It is no secret that today everyone who works in the global movie industry is anxious, above all, because of the economic crisis. The major studios are frantically checking the market prices of their shares on the stock exchanges, independent producers are cutting their budgets, distributors and buyers are being forced to lower their prices and to review their contracts, and television channels are re-arranging their broadcasting networks. Although similar market processes are happening in almost all countries, the economy of each territory as a separate unit has its own specific features; this applies to Russia too. To help you make sense of what is happening in our country in these turbulent times, the SPECIAL PROJECT in this issue is devoted to the Russian movie industry. 1. EKONOMI
Den offentliga sektorns finanser
Den offentliga sektorns finansiella sparande redovisas från och med i vårpropositionen exklusive premiepensionssparandet (PPS). Enligt beslut av Eurostat ska PPS i stället ingå i hushållens sparande. Omläggningen minskar det offentliga sparandet med 1 procent av BNP. Med anledning av beslutet föreslår regeringen att överskottsmålet ändras till 1 procent av BNP över en konjunkturcykel. För att stärka det finanspolitiska ramverket föreslår regeringen i vårpropositionen ett antal ytterligare åtgärder, bl.a. en återgång till treåriga utgiftstak.
Den offentliga sektorns finansiella sparande exklusive PPS uppgick 2006 till 60 miljarder kronor, eller 2,1 procent av BNP (3,1 procent inklusive PPS). Vid utgången av 2006 översteg de finansiella tillgångarna skulderna med 444 miljarder kronor eller 15,6 procent av BNP. Den konsoliderade bruttoskulden uppgick till 46,9 procent av BNP, vilket med god marginal understiger referensvärdet inom EU på 60 procent.
2. Miljö och ekonomi
Dyr sanering av förorenade områden och få räddade liv
Konjunkturinstitutet har i samarbete med arbets- och miljömedicin på Sahlgrenska Universitetssjukhuset analyserat kostnader och effekter av att sanera arsenikföreorenade områden i Sverige. Analysen visar att saneringen bara ger små hälsoeffekter till en hög kostnad; 0,1 liv räddas till en kostnad om 881 miljoner kronor. Kostnaden per sparat liv överstiger många gånger värdet av ett statistiskt liv som används inom trafiksektorn. Resultaten visar ett behov av bättre prioriteringar inom saneringsarbetet i syfte att förebygga miljörelaterade hälsorisker.
Konjunkturinstitutets analys visar att saneringen av de 23 arsenikförorenade områdena som mest sparar 0,03 liv per område. Totalt sparas 0,1 liv till en kostnad på 881 miljoner kronor. Kostnaden per sparat liv varierar mellan 287 miljoner kronor och 1 835 miljarder kronor. För området Konsterud i Kristinehamn är kostnaden per sparat liv lägst och för Svartvik i Sundsvall är kostnaden högst (se tabellen). Kostnaderna per sparat liv överstiger alltså vida värdet av ett statistiskt liv på 21 miljoner kronor som används inom trafiksektorn för att prioritera mellan olika åtgärder.
3. Miljö
Analysen visar också att 72 procent av hälsoeffekterna åstadkoms på tre områden, vilka har sSamhällsekonomiskt effektiv energieffektivisering
Det här projektet syftar till att sammanfatta kunskapsläget om samhällsekonomiskt effektiv energieffektivisering. Syftet kan motiveras med aktualiseringen av klimatfrågan och de höga energipriser som världen beskådat under de senaste åren. Denna samhällsutveckling har fört energieffektivisering högt upp på den politiska agendan i både Sverige och EU. En kostnadseffektiv strategi för att energieffektivisera Sverige kommer att påverka alla sektorer i samhället. Därför är det viktigt att belysa energieffektivisering ur ett samhällsekonomiskt perspektiv. Studien fokuserar främst på "energiparadoxen", dvs. att individer och företag inte genomför en stor del av de energieffektiviseringsåtgärder som är lönsamma för dem, och "återtagningseffekten", dvs. att energieffektivisering på sikt kan leda till en ökad energiefterfrågan. Dessa fenomen är extra intressanta eftersom de berör nödvändigheten, utformningen och effekten av statliga marknadsinterventioner. Dessutom diskuteras de flitigt i litteraturen, så väl internationellt som tvärvetenskapligt.
4. JURIDIK
Sammanfattning: Bakgrunden till målet var i korthet följande. I sin självdeklaration för 1995 års taxering yrkade klaganden avdrag för vad som uppgavs vara skuldräntor för lån upptagna med anledning av en större aktieaffär. Han underrättades i maj 1996 om att skattemyndigheten var av uppfattningen att den påstådda affären saknade verklighetsunderlag och att man därför övervägde att vägra det yrkade avdraget samt påföra skattetillägg. Skattemyndigheten fattade i september 1996 beslut i enlighet med underrättelsen. Klaganden överklagade beslutet. Sedan skattemyndigheten den 30 april 1997 beslutat att inte ändra sitt beslut avslog länsrätten överklagandet i dom den 29 maj 2000. I dom den 15 april 2002 fastställde kammarrätten länsrättens dom. Regeringsrätten beslutade den 11 september 2003 att inte meddela prövningstillstånd. Skatteprocessen tog totalt cirka sju år och tre månader.
I november 2003 väckte klaganden skadeståndstalan mot staten varvid han, under åberopande bl.a. av att handläggningen av skattemålet tagit för lång tid, gjorde gällande att staten genom fel och försummelse vållat honom såväl ekonomisk som ideell skada. Staten, genom Justitiekanslern, bestred klagomålet. I dom den 21 december 2004 lämnade tingsrätten käromålet utan bifall. Domen fastställdes av hovrätten den 2 november 2005. Klaganden överklagade men vid tiden för Europadomstolens prövning hade Högsta domstolen ännu inte meddelat beslut i frågan om prövningstillstånd.

Sammanfattning av uppdraget
En särskild utredare ska se över nuvarande resurser för utvärde-ring inom utbildningsområdet.
Uppdraget består av två delar, policyinriktad utvärdering och forskning med relevans för skolans måluppfyllelse och peda-gogiskt verksamma.
Policyinriktad utvärdering

ta ställning till om resurser för policyinriktad utvärdering bör kvarstå i den befintliga myndighetsstrukturen eller samlas och inordnas i en särskild myndighet.
Om utredaren bedömer att en ny myndighet bör bildas, ska utredaren föreslå hur uppgifter, ansvar och organisation närmare ska utformas samt redovisa myndighetens resursbehov.
7. Bistånd
Krav på utfasning av ekonomiska policyvillkor
Över 600 representanter för civila samhället fanns också på plats i …., och de höll sin egen konferens före det officiella högnivåmötet. Ett av de starkaste kraven från civila samhället gällde frågan kring mottagarländernas ägarskap över sin egen utveckling. Folkrörelser menar att de villkor som givarna ställer måste garantera att demokrati och mänskliga rättigheter respekteras i mottagarländerna. Idag ställs istället detaljerade villkor om den ekonomiska politiken, och sådana villkor underminerar ett genuint ägarskap hos utvecklingsländerna. I ….. drev representanterna för civila samhället på för att mötet skulle anta konkreta åtaganden om att fasa ut ekonomiska policyvillkor. Frågan kring ägarskap och villkor i biståndet har också drivits av utvecklingsländer i processen inför ….-mötet. Ett av u-ländernas krav var att policyvillkor inom biståndet måste minskas och att detta måste påbörjas omgående.
Konkreta åtaganden saknas
Folkrörelserna var överens om att resultatet från …. är ett steg i rätt riktning mot ett bistånd som verkligen når de fattigaste. Men de saknar mer konkreta åtaganden och tidsramar i det slutliga handlingsprogrammet, framför allt saknar man tydliga formuleringar kring utfasning av policyvillkor inom biståndet.
Bistånd kan ge mycket bra resultat. i alla fall på projektnivå, t ex för befolkningen i en viss by, eller inom en viss sektor, t ex att minska vissa sjukdomar genom vaccination eller bidra till att en större andel barn lär sig läsa och skriva. Detta har ganska länge varit allmänt accepterat i debatten. En djupt omdiskuterad fråga är däremot om bistånd också bidrar till att öka den ekonomiska tillväxten i ett land eller inte. Många har fört fram motsatsen, att biståndets effekter försvinner på makronivå.

1. THE ECONOMY
Public finances
With effect from the Spring Fiscal Policy Bill, general government net lending will be shown excluding premium pension savings (PPS), in compliance with a Eurostat decision to that effect, and will be included instead in household savings, a change that will reduce general government net lending by one per cent of GNP. In the light of this decision, the government proposes that the surplus target be amended to one per cent of GNP during a business cycle. The government also proposes a number of additional measures in the Spring Fiscal Policy Bill, including a return to three-year expenditure ceilings, as a means of strengthening fiscal policy framework.
