ARTIKEL 1. AARD DIENSTVERBAND, PROEFTIJD EN FUNCTIE
1.1 De werknemer treedt per .. ……….. bij de werkgever in dienst in de functie van ……………….. De arbeidsovereenkomst wordt aangegaan voor bepaalde tijd van ……………………, ingaande op .. …….. ….. en derhalve van rechtswege eindigend op ……………………...
1.2 Er geldt een wederzijdse proeftijd van een maand. Gedurende deze proeftijd kunnen beide partijen de arbeidsovereenkomst met onmiddellijke ingang beëindigen.
1.3 Beide partijen zijn op ieder gewenst moment bevoegd de arbeidsovereenkomst door schriftelijke opzegging tussentijds te doen eindigen, met inachtneming van de wettelijk vereiste opzegtermijn. De werknemer verplicht zich ook andere werkzaamheden te verrichten die tot een normale uitoefening van zijn functie behoren, indien deze werkzaamheden redelijkerwijze van hem kunnen worden gevergd.
1.5 De arbeidsovereenkomst eindigt in ieder geval, zonder dat opzegging is vereist, van rechtswege, op de laatste dag van de kalendermaand waarin de werknemer de 65-jarige leeftijd bereikt.
ARTIKEL 2. WERKTIJDEN
2.1 Bij indiensttreding van de werknemer geldt een .. -urige werkweek.
2.2 De werkgever stelt de dagelijkse werktijden vast (thans van …. uur tot …. uur). De werknemer heeft van…. uur tot ….uur recht op pauze.
2.3 De werknemer is redelijkerwijs verplicht incidenteel overwerk te verrichten, als de werkgever dit in het kader van een goede bedrijfsvoering noodzakelijk acht.
2.4 Van overwerk is alleen sprake, indien de werknemer van de werkgever opdracht heeft gekregen buiten de voor hem geldende normale arbeidsduur arbeid te verrichten.
ARTIKEL 3. SALARIS (BETALING)
3.1 De werknemer ontvangt een bruto-salaris van …………. euro per maand, door de werkgever te voldoen aan het einde van iedere maand. Het salaris is gebaseerd op een volledige (40-urige) werkweek.
3.2 In het salaris en emolumenten worden geacht begrepen te zijn alle toelagen, gratificaties en vergoedingen, hoe ook genaamd en van welke aard ook, waarop de werknemer jegens de werkgever krachtens de wet en/of een andere regeling van loon- en arbeidsvoorwaarden, waaronder begrepen een collectieve arbeidsovereenkomst, te eniger tijd aanspraak zou hebben, tenzij in deze overeenkomst anders is bepaald.
3.3 Indien de dienstbetrekking te eniger tijd korter heeft geduurd dan de periode waarover de aanspraak op salaris en emolumenten is toegekend, zal de aanspraak op het betreffende salaris en emolumenten over die periode pro rata bestaan.
ARTIKEL 4. VAKANTIETOESLAG
4.1 Jaarlijks, uiterlijk in de maand …., heeft de werknemer jegens de werkgever aanspraak op vakantiebijslag. De aanspraak op vakantiebijslag wordt opgebouwd in de periode van 1 juli van het voorafgaande jaar tot en met 30 juni van het lopende jaar. Bij tussentijdse aanvang of beëindiging van het diensverband wordt de vakantiebijslag naar evenredigheid vastgesteld.
4.2 De hoogte van de vakantiebijslag bedraagt 8% en is gerelateerd aan het vaste brutomaandsalaris, zonder eventueel overwerk.
ARTIKEL 5. VAKANTIEDAGEN
5.1 Het vakantiejaar loopt van 1 januari tot en met 31 december van enig jaar.
5.2 Het aantal vakantiedagen waarop de werknemer in een kalenderjaar recht heeft, bedraagt …. (minimaal 4 keer het aantal overeengekomen arbeidsdagen per week).
5.3 De werknemer is gerechtigd zelf de tijdstippen van aanvang en einde van zijn vakantie(s) vast te stellen, voor zover daartoe op dat moment aanspraak bestaat en rekening houdend met de belangen van de werkgever.
5.4 Als regel dienen de vakantiedagen te worden opgenomen in het vakantiejaar, waarin deze worden opgebouwd. De werkgever kan bepalen dat de werknemer eventueel nog openstaande vakantiedagen bij het einde van het dienstverband moet opnemen.
5.5 Bij tussentijdse aanvang of beëindiging van de arbeidsovereenkomst worden de vakantiedagen naar evenredigheid vastgesteld.
ARTIKEL 6. ARBEIDSONGESCHIKTHEID
6.1 Indien de werknemer wegens arbeidsongeschiktheid door ziekte of een ongeval verhinderd is de overeengekomen werkzaamheden te verrichten, zal de werkgever hem gedurende maximaal 104 weken, doch ten hoogste voor de duur van deze overeenkomst, 70 % van het laatstgenoten bruto salaris doorbetalen. Onder bruto salaris wordt in dit verband verstaan het bruto salaris (artikel 3, lid 1 van deze overeenkomst) inclusief vakantiebijslag (artikel 4 van deze overeenkomst).
6.2 Perioden van arbeidsongeschiktheid die elkaar opvolgen binnen een termijn van vier weken worden als een aaneengesloten periode beschouwd
6.3 De verplichting als bedoeld in artikel 6 lid 1 geldt slechts voor zover de werkgever verplicht is op grond van de wettelijke bepalingen ter zake minimaal 70% van het bruto salaris door te betalen.
6.4 De werknemer meldt zich onverwijld, doch uiterlijk aan het begin van een werkdag (vóór 09.00 uur) bij…………………., indien hij door ziekte is verhinder de overeengekomen werkzaamheden verrichten. Tijdens de arbeidsongeschiktheidsperiode dient de werknemer zich te houden aan de voorschriften van de Arbodienst, waarbij de werkgever is aangesloten, alsook aan de door de werkgever terzake vastgestelde voorschriften, die aan de werknemer op de eerste werkdag ter hand zijn gesteld.

