishes fraudulent declarations committed by an individual in a public document with imprisonment of up to two years.
Taking this into consideration, I remain firm in my conviction that the accusations merit, naturally, being well researched in order to prepare the best defense, though this cannot be done herein. I again point out that, of which we are speaking, above all, is a criminal trial that has not yet been well defined except by a formulation of charges on the part of the Prosecutor’s Office, which has received notice from the Customs Agency.
At the moment of the closing of the investigation not only the Deputy Prosecutor, who is carrying out the investigation itself, if he does not choose to request dismissal of the proceedings, must formulate an indictment of one or more specific persons, within their quality and functions, precisely specifying the crimes and facts contested, but he must also deposit the files of the State’s investigation with the court, at which time we may examine them and obtain copies. At that point, even with very little time, we shall be able to carry out our defensive maneuvers, depositing, for example, defense briefs, legal precedents, documents, as well as reports of investigations we have carried out in order to clarify the facts. At the outcome of the gathering of the evidence and reports from the State’s investigation and from those which we may carry out which he will evaluate, the State Prosecutor will decide either to request dismissal or to remand to trial, either of which must be finally decided upon by a judge. This is to better understand the procedural phase, which is that of the preliminary investigation, in which we are presently and where we have the possibility of “interacting” with the prosecution. It would be worthwhile if, at the moment of the filing of the criminal indictments, the judgment in the administrative procedure, set in motion by the petitions presented by XXXXX Italia, were to have already been made. This could be of great assistance in orienting and articulating a defense even in the criminal case, as will be better discussed below.
As for the sums that Mr. _____________________________ and, hence, XXXXX Italia, might be condemned to pay as penal sanctions, at the end of a trial to be held, beyond any assignation of responsibility as well, in terms of minimums and maximums applicable in such a case (in the same manner that there may be further reductions of the penalty to be calculated with the concession of mitigating circumstances), these at present are impossible for me to quantify in that I am not privy, among other things, with the total sums contested. Furthermore, the orientation of the Prosecutor’s Office in relation to what has been reported by Customs is not clear.
Instead, as for the evaluation of the risk (in procedures which are at present pending in the phase of preliminary investigation but for which there has not yet been presented a request for trial) I can synthesize, at this time, what follows.
I would consider it very probable that a criminal indictment will be filed in the name of ___________________________________ for the year 2005 unless there is a swift and favorable decision regarding the petitions XXXXX Italia has already presented in the Administrative case, or that those accusations will be directed towards him within the case already filed in 2006.
As for an abstract representation of the crimes and the outcome of the possible, consequent criminal trial, it is quite possible that the accusations will be sustained, with the following qualifications.
It should be said that the petitions presented in the administrative case (which have been delineated to me by counsel presenting that case) appear to be founded upon serious and sustainable argument, and will be, based upon their outcome, extremely relevant to the possible criminal proceeding which is just being initiated.
A positive outcome of that proceeding could be decisive, ab origine, (from the outset), even for the penal issue, if it is a dismissal with a broad formula. I cannot, therefore, but refer, under the profile of risk, to what my colleagues working in that case maintain.
However, I must point out that the criminal procedure may offer ulterior and diverse possibilities for the defense. I am referring, for example, (well beyond ascertaining who was the physical signer of the declarations contested) to the evaluations that the criminal judge, dealing with crimes, must make regarding the validity of the so called subjective element of the offense; that is to say the consciousness, the willfulness and the awareness of the violation of the criminal law, necessary, by any other name, so that the crime may be considered completed. It is obvious that in a case such as this, which deals with extremely complex material and that is based upon varying interpretations of the applicable laws (again I refer to the administrative case) the defendant could consider himself, legitimately, having acted in the right, that he was not aware of violating any criminal code, that he had no intention of defrauding, even though there might be an opposing interpretation differing from ours, it could be argued in a venue other than criminal court.
Extremely synthetically, that which has just been discussed permits us to conclude that other elements of defense could be worthwhile and placed before a judge for evaluation in a possible criminal trial, even if the administrative case were to result in a sentence not altogether benefiting XXXXX Italia.
This, however, even if new spaces for the defense are opened, in terms of the groundlessness of the crime, but also for the quantification of the penalty between the statutory minimum and maximum, does not change the terms of this discussion as far as the evaluation of risk which, at present, is to be defined, in my opinion, possible, both in the case of it being brought to trial or in recognition of the accusatory arguments.
I hope to have presented, being of my competence and to the extent to which it may be expounded at the present time, in a manner that is sufficiently thorough for your needs, a perspective of the situation with regard to the difficulties encountered in criminal law in line with the request for my professional opinion.

