Divorce - Overview
A divorce -- referred to in some states as a dissolution of marriage -- is a decree by a court that a valid marriage no longer exists. A divorce leaves both parties free to remarry. It usually provides for division of property and makes arrangements for child custody and support.
Although divorces may be emotionally contentious, most divorces (probably more than 95 percent) do not end up in a contested trial. Usually the parties negotiate and settle such things as division of property, spousal support, and child custody between themselves, often with an attorney's help. Sometimes parties reach an agreement by mediation, with a trained mediator who tries to help husband and wife identify and accommodate common interests. The parties then present their negotiated or mediated agreement to a judge. Approval is virtually automatic if the agreement appears to meet a minimal standard of fairness.
If parties are unable to agree about property, support, and child custody, they may ask the court to decide one or more of those issues.
A threshold requirement for obtaining a divorce in most states is residency or domicile of one or both parties who are to be divorced. "Residency" refers to the state in which a person lives; "domicile" refers to the state that the person regards as "home." Usually the state of a person's residency and domicile are the same, but sometimes they can be different. For example, a couple may reside four months each year in the state of their "summer home", but regard another state where they spend the rest of the year as their true home (and that state would be the state of their domicile).
Residency (or domicile) requirements vary. A few states have no residency requirement. That means a person can arrive in a state and seek a divorce on the same day. Residency requirements of other states range from six weeks to one year; six months is the most common time period. In states with a residency requirement, a party must have lived in the state for the specified period before a divorce can be granted.
The party seeking a divorce must state a ground for divorce in the papers filed with the court. The grounds may be based on no-fault or fault, depending on the state. All states now offer no-fault divorces; approximately thirty-two states also offer fault-based grounds as an additional option. (See chart.)

Advise of Rights — US Magistrate Judge
You have the following rights under the Constitution and laws of the United States:
1. You have the right not to incriminate yourself, sometimes called the ‘right of silence”. This means that no one can require you to answer any questions or make any statements about the charges you face. This is a right that you can waive or give up. So, after knowing of your right of silence if you decide to answer any questions or make any statements, whatever you say can and will be used against you.
2. We are recording this proceeding with a tape recorder and I will be asking you a few questions in a moment; however, I will not ask you anything about these charges and I suggest you make no statement about them to me or to anyone else.
3. On a later date, you will be called on to enter a plea to the charges in the indictment. That plea can either be guilty or not guilty. If you decide to plead guilty
there will be no need for a trial because you will not be contesting the governments contention that you did the crimes charged in the indictment. If you decide to plead not guilty, there will be a trial.
4. At the trial, there will be no burden on you to prove anything and you will be presumed innocent. The burden will be on the government to prove you guilty
beyond a reasonable doubt. The government must do this by bringing into court witnesses to testify against you in open court, under oath, from the witness stand. After the government finishes asking these witnesses questions, you or your attorney will be allowed to ask those witnesses questions because the Constitution gives you the right to
confront witnesses.
5. You have the right to present evidence in your own behalf at trial. This includes the right for you to testify, but only if you wish to testify. You cannot be required to testify because you have the right of silence, to which I have already referred. If you elect not to testify, no inference of your guilt can be drawn from your silence.
6. You have the right to use the power of the subpoena to bring to court witnesses whom you wish to testify for you.
7. You have the right to a jury trial.
8. You have the right to be represented by an attorney. If you cannot afford an attorney, I will appoint an attorney to represent you. If I do appoint an attorney, that attorney may not be free to you because if you are found guilty the court might require you to reimburse the government for the cost of court appointed counsel.
The Constitution provides that persons will not be tried on felony charges except on presentment of a true bill of indictment by a grand jury. At this point, a grand jury has not indicted you. If it never does indict you, you would not be tried and if you are then in custody, you would be released. Until the grand jury has a chance to consider whether to indict you, you have a right to a hearing called a “preliminary examination”, which is the same as a probable cause hearing. At that hearing the court will determine whether there is probable cause to believe: (1) that the crimes alleged have been committed; and ( 2) that you committed them.
This probable cause hearing will be held at the same time as your detention hearing.
The U.S. Attorney has moved that you be held in custody from now until time of trial of this case. Whether you should be held in custody or released on bond or other conditions will be decided at a hearing called a detention hearing. You will be held in custody until this hearing and you will be brought back to court for it. You will be represented by an attorney at that hearing.
l am now going to ask you a few questions and I want you to understand the reason for my questions. First, we simply need to corroborate certain identifying information in the court’s file, such as name and address. Next, we need to determine whether there is any issue of your competence. If so, we would need to have you hospitalized for a mental competency determination. Lastly, I need to see if you have understood these proceedings.

Esto quiere decir que nadie puede pedirle que conteste preguntas o haga declaraciones con respecto a los cargos que esta enfrentando. Este es un derecho del cual usted puede prescindir o al cual puede renunciar.
