3. METODA URMATĂ ÎN ANALIZA PIEŢEI
3.1 Introducere
55. În acest capitol sunt prezentate pe larg principiile şi metoda adoptată de Colegiu în definirea pieţelor relevante, în stabilirea coordonatei AMM* şi în impunerea unor constrângeri în sens general,30 recurgându-se în acest scop la o serie de concepte şi noţiuni preluate din legislaţia asupra concurenţei.
3.2 Definirea pieţelor relevante specifice
56. În definirea pieţelor relevante specifice, Colegiul va ţine cont de recomandările şi liniile directoare precizate de Comisia Europeană, prezentate succint în capitolul 2.
57. O piată relevantă specifică comportă două dimensiuni: cea a sferei de producţie şi cea a ariei geografice. În stabilirea unei pieţe de producţie relevante se vor examina produsele şi serviciile concurenţiale care fac parte astfel din acelaşi sector de producţie relevant. În stabilirea unui sector geografic relevant se va analiza zona geografică în cadrul căreia coexistă în regim concurenţial diverşii producători şi ofertanţi de servicii.
58. O piată de producţie relevantă cuprinde toate produsele sau serviciile reciproc substituibile, parţial sau total, atât prin caracteristicile lor obiective (cum sunt preţul şi aplicabilitatea scontată), prin care pot satisface cererea constantă a consumatorului, cât şi prin condiţiile concurenţiale şi/sau pe baza relaţiei dintre cerere şi ofertă existente pe piaţa respectivă. Produsele care nu sunt substituibile reciproc decât într-un grad redus sau destul de redus nu aparţin aceleiaşi pieţe.31
59. O piaţă geografică relevantă coincide cu aria geografică în interiorul căreia firmele dintr-un anumit sector de activitate joacă un rol semnificativ în relaţia cerere-ofertă privind produsele şi serviciile oferite şi în interiorul căreia funcţionează legi concurenţiale similare sau destul de omogene. De asemenea, o piaţă geografică relevantă se poate delimita net de zonele comerciale limitrofe prin anumite condiţii concurenţiale clare ce-i sunt specifice.32
60. Graniţele unei pieţe relevante sunt determinate de ponderea presiunii concurenţiale exercitate în stabilirea preţului de către producători sau de către ofertanţii de servicii. În identificarea pieţelor relevante trebuie analizate două surse importante de presiune concurenţială : i) substituţia în privinţa cererii şi ii) substituţia în privinţa ofertei. 3. METHOD USED FOR MARKET ANALYSIS
3.1 Introduction
55. In this chapter the principles and the method adopted by the College in defining the relevant markets, determining the AMM* coordinate and generally imposing certain restrictions30 are comprehensively presented using a variety of concepts and notions taken form the legislation regarding the fair competition.
3.2 Defining the specific relevant markets
56. When defining the specific relevant markets the College will take into consideration the recommendations and directives of the European Commission presented briefly in chapter 2.
57. A specific relevant market displays two dimensions: the production sphere and the geographic area. When defining a relevant production market the competition products and services belonging to the same relevant production sector will be examined. The geographical area in which various manufacturers and service suppliers coexist within a competition based system will be analyzed when it comes to defining a relevant geographic sector.
58. A relevant production market contains all the partially or totally interchangeable products or services, due to both their objective features (such as the price and the expected applicability) with which the constant demand of the consumer can be satisfied as well as the competition conditions and / or conditions based on the relation between the existing demand and supply on the market in question. Products which are interchangeable only to a small or almost inexistent extent do not belong to the same market31.
59. A relevant geographical market is the same as the geographic area within which the companies activating in a certain sector play an important role in the supply - demand relationship with regard to the products and services offered and within which similar or quite homogenous competition laws are at work. A relevant geographical market can also be distinctly limited from the neighboring commercial areas by certain clear and intrinsic competition conditions32.
60. The boundaries of a relevant market are determined by the relevance of the competition pressure exerted when the manufacturers or service suppliers set the prices. Two main competition pressure sources must be analyzed when identifying the relevant markets: i) demand substitution and ii) supply substitution. The third competition pressure source is the potential competition. |

In 2005 I received the licence from the Romanian Ministry of Justice which allows me to translate from/into English, German and Romanian, after which I moved to Rome, Italy where I did a lot of interpreting for English speaking and German tourists, this time in Italian.
In February 2007 I went back to Bucharest and continued my cooperation with ATIS Pro Translation. Some of the renowned institutions and organizations for which I translated and/or interpreted while working for this company include Citigroup, the Romanian Chamber of Commerce, Porsche, ING, etc.
In 2007 after I came to London for my MA at King’s College, I started doing translations for London-based translation services companies such as Bilingual People Ltd., Translate GB Ltd. or ITR International Translation Resources Ltd. |
