While updating a 600 series Harmony Remote using the Russian language, the progress bar stops at 3%.
Solution:
600 series remotes are incompatible with the Cyrillic alphabet. Devices and Activity names must use Latin characters. To resolve this issue, you will need to rename both your Devices and your Activites using Latin characters. Instructions for renaming devices and Activites are as follows:
To rename your Devices:
1. Login to your Harmony account using the Logitech Harmony Remote software client.
2. Click the "Devices" tab.
3. Starting with the first device, click "Settings".
4. Select "Rename this device" and click "Next".
NOTE: Some Cyrillic characters look the same as Latin characters. Even though "TB" in Cyrillic looks the same as "TB" in Latin, the characters are incompatible.
5. Enter a new name for the device, using only Latin characters.
6. Click "Save", then click "Done".

Warunki umowy dostępu do usług portalu Ebizzu
Niniejsze warunki umowy dostępu do usług portalu Ebizzu zwane dalej Umową określają zasady i warunki korzystania z portalu internetowego umieszczonego pod adresem http://www.ebizzu.pl, zwanego dalej Ebizzu. Niniejsza umowa została zawarta pomiędzy;
użytkownikiem po stronie przeglądarki, który zarejestrował się w Ebizzu spełniając wszystkie warunki niniejszej Umowy i wyrażając zgodę na jej postanowienia, zwanym dalej Abonentem,
a,
właścicielem i zarządcą Ebizzu, firmą Złoty Fundusz Sp. z o.o. z siedzibą w Polsce, Wały Rzeczne 5, 59-220 Legnica, zwaną dalej Funduszem.
1.Postanowienia ogólne
Uwaga! Ze względu na potrzebę pozyskania jak największej liczby użytkowników z Polski, każda zarejestrowana na portalu EBIZZU firma, zgodnie z pkt. 5.7 niniejszych warunków umowy, otrzymuje bezwarunkowo bezpłatny abonament na okres jednego roku. Przed upływem tego okresu zostanie wysłane zapytanie o chęć przedłużenia abonamentu. Warunkiem jest wprowadzenie podczas rejestracji prawidłowego kodu referencyjnego. Promocja ważna jest do odwołania.
1.1.Fundusz prowadzi wirtualną giełdę ofert biznesowych Ebizzu, która służy wyłącznie wymianie informacji w handlu B2B. Ebizzu służy wyłącznie nawiązywaniu kontaktów i nie jest stroną umowy sprzedaży lub współpracy pomiędzy Abonentami.
1.2.Fundusz zastrzega sobie prawo do wprowadzania zmian w Umowie. Każdego Klienta i użytkownika Ebizzu oraz podmiotów współpracujących z Ebizzu obowiązuje aktualna Umowa dostępna na stronie internetowej http://www.ebizzu.pl.
1.3.Portal Ebizzu pośredniczy w handlu produktami i usługami oraz w nawiązywaniu kontaktów handlowych pomiędzy użytkownikami za pomocą informacji dotyczących ofert, kontaktów i przetargów.
1.4.Warunkiem dostępu i użytkowania platformy biznesowej Ebizzu jest zawarcie z Funduszem Umowy, poprzez rejestrację na Portalu i akceptację warunków Umowy.
1.5.Z Ebizzu mogą korzystać wyłącznie podmioty gospodarcze, mogące udokumentować taki status właściwymi dokumentami rejestrowymi.
1.6.Poprzez dostęp i używanie Ebizzu Abonent wyraża zgodę na przyjęcie warunków wyrażonych w Umowie.
2.Warunki rejestracji i zawiązania Umowy
2.1.Osoba chcąca zostać Abonentem Ebizzu zapewnia, że wszystkie podane przez nią dane są pełne i prawdziwe. Jeżeli Abonent nie jest osobą fizyczną, wówczas osoba działająca w imieniu Abonenta zobowiązana jest udokumentować na wezwanie Funduszu swoje pełnomocnictwo do działania w imieniu Abonenta. Fundusz jest uprawniony do szczegółowego określenia sposobu udokumentowania pełnomocnictwa. W pozostałym zakresie Fundusz jest w dobrej wierze co do odpowiedniego umocowania.
2.2.Nie istnieje roszczenie o rejestrację w Ebizzu, ponieważ automatyczny system platformy Ebizzu może wykluczyć Abonenta podczas rejestracji i w każdej chwili w czasie trwania Umowy na przykład ze względów bezpieczeństwa i bez podania przyczyn.
2.3.Wraz z rejestracją Abonent akceptuje niniejszą Umowę, jak i ewentualne zmiany Umowy, o których zostanie powiadomiony.
