CODE DE BONNE CONDUITE DES PARTIS POLITIQUES, DES GROUPEMENTS, FORCES POLITIQUES ET DES CANDIDATS AUX ELECTIONS EN COTE D’IVOIRE
PREAMBULE
Nous, Partis politiques, Groupements, Forces politiques, et Candidats aux élections en Côte d’Ivoire, désignés dans ce Code sous le titre de « signataires »
•Considérant l’impérieuse nécessité d’oeuvrer à une sortie de crise rapide pour une paix durable ;
•Souscrivant sans réserve aux lois et règlements qui encadrent les élections en Côte d’Ivoire ainsi qu’aux standards internationaux en matière électorale;
•Souscrivant aux Accords Politiques entre Acteurs Ivoiriens et aux Résolutions internationales tendant au règlement de la crise Ivoirienne ;
•Souscrivant aux valeurs et fondements d’une compétition électorale démocratique: libre, transparente et ouverte à tous ;
•Soucieux de la stabilité et de l’intégrité de la Côte d’Ivoire,
CONVENONS DES PRINCIPES ENONCES CI-APRES:
Article 1
Les signataires s’engagent à soutenir la tenue d’élections démocratiques, libres, ouvertes et transparentes organisées par la Commission Electorale Indépendante (CEI). Ils s’engagent à respecter le verdict des urnes. Ils s’engagent également à n’utiliser que la procédure judiciaire prévue par les lois pour contester éventuellement les résultats des élections.
Article 2
Les signataires reconnaissent à tous les électeurs la possibilité d’exercer leur droit de vote et de participer librement et sans contrainte à toutes les activités du processus électoral dans le respect des lois et règlements, de l’ordre public et des bonnes moeurs.
Article 3
Les signataires s’engagent à respecter les droits et la liberté de tous les
citoyens, des Partis politiques, des groupements et forces politiques, des
candidats :
•de circuler partout où seront organisées les élections objet du présent code ;
•de faire campagne en toute sécurité ;
•de faire connaître leurs idées politiques et leurs principes sans entrave, et préjudice de leur intégrité, morale, physique et de leurs biens ;
•d’avoir un égal accès aux médias publics conformément aux dispositions légales et réglementaires.
Article 4
Les signataires s’interdisent d’utiliser la violence sous toutes ses formes et s’engagent à:
•faire preuve de retenue dans les discours, écrits, attitudes, comportements, et à respecter les opinions d’autrui ;
•lutter contre la violence, l’intimidation, le vandalisme, les voies de fait, le désordre public.
Article 5
Les signataires rejettent le recours aux manoeuvres dolosives, à tous les
moyens visant à empêcher l’électeur d’opérer un choix éclairé et indépendant, à l’achat des consciences, à toute autre opération pouvant pervertir l’intégrité, la qualité ou la transparence du processus électoral.
Article 6
Les signataires s’interdisent et s’engagent à interdire à leurs militants, partisans et sympathisants toute attitude, tout comportement, tout propos de nature à porter atteinte à la sécurité, à la dignité, à la vie privée, à l’intégrité physique et morale de toutes personnes, ainsi qu’aux biens publics et privés.
Article 7
Les signataires s’interdisent et s’engagent :
•à interdire à leurs militants, partisans et sympathisants d’empêcher la distribution des prospectus et des dépliants de même que la pose d’affiches des autres partis ou candidats ;
•de barbouiller ou détruire les affiches des autres partis ou candidats.
Article 8
Les signataires s’interdisent et s’engagent à interdire à leurs militants, partisans et sympathisants toute attitude, tout comportement, tout propos de nature à porter atteinte à la sécurité et à la protection des journalistes commis par les organes de presse pour la couverture des différentes manifestations ainsi qu’à celle de tout observateur national ou international.
Article 9
Les signataires s’interdisent d’utiliser des moyens de l’Etat, des collectivités territoriales ou des autres démembrements de l’Etat à des fins de campagne électorale ou de propagande politique ou à l’occasion de manifestations politiques durant la campagne électorale, à compter de l’enrôlement des électeurs.