General government net lending in 2006, excluding PPS, totalled SEK 60 billion or 2.1 per cent of GNP, (3.1 per cent including PPS), and by the end of that year, financial assets exceeded liabilities by SEK 444 billion or 15.6 per cent of GNP. The consolidated gross debt was equivalent to 46.9 per cent of GNP and thus comfortably below the EU reference level of sixty per cent.

Pressmeddelandet finns i en något stelbent engelsk översättning, men jag har försökt att skriva en ledigare version med en meningsuppbyggnad som undviker den ryckighet som präglar många svenska texter på grund av att meningarna är alldeles för korta samt saknar bisatser och infogade satser; samtliga dessa stilistiska medel används regelbundet som en självklarhet av infödda talare. Så sent som under 1940-talet, det svenska språket skrevs på samma sätt som det engelska språket fortfarande görs. Detta framgår tydligt när man läser svenska kvalitetstidningar från denna period.
2. The environment and the economy
Expensive cleanup of contaminated areas saves few lives
The National Institute of Economic Research and the Department of Occupational and Environmental Medicine at Sahlgrenska University Hospital have together analysed the costs and effects of cleaning up areas of Sweden contaminated by arsenic. Their analysis demonstrates that cleanup operations have only a minor impact on public health but come at a high cost, amounting to SEK 881 million for saving 0.1 of a life. Consequently, the cost per life saved exceeds many times over the value of a statistical life, as applied within the traffic sector. These results illustrate a need to improve the allocation of priorities in cleanup operations with the aim of forestalling environmentally determined health hazards.
This analysis shows that the cleanup of the twenty-three areas contaminated by arsenic achieved a maximum saving of 0.03 of a life per area. A total of 0.1 of a life was saved at a cost of SEK 881 million, while the cost per life saved thus varies between SEK 287 million and SEK 1,835 billion. This cost was lowest in Konsterud in the city of Kristinehamn and highest in Svartvik in the city of Sundsvall (please refer to the table). Hence, the cost per life saved greatly exceeds the value of SEK 21 million for a statistical life that is applied within the traffic sector to determine the priority of different measures.

3. Enviroment
The analysis shows that seventy-two per cent of the effects on public health were achieved in three areas, where measure are in place that aim at greater energy efficiency in general economic terms.
The objective of this project is to summarise the state of our knowledge with regard to measures to achieve greater energy efficiency in general economic terms. This aim can be motivated by the current focus on the issue of climate change and the high energy prices that the world has experienced in recent years. This trend has pushed the issue of greater energy efficiency further up the political agenda in Sweden and all other EU member states. A cost-efficient strategy for greater energy efficiency in Sweden will affect all sectors of society; this makes it important that energy efficiency is discussed in a general economic context. This study focuses primarily on what is termed the energy paradox, that is to say, that individuals and companies fail to implement a large proportion of those greater energy efficiency measures that it would be profitable for them to adopt. It also considers what is termed the "rebound effect", i.e. the notion that such measures would result in a greater demand for energy in the long term. These phenomena are of particular interest as they touch on both the need for governmental market interventions and the latter's design and effects, and, moreover, are frequently the topic of discussions in international and inter-disciplinary literature.
4. LAW
Summary: The background to the case is briefly as follows. In his tax return for 1995, the plaintiff claimed an allowance for what he stated were interest payments on loans that he had taken in conjunction with a share transaction of some magnitude. He was notified in May 1996 that the Swedish Tax Agency was of the opinion that the alleged transaction had no basis in reality and that they were considering rejecting the allowance claim and applying a tax surcharge. In September 1996 a decision was taken in accordance with this notification against which the plaintive appealed. After the Agency notified him on 30 April 1997 that their decision would not be amended, the County Administrative Court rejected the plaintiff's appeal against its ruling of 29 May 2000. In its ruling of 15 April 2002 the Administrative Court of Appeal upheld the ruling by the County Administrative Court. On 11 September 2003 the Supreme Administrative Court decided not to grant him leave to appeal. This taxation lawsuit took around seven years and three months to resolve.
In November 2003, the plaintiff brought an action for damages against the Swedish State, in which, citing, inter alia, that the administration of this tax case had taken too long, he argued that errors and negligence on the part of the State had caused him both financial and non-pecuniary losses. The State, in the person of the Chancellor of Justice, rejected these claims and in a ruling of 21 December 2004 the District Court dismissed the case, and this ruling was upheld by the Appeals Court on 2 November 2005. The plaintiff appealed but by the time the case came before the European Court of Justice, the Supreme Court had still not announced its ruling on the question of leave to appeal.
5. Human rights
Considering the Universal Declaration of Human Rights adopted by the General Assembly of the United Nations on 10 December 1948;
Considering that this declaration aims at ensuring universal and effective recognition and observance of those rights stated therein;

Should the investigator find that a new authority ought to be created, he or she shall propose in greater detail the manner in which its duties, responsibilities and organization are to be laid down and also describe the resources that it will require.
7. Aid
Demand for the phasing out of economic policy conditionality.
More than six hundred representatives of civil society were also in attendance in ..., and held their own conference prior to the official high level forum. One of the most vocal demands from civil society related to the question of the recipient countries' ownership of their own development. The CSOs are of the opinion that the conditions made by the donors must guarantee that democracy and human rights will be respected in the recipient countries. At present, detailed conditions are made instead with regard to economic policy and such conditions undermine a genuine ownership by the developing countries. In ... the representatives of civil society urged the meeting to adopt concrete commitments to phasing out economic policy conditionality. The question of ownership and conditionality in the field of aid was also stressed by the developing countries in the proceedings prior to the meeting. One of their demands was that policy conditionality as a component of aid must diminish and that this should commence immediately.
Concrete commitments absent
The CSOs were agreed that the results of ... are a step in the right direction towards aid that actually reaches the most impoverished. However, they regret the absence of more concrete commitments and timetables in the final action programme and, above all, the lack of clear formulations relating to the phasing out of policy conditionality as a component of aid.
Aid can achieve very good results, in any case at project level. For example, for the population of a specific village, or within a specific sector, by reducing the incidence of certain illness through vaccination, or by contributing towards a greater proportion of children learning to read and write. This view has been generally accepted in public debate for some little while. By contrast, a highly controversial question is whether or not aid also contributes towards promoting a country's economic growth and there are many who have argued the opposite view that the effects of aid dissipate at the macro level.

Каменистый холм. На вершине холма огромная, почти черная каменая скала. Она изрыта странными углублениями, причудливыми гротами. По узкой, протоптанной к вершине тропинке бредет вереница женщин в темных, длинных до пят платьях. Лиц почти не видно. Они закутаны в платки. Достигнув скалы женщины замирают, молятся, целуют, трут ее руками. Холм издревле считается местом излечивающим женщин от бесплодия.
У подножия холма продают целебные амулеты, коренья, микстуры.
Шум, гам. Без конца подъезжают автомобили, скособоченные автобусы, повозки с впряженными осликами.
Улыбчивый, блуждающий по толпе взгляд водителя грузовика по имени ТИМУР застывает. Он замечает выделяющуюся среди всех пару. Молодая женщина с горделивой осанкой и тонкой статью в длинном бирюзовом платье, расшитом по кайме узорами и платке искрящимся серебрянными нитями словно плывет среди бесформенных статуй. Это ШИРИН. Ширин живет с мужем и свекровью в большом доме с просторным двором. Разноцветная пряжа, охапки подсушивающихся трав и цветов придают двору веселый яркий вид и уют. Ширин самая лучшая ковроткальщица в этих местах. Нет ярче и затейливее узоров, чем у нее. Вот только одна беда у нее. Никак не приходит к ней радость материнства.
БАГРАМ, ее муж, лысеющий мужчина лет тридцати пяти с заметным брюшком, обеспеченный бизнесмен с властолюбивым тщеславием. Он не прочь занять пост районного раиса (мэра). Но отсутствие у них с Ширин детей делает это невозможным. Потому как в глазах местного населения бездетный муж – это просто неполноценный человек. Баграм любит Ширин, но ее бесплодность приводит его иногда в бешенство.
Ширин не прочь усыновить РУСТИКА, мальчика-сироту нашедшего себе прибежище в автодворе среди водителей грузовиков. Баграм и слышать о нем не желает. Вдобавок, из ревности, он запрещает Ширин ходить туда.
Однажды в воротах раздается стук. За воротами стоит группа бродячих дервишей. Обветренные, почти черные лица, длинные волосы и бороды, запыленные одежды. Тимур никогда не видел своих погибших родителей. У него даже нет их фотографий. В горах он находит старика, который знал его родителей. Старик тяжело болен. Он рассказывает Тимуру, про поверье, что через глаза умирающего можно увидеть своих близких на том свете. И он обещает Тимуру перед своей смертью позвать его, чтобы он хоть на миг увидел своих родителей.