2.4.Abonent może zarejestrować się w Ebizzu poprzez wypełnienie i wysłanie formularza rejestracyjnego. Wraz z rejestracją Abonent akceptuje specyficzne warunki zamówienia wyszczególnione w punkcie 4.4 oraz niniejsze warunki Umowy. Zawarcie Umowy i zezwolenie na korzystanie z platformy następuje po otrzymaniu przez Ebizzu formularza zgłoszeniowego użytkownika wraz z potwierdzeniem rejestracji oraz wprowadzenia jego nazwy oraz hasła do systemu.
2.5.Umowy przedłużają się każdorazowo o okres jednego roku, niezależnie od czasu trwania poprzedniego okresu dostępu do portalu Ebizzu, jeżeli Fundusz nie otrzyma od abonenta oświadczenia o wypowiedzeniu Umowy najpóźniej trzy dni przed upływem pierwszego lub dalszych okresów, na które Umowa została zawarta. Fundusz potwierdzi otrzymanie wypowiedzenia emailem w ciągu siedmiu dni. Zasada ta dotyczy zarówno kont darmowych jak i płatnych.
2.6.Roszczenie o zawarcie Umowy jest wykluczone. Ebizzu zastrzega sobie prawo do odmowy zawarcia umowy bez podania przyczyn lub jego odwołania, w szczególności z powodu;
- podania fałszywych danych przy rejestracji,
- wątpliwości co do umocowania i prawnego istnienia abonenta,
- wątpliwości lub podejrzenia co do wiarygodności oraz wypłacalności abonenta,
- podejrzenie o nieuczciwe prowadzenie interesów na platformie Ebizzu,
- działalność konkurencyjną wobec portalu Ebizzu,
- naruszenia zasad użytkowania lub Umowy.
2.7.Powyższe postanowienia nie naruszają prawa Funduszu do wypowiedzenia umowy bez zachowania okresu wypowiedzenia i jednostronnego wykluczenia Abonenta z ważnego powodu.
3.Obowiązki Abonenta i warunki korzystania z Ebizzu
3.1.Abonent zobowiązuje się do niezwłocznego poinformowania Ebizzu o zmianie danych podanych podczas rejestracji. Abonent powinien w szczególności dbać o to, aby Ebizzu dysponował jego aktualnym i ważnym adresem emailowym.
3.2.Abonent zobowiązuje się dbać o to, aby nazwa użytkownika oraz hasło były chronione przed nieuprawnionym dostępem osób trzecich. W szczególności Abonent zobowiązuje się nie udostępniać tych informacji osobom, które nie są Abonentami lub które nie są przyporządkowane przedsiębiorstwu Abonenta .
3.3.Każde nieuprawnione użycie nazwy użytkownika lub hasła, o którym Abonent się dowie lub które na podstawie zdarzeń faktycznych podejrzewa, powinno niezwłocznie zostać zgłoszone Ebizzu. Abonent odpowiada za nieuprawnione użycie swoich danych służących do identyfikacji użytkownika, chyba że wykaże, iż nieuprawnione użycie zostało spowodowane przyczynami, których ryzyko wystąpienia ponosi Ebizzu.
3.4.Abonent zapewnia, że wszelkie dane, w szczególności dotyczące oferowanych przez niego towarów, usług oraz nawiązania kontaktów handlowych są prawdziwe i nie wprowadzają w błąd. Abonent występuje na Ebizzu pod własnym nazwiskiem/własną nazwą i dba o to, aby dane dotyczące jego adresu, firmy oraz sposobu nawiązania kontaktu były zawsze aktualne.
3.5.Abonent zobowiązuje się do korzystania z usług Ebizzu zgodnie z Umową oraz zgodnie z właściwymi przepisami prawnymi, dobrymi obyczajami i ogólnymi standardami użytkowania Internetu. Niedopuszczalne są w szczególności następujące wykroczenia w zakresie użytkowania ;
- naruszanie praw osób trzecich, w szczególności prawa własności, praw autorskich, prawa do nazwiska/nazwy oraz praw do znaków towarowych
- treści promujące przemoc lub pornografię albo w inny sposób niezgodne z postanowieniami polskiego Kodeksu Karnego
- wprowadzanie treści zawierających wirusy, konie trojańskie, lub inne programy, które mogą uszkodzić, potajemnie przechwycić lub wykasować dane lub systemy komputerowe
- oferowanie towarów i treści, które nie mogą być publicznie sprzedawane lub oferowane, lub których posiadanie narusza obowiązujące prawo
- umieszczanie treści ofert wprowadzające w błąd i obiektywnie przesadzone,
- wprowadzanie ofert naruszających obowiązujące prawo, w szczególności prawo konkurencji, prawa własności przemysłowej lub Umowy,
- oferty konkurencyjne (portale handlowe) dla Ebizzu
- oferty współpracy handlowej zawierające mało wiarygodne treści

3.6.Abonenci mogą, jako oferenci, zamieszczać na platformie Ebizzu oferty towarów, oferty współpracy handlowej, oferty kupna oraz informacje o poszukiwaniu kontaktów handlowych. W tym celu konieczne jest wypełnienie formularza na stronie internetowej, z podaniem wymaganej minimalnej treści.