ARTIKEL 7. AUTO
7.1 De werkgever stelt aan de werknemer ter uitoefening van zijn functie …………..voor de duur van het dienstverband een auto ter beschikking. Deze auto blijft eigendom van de werkgever.
7.2 Het gebruik van de hiervoor bedoelde auto eindigt:
• Bij beëindiging van het dienstverband;
• Bij beëindiging van de werkzaamheden;
• Bij langdurige arbeidsongeschiktheid van de werknemer (langer dan twee maanden);
• Indien sprake is van schorsing of op non-actiefstelling van de werknemer;
7.3 Alle aan het normale gebruik van de auto verbonden kosten komen voor rekening van
de werkgever.
7.4 De werknemer is verplicht de hem ter beschikking gestelde auto als “een goed huisvader” te gebruiken. Indien er schade aan de auto is ontstaan, dient de werknemer dit onmiddellijk aan de werkgever en aan de verzekeringsmaatschappij mede te delen. De werknemer is aansprakelijk voor alle schade, die is ontstaan door zijn opzet of bewuste roekeloosheid.
7.5 De werknemer zal zonder schriftelijke toestemming van de werkgever de auto niet aan derden ter beschikking stellen.
7.6 De werknemer zal de auto in overeenstemming met de verzekeringsvoorwaarden van de door werkgever afgesloten verzekering te gebruiken.
7.7 Indien er sprake is van een lease-auto, dan maken de eventuele leasevoorwaarden integraal deel uit van deze overeenkomst en verklaart de werknemer hierbij deze voorwaarden van werkgever ontvangen te hebben.
7.8 Wanneer de werknemer in strijd met enige bepaling uit dit artikel handelt, is de werknemer aan de werkgever een boete van € 500,- verschuldigd aan werkgever, welke boete onmiddellijk en zonder gerechtelijke tussenkomst opeisbaar is. De boete als hiervoor bedoeld laat werkgever onverlet van werknemer schadevergoeding te vorderen. Op voet van het bepaalde in artikel 7:650 lid 6 BW wordt hierbij afgeweken van het bepaalde in artikel 7:650 lid 3 en 5 BW. De werkgever kan de boete inhouden op het eerstvolgende verschuldigde loon van werknemer.
ARTIKEL 8. REISKOSTEN
8.1 Indien de werknemer voor het woon-werkverkeer gebruik maakt van een eigen auto, dan bedraagt de reiskostenvergoeding voor het woonwerkverkeer maximaal het bedrag dat de werkgever belastingvrij mag uitkeren, mist de woon-werkafstand meer dan tien (10) kilometer bedraagt.
8.2 De werknemer ontvangt een vergoeding voor zakelijk met de eigen auto gereden kilometers van € … per kilometer of ene zodanig bedrag per kilometer als op basis van de fiscale regelgeving als vrije vergoeding kan worden uitgekeerd.
8.3 Indien aan de werknemer een auto ter beschikking wordt gesteld, bestaat geen recht op een vergoeding van reiskosten zoals hierboven omschreven.

ARTIKEL 9. MOBIELE TELEFOON
De werkgever zal aan de werknemer voor een goede uitvoering van zijn functie als ………………. een mobiele telefoon ter beschikking stellen. De kosten van het abonnement en de zakelijke gesprekskosten komen voor rekening van de werkgever. De werknemer zal de telefoon als een goed huisvader betaamt onder zich houden en zal deze slechts gebruiken om de werkzaamheden uit te voeren welke voortvloeien uit de hiervoor genoemde functie.
ARTIKEL 10. OVERIGE RECHTEN EN PLICHTEN
10.1 Het is de werknemer niet toegestaan, anders dan ten behoeve van de werkgever, van afnemers, leveranciers of derden voor werkzaamheden of diensten, die samenhangen met de activiteiten van de werkgever en de onderhavige arbeidsovereenkomst, direct of indirect enigerlei provisie, tegemoetkoming of vergoeding in welke vorm dan ook te bedingen of aan te nemen. Ook is het niet toegestaan personeel in te schakelen of materialen te gebruiken, anders dan in de zakelijke activiteiten van de werkgever.
10.2 Behoudens voorafgaande schriftelijke toestemming van de werkgever zal de werknemer naast de dienstbetrekking geen beroep of bedrijf uitoefenen, op welke wijze en in welke vorm dan ook, hetzij op eigen naam, door middel van en/of in samenwerking met andere natuurlijke of rechtspersonen.
10.3 De werknemer is verplicht zowel tijdens als na het einde van het dienstverband tot volstrekte geheimhouding omtrent alle gegevens betreffende uitvindingen, producten, diensten, octrooien, tekeningen, contracten organisatie, leveranciers afnemers en derden met wie de werkgever contracten onderhoudt, kortom omtrent alle bedrijfsaangelegenheden in de ruimste zin van het woord, waarvan de werknemer het vertrouwelijk karakter behoort te begrijpen.
10.4 Indien de werknemer in woord of geschrift publicaties mocht gaan verzorgen die de belangen van de werkgever kunnen raken, verplicht de werknemer zich vooraf de goedkeuring van de werkgever te vragen en te verkrijgen.
10.5 Bedrijfsmiddelen alsmede alle correspondentie. aantekeningen, tekeningen etc. betrekking hebbende op bedrijfsaangelegenheden zullen bij het einde van het dienstverband onverwijld door de werknemer bij de werkgever moeten worden ingeleverd. Voorts is werknemer gehouden om op verzoek van de werkgever de bovengenoemde zaken aan de werkgever ter beschikking te stellen tijdens de periode waarin hij zijn functie niet uitoefent, hetzij wegens arbeidsongeschiktheid gedurende een aaneengesloten periode langer dan 4 weken, hetzij wegens schorsing door de werkgever met behoud van salaris.