Article 10
Les signataires s’interdisent de faire de la race, de l’ethnie, le genre, la religion et de la vie privée des thèmes de campagne. Ils sont disposés à encourager toute dynamique susceptible de maintenir la cohésion sociale et de préserver la paix.
Article 11
Les signataires s’engagent à recourir au dialogue, tous autres moyens
pacifiques et légaux dans le règlement de leurs différends. Ils s’interdisent d’entretenir et de financer des milices, des groupes d’autodéfense ou des groupes paramilitaires. Ils s’engagent par ailleurs à ne pas manipuler ou instrumentaliser toute force armée.
Article 12
Les signataires s’engagent à oeuvrer au bon déroulement du processus électoral et rejettent toute initiative visant à le perturber ou à le bloquer.
Ils conviennent de consulter régulièrement la Commission Electorale
Indépendante sur tous les sujets liés au processus électoral.
Ils s’engagent à entreprendre tous les efforts pour entretenir la communication entre eux et participer aux consultations organisées par la Commission Electorale Indépendante.
Article 13
Les signataires s’engagent à ne pas diffuser de résultats avant la proclamation officielle par la Commission Electorale Indépendante.
Article 14
Les signataires conviennent de saisir la Commission Electorale Indépendante de toutes difficultés liées au processus électoral et de tout manquement au présent code. La Commission Electorale Indépendante prend toutes les mesures adéquates pour en faciliter le bon déroulement.
Article 15
Pour tout manquement au présent Code, le Parti politique, le Groupement politique, la Force politique ou le candidat en cause encourt le rappel à l’ordre ou le blâme public prononcé par la Commission Electorale Indépendante.
Article 16
Les signataires s’engagent à appliquer de bonne foi le présent Code de Bonne Conduite et reconnaissent que les élections sont le seul moyen pour un Parti politique, un Groupement politique, une Force politique ou un candidat de conquérir le pouvoir et pour tout électeur d’exprimer son choix.
Article 17
Les signataires s’engagent à compétir dans un esprit de fraternité, de loyauté, à faire preuve de « fair play », à oeuvrer au maintien de la paix et à la préservation de l’unité nationale et la cohésion sociale.
Article 18
Le présent Code de Bonne Conduite entre en vigueur dès sa signature. Tout Parti, Groupement et Force politiques et tout candidat n’ayant pas adhéré à celui-ci lors de son entrée en vigueur, pourra le faire auprès de la Commission Electorale Indépendante.
La Commission Electorale Indépendante rendra publique toute nouvelle
adhésion et en informera les signataires.
Article 19
Les signataires du présent Code de bonne conduite s’engagent à en assurer la diffusion et la promotion sur l’ensemble du territoire national.
Article 20
Les signataires donnent mandat à la Commission Electorale Indépendante de veiller à la stricte application du présent code et de prendre, le cas échéant, les mesures adéquates.

CODE OF CONDUCT FOR POLITICAL PARTIES, POLITICAL GROUPS AND FORCES, AND CANDIDATES PARTICIPATING IN ELECTIONS IN COTE D’IVOIRE
PREAMBLE
We, the Political Parties, Political Groups and Forces, and Candidates participating in elections in Côte d’Ivoire, referred to in this Code as “signatories”
•Taking into account the pressing need to work toward an immediate crisis resolution for the sake of a sustainable peace;
•Subscribing without reserve to the laws and regulations controlling elections in Côte d’Ivoire, as well as to international standards regarding elections;
•Subscribing to the Political Agreements between Ivorian Actors and to the International Resolutions seeking to resolve the Ivorian crisis;
•Subscribing to the values and foundations of democratic electoral competition: free, transparent and open to all;
•Concerned for the stability and integrity of Côte d’Ivoire,
AGREE TO THE PRINCIPLES HEREINAFTER STATED:
Article 1
The signatories agree to support the holding of democratic, free, open, and transparent elections organized by the Independent Electoral Commission (CEI). They agree to respect the poll verdict. They likewise agree to use only the judicial procedures provided for by the law to contest, if necessary, the election results.