3.7.Odniesienia do dalszych ofert oraz ofert internetowych Abonenta można umieścić w przewidzianych ku temu polach oraz w wyczerpującym opisie. Wklejać można jedynie czysty i niesformatowany tekst.
3.8.Fundusz ma prawo do sprawdzania treści ofert oraz tożsamości abonentów jak i do kontroli spełniania przez nich warunków posiadania konta na platformie Ebizzu.
4.Usługi Ebizzu
4.1.Ebizzu oferuje platformę wymiany informacji biznesowej pomiędzy ponad 170-cioma krajami w 34 językach, na której Abonent może zamieścić informacje dotyczące swoich towarów lub usług, zainteresowania nawiązaniem kontaktów handlowych lub ofert kupna, może uzyskać wgląd do takich ogłoszeń oraz skontaktować się z innymi Abonentami.
4.2.Dodatkowo dla użytkowników (Abonentów), którzy zamówili abonament Ebizzu Silver dostępne jest specjalne narzędzie komunikatora internetowego Ebizzu CHAT, które tłumaczy w czasie rzeczywistym teksty pomiędzy parą dowolnie wybranych języków spośród 34 dostępnych na Ebizzu.
4.3.Ebizzu oferuje Abonentom trzy rodzaje pakietów dostępu do usług; Ebizzu Silver Demo, Ebizzu Silver oraz Ebizzu Gold.
- Ebizzu Silver Demo - wiąże się z rejestracją firmy na platformie Ebizzu i założeniem darmowego, miesięcznego konta. Każdy zarejestrowany użytkownik ma możliwość dodania dowolnej liczby ofert swojej firmy, która zostanie automatycznie przetłumaczona na inne języki na pozostałych 33 platformach narodowych Ebizzu. Złożenie darmowego konta nie obliguje do wnoszenia jakichkolwiek opłat pod warunkiem zachowania terminu wypowiedzenia Umowy wyszczególnionego w pkt. 2.5.
- Ebizzu Silver - każdy Abonent, który zamówi abonament Ebizzu Silver dodatkowo ma możliwość korzystania z narzędzia Ebizzu CHAT, które tłumaczy pomiędzy parą dowolnie wybranych języków spośród 34 obsługiwanych przez Ebizzu. Dodatkowo treści ogłoszeń Abonenta będą sprawdzane i poprawiane przez wykwalifikowanych tłumaczy w każdym z 34 języków. Koszt rocznego abonamentu wynosi 550 PLN netto lub równowartość w innej walucie liczona według kursu wymiany w systemie PayPal (http//:www.paypal.com).
- Ebizzu Gold - zapewnia wszystkie funkcjonalności Ebizzu Silver. W pakiecie zawarte są również usługi; consultingu, wstępnego badania rynku oraz pomoc w podjęciu współpracy handlowej (organizacja obsługi prawnej, rejestracja firmy) z trzema wybranymi państwami z listy dostępnej na platformie Ebizzu. W celu promocji firmy Abonenta Ebizzu Gold na stronie głównej każdego portalu Ebizzu zostanie umieszczony rotacyjny baner reklamowy. Dodatkowo Ebizzu zapewnia opracowanie 34 stron internetowych (w subdomenach Ebizzu), każda przetłumaczona w odpowiednim języku, zawierających ofertę Abonenta. Abonament ustalany jest na czas bezterminowy, czyli płacony jest tylko raz. Koszt jednorazowego abonamentu Ebizzu Gold wynosi 8000 PLN netto lub równowartość w innej walucie liczona według kursu wymiany w systemie PayPal (http//:www.paypal.com)
4.4.Istnieje możliwość założenia próbnego konta Ebizzu Silver Demo na okres jednego miesiąca. Jeżeli Abonent nie wypowie Umowy według wytycznych punktu 2.5 abonament zostanie automatycznie przedłużony, jako Ebizzu Silver, na okres jednego roku. Opłata za nowy okres będzie wymagana z góry i będzie wynosiła 550 zł netto.
4.5.Ebizzu ma prawo w każdym czasie zmienić ofertę świadczonych usług, jak i funkcje i wygląd stron internetowych wirtualnej platformy.
5.Okresy rozliczeń i płatności
5.1.Datę rozpoczęcia płatnego okresu abonamentowego liczy się od dnia zaistnienia takiego faktu według warunków Umowy. Jeżeli Klient opłaci abonament Ebizzu Silver, posiadając jeszcze dostęp do konta Ebizzu Silver Demo, właściwy abonament Ebizzu Silver będzie liczony dopiero od dnia wygaśnięcia konta darmowego.