ARTIKEL 11. INTELLECTUELE RECHTEN
11.1 Intellectuele eigendomsrechten op werken of andere binnen het kader van de arbeidsovereenkomst aan de werknemer ter beschikking gestelde programmatuur, software, apparatuur of andere materialen zoals analyses, ontwerpen, documentatie, rapporten, offertes of andere producten of diensten, alsmede voorbereidend materiaal daarvan, berusten bij de werkgever. Indien en voorzover deze berusting niet van rechtswege bij werkgever ligt, maar daarvoor bijvoorbeeld een nadere akte noodzakelijk is, machtigt werknemer hierbij werkgever om namens hem een akte te ondertekenen om intellectuele eigendomsrechten van werknemer naar werkgever over te dragen.
11.2 De werknemer is verplicht om op verzoek van de werkgever alle medewerking te verlenen aan het vestigen of verdedigen van intellectuele eigendomsrechten in Nederland of daarbuiten. De medewerking kan onder andere bestaan uit het afleggen en ondertekenen van verklaringen en het uitstellen van publicaties voor een termijn die nodig is om het recht te vestigen.

ARTIKEL 12. CONCURRENTIEVERBOD
De werknemer zal tijdens de dienstbetrekking, alsmede gedurende een periode van twaalf maanden na het eindigen van de dienstbetrekking zonder voorafgaande schriftelijke toestemming van de werkgever geen activiteiten ondernemen bij relaties van de werkgever, dan wel binnen het werkgebied van de werkgever, op welke wijze en in welke vorm dan ook, hetzij op eigen naam, hetzij door middel van en/of in samenwerking met, dan wel in dienstverband van andere natuurlijke of rechtspersonen, welke gelijk zijn aan de activiteiten van de werkgever of met de werkgever gelieerde organisaties.

ARTIKEL 13. BOETEBEDING
13.1 Indien de werknemer het bepaalde in de artikelen … en overtreedt en/of niet nakomt, verbeurt hij aan de werkgever een direct opeisbare boete ten bedrage van €…….. voor iedere overtreding, alsmede een bedrag van €………….. voor iedere dag dat de overtreding / niet-nakoming voortduurt. De boete zal verschuldigd zijn door het enkele feit van de overtreding of de niet-nakoming, maar laat onverminderd het recht van de werkgever nakoming te van deze overeenkomst te verlangen en laat onverminderd het recht van de werkgever tot het vorderen van volledige schadevergoeding.
13.2 In afwijking van de leden 3 en 5 van artikel 7:650 BW is op basis van lid 6 van hetzelfde artikel geen bestemming aan de boete gegeven en wordt de mogelijkheid opengelaten dat deze tot persoonlijk voordeel van de werkgever zal strekken, alsmede is de boete op een hoger bedrag gesteld dan het in geld vastgesteld loon voor een halve dag.
ARTIKEL 14. PENSIOEN
14.1 De werkgever heeft toegezegd een pensioenvoorziening voor de werknemer te treffen door middel van een bij……………………onder te brengen pensioenverzekering.
14.2 De rechten en verplichtingen terzake de pensioenvoorziening zijn opgenomen in een pensioenreglement dat aan de werknemer ter hand wordt gesteld. Het pensioenreglement maakt integraal deel uit van deze arbeidsovereenkomst, werknemer verklaart hierbij het hiervoor bedoelde regelement te hebben ontvangen.
ARTIKEL 15. SPAARLOONREGELING
De werknemer kan gebruik maken van een spaarloonregeling. Hiervoor heeft de werknemer een collectieve regeling getroffen. Wanneer de werknemer gebruik wil maken van de spaarloonregeling, dan zal de collectieve regeling aan de werknemer worden overhandigd.
ARTIKEL 16. WIJZIGINGEN ARBEIDSOVEREENKOMST
16.1 De werkgever behoudt zich het recht voor de arbeidsovereenkomst eenzijdig te wijzigen, indien hij daarbij een zodanig zwaarwichtig belang heeft dat het belang van de werknemer dat door de wijziging wordt geschaad, daarvoor naar maatstaven van redelijkheid en billijkheid moet wijken.
16.2 Wijzigingen en/of aanvullingen op deze overeenkomst zullen schriftelijk worden vastgelegd en door de werkgever en de werknemer voor akkoord worden getekend.
ARTIKEL 17. TOEPASSELIJKHEID BEPALINGEN
17.1 Op de verhouding tussen de werkgever en de werknemer is van toepassing de geldende CAO …………………………en de van toepassing zijnde wettelijke bepalingen, voorzover daarvan niet in de arbeidsovereenkomst of de bovenvermelde CAO is afgeweken.

ARTICLE 1. SORT OF EMPLOYMENT, PROBATIONARY PERIOD AND FUNCTION
1.1 The commencement of employment of the employee with the employer will start at .. ……….. in the function of……………….. The employment contract is entered into for a determined period of ……………………, effective as of .. …….. ….. and therefore ending by operation of law at ……………………...
1.2 There is a mutual probationary period of a month. During this probationary period, both parties can end the employment contract at once.
1.3 Meantime, both parties are authorized to end the employment contract at all time by means of a written resignation, with observance of the legally demanded term of notice. Resignation needs to take place in writing and by recorded delivery before the end of the calendar month.