С Рустиком они становятся верными друзьями-компаньонами, а официантка Сабина без памяти влюбляется в него.
У подножия холма Тимур высматривает Ширин. А когда она появляется, внезапно начинается припадок у одного из обитаемых здесь цыган-попрошаек. Люди брезгливо обходят стороной лежащего в пыли человека. Лишь Ширин и Тимур стремглав несутся к нему на помощь. Тимур сражен красотой Ширин. Правила приличия не позволяют замужней Ширин познакомиться с Тимуром. Она уходит одарив его молчаливой улыбкой.
Неожиданно в один из знойных дней наступает гроза.
Ширин переодевается в ярко-красное платье с причудливыми узорами на рукавах, выбегает во двор. На глазах изумленной свекрови, она начинает петь, а тело ее извиваться в причудливых движениях. Гремит первый гром, сверкает молния во все небо.
В это время Баграм находится на консультации у врача. Он рекомендует новейшую методику искусственного оплодотворения.
Баграм узнав подробности процедуру приходит в ярость. Кричит, что она хороша для безродных американцев, но он даже представить себе не может, чтобы его сын был зачат в какой-то пробирке. Его еле успокаивают.
Вспышки молний озаряют дно пропасти с бушующей рекой.
Возле чернеющей каменой глыбы маленькая фигура Ширин.
Вдруг один за другим появляются дервиши. Ширин вместе с ними кружится в молчаливом танце дервишей.
Гроза стихает. Горизонт окрашивается в алый цвет.
Звонкое пение дроздов пробуждает Ширин лежащую на мокрой скале. Она озирается по сторонам, бросается к скалам в поисках бродячих дервишей. Но вокруг ни души.
Во дворе шушукаются соседи. Из дома доносится грохот переворачиваемой мебели, бьющейся посуды.
- Ой, позор...Какой позор...Всю ночь дома нет,- причитает свекровь
Кто-то с улицы кричит, что идет Ширин. Народ высыпает за ворота. Появляется Баграм, спрашивает ее где она была.
Ширин отвечает, что была у Святой скалы и танцевала с бродячими дервишами. По толпе проносится гул изумления.
Баграм ведет ее за руку на середину двора.
- Соседи! Призываю вас в свидетели! Я развожусь с этой женщиной! Я развожусь с этой женщиной! Я развожусь с этой женщиной! ( Сеталлак! Сеталлак! Сеталлак!) - троекратно объявляет он. По существующим в этих краях закону Ширин и Баграм больше не муж и жена. Она возвращается в родительский дом.
Однажды Ширин идет на базар купить для племяника школьный ранец. Торговки на базаре открыто выражают ей свое презрение, плюют вслед. Мужчины не стесняясь похотливо рассматривают ее. Ширин в смятении бежит с базара. Торговцы улюлюкают ей вслед.
На ее потемневшем от горя лице немой вопрос - за что?
Тимур еще раз случайно встречает Ширин у реки. Знакомства по-прежнему не происходит и он решает выкинуть ее из головы.
САИД друг Баграма пытается найти ему новую спутницу жизни. Но Баграм отвергает все кандидатуры. Он потерян, подавлен. Ничто не радует, не заводит его. Он понимает, что совершил большую ошибку с Ширин.
В самый разгар ячьих бегов он покидает их, отказывается знакомиться с самой завидной невестой района и неожиданно заявляет, что хочет вернуть Ширин назад.
Но сделать это теперь не так просто. Он бежит за помощью к сельскому мулле. Мулла объясняет, что вернуть ее можно. Он приводит строки из священного Корана.
И если муж с женой развелся
То в жены не дозволена она ему опять
Пока не выйдет замуж за другого
И тот не даст развода ей.
И добавляет, что в народе это называют обрядом халолы.
Баграм соглашается. Но этого мало. Требуется и согласие Ширин. А Ширин категорически не согласна.
Баграм с помощью Саида начинает осуществлять свой план.
Ковры Ширин больше не продаются, зерно на мельницу отца не завозится. Брата Ширин увольняют с работы. А у него беременная жена и двое детей. Баграм уверен, что не сегодня-завтра Ширин согласится.
Но в его плане сильнее тревожит другое. Где найти подходящего кандидата на роль «мужа на одну ночь». На кого из местных можно положиться в столь щекотливом деле? Лучше всего дело иметь с чужаком. Заплатить и гнать в три шеи отсюда.
И вдруг он вспоминает водителя Тимура. А что? Честный, порядочный, за свои слова в ответе и...чужак. Перекати-поле.
Баграм делает Тимуру предложение. Тимур отказывается. Баграм применяет свой испытанный метод. С этого дня у Тимура нет заказов, на трассе его отказываются заправлять бензином. Тимуру нечем выплачивать кредит за грузовик. Он чувствует, что ему наступает конец. И он соглашается.
Мать рассказывает Ширин, как страшна стала окружающая их жизнь. А для женщин главное пережить такие времена, сохранить традиции домашнего очага, приумножить потомство. А затем добавляет, что если Ширин захочет, то Баграм согласен усыновить мальчика с автодвора.
И она соглашается.
Обряд халолы решено проводить в доме муллы. На столах выставлено угощение. Играет музыка. В доме мулла заканчивает обряд бракосочетания (никох). Вечереет. Народ расходиться.
Тимура и невесту приводят в комнату украшенную коврами. Баграм берет с Тимура слово не прикасаться к невесте. Старухи-свидетельницы закрывают за ними дверь и располагаются в соседней комнате. В комнате для мужчин, положив рядом с собой ружье растягивается Баграм.
Тимур устало опрокидывается на кровать. Невеста скромно садится в углу. Тимур просит ее снять платок. Платок спадает с лица невесты. Тимур не верит своим глазам. Перед ним предстает та, кто грезилась ему во снах, кого он называл горной пери. Длинная ночь становится самой короткой в их жизни - так быстро наступает рассвет и так много остается недорассказанным. А руки находят друг друга и губы готовы слиться в раскаленном поцелуе. Но слово данное Баграму останавливает его. Ширин говорит ему, что этот грех она перенимает на себя.
Внезапно за окном начинается песчаная буря.
И под шум разбушевавшейся стихии, они сливаются друг с другом.
Тимур одевается, долгим взглядом окидывает спящую Ширин. Шепчет, чтоб она была счастливой и тихо закрывает за собой дверь. Старухи дружно спят. Вдруг одна открывает глаза и немигающим взглядом смотрит мимо него. Тимур оборачивается. В дверях стоит одетая Ширин. Он машет на всех рукой, негромко посылает всех к чертовой матери и уходит. Старуха снова погружается в сон.
Ширин молча сидит в кабине грузовика. Тимур говорит ей, что он дал слово Баграму поутру развестись с ней. Ширин смотрит ему в глаза. Отвечает, что ему еще не поздно. Стоит лишь выйти из машины и войти вон в ту дверь. А вот для себя она приняла решение. Быть вместе с Тимуром.
Шум взревевшего двигателя выводит Баграма из тревожного сна.
В доме переполох, ружейные выстрелы. Баграм вне себя.
Тимур останавливает грузовик возле дома старика. Он просит Ширин подождать его, а сам бежит в дом. Он объясняет старику, что встретил женщину равных которой нет на свете. Но оставаться с ней в этих краях невозможно и поэтому они уезжают. Присаживается перед стариком.
- Прости меня, что я в мыслях своих желал твоей смерти... А когда встретишься с ними, скажи им, что я люблю их. Очень люблю!
Тимур выбегает из дома старика. Возле грузовика его поджидает Баграм с друзьями.
- А как же наш договор? Отпускай Ширин,- говорит Баграм.
- А я ей не даю развода,- отвечает Тимур.
- Я покажу тебе, чья она,- кричит Баграм и кидается на Тимура.
Между ними завязывается драка. Они катаются в пыли, рычат друг на друга, как злобные волки.
Ширин в окно слышит и видит этот нелепый бой самцов. В ужасе она закрывает ладонями уши. Когда Тимур с Баграмом скатываются в реку, Ширин незаметно выходит из кабины и со слезами на глазах бежит прочь.
Тимур выкарабкивается на берег. Идет к машине. В кабине никого нет. Тимур замечает удаляющуюся вдали машину Баграма. Он запрыгивает в грузовик и мчится за ней.
Ширин проходит мимо автодвора. Останавливается, мгновение думает.
Ширин спрашивает Сабину, где можно найти Рустика. Сабина внимательно всматривается в Ширин.
- Так вот ты какая, подруга...- Она тащит ее на разборку в дымяшуюся от пара кухню. Остервенелая Сабина предлагает Ширин на выбор или глаза уксусом выжечь или кипятком лицо ошпарить. Ширин в ужасе не знает, что и ответить. Она простодушно отвечает. Что если ей от этого станет лучше, то пусть решает сама.