5.2.W przypadku płatności za pomocą karty kredytowej obsługę Klienta przejmuje PAYPAL lub DOTPAY. W tym przypadku tylko system PAYPAL lub DOTPAY zna i jest odpowiedzialny za dane podane w jego formularzach. Formularze znajdują się na jego serwerze i są szyfrowane odpowiednimi technologiami.
5.3.Rejestracja i wybór konta Ebizzu Silver Demo jest bezpłatne jedynie na okres jednego miesiąca, zachowując podany w pkt. 2.5 termin wypowiedzenia Umowy.
5.4.Rejestracja i wybór konta Ebizzu Silver jest płatna z góry. Zgodnie z pkt. 2.5 jeżeli Fundusz nie otrzyma od abonenta oświadczenia o wypowiedzeniu Umowy najpóźniej na trzy dni przed upływem okresu dostępu do Ebizzu Umowa przedłuża się automatycznie na okres jednego roku.
5.5.Opłaty abonenckie należy regulować wobec Funduszu, który wystawia rachunek, z góry i terminowo, przy czym Fundusz nie ponosi w związku z tym żadnych kosztów dodatkowych. W przypadku nie opłacenia abonamentu wynikającego z umowy w terminie płatności, wierzytelność może zostać przekazana do firmy windykacyjnej. Zaistniałe opłaty i koszty związane z odzyskaniem wierzytelności ponosi w pełni abonent Ebizzu.
5.6.Abonent akceptuje zasady ponoszenia opłat.
5.7.Wyjątkiem są okresowe promocje, dzięki którym Klient może uzyskać dostęp do portalu Ebizzu na preferencyjnych warunkach. Można tego dokonać jedynie poprzez wprowadzenie odpowiedniego kodu referencyjnego podczas czynności rejestracji. W kodzie referencyjnym jest zawarta liczba określająca procent upustu. Wysokość upustu może wynosić od 5 do 100%. Każdy kod referencyjny uprawnia do jednorazowej zniżki , w kolejnych okresach abonenckich należy wprowadzić inny kod lub opłacić standardową stawkę.
6.Publikowanie i zarządzanie ogłoszeniami Abonenta
6.1.Fundusz ma prawo do kasowania kont abonentów Ebizzu bez podania przyczyn lub do dezaktywacji niektórych funkcji. Odnosi się to w szczególności do sytuacji, gdy abonent naruszy swoje obowiązki, zasady użytkowania wymienione w pkt. 3.5 lub Umowę dostępu do usług. Powyższe zasady znajdują również zastosowanie wówczas, gdy będą tego wymagały względy bezpieczeństwa platformy Ebizzu i jej abonentów.
6.2.Ogłoszenie umieszczone przez Abonenta jest dla niego wiążące, gdy zostało ono zarejestrowanie w bazie danych Ebizzu.
6.3.Ogłoszenie Abonenta umieszczone na platformie Ebizzu nie stanowi wiążącej oferty zawarcia umowy sprzedaży lub podjęcia współpracy. Inni Abonenci zainteresowani ofertą mogą skontaktować się z oferentem przez telefon, faks, wysłanie formularza kontaktowego, drogą emailową lub skorzystanie z narzędzia Ebizzu CHAT. Ebizzu służy zatem jedynie wymianie informacji i nawiązaniu kontaktów handlowych i nie jest stroną umowy sprzedaży.
7.Ograniczenie odpowiedzialności
7.1.Jeżeli z powodu treści zamieszczonych przez Abonenta osoba trzecia wystąpi przeciwko Funduszowi o zaniechanie, usunięcie, udzielenie informacji, zwrot wydatków lub odszkodowanie, wówczas Abonent jest zobowiązany pokryć wydatki, które poniósł Fundusz, łącznie z kosztami dochodzenia praw.
7.2.Wszelkie oświadczenia woli, składane na biznesowej platformie internetowej Ebizzu przez Abonenta, przekazywane innym Abonentom lub też przez nich przyjmowane, oraz wszelkie działania handlowe i inne wypowiedzi lub działania mające doniosłość prawną są działaniami podejmowanymi wyłącznie przez samego Abonenta. Fundusz nie działa w tym względzie ani w imieniu własnym ani jako przedstawiciel osoby trzeciej.