ARTICLE 2. WORKING HOURS

2.2 The employee is committed to execute overtime in fairness when the employer thinks it necessary for a good conduct of business.
2.3 Overtime only comes up when the employee received the assignment from the employer to execute work outside the valid regular working hours of the employee.
ARTICLE 3. SALARY (PAYMENT)
3.1 The employee receives a gross-salary of …………. Euro per month, to be paid by the employer at the end of every month. The salary is based upon a full (40 hours) working week
3.2 In the salary and emoluments it is esteemed that the following are included: allowances, gratuities, compensations, no matter how named and of which type, the employee is legally entitled to from the employer at any time by virtue of the law and / or another arrangement of salary and labour conditions, under which a collective labor agreement, barring determined differently in this contract.
3.3 If the employment was anyhow shorter than the period over which the agreement on salary and emoluments is allocated, the claim of the concerning salary and emoluments over this period will exist pro rata.
ARTICLE 4. HOLIDAY ALLOWANCE
4.1 Annual, at the latest in the month ….., the employee is entitled to a holiday allowance from the employer. The claim of the holiday allowance is built-up in the period of 1 July of the previous year until 30 June of the current year. With interim outset or finish of the employment the holiday allowance will be determined with proper proportion.
4.2 The height of the holiday allowance amounts 8% and is related to the fixed gross monthly salary without possible overtime.
ARTICLE 5. DAYS’ HOLIDAY
5.1 The holiday year goes from 1 January until 31 December in every unique year.
5.2 The number of days’ holiday that the employee is entitled to in a calendar year amounts …. (minimal 4 times the number of agreed working days per week).
5.3 The employee himself is authorized to determine the outset and finish times of his holiday(s), as far as he is entitled to it at that moment and bearing in mind the merits of the employer.
5.4 As a rule, the days’ holiday need to be taken up in the holiday year in which they are built-up. The employer can determine that the employee possibly needs to take up outstanding days’ holiday at the end of the employment.
5.5 With interim outset or finish of the employment contract the days’ holiday are determined to proper proportions.
ARTICLE 6. DISABILITY
6.1 If the employee is prevented to execute the concurred activities due to disability by illness or an accident, the employer will continue to pay 70 % of the last gross salary during a maximum of 104 weeks and at the utmost for the duration of this contract. In this relationship, gross salary is understood to mean the gross salary (article 3, subsection 1 of this contract) including holiday allowance (article 4 of this contract).
6.2 Periods of disability that follow one another within a term of four weeks will be regarded as an interconnected period.
6.3 The commitment as referred to in article 6 subsection1 only counts as far as the employer is committed to continue to pay a minimum of 70 % of the gross salary, based upon the legal stipulations to this point.
6.4 The employee will immediately report, although at the latest at the beginning of a working day (before 09.00 AM) to ………………….if he is unable to attend the concurred activities. During the disability period, the employee is to observe to the regulations of the Health and Safety Executive to which the employer is connected, as well as regulations to the point that the employer determined , which have been provided to the employee at the first working day.

ARTICLE 7. CAR
7.1 The employer will place a car at the employee’s disposal for the practise of his function as …………..for the duration of the employment. This car will remain a possession of the employer.
7.2 The usage of the car for this purpose ends:
• When finishing the employment;
• When finishing the activities;
• With long term disability of the employee (longer then two months);
• When suspension of the employee comes up;
7.3 All costs connected to the normal usage of the car will be for the employer’s own expense.
7.4 The employee is committed to use the car that is placed at his disposal in a manner befitting a “good paterfamilias”. When the car is damaged, the employee needs to report this immediately to the employer and the insurance company. The employee is responsible for all damage that is caused by his intention or deliberate recklessness.
7.5 The employee will not place the car at someone else’s disposal without a written authorization of the employer.
7.6 The employee is to use the car in consensus with this insurance conditions of the insurance the employer purchased.
7.7 When a lease-car is appropriate, the possible lease conditions will be integrant part of this contract and the employee hereby declares to have received these conditions from the employer.
7.8 If the employee operates contradictory to any stipulation of this article, the employee is indebted a fine of € 500,- to the employer, which is collectible directly and without any judicial intervention. The fine as referred to for this purpose will not holdup the employer of demanding an indemnification. From the determined in article 7:650 subsection 6 CC is hereby deviated from the determined in article 7:650 subsection 3 and 5 CC. The employer can deduct the fine from the next indebted salary of employee.
ARTICLE 8. TRAVELLING-EXPENSES
8.1 When the employee uses his own car for the commuter traffic the travel allowance for the commuter traffic amounts the maximum sum that the employer is authorized to remit tax-free, provided that the commuter traffic distance amounts more than ten (10) kilometers.
8.2 The employee will receive an allowance of € … per kilometer for the number of business kilometers driven with the own car or an amount as such per kilometer that can be remitted as based upon the fiscal instructions as free allowance.
8.3 When a car is placed at the employee’s disposal there is no right to the travel allowance as described above.

ARTICLE 9. MOBILE PHONE
The employer will place a mobile phone at the employee’s disposal for the practise of his function as …………..for the duration of the employment. The costs of the subscription and the business conversation costs will be paid by the employer. The employee will preserve the phone in a manner befitting a good paterfamilias becomes and will only use this in order to execute the activities that come forth from the earlier mentioned function.
ARTICLE 10. OTHER RIGHTS AND DUTIES
10.1 The employee is not authorized to accept or accomplish any direct or indirect commission, compensation or allowance of any kind from customers, suppliers or others for activities or services that ligature with the activities of the employer and the employment contract in question with other than on behalf of the employer. It is also not authorized to involve employees or use materials different from the business activities of the employee.
10.2 Except for preceding authorization in writing from the employer, the employee will not practise a profession or company besides the employment, not in what way and in which condition what so ever, not by his own name, with help of and / or in cooperation with another natural or legal person.
10.3 The employee is committed to full confidentiality both during and after the employment with regard to all details concerning inventions, products, services, patents, drawings, contracts organization, suppliers, customers and others with whom the employer keeps u a contract, in short concerning all company affairs in the broadest sense of the word, of which the employee needs to understand the confidential nature.
10.4 If the employee is to take care of publications in word or writing that may affect the merits of the employer, the employee is bound to ask for and receive the employer’s consent in advance.
10.5 Company means as well as all correspondence, notes, drawings etc. relating to company affairs will be immediately turned in with the employer by the employee at the end of the employment. Furthermore, the employee is bound to place all the things mentioned above at the employer’s disposal during the period in which he doesn’t execute his function, either due to disability during an interconnected period longer then 4 weeks, or due to suspension by the employer with preservation of the salary.

