Diffamazione a mezzo internet
L’art. (Cass. Penale, 1° luglio 2008, n.31392, in “Guida al diritto”, 2008, 40, 87; Tribunale Milano, 16 novembre 2005, in “Foro ambrosiano”, 2005, 4, 419).
| Translation - English 1. Internet Defamation
Art. 595(1) of the Italian Criminal Code states that “Whosoever harms the reputation of another in communications with a number of people is punishable by up to one year of imprisonment or a fine of up to €1,032”, whilst paragraphs 2 and 3 set out, respectively, the aggravating factors of: the attribution of a particular deed, and the use of the press or any other form of publicity to bring defamatory material into being. In the case in question, the means used for willful defamation can be assimilated to the press, so much so that the Italian Supreme Court has already been able to decree that “defamation through the internet constitutes a hypothesis of aggravated defamation, pursuant to art.595(3) of the Criminal Code, in that it is committed using a means of publicity other than the press.'' (Criminal Division of the Court of Cassation, 1 July 2008, n.31392, in “Guida al diritto”, 2008, 40, 87; Court of Milan, 16 November 2005, in “Foro ambrosiano”, 2005, 4, 419).