7.3.Roszczenie o wynagrodzenie za ustalony okres czasu istnieje niezależnie od korzystania z platformy lub możliwych, zgodnych z Umową ograniczeń w świadczeniu usług, dokonywanych przez Ebizzu. Odnosi się to w szczególności do ograniczeń w świadczeniu usług, które mogą wynikać z niekompatybilnych lub specyficznych ustawień oprogramowania abonenta lub jego dostawcę internetowego. Świadczenie usług i dostęp do platformy Ebizzu mogą zostać ograniczone w szczególności wówczas, gdy użytkownik (Abonent) nie zapłacił w terminie abonamentu.
7.4.Odpowiedzialność Funduszu jest ograniczona odnośnie wszelkich przekazanych przez portal Ebizzu informacji, oświadczeń woli, umów pomiędzy osobami trzecimi i zapytań o towary i usługi. Fundusz nie odpowiada za szkody powstałe z nieprawidłowości ofert zamieszczanych przez Abonentów na stronie internetowej Ebizzu. W szczególności Fundusz nie odpowiada za szkody, które wynikają z usunięcia lub zatajenia danych podawanych przez Abonentów Ebizzu lub szkód powstałych wskutek nie usunięcia lub nie zatajenia tych danych.
7.5.Fundusz nie odpowiada za zawierane pomiędzy poszczególnymi Abonentami porozumienia i udostępniane informacje.
7.6.Fundusz nie odpowiada za to, że platforma Ebizzu przejściowo, w szczególności z powodu prac konserwacyjnych, nie będzie dostępna dla Abonenta, jeżeli brak dostępu nie przekroczy łącznie 5% roku w roku kalendarzowym oraz gdy dłuższe przerwy w dostępie nie będą spowodowane przez działanie umyślne lub rażące niedbalstwo.
7.7.Fundusz nie odpowiada za prawdziwość lub/i kompletność informacji, porad i zaleceń umieszczonych na stronach internetowych Ebizzu przez Abonentów, jak i informacji, porad i zaleceń użytkowników dostępnych za pośrednictwem stron internetowych Ebizzu. 8.Otrzymywanie i przechowywanie informacji
8.1.Abonent oświadcza, że wyraża zgodę na otrzymywanie od Funduszu rachunków i związanych z tym informacji w oryginale, drogą listowną oraz że dołoży wszelkich starań, aby jego dane wprowadzone do systemu platformy Ebizzu były zawsze aktualne, w szczególności email, pod którym będzie można się z nim skontaktować.
8.2.Z chwilą zgłoszenia i rejestracji na platformie Ebizzu Abonent wyraża zgodę na przechowywanie i przetwarzanie swoich danych osobowych i handlowych, opublikowanych ofert i wewnątrzsystemowej korespondencji emailowej, jeżeli zostały zebrane dla celów handlowych portalu, a archiwizacja konieczna jest dla celów dokumentacji i ze względów bezpieczeństwa.
8.3.Fundusz jest w szczególności upoważniony do korzystania z Państwa danych abonenckich i adresu emailowego w następujący sposób:
- publikacja w ramach usług świadczonych przez platformę Ebizzu i przekazywanie ich Abonentom wraz z zapytaniami
- przesyłanie rachunków za opłatę abonamentu i informacji, podczas trwania abonamentu i bezpośrednio po jego zakończeniu, aż do momentu kiedy upoważnienie to zostanie przez Abonenta odwołane.
- przekazywanie ich upoważnionym jednostkom w ramach obowiązków ustawowych
- przekazywanie instytucjom publicznym we wszystkich przypadkach, gdy będzie to uwarunkowane uzasadnionym interesem portalu Ebizzu wynikającym z działań użytkownika w portalu. Abonent wyraża ewentualnie niezbędną zgodę na powyższe poprzez akceptację niniejszych warunków Umowy.
9.Postanowienia końcowe
9.1.W sprawach dotyczących przedmiotu niniejszej umowy, a nie uregulowanych jej postanowieniami zastosowanie mieć będą przepisy Kodeksu Cywilnego oraz Kodeksu Handlowego.
9.2.Spory mogące wyniknąć na tle wykonania niniejszej umowy strony poddają rozstrzygnięciu sądów powszechnych, właściwych ze względu na siedzibę Funduszu.

Terms and conditions of access to the Ebizzu portal
The terms and conditions of access to the Ebizzu portal (hereinafter the Agreement) are between the browser-side end user (hereinafter the Subscriber), who registered with Ebizzu fulfilling all conditions of this Agreement and consenting to the provisions herein, and the owner and operator of Ebizzu, the company Złoty Fundusz Sp. z o.o. based in Poland at Wały River 5, 59-220 Legnica (hereinafter the Fund). The purpose of this agreement is to set forth the terms and conditions of use of the web portal located at http://www.ebizzu.pl (hereinafter referred to as Ebizzu).
1. General Provisions
1.1. The Fund conducts a virtual business advertisement market place Ebizzu, which serves only in facilitating the exchange of information in the B2B transactions. Ebizzu serves only in establishing business contacts and is not a party to the contracts or cooperation between the Subscribers.