- А выпьешь со мной? - спрашивает ее Сабина. Ширин отвечает, что с удовольствием...Чаю.
Тимур влетает в поселок и на базарной площади настигает машину Баграма. Он сходу врезается в нее. Появляются зеваки. Из машин валит пар.
- Где она? – кричит Тимур.
- Кто? – спрашивает в свою очередь опешивший Баграм.
- Ширин!- отвечает Тимур.
Оба в недоумении. В этот момент к Баграму подходит Саид. Он держит за руку Рустика.
- Вот...нашли,- говорит он.
Саид спрашивает Баграма, что делать с Рустиком. Собакам скормить или может в детскую колонию отправить?
Тимур просит Саида отпустить Рустика по-хорошему. Саид вызывающе просит показать по-плохому. Тимур наклоняется, подымает камень и без слов запускает его прямо Саиду в лоб. Рустик вырывается из его рук и подбегает к Тимуру. Толпа словно парализована. Тимур берет Рустика за руку и они уходят.
Баграм первым приходит в себя. Он выхватывает из рук рядом стоящего свою винтовку. Говорит, что Тимура следует просто пристрелить, как бродячую собаку.
Тимур с Рустиком уходят под молчаливыми взглядами жителей городка. Баграм медленно подымает винтовку. Улица пустеет, ставни, двери в воротах резко захлопываются.
Внезапно раздается грохот выстрела. Пуля с визгом разносит ржавый почтовый ящик.
Тимур отталкивает Рустика в сторону и кричит, чтоб он бежал.
Гремит еще выстрел, взметая фонтанчик пыли. Улица наполняется грохотом выстрелов. Пули летят мимо Тимура, расщепляя заборы.
Неожиданно вновь подымается ветер-афганец и окутывает Тимура с Рустиком плотным пыльным покровом.
Баграм опускает ружье, затем разбивает его о стоящий рядом аттракцион-силомер, который издает веселую испанскую музыку.
Возле автодвора, ветер стихает так же неожиданно, как и начался. Из развеявшейся песчаной тьмы появляются бредущие вдоль обочины Тимур и Рустик.
- Твои пришли... Иди к ним,- говорит Сабина, подталкивая рукой Ширин.
Фигуры Тимура, Ширин и Рустика растворяются в горной дали.
- Счастливой дороги, - шепчет Сабина глядя им вслед.

At any parking area or roadside cafe that offers shelter along the Karakorum Highway, the highest mountain road in the world, this story is eagerly related. A tale that could happen only here, among those who for countless generations have lived their lives amidst the towering Pamir mountains.
A stony hill, and at its top an enormous, almost black, rock riddled with strange depressions and fantastical grottoes. Along the narrow, rutted path to the top, a line of women trudge in long, dark dresses that reach down to their heels. Their faces are wrapped in headscarves and almost invisible. Upon reaching the rock, the women stop dead in their tracks, pray, and then kiss and rub the ground. Since time immemorial, this place is believed to cure women of their barrenness.
At its foot, healing amulets, roots and medicines are on sale amidst a noisy uproar, while an unending stream of ramshackle buses and donkey carts draw up.
Timur, as this smiling truck driver is called, gazes out over the crowd, and his attention is suddenly caught by a couple who stand out from the rest. One is the slender figure of a young woman of proud bearing, in a long turquoise dress, embroidered with patterns along the border, and a headscarf sparkling with silver threads, who literally floats in a sea of shapeless statues. She is Shirin, and her companion is her husband's mother, an old woman completely swathed in black.
Timur tries to acquaint himself with her, but her mother-in-law chases him away.
Shirin lives with her husband and his mother in a large house within a spacious courtyard strewn with multi-colored yarns and armfuls of drying herbs and spices that give it a happy, bright and cozy air. Shirin is the best carpet weaver in these parts, and nobody can outdo her intricate, bright patterns. Her only sorrow is that she has yet to know the joys of motherhood.
Bagram, her husband, a balding man, aged thirty-five, with a noticeable paunch, is a well-to-do businessman, power-seeking and vain. He is not averse to holding the position of local rais* or headman but this is impossible as Shirin has no children. In the eyes of the local population a childless husband is simply a person of lower standing. Bagram loves Shirin but her barrenness sometimes drives him into a rage.
Shirin would be happy to adopt Rustik, an orphan boy who has found shelter at the depot, among the truck drivers, but Bagram refuses to even discuss this and, moreover, his jealousy drives him to forbid Shirin to go there.
One day, there is a knock at the gates, beyond which stands a group of wandering dervishes, with their weather-beaten, almost black faces, long hair and beards, and dusty clothes. Their bodies were festooned with strange amulets, necklaces and bracelets, and their eyes have a fixed and penetrating stare. Shirin runs to the oven, grabs some freshly baked flat cakes, adds some fresh fruit, and hands these to the weary wanderers.
One of them tells her she has no children and explains to an astonished Shirin that this is obvious; on her arms she wears charms to ward off barrenness, and her home does not resound to the sound of children's voices. At that moment, Bagram yells from the yard that they should take themselves off straight away, or he will set the dogs on them.
"We will help you. Remember! When the terrible thunderstorm comes, obey your heart, not your mind", says the dervish by way of farewell and hurries to join his companions.
Timur never knew his late parents and does not even have any photographs of them. In the mountains he finds an old man who knew them, and who is terribly ill. He tells Timur about the belief that you can see your loved ones in the next world, in the eyes of a dying man. He promises to summon Timur to his side before he dies, so that Timur may catch a glimpse of them.
He and Rustik are becoming true friends and companions, while the waitress Sabina is falling madly in love with Timur.
At the foot of the hill Timur tries to catch sight of Shirin, but as soon as she appears, one of the local gypsy beggars suddenly has a fit. People step round him in disgust as he lies there in the dust, and only Shirin and Timur rush over to help him. Timur is dumbfounded by her beauty, but the rules of propriety do not allow a married woman such as Shirin to speak to him. She departs, bestowing on him a secret smile.
One sultry day, a thunderstorm arrives unexpectedly. Shirin changes into a bright red dress with intricately patterned sleeves and runs out into the courtyard. In full view of her astonished mother-in-law, she starts to sing as her body undulates in elaborate movements. The first thunderclap sounds, and lightning flashes across the entire sky.
Meanwhile, Bagram is with his doctor, who recommends the latest method of artificial insemination. After the details of the procedure are explained to him, Bagram flies into a rage. He shouts that it may be all right for infertile Americans, but that he would never even consider allowing his son to be conceived in a test-tube, and it is only with some difficulty that he is pacified.
Flashes of lightning illuminate the bottom of the gorge through which the raging river flows. The diminutive figure of Shirin stands next to the black stone block. Suddenly, the dervishes appear one by one. Shirin joins them and spins round in their silent dance.
The storm abates, and a scarlet hue paints the horizon.
The trilling song of blackbirds awakens Shirin, who is lying on the damp rock. She peers around and runs toward the rocks to find the wandering dervishes, but not a soul is to be seen.
In the yard the neighbors are gossiping. The crash of overturned furniture and broken crockery resounds in the house.
"My God, the shame...the terrible shame...out all night", wails the mother-in-law.
Somebody in the street shouts that Shirin is coming and the crowd pours out through the gates. Bagram arrives and asks her where she has been. Shirin replies that she was at the Holy Rock dancing with the wandering dervishes. There is a mumble of amazement from the crowd. Bagram leads her by the hand into the center of the courtyard.
"Neighbors! I call upon you to be my witnesses! I divorce this woman! I divorce this woman! I divorce this woman!" (Se Talaq! Se Talaq! Se Talaq!), he declares three times. According to the law that applies in this region, Shirin and Bagram are no longer man and wife, and she returns to her parents' home.
One day, Shirin goes to the market to buy her nephew a school satchel. The women vendors openly display their contempt and spit after her, while the men are not ashamed to give her lewd looks. In confusion, she hurries away from the market while the vendors catcall after her. A mute question forms on her face clouded by grief. Why?
Once again Shirin encounters Timur by the river. As before she does not address him, and he decides to put her out of his mind.
Bagram's friend Said tries to find him a new life partner, but Bagram rejects all these prospective consorts. He is lost, crushed, and there is nothing that gladdens or motivates him. He realizes that that he made a great mistake with respect to Shirin.
At the yak races he walks out at the most exciting moment, refusing to introduce himself to the most eminently marriageable woman in the area. Suddenly, he declares that he wants to take Shirin back.
However, this is easier said than done. He dashes off to see the village mullah for help, who explains that this is possible, and quotes a verse from the Holy Koran:
And if a man divorce his wife
Then she is not lawful unto him again
Until she marries another man
And he divorce her.
This, he adds, is known among the common people as the halola rite. Bagram consents, but this is not enough as Shirin must also agree, and she most emphatically does not.
