RESOLUÇÃO CNSP No 168, DE 2007.
Dispõe sobre a atividade de resseguro,
retrocessão e sua intermediação e dá
outras providências.
A SUPERINTENDÊNCIA DE SEGUROS PRIVADOS – SUSEP, no uso da atribuição
que lhe confere o art. 34, inciso XI do Decreto No 60.459, de 13 de março de 1967, e considerando o
que consta do Processo CNSP No 3, de 3 ,de dezembro de 2007, na origem, e Processo SUSEP no
15414.002699/2007-32, torna público que o CONSELHO NACIONAL DE SEGUROS PRIVADOS
– CNSP, em sessão ordinária realizada em 17 de dezembro de 2007, com fundamento nos incisos II, VI
e VII do artigo 32, do Decreto-Lei No 73, de 21 de novembro de 1966, e nas disposições da Lei
Complementar No 126, de 15 de janeiro de 2007,
R E S O L V E U:
CAPÍTULO I
INTRODUÇÃO
Art. 1o Todas as operações de resseguro, retrocessão e a intermediação dessas operações
ficam subordinadas às disposições da presente Resolução.
CAPÍTULO II
DAS DEFINIÇÕES
Art. 2o Para fins de aplicação da presente Resolução consideram-se:
I - cedente: a sociedade seguradora que contrata operação de resseguro ou o ressegurador
que contrata operação de retrocessão;
II - contrato automático: a operação de resseguro através da qual a cedente acorda com
ressegurador ou resseguradores a cessão de uma carteira de riscos previamente definidos entre as partes
e compreendendo mais de uma apólice ou plano de benefícios, subscritos ao longo de um período prédeterminado
em contrato;
III - contrato facultativo: operação de resseguro através da qual o ressegurador ou
resseguradores dão cobertura a riscos referentes a uma única apólice ou plano de benefícios ou grupo
de apólices ou planos de benefícios já definidos quando da contratação entre as partes;
IV – corretora de resseguro: pessoa jurídica autorizada a intermediar a contratação de
resseguros e retrocessão, que disponha de contrato de seguro de responsabilidade civil profissional, e
que tenha como responsável técnico o corretor de seguros especializado e devidamente habilitado, na
forma definida pelo Conselho Nacional de Seguros Privados – CNSP;

V - ressegurador local: ressegurador sediado no País, constituído sob a forma de sociedade
anônima, que tenha por objeto exclusivo a realização de operações de resseguro e retrocessão;
VI - ressegurador admitido: ressegurador sediado no exterior, com escritório de
representação no País, que, atendendo às exigências previstas na Lei Complementar No 126/07 e nas
normas aplicáveis à atividade de resseguro e retrocessão, tenha sido cadastrado como tal na
Superintendência de Seguros Privados – SUSEP, para realizar operações de resseguro e retrocessão;
VII - ressegurador eventual: empresa resseguradora estrangeira sediada no exterior, sem
escritório de representação no País, que, atendendo às exigências previstas na Lei Complementar No
126/07 e nas normas aplicáveis à atividade de resseguro e retrocessão, tenha sido cadastrada como tal
na SUSEP, para realizar operações de resseguro e retrocessão;
VIII - resseguro: operação de transferência de riscos de uma cedente, com vistas a sua
própria proteção, para um ou mais resseguradores, através de contratos automáticos ou facultativos,
ressalvado o disposto no inciso IX deste artigo; e
IX - retrocessão: operação de transferência de riscos de resseguro de resseguradores, com
vistas a sua própria proteção, para resseguradores ou para sociedades seguradoras locais, através de
contratos automáticos ou facultativos.
§ 1o Equipara-se à sociedade seguradora a sociedade cooperativa autorizada a operar em
seguros privados que contrata operação de resseguro, desde que a esta sejam aplicadas as condições
impostas às seguradoras pelo CNSP.
§ 2o Para os fins e efeitos previstos nesta Resolução, a retrocessão se enquadra, no que
couber, nas operações de resseguro.
CAPÍTULO III
DAS CONDIÇÕES DE ACESSO E EXERCÍCIO

CNSP RESOLUTION NO. 168 of 17 DECEMBER 2007
Regulates the reinsurance, retrocession activity and the intermediation thereof and provides other provisions.
The PRIVATE INSURANCE SUPERINTENDENCE - SUSEP, in use of the power bestowed in Article 34, incision XI therein Decree No 60.459 of 13 March 1967, and considering that stated in CNSP Case No. 3 of 3 December 2007, originally, and SUSEP Case No. 15414.002699/2007-32, proclaim that the NATIONAL PRIVATE INSURANCE COUNCIL - CNSP, in ordinary session held on 17 December 2007, founded on incisions II, VI and VII of Article 32, therein Decree-Act No. 73 of 21 November 1966, and on the provisions therein Complementary Act No 126 of 15 January 2007, hereby resolve that:
CHAPTER I
INTRODUCTION
Article 1. All reinsurance and retrocession operations as well as the intermediation of such operations are subordinated to the provisions of the present Resolution.
CHAPTER II
DEFINITIONS
Article 2. The following terms shall be considered for the purposes of applying the present Resolution:
I - cedent: a corporate insurer that contracts reinsurance operations or a reinsurer that contracts retrocession operations;
II – automatic contract: a reinsurance operation through which the cedent agrees with an reinsurer or reinsurers to assign a risk portfolio previously defined between the parties and embodies more than one policy or benefit plan, underwritten throughout a preset contracted period;
III - facultative contract: a reinsurance operation through which the reinsurer or reinsurers provide risk coverage referring to a single policy or benefit plan or group of policies or benefit plans previously defined upon the contracting between the parties;
IV - reinsurance broker: an enterprise authorized to intermediate the contracting of reinsurance and retrocession, which utilizes an insurance contract of professional civil liability, and which maintains a duly-licensed specialized insurance broker as the technician in charge, under the form defined by the National Council of Private Insurance - CNSP;
V - local reinsurer: a reinsurer based within the Country, chartered under the form of a limited liability corporation, which has the sole concern of conducting reinsurance and retrocession operations;
VI - admitted reinsurer: a foreign-based reinsurer that maintains a representational office in Brazil, which, upon compliance with those requirements set forth therein Complementary Act No 126/07 and those norms applicable to reinsurance and retrocession activity, have been registered as such at the Superintendence of Private Insurance - SUSEP, to conduct reinsurance and retrocession operations;
VII - reinsurer eventual: a foreign-based alien reinsurer that does not maintain a representational office in Brazil, which, upon compliance with the requirements set forth therein Complementary Act No 126/07 and those norms applicable to reinsurance and retrocession activity, have been registered as such at SUSEP, to conduct reinsurance and retrocession operations;
VIII - reinsurance: an operation transferring risk from one cedent, aimed at the self protection thereof, to one or more reinsurers, through automatic or facultative contracts, save guarding the precept in incision IX of this article; and
IX - retrocession: an operation transferring reinsurance risks from reinsurers, aimed at the self protection thereof, to local reinsurers or to insurance companies, through automatic or facultative contracts.
Paragraph 1. An association (pool) authorized to operate Private Insurance that contracts reinsurance operations shall be deemed the equivalent of an insurance company, provided that the same is subject to those conditions imposed by the CNSP upon insurers.
Paragraph 2. For those purposes and effects set forth herein this Resolution, retrocession shall be embodied, whenever befitting, within reinsurance operations.