ARTICLE 11. INTELLECTUAL OWNERSHIP RIGHTS
11.1 Intellectual ownership rights on work or other equipment within the framework that is placed at the employee’s disposal, such as programs, software or other materials such as analyses, designs, reports, offers or other products or services, as is preparatory material of this, belongs to the employer. If and as far as this right does not belong to the employer by operation of law, but if a more detailed document is required for this, the employee authorizes the employer to sign a document on behalf of him in order to transfer intellectual ownership rights from employee to employer.
11.2 The employee is committed to render assistance on request of the employer to the establishment or defense of intellectual ownership rights in the Netherlands or abroad. The cooperation could consist of, among other things, making and signing statements and postponing publications for a period that is needed to settle that right.

ARTICLE 12. COMPETITION INJUNCTION
The employee will not execute activities with relations of the employer, as well as within the working area of the employer, in what way and in which condition what so ever, either with his own name, with help of / and in cooperation with, as well as in employment of other natural or legal persons, which are equal to the activities of the employer or with the organizations related to the employer without a preceding consent in writing during the employment, as well as during a period of twelve months after ending the employment.

ARTICLE 13. PENALTY STIPULATION
13.1 If the employee violates and / or does not follow the determined in the articles … he will forfeit a directly collectable fine of €……..to the employer for every violation, as well as an amount of €………….. for every day that the violation / not-following occurs. The fine will be indebted due to the fact of the violation or the not-following, but leaves the right of the employer unabated to require following of this contract and leaves the right of the employer unabated to demand a full indemnification.

14.1 The employer has promised to establish a pension facility for the employee by means of a pension insurance that will be accommodated at …………………….
14.2 The rights and commitments to the point of the pension facility are taken up in a pension regulation that will be given to the employee. The pension regulation is an integral part of this employment contract, employee hereby declares to have received the regulations for this purpose.
ARTICLE 15. SALARY SAVINGS SCHEME
The employee may utilize a salary savings scheme. The employer made a collective arrangement for this. When the employee desires to utilize the salary savings scheme the collective arrangement will be given to the employee.
ARTICLE 16. CHANGES EMPLOYMENT CONTRACT
16.1 The employer has the right to change the employment contract biased and without reservations when he has such a ponderous merit that the merit of the employee that will be damaged by the change has to budge according to measures in all fairness and judiciousness.
16.2 Changes and / or additions to this contract will be legally bound in writing and will be signed for approval by the employer and the employee.
ARTICLE 17. APPROPRIATENESS STIPULATIONS

The RF treatment system is mainly made up of the following parts:

1.5 Control panel
The operator controls the system through the control panel which includes the
following parts:
Key switch: To be used to turn on and off the power supply；
Emergency Switch: pressing this switch will shut off the whole power supply of
system immediately. It has priority over the system performance compared with the key
switch. Follow the arrowhead direction, turn the emergency switch clockwise and
immediately loosen it, otherwise the machine will be kept on shut off；
The LCD: The operator exchanges information by the LCD.
The system state, operation interface, hints and instructions are all on the LCD.
1.6 The RF treatment head
Five Monopolar treatment heads available as following:

The RF treatment head contains electronic components emitting RF. It connects the
system through a set of cable.
Pressing the key on the RF treatment head can emit RF, which is delivered to the
area to be treated through the head.
Inside the RF treatment head, there is the thermoelectricity type semi-conductor
refrigeration system to be used to cool down the treatment head. So, the temperature of
the skin surface can be lowered down so as to reduce the patient’s discomfort.

Chapter 2 Installation
2.1 Infuse water
Take out the machine from the box and place it carefully in the appointed room, where
the indoor temperature is at 10℃～28℃, and the humidity is not over 80%. Keep the
operation room and treatment bed clean all the time.
Infuse distilled water from the water infusion hole until the water line reaches the 2/3
place of the water level observation window.
Danger
Before turning on the machine the first time, you must infuse enough
cooling water; otherwise, the machine will be burned or damaged.
So, you must check the water level before turning on the machine to avoid
the damage to the machine.

Install the treatment head. Requirement: keep the connection
part dry and install it correctly.
Link the power supply，foot switch.
Switch on： After completing the above installation,
insert the key and turn it left, the machine is switched on
at once, at this time, water begin to circulate, and the
cooling system starts automatically.
Check：Observe instrument to make sure that no
water leaks. If it is leaks, shut off the power supply, and
contact the dealer.
Add water: When the water in the machine begins circulating, the water level inside
will drop, so you should add some water to the 2/3 place of water level observation.
After that, please screw the stopper with a hole to the Water Input.
2.2 Replace the water
Replace the water inside every 2 to 3 months and please do it according to the
following steps strictly:
Drain water in the machine: Screw off drain plug, lift up the front of the device to drain
water completely.

Infuse water again following the above-mentioned steps.
Link the power supply according to the above mentioned steps.
Attention:
1 In order to guarantee the safety of operation, please increase the distilled water up
to 2/3 place of the water level observation；
2. Please use the distilled water (not pure waters) only.
3. if the machine has been in the room with its inside temperature below 0℃ for a
long time, there may be frost inside the machine and the machine may be damaged.
Method: place the machine in a room with a temperature at 20℃ for 24 hours, then you
can carry on operation.
2.3. Install the Foot Switch
Open the stopper and insert the plug and screw it on tightly.
Caution
In order to guarantee the machine operated safely, please increase the
distilled water to the cooling system in time. It is not our responsibility if
the treatment head is damaged because of the shortage of cooling water.
While adding the distilled water for the first time, please carry on according
to the above steps, then start the system ；
Use the distilled water or purified water only. The water temperature can not
be lower than 5 degrees centigrade ；

2.4 Connect the power supply
2.5 install the Treatment heads and the cathode plate
1) Plug the treatment head into the machine and connect the cathode plate.
2) Select the right treatment head and screw it on tightly to the handpiece and then
put it on the holder.
3) Let the metallic side of the plate face up and then press down the fastener.