With the assistance of Said, Bagram starts to put his plan into action. Shirin's carpets are no longer on sale and grain is not delivered to her father's mill. Her brother, who has two children and a pregnant wife, loses his job. Bagram is convinced that any day soon, Shirin will give her consent.
However, one aspect of his plan is a greater worry. Where to find a suitable candidate for the role of "husband for a night"? Who among the locals can be relied on in such a delicate matter? An outsider would be the best choice; just pay him off and kick him out. He suddenly recalls Timur, the driver. Why not? Honest, decent, keeps his word and ... an outsider. A rolling stone. Bagram makes him an offer, but Timur refuses and Bagram then employs his well-proven method. From that day on, Timur has no more orders, and along the highway they refuse to serve him with gas. This leaves him without any money to pay off the loan on his truck. He feels that this will end badly and gives in.
Shirin's mother tells her how unbearable life around them has become, and that for women the most important thing is to survive such times, preserve the traditions of the family hearth and ensure offspring. She then states that if Shirin is agreeable, Bagram is prepared to adopt the boy from the depot.
And so she gives her consent.
The halola rite is to be performed in the mullah's house, where refreshments have been laid out on tables and musicians are playing, and it is concluded with the nikokh, the marriage ceremony. Night falls, and the guests depart.
Timur and his bride are led into a room decorated with carpets. Bagram gets Timur to give his word of honor that he will not touch her. The old women, who act as witnesses, shut the door behind them and settle down to sleep in the adjoining room. In the men's room, Bagram stretches out and places his rifle by his side.
Timur topples wearily onto the bed while the bride sits down modestly in a corner. Timur asks her to remove her headscarf, which falls from her face. He cannot believe his eyes. In front of him appears the figure he saw in his daydreams, whom he called the Nymph** of the Mountains. The long night becomes the briefest one of their lives; dawn arrives so swiftly and yet so much remains unsaid. Their hands find each other and their lips are ready to meet in a burning kiss, when Timur remembers his promise to Bagram and desists, but Shirin tells him that she will take this sin upon herself.
Suddenly, a dust storm blows up outside the window. And to the sound of the raging elements, they become one flesh.
Timur dresses and takes a long look at the sleeping Shirin. He whispers to her to be happy and quietly closes the door after him. The old women are sleeping harmoniously. All of a sudden, one of them opens her eyes and looks past him with an unblinking gaze. Timur turns around. Already dressed, Shirin stands in the doorway. He waves to them all, quietly cursing them under his breath and leaves. The old woman is fast asleep again.
Shirin sits silently in the cab of his truck. Timur tells her that he gave Bagram his word that he would divorce her in the morning. Shirin looks him in the eye and replies that he still has time to do so. All he has to do is to get out and go through the door over there. As for herself, she has made up her mind to remain with Timur.
The noise of a roaring engine awakens Bagram from a troubled sleep. In the house there is a commotion and rifle shots are heard. Bagram is beside himself.
Timur parks the truck next to the old man's house, asks Shirin to wait for him, and then runs indoors. He explains to the old man that he has met a woman who has no equal anywhere in the world. However, they cannot remain in this area and so they are leaving. He squats down next to the old man.
"Forgive me, for wishing for your death in my heart...When you meet them, tell them I love them....I love them very much!
Timur runs out of the old man's house. Bagram and his friends are waiting for him by the truck.
"And what about our agreement? Let Shirin go," says Bagram.
"I won't divorce her," responds Timur.
"I'll show you whose she is," shouts Bagram and hurls himself at Timur and they begin to fight. They roll around in the dust, snarling at each other like angry wolves.
Shirin sees and hears this ugly struggle between these two men through the cab window, and terrified, she covers her ears with her palms. When Timur and Bagram roll down into the river, Shirin gets out of the cab unnoticed and runs off, her eyes full of tears.
Timur clambers out onto the bank and walks to his truck, whose cab is deserted. He notices Bagram's car disappearing into the distance, jumps into the truck and tears after it.
Shirin walks past the depot, stops and thinks for a moment.
She asks Sabina where she can find Rustik, and Sabina looks at her attentively.
"And now for you, my dear ..." She drags Shirin into the steam-filled kitchen intent on settling their differences. A frenzied Sabina offers Shirin the choice between having her eyes burned with vinegar or her face scalded with boiling water. A terrified Shirin does not how to respond, and naively she replies that if this makes her feel better, then she should decide herself.
"Have a drink with me?" Sabina asks her, to which Shirin replies that she would like some ... tea.
Timur hurtles into the village and overtakes Bagram's car on the market square and smashes straight into it. Gawking onlookers gather as steam pours out of both vehicles.
"Where is she?" shouts Timur.
"Who?" asks Bagram in turn, taken back by this question.
"Shirin!" responds Timur.
Both men are perplexed. At that moment Said comes up to Bagram, holding Rustik with his hands.
"Here you are ... we found him," he says.
Said asks Bagram what he should do with Rustik. Feed him to the dogs or perhaps pack him off to reform school?
Timur asks Said to let him go without harming him. Said asks defiantly to be allowed to show how nasty he can get. Timur bends down, picks up a stone and without a word flings it right at Said's forehead. Rustik wriggles out of his hands and runs to Timur. The crowd is literally paralyzed. Timur takes Rustik by the hand and they leave.
Bagram is the first to come to his senses. He grabs his rifle from the hands of somebody standing next to him and says that Timur is to be shot like a stray dog.
Timur and Rustik leave as the town's inhabitants look on in silence. Bagram slowly raises his rifle. The street empties; d shutters, doors and gates slam shut.
Suddenly a shot rings out. The bullet screeches as it smashes a rusty letterbox.
Timur pushes Rustik to one side and shouts at him to run. Another shot resounds, raising a cloud of dust. More shots fill the streets with thunder as the bullets fly past Timur, splintering fences. Without warning, the "Afghan Wind"(***) rises once more and shrouds Timur and Rustik in a thick covering of dust.
Bagram drops his rifle, and then smashes it against a near-by test-your-strength machine, which emits a jaunty Spanish tune.
Close to the depot, the wind drops as unexpectedly as it rose. Timur and Rustik emerge from the dispersing dust cloud, making their way along the curb.
"He's here with the boy ... go to them," says Sabina, nudging Shirin with her hand.
The figures of Timur, Shirin and Rustik grow fainter in the mountainous distance.
"A safe journey," whispers Sabina as she watches them fade from view.

Sjävklart finns det alternativa tillvägagångssätt och mer raffinerade lösningar, men vi håller oss här till de grundläggande stegen i ett tänkt utvecklingsarbete - att skapa en skala avsedd att mäta ”Pålitlighet”. På detta sätt presenteras de vanligaste psykometriska begreppen.
Det första steget är att definiera vad man avser med begreppet ”Pålitlighet” och utifrån detta konstruera item som man kan koppla till definitionen. Psychometric concepts
The use of psychometrics is essential in constructing a psychological test, and the following is a highly condensed account of how one such imaginary test is constructed, with a schematic view of the problems that will be encountered and must be solved in its development. Obviously, alternative approaches and more sophisticated solutions do exist, but we will confine ourselves to the fundamental steps in a conceivable development project intended to devise a scale to measure "Reliability", which will provide an introduction to the most common psychometric concepts.
The first step is to define the meaning of the concept "Reliability" and from there proceed to construct items linked to this definition. In this instance, the scale develops from a theoretical framework based on previous research. It is also necessary to consider and decide how a test subject should respond to any one item, for example, on a dichotomous scale with typical responses such as true/false or agree/disagree. Alternatively, the test subject may have to decide to what degree they concur with an item on for example, a five-level Likert scale. Scale construction determines the statistical methods that can be employed to describe and analyse the test results. The optimum procedure is to construct more items than will be included in the definitive version, so as not to restrict any modification of the scale during its development. Let us now assume that we have a number of items that are considered to reflect "Reliability", the quality that is to be assessed.
A smaller-scale pilot study is undertaken to collect data, and it is important to keep in mind the context in which the test is to be employed, and the categories within which information relating to its utility is to be collected. We must ask ourselves whether, in this respect, medical students and shop assistants are suitable categories and what advantages and disadvantages these respective categories confer. Another consideration is that important background factors such as gender, age and educational level may affect the test results and must therefore be ascertained at this early construction stage. This will allow us to examine the connections between the results on the scale and these variables.

Согласно данным ВЦИОМ, сегодня Интернетом пользуется 38% россиян (то есть более 50 млн. человек), причем 23% — ежедневно. Конечно, по этим показателям Россия заметно отстает от Соединенных Штатов, но столь существенный сегмент общественной и экономической жизни уже нельзя не принимать в расчет. Свой взор на него обратили власти — чего стоит лишь тот факт, что президент Алексей Медведев завел себе аккаунт в Живом Журнале. Однако это лишь первые шаги — Сеть пока остается для России terra incognita, в которой действуют свои законы и правила, и прежде всего это касается распространения авторского контента. Очень долгое время обладатели легальных прав боялись подступиться к Интернету, и их место быстро заняли пираты. Именно благодаря этому Россия снискала славу мирового лидера по нарушению авторских прав. Однако сегодня становится очевидным тектонический сдвиг, произошедший в сознании правообладателей в этой области (то есть поменялось их отношение к Интернету). Начинается их активное наступление на русский Интернет — и многие верят, что 2010 год станет переломным.