1.2. The Fund reserves the right to make changes to this Agreement. Every customer and user of Ebizzu and those currently cooperating with Ebizzu are bound by the current Agreement available on the website http://www.ebizzu.pl.
1.3. The Ebizzu portal acts as an intermediary in facilitating the exchange of products and services and in establishing contact between users, relaying information about business contacts, offers, or contracts.
1.4. The conditions of access to and use of the Ebizzu business platform are a contract with the Fund’s Agreement, by registering with the Portal and accepting conditions of the Agreement.
1.5. Ebizzu may only be used by business entities that are able to provide proper documented proof of such registered status.
1.6. By accessing and using Ebizzu, the Subscriber agrees to accept the conditions expressed in the Agreement.
2. Registration and conditions for Agreement
2.1. A person wishing to be a Subscriber to Ebizzu will ensure that all of the data they provide is complete and correct. If the Subscriber is not a natural person, the person acting on behalf of the Subscriber is, upon request, required to provide evidence to the Fund of their power of attorney to act on behalf of the Subscriber. The Fund is entitled to specifically determine documentation for a proxy. The Fund remains in good faith as to the appropriate authority.
2.2. No claim exists for registering with Ebizzu, as the automated system of the Ebizzu platform may lock out the Subscriber during registration or at any time during the duration of the Agreement, for example for security reasons, without any given reason whatsoever.
2.3. Upon registering, the Subscriber accepts this Agreement and any amendment to this Agreement, of which they will be duly notified.
2.4. A Subscriber may register with the Ebizzu by completing and submitting the registration form. By registering, the Subscriber accepts the specific terms of contract as specified in paragraph 4.4 and the conditions of this Agreement. Entering into Agreement and authorisation for use of the platform follows the receipt of the user submitted form by Ebizzu together with confirmation of registration and the input of their name and password into the system.
2.5. In the event that the Fund has not received a notice from the Subscriber to terminate the Agreement, no later than three days before the first or subsequent periods for which Agreement has been concluded, the duration of the Agreement will be extended by a period of one year, regardless of the duration of the past period granting access to the Ebizzu portal. The Fund will confirm the receipt of such notice by email within seven days. This condition applies to both free and paid accounts.
2.6. No right exists to claim contract by the Agreement. Ebizzu reserves the right to rescind the contract, without providing prior reasons or notification, in particular for but not limited to:
- providing false information during registration
- doubts about the existence and legal authority of the subscriber
- doubt or suspicion as to the solvency and credibility of the subscriber
- suspicion of unfair business practices on the Ebizzu platform
- competing with the Ebizzu portal
- breach of the Agreement or the terms of use
2.7. These provisions given above will not infringe on the rights of the Fund to terminate the agreement without prior notice and to unilaterally block the Subscriber for any important reason.
3. Subscriber responsibilities and Ebizzu terms of use
3.1. The Subscriber undertakes to promptly inform Ebizzu in the event that any data provided during registration has changed. The subscriber shall in particular ensure that Ebizzu has their valid and current email address.
3.2. The Subscriber undertakes to ensure that their user name and password are protected from unauthorised access by third parties. In particular, the Subscriber undertakes not to share any information with those who are not Subscribers, or which are not assigned to a Subscriber enterprise.
3.3. Any unauthorised use of the user name or password, of which the Subscriber is aware of directly or based upon suspicion, should be immediately reported to Ebizzu. The Subscriber is fully responsible for any unauthorised use of data to unless it can be that the unauthorised use was due to causes of risks undertaken by Ebizzu.
3.4. The Subscriber shall ensure that all data, in particular goods and/or services offered by him, as well as the establishment of business contacts are true and not misleading. The Subscriber is on Ebizzu under his own name and ensures that the data for his address, company, and method for contact is up to date and current.
3.5. The Subscriber undertakes to use the services of Ebizzu in accordance with the Agreement and in accordance with relevant laws, good behaviour, and general standards for use of the Internet. In particular, the following misconduct during use is unacceptable :
- violating the rights of a third party, in particular property rights, copyrights, name rights, as well as trademark laws
- content promoting violence or pornography or in any manner unacceptable according to the provisions of the Polish Criminal Code
- the introduction of content containing viruses, Trojan horses, or other programs that may damage, secretly intercept, or erase data or computer systems
- offering goods or contents, which cannot be publicly offered or sold, or possession of which violates the law
- posting of offerings that are misleading or objectively excessive
- posting offerings that violate applicable laws, in particular competition laws, commercial property rights, or the Agreement
- causing competition for Ebizzu (other trade portals)
- offering non-credible business cooperation
- referencing websites and email addresses in company names, drawings, headlines, and short descriptions of the offerings
3.6. Subscribers may, as offerors, post on the Ebizzu platform offers of goods, business cooperation offers, offers to buy, and information about the search for business contacts. For this purpose it is necessary to fill out a form on the website, providing the minimum required content.
