5.02 – Discipline
Als Disziplinarmaßnahme sind nach deutschen Recht möglich
* Ermahnung (Aufforderung, vertragswidriges Verhalten abzustellen ohne Androhung arbeitsrechtlicher Schritte – Kündigung – im Wiederholungsfalle)
* Abmahnung (schriftliche Aufforderung, vertragswidriges Verhalten abzustellen mit Androhung arbeitsrechtlicher Schritte bis zu Kündigung im Wiederholungsfalle)
Sowohl eine Ermahnung als auch eine Abmahnung können zur Personalakte genommen werden.
* ggf. Versetzung
* bezahlte Freistellung von der Arbeit (jedoch keine unbezahlte Suspendierung). Die bezahlte Freistellung – ggf. unter Anrechnung der verbleibenden Urlaubsansprüche und ggf. anderweitigen Verdienstes - ist in der Regel für die Zeit vom Ausspruch der Kündigung bis zum Auslaufen der Kündigungsfrist vorgesehen.
Darüber hinaus ist es möglich, im Rahmen einer Betriebsvereinbarung (zwischen Arbeitgeber und Betriebsrat) eine Betriebsbußenordung zu vereinbaren. Mit dieser wird regelmäßig ein Verstoß des Arbeitnehmers gegen die kollektive betriebliche Ordnung geahndet. Nach der Rechtsprechung muß in der Betriebsordnung ein entsprechender, abgestufter Strafkatalog aufgestellt sein. Ein solcher beginnt mit Sanktionen wie Rüge, Versetzung, Gehaltskürzung oder einer echten Geldbuße im Sinne von Strafe.
Dementsprechend ist folgende Regelung möglich:
„5.02 Discipline
Jede Vertragsverletzung und jeder Verstoß gegen eine Verhaltensanordnung oder gegen die betriebliche Ordnung kann disziplinarisch geahndet werden. Als Disziplinarmaßnahmen kommen in Betracht Ermahnung, Abmahnung, Versetzung, Ausschluss von Sonderleistungen, Arbeitsfreistellung bis hin zur Kündigung des Arbeitsverhältnisses. Der Arbeitgeber hat das Recht, unter Beachtung des ultima-ratio-Prinzips für jeden Verstoß die ihm geeignete Maßnahme zu wählen.

Over and above this it is possible to agree on a company system of punitive measures within the framework of a company agreement (between employer and works council). The system will be used regularly to punish offences by the employee against the collective company rules and regulations. Following adjudication, a corresponding graded catalogue of punitive measures has to be entered into the company rules and regulations. This will begin with sanctions such as warnings, transfers, reduction in salary or an actual monetary fine as a punitive measure.
Thus the following rule is possible:

Delivery times

XXXX.Ltd ist verpflichtet, als Sportwettunternehmen alle nach dieser Vereinbarung eingehenden Wettanträge entsprechend den eigenen Quoten zu bearbeiten und ohne Verzug die auf die Wettkunden entfallenden Gewinne zur Auszahlung zu bringen. XXXX.Ltd bietet täglich verschiedene Sportereignisse als Wetten an. Diese Sportereignisse sucht XXXX.Ltd aus. Einen Anspruch auf die Auswahl bestimmter Ereignisse hat der Vermittler nicht.
2. Ablehnung von Wettanträgen
XXXX.Ltd hat das Recht, Wettanträge nicht anzunehmen, ohne dass es dafür einer Begründung bedarf. Dazu sperrt XXXX.Ltd einzelne Wettmöglichkeiten bzw. begrenzt oder limitiert den hierauf gerichteten Gesamteinsatz. In diesem Fall entstehen keine Schadensersatzansprüche seitens des Wettvermittlers.
3. Ein- und Auszahlungslimits
Ein- und Auszahlungslimits sind der beiliegenden Anlage zu entnehmen. Die Aus- zahlungslimits sind den Kunden gegenüber deutlich sichtbar zu machen. Der Wett- vermittler kann lediglich Wetten der Kunden innerhalb der Einzahlungslimits vermitteln.
Wetten, die über diese Limits in den Rechner von XXXX.Ltd eingehen, gelten trotz einer eventuellen datentechnischen Empfangsbestätigung nur in Höhe des Limits als abgeschlossen. § 2 Rights and duties of the company XXXX.Ltd
1. Processing the betting applications
XXXX.Ltd as a sports betting operator is obliged to process all betting applications received in accordance with this agreement in line with their own odds and to pay out any wins due to the customers without delay. XXXX.Ltd will offer different sporting events as betting options on a daily basis. These sporting events are selected by XXXX.Ltd. The broker has no right to select particular events.
2. Rejection of betting applications
XXXX.Ltd has the right to not accept betting applications without having to declare a reason for doing so. XXXX.Ltd will block certain betting options completely or will limit the total stake that can be placed or them. In this case the broker will not be entitled to any claims for damages.
3. Paying-in and out limits
Paying-in and out limits can be found in the enclosed appendix. The limit on sums paid out is to be displayed clearly for customers to see. The broker can only broker customers’ bets within the paying-in limit.
Any bets exceeding this limit being received by XXXX.Ltd's computers will only be valid up to the limit despite any possible electronic receipts. XXXX.Ltd reserves the right to change these limits. These changes are to be communicated clearly to the customers.