ПИРАТСКИЙ ЗАХВАТ
Интернет — уникальная структура, развитие которой происходит практически бесконтрольно и вне рамок существующих оффлайн-правил. Если по проникновению Интернета Россия была и пока остается позади США и Европы, то для распространения передовых технологий внутри Сети не существует никаких препятствий — а значит, в России работают все те же продвинутые программы, позволяющие «пиратить», загружать и распространять контент. На фоне явного дефицита юридических норм, регулирующих онлайн-деятельность, и пренебрежения возможностями Сети, которое выказывали правообладатели, это означало полный захват Рунета (Runet = Russian Internet) пиратами. В 2009 году объем российского интернет-рынка пиратских фильмов составил $220 млн. Картины широкого проката попадают в Сеть в среднем через 4 дня после релиза, ограниченного — через 12 дней. При этом широкий прокат теряет 4,42% аудитории, ограниченный же — 62,6%. Так, ЛЕДНИКОВЫЙ ПЕРИОД 3, лидер российского проката 2009 года, был загружен в торрент-сети через 1 день после релиза и скачан 408 000 раз. Многие сочли, что 3D станет достойным ответом проблеме нелегального распространения — однако вряд ли новый формат надолго остановит пиратов: ведь скоро 3D придет в home entertainment, а значит, не за горами техническое решение, которое позволит скопировать и стереоизображение. Похожая история уже произошла с Blu-ray, на который возлагали надежды правообладатели: не помог и большой объем информации, записываемой на диск, — сегодняшние технологии позволяют спокойно загружать и такие объемы.
Среди тех, кого принято называть «пиратами», четко выделяются две категории: сайты, продающие контрафактный контент за деньги, и децентрализованные пиринговые сети или закрытые сообщества, основанные на бескорыстном обмене. На российских сайтах вроде InTV.ru, Onlyfilms.ru и других можно скачать или посмотреть фильм, заплатив в среднем 136 руб. (при цене билета 270 руб. и DVD – 300 руб.). Но если вина первой категории пиратов очевидна и с юридической, и с моральной точки зрения, то куда больший вопрос с юридической точки зрения вызывают пиринговые сети. Торрент-сайты (Torrents.ru, Nnm-club.ru, Kinokopilka.ru, Fast-torrent.ru) стали притчей во языцех (что-то, о чем все говорят, обсуждают, передают из уст в уста) — ведь «пиратом» может стать практически каждый пользователь, не видя в своем поступке ничего зазорного. Бороться с торрентами оказалось крайне сложно — в силу комплекса причин этического, юридического, технического, экономического характера.
БИТВА ЗА СЕТЬ
В первую очередь правообладателям крайне сложно создать негативный образ торрент-пользователя: ведь торрент-трекеры построены на альтруистическом принципе обмена. Более того, крупнейший сайт Torrents.ru с готовностью идет навстречу правообладателям и убирает ссылки по их просьбе, а некоторым распространителям программного обеспечения даже предоставил административный доступ с целью поиска ссылок на нелегальный контент. В начале этого года власти попытались закрыть Torrents.ru — но менее чем через сутки он заработал на другом домене, по другому адресу. Более того, действия властей вызвали бурю недовольства в Сети (не в последнюю очередь из-за сомнительного правового обоснования). «Союзников у пиратов не убавилось, а возможно, стало даже больше, — считает Иван Кудрявцев, ведущий телевизионной программы «Индустрия кино». — Людям показывают, что услугу можно запретить, но не говорят, куда обращаться за легальным аналогом».
На этой волне широкую паблисити получила Пиратская партия России (ППР), недавно созданная по образцу подобных зарубежных движений, участвующих в глобальном «Пиратском Интернационале». ППР пока не имеет таких рычагов влияния, как, например, Пиратская партия Швеции, однако менее чем за год сфера ее действий распространилась на 24 из 89 регионов России. Партия амбициозно заявляет о намерении превратиться в полноценного субъекта политики и ставит целью адаптацию законодательства для того, чтобы оно максимально соответствовало потребностям интернет-сообщества и описывало существующую практику взаимодействия автора и потребителя. ППР заняла позицию, которая явно должна импонировать обычному пользователю: «К контрафактному пиратству, когда украденный авторский продукт продается за деньги, наше движение не имеет никакого отношения, — говорят в партии. — Наш принцип прост: пользователь должен быть неприкосновенен. Мы стоим на защите прав личности». При этом пираты активно клеймят правообладателей, наживающихся, по их мнению, и на авторах, и на потребителях — не принимая во внимание тот факт, что без этого звена существование кинематографа невозможно.
Тем временем представитель государственного предприятия «Информзащита» Михаил Чупов полагает, что ситуация в сфере правовой борьбы в России идет на поправку: в 2009 году заведено около 400 уголовных дел в области нарушения авторских прав, а в милиции созданы отделения, специализирующиеся на преступлениях в Интернете. Закрытием Torrents.ru московская милиция объявила войну торрентам и файлообменным сайтам, борьба с которыми вошла в число главных задач отдела по экономической безопасности. Но параллельно растут сомнения в обоснованности и эффективности подобных действий.
В случае с торрентами самое уязвимое место «милицейской» борьбы – тот факт, что она не опирается на внятные юридические аргументы. Как с юридической, так и с технической точки зрения сложно доказать нарушение прав, если скачивание происходит через торренты. Во-первых, выкладываемый торрент-файл не содержит собственно фильма, а значит, его нельзя трактовать как нелегальный контент. Во-вторых, технически трудно доказать, что пользователь отдает весь файл — ведь он передает только часть. Порой предотвратить распространение файла в пиринговой сети невозможно просто физически — нельзя выключить все компьютеры, на которых лежит контент: а он может находится на сотнях тысяч жестких дисков по всему миру. Зачастую торренты находятся за пределами юрисдикции отдельной страны, и их создатели тоже могут находится за рубежом. Более того, технологиям всегда удается опережать право. «Юридический мир живет месяцами, интернет-мир — часами», — говорит Михаил Чупов. Это подтверждают и пираты, полагающие, что на любое давление найдется способ технологического противодействия. Пример тому — переход американского сайта Thepiratebay.org на магнитные ссылки.
Уровень подготовки юристов по-прежнему недостаточен для поддержки антипиратской кампании. По словам Павла Каткова (компания «Система Масс-медиа»), нотариусы зачастую просто не знают, как обращаться с документами, связанными с доказательной базой. Другая проблема — отсутствие громких прецедентов, которые бы лишили пиратство ореола безнаказанности. «Для развития легального рынка можно максимально усложнять жизнь распространителям нелегального контента, просто как конкурентам, — предлагает Иван Кудрявцев. — Можно создать несколько прецедентов, оштрафовав на крупные суммы, например, тех, кто раздает фильмы, — отследить их не сложно. А потом нужно рассказать об этом максимально широкой аудитории».
Не секрет, что попытки засудить пользователей пиринговых сетей осуществляются по всему миру, но они лишь свидетельствуют о бессилии правообладателей и вряд ли положительно сказываются на их отношениях с потребителями.
Много вопросов возникает и по поводу жестокости предлагаемых мер. Юрист Лейла Нейман заметила: «Почему все обращаются к уголовному праву, а не пытаются действовать в рамках гражданского? Существует возможность разделегировать домен, есть реальная возможность убирать пиратские ссылки из поисковиков. Домен можно приостановить еще на уровне обеспечения иска». Недавно фиаско потерпела другая попытка органов явить показательный пример борьбы за авторские права. Учитель Александр Поносов, привлеченный к уголовной ответственности за то, что на школьных компьютерах были установлены нелицензионные копии Windows и Microsoft Office, в конце концов был полностью оправдан и добился извинений со стороны государства и возмещения морального ущерба. Громкий инцидент продемонстрировал несовершенство законодательства об авторском праве и очевидную враждебность общества по отношению к подобным попыткам.