Of the many idioms man uses to express ideas, graphics is the most natural. This representation has always gone hand in hand with constant research into innovative methods, also sustained by artifacts, which have positively influenced its development. For artifacts we mean, “individual techniques which act as surrogates for those capabilities —either innate or acquired— of man in his operative (and/or communicative) relations with his physical or social environment (Maldonado). Indeed, recent research has highlighted the role of mediation in regard to human cognition (Stahl). The cognitive artifact par excellence today is the personal computer (PC), which differentiates itself from its predecessors in that it is not specific but may be programmed and is multifunctional. Conversely, the software used in the PC has a precise aim that is communicated by way of the interface, which is the locus of interaction between man and machine. Therefore, the interface is the product, the place in which the cognitive artifact is situated.
American industry is investing a great deal in the perfection of the level of detail of the interface due to a renewed interest on the part of scientific research because, “…scientists have recognized that the comprehension of concepts is more complete if they can be manipulated as if they were objects. In other words, concepts that can be experienced physically are more readily deducible than those that can be only elaborated mentally… The recognition of the value of complete interactive representations of reality has brought about three-dimensional graphic systems which allow the visual exploration of a three dimensional space. Representations of the imperceptible and the conceptual are evolving to such a point that not only are we able to see them, but also to hear, perceive and explore them” (Krueger). How can the great quantity of information derived from a simulation be conveyed? How can descriptive images of ideas be rendered and how are conceptual operations translated into the manipulation of images? How are images with the desired characteristics constructed?

Ambiguità retorica del disegno architettonico

L’input per questa ricerca sono stati gli intensi dialoghi e scambi di opinioni, tra chi scrive e il prof. Giuliano Maggiora, durante la composizione del suo libro “Sulla retorica dell’architettura”, e che hanno portato alla formulazioni di alcune ipotesi che legano la retorica al disegno nella ricerca architettonica.
Le riflessioni scritte sono l’estensione di questi dialoghi e propongono una “lettura” del linguaggio architettonico, ed in particolare del suo metalinguaggio iconico: il disegno, seguendo un percorso specifico dell’analisi dei procedimenti retorici delle lingue parlate.

Vengono poste delle premesse necessarie sul concetto di spazio, di disegno e di retorica.
In particolare, le ipotesi che vengono formulate seguono le ultime ricerche che vanno sotto il nome di “Nuova Retorica”, che attualmente si stanno orientando verso l’ipotesi di una sostanziale analogia fra le relazioni che la mente istituisce fra i fenomeni a livello percettivo nel discorso retorico e quelle che istituisce a livello logico; nel senso che le prime costituiscono il corrispettivo spaziale e temporale delle seconde.