3.7. References to Subscriber’s further offerings may be placed in the designated fields provided as well as in the detailed description. You can only paste plain and unformatted text.
3.8. The Fund has the right to check the content of tenders and the identity of subscribers and to control the latter's compliance with the conditions to have a platform Ebizzu.
4. Ebizzu services
4.1. Ebizzu offers a platform for the exchange of business information between more than 170 (one hundred seventy) countries in thirty-four (34) languages, on which the Subscriber may post information about their goods or services, express interest in the establishment of business contacts or offers to purchase, and may obtain access to such announcements as well as contact other Subscribers.
4.2. Additionally, for users (Subscribers) who ordered the Ebizzu Silver subscription, a special instant messaging tool, known as Ebizzu CHAT, is available, which translates chat text in real- time between any pair of languages chosen from among the 34 available on Ebizzu.
4.3. Ebizzu offers Subscribers three types of packages for access to services: Ebizzu Silver Demo, Ebizzu Silver, and Ebizzu Gold.
- Ebizzu Silver Demo - associated with the registration of a business on the Ebizzu platform the creation of a free, one (1) month account. Each registered user has the opportunity to post an unlimited number of offerings for their business, which will automatically be translated into the other languages of the remaining thirty-three (33) national Ebizzu platforms. Registering for a free account does not create any obligation that will bring about any charges subject to the Agreement termination deadline as set out in paragraph 2.5.
- Ebizzu Silver - each Subscriber who orders the Ebizzu Silver subscription has the opportunity of using the Ebizzu CHAT tool that translates between a pair of languages arbitrarily selected from among the 34 languages supported by Ebizzu. Additionally, contents of the Subscriber’s offerings will be proofread and copyedited by qualified translators in each of the 34 languages supported. The net annual subscription cost is 550 PLN or the equivalent in another currency calculated at the exchange rate set out by the PayPal system (http:// www.paypal.com).
- Ebizzu Gold - provides all the functionality of Ebizzu Silver. In the package are also included services: consulting, preliminary market research, and assistance in establishing commercial operations (organizing legal services, business registration) in three (3) selected countries from the list available on the Ebizzu platform. To promote the company of the Ebizzu Gold Subscriber, the main page of each Ebizzu portal will feature rotating banner ads. Additionally, Ebizzu guarantees the development of 34 web pages (in the Ebizzu subdomains), all translated in the appropriate language, containing the Subscriber’s offering. The duration of the subscription shall be set for an indefinite period of time, which means that payment is only once. The net cost for a one-time Ebizzu Gold subscription is 8,000 PLN or the equivalent in another currency calculated at the exchange rate set out by the PayPal system (http:// www.paypal.com).
4.4. It is possible to register an Ebizzu Silver Demo account for a period of one (1) month. If the Subscriber does not submit a notice of termination of the Agreement in accordance with guidelines set out in paragraph 2.5, the subscription will automatically be extended, as Ebizzu Silver, for a period of one (1) year. The fee for the new subscription period will be required at the outset and will be net 550 PLN.
4.5. Ebizzu reserves the right to change, at any time, the offered services as well as the functionality and appearance of the virtual platform’s web pages.
5. Payment and settlement period
5.1. The commencement date of the subscription period is counted from the day such an occurrence is noted according to the terms of the Agreement. If the Subscriber pays for an Ebizzu Silver subscription while still using an active Ebizzu Silver Demo account, the Ebizzu Silver subscription will only be counted after the free account expires.
5.2. If you pay by credit card, customer service is undertaken by PAYPAL or DOTPAY. In this case, only PAYPAL or DOTPAY are aware of and responsible for the information submitted on their forms. Forms are found on their servers and are encrypted with relevant technologies.
5.3. Registration and selection of an Ebizzu Silver Demo account is free only for a period of one month subject to the Agreement termination deadline as set out in paragraph 2.5.
5.4. Registration and selection of an Ebizzu Silver account is due payable from the outset. In accordance with paragraph 2.5, where the Fund has not received a notice from the Subscriber to terminate the Agreement no later than three (3) days prior to the expiry date of the period of access to Ebizzu, the Agreement shall be extended automatically for a period of one year.
5.5. Subscription fees will be regulated by the Fund, which will bill in advance and in a timely manner, and for which in connection to this the Fund does not bear additional costs. In the event of non-payment of subscription fees arising from the Agreement by the payment due date, the claim may be forwarded to a recovery agency. Fees and expenses arising in connection to the claim shall be fully borne by the Subscriber.