РЕНЕСАНС НАЧИНАЕТСЯ
Вплоть до совсем недавнего времени российские дистрибьюторы держались в стороне от Сети и предпочитали не рассматривать Интернет в качестве площадки для проката своего контента, но в последнее время ситуация изменилась. Еще недавно западные студии не очень понимали, в каком направлении развивается российский Интернет, каковы его объемы и насколько выгодно продавать фильмы на русских сайтах. «Выкладывая за три копейки контент в России, мы получали те же три копейки и в Америке», — привел свои возражения Филипп Курпеков, представитель Sony Pictures Home Entertainment. Некоторые мейджоры вроде Sony и Universal по-прежнему не готовы отдать предпочтение Интернету — кинопрокат и продажи физических носителей все еще составляют львиную долю их доходов, несмотря на падение продаж DVD. Как утверждает Инга Ковалевская (сайт Omlet.ru), не видят необходимости выкладывать свои фильмы в Сеть и многие российские продюсеры: за российские фильмы порой запрашивают цены, на порядок превышающие стоимость западных, ожидая доходов, сопоставимых с рынком кинопроката. В России нет и отработанной схемы продаж фильмов, подобной западной: нет каталогов, а потому права на фильмы порой приходится просить у каждого конкретного продюсера.
Однако изменения в отношениях дистрибьюторов и интернет-площадок уже происходят. Первым сигналом стало заключенное в апреле соглашение между самым популярным из существующих на сегодняшний день сайтов по продаже легального контента Omlet.ru и Walt Disney CIS: теперь фильмы и сериалы из каталога мейджора (включая ПИРАТЫ КАРИБСКОГО МОРЯ, СУРРОГАТЫ, СОКРОВИЩЕ НАЦИИ) можно взять на сайте напрокат (75-60 руб) или приобрести легально (100-150 руб) в цифровом виде. Более того, фильмы будут доступны онлайн одновременно с выходом в России на DVD. Disney оказалась пионером среди мейджоров — и есть надежда, что это соглашение запустит цепную реакцию.
Немало перспектив и у сайтов, предлагающих демонстрировать контент бесплатно, но с рекламой — как, например, Ivi.ru, созданный по образцу американского Hulu.com. Он предлагает востребованную услугу: посещаемость ресурса растёт и несколько крупных поставщиков уже согласились размещать своё кино, сериалы и телепрограммы на этой площадке. Например, совсем недавно потенциал Ivi.ru
Потенциал сайта оценил один из крупнейших российских телеканалов России — «Первый», который заключил соглашение о предоставлении Ivi.ru прав на онлайн-демонстрацию своего контента (в том числе на такие популярные фильмы, как «Ночной Дозор» и «Дневной Дозор», произведенные при участии канала). Участники сделки будут делить доходы от рекламы. Вполне возможно, что «Первый канал» поучаствует в информационной поддержке сайта Ivi.ru, что практически является гарантом его того, что о его существовании узнают практически все пользователи и не-пользователи Интернета.
Открываются и другие ресурсы, работающие по «рекламной» схеме: активно собирает библиотеку прав только что созданный TVzavr.ru. В его планах — и сотрудничество с западными мейджорами, которые, как рассчитывают владельцы сайта, смогут предоставить англоязычный контент.
Не отстают и артхаусные дистрибьюторы, страдающие от пиратства куда сильнее, чем мейджоры. Недавно о намерении выкладывать легальный контент на своем справочно-информационном портале Arthouse.ru объявила компания «Кино без границ», библиотека которой насчитывает около 700 фильмов — в том числе картин Питера Гринуэя, Акиры Куросавы, Фатиха Акина, Френсиса Форда Копполы, Жака Одиара, Михаэля Ханеке и многих других режиссеров.
Еще одна знаменательная инициатива принадлежит Гильдии кинопродюсеров России. Эта Ассоциация в целях борьбы с пиратством разрабатывает «Национальный портал российского кино», который предоставит легальный доступ к российским картинам и сериалам. По заверениям Гильдии, проект находится на последней стадии подготовки. Он позволит собрать в одном месте картины локального производства и, вероятно, облегчит возможность их приобретения более крупными интернет-площадками.
Не будем скрывать: российский интернет-рынок, особенно по сравнению с американским, еще слишком молод, чтобы хвастаться особыми достижениями в этой области. Но если еще пять лет назад мы даже не мыслили о продаже/покупке фильмов в Интернете – то теперь можно с уверенностью сказать: это происходит, и с каждым месяцем будет происходит все больше, и что самое важное для рынка – все легальнее. Многие стали замечать, что российские пользователи стали более требовательны и взыскательнее к тому, что и в каком качестве они смотрят. Им уже неохота скачивать непонятно какие файлы на торрентах, тратить на это время, где-то их искать – им проще заплатить небольшие деньги, но получить за эти деньги определенный сервис. Это называется культура, и Интернет-культура имеет свойство распространяться довольно быстро – к счастью, новые технологии уже не требуют не требуют строительства кинотеатров, музеев и библиотек в самых отдаленных уголках планеты. The official view of the Internet is clear as can be seen from the fact that Russia’s president, Aleksey Medvedev has his own blog on the LiveJournal site. However, these are just preliminary stages, and for Russia the Net remains terra incognita, an unknown country, governed by its own laws and rules, which is true, above all, in the area of the distribution of copyright content. For a very long time, the owners of legal rights were wary of the Internet, and the pirates quickly took their place, which resulted in Russia acquiring the reputation of being a world leader in the field of copyright infringement. Today, the tectonic shift that has taken place in the mind of the rights holders in this field is becoming obvious. They are beginning to establish themselves on the Internet in Russia, and it is widely believed that a breakthrough will occur in 2010.
CAPTURED BY PIRATES
The Internet is a unique structure that is developing in a virtually uncontrolled manner outside the framework of existing off-line regulation. Although, in terms of Internet penetration, Russia still remains behind the USA and Europe, there are no obstacles to the spread of advanced technologies within the Net, which means that in Russia all the same advanced software is in use that makes piracy possible along with the uploading and distribution of content. Given the obvious lack of legal norms regulating on-line operations and the rights holders’ failure to make use of the potential of the Net, the pirates have mounted a total takeover in Russia. In 2009, the volume of the Russian Internet market for pirated movies totaled $220,000,000. Wide distribution movies turn up on the Net on average four days after release, while their limited release counterparts suffer the same fate after twelve days. The audience loss that this causes is 4.4% in wide distribution and 62.6% in limited distribution. ICE AGE 3, the number 1 movie release in Russia in 2009, was uploaded to bit torrent networks one day after release and was downloaded 408,000 times. It was widely held that 3D would be an effective response to the problem of illegal distribution, but there is hardly any new format that can stop the pirates for long. Soon 3D will be available in home entertainment, and this means that a technical solution is not far off that will allow even stereo images to be copied. A similar fate has already befallen Blu-ray, on which rights holders had pinned their hopes, but the large volume of information recorded on the disc was no deterrent as modern technology allows even such volumes to be easily uploaded.
Two distinct categories are to be found among those to whom the term “pirates” is conventionally applied: sites selling counterfeit content, and decentralized peer-to-peer sites or closed non-profit communities. On Russian sites such as InTV.ru, Onlyfilms.ru and many others a movie can be viewed or downloaded at an average cost of 136 rubles, while a ticket costs 270 rubles and a DVD, 300 rubles. However, if the pirates in the first category are clearly guilty in legal and moral terms, the legality of peer-to-peer sites is far more problematical. Torrent sites (Torrents.ru, Nnm-club.ru, Kinokopilka.ru, Fast-torrent.ru, etc.) have become a hot topic. Virtually any user can become a “pirate” who sees nothing shameful in his or her actions.
Combating torrent sites has proved extremely involved, by reason of a combination of factors of an ethical, legal, technological and financial nature.
THE BATTLE FOR THE NET
In the first instance, it is extremely difficult for the rights holders to create a negative image of the torrent user, as torrent trackers are based on the altruistic principle of exchange. Furthermore, the largest site, Torrents.ru, readily submits to the rights holders’ requests to remove sites, while it has even allowed several distributors of program protection software administrative access for the purpose of looking for links to illegal content. At the beginning of 2010, the authorities attempted to close Torrents.ru, but less than twenty-four hours later it had started up again on a different domain and at a different address. Furthermore, the authorities’ actions provoked a storm of discontent on the Net (not least on account of their doubtful legality). The pirates’ “allies” have not grown fewer and have perhaps even increased in numbers according to Ivan Kudryaev, who hosts the TV program “Movie Industry”. “People are shown that a service can be prohibited but are not told where they can obtain the legal equivalent”.
This action gained widespread publicity for the Pirate Party of Russia (PPR), recently founded on the model of similar overseas movements that belong to the PP International collective. So far, PPR has not attained the same level of influence as, for example, the Swedish Pirate Party, but in less than a year its sphere of action has expanded from twenty-four to eighty-nine Russian regions. The party ambitiously declares its intention of becoming a fully fledged political body, and has set itself the goal of adapting legislation so that it fully corresponds to the needs of an Internet society and prescribes the existing practice of interaction between the copyright holder and the consumer. The PPR has adopted a position that should undoubtedly impress the ordinary user, as the party states that “its movement will have nothing at all to do with piracy involving counterfeiting, when a stolen copyright product is sold for financial gain. Our principle is a simple one: that the user should be legally immune and we stand on the protection of the rights of the individual”. In this respect, the pirates brand the rights holders as, in their opinion, profiteering from the copyright holders and the consumers but the former neglect the fact that the existence of a movie industry would be impossible without this link.