Chapter3 Software operation
After the installation, please switch on the machine and the following interface will
appear:
Please press “ENTER” key and enter the hint interface, the IC Card number and the

You can decrease the temperature by the “DOWN” key or increase the temperature
by the “UP” key. After setting, press “ENTER” key and return to the main interface.
Under the main interface, you can turn on or off the tone by the “RET” key as follows:

“FUN” key:

Here, “DOWN” or “UP” key is used to decrease or increase the energy and “RET” key
is used for changing the treatment mode.
After the temperature of the treatment head reach the temperature preset, you can
choose the proper treatment mode, adjust to the just energy and put the head onto the
area to be treated and start your treatment by pressing the start button or the step switch.
You can press the “ENTER” key for the temperature setting and press again the
“FUN” key and enter the standby state.
Danger
When the temperature of the treatment head is over 5 degrees
centigrade, you’d better not to do your treatment.
2.After turning on the machine, you can find that the temperature of the
treatment head is falling till it reach the temperature preset; when the
temperature of the treatment decrease below minus 8 degrees
centigrade, it means that something is wrong with the circuit of the
equipment, please manage to solve the problem.

Chapter4 Operation procedure
4.1 Preparation
1) Insert the IC card (Let the side with metal face down);
2) Turn on the machine by the Key Switch
3) Press the “ENTER” key and enter the interfaces:
A. Set Temperatures:
-4-4 degree centigrade, adjustable;
B. Select the treatment modes (0, 1, 2 and 3):
a. 0 for the sensitive;
b. 1 for the normal;
c. 2 for the endurable;
d. 3 for any part of the body.
C. Set the RF energy Level according to the parameters table.
4.2 Operation Examples
Operation technique: Let the treatment head touch the target area and move (or slide)
from the inner to the outer and round and round and from the lower place to the higher; do
it in this way again and again; when you do the treatment on the upper lid, please move a
bit more quickly; when the gel on the face get drier, please add some water and go on with
the treatment.
4.2.1 Face (Including cheek, eye, forehead, lip, neck and acne scars)

Replacing treatment head: When you want to replace the
treatment head during treatment, you must keep the machine in
standby state by pressing the “FUN” key.
The treatment head must be kept on the skin (sliding); otherwise, the skin
will get burned.
Before the treatment head leaves the skin, you must loose the button on the
head or loose the foot switch.
When the temperature of the treatment head is over too high, you should
stop treatment.
The energy you adopt should not be too high; otherwise, the skin will get
burned.
Please choose the proper energy, the feeling of the patient should be hot
inside and cool outside.
Adjust energy Level from weak to strong during treatment, the stronger
energy, the better effect will be; take the highest energy which patient can
tolerate as standard.
Do not apply on areas such as larynx, eyeball, upper eyelid, temple etc.
Be careful during the treatment on areas with thin skin or many vessels
such as canthus, forehead, neck, mouth corners, cheekbone etc.
Smear gel on areas to be treated during treatment.
Do not spray alcohol directly on treatment tips to sterilize.
Hold the hand piece correctly during treatment, put the thumb and
forefinger above the button, and put ring finger and little finger below the
button, and use the middle finger to press the button.
Slow down the energy release speed during the treatment on faces for more
comfortable feeling.
Does not use hand to comfort skin to avoid gel sticking on hand piece.
It’s normal phenomenon that some patients’ skin may appear with a little bit
redness which will fade automatically after half an hour.
Please carry out skin moisturizing and sun proof cream work after
treatments, do not wash faces with hot water (use water under the body
temperature), and do not go for hot spring and massage.

6.1 What is radio frequency?
A definition of physics, radio frequency means electric and magnetic wave which
transmits, for short it is RF, i.e. RF electric current, a shortened form of high frequency AC
changing electric and magnetic wave. AC which changes less than1000 times per second is
low frequency electric current, and changes more than 10000 times per second is high
frequency electric current, RF is such a high frequency electric current. Medically, the
0.5MHz-8MHz AC high frequency electric current is called RF, and it is widely used in fields
of wireless communications and has non-replaceable function. For example, RF thermal
technology transfers high frequency electric current into thermal energy which can be used

1.5 Controle paneel
De operateur die het systeem controleert middels het controle paneel bevat de volgende onderdelen:
Hoofdschakelaar: Wordt gebruikt om de stroomtoevoer van het apparaat aan en uit te schakelen;
Noodschakelaar: Het indrukken van deze schakelaar zal direct de gehele stroomtoevoer van het apparaat afsluiten. Het heeft prioriteit boven de systeem prestaties in vergelijking met de hoofdschakelaar. Volg de richting van de pijltjes, draai de noodschakelaar met de klok mee en laat het direct los, anders zal het apparaat uitgeschakeld blijven;
De LCD: De operateur wisselt informatie uit middels de LCD.
De systeem status, bedieningsmenu, hints en instructies worden allen weergegeven op de LCD.
1.6 De RF behandelingskop

De RF behandelingskop bevat elektronische compenenten die RF uitstralen. Het is aan het systeem gekoppeld middels een set van kabels.
Drukken op de toets op de RF behandelingskop kan RF uitstralen, wat wordt debracht naar het te behandelen gebied middels de kop.
Binnen de RF behandelingskop is een thermo-elektroscuh halfgeleider koel systeem aangebracht dat wordt gebruikt om de behandelingskop af te koelen. Daardoor kan de temperatuur van het huidoppervlak worden gereduceerd, wat resulteert in vermindering van het ongemak van de patiënt.