5.6. The Subscriber accepts the terms of payment.
5.7. The exception is occasional promotions, by which Subscribers can gain access to Ebizzu on preferential terms. This can only be achieved by applying the appropriate reference code during registration. A discount code corresponds to a figure for discount. The range of discount may be from 5 to 100%. Each reference code is valid for a one-time discount. For subsequent periods, it is necessary to apply a different reference code or pay the standard rate.
6. Publishing and management of the Subscriber’s offerings
6.1. The Fund has the right to delete or to deactivate certain functions of subscribed Ebizzu accounts without giving any reasons. This applies particularly to situations where the subscriber has breached their obligations, exclusion in the use of or agreement for access to services. These conditions shall also apply if they are so required for the security of the Ebizzu platform and its subscribers.
6.2. The Subscriber is bound to the posted offering once it is recorded in the Ebizzu database.
6.3. The Subscriber’s offerings posted on Ebizzu platform do not constitute a binding offer of sale or agreement to cooperate. Other interested Subscribers can contact the bidder by telephone, fax, submission of a contact form, by email, or by making use of the Ebizzu CHAT tool. Ebizzu thus serves only in the exchange of information and establishment of business contacts and is not party to the contract of sale.
7. Limitations of liability
7.1. If, because of the content posted by a Subscriber, a third party arises against the Fund for omission, removal, sharing information, compensation, or reimbursement of expenses, then the Subscriber is required to cover the expenses incurred by the Fund, including legal fees.
7.2. All wilful declarations made on the Ebizzu platform by the Subscriber, transmitted to other Subscribers or received by others, as well as all commercial activities and other content or activities having legal importance are the sole responsibility of the Subscriber only. The Fund does not act in this regard nor on their own behalf nor as representatives of a third party.
7.3. The claim for compensation for a fixed period of time exists independent of the use of the platform or services, consistent with the Agreement’s restrictions for provision of service, made possible by Ebizzu. This applies, in particular, to restrictions in the provision of services, which may result from the Subscriber’s incompatible software or specific software settings or their Internet provider. Provision of services and access to the Ebizzu platform may be limited, in particular if the user (Subscriber) did not pay within a period of subscription.
7.4. The liability of the Fund is limited in regards to all information, including but not limited to wilful statements, contracts between third parties, and inquiries regarding goods and services provided through the Ebizzu portal. The Fund shall not be liable for damages resulting from irregularities or abnormalities of offers posted by Subscribers to the Ebizzu website. In particular, the Fund shall not be liable for damages that result from the withholding or concealment of data provided by Subscribers or damages arising as a result of not withholding or concealment of data.
7.5. The Fund is neither responsible for agreements contracted between Subscribers nor in otherwise making available any information.
7.6. The Fund is not responsible for the fact that the Ebizzu platform will occasionally not be available to the Subscriber, in particular due to maintenance work, if the lack of access does not exceed a total of 5% of a year in a calendar year and when longer interruptions in access are not caused by deliberate actions or gross negligence.
7.7. The Fund is not responsible for the accuracy of and/or the completeness of information, advice, and recommendations posted by Subscribers on the Ebizzu web pages, as well as information, advice, and recommendations available through the Ebizzu web pages. The Fund shall not be held liable for any damages arising from accidents and errors in use of software and hardware, and in particular in connection with technical malfunctions on the Internet.
8. Collection and storage of information
8.1. The Subscriber agrees to receive from the Fund bills and other related information via postal mail, as the original copy, and will make every effort to ensure that the data entered into the Ebizzu platform’s systems are kept up to date, particularly the email address at which the Subscriber can be contacted.
8.2. Upon accessing and registering with the Ebizzu platform, the Subscriber consents to storage and processing of personal and commercial details, published offerings, and internal email correspondence, where this information was collected for the purpose of commercial transactions related to the portal, and archiving, which is necessary for documentation and security reasons.
8.3. The Fund is specifically authorised to make use of the Subscriber’s provided details and email address in the following manners:
- publication within the scope of services provided by the Ebizzu platform and relaying it to their Subscribers along with given inquiries,
- delivery of bills for the payment of subscription fees and other information, during the subscription period and immediately after its completion, until authorization is revoked by the Subscriber,
- transmission to authorised third parties when obligated to do so by law,
- transmission to public institutions in all cases when it is in the best legitimate interests of the Ebizzu portal, as a result of a user’s actions on the portal. By accepting the terms and conditions of this Agreement, the Subscriber expresses unconditional acceptance of all the above.
9. Final provisions
9.1. In matters relating to the subject matter of this Agreement and not governed by its provisions will be applicable the provisions of the Civil Code and Commercial Code.
9.2. Disputes that may arise regarding the execution of this Agreement shall be subject to the courts of common law, competent jurisdiction established by the Fund’s headquarters.