Seguendo le affermazioni di Aristotele contenute nel suo libro della Retorica, fondamentale per questo genere di ricerche, si sono individuati innanzitutto i luoghi "propri" del disegno, cioè i mezzi linguistici che appartengono esclusivamente al modo di simulare lo spazio: il contorno, il riempimento, la struttura e la riduzione della scala del disegno. I luoghi "comuni", ovvero, quelle immagini mentali comuni a tutti i pensanti perché basate sull'esperienza spaziale di tutti e che concorrono alla formazione del nostro "modello" della realtà: il reticolo, l'angolo, le rotazioni, ecc.. Infine, come ultimo artificio, a completamento dell'emozione retorica del disegno, l'evocazione di altre simulazioni spaziali conosciute.
La tecnica retorica consiste nel miscelare ambiguamente queste immagini, che costituiscono il patrimonio codificato del linguaggio, in modo da ottenere immagini dello spazio nuove, ambigue ma sorprendenti perché inattese, capaci di simulare esperienze spaziali non ancora codificate.
Un primo approccio alla "verifica sul campo" di questa lettura del disegno architettonico è stato fatto seguendo la genesi dell’architettura come atto linguistico, all’interno della “Scuola fiorentina”, dove questa impostazione di ricerca e di pensiero trova un terreno fertile nell’insegnamento di Italo Gamberini, negli anni ’50 e ’60, già improntato sul rifiuto dell’insegnamento accademico tradizionale e in Carlo Maggiora, che la svilupperà attraverso la didattica del “disegno dal vero” fino alla definizione di metalinguaggio iconico.
La continua evoluzione della nostra percezione dello spazio tramite le estensioni artificiali del nostro corpo, come per esempio il telefono, l'automobile o la televisione, il computer, ecc. porteranno ad ulteriori eversioni della rappresentazione di questo spazio "virtuale", inserendo nuove figure retoriche, create anche dall’uso di strumenti elettronici che permettono una percezione dello spazio, che Paul Virilio chiama "stereofonia della realtà." Una percezione che non è fondata sulla mobilità, ma sulla simultaneità degli avvenimenti e che, contemporaneamente, nega le due modalità tipiche della visione: il punto di vista fissa ed il punto di vista mobile.
È evidente, che anche questi nuovi procedimenti, una volta accolti nell'universo linguistico del disegno, andranno a fare parte del suo patrimonio codificato e che, a loro volta, saranno superati da nuovi procedimenti retorici legati a nuove esperienze sulla percezione dello spazio.
Codificazione ed eversione sono infatti l’uno la condizione e al tempo stesso la conseguenza dell’altra.
Questa dialettica non finirà mai finché occorrerà rappresentare lo spazio per conoscerlo.

Rhetorical Ambiguity in Architectural Design
The inspirational input for this research came from the intense discussions and exchanges of opinion between the writer of this paper and Professor Giuliano Maggiora, during the composition of his recently published book, Sulla retorica dell’architettura (On the Rhetoric of Architecture), which brought about the formulation of certain hypotheses that connect rhetoric to design in architectural research. The observations made here, extensions of those discussions, propose a “reading” of the language of architecture, in particular of its iconic metalanguage: design following a specific line of analysis based upon the rhetorical methods of the language spoken.
Certain necessary premises on the concepts of space, design and rhetoric have been set. In particular, the hypotheses that have been formulated trace the latest research, known as “Nuova Retorica” (New Rhetoric), which is presently aimed toward the proposition of a fundamental analogy between the relationships that the mind creates among phenomena on a level of perception within rhetorical discourse and those which it creates on a level of logic; that is to say the former underlie spatial considerations while the latter those temporal.
In line with Aristotle’s affirmations contained in his book on Rhetoric, indispensable for this genre of research, the “proper” terms for design were first of all identified, that is linguistic items which have exclusively to do with how space is simulated: the outline, the fill, the structure, the reduction of the scale of the design. Then the “common” terms, or rather, those mental images common to every thinker as they are founded on the spatial experience of everyone and that concur with the formation of our “pattern” of reality: the lattice, the angle, rotations, etc.
At last, for the final device for the fulfillment of our rhetorical emotion of design, we evoke other known spatial simulations. The rhetorical technique consists in ambiguously mixing those images, which constitute the codified heritage of the language, in a manner that permits the attainment of new images of space, ambiguous perhaps, yet surprising nevertheless, because they are unexpected, capable of simulating spatial experiences as yet not codified.
An initial approach toward the “practical viability” of this reading of architectural design was made following the genesis of architecture as a language act, within the “Florentine School”. It was here that this formulation of research and thought found fertile ground in the teaching of Italo Gamberini in the 50s and 60s, already based on the repudiation of traditional academic instruction as well as with Carlo Maggiora, who developed this idea by way of his teaching “drawing from reality” (“disegno dal vero”) up to a definition of an iconic metalanguage.
The continuous evolution of our perception of space by way of artificial extensions of our physical body such as, the telephone, the automobile, the television or computer, etc., will bring about further subversions of the depictions of this “virtual” space, with the insertion of new rhetorical devices, also created with electronic instruments which allow a perception of space that Paul Virilio calls “stereophony of reality.” This is a perception not founded upon mobility but upon the simultaneity of events and which, at the same time, negates the two characteristic modes of vision: the fixed point of view and the mobile point of view.
It is evident that even these new methods, once accommodated in the linguistic universe of design, will become a part of its codified heritage and which, in their own time, will be surpassed by new rhetorical procedures linked to new experiences of the perception of space.
Codification and subversion are indeed conditioned by one and at the same time consequence of the other.
This dialectic will have no end as long as there is a need to represent space in order to know it.

