L’art. 595 comma 1° cod. pen. statuisce che “Chiunque comunicando con più persone offende l’altrui reputazione, è punito con la reclusione fino a un anno o con la multa fino a euro 1.032”, mentre al comma 2° e 3° si prevedono quali possibili aggravanti, rispettivamente, l’attribuzione di un fatto determinato nonché l’utilizzo della stampa o di qualsiasi altro mezzo di pubblicità utilizzato al fine di porre in essere la condotta diffamatoria. Nel caso di specie il mezzo utilizzato ai fini volutamente diffamatori è assimilabile alla stampa, tanto che la Suprema Corte ha già avuto modo di statuire “la diffamazione tramite internet costituisce un’ipotesi di diffamazione aggravata ai sensi dell’art.595, comma 3, c.p., in quanto commessa con altro (rispetto alla stampa) mezzo di pubblicità. (Cass. Penale, 1° luglio 2008, n.31392, in “Guida al diritto”, 2008, 40, 87; Tribunale Milano, 16 novembre 2005, in “Foro ambrosiano”, 2005, 4, 419).
| Translation - English 1. Internet Defamation
Art. 595 clause 1 of the Italian Penal Code decrees that “Whoever harms the reputation of another in communications with a number of people is to be punished by up to one year of imprisonment or a fine of up to 1,032 euros”, whilst clauses 2 and 3 set out, respectively, the aggravants of: the attribution of a particular deed and the use of the press or any other form of publicity to bring defamatory material into being. In the case in question, the means used for willful defamation can be assimilated to the press, so much so that the Italian Supreme Court has already been able to stipulate that “defamation through the internet constitutes a hypothesis of aggravated defamation, pursuant to art.595, clause 3, of the Penal Code, in that it is committed using a means of publicity other than the press.'' (Penal Division of the Court of Cassation, 1 July 2008, n.31392, in “Guida al diritto”, 2008, 40, 87; Court of Milan, 16 November 2005, in “Foro ambrosiano”, 2005, 4, 419).

I have returned to England to pursue a freelance career as I continue my studies. I will be taking the Diploma in Translation exam in January 2010.