Article 2
The signatories recognize the opportunity of all voters to exercise their right to vote and to participate freely and without restraint in allactivities related to the electoral process within the bounds of laws and regulations, public order and good conduct.
Article 3
The signatories agree to respect the rights and freedom of all citizens, Political Parties, political groups and forces, and candidates:
•to move freely wherever the elections subject to this code are organized;
•to campaign with complete safety;
•to make known their political ideas and principles without restriction, or harm to their integrity, morals, person, or property;
•to have equal access to public media in accordance with legal and regulatory measures.
Article 4
The signatories agree to abstain from the use of violence of any kind and agree to:
•show restraint in speech, writing, attitude, behavior, and to respect the opinions of others;
•combat violence, intimidation, vandalism, assault and battery, and public disorder.
Article 5
The signatories reject the recourse to malicious tactics, to any attempt to prevent voters from making enlightened and independent choices, to vote buying, to any other strategies which could corrupt the integrity, the quality or the transparency of the electoral process.
Article 6
The signatories agree to abstain from any attitudes, behaviors, remarks likely to threaten the safety, dignity, privacy, moral and physical integrity of any person, as well as public and private property, and agree to forbid the same of their advocates, supporters and sympathizers.
Article 7
The signatories agree to abstain from:
•the prevention of flyer or leaflet distribution or the hanging of posters by other parties or candidates;
•the defacement or destruction of the posters of other parties and candidates, and agree to forbid the same of their advocates, supporters and sympathizers.
Article 8
The signatories agree to abstain from attitudes, behaviors, remarks likely to threaten the safety and protection of journalists assigned by press agencies to cover various events, as well as that of any domestic or international observer, and agree to forbid the same of their advocates, supporters and sympathizers.
Article 9
The signatories agree to abstain from the use of resources of the State, territorial collectivities, or other divisions of the State for the purpose of electoral campaigns or political propaganda or for the sake of political events during the electoral campaign, to take effect from the registration of voters.
Article 10
The signatories agree to abstain from the use of race, ethnicity, gender, religion or personal life as campaign issues. They are willing to encourage dynamics likely to uphold social cohesion and preserve peace.
Article 11
The signatories agree to resort to dialogue, and to any other peaceful and legal means to resolve their differences. They agree to abstain from the maintenance or financing of militias, of self-defense groups or of paramilitary groups. In addition, they agree not to manipulate or use any armed forces.
Article 12
The signatories agree to work for the success of the electoral process and to reject any initiative aimed to disrupt or impede it.
They commit to regularly consult the Independent Electoral Commission on any issue related to the electoral process.
They agree to undertake any efforts necessary to maintain communication between themselves and to participate in consultations organized by the Independent Electoral Commission.
Article 13
The signatories agree not to circulate any results before the official announcement by the Independent Electoral Commission.
Article 14
The signatories agree to refer any difficulties related to the electoral process and any breach of this code to the Independent Electoral Commission. The Independent Electoral Commission will take all appropriate measures to facilitate the success of both.
Article 15
For any breach of this code, the Political Party, Political Group, Political Force or candidate in question will incur a public call to order or reprimand delivered by the Independent Electoral Commission.
Article 16
The signatories agree to implement this Code of Conduct in good faith and to recognize that elections are the sole means by which a Political Party, a Political Group, a Political Force or a candidate may gain power, and by which any voter may express his/her choice.
Article 17
The signatories agree to compete in a spirit of fraternity, of loyalty, to demonstrate fair play, to work to maintain peace and to preserve national unity and social cohesion.
Article 18
This Code of Conduct will enter into force upon signing. Any Party, Political Group or Force or candidate not having acceded to the Code at the time of its entry into force, may do so through the Independent Electoral Commission.
The Independent Electoral Commission will make public any new accessions and will inform the signatories of such.
Article 19
The signatories of this Code of Conduct agree to ensure its dissemination and promotion throughout the entire national territory.
Article 20
The signatories delegate authority to the Independent Electoral Commission to oversee the strict enforcement of this code and, if the need arises, to take appropriate measures.