An episode that occurred in the rural clinic of Manongarivo, in Madagascar, showed me the effectiveness of the unique alliance between the local traditional medicine and that of the West. One day, I was busy shooting photographs. All of a sudden, I heard chilling screams: there was an emergency. A woman from the village came running into the clinic with her daughter, Natasha, who was badly burned. While the child was playing in front of her house, the woman had accidentally spilled boiling water on her. Doctor Jean Berthin Tida, with a degree in medicine from the West, examined the child’s abdomen, which was covered with blisters, and diagnosed third degree burns. He then consulted Ndronalahy, the local traditional herbalist and healer. After seeing the burns, Ndronalahy went to gather a plant in the forest. Even under the most modern and aseptic conditions, children with such burns often do not survive. I asked myself if Natasha would make it. Ndronalahy returned with a piece of liana. Blowing into one end of the plant he forced the lymph out of the other end. The child’s crying stopped immediately with the application of the liquid. The city had a magic enchantment. I had a charm that was impossible to escape. “Peking is the last refuge of the unknown and the marvelous that exists in the world,” wrote Pierre Loti in 1900. “A city that commands respect,” Arnold Toynbee defined it in 1930.
In 1949, when the Communists took it, Peking was still a city unique in the world: a great example of architecture, a city of immense splendor that seemed to have been built to live forever. It is no longer so.
Peking is dying.
The walls are gone. The gates are gone. The arches are gone. Gone are most of the temples, the palaces and the parks. And every day that passes another piece of the centuries old Peking disappears under the inexorable strokes of pick-axes and bulldozers.
The city has lost that inner order it had that was made to mirror the geometry of the universe. Where at one time there was harmony and perfection, now there is confusion and chaos.
“If Venice sinks, the whole world cries and protests. If Peking disappears, no one notices,” says Philippe Jonathan, a young French urban designer who works at Qing Hua University and who directs for now, nearly by himself, a campaign to “Save Peking”. “The fate of this city should interest everyone, because the greatness of Peking is not just a Chinese issue; it belongs to the culture of the human race.