Meanwhile, Mikhail Chupov, a representative of the state company “Informzashchita” (which deals with information protection), considers that the situation in the field of rights enforcement in Russia is improving. In 2009, around four hundred criminal cases were brought that involved copyright infringements, while the police have organized units that specialize in Internet crime. In closing Torrents.ru the Moscow police declared war against torrent and file-swapping sites, and this struggle was one of the main tasks of the department for financial security, but there are growing doubts about the grounds for such actions and their effectiveness.
In the case involving the torrents sites, the most vulnerable aspect of this police action is the fact that it is not supported by clear legal arguments. From both a legal and a technical perspective, it is difficult to prove any infringement of rights if downloads involve the use of torrents. Firstly, the uploaded torrent file does not actually contain a movie, and thus it cannot be considered as illegal content. Secondly, it is technically difficult to prove that the user is transmitting the entire file, as he is only relaying part of it. At times it is physically impossible to prevent the file being distributed within a peer-to-peer network and it is impossible to switch off all the computers on which content is stored, as this may be done on hundreds of thousands of hard disks all over the world. Torrents may often be located beyond the limits of the jurisdiction of any one single country, while their creators may also be living abroad. Furthermore, technology always manages to outpace the law. “Legal matters take months, while the Internet responds in a matter of hours,” says Mikhail Chupov. This view is confirmed by the pirates who consider that technological countermeasures can be found to respond to any pressure. One example of this is when the American site Thepiratebay.org switched to magnet links.
Lawyers remain inadequately prepared to provide support for an anti-piracy campaign. In the words of Pavel Katkov (from the Sistema Mass-Media company) notaries public often do not know how to deal with documents that are associated with the evidentiary base. Another problem is the absence of weighty precedents that would deprive the pirates of their aura of impunity. “To develop a legal market, it is possible to cause the maximum disruption to distributors of illegal content simply in their capacity as competitors,” proposes Ivan Kudryavtsev. “Several precedents could be established imposing heavy fines on, for example, those who distribute movies, and tracking them is not hard, and then this has to be brought to the attention of the widest possible audience.”
It is no secret that attempts to convict users of peer-to-peer sites are being undertaken all over the world, but they only testify to the impotence of the rights holders and hardly have a positive effect on their relations with the consumers.
Many questions are being raised with regard to the severity of the proposed measures. Lawyer Leila Neiman remarked “as to why everyone seems to be resorting to criminal law and not attempting to proceed under civil law. Domain names can be de-registered and it is actually possible to remove pirate links from search engines. Domains can be halted while still at the level of search protection”. Recently, the second attempt by the authorities to demonstrate a shining example of the struggle to protect copyright ended in a fiasco. Teacher Aleksandr Ponosov was put on trial because unlicensed copies of Windows and Microsoft Office had been installed on school computers. He was eventually completely vindicated and received an apology from the government as well as compensation for the damage to his reputation. This weighty precedent demonstrated the shortcomings of copyright legislation and also the manifest public hostility to similar actions.
BEGINNINGS OF A REVIVAL
Until quite recently, distributors kept their distance from the Internet and preferred to not look upon it as distribution platform for their content, but lately the situation has changed. In addition Western studios had very little understanding of the direction that the Internet is taking in Russia, the volumes involved, and the degree to which it is profitable to sell content on Russian sites. “Having offered their kopeks worth of content in Russia, we got back the same sum in the USA,” was the objection voiced by Filipp Kupekov, the president of Sony Pictures Home Entertainment. Several of the majors, such as Sony and Universal, remained unwilling to favor the Internet, and theatrical distribution and the sale of physical media still provide the lion’s share of their earnings, despite the fall in DVD sales. As Inga Kovalevskaya (of the site Omlet.ru) confirms, many Russian producers also do not see the necessity of putting their movies on the Internet, and at times they demand prices for Russian movies that considerably exceed the cost of Western product, and they expect revenues comparable with those generated by theatrical distribution. Russia does not have an organized movie sales system similar to that in the West; there are no catalogues, for which reason at times questions about movie rights have to be addressed to every individual producer.
However, changes in the relationships between distributors and Internet platforms are already happening. The first hint of this was the conclusion of an agreement between the most popular of the existing sites for the sale of legal content, Omlet.ru, and Walt Disney CIS. Movies and series from this major’s catalogue, including PIRATES OF THE CARIBBEAN, SURROGATES and NATIONAL TREASURE, can be rented on a site for between sixty and seventy-five rubles, or acquired legally in a digital form for between one hundred and one hundred and fifty rubles. Furthermore, movies will be available on line simultaneously with their Russian DVD release. Disney has shown itself to be a pioneer among the majors, and it is hoped that this agreement will trigger a chain reaction.
There are significant prospects for sites that offer to show content free of charge but with advertising, such as, for example, Ivi.ru, based on the model of the American site Hulu.com. It offers a service that is in demand; the number of hits on this resource is growing, and several major suppliers have already agreed to put their movies, series and TV programs on this platform.
The site’s potential was assessed by the First Channel, one of Russia’s largest TV broadcasters, which concluded an agreement on granting Ivi.ru rights to show its content on line (including such popular moves as NIGHT WATCH and DAY WATCH, in the production of which this channel took part. The parties to this deal will share advertising revenues, and it is conceivable that the First Channel will participate in information support for the Ivi.ru site, which, in practical terms, means that it will guarantee that the existence of the site will be known to both users and non-users of the Internet.
Other resources are opening that will operate on an advertising basis, and the Tvzavr.ru site, which has only just been set up, is actively building a rights library. Its plans include co-operation with Western majors on whom the site’s owners are counting to provide English-language content.
The arthouse distributors, who suffer more severely from piracy than the majors do, are not lagging behind. The Cinema Without Frontiers company recently made public its intention to put legal content on its enquiry and information portal Arthouse.ru, which will come from its library of around seven hundred movies that include work by Peter Greenaway, Akira Kurosawa, Fatih Akin, Francis Ford Coppola, Jacques Odiar, Michael Haneke and many other directors.
Another momentous initiative comes from the Guild of Russian Movie Producers. As a means of combating piracy, this Association is developing its National Portal of Russian Cinema, which will provide legal access to Russian movies and series. According to assurances from the Guild, this project is in its final stage of preparation. It will make it possible to bring together on a single site locally produced movies, and it will probably facilitate their acquisition by the larger Internet platforms.
We will not conceal the fact that the Russian Internet market, especially in comparison with that in the USA, is still too immature to boast any outstanding achievements in this field. However, given that five years ago nobody had even dreamt of selling or buying movies on the Internet, it is now possible to state with conviction that this is happening, and to an ever-increasing degree every month, and that the most important thing for this market is that this is being done in an increasingly legal fashion. Many people have begun to notice that Russian users have become more demanding and discerning with respect to what they watch and its quality. They are loath to download who knows what files from torrent sites and spend time looking for where to find them. They would rather pay a small sum of money in return for a specific service. This is what is termed culture, and Internet culture spreads quite rapidly. Happily, new technologies do not require the construction of movie theaters, museums and libraries in the remotest corners of the globe. All that is required is to open an Internet café.

Jag vill och måste, det är alltsammans. Allt mer och mer obönhörligt frågar man efter avsikten och planmässigheten i vad som göres och säges, så att helst inte ett ord ska falla på måfå - det är bara författaren till den här boken som har tvingats gå motsatta vägen, ut i det ändamålslösa. Ty fast mina år här som fånge och kemist - de måste vara över tjugu, tänker jag mig - har varit fulla nog ändå av arbete och brådska, måste det finnas något som inte tycker det är tillräckligt och som har lett och överblickat ett annat arbete inom mig, ett som jag själv inte hade någon möjlighet att överblicka och där jag ändå har varit djupt och nästan plågsamt medintresserad. Many people would surely consider the account that I am now about to write a pointless venture, even if I dare to believe that “many” would ever be permitted to read it, as I embark on this task entirely on my own initiative and at nobody’s command and yet I remain somewhat uncertain of my true intention. It is simply my own desire and compulsion that drive me. There is a growing and ever more implacable demand for every word and every action to result from intention and planning lest even a single utterance happen spontaneously, while I, the author, am the only one to follow an opposite path towards no fixed destination. Although my time as a prisoner and a chemist, which, it seems, must amount to more than twenty years, has been busy and frantic enough, there must be some part of me that feels that this is insufficient. It has guided and conceived within me another project, one that I myself was unable to envisage, but to which I was deeply and almost painfully committed. When my account is complete, this project will come to an end. Hence I realize how irrational my writing must seem to a rational and practical mind but I press on regardless. |