Hoofdstuk 2 Installatie
2.1 Water ingieten
Haal het apparaat uit de kast en plaats het voorzichtig in de aangestelde ruimte waar de binnen temperatuur 10℃～28℃ en de vochtigheid niet meer dan 80% bedraagt. Houd de aangestelde ruimte en het behandelingsbed ten aller tijden schoon.
Giet gedestilleerd water in het watergaatje totdat het de waterlijn de 2/3 plaats van het water niveau observatie scherm bereikt.
Gevaar
Alvorens het apparaat voor de eerste keer aan te zetten moet u voldoende koelwater ingieten; anders zal het apparaat verbranden of beschadigen.
Daarom moet u het water niveau controleren voordat het apparaat wordt aangezet om schade aan het apparaat te voorkomen.

Installeer de behandelingskop. Vereiste: houd het verbindingsstuk droog en installeer het juist.
Verbind de stroomtoevoer en het voetpedaal.
Zet aan: Na voltooiing van de eerder genoemde installatie,
geef de sleutel in en draai naar links, het apparaat wordt direct aangezet,
op dit moment zal het water beginnen te circuleren en het koel systeem
start automatisch.
Controleer: Bekijk gereedschap om ervan verzekerd te zijn
dat geen water lekt. Als het lekt, zet dan de stroomtoevoer uit en
neem contact op met de dealer.
Voeg water toe: Wanneer het water in het apparaat begint te circuleren zal het water niveau
binnenin verminderen, u dient dus wat water toe te voegen tot het 2.3 niveau van het water niveau waarnemingsvenster is bereikt. Daarna schroeft u de stop terug op de ingang waar het water ingegoten wordt.
2.2 Het water vervangen
Vervang het water elke twee tot drie maanden en doe dit precies volgens de volgende stappen:
Voer het water in het apparaat af: schroef de afvoer stop eraf en til de voorkant van het apparaat op om het water compleet af te voeren.

Giet weer nieuw water in volgens de eerder genoemde stappen.
Maak wederom verbinding met de stroomtoevoer volgens de eerder genoemde stappen.
Let op:
1 Om de veiligheid van de bediening te garanderen dient gedestilleerd water tot 2/3 niveau van het water niveau venster；
2. Gebruik louter gedestilleerd water (geen puur water).
3. Wanneer het apparaat zich in een ruimte heeft bevonden waar de termperatuur onder 0℃ is geweest voor een lange tijd, zou er zich ijs binnen het apparaat kunnen bevinden en het apparaat zou beschadigd kunnen zijn.
Procedure: plaats het apparaat gedurende 24 uur in een ruimte met een temperatuur van 20℃,daarna kunt u het apparaat wederom bedienen.
2.3. Het voetpedaal installeren
Open de stop en geef de stop in, schroef deze strak aan.
Let op
Om de veiligheid van de bediening van het apparaat te garanderen dient u tijdig gedestilleerd water toe te voegen aan het koel systeem. Het is niet onze verantwoordelijkheid wanneer de behandelingskop is beschadigd door een tekort aan koelwater.
Wanneer u voor de eerste keer gedestilleerd water toevoegt dient u de stappen als eerder genoemd te volgen, waarna het apparaat aangezet kan worden;
Gebruik louter gedestilleerd of gezuiverd water. De water temperatuur mag niet lager zijn dan 5 graden Celcius;

2.4 Sluit de stroomtoevoer aan
2.5 Installeer de behandelingskoppen en de kathode plaat
1) Sluit de behandelingskop aan op het apparaat en sluit de kathode plaat aan.
2) Selecteer de goede behandelingskop, schroef het steving aan op het handvat en plaats het in de houder.
3) Zorg ervoor dat de metalen kant van de plaat naar boven gericht is en druk vervolgens op de sluiting.

Hoofdstuk 3 Software bediening
Na installatie zet u het apparaat aan en het volgende menu zal verschijnen:

U kunt de temperatuur verlagen middels de “OMHOOG” toets of the temperatuur verhogen middels de “OMLAAG” toets. Na het instellen, druk op de “ENTER” toets om terug te keren naar het hoofdmenu. Onder het hoofdmenu kunt u als volgt de toon aan- of uitzetten middels de “RET” toets:
Onder het hoofdmenu kunt u de behandelingstijd als volgt middels de “OMLAAG” of “OMHOOG” toets verlagen of verhogen:
Onder het hoofdmenu zal het systeem de GEREED status aangeven wanneer u de “FUN” toets indrukt:

Hier wordt de “OMLAAG” of “OMHOOG” toets gebruikt om de energy de verhogen of te verlagen, de “RET” toets wordt gebruikt om de behandelingsmodus aan te passen.
Wanneer de temperatuur van de behandelingskop de vooraf ingegeven temperatuur heeft bereikt kunt u de geschikte behandelingsmethode selecteren, regel het naar de juiste energie en plaats de kop of het te behandelen gebied en start de behandeling door de start knop of het voetpedaal in te drukken.
U kunt de “ENTER” toets indrukken om de temperatuur instellingen te bereiken en druk nogmaals of de “FUN” toets en geef de standby status in.
Waarschuwing
Wanneer de temperatuur van de behandelingskop boven de 5 graden Celcius komt kunt u het beste de behandeling staken.
2. Na aanzetten van het apparaat kunt u de temperatuur van de behandelingskop zien verlagen totdat het de vooraf ingegeven temperatuur bereikt; wanneer de temperatuur van de behandeling verlaagt tot beneden 8 graden Celcius betekent dit dat iets niet in het circuit van het apparaat niet in orde is, probeert u het probleem op te lossen.