Hexagram 53 Gradualness
GUIDANCE: “Be gradual like a woman planning to marry. Good fortune comes by firmly keeping to the right way.”
In this hexagram, Wind or Wood is above Mountain. Mountain suggests quiet, while Wind represents gentle movement. Together they suggest gradualness. The upper trigram, Wood, is like a tree slowly growing on a mountain. The inner trigrams of Water and Fire enable Wood and Mountain to interact harmoniously. The inner trigrams also suggest the union of male and female energies, or of any positive relationship. This type of internal harmony encourages the gradual development of a good relationship.
The Mountain suggests a young man. and Wind suggests a young woman. As they gradually come closer together, their relationship culminates in marriage. If they follow the natural order of development, success is assured. However, if they rush unto the relationship, it probably will not endure. The relationship will benefit both sides if they remain detached in the beginning, observe circumstances and slowly reach a point of mutual friendship before becoming more closely involved. Thus, there will be no remorse.
Obviously, this principle is not limited to marriage. Marriage is simply a metaphor for the gradual development of any relationship or situation.
The meaning of this hexagram is further illustrated by the gradual step-by-step process of geese migrating to distant lands. Each line of the hexagram represents a different resting place in their long journey. In cold weather they fly southward: in Summer they go northward. Geese symbolize stability as they unerringly follow the rhythm of the seasons. They also display order in the formations in which they fly and faithfulness in their mating habits. When one dies, the other never chooses another mate.
Wild geese are water birds and gather on river banks. From there, they travel over the plains to the highlands. Thus, they symbolize wind gently blowing over the mountains.
Gradual progress leads one to higher levels. The Mountain, when it refers to a young man, indicates inexperience. He suffers emotional difficulties because he still knows little about handling problems. At an early stage, it is sometimes beneficial to follow a leader in order to gain an opportunity for development. By slowly showing one's talents and earning the trust of superiors, a relationship can mature. Therefore, one has an opportunity to be useful in any situation and to share life meaningfully with others. Conversely, if one engages in work for a superior person but perceives it as an obligatioI1 rather than a privilege, one's efforts will not be positive, nor will they be received with appreciation. The energy offered to one's spouse is received in the same manner.

Così simbolizzano il vento che soffia dolcemente sulle montagne.
Il progresso graduale porta un individuo ai livelli più alti. La Montagna, quando è riferito ad un uomo giovane, indica mancanza di esperienza. Egli soffre difficoltà emotive perché ancora sa gestire poco i problemi. Quando questa situazione si presenta allo stadio iniziale, è consigliabile seguire un leader per guadagnare un’opportunità di sviluppo, dimostrando gradualmente i propri capacità e guadagnando la fiducia dei superiori, il rapporto potrà maturare. Così facendo questo individuo potrà essere utile in qualsiasi situazione e contribuire alla vita in un modo rilevante. Ma allorquando il lavoro viene svolto per una persona superiore ed è vissuto non come un privilegio bensì come un onere o un obbligo a cui non ci si può sottrarre, gli sforzi compiuti non saranno positivi, né saranno apprezzati. Following what is right
is like a stream flowing toward the ocean.
Maintaining one’s innate virtue
is the true foundation of happiness.
Through practicing great virtue,
one can change one’s personality
and alter one’s life.
One’s life will then be peaceful and long.
Persevere in doing things
of a giving and constructive nature,
and your heart will become pure
and free of negativity.
Extend the care you bestow on your own family
to all things and creatures surrounding your house,
such as plants and animals.
When you make an error,
correct it as best you can,
and do not harbor guilt within.
Be earnest in all you do.
Soften your disposition,
and be thorough in your good conduct.
Do not do anything that cannot be exposed to daylight;
it will be seen in the subtle realm of Heaven
as a flash of lightning.
See virtue as your main goal in life,
and enjoy helping others.
Never let an opportunity to help pass by.
To be honest, faithful, trustworthy and sincere
is to be carefree.
If your virtue and your talents are equally good,
you are a superior person.
If you want your good deeds to be seen by others,
their goodness is lost.

Ma già comincia e si propaga minaccioso un rumore di sportelli richiusi. Tanto che il signor Zeme, sistemata l’ingombrante sacca della moglie sulla mensola strapiena e raccolto anche il fascio delle riviste acquistate alla stazione, che nel trambusto era scivolato in terra, ha appena il tempo di rifarsi largo tra i viaggiatori in piedi e raggiungere la piattaforma, saltare in fretta giù dal treno.