Hoofdstuk 4 Bedieningsprocedure
4.1 Voorbereiding
1) Geef de IC kaart in (Plaats de zijde met metaal naar beneden);
2) Zet het apparaat aan met de Sleutel Schakelaar
3) Druk op de “ENTER”toets en ga de menu’s binnen:
A. Stel temperaturen in:
-4-4 graden Celcuis, aanpasbaar;
B. Selecteer de behandelings modi (0, 1, 2 en 3):
a. 0 voor de gevoelige huid;
b. 1 voor de normale huid;
c. 2 voor de stevige huid;
d. 3 voor elk deel van het lichaam.
C. Stel het RF energie niveau in volgens de parameters tabel.
4.2 Bedieningsvoorbeelden
Bedieningstechniek: Laat de behandelingskop het doelgebied aanraken en beweeg (of schuif) van binnen naar buiten in cirkels en van de lagere plaats naar de hogere plaats; doe dit een aantal maal; wanneer u de behandeling uitvoert op het ooglod beweegt u ietwat sneller; wanneer de gel op het gezicht droger wordt voegt u wat water toe en vervolgt de behandeling.
4.2.1 Gezicht (Inclusief wang, oog, voorhoofd, lip, nek en acné littekens)
Bedieningsprocedure:
(Ongeveer 60 minuten voor het gehele gezicht, 30~45 minuten voor de nek)
a) Voer een huid evaluatie uit voor de behandeling te starten.
b) Reinig de huid.
c) Harmonieer de huid.
d) Masseer met cosmetica.
e) Reinig huid.
f) Plaats de metalen zijde van de kathode plaat dichtbij de rug van de patiënt.

g) Smeer gel op de huid en pas behandeling toe middels het handvat.
h) Breng anti-veroudering distilaat aan.
i) Draag gedurende 15-20 minuten een gezichtsmasker.
j) Reinig huid.
k) Bevochtig de huid middels cosmetica.
l) Voer een huid evaluatie uit na behandeling.
Serie behandelingen: Eén serie behandelingen bevat vijf behandelingen met een interval van elke 10 ~15 dagen.
Genezend effect.
Na één behandeling zullen de verhitte subcutaan vezels direct krimpen, daardoor worden fijne rimpels verbetered en wordt de huid jonger, zachter en steviger.
Na een serie behandelingen: De collageen proteïnen zijn verbeterd voor lange termijn, huid wordt jonger en zachter, rimpels zijn verminderd en de huid is strakker en steviger.

Waarschuwing
Het principe voor behandeling is dat de patiënt hitte maar geen extreme hitte of verbranding voelt.
Behandelingskop vervangen: Wanneer u de behandelingskop wilt vervangen tijdens de behandeling dient u het apparaat in standby modus te houden door de “FUN” toets in te drukken.
De behandelingskop moet op de huid gehouden worden (schuiven); anders zal ze huid verbranden.
Voordat de behandelingskop de huid verlaat dient u de knop op de kop of het voetpedaal los te laten.
Wanneer de temperatuur van de behandelingskop te hoog is dient u de behandeling stop te zetten.
De energie die u aanneemt dient niet te hoog te zijn; anders zal de huid verbranden.
Kies de juiste energie, het gevoel van de patiënt dient niet heet van binnen en koud van buiten te zijn.
Pas het energie niveau tijdens de behandeling van zwak naar sterk aan, hoe meer energie, hoe groter het succes zal zijn; neem de hoogste energie waarde die de patiënt standaard kan verdragen.
Gebruik het apparaat niet op gebieden als de larynx, oogbal, bovenste ooglid, slaap etc.
Ben tijdens de behandeling voorzichtig met gebieden waarbij dunne huid of vele bloedbaten voorkomen, zoals het voorhoofd, de nek, de mondhoekenen en de jukbeenderen.
Sproei niet direct alcohol op de behandelingspunten om te steriliseren.
Houd het handvat goed vast tijdens de behandeling, plaats de duim en de wijsvinger boven de knop en plaats de ringvinger en de pink onder de knop, gebruik de middelvinger om de knop in te drukken.
Vertraag de energie afgave snelheid tijdens de behandeling bij gezichten voor een comfortabeler gevoel.

Hoofdstuk 6 Veelgestelde vragen
6.1 Wat is radio frequentie?
Volgens een definitie van fysica, betekent radio frequentie elektrische en magnetische golven welke worden overgebracht, in het kort is het RF, m.a.w. elektrische stroming, een verkorte vorm van hoge frequentie AC veranderend elektrische en magnetische golven. AC verandert minder dan 1000 maal per seconde en dit is een lage frequentie elektrische stroming, een verandering van meer dan 10000 maal per seconde wordt als hoge frequentie elektrische stroming aangemerkt. RF is een hoge frequentie elektrische stroming. Medisch gezien, de 0.5MHz-8MHz AC hoge frequentie elektrische stroming wordt RF genoemd en het wordt veelal gebruikt in gebieden van draadloze communicatie en heeft een niet-verplaatsbare functie. Bijvoorbeeld, RF thermale technologie verplaatst hoge frequentie elektrische stroming naar thermale energie, wat kan worden gebruikt op het esthetisch vlak.
6.2 Wat is het principe van het RF thermale therapie apparaat?

6.4 Wat voor soort mensen zijn geschikt voor RF behandelingen?

c) Mensen die geen plastische chirurgie willen ondergaan.
d) Mensen die hun uiterlijk willen verbeteren.

g) Mensen die hun slappe huid strakker willen maken en hun gezichtscontouren willen verbeteren middels een niet-operatieve en niet-invasieve manier.
6.5 Wat voor soort mensen zijn niet geschikt voor RF behandelingen?
Mensen die een hoge bloeddruk hebben, diabetici, ernstige huidziekten of hartziekten hebben, mensen die gevoelig zijn voor elektrische stroming, diegenen die zwanger zijn, een hormoonbehandeling ontvangen of een andere huidbehandeling en patiënten met een pacemaker.
6.6 Zijn RF behandelingen pijnlijk?
De energie voor de meeste behandelingen ligt tussen niveau 2 en 3 en de opperhuid is koel, daardoor is het totaal niet pijnlijk.
